Most of us take pride in our homes, and when it comes to selling yourproperty you want it to look as good as possible. I’ve created a list of tips, that over the years I have come across on a regular basis, to ensure you getthe best possible price for your property and fast.

11 Ways you could be devaluing your propertywithout even knowing it by Martin McKelvey

1Reducing the number of rooms. Anupstairs bathroom may be the ideal but

many older homes only have one on theground floor and sacrificing the smallest thirdbedroom may seem like a good idea but yourhome will, most likely, be worth less as a twobedroom property.

2Dodgy DIY. It may seem cheaper to do ityourself in the short-term, but there’s

nothing more off-putting to a potential buyerthan bad DIY, it could even prevent an offeraltogether.

3Untidy garden. Messy front gardens willput off potential buyers before they even

walk through the door. Spend some timethinking about what improvements youcould make to help your kerb appeal.

4Your front door. First impressions reallycount so it’s worth putting in the effort.

Clean it, paint it or stain it for best results.

5Wedon’t all love feature walls. Neutralsmay be a little bit boring, but they allow

people to imagine themselves living in yourhome, and gives them time to settle in beforehaving to re-decorate. Consider painting overfeature walls or removing busy wallpaper.

6Keep it tidy and declutter. Keeping yourhome tidy and clutter free is vital during

viewings and especially when your propertyis photographed by your estate agent.

7Pets. Ideally keep them out the way forviewings. Hairs, smells, and pets in

general can be off-putting.

8Suspicious smells. Never mind pets andteenagers more sinister smells such as

damp or mould will need to be addressed. These can deter buyers, or result in a loweroffer.

9Wasted space. Too much furniture andclutter can make your home appear

smaller than it is. Clear them away to allowbuyers to see your home’s potential - maybeput a dining table in the area you usually usefor your home office, or a couple of comfychairs in a conservatory that’s usually stuffedwith junk.

10Unsightly views. Does your gardenoverlook a busy road, factory yard or

a brick wall? Consider installing a fence andsome shrubs to mask the issue or distract theeye.

11Standing out for all the wrongreasons. Stone cladding and equally

ultra-modern features can make your housestick out like a sore thumb, especially onperiod terraces so bear this in mind beforeyou make any drastic alterations to yourhome. Remember, if you live in aconservation area you will need permissionto make any alterations to the exterior ofyour property, including changing its colour!

If you’re concerned that something in your home is stopping your property selling or might affect your resale price pleasecontact me for some free advice. If you’re considering selling please give me a call for a current market valuation.

Anthony Webb welcomes our second artist Christos Chrysanthou as heopens his exhibition this July and August at our Palmers Green office.10% of all sale proceeds are kindly donated to the North London Hopsice.

Introducing local artist Christos Chrysanthou

The variety of art Christos creates comes fromhis love of colour, shapes and symbols. As afan of abstract and modern abstract art heuses atmosphere and space to depict andcreate different worlds and landscapes thatcan take you through an emotional journey.Christos’ artistic influences are Mark Rothko,Henri Matisse, post cubist artist Mondrian, aswell as Hindu and Aboriginal art. Thesymbolic images in his ‘Journeys andLandscapes’ series is particularly inspired byhis Greek Cypriot culture. Although his art

practice is mostly fine art, consisting mostlyof canvas art and watercolours, he works ina variety of media and sizes and always triesto be experimental with his techniques andideas.“Being an art teacher means that there is nota day that I do not think about art. The art Icreate comes from colour, shapes, symbolsand experimentation.”Some of his work was created in Cyprus atthe Lemba Art School in Paphos where hestudied in the summer of 1995. Thesecolourful and bright water colours later ledto the cell creations that were part of hisDegree show and most recent Cells series.“Art was always my love, nothing came closeat school, and so I went on to Middlesex andHertfordshire University to complete my BAArt and Design Honours degree. In 2000 I became an art teacher and havenever looked back. My ideas and influencesare always changing, especially being aroundsome amazingly talented and creative pupils

and teachers. No matter how my life changes,I know my love of art and the ambition toexpress myself will never change.”

