Report of the S ix th Com m ittee to the Assembly

Rapporteur : His Excellency M. A. L o u d o n ( Netherlands).

The Assembly lias referred the question of in te rnational assistance to refugees to the Sixth Committee.

The Sixth Committee has set o u t the resul ts of ils discussions in the following five draft resolutions and in the brief remarks th a t precede them.

1. In accordance with the Assembly resolutions on the question, the Office of the High Commissioner for Refugees coming from Germany and the Nansen International Office for Refugees are to lie discontinued as from December :il sl, I 938.

The Nansen Office is legally empowered to wind itself up. and has sole responsibility for the measures to be taken for tha t purpose. In accordance with custom. I he Governing Body of the Office will doubtless appoin t one or more liquidators d uly qualified to ac t afte r th e dissolution of the Office.

The High Commissioner, whom it is proposed to appoint under Resolution No. I below, represents a new appoin tm ent entirely independent of the institutions which are to be discontinued a t the end of this year. In particular, he is not the legal successor of those institutions. He may accept any sums in cash offered to hint by th e Nansen Office ; blit ho will have no power to agree to the transfer to him of all or p a r t of the Office’s liabilities

■>. Paragraph 1 of resolution No. 1 provides t h a t the futu re H igh Commissioner shall deal with refugees hitherto coming under the Nansen Office and the Office of the High Commissioner for Refugees coming from Germany.

The la t te r was empowered by a resolution of the Council of the League of Nations, da ted May 14th, 1038, " t o inte rpre t his m andate as apply ing to refugees coming from Austria, unti l a final decision on lhe subject lias liven ta ken by the Assembly ai its next session

If it approves this report, the Assembly will at the same tim e be confirming the above Council resolution, so tha t both the m andate of the High Commissioner for Refugees coming from Germany and th a t of the futu re High Commissioner will have to be in te rpre te d as covering the refugees referred to in the said resolution of May 11 ill, 1938.

3. In Pa ragraph 1 of the aforesaid resolution No. 1, i t is provided th a t the future High Commissioner shall main ta in such contac t as m ay seem necessary with the Inte rgovernmenta l Committee in London.

Here it should be poin ted out tha t the resolution adopted by the ln lc rgovernniynta l Committee at Kviaii un .1 ni> 1 !iii, nic alv.l to ;i:e Lea; .1lô th (document C.L'M.M.113.1938.XU), was further elucidated a t a meet ing of the Committee in London on August 1th. 1938. li turn appears t liat I In League of Nations High Commissioner will be invited to lie represented at the meetings of the Com mittee at which quest ions concerning the admission of involuntary emigrants into countries of refuge and sett lement, and questions concerning the work of the private organisations, are under discussion.

I. I t is provided in paragraph 0 of resolution No. 1 th a t the High Commissioner shall be assisted by a D eputy High Commissioner and a small staff.

It may here be suggested th a t the organisation might be somewhat as follows : Deputy High Commissioner; I wo secretaries ; four shorthaud-lypists ; one officc-keeper.

5. The annual League g ran t, to which the League's financial assistance to the High( 'ommissioiier is limited for I hv current year , covers i hi' salaries of t he l)eptll.\ High Commissioner, sta ff and foreign representa tives, together with all the High Commissioner's

ro ther expenses, such as travelling expenses, ren t and office expenses. I t also cox expenses as may he occasioned by representa tion abroad.

I t will be seen from paragraph 2 of resolution No. 2 th a t the am o u n t of t for the year 1930 is 22-1,500 Swiss francs. In future, the High Commissioner wil his proposals to the Assembly in regard to the annual League g ran t.

The N ansen Office and the High Commissioner for Refugees coming from Germany will doubtless give the fu ture H igh Commissioner every a ssistance in the ir power d uring I bis transitional period.

“ The Assembly,

“ H aving regard to its previous resolutions under which th e N ansen In ternational Office for Refugees and the Office o f th e H igh Commissioner fo r Refugees coming from Germany a re to bo discontinued as from Decem ber 31st, 1938 ;

“ A dopts the following arrangem ents :

“ 1. A High Commissioner of the League of N ations shall bo c onstitu ted to deal with refugees hitherto coming under the N ansen In terna tiona l Office and the Office of th e High Commissioner for Refugees coming f rom Germany.

“ 2. The High Commissioner’s duties will be as follows :" (a ) To provide for the political and legal p rotection of refugees, as en trusted

to the regular organs of the League by paragraph 3 of the Assembly’s decision of September 30th, 1030 ;

“ (b ) To superintend the en try in to force and the application of the legal sta tu s of refugees, as defined more particu larly in the Conventions of O ctober 28th, 1933, and February 10th, 1038 ;

“ (c) To fac ilitate the co-ordination of hum anita rian assistance ;“ ( d ) To assist the Governments and p r ivate organisations in the ir efforts

to prom ote em igration and pe rm anent settlem ent.

“ 3. The High ( shall repo rt to the Assembly annually on his

I t may in no case bo employed for the relief and se ttlem ent of refugees. I t shall be fixed by the Assembly year by

L’Assemblée a déféré à la six ième Commission la question de l ’assistance inte rnationale

La sixième Commission a formulé le résu l ta t de son examen dans les cinq projets de résolution ci-après e t dans les rem arques qui les précèdent.

1. Conformém ent aux résolutions de l’Assemblée concernant la question, le H au t Commissariat pour les réfugiés p rovenant d ’Allemagne e t l’Office in ternational Nansen p our les réfugiés cesseront le ur activité le 31 décembre 1938.

L’Office se trouve investi de la capacité ju ridique requise p our procéder à s a liquidation ; i l est exclusivement responsable des mesures à prendre à cet égard. S’inspirant de l’usage, le Conseil d’administration de l ’Office tiendra sans doute à nommer un ou plusieurs liquidateurs dûm en t habilités pour agir après la dissolution de l ’Office.

Le H au t Commissaire do n t l a nomination est prévue dans l a résolution X° 1 ci-après constitue une institution nouvelle, indépendante de celles qui cessent leu r activité à la fin de la présente année. N otam m ent, le H a u t Commissaire n ’est pas le successeur juridique de ces institutions. S’il peu t recevoir les sommes liquides que lui offrirait l’Office Xansen, il ne saura it accepter le tran s fe rt su r sa tê te de to u t ou pa rtie des obligations e t créances de l'Office.

li. L 'a linéa prem ier de la résolution X» 1 prévoit que le fu tu r H a u t Commissaire aura à s 'occuper des réfugiés relevant de l'Office Xansen e t du H aut Commissariat pour les réfugiés provenant d ’Allemagne. . .

