Records of the communications have been attached to this Order. On July 26, 2016, the Indiana Broadband and Technology Association ("IBTA") filed a request to reopen the record in this proceeding for the purposes of allowing the parties an opportunity to provide evidence regarding the timing of the 317 Area Code Relief Implementation. Further, out of consideration for ESA of Indiana's request for additional time, the IBTA proposed that the Commission extend the mandatory 10-digit dialing deadline to October 15, 2016 from the current September 17, 2016 deadline. While we believe the schedule approved in the 317 Order was designed to provide adequate time for preparation and customer education, we must exercise caution to ensure both the safety of the public and a smooth transition to mandatory 10-digit dialing. Indiana Code § 8-1-2-113 provides the Commission authority to take temporary action for the benefit of the public interest. Thus, the Commission finds that an emergency situation exists, and we order that the all-services

On April 8, 2015, the Indiana Utility Regulatory Commission ("Commission") issued an Order in this Cause granting NeuStar, Inc. ("NeuStar"), the North American Numbering Plan Administrator's Petition for an all-services distributed overlay for the 317 Numbering Plan Area (the "317 Order"). The 317 Order approved a 13-month schedule for implementing the all-services distributed overlay. The schedule included intervals for each implementation phase, including six months for network preparation and customer education followed by six months for permissive 10-digit dialing and continued customer education. Mandatory 10-digit dialing is to begin at the end of the permissive dialing period. The permissive dialing period is currently scheduled to run through September 17, 2016.

On July 14, 2016, the Commission received information from the Electronic Security Association ("ESA of Indiana") that certain alarm companies may be behind in their preparations for the switch to mandatory 10-digit dialing. As a result, the Commission met with representatives of the alarm companies to determine the scope of the problem. Furthermore, the Commission participated in a conference call with the Indiana Industry Implementation Committee regarding the ESA oflndiana's concerns. Records of the communications have been attached to this Order. On July 26, 2016, the Indiana Broadband and Technology Association ("IBTA") filed a request to reopen the record in this proceeding for the purposes of allowing the parties an opportunity to provide evidence regarding the timing of the 317 Area Code Relief Implementation. distributed overlay for the 317 Numbering Plan Area remain in the permissive 10-digit dialing phase until otherwise ordered by the Commission. Furthermore, we are reopening the record in this proceeding pursuant to Indiana Code § 8-1-2-72 to allow the opportunity to determine if the 317 Order should be modified in regard to the timing of the implementation of the all-services distributed overlay due to new facts and circumstances.

In addition, in order to expedite the resolution of this matter, the Commission sets the following procedural schedule:

(A) The IBTA shall submit testimony by August 9, 2016, in support of its request to extend the mandatory 10-digit dialing deadline to October 15, 2016

(B) Parties may file a response to the IBTA's testimony by August 16, 2016.

(C) The Evidentiary Hearing in this matter is scheduled for August 19, 2016 at 9:30 a.m. in 224 of the PNC Center, 101 West Washington Street, Indianapolis, Indiana.

IT IS THEREFORE ORDERED BY THE INDIANA UTILITY REGULATORY COMMISSION that:

1. The permissive dialing period is hereby extended until further order of the Commission.

2. The evidentiary record in this proceeding is hereby reopened.

The Indiana Utility Regulatory Commission ("Commission") issued its final order in Cause No. 44513 on April 8, 2015. The Final Order, among other findings, approved a 13-month schedule to implement an overlay within the 317 Numbering Plan Area, required ten-digit dialing after implementation, and directed the formulation of a customer education plan.

After the Final Order was issued, the Commission made various outreach efforts to affected entities, including alarm companies. Recently, certain alarm companies contacted Commission staff to express difficulties in their implementation of ten-digit dialing. Commission staff suggested a meeting to address the alarm companies' concerns. That meeting was scheduled for and occurred on July 27, 2016.

