FIGHT AGAINST TRAFFICKING IN HUMAN BEINGS IN MONTENEGRO

In 2001 Montenegro identified the problem of trafficking in human beings and immediately started the fight against this type of organized crime by establishing the position of the National Coordinator for Fight against Trafficking in Human Beings. The identification of the problem of trafficking in persons as a danger and a threat which violates basic human rights, as well as a unique kind of slavery of the 21st century, helped create an understanding of the significance of an efficient and all-encompassing fight against this problem. Joint participation of governmental actors, nongovernmental agencies and international institutions in suppressing this problem was recognized as a necessity.

The first step in establishing a mechanism for fight against trafficking in persons was seen in the establishment of the Project Board (PB). The Project Board consists of ten members. Besides the Chair – the National Coordinator for Fight against Trafficking in Human Beings and the Co-Chair – the OSCE representative, there are also representatives of the Ministry of Interior, the Government’s Office for Gender Equality, as well as the representatives of the International Organization for Migrations (IOM), the Council of Europe (CoE), UNICEF, Usaid, Save the Children UK, and two local nongovernmental organizations „Montenegrin Women’s Lobby” and “Women’s Safe House”.

A Subgroup for Combating trafficking in Children was established in February 2004, as a response and a reaction to the global problem of that particular type of crime. The Subgroup consists of the co-presiding representatives of the UNICEF and the Office of the National Coordinator, as well as of the Ministry of Labor and Social Welfare, Save the Children UK, and Roma NGO “Female Heart”.

A Task Force comprised of representatives of governmental institutions, international organizations, and US Consulate in Podgorica, was involved in drafting a strategic document for fight against trafficking in persons. On November 13, 2003 the Government of Montenegro adopted the Strategy for Fight against Trafficking in Human Beings, which represents an official document and a basis for further action in the area of combating this type of organized crime. Concurrently, the Government established a Working Group for Monitoring and Implementation of the Strategy. The Working Group is chaired by the National Coordinator for Fight against Trafficking in Human Beings, and consists of deputy ministers of the relevant Ministries, such as: Ministry of Labor and Social Welfare, Ministry of Justice, Ministry of Health, Ministry of Interior, Ministry of Education, and Deputy State Prosecutor, together with the representatives of IOM, Council of Europe, OSCE and a representative of the US Consulate in Podgorica, as an observer.

The legislative framework dealing with the problem of human trafficking consists of the following adopted pieces of legislation: the Criminal Code, the Criminal Procedure Code, the Law on State Prosecutor, the Law on Witness Protection, the Law on Police and the Law on Agency for National Security.

In early 2004 the Government of Montenegro, in cooperation with IOM and OSCE, established a Shelter for victims of trafficking. The NGO selected to run the Shelter is “Montenegrin Women’s Lobby”. This is a unique model of good practice in the region involving governmental, non-governmental and international stakeholders working on the same project. There is another shelter in Montenegro for victims of domestic violence and victims of trafficking, run by local NGO “Women’s Safe House”.

The results achieved so far in combating trafficking in persons have pointed out at the necessity of establishing a network of institutions and organizations in order to address this problem in a more successful way in order to ensure adequate treatment of victims. Trafficking in human beings represents a global problem many countries throughout the world are faced with today. It is organized crime rings that stand behind the phenomenon of trafficking in human beings. They employ various methods, such as changing the identity of victims, illegal border crossings, crossing borders in impassable, unsigned border crossings, etc., all of which makes the identification of victims a very difficult task to perform. Therefore, the first step in a successful fight against trafficking in persons is to have well-trained border crossing police officers.

Once they enter a country, the victims of trafficking are taken away all their documents, are kept prisoners under constant surveillance, and are treated in a ruthless manner, without any opportunity to escape or turn to someone for help. Thus, the most common way of identifying victims is during police raids, or through the phone reports of eyewitnesses or the victims` relatives. That is why it is of crucial importance to have good cooperation between the police and the organizations that run SOS hotlines.

In order to provide timely and efficient protection of victims of trafficking, a Memorandum of Understanding was signed between the government institutions and nongovernmental organizations. The agreement was signed by the representatives of the Ministry of Interior, the Ministry of Labour and Social Welfare and the Ministry of Health, on one side, and by two NGOs: “Montenegrin Women’s Lobby” and “Women’s Safe House”, on the other.

Bearing in mind the way in which victims are mistreated and the condition they are usually found in during the identification process, it is absolutely necessary to refer victims to a safe place, where they will be provided appropriate care and a beneficial environment. While being trafficked, victims usually experience strong psychological and emotional trauma, and consequently demonstrate suspiciousness and lack of trust in people. For that reason it is of utmost importance to establish a positive first contact and first approach. For this stage of the rehabilitation process, it is necessary to provide adequate assistance by people who have experience in dealing with the victims of trafficking, and who are able to establish a relationship of trust with the victim.

Not only is the mental condition of the victim imperiled, but physical as well. In the long recovery process of the victim, it is necessary to have a good cooperation of psychologists, psychiatrists and social workers, for a victim to be prepared for normal life and smooth reintegration into the society.

The assistance provided for faster rehabilitation and reintegration of victims is fundamental. Also, for the process to be successful it is necessary to have appropriate legislation aimed at protecting the rights of victims, as well as the institutional support and engagement in raising public awareness about the problem of trafficking. The Draft Law on Foreign Citizens, which is to be adopted in the near future, will provide the victims of trafficking a possibility for shorter or longer residence on the territory of Montenegro. The Draft Law foresees the issuance of temporary residence permits of up to three months. The authorized officials of the state administration, institutions and other organizations are obliged to provide to the victims safe accommodation in a shelter or other appropriate accommodation for the period of up to three or up to six months. During that period the victims of trafficking will be provided all the necessary assistance and services, as well as legal advice on their status and their position.

The purpose of the Directory of institutions and organizations that deal with the problem of trafficking in persons is to give an overview of organizations, institutions and individuals who are involved in combating this type of crime through coordinated efforts. The main intention is that those who get into contact with a victim, directly or indirectly, know whom to turn to and where to refer the victim to for safe accommodation and recovery. This will help complete the mechanism for referring victims and coordinate the efforts of the stakeholders involved in addressing the problem of trafficking in persons. Additional major intention is to help provide professional and efficient treatment of victims. The pages that follow offer all relevant data of the governmental institutions, international and nongovernmental organizations, with the description of the role they play in the united front of fight against trafficking in persons in Montenegro.
