When it comes to kitchens nowadays it seems in some cases there really are no limits. Smart appliances such as ovens that can remember recipes and washing machines you can operate away from home can take the hassle and stress away from the heart of the house, but what are the trends to look out for this summer?

Metallic, black and white, take your pick colour wise. Land is scarce in Jersey.  Planning decisions can redefine and reshape the island and are often the source of great controversy. Not all planning decisions (either to refuse an application or to grant one) are beyond reproach. So how do you make a challenge?

Up until March 2015, persons aggrieved by a planning decision could only challenge it in the Royal Court. This process was intimidating and procedurally complex for potential appellants, who would often feel compelled to instruct lawyers to settle what was perceived as an imbalance of power and resources between the appellant on the one side, and developers and/or the Minister on the other. Specific rules regarding costs meant that appellants were not normally able to recover their costs, even if successful. The passing of the Planning & Building (Amendment No. 6) (Jersey) Law 2014 brings wholesale changes to the appeals process.

Planning applications are now considered by either the Planning Applications Committee (“PAC”) or by officers in the Planning Department. The PAC may review a planning decision which has been made by officers and make a new determination to replace the initial decision.  A PAC decision may also be challenged and referred to an inspector for review who can make recommendations based on the merits of a particular decision. The time scale for challenges has been extended from 14 days to a fairer 28 days.  The cost of appealingA fee will be payable of up to £300, depending on the type of appeal lodged and all parties will be expected to bear their own costs.

The steps in the appeal process· Independent Inspectors will now be appointed by the Judicial Greffe.

· Individuals have 28 days from the date of a decision to appeal against it. The appeal must be submitted to the Judicial Greffe and the Greffier will allocate an appropriate independent Inspector from a panel of those recruited by the Judicial appointment committee.

· The appeal will be considered by the Inspector based upon its merits, either by written submissions or by convening a hearing chaired by the Inspector.

· The Inspector will make his recommendations following consideration of the merits of the appeal to the Minister. The Minister will then decide on the outcome, which will take around 10 weeks from acceptance of the appeal.

· The Inspectors’ recommendations are not binding on the Minister but if the Minister makes a decision that is at odds with the Inspector’s advice, he will need to outline his reasons for doing so. The advice given to the Minister will be released at the same time as the outcome of the appeal.

Appealing an appealAn appellant may appeal the decision of the Minister, but such appeals are limited to points of law or judicial review (where the appellant will have to show that the decision was “Wednesbury unreasonable”).

CommentThe amendments to the planning law may have been a long time coming but there are some interesting outcomes. The Minister is no longer involved in any first-tier planning decisions, which means he will not be judging the merits of his own decision on appeal.  This should ensure greater fairness and accountability.

It remains to be seen whether the new process will be simpler, cheaper and faster and whether the Minister will follow the recommendation of the inspector in the majority of cases.

Should the Minister not follow the inspector’s recommendation, appellants, who it is to be remembered will have immense personal interest in the outcome, are likely to bring appeals to the Royal Court on points of law or even seek judicial review of the decision. It is therefore questionable whether amendments to the law will ease the burden on the Court. Jersey is a special place and decisions ought to be considered carefully and be subject to challenge if needs be, before a part of the island is changed forever.  

As well as having our own currency and (slightly better) climate, here in Jersey we also have our own legislation, governing pensions and investments. Because of this, most products and services advertised on TV, or online are not available, or suitable for Jersey residents. BASE RATE

COUNTDOWNThe Bank of England recently announced that interest rates were ‘’glued to the fl oor’’ which should perhaps not be taken too literally. Whilst the woes with Greece and the EU continue, British industry struggles with a strong pound and infl ation remains low, it is unlikely that base rate is going to go anywhere in a hurry.

JERSEY LENDING MARKETFinding a mortgage has become a bit of struggle for some this year, due in part to increased a� ordability calculations and “stress testing” by the lenders. We need much more competition from lenders but that isn’t going to happen soon.

The good news is that interest rates are at the lowest we are ever likely to see and show little sign of rising soon.

WHICH TYPE OF MORTGAGE PRODUCT?

Many borrowers are still choosing a fi xed rate option for their mortgage, which is the best way to protect against future base rate rises. Tracker rates however are generally much lower and are seriously worth considering if you can a� ord to cover any future rate rises.

JERSEY PROPERTY MARKETThere is a lot of property for sale at the moment, although we regularly hear that three bedroom houses for First Time Buyers are in short supply. When the fi nancial downturn started in 2009, many properties of this type were snapped up by buy to let investors, with the result that as demand has now increased, there are not enough houses available because builders are not providing enough new stock and many owners are sitting on their current house because they cannot a� ord to trade up.

House prices generally seem to have bottomed out. There is still scope to negotiate, but this is still a buyer’s market.

ISLAND GAMES - GOING FOR GOLD

How proud we all feel that Jersey did so well in the Island Games, bagging an impressive 50 gold medals, 54 silver medals and 29 bronze medals respectively.

The hard work and determination certainly paid o� for each of the contestants involved.

Looking back, I’m sure they were pleased to have made certain sacrifi ces along the way to help improve their chances of winning. Many giving up their social lives, cutting back on certain food and drink habits that would impact on their overall fi tness.

Despite their own e� orts, many of the winners commented on the overwhelming “support of the crowd” and the encouragement they received from family and friends to reach their end goal.

A true team spirit permeated throughout the whole event which in itself is priceless.

When it comes to property, we can make similar comparisons to the recent success of the Island Games.

Like those sporting contestants, it takes real hard work and determination to get onto the property ladder or to climb further up it.

We too may need to make certain sacrifi ces along the way, for example, going without a holiday, cutting back on life’s little luxuries and pleasures in order to save hard and improve our “fi nancial fi tness”.

No matter how determined we are to purchase a property, all of us need the “support of the crowd” to see us through to the fi nish line of actually completing the sale.

Family MembersFor some, the bank of Mum and Dad goes a long way in helping to secure a loan or enable a deposit to be paid. 

For others, just having family/friends to support and help pack and move is appreciated and takes some of the stress out of moving.

Estate AgentYour Estate Agent can be worth their weight in gold and will oversee the whole process from start to fi nish, ensuring that the property is processed within the time frame specifi ed. 

Mortgage LenderHaving discussed your fi nancial fi tness at great length, your mortgage lender will agree the amount that you can borrow and prepare the necessary fi nances.

LawyerHaving appointed a lawyer, they will review the deeds to the property on your behalf and conduct a deep and thorough review of the property to ensure that there are no hidden liabilities that you will become responsible for.

SurveyorThe surveyor will conduct a detailed Homebuyers report and o� er a valuation and condition of the property, which can be used for mortgage or insurance purposes.

All the above professionals are team players in ensuring you reach your end goal of buying your next property as smoothly as possible and assisting you in GOING FOR GOLD.
