5.0 DISCLOSURE OF INTEREST
The provision of Chapter 14 of the NSW Local Government Act 1993 and Council’s Code
of Conduct regulate the way in which Councillors and staff of Council conduct
themselves to ensure that there is no conflict between their private interests and their
public trust.
The Act prescribes that where an official of Council (or a Committee of Council) has an
interest in a matter to be considered at a meeting of the Council (or Committee), that
interest must be disclosed as soon as practicable after the start of the meeting and the
reasons for declaring such interest.
Recommendation
That Councillors and staff now disclose any interest in the matters under
consideration at this meeting, describe the nature and type of interest, and in the
case of ‘less than significant on pecuniary interests’ the reasons why they
consider the interest to be non significant.

RECOMMENDATION
That Council notes the General Manager’s Report for November 2014.
INTRODUCTION
The following report provides an update for Councillors on current strategic Council
related issues including initiatives to address these and specific activities undertaken
by the General Manager over the past month.
STRATEGIC PROJECTS
“Fit for the Future”
The Office of Local Government (OLG) has been conducting a range of meetings
and workshops over the last month, as they roll out further information regarding the
“Fit for the Future” suite of Local Government Reform Programs.

I received an invitation from OLG, to attend a meeting in Sydney in early October as
one of 12 General Managers representing a diverse range of Councils. This diversity
was evident from their size, geographic locations TCorp placements and positioning
within the panel's recommendation tables. The group was invited to provide input
and feedback on the initiatives featured in ”Fit for the Future" and how the Office can
provide strong support and assistance to General Managers and Councils’ in
navigating the Programs.
The Mayor and I also attended a workshop in Dubbo in early November regarding
the development of a Rural Council Model. OLG are seeking input from Councils
including the challenges and opportunities for Rural Councils, to assist them in
developing the framework on what a Rural Council Model will look like.
There is another workshop to be held in early December regarding the self-
assessment process which has a strong operational focus. This workshop will be
attended by myself and the Director Community Services and Governance.
As all the final information has not yet been completed it is recommended that a
report regarding “Fit for the Future” be presented at the December Meeting of
Council.
In relation to the Joint Organisations Models, The Office of Local Government has
announced which applications were successful in their expression of interest to be a
trial Joint Organisation and the application by Centroc was one of the five successful
applications.
Christmas Trees
Council’s fully decorated and beautifully lit Christmas Trees that made their debut in
Condobolin and Lake Cargelligo last year will be erected in Condobolin on Monday 1
December and in Lake Cargelligo 2-3 December. The lights of the Condobolin tree
will be officially turned on as part of the Fiesta on Thursday 4 December and the
Lake lights will be officially turned on Friday 5 December. A competition open to
young residents of the Shire, 12 years and under, will be conducted in both locations
with a lucky child in each location winning the honor of officially turn on the lights.
Entry forms will be available from Council Offices, Council’s website and local
papers over the next week.

The planning for the Annual Lachlan Christmas Fiesta to be held on Thursday 4
December 2014 is well under way. Traffic Management Plans have been adopted
by the Traffic Committee and after a planning meeting with local businesses held at
the end of October, this year’s event will commence at 5.00pm and finish at 9.00pm
with the official lighting of the Christmas tree to occur at approximately 8.30pm.
Aboriginal Advisory Committee
The Inaugural Meeting of Council’s Aboriginal Advisory Committee was held on
Tuesday 11 November at the Wiradjuri Centre. This was a symbolic event with the
new Committee expressing their passion and priorities for ensuring their participation
in this Committee will deliver positive outcomes for members of Lachlan's Aboriginal
Community.
The community representatives voted for the Chair and Deputy Chair at the meeting
and Kevin Read was elected as the Committee’s Chair and Dave Carter elected as
the Deputy Chair.
A formal report will go to the December Ordinary Meeting of Council to formally
adopt the Committee’s Terms of Reference.
The next meeting of the Committee will be held on Friday 13 February 2015.
Entry Statements
The first of the new entry statements into Condobolin has been completed on the
Diggers Avenue entry into town. In keeping with the ‘Ultimate Bush Experience’
theme, the steel based design incorporates elements that are synonymous with
farming and bush culture with a tractor, working dog and wheat featuring in the steel
cut outs. This statement also includes elements of some of the lost history of the
local area utilising some of the metal beams that were retrieved from the ruins of the
Renown Theatre fire.
The other statement that is currently being constructed on the Parkes Road entry
into Condobolin is expected to be finished by the third week in November. This

design also in keeping with the bush and farming theme will feature a 5 metre high
windmill amongst other innovative concepts.
Community Strategic Plan
The Draft Community Strategic Plan is on Public Exhibition until 26 November 2014.
The community is encouraged to review the Plan and provide any submissions or
proposals to Council by the due date.
Submissions received will be considered and the Final Plan will be presented to
Council for adoption at the December Ordinary Meeting of Council.
The Plan is the guiding document that directs Council’s strategic business and will
direct and inform the development of the 2015/2016 Delivery/Operational Plan with
workshops in the development of the Delivery Plan commencing in January 2015.
Council Christmas Shut Down Period
The official Christmas Shut Down period will be as follows:
Outdoor Teams last day Friday 19 December return to work Monday 5
January 2014.
Indoor Teams Council Offices, Libraries, Child Care and HACC Service will
close at 12.00noon on Tuesday 24 December and re open 8.30am Monday 5
January 2014.
Appropriate notification of the shutdown dates will be made on Council’s website,
notices on office and library outlets, Facebook and advertisements will be placed in
the Lachlander, Argus and Lake News.
A recorded message on Council’s telephone system and out of office reply to the
Council Connect email address with directions for urgent matters will also be put in
place.
A listing of skeleton staff details and contacts will be forwarded to Councillors before
the Christmas Break.
LGNSW Conference
The Annual Local Government NSW Conference was held in Coffs Harbour on 20 -
21 October. I attended the conference along with our Mayor, Deputy Mayor and
Councillor Brady.

The Premier of NSW The Hon Mike Baird provided the opening conference address
and the Minister for Local Government The Hon Paul Toole delivered a presentation
on “Fit for the Future”. A great deal of discussion from the presenters and from the
floor centered around the Local Government Reforms.
Tourism
As part of our tourism strategy and in keeping with our branding of ‘Your Ultimate
Bush Experience’ theme, Council again presented the Shire as an exciting visitor
destination at the Annual Canberra Home, Leisure, Caravan, Camping. 4WD, and
Outdoors Show held in at the Exhibition Centre in Canberra from 24 to 26 October.
Elements of our new tourism brochures and collateral were released at the show
highlighting the Bush Camping theme for Lachlan. The new Bush Camping brochure
showcases Lachlan as a great destination for the caravanning and RV Motorhome
market with a range of formal caravan parks that are complemented by freedom
camping sites across the Shire.

