Article 3 shall be punished with penal servitudeor imprisonment for a period not exceeding threeyears or a fine not exceeding 100,000yen.

Any person who has committed the offencementioned in the preceding paragraph may besubjected to both penal servitude or imprison-ment and fine concurrently.

Article 13. Any person who comes under any oneof the following items shall be punished withpenal servitude or imprisonment for a period not

" exceeding one year or a fine not exceeding 10,000

yew.(1) Any person w^ho, in contravention of the

provisions of Article 4 paragraph 1, Article 7paragraph 1, Article 8 paragraph 1 or Article8-(2) paragraph 2, fails to apply for registra-tion or issuance of a registration certificate ormakes false application therefor ;

(2) Any person who prevents the application forregistration or issuance of a.registration certi-ficate provided for in Article 4 paragraph 1,Article 7 paragraph 1, Article 8 paragraph 1 orArticle 8-(2) paragraph 2 ;

{3) Any person who applies for registration totwo or more city or town mayors or villageheads in contravention of the provision ofArticle 4 paragraph 3 or the same provisionwhen applicable mutatis mutandis under Article7 paragraph 3;

(4) Any person who fails to return his registra-tion certificate in contravention of the provi-sions of Article 9;

,(S) Any person who fails to carry his registra-tion certificate with him or refuses to show itor olher documents in contravention of the pro-visions of Article 10;

(6) Any person who gives his registration certi-ficate to another person or receives a registra-tion certificate bearing the name of anotherperson for the purpose of employing it; or em-ploys such certificate.

Article 14. In case any ship used in the criminalact mentioned in Article 12 is owned or possessedby the offender, it shall be confiscated.

In case any person other than the offender hasacquired the shipmentioned in the preceding para-graph after the committal of the offence, it shallbe confiscated unless he is proved to have acquiredin bona fide. '

Article 15. The proviso to Article 60 paragraph 2and Article 89 of the Code of.Criminal Procedureshall not apply to any case involving the offencementioned in Article 12.

If, in the case mentioned in the preceding para-graph, the court gives a judgment suspending theexecution of penalty or a judgment of fine, thewarrant of detention shall not lose its effect not-withstanding the provision of Article 345 of theCode of Criminal Procedure.

When the judgment mentioned in the precedingparagraph has become irrevocable, the warrantof detention shall lose its effect.The following two Articles shall be added next

to Article 15:Article 16. The Attorney-General may, as he

stipulates, compel any alien falling under any oneof the following items to leave Japan:(1) Any person who has entered Japan in contra-

vention of the provision of Article 3;(2) Any person who has been sentenced to im-

prisonment or a heavier penalty after committal•E of any one of the offences mentioned in Article

13;(3) Besides the person mentioned in the preced-

ing item, any person who has once been punish-ed after committing an offence mentioned inArticle 13 and again committed any one of theoffences in the same Article;

(4) Any person who has been punished aftercommittal of the offence mentioned in Article155 or 158 of the Penal Code regarding a regis-tration certificate.

Article 17. The Attorney-General may, if he deemsit especially necessary, let a governor of To, Do,Fu or prefecture compel the person concerned toleave Japan as prescribed by the precedingArticle.

In case the governor of To, Do, Fu or prefec-ture has compelled the parson concerned to leaveJapan under the preceding paragraph, he shallimmediately report it to the Attorney-General.

Supplementary Provisions :1. This Cabinet Order shall come into force as

from January 16, 1950.2. Aliens shall, as provided for by the Attorney-

General, return the registration certificates issuedprior to the enforcement of this Order (herein-after to be referred to as ' old registration certi-ficate") to the mayor of city or town or the headof village where their residences are located andapply anew for the issuance of a registration certi-ficate between January 16 and 31, 1950. Tn thiscase, the provision of Article 4 paragraph 3 sh^llapply mutatis mutandis.

3. When the mayor of city or town or the head ofvillage has received the application for theissuance of a registration certificate under thepreceding paragraph, he shall issue a registrationcertificate without delay as provided for by theAttorney-General.

4. The old registration certificates shall lose theirvalidity after the period mentioned in paragraph 2.

5. Any person who comes under any one of thefollowing items shall be punished^ with penalservitude or imprisonment for not more than one.year or a fine not exceeding 10,000 yen:(1) Any person who fails to apply for the issu-

ance of a registration certificate or makes the

false application therefor in violation of theprovisions of paragraph 2 ;

(2) Any person who prevents the application forthe issuance of a registration certificate as pre-scribed by paragraph 2;

(3) Any person who, in contravention of theprovisions of Article 4 paragraph 3 when applica-ble mutatis mutandis in paragraph 2, makesapplication for the issuance of a registrationcertificate to two or more mayors of cities ortowns or heads of villages.

