After hearing the counsel for the petitioner on 23.05.2016 the Hon'ble Court ordered

as under:-

"Learned counsel for the petitioner, inter alia, contends that as per Rule 2.5 of

the Punjab Civil Service Rules, a correction in the date of birth is to be made by the

competent authority i.e. respondent No.1 and only a clerical mistake can be rectified by the Director. In the present case, after getting necessary certificate (Annexure P-3), the date of birth was to be finally decided by respondent No.1 and not by the Director.

Notice of motion.

On the asking of the Court, Mr. Hitesh Pandit, Addl. A.G., Haryana, accepts notice on behalf of respondent-State and seeks time to get instruction. Copy of this petition be given to learned State counsel during the course of the day".

I have examined the case file of Sh. Banwari Lal Kaushik. The petitioner joined

Govt. Service as Science Master on 07/11/1986 on adhoc basis and his services

were regularized w.e.f 01.01.1991. He has requested to change the date of Birth as

20.02.1964 in place of 06.12.1962 written in his academic certificate. The date of

birth of Govt. employee was entered in service book as per provision made in rule 2.5

(Note-1) of Punjab Civil Service Rules as under:-

"Every person newly appointed to a service or a post under Govt. should at the time of appointment declare the date of his birth by the

Christian era with confirmatory evidence as far as possible

confirmatory documentary evidence such as matriculation certificate, municipal birth certificate as so on. If the exact date is

not known as approximate date may be given. The actual date or

the assumed date determined under note I below should be recorded in the history of service, service book or any other record

that may be kept in respect of the Govt. Employee's service under

Govt. and once recorded, it cannot be altered except in the case of

clerical error, without the previous orders of Govt."

q In such a matter, Rule 7.3 (Supra) says that a declaration regarding the date

of birth or age made at the time of, or for purpose of entry in to Govt. Service,

shall as against the Govt. employee in question, be deemed to be conclusive

unless he applied for correction of his age as recorded within two years from the

date of his entry in govt. Service. No application submitted beyond the stipulated

period of two years for change in date of birth will be entertained.

As per the above mention rule, he could have applied for correction his

date of birth within 2 years from the date of his joining in Govt. service. But he

applied for after 27 years. of his entry in Govt. service without any justification for

his long period and the petitioner is seeking change his date of birth which is not a

clerical error and was entered on the documents produced by him at the time of

joining in Govt. service.

In the light of Chapter-VII rule-7.3 of Punjab Financial Rules, Volume-1, the

matter has been considered in detail and the undersigned is of the considered view

that there is no merit in entertaining such a request made after 27 years for correction

in date of birth, especially for someone who is educated and have been working as a

teacher. Therefore, the claim of the petitioner is hereby rejected.

Subject:- Recognition Certificate for the School under sub-rule (4) of rule 12 of Haryana State Right of Children to Free and Compulsory Education Rules, 2011 for the purpose of Section 18 of right of Children to Free and Compulsory Education Act, 2009.

With reference to your application and subsequent correspondence with the

school/Inspection in this regard, I convey the grant for provisional recognition to Blue Angels Global

School, Sec-39, Charmwood Village, Surajkund Road, Faridabad for class 6th to 8th with effect from

01.04.2017 run by Managing Committee GD-20, Khasra No. 380, Pul Prahlad Pur, New Delhi-110044.

The above sanction is subject to fulfilment of following conditions:- 1. The grant for recognition is Class not extendable and does not in any way imply any obligation to recognize /affiliate beyond Class VIII. 2. The school shall by the provisions of Right of Children to Free and Compulsory Education Act, 2(1(19

and the Haryana State Right of Children to Free and Compulsory Education Rules 2011. 3.The school shall admit in class 1, to the extent of the Strength of that class. Children belonging to weaker section and disadvantaged group in the neighbourhood and provide free and compulsory elementary education till its completion: Provided, that in case of pre primary classes also, this norm shall be followed.

4.For the children referred to in paragraph 3, the school shall be reimbursed as per sub section (2) of section 12. "l'o receive such reimbursements school shall provide a separate bank account. 5. The school shall not collect any capitation fee and subject the child or his or her parents or guardians

to any screening procedure. 6.The school shall not deny admission to any child for lack of age proof. If such admission is sought

subsequent to the extended period specified for admission, the same shall not be denied and the child shall not be discriminated on the ground of religion, caste or race, place of birth or any of them.

The school shall ensure that :- (i) no child admitted shall be held back in any class or expelled from school till the completion of elementary education in a school; (ii) no child shall be subjected to physical punishment or mental harassment; (iii) no child is required to pass any board examination till the completion of elementary education. (iv) every child completing elementary education shall he awarded a certificate as laid down under

rule 22: (v) inclusion of students with disabilities /special needs as per provision of the Act; (vi) the teachers are recruited with minimum qualifications as laid under section 23(1) of the Act.

Provided further that the current teachers who, at the commencement of this Act do not posses minimum qualifications shall acquire such minimum qualification within a period of 5 years;

(vii; the teacher performs its duties specified under section 24(1) of the Act; and (viii) the teachers shall not engage himself or herself for private teaching activities.

7. The school shall follow the syllabus on the basis of curriculum laid down by academic authority. 8. The school shall enroll students proportionate to the facilities available in the school as prescribed 19. 9. The school shall maintain the standards and norms of the school as specified in section 19 of the Act.

The facilities reported at the time of last inspection are as given under :- (i) Area of school campus total built up area. (ii) Area of play ground (iii) Number of class rooms (iv) Room for Headmaster-cum-Office-cum-Store room (v) Separate toilet for boys and girls (vi) Drinking Water Facility (vii) Kitchen for cooking Mid Day Meal (viii) Barrier free Access (ix) Availability of Teaching Learning Material /Play Sports Equipments/Library.

10.No unrecognized classes shall run within the premises of the school or outside in the same name of school.

11.The school buildings or other structures or the grounds are used only for the purposes education and skill development. 12.The school is run br a society registered under the Societies Registration Act, 1860(21 of 1860), or a

public trust constituted under any law for the time being in force. 13.The accounts should be audited and certified by a Chartered Accountant and proper accounts

statement should be prepared as per rules. A copy each of the statements of accounts should be sent to the District Elementary Education Officers every year. 14.The recognition code Number allotted to your school is 3384/FBD/8th/BOSE/2017. This may please

be noted and quoted for any correspondence with this office. 15.The school furnishes such reports and information as may be required by the Director of Education/District Elementary Education Officer from time to time and complies with such

instructions of the State Government/Local Authority as may be issued to secure the continued fulfillment of the condition or recognition or the deficiencies in working of the school. 16.Renewal of Registration of Society, If any be ensured. 17.0ther Condition as per Annexure

the subject cited above. The Medical Reimbursement case of Sh. Bhagwat Singh, ESHM, GMS

Dharsu, Distt. M.Garh for the treatment of his Mother from 21.09.2016 to 29.09.2016 at Pooja Hospital, Narnaul is sent to you in original to do the needful as per the DSE letter No. 10/30-2011 Adman. (4) Dated: 25.10.2012 that confers the power to sanction the bills for medical reimbursement to the Head of Office up to Rs. 50,000 & 1,00,000 that has been further extended up to 3,00,000/-as per Health Department, Haryana letter No. 2/24-2013 IHB-III dated 19.09.2016.

The Administrative Department has granted relaxation in the policy for the treatment taken in an unapproved hospital as per guidelines issued by Finance Department, Haryana and Health Department, Haryana time to time.
