Plaintiff James O'Keefe, III, residing at 121 Goodwin Terrace, Westwood, New Jersey,

by way of complaint against the Defendants named above, alleges as follows:

1. Defendant Current Media, LLC, on information and belief, is a California

corporation with its principal place of business at 118 King Street, San Francisco,

California. Current Media is a media company broadcasting on television and the

internet. One of the "news" broadcasts by Current Media across the United

States, and including within New Jersey, is Countdown with Keith Olbermann

("Countdown"). The defamatory statements described below were broadcast

within the State of New Jersey.

2. Defendant Keith Olbermann is an employee of Current Media, serves as the Host

of Countdown and is Current Media's Chief News Officer. Mr. Olbermann is

responsible for the content broadcast on Countdown.

3. Defendant David Shuster hosted Countdown as an employee of Current Media on

4. On February 24, 2012, during the video broadcast of Countdown on television,

David Shuster, while acting as an employee or other type of agent of Current

media, called Plaintiff James O'Keefe, III a "convicted felon." This statement

was not true when made; it was made with knowledge of its falsity or a reckless

or negligent disregard for its truth, and constitutes slander and slander per se.

This statement has been continually broadcast on Current Media's website since

the television broadcast aired.

5. On February 24, 2012, during the video broadcast of Countdown on television,

David Shuster stated that there is a "rape allegation facing ... conservative

activist. .. James O'Keefe," referring to Plaintiff and certain allegations made by

Nadia Naffe at a municipal court probable cause hearing in Westwood, New

Jersey. A transcript of that hearing is attached hereto as Exhibit A. This

statement was not true when made and has been continually re-broadcast on

Current Media's website and has been repeated in print on Current Media's

website since the original television broadcast aired. The statements referred to in

this paragraph were made with knowledge of their falsity or a negligent or

reckless disregard for their truth and constitute slander and slander per se and the

written statements constitute libel and libel per se.

6. The Municipal Court Judge presiding over the matter in Westwood reviewed Ms.

Naffe's harassment complaint and her sworn statement submitted in support

thereof and then had the following exchange with Naffe:

JUDGE: In reviewing your certification, it's clear that there wasnothing that [was] set forth there regarding any striking, shoving,

include any allegations of physical contact, let alone allegations of rape.

Nevertheless, Olbermann and Current Media encouraged, permitted and endorsed

the contrary statements made by Shuster, described above.

9. Defendant Keith Olbennann is liable for his own statements and for the

statements made by David Shuster on Countdown as he approved and/or endorsed

the statements in his capacity as Chief News Officer and he further endorsed the

statements as they were and are being broadcast under his name.

10. Defendant Current Media is liable for the statements made by David Shuster and

Keith 01bennann because they were made in the course of their employment with

Current Media and Current Media re-broadcast and continues to re-broadcast

those statements by video and print.

COUNT ONE(DEFAMATION - Slander, Slander Per Se, Libel and Libel Per Se)

11. Plaintiff repeats and re-alleges the foregoing paragraphs of the Complaint as if the

same were set forth herein.

12. All of the statements referenced above attributed to any of the Defendants

constitute at least one of the following forms of defamation or defamation per se;

libel, libelper se, slander or slander per se.

13. Plaintiff has been damaged in that his reputation in his social and professional

communities has been injured. Others have and will continue to refrain from

associating with Plaintiff personally and professionally due to the actions and

statements of the Defendants described above. Particularly, and by way of

example and not quantification or limitation, the Defendants' false statement that

Plaintiff has been alleged to have raped a woman has irreparably banned Plaintiff

and monetary damages are presumed by law to arise from such an outrageous

malicious falsehood.

WHEREFORE, Plaintiff demands judgment against the Defendants individually,

jointly, and jointly and severally for all monetary damages permitted by law, plus a

mandatory injunction compelling the Defendant to publish a retraction with language

approved by the Court, costs, attorneys' fees and such other relief as the Court may deem

appropriate and just.

The Hale Boggs Federal Building, located at 500 Poydras Street, New Orl ans, Louisiana

70130, is owned and operated by the United States of America and managed by t e United States

General Services Administration (hereinafter "GSA"). The Hale Boggs Federal uilding houses

the offices of numerous federal agencies and federal officials, including the New rleans office

of United States Senator Mary Landrieu, As such. the office constitutes real pro rty belonging

to the United States.

In addition to Title] 8, United States Code. Section 1036. there are additi nal rules and

regulations governing conduct on federal property. These rules and regulations a e codified in

various portions of the United States Code. Title 41 of the Code of'Federal Regul tions, and in

the Local Rules. These types of laws, regulations and rules are meant to insure t safety and

security of the occupants, visitors. proceedings and buildings of the Federal gove

The General Services Administration ("GSA"). the United States Marshal

Court Security Officers, the Federal Protective Service. and the Federal Bureau 0 Investigation.

among others, are tasked. individually and collectively, with maintaining the h ig est level of

security for federal buildings in order to prevent incidents that could jeopardize t e safety and

security of people with business in the Federal Complex. As such, conduct in all ffices

contained in the Federal Complex is .governed by all of the laws, regulations, and rules.

On or about January 20, 20 I0, JOSEPH BASEL ("BASEL"), STAN D IUDAl"),

ROBERT FLANAGAN ("FLANAGAN"), and JAMES O'KEEFE C'O'KEE

Senator Landrieu and record the interactions using audio and visual equipment.

On or about the afternoon of January 23, 2010, FLANAGAN received a hone call from

O'KEEFE. during which O'KEEFE invited FLANAGAN to participate in their activities

concerning Senator Landrieu's office. O'KEEFE further invited FLANAGAN t meet the next

day to finalize the details and coordinate with the other participants.