4L Any, person who has committed any one ofthe offences mentioned in the preceding para-graph shall be regarded as the one who hascommitted the offence mentioned in Article 13with regard to the application of the provisionsof Articles 16 and 17.

Registration of Aliens (Ministry of Home AffairsOrdinance No. 28 of 1947) shall be partially amend-ed as follows:

In Article 2 paragraph 1, "Article 7 paragraph 1'*shall be deleted. v

Articles 3 to 5 inclusive shall be amended asfollows :Article 3. When the mayor of a city or town or

the head of a village (the chief of a ward, in thearea of Tokyo-To where there are wards and inthe cities of Kyoto, Osaka, Nagoya, Yokohamaand Kobe; hereinafter the same) has received anapplication for registration under Article 4 para-graph 1, Article 7 paragraph 1, Article 8 para-graph 1, or paragraph 2 of the SupplementaryProvisions of the Ordinance, he shall inquire intothe matters stated therein, and shall not registerthem unless he is convinced that they are trueand correct.

Article 4. The registration made by the mayor ofa city or town or the head of a village in accord-ance with the provisions of Article 6 or paragraph2 of the Supplementary Provisions of the Ordinance-shall be made by entering necessary matters inthe registration card as shown in the Form No. 2annexed.

Article 5. A file of registration cards as prescribedin the preceding Article shall be used as theAliens Registration Book as prescribed in Article5 of the Ordinance.In Article 6, "the Form No. 2, annexed" shall

be amended as "the Form No. 3 annexed".The following one Article shall be added next

to Article 6:Article 6-(2). The application for registration of

change of residence as prescribed in Article 7paragraph 1 of the Ordinance shall be made withthe v/ritten application as shown in the Form No.4 annexed.

On receipt of the written application mention-ed in the preceding paragraph, the mayor of acity or town or the head of a village shall, with-out delay, get the registration card from themayor of the city or town or the head of thevillage where the former* residence was locatedand correct the entries therein, filing it to theAliens Registration Book.In Article 7, "the application-form No. 3, an-

nexed" shall be amended as "the written applica-tion as shown in the Form No. 5 annexed".

The Ordinance for Registration of Aliens (Extract)

Article 10. An alien shall have registration certificate on his person at all times,

and produce the same upon demand of a Government or public body official

designated by the Attorney-General.

When requested by the Government or public body official designated by the

Attorney-General, the alien shall present passport, nationality certificate or other

papers showing that he is a proper possessor of the said registration certificate

or that the matter entered in registration certificate is true.

Article 13 (Extract). Any person who comes under any one of the following items

shall be punished with penal servitude or imprisonment for a period not exceed-

ing one year, or a fine not exceeding 10,000 yen:

5. Any person who fails to carry his registration certificate with him or refuses

to show it or other documents in contravention of the provisions of Article

10.

The Enforcement Regulations of the Ordinance for /

Registration of Aliens (Extract)

Article 8. Xhe Government or public body officials provided in Article 10 of the

Ordinance shall be specified as follows :

(1) National Rural Police or Police or Autonomous Entities;

(2) Government or public body officials who are engaged in the business per-

taining to alien registration or distribution of staple food mentioned in Article

2 of the Staple Food Management Law (Law No. 40 of 1942) ;

(3) Maritime Safety officials.

When the government or public body officials specified in item (2) of the pre-

ceding paragraph require the presentation of documents provided in Article 10

of the Ordinance in places outside of their offices they shall bear IDENTIFICA-

TION CARDS as indicated in Form No. 7 annexed with themselves.

The following form shall be added next to Form No. 7 annexed as Form No. 8 annexed and Form

Supplementary Provisions :

1. This Office Ordinance shall come into force as from January 16, 1950.2. The Alien Registration Book under the foiHner provisions shall be deemed as one under the pro-

visions after the amendment made by this Office Ordinance (hereinafter referred to as "new pro-visions"). The Alien* Registration Book, however, shall be prepared anew according to the newprovisions without delay after the enforcement of this Office Ordinance.

3. An application for the issuance of a registration certificate prescribed in paragraph 2 of the-Supplementary Provisions of the Cabinet Order for the Partial Amendment to the Ordinance forRegistration of Aliens (Cabinet Order No. 381 of 1949; hereinafter to be referred to as "Order"}shall be made by a written application in the annexed form.

4. An application mentioned in the preceding paragraph shall be accompanied by a registration?certificate issued before the enforcement of the Order (hereinafter referred to as "old registrationcertificate"). In case, however, the old registration certificate has been destroyed and it is unableto be accompany it, it is sufficient to make an entry in the written application to that effect and!attach to it in addition a paper with statement of the reason therefor.

5. The provisions of Article 2 paragraph 2 and of Article 3 shall apply mutatis mutandis to the-issuance of a registration certificate under the provisions of paragraph 2 of the Supplementary-Provisions of the Order.
