To: THE HEIRS OF EVA J. HOFFMAN, a deceased person, any or all persons, known or unknown, claiming or who might claim any right, title, estate, or interest in or lien or encumbrance upon the real property described in the complaint adverse to plaintiff’s ownership or any cloud upon plaintiff’s title, whether the claim or possible claim be present or contingent. A lawsuit has been filed against you. The lawsuit seeks to quite title in the following real property situated in Hill County, Montana:
The Northeast Quarter (NE1/4) of Section Thirty (30), and the West Half of the Northwest Quarter (W1/2NW1/4) of Section Twenty-Nine (29), in Township 35 North, Range 11 East, M.P.M., BUT SAVING AND EXCEPTING therefrom one-half of all oil, gas and other minerals which are reserved out and excepted in favor of the Vendor. It is understood that if the Vendor owns less than all of the mineral rights, that this reservation and exception shall apply to one-half of all such mineral rights actually owned by Vendor, it being intended that the other one-half of such existing mineral rights shall be transferred and conveyed to the Purchaser.
Within 21 days after service of this summons on you (or 42 days if you are the State of Montana, a state agency, or a state officer or employee), you must serve on the Plaintiff an answer to the attached complaint or a motion under Rule 12 of the Montana Rules of Civil Procedure. Do not include the day you were served in your calculation of time. The answer or motion must be served on the Plaintiff or Plaintiff’s attorney, if Plaintiff is represented by an attorney, whose name and address are listed above.
If you fail to respond, judgment by default will be entered against you for the relief demanded in the complaint.
You also must file your answer or motion with the court.