Ce dernier av ait été autorisé par la résolution du Conseil de la Socié té des Nations du 14 niai 1938, >à in terpré ter son m a nd a t comme s'ap p liqu an t aux réfugiés provenant d ’A utriche jusqu 'il ce qu ’une décision défin itive soit prise à ce su je t p a r l’Assemblée a sa prochaine session ».

E n app ro uv an t le présent rapp o r t, l'Assemblée confirmerait ce tte résolution du Conseil, de sorte que t a n t le m andat du H a u t Commissaire pour les réfugiés provenant d’Allemagne que celui (lu fu tu r H au t Commissaire devra ient s’in te rp ré te r comme cou v ran t les réfugiés visés p a r ladite résolution du 11 mai 1938.

3. A l’alinéa -1 de la résolution N° 1 précitée, il e st prévu que le fu tu r H a u t Commissaire en tre tiendra les rapports utiles avec le Comité in tergouvem em ental de Londres.

Il convient à cet égard de rappeler que la résolution adoptée à Evian, le 1-1 ju illet 1938, pa r le ( 'limité in tergouvem em ental, résolution communiquée a la Socié té des Nations le 15 ju il let (document C.244.M.I 13.1938.X II) , a fait l’obje t d ’une précision lors d ’une réunion que le Comité a te nue à Londres le 4 ao û t 1938. Il en résulte que le H a u t Commissa ire de lu Société des Nations se ra invité il se faire représente r aux réunions d udit Comité au cours desquelles seraient discutées les questions rela tives il l’admission des émigrants involontaires dans les pays de refuge e t d ’établissement, ainsi qu e celles a yan t t r a i t il l’a c ti vité des organisations privées.

j 4. Il est prévu à l’alinéa U de la résolution X° I , que le Haut Commissaire sera assisté s d ’un H au t Commissaire a d jo in t e t d’un personnel restrein t .

Ou peut, à ce propos, préconiser, à titre indicatif, une organisation telle que la suivante: I H au t Commissaire adjoint ; deux secrétaires ; qua tre sténodactylographie ; un huissier.

5. La subvention annuelle de la Société des Nations, il laquelle se lim ite pour l’année en cours le concours financier prêté pa r la Société des Nations au Haut Commissaire, couvre la rémunération d u H aut Commissaire a d jo in t, du personnel, a insi que tous les autres

r frais administratifs du H a u t Commissaire, tels que les frais de voyage, de loyer e t de bureau.

Mlle couvre également les frais que pourra it occasionner la représentation à 1 é tranger.

Ainsi qu 'i l résulte de la résolution N° 2, alinéa 2, ladite subvention est, pour I année 1030, de 224.500 francs suisses. P our les années subséquentes, il appar tiend ra au H a u t Commissaire de soum ettre ses propositions à l’Assemblée q u a n t à la subvention annuelle de la Société.

6. E n tre la présente session de l ’Assemblée e t la d a te du l pr janv ier 1030, à laquelle commenceront les fonctions du fu tu r H au t Commissaire, il s’écoulera une période intermédiaire que ce dernier p ourra m e ttre il profit pour prendre les mesures utiles en vue de l’établissement de l’organisation nouvelle. Ce point fait l’obje t de la résolution N" 3. La somme qu ’il prévoit couvre la rém unération d u fu tu r H a u t Commissaire e t tous les frais auxquels il devra faire face pen dan t ce laps de temps.

L ’Office Nansen e t le H a u t Commissaire p our les réfugiés p rovenant d ’Allemagne voudront bien, au cours de cette période intermédiaire, fournir au fu tu r H a u t Commissa ire to u te l’assistance nécessaire.

Résolution N ° 1.

« L ’Assemblée,

u h) Veiller à la mise on vigueur e t il l’application du s ta tu t ju rid ique desréfugiés te l que l’o n t défini, no tam m ent, les Conventions du 28 octobre 1033 e tdu 10 février 1038 ;

n e ) Facilite r la coordination do l’œ uvre d ’assistance hum anita ire ; n il) Seconder les initiatives des gouvernements e t les initiatives privées

en ce qui concerne Immigration e t l’é tablissement définitif.

« 3. Le H au t Commissaire adresse chaque année à l’Assemblée un rap po r t sur

« 0. Le H a u t Commissaire nomme, pour l’assister, u n H a u t Commissaire adjo in t e t u n personnel restreint. Le H aut Commissaire ad jo in t n ’au ra pas la même nationalité que le H a u t Commissaire.

« L e H au t Commissaire consulte les gouvernements des p rincipaux pays de refuge sur la nécessité d ’y nommer des représentants. E n cas d ’avis favorable, il p ourra nommer dans ces pays des représentants agréés p a r ceux-ci.

« Ni les membres du d it personnel, ni lesdits représen tan ts ou les collaborateurs de ceux-ci ne p euvent ê tre réfugiés ou anciens réfugiés.

L a subvention do la Socié té des N ations est réservée aux dépenses adm inistratives du H au t Commissaire, y compris la rém unération du H a u t Commissaire a d jo in t, du personnel et, le cas échéant, des représentants. Elle ne se ra en aucun cas affectée au secours e t it l’établissement des réfugiés. Elle est fixée chaque année pa r l’Assemblée.

« 8. Le H au t Commissaire peu t accepter des fonds des gouvernem ents ou de source privée ; il pourra de m ême accepter les sommes quo lui offrirait l’Office in ternational Nansen pour les réfugiés.

" Sans pourvoir lui-mf-mo directement; & l'assistance îles réfugiés, il r ép a rt it ces fonda en tre les g roupem ents e t, le cas échéant, les organismes officiels qu ’il juge le plus qualifiés pour assurer une telle assistance.

INTEIiNATIONAI. ASSISTANCE TO REFUGEES

The First Committee discussed fully the present position, and the future prospects of the international assistance to refugees which has been carried on under the auspices of the League. In this discussion, it had the great advantage of assistance from the High ( ommissioncr for Refugees, Sir Herbert Emerson. Many delegations paid warm tribute to the efforts of Sir Herbert Emerson and his staff during the immense difficulties of the past seven years. I hey emphasised the high humanitarian value of the work that Dr. Nansen had started at the very inception of the League. Indeed, it was largely owing to the League's work that the necessity for international organisation for the protection of refugees was now generally recognised.