This year Osidge Primary School in Southgate is celebrating its 80th anniversary. But it could havebeen so different. Just four years after Barnet’s ‘state of the art’ school had been built four incendiarybombs landed on the field and playground with a fifth hitting the roof and bouncing off. Miraculously, through the War, both the building and the children of Osidge survived, to tell the tale.

Osidge Celebrates its 80th Anniversary with Os-Fest!by Paul Shuttleworth, editor of the Osidge 80 years website (PTA member)

Osidge School was the much neededschool for the new district of East Barnetwhich, after the extension of the PiccadillyLine and opening of Southgate tubestation in 1934, was in the midst of ahouse-building boon. Osidge School wasopened in an official ceremony in theUpper Hall on Saturday 18th April 1936, byRev. F. H. Richardson. To this day thebuilding remains almost unchanged, withthe signs for the separate boys and girlsentrances still visible. The first school in the area, the catchmentof Osidge was much wider than today. Oneof the oldest surviving pupils, 87 year oldJoyce Goldsmith, recalls walking all theway home to Arnos Grove not just once, togo home for lunch too!Children’s memories of playing in Pymm’sBrook paints 1930’s East Barnet as a ruralidyll. But this peace was to change withthe outbreak of War and in particular theBattle of Britain when in 1940, lessonswere disrupted daily. Perhaps, living on theoutskirts of London, parents had thoughtthe risks of being bombed were less. Lessthan 50 Osidge children took part in theGovernment’s evacuation programme.Instead, air raid shelters were built in theplaying fields, where they remained until1970.

80 year old TommyWells rememberspassing time in theair raid shelters as ifit was yesterday. “Weused to sing our 12times tables athousand times overin the candlelight.”At the sound

of an air raid each class lined up andproceeded in an orderly manner down theconcrete steps into the undergroundshelters, where they sat on wooden slattedbenches along the side of the walls.School life in the forties saw a constantstream of drives and knitting to help the

war effort. “We used to collect shrapnelfrom the bomb damaged sites and hand itover to the ARP warden in HampdenSquare” explains Tommy. Nothing waswasted. As part of the Dig for Victoryinitiative the playing field was ploughedup for potatoes and each child had theirown plot to grow food for their family. Finally in 1945 peace came to England andfor the children of Osidge it was a time forcelebration. The following year, as part ofthe victory celebrations, every child atschool in the UK received a certificate fromKing George V, possibly the only officialdocument to acknowledge children’sresilience during World War II.

As part of the Osidge 80 Years celebrationspupils are being introduced to past pupilsso that these incredible stories are writtendown and can be passed on to futurepupils. The students findings along withold registers and artefacts are part of aspecial 80 years Exhibition being held at

the school. The Exhibition is also a chance to showchildren how Osidge inspired past pupilsand what a huge array to choose from. Inmore recent years, the school claims anumber of household names as pastpupils. Student Robert Rinder is now betterknown as ITV’s Judge Rinder and from theworld of music the roll call includes RachelStephens from S Club 7 and Dan Gillespie-Sells, lead singer of The Feeling. Recordingartist Juliette Ashby recalls Osidge as theplace where she and her best friend, multiGrammy award winning artist, the lateAmy Winehouse first found their voice.“Osidge made room for our creativity. Ithink that’s crucial for children and theirdevelopment. We were always making upsounds and stories which allowed us toexpress ourselves.” It was for Osidgeassemblies that Juliette and Amy formed agroup called Sweet N Sour after Salt NPepa, their favourite rap duo. Juliette willbe introducing tracks from her new albumas part of Os-Fest, a family music festival inthe school grounds. “I can’t wait to comeback. It’s going to be like performanceassembly all over again.”

The 80 Years Exhibition will be openduring Os-Fest, the family festivaltaking place on 9th July at OsidgeSchool from 2pm – 10pm (theexhibition closes at 5.30pm). Ticketsare available by booking online atwww.osidge 80.org or in person onthe day.