Additionally, on July 25, 2016, Commission staff participated in a teleconference with the 317 /463 Overlay Industry Committee to discuss the alarm association's and the OUCC' s concerns.

One day prior to the meeting with affected alarm companies regarding Cause No. 44513, the Indiana Broadband and Technology Association filed a Verified Motion to Extend 317 Area Code Relief Implementation Dates and to Schedule an Expedited Evidentiary Hearing without Conducting a Prehearing Conference. Because of the timing and nature of this Motion, I believe the proceeding is now considered pending or will likely be within thirty days of the July 27, 2016 meeting. Therefore, this memorandum is disclosed to the Presiding Officer as required by 170 IAC 1-1.5-6.

Summary of Substantive Communications Participants discussed recent concerns they have raised regarding their ability to get all of their customers reprogrammed to 10-digit dialing before mandatory dialing begins on September 17, 2016.

Nelson Alarm Company stated that they have successfully converted 50% of their estimated 5,500 customers. They explained that they have completed reprogramming for those customers they were able to reprogram remotely, but customers with older equipment require site visits. Additionally, the companies explained that the site visits take such a significant amount of time due to the fact that their technicians are driving extended periods of time to meet customer's availability. The visits are scheduled at the customer's convenience, so they may have to drive 45 minutes to one customer and then drive another 30 minutes to get to the next customer. They estimated that they will have 250-350 customers left to program by September 17th. Nelson Alarm Company also raised concerns about a few commercial properties.

Circle City Security Systems, Inc. has around 4,600 customers not including multiple companies for which they provide monitoring services. They estimate there are around 450 customers left to reprogram, but this number has been fluctuating. As they are checking the systems they are finding some are not operating appropriately. These require site visits and often equipment replacements that can take up to half a day to install. They believe they can be finished reprogramming all customers by the end of January 2017.

General Emergency Monitoring Company estimated that they have 1,000 customers left to reprogram, but some of these could be reprogrammed remotely. They believe that they will have 600 site visit left by the time mandatory dialing begins, and believe they can be complete by January 1, 2017. They are running into the same problems with getting customers to schedule appointments for site visits. They also monitor 50 installing companies with a total of 3,000 accounts that dial locally. They believe these companies will have about 500-700 customers that will not be ready in time.

J.C. Alarm Company stated they have around 900 customers left and estimate they can be done by January 1, 2017. They explained that many of their customers are reluctant to get new equipment, so the company has been absorbing that cost.

The Commission staff and companies discussed potential solutions such as hiring third party contractors or more employees. Alarm company representatives explained that it would be a security concern to hire third party contractors to assist with the reprogramming of customers' alarm systems. The issue was also raised that hiring new employees would have a significant lag time due to the extensive training necessary to work on older systems. Additionally, the companies explained that they have had to work simultaneously on converting to 4G which has taken a lot of time and has been extremely costly. They also explained that they could not have customers reprogram their own systems for liability reasons.

The Commission staff explained that a further extension may not be possible due the rapidly approaching exhaust date estimated to be before the end of 2016, and that staff understood the seriousness of the situation. Staff explained the Commission would need to be mindful of the public interest and how best to balance the interests of all parties involved.

1. What has your company has been doing to convert to 10 digit dialing? Remote programming, site visits, panel replacements

2. When did you start the conversion process? March 17th 2016, however we did start programming panels with 1-317 about a year ago anticipating that it would still work after that conversion; This cannot be confirmed by anyone on this commission or by AT&T with the conversations I have seen with them. This virtually made us start completely over on March 17th.

3. What steps are in the conversion process? Try to remote program is always the 1st step.

4. What steps remain incomplete, and what is the timeframe for completing the steps?· Currently all steps still remain however we believe all the accounts that are capable of being remote downloaded will be completed in time of the current deadline of September 17111

However all of the site visits will not be able to be completed until the end of January 2017 5. How many customers do you have and where are they located?