The First Committee took note of the fact that there was sitting 111 London at the same time a Committee of Enquiry established by the Economic and Social Council of the United Nations, to examine in all it's aspects the problem of refugees and displaced persons 1 here seemed good prospects that the eventual outcome of this ( ommittee s work will be the establishment of a new international authority, under the United Nations, for the protection of refugees and displaced persons. Members of the First Committee expressed their strong hope that the categories of refugees with which the League had been particularly concerned would be included in the unified system of protection and assistance which would eventually emerge and that there would be no break in continuity in the system of international protection.

In order to prevent the premature termination of the League's work for the protection ol refugees, the First Committee unanimously recommends the Assembly to adopt a resolution prolonging the term of office of the High Commissioner for Refugees until the end of the present year if required' The text of this resolution is incorporated in the general resolution on the dissolution o f the League, submitted to the Assembly by the Second Committee.

The delegates of Poland and Yugoslavia enquired whether the High Commissioner was in practice able to draw the distinction emphasised in a recent resolution of the General Assembly of the United Nations, between genuine refugees and displaced persons on the one hand and war criminals, " quislings " and traitors on the other. In the absence of the Secretary-General, who is away from Geneva on short leave, I beg to acknowledge the receipt of your letter dated August 7th, and would like to give you some preliminary information on the questions put by you as regards the indemnity on the termination of

contracts.

Personally, I think that the matter will have to be referred to the Board of Liquidation as the Assembly Resolution speaks only of the Secretariat Staff*

The voluntary contribution of the Secretariat officials has been reduced by a decision of the Supervisory Commission by 50 % as from April 1st,1946, contracts of all League officials having been terminated as at July 31st,1946. New contracts have now been given to those whose services have been retained after that date and the voluntary contribution is no longer being applied after July 31st by the Secretariat. This is in accordance with an understanding reached with the Supervisory Commission*

I will submit your letter to the Secretary- General on his return so that he can give you more precise information on the first point raised in your letter.

Except for the High commissioner, the Secretariat has

no Information regarding the composition of M s staff nor

the terms of their contracts.

2. The High Commissioner himself was appointed by the

1938 assembly, the appointment having been made for five

years as from January 1st, 1939. It therefore expired on

December 31st, 1943. I can trace no record either

In the Registry files or in the proceedings of the Supervisory

Commission as to the prolongation of his mandate. He

continued in fact and the Supervisory commission voted his

budget yearly. The last ..ssembly passed a resolution on

April 18th according to which the High Commissioner "shall

remain il office until the end of the year 1946 or such

earlier date as may appear to the Board desirable”.

3. The resolution of the last assembly concerning the

payment of indemnities to dismissed staff applies only to

the Secretariat. Their extension to the High Commissioner

and his staff would require, in my view, a decision of the

Board of Liquidation.

My dear Emerson,

I have before me your letter dated August 7th, the reeelpt of which haa already been provisionally acknowledged by Stencek.

1. I share Stenoek's views that the extension to yourself and your staff of the last Assembly’s resolution concerning the payment of Indemnities would require a special decision by the Liquidation Board, the resolution as passed applying only to the Secretariat staff. I shall therefore, if you so desire,be pleased to put the matter before the Board at its next session.

2. As, according to the Assembly resolution passed onApril 18th, the "High Commissioner for Refugees shall remain in office until the end of the year 1946 or suoh earlier date as may appear to the Board desirable", I think the Board would wish to be informed of the steps you have taken with a view to terminating the contracts of your staff and I should be grateful if you would let me have this information in due course. It would also be useful if you would let me have a list of your staff, indicating their salaries, the beginning of their service and the terms of their contracts, especially as regards the termination clause.

3. The matters mentioned under paragraph (2) will ne doubt fall under the arrangements indicated in the last paragraph of your official letter of August 7th.

different letters from you to which I am very glad to be abl

to reply Immediately.Ao to the payment of Indemnities to certain members

of the staff of the High Commission about whioh you wrote to Ur Lester, the matter will be submitted to the Board of Liquidation at its next session end I think it very probable that the last Assembly’s resolution willbe «tendedto yourself and those members of your staff enumerated in the three lists attached to your letter received here on September 12th, 1946 Certain change* will, however, have to be made in the

amount of tho indemnities to be paid to the in lists B and C. These changes result from the text or tne resolution adopted by the Assembly and from its to the members of the staff of the League. Réfugiés, a sollicité du Comité de Liquidation l'application,

au personnel du Haut Commissariat, de la résolution adoptée par

l'Assemblée en date du 16 avril 1946 au sujet des indemnités à

verser au personnel du Secrétariat. Copie de cette lettre et

des trois listes qui l'accompagnent se trouvent ci-joints.

Le Haut Commissaire pour les Réfugiés a été désigné par unê

résolution de la 19ème Assemblée adoptée le 30 septembre 1938.

Il a été nommé pour 5 ans dès le 1er janvier 1939. Son mandat

devait donc expirer le 31 décembre 19bS, mais il continua à exercer ses fonctions sans discontinuité et durant la guerre ses

divers budgets annuels ont été régulièrement votés par la Com

mission de Contrôle. la dernière Assemblée a pris une résolu

tion en vertu de laquelle son mandat a été prolongé jusqu'^ 3 1

décembre 1946, le Comité de Liquidation pet&aat toutefois/mettre

fin à l'activité du Haut Commissaire à une date plus rapprochée.

A moins d'une décision contraire du Comité de Liquidation, le

Haut Commissaire, ainsi que ses collaborateurs figurant sur la

liste A auront donc, à la date du 31 décembre 1-946, accompli

sans discontinuité 8 ans de service.

Le personnel du Haut Commissariat n'est pas soumis au Statut

du Personnel du Secrétariat. Conformément à la résolution adop

tée par lS Jffifblée, c'est le Haut Commissaire qui nomme, pour

l'assister, "un Haut Commissaire adjoint et un personnel re

streint" . La subvention de la Société des Nations est réservée, en vertu de cette même résolution, aux dépenses administratives

du Haut Commissaire, y compris la rémunération du Haut Commis

saire adjoint, du personnel et, le cas échéant, des représen

tants. /Monsieur Henri Ponsot, kesdemoiailes «.rakelian et

Dulmet (Liste C) ainsi que ceux qui figurent sur la liste B

font partie du Bureau de Paris, alors que les autres personnes

exercent leurs fonctions à Londres au siège même du Haut Com

missariat.La résolution de l'Assemblée, ayant trait aux in fem'itéis-à-

Mademoiselle Arakelian recevraient un mois et demi de traitement

au lieu d'un mois proposé par Sir Herbert Emerson, du fait qu'ils

ont été engagés dèa le 1er mai 1945, alors que Monsieur Paon et

Mesdames Eichner et Kovalska recevraient de môme un mois et demi

de traitement au lieu des 3 mois proposés par le Haut Commissaire.