What A Load Of [email protected]: 020 8379 2653

Councillorʼs Corner by Cllr. Bambos Charalambous

One regular problem that all councillors getcontacted about is flytipping. Flytipping is areal scourge and eyesore for all those livingnearby and can lead to public healthproblems providing a food source for foxesand rats. Whilst the Council does removeflytipped rubbish on public land within 24hours of it being reported this is not thesolution to the problem. The root of theproblem is human behaviour and peopledisrespecting their neighbourhood. TheCouncil does prosecute people flytipping andhas recently acquired additional powers topunish those caught in the act of dumpingrubbish on public land.A few years ago I visited an access road tothe rear of some properties in Rylston Roadwith some local residents to see a problemthey had with flytipping. The residents werecomplaining that plastic carrier bagscontaining rubbish were being thrown overa wall from neighbouring flats into the accessroad. After a few minutes talking with the

residents a bright orange carrier bag camesailing over the wall and landed inches frommy feet. We couldn’t see the culprit anddespite yelling at the mystery flytipper hewas gone. Whilst I don’t recommend thatanyone do this I opened the carrier bag tosee if we could find anything identifying thislitterbug. Sure enough I found a documentwith a name on it and after referring this tothe Council’s enforcement team action wastaken and the perpetrator dealt with.Under the Unauthorised Deposit of Waste(Fixed Penalties) Regulations 2016 whichcame into force on 9 May 2016 a FixedPenalty Notice of £200 can be issued againstanyone caught flytipping. The Council however is not responsible forclearing away rubbish dumped on privateland but does have powers under theEnvironment Protection Act 1990 and theAnti Social Behaviour Crime & Policing Act2014 to prosecute and fine people on whose

land the rubbish has been left if it hasn’tbeen cleared away.To catch flytippers the Council relies on somecctv but also on members of the publiccoming forward to let them know when theyhave seen anyone doing it.There is invariably a cost to the Council intrying to track down flytippers and also inclearing the rubbish. It is far better for it notto have been dumped at all but for thisattitudes need to change. For instance, theidea that leaving rubbish by a random tree, lamp post or street sign is acceptable – wellit isn’t. The cost of enforcing and removingdumped rubbish is paid for by you and me asCouncil Tax payers. If you have anyinformation about who has been flytippingand where, please get in touch with me oryour other ward councillors or the Councildirectly via their website www.enfield.gov.uk or on 020 8379 1000. Let’s see if wecan tackle this problem together.

Parliamentary Commentby David Burrowes MP

It’s been another busy month for me inWestminster. One of my most importantevents involved constituent Mark Dingley, who appeared on a panel discussion entitledCO Safety for Britons Abroad, an event Ichaired and convened hosted by the All PartyParliamentary Carbon Monoxide Group(APPCOG). Francesca, Mr Dingley’s daughter, was 22 when she tragically died in 2015 inChengdu, China, having only just moved tothe country to start work as an Englishteacher. She died when carbon monoxidefumes emitted from an incorrectly installedwater heater in her flat. Francesca is one oftoo many who die from carbon monoxidepoisoning abroad. I followed the meeting bywriting to the Foreign Secretary to urge theGovernment, travel industry and energysuppliers do all that they can to help raiseawareness and ensure carbon monoxidedetectors are readily available. Make surebefore you or friends or family travel abroadthat you pack a carbon monoxide detector. As you may know, I have been campaigning

for tougher laws on the production, distribution, sale and supply of NewPsychoactive Substances (NPS) since 2006.On May 26th of this year, the Governmentresponded to my call for a blanket ban onthese substances, and it came into force in theUK. Also known as “legal highs” thesesubstances have been deemed by the UKGovernment to present dangers to the publicdue to their “legal” profile and thereforeunderestimated threat to users. Deathsrelated to NPS in England and Wales morethan doubled from 26 to 60 between 2009and 2013.I am pleased to have played my part ingetting this important law onto the statutebook. It calls time on shops selling thesedangerous substances. On 4th May, the Prime Minister announcedthat the Government would resettleunaccompanied asylum-seeking children fromGreece, Italy and France. This followedmultiple attempts from me and Conservativecolleagues, for Ministers to build on their