INTRODUCTION
In accordance with the Integrated Planning and Reporting Guidelines for Local
Government in NSW, Council is required to prepare an Annual Report within five
months of the end of the financial year.
The Annual Report is one of the key points of accountability between Council and its
community.
The Office of Local Government in the distribution of the Integrated Planning and
Reporting Guidelines, have reminded Councils that the Annual Report focuses on
Council’s implementation of the Delivery and Operational Plan as these are the
specific plans that are the responsibility of Council.
Whilst a copy of the Annual Report must be submitted to the Minister for Local
Government, the Office of Local Government stresses that it is a report from each
council to their community.
A requirement of Section 404 of the Local Government Act 1993 is that an annual
report in the year of the ordinary election will also include an outline of achievements
in implementing the Community Strategic Plan.
The Local Government elections were held in September 2012; therefore the
2013/2014 Annual Report includes an outline of the achievements from the
Community Strategic Plan “Living Lachlan Style” 2013-2023.
BACKGROUND
As of 30 June 2012, all Councils across NSW are required to be working within the
Integrated Planning and Reporting Framework. This framework includes the
development of a Community Strategic Plan, Delivery Program, Operational Plan
and an Annual Report.
The Integrated Planning and Reporting framework encourages Councils to draw their
various plans together ensuring all these plans have links to each other and are all
following a cohesive path.
This new framework has encouraged greater interaction and engagement between
Councils and their communities. The Community Strategic Plan ensures the
aspirations of communities are clearly understood and a collaborative “whole of
community” approach is adopted in achieving the specific needs of each community.

DISCUSSION
The preparation of the Lachlan Shire Council 2013/2014 Draft Annual Report has
been undertaken within a “whole of Council” framework. It has included the
involvement of all streams of Council and is a collaborative work.
All requirements outlined within section 404 of the Local Government Act 1993 and
Clause 217 of the Local Government (General) Regulations, have been met.
FINANCIAL AND RISK
There are no financial implications of this report. The risk in not preparing an Annual
Report is that Council would be in contravention of its legislative requirements as
detailed in the Integrated Planning and Reporting Guidelines.
ENGAGEMENT
The Development of the Community Strategic Plan and its review in April, 2014
included comprehensive engagement with the diverse communities of Lachlan and a
range of stakeholders from government agencies and community organisations.
The review of Council’s Delivery and Operational Plan in May ensured the Plan and
Budgets were out on public exhibition for the required time period and that members
of the community had the opportunity to comment on the Plan.
CONCLUSION
The 2013/2014 Lachlan Shire Council Annual Report provides a comprehensive
overview of Council’s achievements in the 2013/2014 financial year. The Report
clearly demonstrates Council’s commitment to working collaboratively with its
communities and other stakeholders in achieving its vision for the future where:
“Everything is possible, for all”.

INTRODUCTION
This report provides Councillors with an update on the activities of the Director
Community Services and Governance for November 2014.
OVERVIEW
Work this month focused on continued engagement with Council staff regarding the
development of Council’s 2014 Enterprise Agreement and finalising the end of year
financial statements.

Preliminary work was completed on a review of Council’s Procurement Review
Project. An analysis of Council’s spend and accounting data was used to refine the
project’s Terms of Reference and the project has now commenced.
A meeting was to have been held with the Whiddon Group’s Chief Executive,
Council’s General Manager and I prior to Council’s November meeting in relation to
the Condobolin District Retirement Village. This has now been rescheduled at
Whiddon’s request to 3 December 2014. A report on the Agreement and
implications for Council has been prepared but held over to the December meeting
so outcomes arising from this meeting can be included in the paper.
I have continued to work closely with Western Plains Regional Development Inc.
(WPRD) to develop a Strategic Plan for WPRD and a related funding agreement with
Council. This is designed to assist WPRD to identify youth develop opportunities
and potential funding sources which can then be strategically assessed against
agreed performance indicators for reporting to its Board.

ENGAGEMENT
Council’s investments are discussed with and monitored by CPG Research and
Advisory which have been retained for this purpose.
FINANCE AND RISK
The investment environment continues to operate at a lower interest level. This is
unlikely to change in the short term. Council’s investment advisor recommends that
where cash flow permits, investments should focus on the three to four year range
where rates are more attractive.
CONCLUSION
Investments will continue to be managed so Council can meet its cash commitments
when they fall due. Where possible, investments will target three to four year terms.

INTRODUCTION
What follows is a summary of the activities of the Director Environment and Planning
for the last month.
PROJECT AND STRATEGIC UPDATE
SRA Hall
The Condobolin Show Society are currently in discussions with Graincorp regarding
the possibility of taking ownership of the materials that form the Derriwong Silo Shed
which they understands may be surplus to Graincorp’s needs. The Shed’s 21 steel
portal frames which have a free span of 20m are in excellent condition and could be
dismantled and re-used for the proposed SRA Hall, while the remaining framing

would require disposal and the corrugated steel roof sheeting and cladding could be
recycled to generate income and contribute towards costs. It’s considered that this
proposal would save Council and associated stakeholders around $100K in total
budget costs. The prospect of acquiring the steel portal frames for no cost opens-up,
but also closes, a number of design possibilities which overall will provide increased
opportunities, but at the expense of staging segments of the project to suit the
incremental sourcing of funds, which for Council and its partners, will pose financial
challenges.
By re-using the Graincorp portal frames the proposed SRA Hall would be 20 x 60m
overall in plan, making it far larger in volume compared to the existing facility. This
additional space means that an integrated design solution can be accommodated
which allows for an efficient layout with all facilities including kitchen, bar, toilets and
stage amenities being located within the one building. The impact of this in terms of
function and form means that improvements to security, disabled accessibility,
spatial connectivity, functionality and building appearance will have a positive
influence on end-users and enhance the commercial appeal of the facility to
hopefully attract a broader range of events, increased capital returns, and reduced
maintenance costs.
Generally speaking, this proposal provides ‘more bang for the buck’ than other
potential options previously discussed, but the downside is that the kitchen and toilet
facilities cannot be built at later stages due to space limitations as the new hall will
have to be partly sited where the existing kitchen and toilet facilities are located. If
this obstacle can be overcome a number of opportunities will arise, whereby, a new
pad level across the entire site can be provided all in one go, instead of building up
to one consistent level over a number of stages. This will alleviate the need to
provide expensive stairs, ramps and retaining walls which will only have to be
demolished at a later stage if a multi-staged proposal is alternatively selected.
Another benefit in demolishing the toilets and having them relocated within the new
hall is that views across to the arena/oval from the hall will be greatly enhanced,
providing the opportunity to have a prime multi-purpose outdoor zone housed under
the existing covered annex to suit market events, dining and other entertainment
activities. Such a space with hard and soft landscape finishes would replace the
existing enclosed dining room which is unappealing and remains unused.