Cette réduction provient de 1'interruption survenue dans les fonc

tions que les intéressés exerçaient avant la guerre. Le demi"mois

de traitement accordé à S.E. Monsieur Ponsot et à Mesdames Eichner

et Kovalska est le résultat de la règle adoptée à l'égard des fonc

tionnaires du Secrétariat, règle suivant laquelle chaque fraction

d'année supérieure à 6 mois est calculée en un demi-mois.

In a letter, dated September 10th, 1946, to the

Secretary-General, Sir Herbert Emerson , the High Commissioner

for Refugees, requests the Board of Liquidation to apply to

the staff of the High Commissariat the resolution adopted by

the Assembly on April 16th, 19-46 concerning indemnities to be

paid to the staff of the Secretariat. Copies of the letter

and of the three lists accompanying it are appended.

The High Commissioner for Refugees was appointed by

a resolution of the 19th Assembly adopted on September 30th,

1938. He was nominated for 5 years commencing January 1st,

1939. His term of office should therefore have expired on

December 31st, 1943, but he has continued to exercise his

functions without interruption, and throughout the war his

annual budgets were i gu Li'.rly voted by the Supervisory

Commission. The last Assembly took a resolution under which

his term of office was extended to December 31st, 1946, the

Board of Liquidation, however, being authorised to terminate

his work at an earlier date. In the absence of a decision to

the contrary by the Board of Liquidation, the High CommissionerCX1IV4 1 \^-<J

and his colleagues on List A will therefore have

Fund. It is estimated at 95,000 Swiss francs.

"My attention has recently been drawn to the approval given by the Assembly on the 16th April, 1946, to the payment of indemnities to certain members of the staff of the League.The relevant references are A.32 (l).1946.X, Section V, subsection A, and A.14.1946.X, Section B. I have the honour to request that the Board of Liquidation consider the application of the same principle to members of the staff of the High Commissioner for Refugees under the Protection of the League.I would observe that no pension scheme or provident fund has been established in connection with the High Commission.

2. "Attached is a list of members of the staff who will have completed one year's service before the 31st December,1946. They are divided into the following classes

(a) Officials who have been in continuous service since a date preceding the outbreak of the war.

(b) Officials who were in service on a date preceding the outbreak of the war, whose services were interrupted owing to the occupation of the country in which they were serving, and who were reengaged subsequent to the termination of hostilitiesin Europe.

(c) Officials who were engaged on a date subsequent to the outbreak of the war.

"List B. consists of three officials serving in the Paris office whose original appointments with the High Commission date from the 1st January, 1939. Previous to this they were in the employment of the Nansen Office. Their service was inter- ; rupted by the occupation of France with effect from rbout the end of June, 1940; they were re-employed with effect from the 1st March, 1945. I would request that if the principle of indemnity is approved, their total service since the 1st January, .1939, although interrupted, be allowed to qualify. The total service would then consist of eighteen months from the 1st January, 1939, to the 30th June, 1940, plus twenty-one months from the 1st March, 1945, to the 31st December, 1946, makingthirty-nine months in all. The effect of this concession wouldbe that they would qualify for indemnities equivalent to three months' salary instead of one month's salary.

3. "I may explain that the staff employed in the Western Zones of Germany and Austria has not been included, since it is shared by the High Commission and the Intergovernmental Committee on Refugees, and will almost certainly be completely merged into the latter organisation within the next few months, j before any member of the staff has completed one year's service.

4. "I would particularly request that if the Board of Liquidation is unable to extend the grants to all members of the staff, it should rive favourable consideration to the cases of all but the highest paid officials, namely, to all xcept the High Commissioner himself, the Deputy High Commissioner (Dr. G.G. Le Haut-Commissaire pour les Réfugiés a été désigné

'pw une résiblution de la Dix-Neuvième Assemblée adoptée le

30 septembre 1938. Il a été nommé pour 5 ans à partir du 1er

janvier 1939. Son mandat aurait donc dû expirer le 31

décembre 1943, mais il a continué à exercer ses fonctions

sans dïsweîmiirbé et, pendant toute la guerre, ses budgets

annuels ont été régulièrement votés par la Commission de

Contrôle. La dernière Assemblée a 'pris une résolution^ en"-

vertu de laquelle son mandat- à été prolongé jusqu'au 31

décembre 1946, le Comité de Liquidation étant, toutefois,

autKirioé à mettre fin à l'activité du Haut-Commissaire à une

date plus rapprochée. A moins d'une décision contraire du

Comité de Liquidation, le Haut-Commissaire ainsi que ses

collaborateurs figurant sur la liste A auront donc, à la date

du 31 décembre 1946, accompli,sans discontinuité,8 ans de

service.

Le personnel du Haut-Commissariat n'est pas soumis

au Statut du Personnel du Secrétariat. Conformément à la

résolution adoptée par la Dix-Neuvième Assemblée, c'est le

Haut-Commissaire,nomme, pour 1 'assister, "un Haut-Commissaire

adjoint et un personnel restreint". En vertu de àa même

résolut:on, la subvention de la Société des Nations est réser

vée aux.dépenses administratives du Haut-Commissaire, comprenant

les arfrpointièiüofrts du Haut-Commissaire adjoint, du personnel

et, le cas échéant, des représentants. M. Henri Ponsot

Melles Arakelian et Dulmet (Liste C) ainsi les personnes figurant

sur la liste B font partie du Bureau de Paris, tandis que les

autres personnes exercent leurs fonctions à Londres,au siège

du Haut-Commissariat.

La résolution de l ’Assemblée accordant des indemnités

aux fonctionnaires temporaires précise que ces indemnités

seront proportionnelles à la durée de la présente période de

service des intéressés. Il en résulte que, lorsqu’il y a eu

des périodes successives de service,séparées par des interrup

tions, l'Administration n'a pu tenir compte que de la dernière

période. Si le Comité décide d'appliquer les mêmes principes

au personnel du Haut-Commissariat, lesîndemnités à verser

à M. Ponsot ,'M. Paon/'Mme ? Eichner^ et Kovalska et/ Mlle Arakelian

devront être légèrement modifiées. M. Ponsot et Melie

Arakelian recevraient un mois et demi de traitement, au 1- eu

d'un mois proposé par Sir Herbert Emerson^étant donné quî-ts

ont"oté o a i pr mai 1945, a£ors que M. Paon

et Mmeji Eichner etlftovalska recevraient, de même, un mois et

demi de traitement au lieu des trois mois proposés par le

Haut-Commissaire. La réduction,dans le cas de ces trois

fonctionnaires,provient de 1 * interruption dans les fonctions

exercées par eux avant la guerre. Le demi-mois de traitement

accordé à M. Ponsot, e* à Mme* Eichner èlÿ Kovalska est le

résultat de la règle appliquée au personnel du Secrétariat ,

selon laquelle chaque fraction d'année supérieure à six

mois est calculée comme donnant droit à une indemnité d'un

demi-mois.