commitment to resettle 20,000 people fromSyria by 2020 and a further 3,000 vulnerablechildren from the Middle East and NorthAfrica. This initiative, a non-EU administeredscheme, will rely on the good will of theBritish public. We’ve already proved ourcompassion by pledging £2.3 billion inhumanitarian aid for Syria; £65 million to helptackle the migration crisis in theMediterranean; and resettled around 1,800 ofthe 23,000 refugees, whom the PrimeMinister has committed to give refuge by2020. The Government will now work withlocal authorities to determine their capacityto resettle unaccompanied asylum-seekingchildren from Europe. The first arrivals areexpected by the end of the year, and eachlocal authority must take its fair share ofvulnerable children. The response cannot justfall on the shoulders of counties like Kentwhich are in the front line of irregularmigration. Enfield must match its words ofsupport with practical action to accommodate, integrate and be hospitable to refugees.

The restaurant itself has an upmarketambience, is large and can seat up to 150diners with intimate dining areas alsoavailable. There is a bar at the front with arelaxed feel and a more formal dining area tothe rear. Naz, the manager, tells me thatwithin a month there will also be a reargarden where you can enjoy alfresco dining.

The menu offers a great selection of modernEuropean classics including seafood, steak, chargrills, as well as vegetarian options suchas Risotto Verdure.

Claude and I both opted for seafood starters, black pearl scallops served with porcinimushrooms and a parmesan pea puree andfresh drunken calamari. The scallops weresublime and beautifully presented in a shell. The calamari was light and crispy, served with

tartar sauce. For our mains Claude selectedthe organic duck confit with crushed newpotatoes, spinach, pomegranate, walnuts andan orange sauce and I opted for the wild seabass seasoned in lime, sea salt and freshthyme served with potato gratin. Thepresentation is to be applauded, the flavoursall complement one another subtly and thereis a good selection of sides on offer too. Asfor the dinks, Claude selected a glass of houseRosé and I treated myself to a small goldbottle, or two, of Bottega prosecco.

Feeling very satisfied we still however hadroom to squeeze in a dessert. The chocolatefondant was amazing, hot and intense with ameltingly soft centre and the mangocheesecake special with a thick biscuit basewas the perfect way to finish off what hadbeen a great evening.

The study, carried out on behalf of St. James’s Place, aimed to understand how attitudes have changed ayear after reforms to the UK pension system wereintroduced – and how these are influencingretirement planning and behaviour. The chancellor’s decision to trust over-55s to usetheir pension how they like was welcomed bychampions of freedom and choice; while criticsargued that the move would only serve to increasethe risk of people making poor decisions.Worryingly, despite widespread media coverage andgovernment initiatives to raise awareness, only 49%of those questioned said they understood thepension changes and the impact on their choices. Moreover, over 40% of respondents remain confusedabout the way pension cash withdrawals are taxed.

The paradox of choice: Participants in thestudy were often confused about what their optionswere, the age at which they could access benefits, and even how much their pension was worth.Almost

all of those surveyed said they wanted moreinformation and guidance on pensions; but the studyalso showed that, for some, retirement is an eventpredicated by fear – and that this fear might bedriven, in part, by a lack of financial advice.Just 3% of those who said they were afraid of whatthe future holds have sought help from a financialadviser. In contrast, 45% of those who said that theywere looking forward to retirement have benefitedfrom financial advice.Regardless of whether financial advice had alreadybeen taken, almost all respondents (94%) consider itto be at least ‘quite important’ before or atretirement, and more than half (52%) think afinancial adviser would be their first stop for pensionadvice.

Grey glide: Those approaching retirement oftentalked about the ‘fear’ of stopping work and theimportance of having ‘something to do’ to keep themmentally and physically active.

Many want to continue working and volunteering intheir later years, but will spend less time doing thosethings. Almost half of respondents (47%) plan toreduce their hours and take a glide path intoretirement; in other words they do not see retirementas beginning at a specific point in time.Perhaps unsurprisingly, individuals exhibiting a highlevel of financial sophistication are more than twiceas likely to be interested in their pension, have agreater propensity to seek financial advice, and alsoexpect to retire earlier with a higher annual income. The value of an investment with St. James’s Place willbe directly linked to the performance of the fundsyou select and the value can therefore go down aswell as up.You may get back less than you invested. The level and bases of taxation and reliefs fromtaxation can change at any time. The value of any taxrelief depends on the individual circumstances.*‘The Impact of Pension Freedoms on Pre-retired Holders’,The Wisdom Council, January 2016. A total of 380 peoplecompleted the survey.