On or about Sunday, January 24. 20 10, BASEL. DAI, FLANAGAN. and O'KEEFE.

met to practice how they would interact with Senator Landrieu's staff and record he interaction

with the Senator's staff the next day. During this meeting. the defendants discuss d what they

would wear--disguises to make-them look like telephone repairmen-and what e uipment they

would use to record the interaction.

At approximately 10:00 a.m. on or about January 25. 20 J 0, BASEL. FL AGAN, and

O'KEEFE met at an office located near the Federal Complex to finalize their pla ,check the

recording devices, and mount a small video camera in one of the disguises. Duri g the meeting

O'KEEFE explained to BASEL and FLANAGAN how the recording equipmen worked and

directed them how to position themselves inside of the office.

On or about January 25,2010, at approximately 1] :00 a.m., BASEL. FL

O'KEEFE entered the Hale Boggs Federal Building and passed through the secu ity screening.

DAI remained outside of the building to provide support for BASEL, FLANAG

O'KEEFE. BASEL and FLANAGAN each dressed in blue denim pants, a blue ork shirt. a

Jight fluorescent green vest, a tool belt, and carried a white, construction-style ha d hat. At least

one hard hat contained a video recording device, with a small camera installed on the brim of the

hat. O'KEEFE instructed BASEL and FLANAGAN to wait for him to enter th Senate office

first and to come in shortly thereafter. O'KEEFE then entered the New Orleans ffice of United

States Senator Mary Landrieu, Shortly thereafter. BASEL and FLANAGAN en red the office.

Upon entering the Senate office. BASEL and FLANAGAN stated to me

Senator Landrieu's staff that they were repair technicians from the telephone co pany and were

there to follow up on reports of problems with the telephone system. BASEL an FLANAGAN

were each wearing a white. hard construction hat. a tool belt, a fluorescent vest, a d denim pants

and tops. When BASEL and FLANAGAN entered the office, O'KEEFE positi ned a digital

recording device made to look like a cellular telephone in his hand so as to recor

FLANAGAN.

One of Senator Landrieu's staff members (WITNESS 1) told BASEL and FLANAGAN

that she did not report any phone problems and that the office was not experienci g any issues

with the phone system. WITNESS 1 then turned her attention to O'KEEFE and sked if she

could help him. O'KEEFE responded that he was waiting for a friend. who had sked him to

meet her in Senator Landrieu' s office.

BASEL asked WITNESS I for permission to test the phone system. and

WITNESS I directed him to a phone sitting on a desk reserved for a staff membe for Senator

Landrieu. BASEL then walked behind the desk, lifted the phone handset from th cradic,

questioned whether there was a dial tone. and handled the receiver. BASEL and LANAGAN

also pretended to call the phone with cellular phones in their possession. They to d WITNESS I

that they could not get through. O'KEEFE recorded these interactions.

BASEL also stated that he and FLANAGAN needed to perform repair w rk on the main

telephone system and asked to be taken to the "central box." WITNESS 1 stated hat she did not

know anything about the inner workings of the office phone system and told BA EL and

FLANAGAN that they would have to speak with a representative from GSA abo tit.

While in the office. in keeping with the pretextual story. O'KEEFE repre ented to

BASEL and FLANAGAN that he had recently attempted to place a call to the 0 Ice of Senator

Landrieu but that the call "wouldn't go through."

Subsequently, WITNESS I requested that BASEL and FLANAGAN ace mpany

WITNESS 1 to the main GSA office. Both men accompanied WITNESS 1to th

following her. encountered a manager with GSA. WITNESS I explained to the A employee

that BASEL and FLANAGAN had come to Senator Landrieu's office to repair t e phone

system. which was not in need of repair.

BASEL and FLANAGAN again said they were telephone repairmen, an BASEL asked

the GSA employee to take them to the phone system's "central box" so that they ould perform

repair work.

The GSA employee asked BASEL and FLANAGAN if they had a work rder or

credentials. BASEL and FLANAGAN responded that the work order and their redentials were

in their truck, which was parked just outside of the building, The GSA employee then informed

BASEL and FLANAGAN that he would escort them to their truck so that they c uld provide

the work order to him and present their credentials to him.

While WiTNESS I took BASEL and FLANAGAN to the GSA office, 0 KEEFE

remained in Senator Landrieu's office. He continued to record the office and the emaining staff

members. O'KEEFE stayed in the office for approximately six more minutes be ore pretending

to take a phone call from "Sam" and leaving the office.

Investigators with the Federal Bureau of Investigation and the United Sta s Marshal's

Office would testify that, in individual interviews on or about January 25, 2010,

FLANAGAN admitted that they were 'not telephone repairmen and that they ent red the office

of Senator Landrieu under false pretenses. OtKEEFE further admitted that he panned the

activity and recorded BASEL and FLANAGAN inside of Senator Landrieu's of Ice.

admitted in individual interviews that they collectively brain stormed scenarios t engage the

Senator's staff in conversation, which they ...would record. BASEL, DAI, FLAN GAN, and

O'KEEFE admitted that they worked together in the planning, coordination, and preparation of

the activities.

In this case, further investigation did not uncover evidence that thedefen ants intended

to commit any felony after the entry by false pretenses despite their initial statem nts to the staff

of the Senatorial office and GSA requesting access to the central.phone system. nstead, the

Government's evidence would show that the defendants misrepresented themsel s and their

purpose for gaining access to the central phone system to orchestrate a conversati n about phone

caJJs to the Senator's staff and capture the conversation on video, not to actually mper with the

phone system, or to commit any other felony.