Etant donné que la décision de l'Assemblée ne s'appli

que pas au Haut-Commissaire et à ses collègues, le Comité

devrait péesdre une décision affpHn1p ou— Ca£pe une recommanda

tion,‘en 6e qui les concerne. De plus, cette dépense n'étant

pas prévue dans le budget du Haut-Commissaire pour l'année ^

1946, la somme nécessaire, devçait être U'unuféré^ du Fonds

de Garantie. Elle est e-atiimoof à ^>5.000 francs suisses.

LETTRE ADRESSEE AU SECRETAIRE GENERAL PAR LE HAUT- COI.m-SAIRE POUR LES REFUGIES.

"Mon attention a été récemment attirée sur le

fait que l'Assemblée a approuvé, le 16 avril 1946, le

paiement d 'indemnités à certains membres du personnel de

la Société (^.32(1).Î946.X., Section V, paragraphe A, et

A.14.1946.X., Section B). J'ai l'honneur de demander que

le Comité de Liquidation examine l'application du même

principe aux membres du personnel du Haut-Commissaire pour

les Réfugiéâ'sous le» au»p4&@s de la Société. Je tiens à

faire observer qu'aucun système de pensions ou de Caisse

de prévoyance n'a été établi en ce qui concerne le Haut-

Commissariat.

2. Ci-joint, figure une liste des membres du

personnel qui oat achevé une année de service avant le

31 décembre 1946. Ils sont répartis dans les catégories

suivantes :

a) Fonctionnaires ayant été en service sans

interruption depuis une date précédant 1'ouverture

des hostilités.

b) Fonctionnaires ayw**=éttï" en service à une

date précédant 1 'ouverture des hostilités,mais

dont les services ont été interrompus en raison de

l'occupation du pays où ils étaient employés,et qui

ont été réengagés après la fin des hostilités en

Europe.

c) Fonctionnaires engagés à une date postérieure

à 1 'ouverture des hostilités.

La liste B. comprend trois fonctionnaires en ser

vice au Bureau de Paris,dont l'engagement initial au Haut-

Commissariat remonte au 1er janvier 1939. Auparavant,

ils étaient employés par le Bureau Nansen. Leurs services

ont été interrompus par ,1 'occupation de la France à dater

d'environ la fin de juin 1940; ils ont été employés à nouveau

avec effet à partir du 1er mars 1945. Je demanderais que,

si le principe' de l'indemnité est approuvé, la durée totale

de leur/ service*/ depuis le 1er janvier 1939 soit prise en

considération, malgré les interruptions. La durée totale

de leuiy service/serait donc de dix-huit mois, du 1er janvier

1939 jusqu'au 30 juin 1940, plus vingt-et-un mois, depuis le

1er mars 1945 jusqu'au 31 décembre 1946, soit trente-neuf

mois en tout. Cette concession aurait pour effet de leur

donner droit à des indemnités correspondant au* trois mois

de traitement, au lieu d'un mois de traitement.

3. Je désire indiquer que le personnel employé

dans les Zones occidentales de l'Allemagne et de l'Autriche

n'a pas été compris dans la liste, car il^ travaille^ à la fois

pour le Haut-Commissariat etîe Comité intergouvememental

des Réfugiés et,'il serajpresqüë certainement/complètement

rattaché à cette dernière Organisation au cours des prochains

mois.avant qu'un membre quelconque de ce personnel n'ait

accompli une année entière de service.

4. Je voudrais infester particulièrement ps?»r que

le Comité de Liquidation, s'il ne croit pas pouvoir accorder

une indemnité à tous les membres du personnel, veuille bien

examiner favorablement le cas de tous les fonctionnaires,

sauf ceux dont la rémunération est la plus élevée, c'est-à-dire

tous les fonctionnaires, sauf le Haut-Commissaire lui-même, o$.

le Haut-Commissaire adjoint (Dr. G.G. Kullmann) et le repré

sentant à Paris (M. l'Ambassadeur Henri Ponsot).

5. Les traitements des membres du personnel de

Paris qui figurent sur la liste sont ceux présentement

approuvés. Conformément à une décision récente du Gouverne

ment français, il serait nécessaire de les augmenter de

à l'octroi d'indemnités à tous les membres du personnel

s'élèveraient à environ 95.000 francs suisses. Si les trois

fonctionnaires recevant les traitements les plus élevés n'étaien'

d'environ 20.000 francs suisses. Aucun crédit n'a été prévu

Staff Indemnities

Note by the Secretary-General.

In a letter, dated September 10th, 1946, to the Secretary-General, Sir Herbert Emerson, the High Cummissioner for Refugees, requests the Board of Liquidation to apply to the staff of the High Commissariat the resolution adopted by the Assembly on April 16th, 1946 concerning indemnities to be paid to the staff of the Secretariat. Copies of the letter and of the three lists accompanying it are appended.

The High Commissioner for Refugees was appointed by a resolution of the 19th Assembly adopted on September 30th,1938. He was nominated for 5 years commencing January 1st,1939. His term of office should therefore have expired on December 31st, 1943, but he has continued to exercise his functions without interruption, and throughout the war his annual budgets were duly voted by the Supervisory Commission. The last Assembly took a resolution under which his term of office was extended to December 31st, 1946, the Board of Liquidation, however, being authorised to terminate his work at an earlier date. In the absence of a decision to the contrary by the Board of Liquidation, the High Commissioner and his colleagues on List A will therefore have completed8 years' continuous service on December 31st, 1946.

The staff of the High Commissariat are not covered by the Secretariat Staff Regulations. Under the resolution adopted by the 19th Assembly it is the High Commissioner who appoints "a deputy High Commissioner and a small staff" to assist him. Under the same resolution the grant from the League is appropriated for the High Commissioner's administrative expenses, including the emoluments of the Deputy High Commissioner, the staff, and any representatives. M. Henri Ponsot, Mesdemoiselles Arakelian and Dulmet (List C) and the persons whose names appear on List B belong to the Paris Office, whereas the other persons work in London at theheadquarters of the High Commissariat.

