OBJECTIVE

The objective of this report is two-fold. Secondly, and based on staff's findings and analysis, staff are seeking direction with respect to adjusting the Town's planning and development fees to be more reflective of the current market.

BACKGROUND

As part of their Final Report dated November 23, 2015, KPMG outlined that the Town's revenue generated from Planning and Development fees currently represents a very small percentage of the operating costs to provide the services. They also determined that the Town's level of recovery is significantly less than the comparable municipalities used in the benchmarking exercise . KPMG, noted that a review of user fees will increase the ability for the Town to fund services directly attributable to the individual and lessen the impact on the tax levy. As a result, KPMG recommended that the Town undertake such a review.

In addition, and through the 2016 budget deliberations, Council directed staff to provide recommendations where $50,000 could be generated through cost savings and / or adjustments to fees to increase revenue.

COMMENTS AND CONSIDERATIONS

Planning and Engineering fees for developments are collected through various (e.g. planning, minor variance, subdivision and site plan) application processes. These fees are collected to recover costs associated with the provision of the services associated with the previously referenced processes. The fees are identified in By-law 2007-230 (Planning Fees By-law), which outlines how the fees are to be calculated and collected.

In 2007, a major review of these fees was undertaken and the structure that is currently in use was developed and implemented. This fee structure is based on receiving a fee

to recover costs associated with the staff time to undertake such things as plan review, design review, preparation and presentation of agreements to Council, inspection of construction activities as well as all other administrative duties required throughout each process. In addition to this fee, the structure also allows for the charging back of costs incurred by the municipality for peer consultant reviews and legal costs.

In 2012, a cursory review was undertaken and at that time it was determined that the fee structure was generally in keeping with comparator municipalities used at the time, and only minor amendments were proposed.

In keeping with the recommendations made by KPMG as a result of the Service Delivery Review, dated November 23, 2015, staff conducted a review of current fees and compared these fees to the comparator municipalities of Barrie, Bradford West Gwillimbury, Caledon, Halton Hills, Innisfil, Orillia, and Orangeville. Each municipality collects and calculates fees differently and as such, there is no direct comparison between New Tecumseth and each of the comparators, however it does provide an general indication of market conditions.

Planning Development Fees

Overview:

With respect to the Planning fees, staff have proposed an increase in fees in an attempt to cover more of the actual staff time required for the processing of development applications. These increases have been compared to other municipal counterparts, and the increases proposed attempt to be fair and represent a reasonable recovery of staff time. Regarding the comparators, while every effort has been made to use actual numbers, it is noted that many fee categories have subcategories and some have other additional fees (such as per lot surcharges), therefore not all fee categories in every circumstance are direct comparisons. As noted in the attached planning fees comparison chart (Attachment No. 2), there are 7 comparators, however one being the Town of Innisfil has a fee model that charges actual staff time (full cost recovery) so this has not been included as it is not possible to calculate individual or average application fees. Therefore 6 municipalities form the comparator group.

Attachment no. 2 outlines several recommended fee increases, and also includes the fees charged in the comparator group. In addition, staff are recommending several new miscellaneous fee categories, which are intended to capture staff time incurred in the processing of development applications. The following major fee categories are more specifically described below.

Application for Plan of Subdivision :

With regards to plans of subdivision, it is noted that some of the comparators do not charge a per lot fee in addition to the base fee, whereas the majority do have such a charge. In order to try and compare like applications, staff compared a typical 100 lot

plan of subdivision, and found the average fees were $39,576 whereas the Town’s current fees would be $11,900. Staff are recommending a base fee of $12,000 and a per lot fee of $100 which would raise the Town’s fee to $22,000. While this is still lower than the average, it represents an 85% increase. It is noted that there are 2 very high fees in the comparator group being Halton Hills and Caledon at $60,298 and $86,640 respectively, which greatly influences the average in a relatively small (6) comparator list. The average fee without those two municipalities is $22,630.

Official Plan/Zoning By-law Amendments:

With regards to amendments to the official plan, the average is $12,846 and the Town’s current fee is $7,000. Staff are recommending an increase to $12,000 which is slightly below the average and would be a 71% increase. Similarly, the recommended fee respecting the zoning by-law application category at $10,000 which is close to the average of $10,500. The current fee is $7,000, therefore this recommendation would represent a 43% increase.

Staff are also recommending removal of the minor zoning by-law amendment and temporary use fee category at this time. There is currently a minor zoning by-law amendment fee of $3,000 that would apply if an applicant was proposing adding a single use, amending one zone provision, or as a condition of consent. Further, there is a temporary use category fee of $1,500, which generally can be a garden suite/granny flat or construction of a temporary sales trailer. Given the staff report is usually more straightforward for these categories, a lessor fee has been in place for some time. In reviewing the fee model, although the staff report may be marginally less time to prepare, the statutory requirements required by the Planning Act and the process that staff follow under the legislation is the same as the regular zoning by-law amendment process. In view of this, staff are recommending removal of the minor zoning and temporary use fee category. It is noted that no other municipality within the comparator group had a minor zoning by-law fee category, and the average temporary use fee was $9,548. The recommended fee for all categories of zoning by-law amendments as noted above is $10,000.