Other improvements which feature in this new SRA Hall proposal include the
provision of a dedicated entry, performance stage and ancillary stores; Outdoor and
indoor food and beverage serveries; and, toilets which can be accessed internally or
externally. Additionally, improved truck circulation and dedicated loading areas to
efficiently service the kitchen and bar hub to the west, and the stage performance
areas located at the other end of the building can also be accommodated.
As the construction of the base building of the proposed hall cannot be staged, an
alternative approach to spreading costs over time could be to limit the scope of the
fit-out to the bare basics and to upgrade internal finishes and amenities at a later
date as funds become available. This can be achieved by installing the stage,
outdoor landscaping, operable roller shutter doors, ventilation fans, roof insulation,
bar and kitchen fit-outs, stage lighting and sound systems at later stages. Doors from
the existing hall and kitchen fittings and fixtures could also be re-used in the new hall
to reduce costs.
The standard of thermal comfort to be provided for the new hall is also a crucial
consideration and will impact on the commercial success of the new hall, with the
construction of a new hall providing the opportunity to increase standards to meet
contemporary expectations. Possibilities open for consideration include the addition
of a clerestory along the roof ridge line which would provide a venturi effect by
extracting hot air, the provision of wall and roofing insulation, ceiling fans and banks
of operable roller shutter doors to promote ventilation. Naturally, these are all items
which will impact on the decision making process effecting the projects bottom-line.
The prospect of re-using Graincorp’s steel portal frames provides Council and its
partners the opportunity to procure a significantly larger building in comparison to
other options previously explored, but for similar costs. The biggest barrier however,
is the difficulty of having to largely fund the project in one stage. Despite this, the key
benefits of this option include;
Integration of all amenities within the one structure
Provision of modern electrical and hydraulic services to reduce maintenance
costs
Opportunity to provide improved thermal comfort conditions

Raised pad level height to make the building flood proof

Opportunity to provide adequate lighting and sound amenities to broaden
entertainment capabilities and commercial appeal, leading to increased rental
income.

recent community meeting once more is known about the Show Society’s
negations with Graincorp in relation to the Derriwong facility.

Canberra Home Leisure Caravan 4WD and Camping Show
From Friday 24 to Sunday 26 October Council was represented at the Canberra
Home Leisure Caravan 4wd and Camping Show. The show attracted almost 100,000
people. Many of these people walked past or dropped in to the ‘Lachlan Shire – Your
Ultimate Bush Experience’ display and were impressed by what the Shire offers to
visitors. Many people remarked that they had spent much time visiting coastal areas
and that they were looking to inland destinations for future travels.
Building Services Team Update
During the month of October the Building Services Team has been engaged in
maintenance of Council fixed building assets. Work has progressed on bringing an
extended Building Assets Register up to date to complement our Special Schedule 7
report.
Quotations were called and have now closed for the installation of shade structures
for the Condobolin Skate Park. An order has placed for these structures with

Greenline Group Pty Ltd. Turf, water reticulation augmentation and some park
furniture will also be installed in the near future.
Installation of a new accessible two bedroom cabin and service connections to the
Tottenham Caravan Park is almost complete.
The installation of the second hand toilet block and septic and water connections to
the Fifield Sports Ground is complete.
The work to the new office at Lake Cargelligo Caravan Park is progressing well and
completion is expected by sometime in December.
Annual inspections were carried out at Riverview Caravan Park in Condobolin and
Lakeview Caravan Park at Lake Cargelligo by rating agency AAA Tourism. The star
ratings for both parks remained unchanged at 3.5 stars for Riverview and 3 stars for
Lakeview which is a positive result. In order to improve these ratings, considerable
capital works would need to be undertaken.
Riverview Caravan Park has been receiving outstanding customer feedback reports
and the new contractors at Lake Cargelligo are impressing with their enthusiasm.
Number 3 Whiley Street has been prepared for Auction by Ray White Condobolin as
per Council Resolution. It is expected that it will be offered at an auction prior to the
end of the year.
The Tourist Information Centre at Lake Cargelligo was recently broken into. Newly
installed motion sensors prevented further damage or theft by activating the alarm
system.
Tyres Shredded at Condobolin Waste Facility
Almost 5000 tyres were shredded by a local contractor at the Condobolin Waste
Facility in late October. These tyres are permitted to be landfilled now that shredding
has significantly reduced their bulk. A local primary producer also took 1500 tyres to
use as weights for tarpaulins. A reduction of 6500 tyres from the stockpile at the
facility significantly reduces the risk of fire and also brings the facility into alignment
with the new Waste Regulation that commenced on 1 November 2014.

FINANCE AND RISK
Council has assessed all applications against relevant legislation to minimise
Council’s risk exposure. All fees associated with the applications referred to herein
have been paid.
CONCLUSION
The statistics provided for the month of October 2014 as compared to applications
received in the corresponding month in 2013 have similar quantitative value but
capital, investment value figures for applications is reasonably higher than the 2013
data. To date, Development Application and Complying Development Certificate
data reveal a healthy value of over $2.4 million for applications received in this
financial year.

INTRODUCTION
From 1 November 2014 Lachlan Shire Council will be exposed to regulatory and
financial risks if it does not change the way it operates its waste facilities due to the
introduction of new waste regulations across New South Wales (NSW). While a
separate report herein discusses these matters, this report focuses on changes to

the Protection of the Environment Operations (Waste) Regulation (POEO) 2014
which came into effect on 1 November 2014
BACKGROUND
From 1 November 2014 approximately thirteen new laws will be implemented
effecting change to the waste regulatory framework. The following laws are
changes to the POEO Act 2014 which directly relate to the management of
unlicensed landfill operations;
Proximity principle – It will be an offence to transport waste generated in NSW
by motor vehicle for disposal more than 150 kilometres from the place of
generation.
Improving resource recovery exemptions - Additional obligations will be
required of generators, processors and consumers who supply or receive
waste intended to be beneficially applied to land, reused as fuel or reused in
connection with a process of thermal treatment.
Prescribed wastes for land pollution offence - Section 142A provides an
offence for a person who pollutes land. These wastes include: hazardous
waste, restricted solid waste, 10 tonnes of asbestos waste, 5 tonnes of waste
tyres or more than 500 waste tyres.
Improving immobilisation of high-risk contaminants - Generators or
processors of waste that is subject to an immobilised contaminants approval
(generally hazardous waste) will be required to issue a certificate confirming
the waste has been treated in accordance with EPA requirements for lawful
re-use or disposal.
Land pollution defence for unlicensed landfills - The POEO Act introduces a
defence for waste operators in the event of environmental impacts causing
land pollution at unlicensed landfills. Waste operators who implement controls
to reduce risks such as fire and odour/noise/dust emissions, control of public
access to the premises, and general maintenance of the facility, will, within
reason, be protected against prosecution.
Reduced licensing thresholds for waste activities - New thresholds at which
the processing, recovery, and storage of waste trigger the requirement to hold

an environment protection licence have been introduced. For waste facilities
outside the regulated area a maximum volume of 2500 tonnes or 2500 m3 on-
site at any time and processing more than 12,000 tonnes or 12,000 m3 a year
before a license is required.
Waste tyre monitoring and licensing - New requirements relating to transport
and licensing thresholds for the storage and processing of waste tyres will be
introduced with a proposed threshold of 5 tonnes or 500 units of waste tyres
allowed to be stored on-site at any one time.
Asbestos waste monitoring - From 1 July 2015, loads of asbestos waste will
be assigned a unique consignment code to allow the EPA to monitor their
movement from site of generation to disposal. All waste transporters will be
required to record the movement of more than 100kg of asbestos waste or
more than 10 square metres of asbestos sheeting.
DISCUSSION
How will these new laws impact on Lachlan Shire?
To accommodate these legislative changes additional costs will be imposed on the
waste budget. Alternatively, if Council choose to ignore these new requirements by
overlooking our duty of care Council will be exposing itself to increased risks relating
to potential environmental and Work Health and Safety (WH&S) incidents which may
include; Penalties awarded against Council as a consequence of prosecution for
legal non-compliance; Damages awarded against Council for negligence as a
consequence of environmental or WH&S incidents; And indirectly, increased
insurance premiums.
What are our greatest risks?
To be proactive in meeting our obligations and to reduce risk to acceptable levels,
the key changes to legislation impacting on Council includes;
Prescribed wastes for land pollution offence – To avoid penalties council must
have better control over user behaviour at our waste facilities; this may
include manning all waste facilities to increase user observation effectiveness
to ensure wastes aren’t illegally disposed.