Points to consider when registering for VATby Alex Chrysostomou

Question:I’ve been running my own business and havenever needed to register for VAT. I know thatif I want to grow the business I will need tostart thinking about VAT. I also know that it’squite a minefield. Do you have any advice?Answer:VAT is every business person’s worst enemy. The complexities of how VAT works indifferent industries seems to catch mostpeople out, which is why it is vital that thecorrect advice is given at the onset, evenbefore you register for VAT.

The current threshold for registering for VATis an annual turnover of £83,000.This meansthat if your turnover is above that figure, youHAVE to register for VAT (there are of coursesome industries where VAT registration won’t

be necessary, even if your turnover is abovethe threshold). If your turnover is below thethreshold, you can still register for VAT if youchoose to, however, it is not mandatory.

The key point when registering for VAT is tochoose the correct scheme. Most businesseschoose the standard VAT scheme. However,it is always important to analyse the type ofbusiness you are and the industry youoperate in, before deciding which VATscheme is best.

An alternative scheme often chosen byfreelance workers, is the Flat Rate Scheme(FRS). This scheme is easier to manage andcan usually result in a lower VAT billcompared to the standard VAT method. Also,if you join the FRS when first registering forVAT, you’ll get a 1% discount on your VAT

liability for the first 12 months.

There are of course other options like thecash accounting and annual accountingscheme. It is important to analyse how eachoption will impact your business goingforward. It is also important that you planahead for the VAT liability that you’ll now bepaying. Businesses often underestimate theimpact of paying their VAT liability, particularly in the first few quarters, whichcould have an impact on cash flow.

The final key point to take note of is that onceyou register for VAT, you can potentially claimVAT back paid in the previous 4 years onpurchases (6 months on services), whichshould help ease the burden of any VATliability, particularly in the first quarter ofregistration.

In January of this year Eleni, a local Palmers Green resident, mother and professionalopera singer, launched Asterakia. Fun interactive classes for 0-6 year olds in Greek.

Children learn Greek through musicand movement at Asterakia!

Where did yourpassion formusic develop?Growing up inCyprus my love formusic started atthe age of 7 whenI started learningthe piano. At theage of 18 I studied Music at Aix-Marseille IUniversity in the South of France. After 4years I moved to London to earn my Master'sin Performance Singing from KingstonUniversity and then went on to work as aprofessional opera singer, while performingin London and other European cities. For thepast 10 years, I have worked as a MusicCoordinator teaching children from the ageof 0-11 in schools and children centres.

What was the inspiration behindAsterakia? The idea of creating a funmusical class in Greek came to me after thebirth of my first daughter Ariana. When shewas around 14 months, I realised that shecould understand the Greek language butwas responding in English as she wasattending nursery from the age of sixmonths. It was then that I realised thedifficulty of raising a child in a bilingualenvironment. For that reason I tried to finddifferent ways of teaching her the Greeklanguage through fun games, nurseryrhymes, and traditional tales with puppets. In December 2016, as part of my New Year'sresolution, I started putting everything onpaper and I created the structure and thefirst unit. The name "Asterakia" is the Greekword for 'little stars' and is inspired by my

very own little stars Ariana and Lydia. Musicis always a lovely way of engaging with mytwo daughters and spending constructiveand educational time together. Ariana'sfavourite song is To Gourounaki (Little Pig)and Lydia's I Koukouvagia (The Owl).

Tell us more about your classes.Asterakia is a 30 minute fun music andmovement class which enables each childto learn the Greek language and culture.Asterakia is suitable for 0-6 year olds andour themes are designed to enable babiesand small children to listen and imitateanimal sounds, the sounds of instruments, story time, and the sounds of adults singingand humming in Greek all of which engagesthem in their learning of the Greeklanguage.