Indemnités au personnel

Note du Secrétaire Général

Dans une lettre qu'il a adressée au Secrétaire Général en date du 10 septembre 1946, Sir Herbert Emerson, Haut-Commissaire pour les Réfugiés, demande au Comité de Liquidation d'appliquer au personnel du Haut-Commissariat la résolution adoptée, le 16 avril 1946, par l'Assemblée relativement aux indemnités à verser au personnel du Secrétariat. Copie de cette lettre ainsi que des trois listes qui l'accompagnent se trouve ci-jointe.

Le Haut-Commissaire pour les Réfugiés a été désigné en vertu d'une résolution de la Dix-Neuvième Assemblée adoptée le 30 septembre 1938. Il a été nommé pour 5 ans à dater du 1er janvier 1939. Son mandat aurait donc dû expirer le 31 décembre 1943, mais il a continué à exercer ses fonctions s ans interruption et, pendant toute la guerre, ses budgets annuels ont été dûment votés par la Commission de Contrôle. La dernière Assemblée a adopté une résolution aux termes de laquelle le mandat du Haut-Commissaire a été prolongé jusqu'au 31 décembre 1946, le Comité de Liquidation étant, toutefois, habilité à mettre fin à l'activité du Haut-Commissaire à une date plus rapprochée. A moins d'une décision contraire du Comité de Liquidation, le Haut-Commissaire ainsi que ses collaborateurs figurant sur la liste A auront donc, à la date du 31 décembre 1946, accompli, sans discontinuité, 8 ans de service.

Le personnel du Haut-Commissariat n'est pas soumis au Statut du Personnel du Secrétariat. Conformément à la résolution adoptée par la Dix-Neuvième Assemblée, c'est le Haut-Oommissaire qui nomme, pour 1'assister, "un Haut-Commissaire adjoint, et un personnel restreint". En vertu de cette même résolution, la subvention de la Société des Nations est réservée aux dépenses administratives du Haut-Commissaire, comprenant les émoluments du Haut-Commissaire adjoint, du personnel et, le cas échéant, des représentants. M. Henri Ponsot, Me11es Arakelian et Dulmet (Liste C) ainsi que les personnes figurant sur la liste B font partie du Bureau de Paris, tandis qve les autres personnes exercent leurs fonctions à Londres, au siège du Haut-Commissariat.

La résolution de l'Assemblée accordant des indemnités aux fonctionnaires temporaires précise que ces indemnités seront proportionnelles à la durée de la présente période de service des intéressés. Il en résulte que, lorsqu'il y a eu

rdes périodes successives de service, séparées par des interruptions, 1*Administrât!ou n'a pu tenir ompte que de la dernière période. Si le Comitù décide d'appliquer les mêmes principes au personnel du Haut -Commissariat, les indemnités à verser à M. Ponsot, à M, Paon, à Mme Eichner, à Mme Kovalska et à Melle Arakelian devront être légèrement modifiées.M. Ponsot et Melle Arakejian recevraient un mois et demi de traitement, au lieu d'un mois proposé par Sir Herbert Emerson, étant donné que leur engqgement remonte au 1er mai 1945, tandis que II. Paon et Mme Eichner et lime Kovalska recevraient, de même, un mois et demi de traitement au lieu des trois mois proposés pa:ç le Haut-Commissaire. La réduction, dans le oas de ces trois fonctionnaires, provient de l'interruption dans les fonctions exercées par eux avant la guerre. Le déminais de traitement accordé à 1'. Ponsot, à Mme Eichner et à Mme Kovalska est le résultat de la règle appliquée au personnel du Secrétariat, selon laquelle chaque fraction d'année 's.périeure à six me is est calculée oorice donnant droit à une indemnité d'un demi-mois.

Etant donné que la décision de l'Assemblée ne s'applique pas au Haut-Comr.issaire et à ses collègues, le Comité devrait formuler une décision ou une recommandatior. spéciale, en ce qui les concerne. De.plus, cette dépense n'étant pas prévue dans le budget du Haut-Commissaire.pour l'année 1946, la sr.mme nécessaire devrait être rendue disponible au moyen d'un virement du Fends de Garantie. Elle est évaluée à 95.000^- francs suisses.

"Mon attention a été récemment attirée sur le fait qùe l'Assemblée, a approuvé, le 16 avril 1946, le paiement d 'indemnités à.certains membres du personnel de la Société (Document de référence: A.32(1) ,194G,X- Section V ; par. A, et A.14.1946.X., Section B*). J'ai l'honneur de demander que 16 Comité de Liquidation examine 1 'application du même principe aux membres du personnel du’Haut Commissaire pour les Réfugiés, placés sous la protection de la Société. Je tiens à faire ubserver qu'aucun système de pensica ou de caisse de prévoyance n'a été établi en ce qui concerne le Hàut-Comriis-

2, Ci-joint, figure une liste des membres du personnel qui auront achevé une année de service avant le 31 décembre 1946. Ils sont répartis dans les catégories suivantes :

a) Fonctionnaires ayant été en service sans interruption depuis une date précédant l'ouverture des hostilités.

b) Fonctionnaires qui étaient en service à une date précédant l’ouverture des hostilités, mais dont les services ont été interrompus en raison de l ’occupation du pays où ils étaient employés, et qui ont été réengagés après la fin des hostilités en Europe.

c) Fonctionnaires engagés à une date postérieure à 1*ouverture des hostilités.

La liste B. comprend trois fonctionnaires en service au Bureau de Paris, et dont l'engagement initial au Haut-Commissariat remonte au 1er janvier 1939. Auparavant, ils étaient employés par le Bureau Nansen. Leurs services ont été interrompus par suite de l'occupation de la France à dater d'environ la fin de juin 1940; ils ont été employés à nouveau avec effet à partir du 1er mars 1945. Je demanderais que, si le principe de l'indemnité est approuvé, la durée totale de leurs services-depuis le 1er janvier 1939 soit prise en considération, malgré les interruptions. La durée totale de leurs services serait donc de dix-huit mois, du 1er janvier 1939 jusqu'au 30 juin 1940, plus vingt-et-un mois, depuis le 1er mars 1945 jusqu'au 31 décembre 1946, soit trente-neuf mois en tout. Cette concession aurait pour effet de leur donner droit à des indemnités correspondant à trois mois de traitement, au lieu d'un mois de traitement.