Land pollution defence for unlicensed landfills – Council will be exposed to
increased penalties for litter, odour, noise and dust pollution and illegal
burning if penalties aren’t enforced for illegal behaviour, especially if
safeguards to deter illegal behaviour aren’t implemented. Furthermore,
additional maintenance costs for improved litter control will also impact on the
waste budget. Council will probably have to choose between manning its
waste facilities or to provide weekly cover to the general waste cells to meet
these new obligations.
Waste tyre monitoring and licensing – Chipping and disposal of waste tyres
will have to be undertaken on a more regular basis. This should not impact on
overall costs but will potentially reduce the number of waste facilities in the
Shire where waste tyres can be stockpiled for disposal.
Asbestos waste monitoring – New Council management systems and
procedures will need to be developed and implemented which will impact on
staff resourcing.
The Unknowns
Much debate exists within the waste industry relating to the impacts and the
interpretation of the new laws. Areas of ambiguity for Lachlan Shire include the
possibility that the Condobolin Waste Facility may require licensing depending on the
waste stream classifications that are to be included in capacity calculations. Council
will be conducting volumetric assessments in the near future to evaluate If this
proposal will apply to the Condobolin Waste Management Facility. Such a change
would have dire consequences for budgeting where greater monitoring requirements
will need to be implemented.
In order to clarify the potential costs to Council, consultant Bob Bailey who recently
developed the five Lachlan Shire Waste Action Plan options, will be assisting Council
in interpreting the new requirements and developing solutions in line with the waste
action plan options.
ENGAGEMENT
The impact of these legislative changes will be outlined to stakeholders and
ratepayers alike at the upcoming Waste Management Discussion meetings to be
held at;

In anticipation of these legislative changes, Council developed five potential waste
management options for the Shire. The purpose of these meetings is to discuss the
options and to receive community feedback on the community’s waste management
service expectations. This feedback, in balance with legislative and budgetary
considerations, will assist Council in devising waste management plans for the
future.
FINANCE AND RISK
Council must choose between undertaking its waste operations differently if it’s to
meet increased environmental and WH&S commitments, or alternatively, establish a
contingency fund to pay for future penalties and potential damages. Both options will
be costly and either a reduction in service levels or an increase to the waste budget
via increased fees to users will be required to meet future needs.
CONCLUSION
The four Lachlan Shire Waste Action Plan options that have been developed in
response to potential changes to the legislative waste framework have been
canvassed for community feedback. Now that the proposed legislative changes have
been introduced, Council now finds itself in a position of certainty where it can more
effectively assess the legislative changes to adopt a waste plan model that’s best
suited to meet a combination of legislative requirements, risk exposure, budgetary
limitations, and the Shire’s future waste needs.

INTRODUCTION
Proposed changes to the Waste Regulations by the NSW Government have led to a
review being undertaken on the operations of Council’s waste management facilities.
Council has conducted stakeholder engagement on the more plausible options
identified in the review and is now reporting back to Council with recommendations
for change.
BACKGROUND
In September 2014, a report was presented to Council on the NSW Government’s
proposed amendments to the Waste Regulations (made under the POEO Act 1997)
and described the manner in which these changes, if adopted, would affect how
Council may need to responds in the future management of its waste facilities.
In anticipation of the introduction of the amendments to the Waste Regulations, a
“Waste Facilities Management Plan” was commissioned and received by Council
that examined the operation of its waste facilities, identified improvements to current
performance and contained a range of options for the future management of these
sites. The report also included measures to mitigate risk and potential actions to
consider in response to the likely changes to the Waste Regulations.

Plan” and linked to the Waste Less Recycle More (WLRM) grant opportunities.
WLRM is an initiative of the NSW Government with the aim of increasing resource
recovery and improving environmental outcomes, with the grant funding coming from
the Section 88 Waste and Environment Levy.
The State Government has now announced the opening of applications, with a
closing date of 8 December 2014, for the program to support regional and rural local
councils with Landfill Consolidation/Closure and Environment Improvement. The
availability of this grant opportunity links directly with the future management of
Council’s waste facilities and a criterion of the grant application assessment is for
Council’s to have undertaken stakeholder consultation.
Stakeholder consultation has now been completed with community forums being
conducted at Lake Cargelligo, Condobolin and Tottenham. Participants at the forums
were provided with background information, a number of options were presented for
the future management of Council’s waste facilities and the implications of changes
to the existing services were explored. Those attending the forums interacted,
offered their views and provided important feedback and suggestions on the options
presented. It must be stated that those attending represented only but a small
proportion of Shire residents.
Although the operations of the Condobolin Waste Facility were not a formal part of
the community forums, the generous opening days and times of this facility were
raised at the Tottenham forum and the meeting was advised that there is a contract
for the management of the site for a further 18 months and changes may not be
feasible at this stage of the contract. However, Council could enter into negotiations
with the incumbent contractor, TG & FB Ross, with the aim of making amendments
to the contract that would see a reduction in the opening days and times of the
facility. Should the contractor be amenable to such discussions, any agreed options
for the operations of the facility could be presented at a future forum for Condobolin
residents.

Given any changes to the operations of the Condobolin Waste Facility would not
affect an application through Waste Less Recycle More grant funding for Council’s
other waste facilities, there is sufficient time available to conduct the negotiations
with TG & FB Ross and to undertake a community forum for Condobolin residents.
DISCUSSION
Those attending the forums universally agreed that the “business as usual” option
would be irresponsible for the operation of Council’s waste facilities and would do
nothing to mitigate the identified risks and there was consensus that the waste
facilities should be controlled and supervised when open to the public as a principle
means of risk management. There was overall agreement that improvements to the
manner in which the sites were being managed needed to be undertaken.
There was recognition that providing supervision to the sites would improve waste
separation and could increase the recovery of scrap steel, however, supervision
would come at a cost and this would be reflected into the Domestic Waste
Management Charge and into the Waste Facility Contribution Charge. Significant
increases to these charges would not be welcomed.
The question was raised as to the value of scrap steel recovered and sold each year.
The response from Council was that the figure is about $160,000 and has historically
been directed towards community grants, though this year it went to consolidated
revenue. Given any landfill closures that may result from the recommendations of the
community engagement would be largely supported by WLRM grant funding, the
revenue from the future sale of scrap steel may be needed for landfill closure and
landfill environmental improvements should the WLRM grant applications not be
successful.
Closing some sites and limiting the hours of operation of others was seen as a
means of reducing costs and that the option of transfer stations as an alternative to
landfills was considered too expensive, based on the current costs to operate the
Derriwong transfer station.
There was no opposition to introducing fees for commercial waste, builder’s waste or
large tyres and this was seen as “user pays” and an opportunity to help meet the
likely increased costs in the operation of the waste facilities. Some attendees

