Customs ValuationThe Organisation for Economic Co-operation and Development (OECD) on 16 September released its first recommendations for a co-ordinated international approach to combat tax avoidance by multinational enterprises. This under the OECD/G20 Base Erosion and Profit Shifting Project designed to create a single set of international tax rules to end the erosion of tax bases and the artificial shifting of profits to jurisdictions to avoid paying tax.

What does this have to do with customs valuation? Well, it depends whether you consider imported goods (products) to be subject to a customs duty, a customs levy or a customs tax. Or does it?

In the instance of cross-border trade a Customs authority would have a particular interest in transactions between related parties or multinational companies.

According to Article 15 of Article VII of the General Agreement on Tariffs and Trade (GATT), known as the Agreement on Customs Valuation, there are eight instances in which persons are deemed to be related.

But how significant, if at all, are related party transactions in world trade? According to the referenced OECD document, up to 70% of world trade is now estimated to be between related parties, or multinational companies providing goods and services to one another through cross-border transactions. (In the instance of services, it is a transfer pricing matter. According to the OECD, only 60 governments have adopted transfer pricing rules to curb base erosion.)

This begs the question, can transfer prices be accepted as customs value? In the words of a true Economist,

“it depends”, but the elaboration for another day.

Specialised reefer vessels are being replaced by reefer points in container ships, according to Drewry’s latest Reefer Shipping Market Annual Review & Forecast.

It predicts that reefer capacity on the container ship f leet will increase by 22% over the next five years, at the expense of a declining specialised reefer f leet.

Reefer box capacity is

expected to grow from 1.6 million 40ft slots in 2013 to 1.9 million slots in 2018 in order to accommodate increased demand.

Volumes carried in reefers are forecast to rise by 20.5 million tons over this period – 16.5 million tons by organic growth and 4 million tons at the expense of the shrinking specialised reefer industry.

Overall seaborne perishable reefer trade will

increase by 17% between 2013 and 2018, providing an additional 16.5 million tons of cargo. “As a result of the expected cargo growth, reefer container slot utilisation levels will be unchanged in 2015 and only marginally lower thereafter,” says Kevin Harding, the report editor.

“Meanwhile, the specialised reefer sector is forecast to shrink further

as a result of scrapping and a virtually empty order book.” Drewry estimates that the worldwide seaborne perishable reefer trade has risen at an annual rate of 3.2% in the 10 years to 2013, reaching 98 million tons last year.

Sectors driving this growth have been meat and exotic fruit, with the latter rising by as much as 9.3% each year over the period.

Calls for tenders for civil works, the construction of bridges and platforms in order to upgrade the manganese ore line from Hotazel in the Northern Cape to the Ngqura port have been issued by Transet.

It plans to move 16m

tons of manganese ore a year on the line, with exports going through a new terminal in the Ngqura port.

An estimated R26bn will be invested in the upgrading of the railway line, new manganese

terminal at Ngqura and associated work.

The rail project involves the upgrading or extension of 25 of the existing loops, including Rosmead, on the line between Ngqura and De Aar.

Other improvements

include the upgrading or construction of access roads and new or altered level crossings and additional signalling.

The target for the first exports through the port of Ngqura is October 2019. – Ed Richardson

Call for manganese line to Ngqura

Twenty five years since he hit the freight forwarding road running, Warren Erfmann has decided to take a break, play golf and join the ranks of the retirees.

He has resigned as CEO of DSV South Africa with immediate effect. Vice president Peter Larsen has taken over as acting CEO until a replacement can be found. Erfmann will in the meantime be available to assist the management,  Larsen said.

“It was a fun and exciting career – one which has given me many pleasures and allowed me to travel the world and meet some very interesting people,” Erfmann told FTW.

“People usually make a move because they have a better offer or are unhappy in their current positions. For me it’s neither of those. I’m incredibly happy in the job and love the company but feel that after the frenetic pace of the past 25 years, that often included 20-30 international f lights a year, it’s time to take a break.”– Joy Orlek

Two lawyers with a speciality in commercial law have confirmed that Kevin Martin, chairman of the Durban Harbour Carriers’ Association (DHCA), would appear to be correct in his interpretation of the VAT Act and the new Customs Act (‘Truckers face VAT shock’, September 26, 2014).

Ayanda Masina, candidate attorney in the corporate and commercial law department of Shepstone & Wylie, explained her understanding of the current provisions and the proposed amendments to these acts.

“The VAT Regulation

requires a transporter of goods (in certain circumstances) to register as a remover in bond,” she told FTW. “The normal rules that are applicable to removers in bond, as per the Customs and Excise Act, will be applicable to transporters.

“The proposed amendments and provisions in the Customs Control Act will have implications on transporters that transport goods by truck for a reward (any form of consideration), as it will require them to be registered as licensed carriers. And furthermore, such a licensed carrier will be regarded as a licensed remover in bond. As such, he will be liable

for any duties or taxes due on the goods that he is transporting.