3. Je désire indiquer que le personnel employé dans les Zones occidentales de l'Allemagne et de l'Autriche n'a pas été compris dans la liste, car il travaille à la fois pour le Haut-Comr.issariat et pour le Comité intergouvememental des Réfugiés et, presque certainement, il sera complètement rattaché à cette dernière Organisation au cours des prochains mois, avant qu'un membre quelconque de ce personnel n'ait accompli une année entière de service.

4. Je voudrais demander tout particulièrement que le Comité de Liquidation, s'il ne croit pas pouvoir accorder une indemnité à tous les membres du personnel, veuille bien examiner favorablement le cas de tous les fonctionnaires, sauf ceux dont la rémunération est la plus élevée, c'est à dire tous les "onctionnaires, sauf le Haut-Commissaire lui- même, le Haut-Commissaire adjoint (Dr. G.G., Kullmann) et le représentant à Paris (M. l'Ambassadeur Henri Ponsot).

5= Les traitements des membres du personnel de Paris qui figurent sur la liste sont ceux présentement approuvés. Conformément à une décision récente du Gouvernement français, il sera nécessaire de les augmenter de 25 Compte tenu de ce fait, les dépenses afférentes à l'octroi d'indemnités à tous les membres du personnel s'élèveraienb à environ 95.000 francs suisses. Si les trois fonctionnaires recevant les traitements les plus élevés n'étaient pas compris dans ce chiffre, les dépenses en question seraient d ’environ 2 0 . 0 0 0 francs suisses. Aucun crédit n'a été prévu dans mon budget de 1946 pour faire face à cette dépense.

Dear Sir Herbert,

The Secretary of the Liquidation Board has passed on

to me your enquiry dated December 9th concerning compensatory

payment to the staff of the High Commissioner's office for

leave not taken. Not knowing the terms of their contracts,

I am unfortunately unable to advise you as to the course to

be taken.

As regarda the Secretariat's staff, they «ere entitled,

according to our Staff Regulations, to carry over to the

following year half of the leave to which they were entitled

under the Regulations there being no limit to the number of

days so accumulated. If for reasons of service they were not

able, on the expiration of their contract, to exhaust their

leave, they were entitled to receive monetary compensation

for the number of days of leave not taken. In order to

Illustrate this,I give an example:- If an official at the

end of his contract was left with ten days leave not taken,

he was paid l°/365ths of his salary.

Dear Sir Herbert

Ab I had the pleasure of Informing you during

your recent visit, the Board of Liquidation decided

to extend to you and your staff in the former High

Commissariat, the benefit of the decision of the last

Assembly concerning the grant of indemnities to the

officials of the Secretariat. It further decided

that, as regards the amount of the indemnity payable,

the same rules should be applied as were laid down

for the Secretariat.

According to these rules, in the case of an

interruption of service, only the last period of

service is counted for the purpose of the indemnity;

a fraction of a year exceeding six months la calculated

as entitling the official to one-half month's indemnity.

On that basis M.Paon and Mbdames Eichner and

Kovalska will be entitled to a month-and-a-half indemnity

instead of the three months proposed by you.

On the other hand, M.Ponsot and Mile. Arakelian

will be entitled to a month-and-a-half salary instead

of one month proposed by you.

You yourself, Dr. Kuilmann, the Registrar and

the Office-keeper are each entitled to receive an

indemnity amounting to one year’s salary, while 1

Mrs. Jackson and Miss Shapland will be granted three

months' salary each.

The indemnities are therefore as follows

Dear Sir Herbert,

As I had the pleasure of informing you during

your recent visit, the Board of Liquidation decided

to extend to you and your staff in the former High

commissariat the benefit of the decision of the last

Assembly concerning the grant of indemnities to the

1) Par lettre du 25 tears 1947 ci-jointe en copie, Sir Herbert Emerson. se référant à une communication reçue du Secrétariat Général de la S.D.N-, notifiait à it. Ponsot que te. Paon,iume Eichner. Mme Kovalska et telle Arakellian, anciens fonctionnaires en France du Haut Commissariat pour les réfugiés, recevraient une indemnité de 1 mois 1/2 de traitement et que 1 mois de traitement serait alloué à Mlle Dulmet„

Cette décision paraît se fonder sur l’interprétation restrictive suivant laquelle, aux termes de la note du Secrétaire Général (BoL, 57, page 1, paragraphe 4) "la résolution de 1*Assemblée accordant des indemnités aux fonctionnaires temporaires précise que ces indemnités seront proportionnelles à la durée de la présente période de services de,s intéressés» Il en résulte que, lorsqu’il y a eu des périodes successives de service. séparées par des interruptions, l’Administration n ’a pu tenir compte que de la dernière pé-

2) Or, il paraît difficile, eu égard aux circonstances, de considérer la dernière période de travail des intéressés comme "séparée par des interruptions" de leur activité antérieure.

Tel était d ’ailleurs le sentiment exprimé par Sir Herbert Emerson lui-mêni -■'■ns la lettre qu'il adressait le 10 Septembre 1946 au Secrétaire Général (Annexe au document B.L.57, page 3, paragraphe 3) et dans laquelle le Haut Commissaire pour les Réfugiés écrivait au sujet de iv.. Paon^ de terne Eichner et de terne Kovalska :"Je demanderais que, si le principe de 1’indemnité est approuvé, la durée totale de leurs services depuis le 1er janvier 1939 soit

prise en considération, malgré les interruptions. La durée total, de leurs services serait donc de dix-huit mois, du 1er Janvier 19|J9 jusqu’au 30 Juin 1940, plus vingt et un mois, depuis le 1er Mars 1945 jusqu’au 31 décembre 1946, soit 39 mois en tout."

3) Les conditions dans lesquelles, malgré des circonstances exceptionnellement difficiles, s’est continuée, de 1939 à 1944, l’activité des fonctionnaires intéressés, sont exposées dans une note ci-ennexée.

La doctrine formulée par M. Kullman, dans sa lettre du 19 Septembre 1944 suivant laquelle la seule interruption des relations entre le Haut Commissariat et son personnel resté en France avec les réfugiés aurait suffi à mettre fin aux fonctions, dudit personnel paraît inadmissible,.

En effet, d'une part, aux termes d ’une lettre de M. Kullman lui-même, en date du 30 Avril 1939, le personnel avait été prié de "poursuivre le travail en cas de conflit armé".

D ’autre part, il paraît difficile d ’admettre que, tandis que la continuité des services du Haut Commissaire et de ses collaborateurs immédiats restés en Angleterre, sans contact avec les réfugiés n ’est pas contestée, on puisse conjidérer comme ayant cessé l’action du personnel resté en France, dans des conditions singulièrement difficiles, au contact immédiat et au service des réfugiés eux-mêmes,

A cet égaal il peut être rapp&Lé que :

A) La délégation en France a perçu, jusqu’à la cessation de son fonctionnement, le produit du timbre Nansen pour.un montant de 1.670.000 francs qui ont été distribués aux intéressés.