We currently have 4,594 accounts in the Indianapolis area. However 2,400 is what is remaining to be completed.

6. How many customers will not be functional after mandatory 10-digit dialing on September 17?

Since the number of site visit's is a growing number we cannot provide a solid number but we are estimating around 450

7. What notifications have gone out to your customers, and what notifications are planned? We have been making phone calls to customers 8t direct mailing. Currently not mass notification has gone out since we would be able to handle the shear volume of phone calls and requests to get this done.

8. Is a notification on your website? If not, why not? Currently there is not a notification on our website for the same answer as above.

9. When do you predict your conversion process will be complete? End of January 2017

What this commission is most likely not aware of we are battling 2G sunset at the same time. We are a small business with only 7 trucks on the road. This is putting a real financial strain on our business with both of these conversion going on at the same time

7) What notifications have gone out to your customers, and what notifications are planned? Nelson Alarm has notified customers thru direct mail, email, telephone calls and telephone messages.

8) Is a notification on your website? If not, why not? No notification is on our website for several reasons. First, around 80% of the customers will not need to be involved .directly as Nelson Alarm can connect and program their alarm remotely. Second, not all customers are will visit the Nelson Alarm Website. Third, Nelson Alarm is calling all customers that require an onsite for scheduling. All customers that are not reached will receive an additional written notification.

9) When do you predict your conversion process will be complete? Nelson Alarm forecast shows late December for a scheduled completion.

10) Nelson Alarm Additional Comment: As a small company, Nelson Alarm is constrained on the labor cost side, as well as an overall manpower issue. Unlike a LEC with hundreds of vans on the street, Nelson Alarm has 10 technicians to do not only this project, but the sun setting of the 2G to 4G system change outs, as well as normal everyday installation and service for our subscribers.

We have made several site visits to commercial customers who we are having trouble getting 10 digit voice dialing to operate properly. There is a common theme that 11 digit dialing is working, but 10 digit is not. My personal estimation is that the telephone equipment provider has equipment configured so that does not allow 10 digit dialing. More importantly, NO commercial customer that was visited knew they had to take action on this fix. I.E. If 11 digit dialing ceases to operate on September 17, or hopefully on our requested extension date, these customers will either not be able to make local calls, or may be assessed a long distance charge for every local call they make. I would suggest possibly some public interest advertising to all businesses to take action on this.

All Indiana electronic security companies install, monitor, and maintain system for both property

protection and more importantly for life safety protection. When a fire alarm system cannot operate at

100%, lives can be lost. When a hold-up alarm system cannot operate at 100%, lives can be lost. When a

medical emergency button cannot operate at 100%, a lives can be lost.

We are asking for this extension as a matter of minimizing any situation that may alter our ability to

continue maximum operations of life safety systems.

Hello Jeremy & Sally,

First of all thank you for arranging the meeting this morning. Hopefully all in attendance have a clearer understanding of this important issue, including us alarm companies.

One of our senior tech's here just came up with another area that should be of concern. There are 1 OO's of office buildings, apartment complexes, gated communities, ect., that use electronic call boxes for entry. These units (The Doorking product has 90% of the market) are all telco line dependant for ALL entry into all of the aforementioned. There are probably several I have not thought of, possibly like the buzzer entry at your office on the 15th floor.

These units are almost always installed by either an alarm company, or a fence I gate company and the programming is left to an "administrator" at the location. I.E. a gated neighborhood with 200 homes like Sycamore Springs on N. Dean Road.

If these are not re programmed, NO ENTRY will work for any of these after Sept. 17. My guess is that very few of the administrators know they need to reprogram every number in their system.

This also goes for vending & game companies, ATM companies that may use 7 digit dialing, any local retail chains that use 7 digit for 3:00am inventory orders & control {like some liquor store chains).

We have had another area of concern come up we just remembered. Nelson Alarm monitors the emergency telephones in about 35 elevators (required by State law). We are and can get these fixed or the proper orders into the elevator companies to add the 317 to the local dialing string.