Minor Variance:

With respect to the minor variance category, a modest increase from $700 to $900 has been proposed at this time, recognizing that this type of application is often submitted by the average homeowner. The average among the comparator group is $1,308. The intent of staff’s recommendation is not to overly burden someone whose project cost is sometimes less than the application fees to obtain approval. Higher fees for this category may also lead to people choosing to complete projects without the proper approvals in place, which is undesirable.

Engineering Development Fees

Subdivision Process:

Attachment No. 3 shows the information gathered by staff to illustrate how the comparator municipalities calculate and collect the engineering fees for subdivision application review. This chart shows there is no direct comparator to the Town’s process, however, there are a number of similarities. The Town currently charges a fee based on 3% of the municipal servicing cost, and 5 of the comparators use a similar system. Three of the comparators use 5% of the municipal services as part of their base cost, with one being higher at 6% and one being lower at 1.5% to 3.5%. Additionally, there is a variety of other charges for other reviews and agreements that are also applied with no consistency on if legal and peer reviews are charged back. The Town currently has a number of other agreements that the developers can make use of such as earthworks, pre-servicing, and model homes. Depending on the developer’s timeline this can help to achieve the desired results. Other municipalities may not offer this flexibility in their process and as such do not charge for or contemplate these fees.

Based on the review it is recommended that the Town’s 3% of municipal service cost be raised to 5% and the reminder of the fees charged for other agreements remain in their current form. This will allow for developers to choose different paths to plan registration and if more individual agreements are required then they would be charged on that basis. This change to 5% of municipal service cost would bring the Town’s fees closer in line with the comparators.

Site Plan Agreement Process:

Attachment No. 4 shows the information gathered by staff to illustrate how the comparator municipalities calculate and collect the site plan agreement fees. This chart shows there is no direct comparator to the Town’s process and fee structure. To address this lack of director comparison, staff costed six recent site plan applications through the various fee models and generated a matrix included as Attachment No. 5. The fees generated are varied between comparator and by project. As noted previously with subdivision applications there is no consistency on if legal and peer reviews are charged back to the developer and again vary between comparators.

Based on the review it is recommended that the Base fee for agreement be increased from $2,500 to $5,000, and the per square meter fee for commercial, industrial, and institutional be doubled respectively. This would generate an overall fee more in line with our comparators. The per unit fee charges for residential units could be raised from $100/unit to $150/unit, which again would a fee more in line with our comparators. It was also noted that the Town does not charge for exemptions to the site plan process. Two of the comparator municipalities charge $500 and $570 for this service. The demand for these exemptions has increased recently and can involve meetings,

reviews, and reports being generated by staff. To address this growing demand, a new fee of $500 is recommended to be included in the updated fees by-law.

Other User Fees

The last comprehensive review of fees associated with Parks, Recreation and Culture was completed in 2011. Since then there have been only minor adjustments recommended annually between 2012 - 2016. For this analysis and report only fees which contribute to the largest volume of PRC revenue have been included at this time. A comprehensive review will require additional effort to collect, analyse and recommend fee adjustments. Staff have provided a high level comparison in Attachment No. 6 to provide Council with a snapshot of some of the current fees charged by comparable municipalities identified in the KPMG report, as well as neighbouring municipalities within a commutable distance.

The KPMG report indicated that PRC’s fees are low to average when compared to other municipalities. The fee data collected for this report is consistent with KPMG's results as they show that in most cases PRC fees are average or lower than the average fees charged by comparable municipalities. No PRC fees appear to be higher based on the data collected:

Higher: None

Average: Arena Ice, Daycamps, Shinny Hockey, Public Skating, Fieldhouse.

Lower: Fitness Memberships, Arena floors, Outdoor Sports Fields, Gymnasium.

One approach to generating additional revenue is to increase fees in areas where PRC’s fees are lower than the average comparable municipalities. This would include fee increases for fitness memberships, arena floors, gymnasium and outdoor sportfields. Staff recommend that, prior to adjusting any of the approved fees, staff be directed to conduct further analysis to determine the impact that fee adjustments will have on users’ participation in, and willingness to pay for, PRC services.

A second approach for immediate increased revenue generation is to increase all PRC user fees by a percentage across the board. PRC’s annual revenue through user fees in 2015 was $2,267,169. A 1% fee increase across all PRC user fees would result in $22,672 in additional annual revenue commencing in 2017. The timing for implementing changes to user fees is important for individual’s and user groups’ planning for the upcoming season, requiring at least 6 - 8 months of lead time for user groups to adjust their fees to their participants, in order to accommodate the fee increase. If this option is chosen, the revenue increase for 2016 will be estimated at approximately $5,000 to $11,000 depending on the timing of the notification to user groups, and their ability to pass on these fee increases to their users. Individual single booking fee increases can be introduced one season ahead without a significant impact. As a result, the impact of any fee increase will not be fully realized until 2017.