B) que le nombre des réfugiés qui, eu 1940, était de 163.000,

ftf ^ ,« ^ raque la délégation a cessé ses fonctions, estimé encore a 115*000.

Au surplus, un rapport complet relatant l ’activité du Bureau, remis par M. Paon à M. Ervin, a dû être déposé aux archives de la S=D.N» eu il pourrait être consulté.

4) En conclusion, sans faire entrer en ligne de compte la durée pendant laquelle les fonctionnaires camouflés sous l’étiquette du Bureau des Apatrides ont en réalité continué leurs services, les mêmes fonctionnaires demandent que le chiffre des indemnités à leur attribuer soit remise en tenant compte non seulement de leur dernière période d ’activité ouverte mais aussi de la période anté-

Il y a lieu de relever que le solde relatif au bureau de Paris de francs français 116.616,25 figurant dans la lettre écrite, le 25 mars 1947, par Sir Herbert Emerson, Haut Commissaire, à M. François Ponsot, ambassadeur de France, a été modifié lovo de mon passage à Londres, le 14 avril 1947, du fait de dépenses non comptabilisées pour un montant de francs français 32.883,10.Le solde disponible pour le bureau de Paris s'est donc trouvé ramené, comme il ressort du tableau ci-dessus, à la somme de francs français 83.733,15.

Sir Herbert Emerson's letter of April 25th deals

with the question of indemnities payable to the staff in

France of the High Commission.

Sir Herbert draws attention to the fact that as

a result of increments of salaries of some members of

the staff having been overlooked, the total amount of

indemnities payable under the original decision would not

be French Frs. 8$“,562.50, as mentionned in the Secretary-

General's letter of March 17th, but 94,817. JTrs.

The Liquidation Board having decided that for the

officials which had already belonged to the staff of the

High Commission in France in 1939-1940, this first period

of service should also be taken into account for the

calculation of the indemnities, three officials: M. Paon,

Mme Elchier, Mme Koval ska, are entitled t o /additionnai

indemnity equal to 1 1/2 months salary.

The indemnities due to the officials in question

therefore the following:

TVThe former High Commissionner finally points out

that as the balance of the French account amounts to

83 733.15 French Frs. only, additionnai funds would have to

be made avatlyfable for the p a y m e n t of the indemnities. The

necessary sum is 61.136.85 French Frs. Sir Herbert suggests

that this amount should be placed at the credit of M. Faon

who would see to the payments being made and send the

receipts to Sir Herbert.

With reference to the High Commissioner's note of

April 25th, 1947, and M. van Asoh van Wijok's observations of

Kay 2nd, 1947, In file Ho. 20A/35482.35482, the Treasury has

examined the situation and would like to suggest the following

manner for its settlement.

In conformity with the decision taken by the Board

of Liquidation, the indemnities due to the High Commissioner's

French francsstaff in Paris -

Difference ......... 61,141

On the other band the Liquidator

of the Nansen Office, M. P. Verohère de Reffye,

(File 20A/42784.3509) in Paris, holds

46,449 French francs of League’s money.

The remaining difference ...................... 14,692

could be transferred, according to the indi

cations of the High Commissioner, from Geneva.

Further, it is to be noted that M. de Reffye has at

his disposal for the account of the former Nansen Office an

amount of 20,634.80 Swiss francs at the Credit Suisse, Geneva.

This amount also might be transferred to the account

of the League.Any further expenditure in respect of the liquidation

of the Nansen Office could then be settled by the Secretariat which

necessarily will be liquidated after the Nansen Office.

Les deux lettres de M. Paon du 3 Juin sont, è

mon avis, envoyées à la mauvaise adresse. M. Paon devait saisir

1•ex-Haut-Commissaire des questions dont il s'agit. Il est vrai

qu'il s'était adressé à Sir tierbert Emerson au sujet de l’indem

nité de licenciement de Melle Riobé.

Nous ignorons pourquoi Sir Herbert ne lui a pas ré

pondu et n'a non plus saisi le Comité de Liquidation de ce cas.

Dans ces conditions, je ne crois pas nue le Secrétariat puisse

se saisir de l'affaire sur la simple base de la lettre de M. Paon,

J'estime que ce dernier devrait rappeler 1 'affaire

à l'attention de Sir Herbert. C'est à celui-ci de nous faire une

proposition et non pas au Secrétariat de lui demander son avis

au sujet de la prûposition de M. Paon.

La situation, en ce qui concerne la question soule

vée dans la seconde lettre, est sensiblemai t analogue.

Les agents en France du Haut Commissariat pour les

Réfugiés n*étaient pas membres du Secrétariat, et nous ne dispo

sons pas de données au sujet des services qu'ils ont rendus. Le

Secrétariat est donc assez mal placé pour soutenir les candida

tures de ces agents auprès des organisations internationales.

L'ex - Haut Commissaire devrait donc s'en charger, s'il

considère les divers cas comme dignes d'intérêt.

Après tout, c'est une question assez délicate, à

l'égard de laquelle le Secrétariat devrait adopter une attitude

prudente.

Pour le cas oû vous partageriez ma manière de voir,

je vous soumets ci-joint deux projets de réponse aux deux lettres

de M. Paon.

indemnité de licenciement à Melle Riobé.

Je regrette de vous informer qu'à défaut

de renseignements et avis de 1'ex-Hqut-Commissaire

relatifs à ce cas, il ne nous est pas possible de

nous prononcer à son égard.

En effet, bien que le Haut Commissariat

fût un organisme de la Société des Nations, ses

fonctionnaires et agents ne faisaient pas partie

du Secrétariat.

Aussi, ce dernier ne dispose-t-il d ’au

cune donnée concernant les termes de leur engage

ment et leurs états de service.

Eu égard à ce qui précède, vous Jugerez

peut-être utile de rappeler la question à l'atten

tion de Sir Herbert Emerson, pour que celui-ci

puisse, le cas échéant, nous faire parvenir ses

propositions ou suggestions.

Cher Monsieur Brunakog,

Selon votre memorandum B.L.134 du 21 avril 1947 (dont une oople est ci-jointe) un montant de 67.837,10 francs belges, équivalant à 6.726,65 franos suisses, était à la disposition du Bureau auxiliaire en Belgique du Haut Commissariat pour les Réfugiés.