The main problem I've found is that when I go to the sites to check the elevator phones, I do a courtesy call and ask someone at the business to "try" a 10 digit call to my cell phone. NONE of the businesses have worked. They ALL will allow 11 digit, but not 10. These stops include the School systems main office (which I'm relatively sure means none of the Schools will work either). And the .. Hotel chain main office, which I'm sure means that none of their hotel room phones will work either as I'm relatively sure they use the same telephone provider.

At our November 2015 meeting, no one could guarantee me after Sept. 17th that a local call dialed with 11 digits would either work, or would not incur a long distance charge. I believe a bit more "advertising" of this implementation particularly to businesses and elevator companies, and telephone equipment providers might be in order.

Schools, Municipalities, Hotels. Could be a real problem. Just an FYI for you.

Mandatory 10-digit dialing is to become effective in the 317 area code on Sept. 17, 2016. An alarm company has complained to our commission stating that their reprogramming efforts are being hindered because some local exchange areas are not offering ten-digit dialing. Some of the numbers provided appear to be Comcast numbers and those numbers are included in the attachment.

I spoke with our engineers and they have confirmed that the area has allowed permissive 10 digit dialing since at least December 2013. They did review the dial plan for the CARMEL rate center and everything they are seeing allows for permissive 10 digit dialing.

In the meantime, we have reached out to our Voice Services Department to contact the customer and work with them on placing some test calls. I did stress to them the importance of a quick resolution and will let you know as soon as I have an update from them.

Commission staff is trying to understand the scope of the problem. You may be aware that there was a similar problem when area code relief was implemented in 812 (southern Indiana). The Commission did end up E:,~e.ndtng .. t!1<4 ~andatory ten-digit dialing deadline by a few months after having a technical conference witfi:·coilimun1cations providers serving the affected area code and the alarm company which had implementation problems. However, 317 doesn't have as much leeway as 812 did. Based on current projections, 317 should be at or close to exhaust by 4th Quarter 2016. That is part of the reason why we need a good understanding of the scope of the problem. I'm sending information to the Overlay Implementation Committee so they can advise on what may be the source of the problem.

You should be aware that problems with ten-digit dialing could be with the telephone equipment provider, or perhaps a PBX system if it's a large business customer, and may not necessarily be coming from the LEC. It would be a good idea to know what communications company serves each of your customers having issues. I can provide you with contacts for communications service providers, once I know who they are, to help you trouble shoot.

If that's what's happening, doesn't that mean that there could be other customers served by other providers (i.e., competitive local exchange carriers) who haven't properly prepared for the upcoming change to 10-digit local dialing in the 317/463 NPA?

What is the quickest, easiest & most effective way to reach those other providers? How do the companies who "own" NXXs usually communicate with the providers that port numbers from them?

If 317-NXX owners all have web sites or e-distribution lists they regularly use to communicate quickly with all providers that have ported numbers from them, could all 317-NXX owners be required to notify all such providers to take whatever additional steps are necessary to become 10-digit local dialing compliant and to equip their systems to recognize the new 463 NP A code within the shortest reasonable period of time? (Would that be I week, 48 hours, 30 days-what time frame would be reasonable?)

Even though we're aware of problems identified below, I'm concerned there could be other providers who haven't done everything they need to do to prepare for this transition. If there's a quick way to communicate with all providers using ported numbers, I think we should.

In other states, what steps are taken to ensure notice & instructions are given to providers with ported numbers whose names don't appear on NeuStar's list ofNXX owners in a given NPA?

2.) I also wondered whether NeuStar might be able to send an e-mail to the companies whose NXX projections for the remainder of 2016 are driving the 4th Quarter projected exhaust date for 317. If made aware of a potential problem, would they be able to delay or withdraw their requests?