Living and working in Latin America was part of my life for six years. The clear blue skies with whitemountain peaks circling La Paz Bolivia were the backdrop to falling in love, marriage and raising a family.A love and appreciation for its peoples anddiverse cultures also ensued. Everything fromthe remnants of Inca civilisation on the highAndean plateau to the easy sophistication ofan evening in Buenos Aires have left theirimprint on me.And this is a major reason weventure afar, to experience and understandthe other road travelled.

But isn’t everything south of the Tex-Mex linebest exploited by the backpacker? Fortunately, there is plenty accessible to those who like an

upscale residence! At the ethereal MachuPicchu, the prestigious Belmond Hotel, TheSanctuary, is a flagship property mirrored byothers in theAndean region which will aid thetraveller on an extended itinerary of discovery. The monument itself was built as an estatefor an Inca ruler in the 15th century, fallinginto disuse after the conquest, remainingunknown for many years.Although envelopedin the upper folds of mountainous terrain youcan arrive in style by rail on the special HiramBingham train. For many, a trip to MachuPicchu is a once in a lifetime experience. TheBelmond Hiram Bingham assures a magicaljourney, never to be forgotten.

The most remarkable place I have ever beenis Iguazu Falls, the engulfing water dominatedchasm of rainbow lights, mist and mystery; aplace of both terror, spectacle and inspirationwhere those seeking to enhance theirencounter can be immersed in the neo-Portuguese colonial Hotel Das Cataratas.

In faraway Rio de Janeiro so much can be

enjoyed from any one of the luxurious hotelsin the city whose twin landmarks of the SugarLoaf Mountain and the immense statue ofChrist, together with the famous beaches areall to wonder at. Two hours by car from Rio isthe well-known and more relaxed resort ofBuzios, where a fascinating collection ofbeach coves invite you to unwind.Lovers of wildlife and the natural world willstill be thrilled and delighted by a visit to theAmazon basin, traditionally a difficult areabut now within reach on a P & O cruise.Alternatively, step into the unforgettable bybooking a lodge for just a few nights.Argentina boasts the coloured mountains inthe north, and Chile’s outstanding mountainscenery contrasting sharply with the rainlessAtacama…and many more. There are people to meet, and new customsto discover together with some Spanish orPortuguese to be attempted or perfected. Aguide is still more than useful on any tour,self-made or otherwise.

Many of my clients approach me initially with a physical discomfort, but often they are livingwith a mental or emotional discomfort too, and althoughAmatsu is a physical therapy, workingto realign their body can also have a profoundly positive effect on their mood as well.

Amatsu client, Sue, first contacted me eightmonths after the birth of her daughter, complaining about her lower back pain. After a short series of sessions she describesher relief from postnatal depression:“It’s as if you’ve opened the sunroof in myhead!”With depression you may feel blank andempty a lot of the time, like nothing reallymatters. At other times you may find thatnormal everyday tasks could send you into aspiral of anxiety, making you feel sick, dizzyand unable to do anything else. You may feellike you have lost touch with yourself.Feelings of anxiety or stress can sometimesbe overwhelming and can affect how wellyou sleep at night. It can also have a majorimpact on your mornings too. Maybe you

wake in a panic or even with abject terrorand dread at the idea of facing another day?Or perhaps one minute you’re weepy andupset, but the next angry andfrustrated…and very confused. You may have tried exercising or a form oftalking therapy. Maybe you’ve triedbreathing techniques or meditation. Orperhaps you’ve even tried medication. But you may not have considered a physicaltherapy like Amatsu. With its roots in Japan, Amatsu recognisessomething that we are all know instinctively;our body posture and our mood flow alongwith each other, hand in hand. One affectsthe other and although it’s sometimesdifficult to know which came first, changingone will result in a change to the other.

Amatsu uses a unique combination ofmovement, pressure and release to workwith your physical body. There are no cracksor crunches and for the most part you lie onmy treatment couch fully clothed. It is deeplyrelaxing and calming, creating space for yournervous system to rest. Taking away thebodily stressors by giving your body back itspoise means your nervous system gets achance to recover.

