One Big Problem: TSCA

(1976)

Grandfathered existing 62,000 chemicals – unregulated

But of 20,000 new chemicals

85% have no health data

67% have no data at all

Feds can’t share data with states

EPA cannot compel testing (no sufficient authority)

EPA cannot restrict use of risky chemicals due to

“least burdensome standard” tests

EPA just completed TCE Risk assessment – 1st one in 28 years

Only 19,999 to go….

Reforms efforts have been trying for over 10 years,

2013 -three Bills in the Legislature (one bipartisan),

Oregon’s Toxics Regulations

SB 962: Bans the toxic flame retardants pentaBDE and octaBDE, ands

recommend banning decaBDE if safer alternatives are nationally

available.(Adopted in 2005)

SB 596: Phases the toxic flame retardant decaBDE from products bought

and sold in the state.(Adopted in 2009)

SB 1512: Bans mercury in lamps exceeding certain standards, requires the

state favor purchasing lighting meeting these mercury standards.

(Adopted in 2012)

Executive Order 12-02: Enables Green Chemistry innovations,

revises procurement policies to purchase environmentally

preferable products.(Adopted in 2012)

Attempted Legislation

SB 1569: Creates a list of chemicals of concern for children and requires

manufacturer disclosure. Also requires phase-out of chemicals in some

cases and allows for waivers.

A New Focus for Oregon

Industry

• A significant number of Oregon Industries use toxic metals and

volatile organic compounds

– 465 businesses report use of significant amounts of toluene

– Advanced Manufacturing has a big economic impact in Oregon and

also produces the largest amounts of waste and pollutants

• Over 700 businesses are required to maintain a Toxics

Use Reduction Plan. Plan Improvements can include:

– Encourage use of Alternatives Assessment Guide

– Identify opportunities to incentivize Green Chemistry for key Oregon

industries

– Use DEQ Toxics Focus List