“But only while the goods are being transported. Once the goods have reached the destination ref lected on the bill of entry, the transporter will no longer be responsible/liable for any taxes.”

Nicola Nel, associate attorney at the Durban office of Bowman Gilfillan, agreed with Masina that the relevant provisions of the two acts confirmed Martin’s interpretation.

“The provisions seem to suggest that cartage contractors may well be held to be liable for unpaid VAT or other duties as Martin suggests,” she told FTW.

“It seems there definitely is a story, especially considering that Sars likes to keep its options open in terms of having people to sue!”

Interestingly though, Nel added, the Regulation does distinguish between cartage contractors which are ‘agents’ as defined in the Regulation and those which are not.

The Regulation expressly states that non-compliance will result in the imposition of VAT, but the same provision is not included in the section which prescribes the duties

of cartage contractors (para 12(5)).

And, said Nel: “This seems to suggest that an ‘agent’ in terms of the regulation is envisaged as something more than merely a truck operator which acts on another agents instructions in collecting/delivering certain containers (ie, where he does not know the nature of the contents or any other further information).

“However, there is also section 99 of the Customs and Excise Act, which allows Sars to claim unpaid VAT or duties from agents in any event.”

Legal opinion confirms truckers’ VAT concerns

Sasfin Premier Logistics is set to grow its customer base in the Western Cape as the company targets the export market as well as new emerging African markets over the coming months.

This follows the appointment of Paul Beaumont Thomas as the company’s Western Cape regional manager.

Beaumont Thomas told FTW that diversifying and growing the client base as well as the commodities handled by the group was high on his agenda.

Beaumont Thomas said the

Western Cape branch had, to date, not focused on the export market.

“We have been very involved with imports but we believe there are major opportunities in the export sector. The company has advantages to offer through Sasfin Bank – which allows us to also provide trade finance, forex, incentives and short term insurance over and above traditional logistic services.”

He said perishables as well as oil and gas were two definite industries the company would be targeting from a Western Cape perspective.

According to CEO Peter Ehrenreich, the decision to consolidate all of the company’s non-commercial

activities in Johannesburg has allowed the regions to focus on their core business and to pursue growth.

“One has to be constantly looking at new vertical markets in the current economic environment,” he said. “We believe by consolidating services such as IT, accounting, finance, and HR in Johannesburg our regional teams can be far more client-centric, ultimately allowing us to grow our business and expand our offering.”

persons who couldn’t afford to borrow, let alone repay the amounts back plus exorbitant interest? And all unsecured! Is it any wonder that R17bn

of their R60bn loan book had turned bad? And the depositors were equally reckless in their lending and clearly governed by greed more than common sense, chasing higher returns without concern for the risk to their capital.

But the problem is not just African Bank – it is a much larger and wider contagion.

The chart below says it all – a

massive increase in domestic credit, which has mushroomed 10.8 times since 1994, and now sits at R2.8 trillion. And as can be seen, this has dramatically increased household debt which, though slightly down from its 2007 peak, is still sitting at around 75% of disposable income – dangerous and unsustainable levels. Bailouts, bubbles and bankersWell, well, our very own bailout! Should we not be proud to have joined the Global Bailout Club?

As we all know by now, African Bank was placed under curatorship by the Reserve Bank last month, after announcing a R6.4bn loss for the year and a R8.5bn hole in its balance sheet – prompting its share price to plummet 98% to a low of 31c (from around R40 just two years ago).

For some this may have come as a surprise – especially since the South African authorities have been at pains to assure us that the South African banking industry is well insulated, robust, highly regulated and well capitalised.

But the warning signs have been there for a long time – if you looked for them.

Firstly, with regard to African Bank, this was a business model that was doomed to failure, and was reckless subprime lending at its worst – who in their right mind would lend money to

trigger, like an interest rate increase, or basic food prices going up.

The fact is, we have the makings of our very own credit crisis on our hands, and the cracks are starting to show, not only with African Bank, but the Big Four as well, with a recent tally by Fin24 showing that SA banks have written off or made provisions to write off debt of more than R100bn over the last 12 months.

And then, to top it all, they have joined the Reserve Bank in the bailout, pledging a further R10bn (of depositors’ money) to prop up the ‘good bank’ part of the African Bank toxic debt package. Why? To protect depositors who were reckless and greedy in the first place! We believe this will be a decision that will be regretted down the road, as Credit Crisis Stage II starts to really bite.

Expect a rocky road ahead for the next few months.

Pier 1 has been creating havoc within the logistics chain, according to Gert Viviers, Durban manager for Roadwing and vice-chairman of the Harbour Carrier division of the SA Association of Freight Forwarders (Saaff) of KZN.