If you or someone you know is suffering with depression, anxiety or stress call me for an informal chat.Mobile: 07720 81 01 01 Email: [email protected] www.amatsutherapyintl.com

And you could benefit from my “3 for 2” offer during July and August by quoting this article. Why not try Amatsu; it could change your mind!

Susan Mehmet and myself havemade a short film about the pondin Conway Rec.We spoke to some of the people who have worked sohard to rejuvenate the pond. The original builders who built thehouses of the Lakes Estate, had planned to build a road betweenCannon Road and Conway Road through the original green space, however they were thwarted by the existing swampy pond and theroad was never built. The pond and the Rec have gone throughvarious forms including allotments in the first world war. Currentlythe Rec looks very well cared for at the moment due, in a large part,to the great care and effort that the many volunteers have taken. Aswe walk through the Rec it is super to enjoy our lovely surroundingsbut it is also important to appreciate the hard work of our localvolunteers.

I am a private landlord and I have been informed thatthere were changes made to the eviction procedures inOctober 2015. Can you please explain what thesechanges are?One set of changes that came into force on 1st October 2015relate to the procedure available to private landlords to issuea claim for accelerated possession proceedings once the termof the tenancy has expired. This is usually achieved by firstserving a Notice pursuant to Section 21 of Housing Act 1988(as amended). The changes made were broadly speaking as follows:Timing of the service of the Notice: A Section 21 Noticecannot validly be served in the first four months of a tenancy;Expiry of the Notice: If Court proceedings are not issuedwithin 6 months of the service of a Section 21 Notice then the

notice will be invalid;Prescribed Form: A new prescribed form of Section 21Notice will be required and a copy of the new form is availableonline;Procedures to be followed: A landlord or their agent's failureto provide the required information to tenants at the start of atenancy can invalidate a Section 21; andNotice of Repairs served by the tenant: Failure to follow theprescribed and time-limited repairs process set out in the newregulations can both invalidate a Section 21 Notice andprevent a fresh Section 21 Notice from being served for afurther six months. These are significant changes that have been made andtherefore it would be sensible to obtain legal advice specific toyour individual circumstances to ensure compliance with allrelevant requirements.

Hello to you all. I hope that you have all recovered from the referendum and all the build up to it. Hopefully, wecan all move on to building a happier and stronger future for ourselves and of course for all future generations too.

I hope you are enjoying the Euros? My house is never football free but to be honest (and this is something that Iwould never admit to my husband) I actually quite enjoy football and going to the Emirates to watch my husband’sbeloved Arsenal. I find it a good escape from running a very busy legal practice and gets me out of the house too.

Being a Divorce Lawyer by Karen Chapman10 Things I’ve Learnt…In my twenty years of practice I’ve had the privilege of helping manyhundreds of people through some of the most perilous and tryingtimes of their lives. My job is not to judge any given situation thatwalks through the doors but to try and lift the fallen, restore thebroken and help heal the hurting. Having accompanied many clientson life changing journeys, I have picked up some pearls of wisdomalong the way:-

1. Expect the best but prepare for the worst. With the divorcerate hovering at 1 in 3, those couples who have frank discussionsat the outset and invest time and money in a well thoughtthrough pre-nuptial agreement often save themselves costs anduncertainty if things don’t work out.

2. You still need a “reason” to get divorced. It’s not possible todivorce solely on the basis of irretrievable breakdown ofmarriage. The most commonly used basis for divorce isunreasonable behaviour. This can be obtained using very low keyallegations and is often viewed as a means to an end because itallows a formal process to begin without waiting in limbo for along period of separation.

3. You don’t get more because your spouse cheated. Thereason for marriage break up has no bearing on how assets aresplit. It’s hard not to let anger or guilt cloud your judgement butthe behaviour of a spouse at the end of the marriage will notovershadow an entitlement to a fair share of resources built upduring the whole course of the relationship.

4. Pick your battles carefully. Fighting tooth and nail over everydetail is emotionally exhausting and expensive. Knowing whatreally matters and what you are willing to fight for is importantin divorce. Because I am emotionally removed from the situation

it is my job to help my client’s gain a more objective perspective.