expressed concern that the recently introduced fees for commercial wastes at the
Condobolin waste facility had been discontinued.
There was discussion on what would be an acceptable distance for residents to
transport their bulky wastes to a centralised landfill should some local landfills be
closed and a domestic waste collection service provided. The consensus was “about
60 kilometres”.
Council initiated kerbside “bulky waste clean ups” were suggested as a means for
assisting residents who do not have access to utes or trailers as a way of disposing
of unwanted bulky goods too large to put into the kerbside waste receptacle.
Should Council resolve to close some landfills, it was suggested that there be a
transition period, of perhaps three months, where the kerbside waste collection was
introduced and the local landfill was closed. This would enable residents to dispose
of bulky wastes before the landfill was closed.
There was support for including incorporated community groups in bidding on
contracts that may be tendered for the supervision of waste facilities. This would not
preclude Council from using its own workforce to supervise sites nor inhibit the
extension of existing contracts to expand into waste facility site supervision.
There was concern that some residents and business operators who do not live
within Lachlan Shire were using the Shire’s waste facilities and not contributing to
their operation. The option of controlling (locking up) the sites and providing
supervision during opening hours was considered a suitable solution. It was
suggested by the floor that Lake Cargelligo should be open four days per week,
Burcher one day per week and Tottenham three days per week. The days and times
for the Condobolin facility were considered too generous, but the meeting was
advised that there is a contract for the management of that site for a further 18
months and changes would not be feasible at this stage of the contract. Opening
times for the other sites received no recommendations.
There was general support for maintaining DrumMuster as a service and the
opportunity for community groups to generate income was recognised.
Owners of multiple properties that did not have residences erected on those sites
expressed concern of the application of the Waste Facility Contribution Charge to
those properties.

Closed Circuit Television Cameras (CCTV) were suggested as additional “tools” that
could be used in providing additional security to the waste facilities.
Concern was expressed that “illegal dumping” of wastes would increase should
some landfill sites be closed. Where landfills have been closed in other Council
areas, there is no empirical evidence to support the notion that illegal dumping
increased significantly with landfill closures. Council intends to provide a sum within
its waste budget to attend to any reported illegal dumping within its areas of
jurisdiction.
When the “attributes and detractions” for the range of options presented in the
“Waste Facilities Management Plan” are overlayed with the results recorded from the
community forums, a preferred course of action emerges that will mitigate risks,
provide the most cost effective outcome and be reflective of community consensus.
This course of action would see –
The Derriwong Transfer Station, Fifield Landfill and Albert Landfill (influenced
by the risk assessment) closed and the domestic waste collection service
extended into these townships, with secured waste drop-off enclosures
provided in the affected townships for rural resident’s domestic waste.
The Burcher landfill to remain open but access limited to one day a week, the
day and hours to be determined in consultation with Burcher residents.
The Tullibigeal landfill to remain open but access limited to two half days a
week, the day and hours to be determined in consultation with Tullibigeal
residents.
The Lake Cargelligo landfill to remain open but access limited to four days per
week, the days and hours to be determined in consultation with Lake
Cargelligo residents
The Tottenham landfill to remain open but access limited to three days per
week, the days and hours to be determined in consultation with Tottenham
residents.
Council to enter into negotiations with the incumbent contractor operating the
Condobolin Waste Facility, TG & FB Ross, with the aim of amending the
current contract that would see a reduction in the opening days and times of

the waste facility. Once the negotiations have been completed, community
engagement is to be undertaken to determine the preferred opening days and
times, with a recommendation reported back to Council for determination.
The logical time to introduce any changes to the operation of Council’s waste
facilities and the extension of the domestic waste collection service would be from
the 1 July 2015.
A number of options are contained in the “Waste Facilities Management Plan” and
the more plausible of these were explored during the community forums. Financial
modelling contained within the Waste Facilities Management Plan provided the
relative costs of the more likely options and the effect on the bottom line.
FINANCE AND RISK
There will be significant financial and economic implications with the recommended
course of action. The cost to extend the domestic waste collection service to
Derriwong, Fifield and Albert will be in the order of $22,500 per annum and would
see the average DWMC across the Shire increase by about $12 above CPI. There
will be the costs to provide drop-off enclosures, to undertake landfill closure and site
rehabilitation and these will be the subject of grant applications through the Waste
Less Recycle More (WLRM) program. Without WLRM grant funding, Council could
be confronted with costs approaching $80,000.
Providing supervision to the Lake Cargelligo, Burcher, Tullibigeal and Tottenham
waste facilities will be a significant cost and the quantum will be largely dependent
on how these sites will be supervised, that is, by Council staff, contractors or
incorporated community groups and the actual days of the week they are open.
However, based on the number of recommended days of public access and
assuming some of these will be week-ends, the annual cost to provide supervision
would be in the order of $150,000 which would translate into a 30% increase in the
Waste Facility Contribution Charge. The current annual Waste Facility Contribution
Charge is $108.
ENGAGEMENT
As mentioned elsewhere herein, Council conducted three Community discussion
meetings at Lake Cargelligo (5 November 2014), Condobolin (6 November 2014)
and Tottenham (7 November 2014). These meetings were advertised in

newspapers, community newsletters, on Council’s website and on Council’s
Facebook page. Copies of the relevant plans were also placed in accessible location
in each of the Shire’s towns and villages.
Thirty seven people attended the three works shops and Council was provided with
considerable feedback. A document summarising the key points of discussion is
attached herein for Council’s information.
Attendees were asked to complete a questionnaire and to select one of the four
options in relation to rationalisation of Council’s waste services. These are the
results of this option selection:

On Monday 10 November 2014, the Director Environment and Planning attended the
Tottenham Welfare Council meeting to discuss the Waste Action Plan. At the
meeting, the Council made the following resolution:

the Waste Facilities Management Plan 7/11/2014
II. If Albert landfill disposal facility closes, that the Albert community are given
the best possible waste management service with minimal inconvenience and
cost.
CONCLUSION
As a result of changes to the Work Health and Safety Act 2011, and proposed
changes to waste regulations including the Protection of the Environment Operations
Act 1997, not only Council, but Council employees, are exposed to unacceptably
high levels of regulatory and financial risk and legal action to rectify this situation
must be taken. In order to progress operational improvement, Council has consulted
the community in relation to the four most plausible options for the operation of the

The Floodplain Advisory Committee has re-formed to oversee the development of

Over the last 8 years, with the assistance of Committee members and commissioned
consultants, Council has undertaken floodplain assessment work in association with
the NSW Office of Environment and Heritage, who have fully funded all costs
associated with the project to date. The Floodplain Advisory Committee has recently
re-formed to commence stages 2 and 3 of the project which will incorporate the
commissioning of consultant services to develop the Floodplain Risk Management
Study and Plan.