3.) In one of the early area code relief proceedings, companies that "owned" NXX codes or owned numbers within an NXX-X code were encouraged to voluntarily return any NXX codes or numbering blocks that weren't currently assigned to any customers. The industry's voluntary response was incredibly helpful in extending the lives of Indiana area codes even before the FCC required.1,000-block number pooling. If such an approach could help extend the life of the 317 NP A code, how could that be encouraged? Is that something the IURC might have authority to require?

4.) Is anyone planning to follow-up with the alarm companies to see whether the additional prep time they need could be shortened from 6 to 3 months?

The quickly approaching numbering resource exhaustion date for 317 make this situation more difficult than the one in the 812/930 overlay case.

If a short delay can reduce or eliminate the implementation problems certain alarm companies are experiencing without jeopardizing customers' ability to obtain new numbering resources from their service providers, that would be a "win-win" solution. If that's not possible, the alarm companies identified in Mr. Nelson's letter should be informed that implementation of mandatory 10-digit dialing throughout the 317 NP A will take effect as currently scheduled, without changing any other dates or deadlines.

I haven't run that up the :flag pole at my office yet to see what approach OUCC policy makers believe should be taken. I'm just trying to get a sense of whether there are any possible alternatives that could protect the interests of all customers.

I will weigh in on one question. Key Commission staff are considering the information we have and continue to gather more information. We are trying to get more facts on the scope of the problem with the alarm companies and share information so the companies serving alarm copy clients with problems implementing ten-digit dialing can perhaps assist the alarm companies or at least determine where the problem is originating.

I have a few questions & ideas.

1.) In his e-mail (below), Bob Stewart wrote: "I suspect ... that these numbers have been ported out to another provider and are not serviced or switched by the NXX "owner".

If that's what's happening, doesn't that mean that there could be other customers served by other providers (i.e., competitive local exchange carriers) who haven't properly prepared for the upcoming change to IO-digit local dialing in the 317 I 463 NP A?

What is the quickest, easiest & most effective way to reach those other providers? How do the companies who "own" N:X:Xs usually communicate with the providers that port numbers from them?

If 317-NXX owners all have web sites ore-distribution lists they regularly use to communicate quickly with all providers that have ported numbers from them, could all 317-NXX owners be required to notify all such providers to take whatever additional steps are necessary to become 10-digit local dialing compliant and to equip their systems to recognize the new 463 NPA code within the shortest reasonable period of time? (Would that be 1 week, 48 hours, 30 days - what time frame would be reasonable?)

Even though we're aware of problems identified below, I'm concerned there could be other providers who haven't done everything they need to do to prepare for this transition. If there's a quick way to communicate with all providers using ported numbers, I think we.should.

In other states, what steps are taken to ensure notice & instructions are given to providers with ported numbers whose names don't appear on NeuStar's list ofNXX owners in a given NPA?

2.) I also wondered whether NeuStar might be able to send an e-mail to the companies whose NXX projections for the remainder of2016 are driving the 4th Quarter projected exhaust date for 317. If made aware of a potential problem, would they be able to delay or withdraw their requests?

3.) In one of the early area code relief proceedings, companies that "owned" NXX codes or owned numbers within an NXX-X code were encouraged to voluntarily return any NXX codes or numbering blocks that weren't currently assigned to any customers. The industry's voluntary response was incredibly helpful in extending the lives oflndiana area codes even before the FCC required 1,000-block number pooling. If such an approach could help extend the life of the 317 NP A code, how could that be encouraged? Is that something the IURC might have authority to require?

4.) Is anyone planning to follow-up with the alarm companies to see whether the additional prep time they need could be shortened from 6 to 3 months?

I wanted to give you an update on our progress. I took your list of numbers and I am preparing a spreadsheet to show the company that serves each phone number and contact information for that company. I hope to get you that before I leave today. Could you provide or have the other alarm companies you listed send a list with their numbers not able to achieve ten-digit dialing as well?

