    New Sec. 4. The commissionshallallow affected utilities ro recoverreasonablecosts ncurred to meet the new renewableenergy resourcerequirements required in the renewableenergr standards cilNew Sec. 5. For each affected utiliw. the commissionshall deter-mine whether investment in renewable'energ] resources equired tomeet the renewableportfolio requirement,as r-equired y section 3, andamendments heretd causes he-affectedutility's toial rwenue require-ment to increaseone percent or greater.The retail rate impact shall bedetennined net of ne-wnonrene'irablealterlative sou.ces bf electricitysupply reasonably vailableat the time of the determination.New Sec. 6. (a) The commission hall establish ules and regulationsfor tl.re administrationof the renewableenergy standardsact, iiicludingrepoting and enforcement mechanismsnec*sary to ensure that eacliaffectedutility complieswith this siandardand other provisionsgovemingthe imposition of a-dministrative enalties assessedfter a heiring heliby the commission.Administrativepenaltiesshouldbe set at a level thatwill promote compliance with the renewableenergr standardsact, and

    shalinot be limit6d to penalties et fortl in K.S.A*66-138 nd 66-177.and amendments heretb.(b) For the calendaryears 20ll and 2012, the commission s notrequired to assess enaltiei ifthe affectedutility can demonstrate t madea good faith effort to comply with the portfolio standards equirement.Th"ecommissionshall exenipi an affectehutility from administiativepen-altjes for an individual coripliance year if th; utilitv dernonstrates^thatthe retail rate impact descriled in 6ection5, and amendments hereto,has been reachedor exceededand the utility has not achieved ull com-pliancewith section3, and amendments hereto. In irnposingpenalties,ihe commission shall have discretion to consider miiigatiirg circum-stances,Under no circumstances hall he costsofadministiativJnenaltiesbe recovered rom Kansas etail customers.(c) The commissionshall establish ules and rezulations equired inthis sectionwithin 12 months of the effective date df this actNew Sec. 7. As used n tl.renet metering and easyconnection act:(a) "Commission" means he statecomoration commission.(b) "Customer-qenerator"means he omer or operator of a net me-tered facility whichi(l) Is powered by a renewableeners/ resource;(2) is located on a premisesowned, operated, easedor othemisecontrolledby the customer-gener ator;(3) is interconnectedand operates n parallel phase and syr.rchroni-zation with an affected utility a^nd s in compliancewith the standardsestablishedbv the affected utiliw,(4) is int6nded primarily to 6iTsetpart or all of the customer-gener-ator's own electricalenergyrequirements;(5) containsa mechanism,approvedby the utility, that automatically

    New Sec. I0. Each utility shall:(a) Make net meterinq available o customer-generators n a ffrst-come, frst-servedbasis,until the total ratedgeneraiingcapacityofall netmetered systemsequalsor exceeds ne perdent of the utility'i peak de-mand during the pievious year.The corirmission ay increise ihe totalratedgeneratingc-apacity i all net metered systemso an amount aboveone percent af+erconductinga hearingpursuantto K.S.A. 66-l0ld, andamendmentsheretoi(b) offer to the customer-generator tariffor contract hat s denticalin electricalenerS/ rates, ate structureand monthly clrarges o the con-tract or tariff that the customerwould be assignedf the dustomerwerenot an eligible customer-qeneratorand shall-not charge the customer-generator ny additional slandby,capacity, nterconnec"tion r other feeor charge thit would not otheruise 6e charged f the custornerwere notan eligible customer-generator;(c) provide a residential classbidirectional nreter to the customer-generator t no charge, ut maycharge he custorrrer-generatoror th eiost o[ any additiona]meteringor diitribution equ;pnientnecessaryoaccommodate he customer-generator'sacilitv: an-d'(d) ^discloseannually.the"availability fth6 net metedng program roeach of its customerswi'th the medrod nd rnannerof discloiure 6eing attlre discretjon f the uttlity.Ne w Sec. f1. Each utility shall allow:(a) Residentialcustomer-generatorso generateelectricity subject onet metefing up to 25 kilowatts;and(b) commercial, industrial, school, ocal government,state govern-ment, federal govemment, agricultural and i-n titutional customir-generators o generateelectricity subject o net meteringup to 200 kilowitts.Customer-generators hall appropriatelysize heir generation o theirexDectedoad.Ne* S"". 13. (a) Net metered facilities must rneet all applicablesafety,performance, nterconnectionand reliability standards riibhrh"dby the national electrical code, the national electrical safety code, theinstitute of electricaland electronics ngineers, ndemiters liboratories,th e federalenergy egulatory ommisiionand an y local governingau -thorities.A utility may equire ha ta cusiomer-ger)erator'system ontaina switch, circuit breaker, use or other easilyaccessible eviceor featurelocated in immediate p_roximity o the customer-generator'smeteringequipment that would allowa utility worker the abillty to manuallyandinstantlydisconnect he unit from the utility's electricdistribution system.(b) A utility may not require a customer-generatorwhose et meter-ing facility meets hb standardsn subsection -a)o comply with additionalsafetyor performancestandardsor perform or pay foridditional testsorpurchaseidditional liability insurance.R utility ihall not be liable directlyor indirectly for permitting or continuing o ailow an attachmentof a net

The commissionshall, within 12 months from the ef-fective date ofthe net metering and easyconnectionact, establish ulesand regulationsnecessary or the administrationof the act, which shallinclude rules and regulationsensuring hat simple contractsare used orinterconnectionand net metorinq, For systernsess han 25 kilowatts, heapplication rocess hall rs ean ll-in-on" document lrat ncludes im -ple,interconnectionrequest,simple proceduresand a brief set of termsano condluons.

    New Sec. 15. Reasonable osts ncurred by a utility under the netmetering and easyconnectionact shall be recoverable nthe utility's ratestrucfure.New Sec. 16. The estimatedgeneratingcapacityof all net meteredfacilities perating nder he provi-sionsftliis act sliallcount oward heaffectedu-tility's-ompliance irh the rencwable nergy tandards ct nsections through7,^and mendmerrtshereto.New Sec. 17. As used n sections 7 throuqh 21, and amendmentsthereto:(a) "ASHRAE" meansAmerican societyof heating, efrigeratingandair-conditioningngineers.nc. standard d.I-2007. - .-(b ) "Energystar" means he ioint programof the United States n-vironmental pibtection aqen"y