Council has called for expressions of interest for individuals to be appointed Advisory
Committee members.
The Floodplain Risk Management Study and Plan is to be completed by consultants
and will go to tender on 5 December 2014 and submissions are due on 14 January
2014. The aim of the Floodplain Risk Management Plan is to identify what we can or
can’t do in response to flood events, while the Floodplain Risk Management Study
aims to calculate risk and identify the potential damage which is likely to occur from
future flood events.
FINANCE AND RISK
Stages 2 and 3 incorporating the Floodplain Risk Management Study and Plan will
be fully funded by the NSW Office of Environment and Heritage. Completion of these
two stages will qualify Council for further funding on future projects contrived to
mitigate future flood events and to also assist in developing adaptive actions in
response to the consequences of such events.
As Council is the responsible authority in the management of flood control and flood
prone land in the town and village boundaries within the Shire, completion of Stages
2 and 3 are important as it will help indemnify Council, under Section 733 of the
Local Government Act, from potential damages as a consequence of flooding.
CONCLUSION
Completion of the report will assist to indemnify Council from potential damages.
Additionally, Stages 2 and 3 incorporating the Floodplain Risk Management Study
and Plan will benefit Council as the research developed will assist Council in
developing a range of responses to alleviate future flooding impacts. Some of these
responses may include;

INTRODUCTION
As part of Council’s ongoing review of all policies, the Policy for the Management of
Cemeteries and Burials within the Lachlan Shire Council (LSC) has been reviewed
and updated.
The objectives of the updated policy are to ensure LSC:
Maintains cemeteries in an orderly manner;
Grants approvals for interment, excavation of graves, erection of vaults,
monumental work, and disposition of ashes;

Establishes Committees, or appoints contact persons to facilitate the

Prepares layout plans for each cemetery showing the various denominations
sections of general cemeteries and any portions set aside as lawn
cemeteries.
BACKGROUND
Council’s Cemeteries Policy has been reviewed and updated as part of Council’s
work on policy development, updates, identifying potential operational savings and
achieving operational improvements.
The main changes to the draft policy are:
that it seeks to include a new section which provides a procedure for
reserving a plot; and
Proposes to establish online access to its Cemetery records on Council’s
website.
DISCUSSION
The ability to reserve a plot has been included in the draft policy because Council
recognises that some people choose to select and reserve a plot in the cemetery to
avoid an additional burden being placed on surviving family members or to be close
to deceased family members.
FINANCE AND RISK
There are no significant financial or other risks associated with this policy.
A minor to medium risk is that someone may be inadvertently buried in a plot that
has been pre-booked by someone else. This risk will be controlled by the
Environment and Planning Stream maintaining an up to date and accurate Register
of Burials.

ENGAGEMENT
Once endorsed for exhibition, the policy will be placed on public exhibition and

CONCLUSION
It is anticipated that the updated Cemeteries policy will lead to a more efficient and
effective operation of Council’s cemeteries. The ability to be able to reserve a plot
will allow community members to be close to other loved ones who have passed
away.

INTRODUCTION
The following report provides an update for Councillors on current strategic Council
related issues including initiatives to address these and specific activities undertaken
by the Director Infrastructure Services over the past month.
STRATEGIC AND PROJECT UPDATE
Lake Cargelligo 2ML Reservoir
Preparations for the first concrete pour for the reservoir wall were delayed for a
couple of days when the outer layer of steel reinforcing collapsed to the ground. The
collapse was a rather slow unremarkable event that did not cause any damage to the
materials or construction. Unfortunately, rectifying the site and the ensuing
investigation has resulted in a delay in the construction program, although the
contractor has provided considerable confidence in their approach to this situation.
Lachlan River Valley Water Security Study
State Water has commissioned consultants MWH to complete a water security study
for the Lachlan River Valley. A considerable part of this study is the consideration of
a number of sites in the Belubula and Upper Lachlan that are being investigated for a
potential dam to improve water security in the Lachlan Valley. The study includes the
Needles Gap site as well as a range of other sites that have been identified in past
studies over the last 30 years.

The scoping study, which is being undertaken by State Water, will undertake
preliminary engineering assessments and hydrologic studies, identify any statutory
constraints, and do an initial cost analysis of the potential sites.
Local Water Utilities (LWUs) within the catchment as well as a few neighbouring
LWUs were invited to attend a stakeholder consultation meeting on Thursday 6
November in Forbes. At this meeting the importance of providing water security for
each of the LWUs was discussed, particularly the idea of improving the current
security status of many LW ’s. The importance of environmental flow for Lake
Cargelligo was recorded in the meeting and attracted the attention of the facilitator
and many of the participants.
The study will report back to the NSW Government by the end of December 2014
with an assessment of the options to allow selection of a site for full investigation of
the engineering, environmental, community and heritage considerations including
cost-benefit analysis. Further information on the investigations is available on the

Lake Cargelligo Foreshore Advisory Committee
A call for additional applications for membership of the Lake Cargelligo Foreshore
Advisory Committee closed on 10 October 2014, and no further applications were
received. The six applications that were received in 2013 will be presented to the
December Councillor Strategic Briefing Session for consideration and formation of
this advisory committee.
Lake Cargelligo Water Supply
Emergency water restrictions to level 3 were put into place on Thursday 13
November due to a number of issues with provision of water supply for Lake
Cargelligo. Two of the three bore pumps associated with “Merri Abb”’ scheme are
currently out of action due to suspected lightening strikes, and while replacements
and repairs are been carried out water is being sourced from Council’s surface water
allocation in Lake Cargelligo. Currently the water at the draw point in the Lake has a
high concentration of organic material and is providing a considerable challenge for
the filtration process. Staff have commenced work on a rotation shift basis to ensure
water production continues and it is hoped that the water restriction will provide

some relief to allow further investigations towards rectifying both the bore and
surface water supplies.

Road Closure No 1: No objections to the closure of Crown Road east of Lot
19 DP 264367 as this would not isolate any property, however if individual
parcels in the property held by BA Stonestreet were sold, an easement would
need to be provided.
Road Closure No 2 and 2a: No objections to the closure of Crown Road
south of Lot 12 DP 722887 and west of Lot 5 DP 5 DP 752894, this would
deny legal access to Lot 21 DP 881695, however this property owned by N J
and N M O’Hara, is currently accessed through the adjoining parcel owned by
N J O’Hara. Thus an easement would need to be provided for Lot 21 DP
881695, if it was sold separately. Narelle O’Hara has been made aware of
the issues with access but is not concerned about this.
Road Closure No 3: No objections to the closure of Crown Road west of Lot
22 DP 881695 and Lot 1 DP 752921, as this would not isolate any parcels.