Commission staff is trying to understand the scope of the problem. You may be aware that there was a similar problem when area code relief was implemented in 812 (southern Indiana). The Commission did end up extending the mandatory ten-digit dialing deadline by a few months after having a technical conference with communications providers serving the affected area code and the alarm company which had implementation problems. However, 317 doesn't have as much leeway as 812 did. Based on current projections, 317 should be at or close to exhaust by 4th Quarter 2016. That is part of the reason why we need a good understanding of the scope of the problem. I'm sending information to the Overlay Implementation Committee so they can advise on what may be the source of the problem.

I'll do my best to get lists from the other Companies. After a few site visits just today to several of our problems related to commercial accounts, I did find that their blocking was "probably" related to the telephone equipment provider or their telephone dial tone provider. In many cases, these are different companies. We are working as diligently as is possible to get 100% finished by Sept. 16th. Whatever consideration the Alarm Industry can get on a time extension would help. Particularly since we are dealing with life safety emergency signaling.

On behalf of the Electronic Security Association of Indiana I am requesting the Utility Commission issue an order extending the 7 or 10 digit dialing period for an additional six months until March 17, 2017

There has been difficulty with many electronic life safety security companies to get the re programming done on all alarm life safety systems. As would be expected, there is troubles that originates from both the LEC side of the dialing ability as well as the Alarm Companies being overwhelmed with the volume of site visits necessary to add the 1 O digit dialing strings into alarm equipment.

I personally have a listing of NPA-NXX that will not allow 10 digit dialing due to LEC problems as we speak.

This is of vital importance because of the nature of our businesses. We protect property but more importantly people from life safety situations such as fire and medical emergency.

Here is a brief list of just the local companies that will not be able to meet the September 17th, 2016 deadline.

I hate to be the bearer of bad news, but I just received this email today from ESA Alarm Association that several alarm companies are claiming they are not ready for mandatory 10-digit dialing on Sept. 17. On behalf of the Electronic Security Association of Indiana I am requesting the Utility Commission issue an order extending the 7 or 10 digit dialing period for an additional six months until March 17, 2017

There has been difficulty with many electronic life safety security companies to get the re programming done on all alarm life safety systems. As would be expected, there is troubles that originates from both the LEC side of the dialing ability as well as the Alarm Companies being overwhelmed with the volume of site visits necessary to add the 10 digit dialing strings into alarm equipment.

I personally have a listing of NPA-NXX that will not allow 10 digit dialing due to LEG problems as we speak.

You should be aware that problems with ten-digit dialing could be with the telephone equipment provider, or perhaps a PBX system if it's a large business customer, and may not necessarily be coming from the LEC. It would be a good idea to know what communications company serves each of your customers having issues. I can provide you with contacts for communications service providers, once I know who they are, to help you trouble shoot.

The date of mid-October or November was presented and it was agreed October would be best to meet the holiday sales season. There was no objection from the industry on an October mandatory dialing date. We looked at the calendar and decided to recommend October 15, 2016 as the new mandatory dialing date,

Summary of Substantive Communications Commission staff informed the Committee that certain alarm companies have raised concerns regarding their ability to get all of their customers reprogrammed to IO-digit dialing before mandatory dialing begins on September 17, 2016. Commission staff inquired as to when exhaustion of the 317 area code would occur. The industry participants responded that exhaustion was still likely in the 4th quarter, 2016. The holidays may increase the uptake rate resulting in possible exhaustion in November, 2016.

Commission staff informed the Committee that if Cause No. 44513 is reopened and a determination made by the Commission on whether an extension of time for mandatory 10 digit dialing is appropriate, it would be helpful for industry participants to discuss among themselves a possible modified milestone schedule with revised customer notices and deadlines. Industry participants discussed possibilities for a modified schedule. The Commission staff made clear that that Commission would have to consider any recommendation in the context of a public hearing with notice to all parties, and that the Commission could not make a decision on any proposal until that time.