But Pier 1 management have been receptive to comments from the private sector, and a collaborative relationship has been established between Transnet Port Terminals (TPT) and the carriers.

This has seen Viviers leading a task force which identifies problem areas on both sides, and looks for joint solutions.

“Many factors have to be taken into account on any project, as they see where they can obviate some of the challenges they are faced with,” he said. “Then the team can start working on solutions together with Pier 1 management.”

So far, three major problem areas have come under the scrutiny of the Saaff-KZN team.

The widening of Bayhead Road was one. A project that

went off without any major disruptions and was a success, said Viviers.

Then there was what was titled the “Gas Leak Project”. This was emitted at one of the tenant’s premises in the Luther Complex and often caused stoppages within the port. “This is still under observation,” Viviers said, “and is being successfully monitored.”

Last year, the Pier 1 wind stoppage and truck delay project was instituted. It was found that stoppages were inevitable because of the wind gust sensitivity of the rubber-tyred gantry cranes (RTGs), and the electronic automatic cut-off system attached to the cranes. But the truck delays remained on the table, and answers are currently being found in the likes of directional siting of container stacks.

“Even on the worst of bad days, we want to get our trucks through the terminal in four hours,” Viviers said.

“These are just some of the ongoing issues that our Saaff-KZN members have set as a target to fight, as they directly affect our country’s economy.”

An exception was Mark Scott of NGL Logistics who told FTW his company was currently Level 7 and was in the process of revisiting its compliance requirements. The biggest change is in procurement, said Scott. “It’s no longer just about service – it’s about finding the service

providers who can give you the requisite points. The businesses you need to deal with are broken up by levels related to ownership and the value of the business.”

Scott believes that NGL’s BEE level will go up, but it won’t be due to procurement.

“Our current suppliers will take a knock because we’ll need to find new suppliers who fit the profile

– black, female-owned businesses with a turnover of under R5m will provide more points.”

Another logistics company was in the process of re-applying for its BEE certificate after the MD had bought out his partner. And he described the new regulations as “draconian”. For most other companies approached for comment, it was a reminder of a grudge task that needed attention.

As the festive season approaches, truck hijackings are expected to increase in line with an upsurge in demand for goods – particularly food and fuel. More worryingly, the crimes are becoming more sophisticated as hijackers become increasingly tech-savvy.

Gavin Kelly, technical and

operations manager at the Road Freight Association (RFA), told FTW that there were two types of truck hijackers – the opportunists who take advantage when a truck is vulnerable (a lonely highway late at night) and those hijackings that are planned and targeted at specific goods. “They know there is a demand for specific goods and thus know they

will be able to sell off the goods fast,” he said.

And as investigators, industry and the police

have improved their technology to prevent or catch hijackers, so too have hijackers become more tech-savvy by using sophisticated jamming devices to bypass a truck’s tracking device.

According to Kelly, the less sophisticated hijackers use a device that scrambles the truck’s tracking system. “The truck simply disappears off the system and of course those monitoring the system immediately know something is fishy and alert the trucking company and the authority,” he noted. A second type of jamming device mimics the truck’s tracking system and sends

out a duplicate signal showing the truck

is standing stationary somewhere.

Other methods include hijackers creating ‘police’ or ‘fire brigade’ roadblocks, using bogus vehicles and uniforms, which Kelly says very closely mimic the “real thing”, leading to speculation that actual officials are sometimes involved.

In July this year, four

Road Traffic Management Corporation (RTMC) traffic officials involved in a truck hijacking were arrested by Gauteng police. A high-ranking South African Police Service (Saps) official told FTW confidentially that more arrests were likely of other police and traffic officials whom they suspected were involved.

Chris Barry from truck insurance agency HCV said truck theft was a “professional business” and that there were clear indications that truck hijackings were being organised by sophisticated cross-border gangs. He said part of the problem was South Africa’s porous borders, high levels of corruption in the police force, and in some cases poor screening within companies.

“We recommend that fleet owners take a proactive rather than reactive approach when it comes to risk management and mitigate the impact of attempted hijackings,” said Barry.

Kelly agreed that cross-border hijacking was

increasing. “The truck hijacking task force we established with the police is working to ascertain exactly how many trucks hijacked in South Africa are taken across borders.” Kelly said that foodstuffs such as cooking oil and maize meal were in high demand across the border.

Kelly suggested that fleet owners fit good tracking devices and arrange 24-hour monitoring of their trucks and that they train their drivers to be on high-alert for danger signs that they are being targeted. Drivers should also be trained on how to deal with a hijacking situation, making sure that they provide information to the truck hijacking hotline so that hijacking hotspots and changes in modus operandi can be identified and so prevent future hijackings,” he said.

Furthermore, Kelly said that f leet owners could minimise exposure by travelling in daylight hours and by ensuring their trucks are regularly maintained to prevent unexpected breakdowns.