Road Closure No 5: No objections to the closure of Crown Road north of Lot
12 DP 752892 and intersects Lot 18 DP 752901 as this would not isolate any
property, however if individual parcels in the property held by R K Fox-Ashwin
were sold an easement would need to be provided.
Road Closure No 6: No objections to the closure of Crown Road north of
Lots 12, 13 & 15 DP 752866 as this would not isolate any parcel, as long as
the Crown Road west of Lot 7 DP 752901 is maintained or an easement
is provided to maintain access to Lot 13 DP 752866. Crown Lands have
indicated that this section would only be offered to be sold to K Watson and
not the neighbours. The Crown road between Lots 7 and 12 DP 752901 is
the only legal (albeit slightly impractical) access to Lot 13 DP 752866. If the
section of Closure No 5 was sold to either of the neighbours this would isolate
Watson’s parcel from its only legal access. Contact with Kathleen Watson
has not been successful, although contact with her son, Graham, has been
possible. Graham acknowledges that the only legal access to her property is
via these crown roads to the north and west but it is not possible to get farm
machinery and trucks along these roads. Correspondence to Council from
Kathleen Watson (2005 – 2010) indicates that this has been an ongoing
issue. The relationship with neighbours does not appear to be good and
easements may not be granted. Currently to access the property larger
vehicles trespass on George Easey’s property to the west. The previous
owner was George Easey, Kathleen’s brother, and the relationship appears to
have deteriorated (prior to his death in January 2013). Practical access
needs to be improved via these Crown roads by Bogan Shire Council and
Lachlan Shire Council.
FINANCE AND RISK
The Crown Road closures will have no financial affect to Council. However there is
a risk of isolating parcels if easement’s are not created for Lot 21 DP 881695 and Lot
13 DP 752866.

Graham her son 1/10/14 (Kathleen is in hospital) – he is very concerned
about access to property. Currently uses crown roads off Cockies Road,
travelling East then South to Hopbush Valley, but cannot get all vehicles
needed along there (no headers, road trains). Currently, vehicles of this size
get the property by trespassing through George Easey’s property (uncle with
poor relationship). He has had disputes with Lands Dept for removing fallen
timber off road and scraping road surface on a corner with a bulldozer.
Graham did not immediately divulge that M Easey had passed away.

Discussion with Robert Vincent indicated that GP Easey is deceased and
property is now in family trust.
Neville and Narelle O’Hara Rang 29/9/14, Narelle is not concerned about
access to this block as they get on well with the neighbours. Advised her
about the issue of access if it was sold separately and then need to have
access to the property.
Ronald Kent, Fox-Ashwin, Neville John O’Hara, Mervyn & Anne O’Hara, John
and Kate Lees: Prosperity Investment Nominees David Lindsay, Fox-Ashwin
Bruce Arthur. Stonestreet, Geoffrey Todd and Emma Daley have indicated no
issues with access.

INTRODUCTION
NSW Trade & Investment – Crown Lands have requested comments on the
proposed road closings: with notice of intention to sell.
BACKGROUND
The Lands Office is progressively closing unused crown roads. The Office
periodically forwards notices of its intentions for a batch of roads and seek
comments from landholders and other interested parties such as Council. Mostly
Council is not directly affected but if Council are aware of any issues from
landholders, Council can add its support to their objections.
On 19 February 2014, Council resolved (040/14) to apply for the transfer of Crown
Roads as shown in Figure 2: Road Closure Tottenham Locality to Council’s control.

BACKGROUND
To implement rural addressing across the LGA, Council is required to have approved
names of roads within its network that comply with the NSW Road Naming Policy.
The Geographical Names Board (GNB) is the approvals body that implements this
policy and has considered the names proposed by Council for all of the roads in the
Lachlan Shire.
DISCUSSION
The names listed in Table 1 below have been objected to by the GNB under
Principle 4 Uniqueness, Duplication of the NSW Road Naming Policy.
Principle 4 states:
A road name will be regarded as a duplicate if it is the same or similar in spelling
or sound to an existing name, regardless of the road type. Road names shall not
be duplicated:
Within the same address locality
Within an adjoining address locality
Within a local government area, and o Within 10 kilometres in a urban area o Within 20 kilometres in a regional urban area o Within 30 kilometres in a rural area o Within 50 kilometres in remote areas

The Table 1 lists the road number, the name that was initially requested and the
reason from the GNB for the name being objected. The proposal column outlines
the recommendation for each road to submit back to the GNB in order to complete

INTRODUCTION
All water extraction activities undertaken by Council are licensed through the Water
Management Act 2000 and the Water Act 1912. The Water Act 1912 is being
progressively repealed and replaced by the Water Management Act 2000; however
some provisions are still in force. The licenses held by Council contain conditions,
including volumetric limits, to which Council must comply. This report provides an
assessment of current accumulative water consumption for the water year and
available remaining water resource, with recommendation of any measures that may
be required for continued compliance.
BACKGROUND
As per the previous month, rainfall data presented in this report were gathered from
Lawling Vale weather station at Cowra. This is due to the fact that Wyangala Dam
Village weather station from which rainfall data was usually gathered remains out of
commission.
Sparse rain fell across the Lachlan Valley Catchment during the month of October.
During that month a total of 42mm of rain fell in the Lachlan Valley Catchment with
the wettest day being 7 October 2014 when 16.6mm of rain fell. There were 26 days
in the month for which no rainfall events were reported. The daily average for the
month was 1.35mm. 1
Wyangala Dam has an accessible storage capacity of 1,217,035 ML. At the last
reading which was on 5 November the level of the water in the dam was 2.24m and
the flow from the dam was 2,112ML/day. The dam was holding 52.3% of its capacity
(which is a volume of 637,106ML). This is a decrease in total storage capacity of
3.4% or 41,961ML since the last reporting period.2
State Water reported on 2 October 2014 that water release from Wyangala Dam was
2,365ML over a 24 hours period to supply downstream water consumers. This is
compared to a reported net reservoir inflow of 311.37ML over a 24 hours period on
the same day.3

Lake Cargelligo has an accessible storage capacity of 30,163ML. At the last reading
which was on the 6 November 2014, the lake was holding 78.6% of its accessible
storage capacity which is a volume of 23,720ML. This is a storage increase of 26.1%
or 7,863ML since the last reporting period. 4

Condobolin water consumption
Condobolin Township water consumption is within the allowable allocation.
Condobolin Township has consumed for October 2014; 97.40ML or 6.56% of the
available 1,500ML per annum surface water allocation and 0.0% of the available
800ML per annum groundwater allocation for the 2014/2015 water year. A total of
1,511 properties are connected to the Condobolin Township water supply scheme.
This equates to a water usage of 64.46kL per connected property for the month of
October. Compared to the previous water year, total water consumption is
approximately 21% higher for the period, 97.40ML (2014/2015) compared to
76.952ML (2013/2014).
Lake Cargelligo water consumption
Lake Cargelligo Township water consumption was from ground water extraction only
for the month of October following the bores coming back online on the 27 June
2014.
Water consumption from Lake Cargelligo Township is within the allowable allocation.
Lake Cargelligo Township has consumed for October 2014, 63.87ML or 10.65% of
the available 600ML groundwater allocation for the 2014/2015 water year and 0.0%
of the available 677ML per annum surface water allocation for the 2014/2015 water
year. A total of 814 properties are connected to the Lake Cargelligo water supply