Staff is recommending that Council not increase PRC user fees until a full fee assessment is undertaken, and any significant user fee adjustments, be considered for the 2017 operating budget.

As previously outlined, it is being recommended that the fees related to managing the subdivision process be increased from 3% of the municipal servicing cost to 5%. To manage the site plan process it is recommended that the base fee be increased from $2,500 to $5,000 and the per square meter fee for commercial, industrial and institutional be doubled. It is also being recommended that the per unit fee for residential units be raised from $100 to $150. Currently, the Town does not charge a fee for exemptions to the site plan process. The demand for these exemptions has been trending significantly upwards and therefore, it is being recommended that a new fee of $500 be established.

Based on the volume of subdivisions and site plans that the Engineering Department processed in 2015 the additional revenue from the proposed increase in fees would equate approximately $400,000 for subdivisions and $35,000 for site plans.

“PLANNING/ENGINEERING FEES BY-LAW”

Being a by-law to prescribe a tariff of fees for processing applications in respect to planning and engineering matters

WHEREAS Section 69(1) of the Planning Act, R.S.O. 1990 as amended, provides that the Council of a Municipality may by by-law establish a tariff of fees for the processing of applications made in respect of planning matters, which tariff shall be designed to meet only the anticipated cost of the municipality and of the committee of adjustment constituted by the Council of the Municipality in respect of the processing of each type of application provided for in the tariff;

AND WHEREAS the Municipal Council of the Town of New Tecumseth deems it

necessary to adopt a new by-law respecting planning fees;

NOW THEREFORE the Council of the Corporation of the Town of New Tecumseth hereby enacts as follows:

1. That the tariff of fees as set out in the Attached Schedule A to this By-law be and

are hereby prescribed for the processing of applications made in respect of those types of planning matters as set out on Schedule A.

2. Applications for plans of subdivision or phases thereof, that have made a complete engineering submission including first stage fees prior to February 8, 2016, shall be subject to the tariff of fees in affect on the date of draft plan approval.

3. That this by-law shall be cited as the “Planning/Engineering Fees By-law”. 4. That this by-law shall come into force and take effect on the date of final passing

thereof. 5. This by-law shall repeal By-law 2007-230, as amended by By-law 2012-006 and

2010-030.

Subdivision Engineering Review: 5% of the estimated cost to construct the

municipal services plus the cost of external consultants to assist in the review of the engineering submission. The Engineering Fee shall be paid in two instalments. The first 2.0% instalment is due in conjunction with the application to process the engineering component of the plan of subdivision. The initial instalment is non refundable should the applicant not wish to proceed with the development. The payment of the second 3.0% instalment shall be included as a condition of the subdivision agreement and due prior to final approval of the plan. The engineering fee shall be adjusted prior to issuance of guaranteed maintenance based on the actual certified cost of the municipal services if the fee variance is greater than $500.00.

The cost of peer reviews required for the processing applications where resources outside of Municipal Staff are required for the review of the application shall be charged to the applicant, in addition to the Base Fee and the applicant shall provide the Town with a deposit in the amount of $2,500.

4.

Where agreements are to be registered on title, the costs associated with the registering of the agreement on title and the costs of the Town’s legal review of the agreement are in addition to the Base Fee and shall be paid by the applicant prior to the execution of the agreement by the Town and the applicant shall provide the Town with a deposit in the following amounts: Subdivision Agreement $5,000 Site Plan Agreement $2,500

All monies paid as a deposit for subdivision, site plan and consent agreements and peer review shall be considered as a deposit on account, from which expenses incurred in processing the agreement including but not limited to legal review, registration on title and consultant review and expenses, will be invoiced to the applicant.

6. Copies of third party invoices and a Town invoice will be forwarded to the applicant with payment due to the Town within 30 days. Any unpaid Town invoices will result in interest charges in accordance with the Town’s Interest By-law.

7.

Upon completion of the matter for which the deposit is being held by the Town, the applicant shall make a written request to the Chief Financial Officer/Treasurer for refund of the balance of the deposit. The applicable department head shall authorize the release of the deposit or portion thereof and forward same to the Finance Department for processing.

8.

Fifty percent of the required application fees submitted in respect of an Official Plan or Zoning Amendment application may be refunded if the application is withdrawn prior to it having been scheduled for a public meeting. Notice of the withdrawal shall be in writing to the Manager of Planning and shall be signed by the applicant.

9.

One hundred percent of the required application fees submitted in respect of a consent or minor variance may be refunded if the application is withdrawn prior to it having been scheduled for a committee of adjustment meeting. Notice of the withdrawal shall be submitted in writing to the Secretary, Committee of Adjustment and shall be signed by the applicant.

NOTES: The cost of peer reviews required for processing applications where

resources outside of Municipal Staff are required for the review of the application shall be charged to the applicant, in addition to the Base Fee.
