NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These Notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Chippewa Cree Tribe.

REQUEST FOR RELEASE OF FUNDS

On or about June 18, 2020, the Chippewa Cree Tribe will submit a request to the Department of Housing and Urban Development for the release of funds for the following project: MT 11-50 Senior Citizen Housing IHBG201CMT06460. To undertake a project known as MT 11-50 for the purpose of construction of Thirty-One (31), two (2) bedroom elderly housing units to include water, sewer, site work, roads and street infrastructure on Upper Box Elder Road, east of Rocky Boy Health Center.

FINDING OF NO SIGNIFICANT IMPACT

The Chippewa Cree Tribe has determined that the project will have no significant impact on the human environment; therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Chippewa Cree Housing Authority at 75 Laredo Road, Box Elder, Montana, 59521, and may be examined or copied Monday through Friday from 8:00 a.m. - 4:00 p.m.

PUBLIC COMMENTS

Any individual, group or Agency may submit written comments on the ERR to the Chippewa Cree Housing Authority. All comments received within the fifteen (15) day waiting period will be considered by the Chippewa Cree Tribe prior to authorizing submission of a request for release of funds.

ENVIRONMENTAL CERTIFICATION

The Chippewa Cree Tribe certifies to the Department of Housing and Urban Development that Honorable Harlan Baker in his capacity as Chippewa Cree Tribal Chairman, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the Environmental Review process and that these responsibilities have been satisfied. The Department of Housing and Urban Development approval of the certification satisfies its responsibilities under NEPA and related to laws and authorities and allows Chippewa Cree Tribe to use program funds.

OBJECTION TO RELEASE OF FUNDS

The Department of Housing and Urban Development will accept objections to its release of funds and the Chippewa Cree Tribe certification for a period of fifteen (15) days following the anticipated submission date or its actual receipt of the request only if they are on one of the following basis: (a) the certification was not executed by the Chippewa Cree Tribe; (b) the Chippewa Cree Tribe has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of release of funds by HUD; or (d) another federal agency acting pursuant to 40 CFR Part 1504 has submitted written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Grants Management Specialist, Debra Richards. Email Objections can be sent to debra.j.richards@hud.gov. Potential objectors should contact HUD to verify actual last day of the objection period.