5. Children always want their parents to get along. There aremany resources available to help divorcing couples with childrenmanage the process from a child centred perspective. I have thebenefit of working with a team of lawyers who collectively drawon a wealth of many years of experience and employ skills andstrategies to find a solution. If you have children together youmust do what you can to try and get along and protect themfrom the fallout. End of story.

6. You will encounter many emotions along the way. Grief, anger, sadness, denial and depression are all a normal part of thegrieving process when a marriage ends. High conflict divorce isripe with emotions. The people that dissolve their marriages withthe least amount of trauma are the ones that have learned tomanage their emotions.Acknowledge what you are feeling. Findconstructive ways of expressing those emotions. Seekprofessional help if needed. Divorce litigation as a form oftherapy is an expensive and painful exercise.

The Family Law Specialists7. Judges decisions are unpredictable. Even when you do

everything right it is impossible to predict with absolute certaintywhat a judge will decide. When a range of issues have to bedecided there is often no clear “win or lose”. I will always helpclients search for the fair solution where available. An out ofcourt settlement can provide much needed certainty andfinality.

8. Dealing with an uncooperative spouse can be tough.Sometimes no matter how hard you try to keep the processcivilised if the other party takes on the role of uncooperativespouse ending up at court may be inevitable. When that happensit is vital for my client’s to know that I am on their side and readyto roll up my sleeves, dig deep and fight their corner. There is nonegotiating with crazy.

9. Choosing the right lawyer is one of the most importantdecisions that you can make. Giving my clients legal advice isjust one part of the job but it is so much more. Although manyclients cannot comprehend the roller coaster of a ride that liesahead of them, each individual’s journey through the process willbe unique and my role will include being adviser, confidante, sounding board, therapist, punch bag, mentor, counsellor andfriend. When a client is clinging on by the fingernails I know theyare relying on me to quite literally “get them through it” and Ialways do.

10. There is life after divorce. The demands of the job are achallenge but helping people through the tough times, seeingthem grow and start a new and better chapter of their lives is areal privilege and immensely rewarding. How many people cansay that they can do that in their line of work?

Separation and the impact on childrenby Marion FoleyA few weeks ago my nine year old daughter asked me what I did fora living. Given the nature of my job and her young age it was a trickyone to answer. I explained that my job was to help mummies anddaddies who have stopped loving each other to decide where theirfamily should live, how their children should spend time with eachparent and how their mummies and daddies should share what theyhave.

I was interested to hear from my daughter about the livingarrangement that she would choose if me and my husband everseparated. She said "oh, that's easy mummy - one week with youand one week with daddy!” I must admit I was surprised by the easeat which she answered my question and the simplicity of herresponse. If only parental separation could be that easy on childrenand they could adjust to splitting their time between parents sosmoothly. But in my twenty years of practice more often than not, Ihave experienced that children find the transition a struggle nothelped by feuding parents who find it difficult if not impossible to putaside angry and hurt feelings and to prioritise their children’s needsand emotions.

In the turmoil of separation couples can forget that they are not theonly ones who are suffering. Many children strongly feel the loss ofthe family unit and the separation from a parent who has moved outof the family home and who they may only see every other weekendand in the school holidays. It is a big change for children fromspending time with a parent every day to not seeing them for days orweeks. Precious memories and experiences we hope our children willtake into adulthood and share with their own children one day canbecome tainted by the pain of family separation.

When parents are embittered and angry they can use children as

weapons not realising the pain and anxiety it can cause them. It ishard to imagine that a parent’s behaviour is intentional because asparents we love our children more than anything else. When you arenot thinking straight however, it can be hard to see the emotionalharm of parental conflict. If it happened to me, I would hope that Icould put my daughter first but you never know how you will reactuntil you are in that situation.

That’s why it is so important to find the right solicitor who will notonly support you through the pain of separation but who willencourage you to put the emotional needs of your children first andto reach a compromise that causes the least upset and disruption toyour children. When a Judge has to decide how assets are dividedand how much time children should spend, it is the welfare of thechildren that the Judge considers first.

If you are thinking about separating and you want advice about howassets and arrangements should be shared in the best interest of yourchildren please get in touch. At Chapman Pieri we have a wealth ofexperience between us acting for parents.