scheme. This equates to a water usage of 78.46kL per connected property for the
month of October.
Compared to the previous water year, total water consumption is approximately
17.25% higher for the period, 63.87ML (2014/2015) compared to 52.85ML
(2013/2014).
The Merri Abba Water Supply Scheme consists of three bores each fitted out with a
Grundfos submersible pump. Two pumps normally operate at any one time to deliver
the required flow rate as the system operates on a Duty/Duty/Standby configuration
with the third pump being on standby. One of the pump motors was removed during
the defects liability period and found to be badly burnt. This motor has been at the
suppliers for more than 9 months. Mitchell Water provided documented evidence
from the pump supplier confirming that lightning which plagues the area was the
cause for the pump motor being destroyed even though the pump was located more
than 50m underground in the bore. Further investigation has revealed that there was
little difference between the cost to repair the damaged pump and its motor as
compared to the cost to procure a new pump and motor. Consequently, as the Water
Supply Scheme had an inline spare redundancy it had not been considered an
urgency to replace the damaged pump. There is now an urgency to replace the
pump as a recent lighting strike in October destroyed a second bore pump leaving
only one pump in operation. The single pump was laboring to meet the present high
water demand at Lake Cargelligo and the water supply was switched back to the
surface water allocation from Lake Cargelligo on Thursday 6 November in an effort
to preserve the remaining pump. Quotes are currently being sourced to purchase
two new pumps/motors as soon as possible.
The water sourced from Lake Cargelligo currently has a very high organic matter
content and is proving very difficult to treat. It is suspected that making a
modification to the offtake location will rectify this. Staff will be working in ‘shifts’ to
manage fatigue and maintain supply. It is expected to take three weeks to rectify the
situation with both the bore pumps and the offtake point in the lake.
Due to the issues with maintaining supplies, emergency restrictions to level 3 were
implemented for the Lake Cargelligo town users on Thursday 13 November until the
supply issues can be rectified.

Tullibigeal and adjoining rural connections water consumption
The village of Tullibigeal and rural connections to the Tullibigeal – Kikoira Pipeline
consumed 8.00ML of the 63.87ML of water processed at the Lake Cargelligo water
treatment plant. This equates to approximately 12.53% of the water processed for
the month of October 2014.
A total of 154 properties are connected to this section of the scheme. This equates to
a water usage of 51.95kL per connected property for the month of October. This
section of the scheme comprises approximately 15.91% of the Lake Cargelligo water
supply schemes total number of connections.
Due to the issues with maintaining supplies, emergency restrictions to level 3 were
implemented for the Tullibigeal town users and connections to the Tullibigeal –
Kikoira pipeline on Thursday 13 November until the supply issues can be rectified.
Tottenham water consumption
Tottenham Township water consumption is within the allowable allocation.
A total of 9.177ML of water was sourced from the B-Section Pipeline during the
month of October 2014 for the Tottenham Township water supply. The Leg O Mutton
Water Treatment Plant was also utilised to supply 0.804ML of supplemental water
was found to be almost the same much less than the during the month of October
2014.
A total of 253 properties are connected to the Tottenham Township water supply
scheme. This equates to a water usage of 36.27kL per connected property for the
month of October.
Compared to the previous water year, total water consumption is approximately
7.05% lower for the period this being 9.177ML (2014/2015) compared to 9.873ML
(2013/2014).
The current storage level in the Leg of Mutton dam is 8.5m. This is a decrease in the
dam storage level over the previous month by 0.3m.
The decrease in the dam’s storage level was due to 0.804ML drawn-off from the Leg
of Mutton Dam this being required to supplement the town’s water supply source
from the B-Section Pipeline.

Rainfall events in the Tottenham area during the month of October were sparse with
only 3 wet days occurring. The highest rainfall event occurred on the 26 October
2014 when 3mm of rain fell. Total rainfall fall for the month of October 2014 was
3.6mm with the daily average being 0.1mm.
Modifications to water restrictions
It is recommended that Burcher Town Water Supply Level 2 water restriction be
increased to Level 3, due to the storage dam dropping to less than 3m depth. This
restriction should be effective from 20 October 2014 and remain in place until further
notice. The water level in the dam being so low, arrangements are been made to
implement water carting to the town if required. Similar arrangements are being
prepared to cart water to Fifield if required.
It is recommended to introduce Level 1 Water Restrictions for Town Water
Consumers connected to the Condobolin water supply effective immediately and
remain in place until further notice.
It is recommended to Retain Level 3 Water Restrictions for Lake Cargelligo and
Tullibigeal town water consumers and all connections to the Tullibigeal and Kikoira
Pipeline until further notice.
It is recommended to retain the existing Level 1 Water Restrictions for Town Water
Consumers connected to the Tottenham and Albert Town Water Supplies and the B
– Section Pipeline in Lachlan Shire.
Water restriction reductions to the next lower level or increases to the next higher
level are in accordance with the Council’s Drought Management Plan triggers.
FINANCE AND RISK
Income from water sales are reviewed quarterly and provided in Council’s quarterly
budget review for consideration.
From a risk perspective, the Water Management Act 2000 has severe penalties for
failure to comply with licensing conditions. Penalties range from Tier 3 to Tier 1
Offences.
A Tier 3 Offence has a maximum penalty of $110,000 for a Corporation.
A Tier 1 Offence has a maximum penalty of $2,200,000 for a Corporation.

ENGAGEMENT
All demand management measures are outlined in Council’s Demand Management
and Drought Management Plans as approved by the NSW Office of Water and
adopted by Council. Community consultation was undertaken as part of the plan
development and review.
Council utilises local print media, community newsletters, Council’s website and
Facebook, pamphlets and rate notice inserts to disseminate information to the local
community.
CONCLUSION
Consumption levels for the Condobolin, Lake Cargelligo and Tottenham town water
supplies will continue to be monitored and further water restrictions may be required
if water consumption increases or water supplies continue to diminish without being
recharged.

RECOMMENDATION
That Council note the available General Security water allocation for the
2014/2015 water year.
INTRODUCTION
All water extraction activities undertaken by Council are licensed through the Water
Management Act 2000 and the Water Act 1912. The Water Act 1912 is being
progressively repealed and replaced by the Water Management Act 2000; however
some provisions are still in force. The licenses held by Council contain conditions,
including volumetric limits, to which Council must comply. At the start of each water
year the Water Commissioner announces available water determinations. Further
announcements in allocation may be made throughout the water year where
increases in available water resources occur.
BACKGROUND
The 2013/2014 water year was slightly wetter than the previous run of dry years,
although there was no significant runoff into Wyangala Dam. Water Storage has

slowly diminished throughout the year after peaking at 72.7% in August 2013 and by
June 2013 was 46.5%. There have been no further allocations of General Security
water announced for the 2014-2015 water year.
DISCUSSION
Water allocations for the 2014-2015 water year were announced on 1 July 2014, by
Acting Deputy Director General Water, Michael Bullen. Local water utility and
domestic and stock access licence holders on the Lachlan regulated river received
100% of their allocation. Regulated river high security access licence holders
received an allocation of 1 megalitre per unit share of entitlement (100%). For
regulated river general security users operating under continuous accounting rules,
there was no available water allocated and this will be reserved until significant
inflow was been received. General security licence holders will still have access to
an average of 51% of entitlement subject to the actual volume of carryover of each
individual allocation account.

Council will continue to utilise local print media, community newsletters, Council’s
website and Facebook, pamphlets and Council rates notice inserts to disseminate
information to the local community regarding water allocations when required.
CONCLUSION
The general security water allocations available to Council are insufficient to provide
adequate water for all of Council’s irrigation and recreational requirements. Close
monitoring of water usage will continue to ensure that the conditions of each water
licence are complied with, and water is transferred from the available licences when
it is available.
