Negotiations collapse“4 April 2012Following a three week protected strike, ModikwaPlatinum Mine (the “Mine”) announces that theprotracted collective bargaining process with theNational Union of Mineworkers (“NUM”), spanningseveral months, has not produced any agreement.

The dispute concerns wages and conditions ofemployment. At a meeting held on Tuesday, 3 April2012, NUM rejected the Mine’s final offer. The Mine hasthus withdrawn its final offer. NUM made other demandsthat the Mine simply cannot afford. The strike and thecollective bargaining process have failed the parties.The Mine has no option but to withdraw from thenegotiation process.

Striking employees are at liberty to return to work ontheir existing conditions of service.” -African RainbowMinerals statement on Wednesday.

Production had ground to a halt threeweeks ago when about 3 000 NUMmembers downed tools over wagesand conditions of employment.

NUM spokesperson LesibaSeshoka told the media the unionintended to accelerate the strike andwill attempt to spread the industrialaction to oher mines until demandswere met. Seshoka said NUM wantedto close the gap between higher andlower earners and that the offer of a10%-across-the-board increase wouldfail to do so.

NUM said that Modikwa initiallyoffered wage increases of 9.5% for theA-band, 8.75% for the B-band and8.5% for the C-band, while theworkers demanded a 12% wageincrease for all employees. “There is

no going back. Mine managementmust meet our demands or else thestrike is on them,” regional secretaryfor the north-east region WilliamMabapa said in a statement shortlybefore the strike started.

Seshoka claimed the mine waslosing R8.6-million a day in production,adding that should no suitableagreement be made, it seemed likelythat “there would be no mine left”. Themine confirmed that it was losingabout 1 000 oz of platinum-groupmetals a day and that none of thestriking workers had returned to workas yet. ARM said that the mine’smanagement was keepingcommunication channels open, as wellas consulting the relevant structures tomap out a way forward.

Anooraq Resources say the highnumber of Section 54 safetystoppages, as well as a plannedmill shell replacement at itsMerensky concentrator had anadverse impact on its fourth-quarter production.

Platinum group metals (PGMs)output from its Bokoni mine fell by5% year-on-year to 29 316 oz inthe quarter, which endedDecember.

Production over the full yeardeclined 2% to 113 625 oz.Fourth-quarter revenue dropped toCanadian dollar 32.5-million, fromCanadian dollar $43.2-million ayear earlier, while revenue for thetwelve months was Canadiandollar144.4-million, down fromCanadian dollar148.3-million theprevious year.

The company stated that to theslight weakening of the averageRand/Dollar exchange rate duringthe period, combined with animproved basket price keptrevenues relatively constant overthe financial year.

The average PGM basketprice achieved for 2011 was $1380/oz, representing a 10%increase on the 2010 price of $1257/oz.

Cash operating costs for theyear were Canadian dollar 167.9-million, down from the previousCanadian dollar141.8-million in2010, primarily attributed toinflation increases in labour costs,

increased stores charges andannual increases in utility charges.

Fourth-quarter cash operatingcosts declined to Canadian dollar41.7-million, from Canadian dollar42.3-million in the final quarter of2010.The company made a netloss of Canadian dollar 19.5-millionin the fourth quarter, bringing itsloss for the year to Canadian dollar81.7-million. This compares with aCanadian dollar18.4-million fourth-quarter loss and Candaian dollar81.7-million loss in 2010.Meanwhile, Anooraq and AngloAmerican Platinum in Februaryagreed a $600-million restructure,recapitalisation and refinancingplan for the Bokoni mine.Anooraqsaid that the companies were in theprocess of settling definitivetransaction agreements, whileadvancing the necessary legal andregulatory approvals required forthe implementation of the plan. Thecompletion of the proposedrestructure plan is subject toconditions precedent and isexpected to close during July.

The platinum miners alsoagreed a new and enhancedBokoni extraction strategy andrecapitalisation plan, which willfocus Bokoni as a mine indevelopment through to 2017, whilephasing out higher cost marginalshaft operations and increasingannual steady state productionfrom its current base to more than300 000 PGM ounces.

Anooraq’s resultsadversely affected

South African ferrochrome aspirant Ruukki has urged the South African government toimpose a $100/t duty on the export of raw chrome from South Africa with the utmosturgency.

Speaking at an industry conference in Hong Kong, Ruukki enterprise director Dr DankoKonchar called for industry consolidation to protect jobs and maximise South Africa’schrome resource endowment.

Ruukki currently exports raw chrome directly to China and sells a diverse range ofchrome products internantionally into the the stanles steel and steel sectors.

His plea follows years of requests to government to halt the South African ferrochromeindustry’s demise in the face of rising Chinese production from raw South Africa chrome ore.Konchar told the conference that the fundamental challenge for South Africa was to create acompetitive ferrochrome industry capable of protecting, sustaining and creating jobs whilegrowing its global market share.

In the past year both of these objectives have come under threat. The South Africanferrochrome industry currently employs more than 200 000 people and contributes R42-billion to South Africa’s gross domestic product (GDP).

South Africa’s share of the global ferrochrome market has fallen from 50% to 42%between 2001 and 2010 and the worrying trend was set to continue unless urgent actionwas taken to prevent a predicted fall to 36%.

While that was under way, China’s market share had grown from 5% to 25% and wasforecast to increase further. The curbing of unbeneficiated chrome ore exports to China wascritical to reversing the decline in South Africa’s global market share and jobs. Ruukkisupported the current industry initiative that sought to form a partnership betweengovernment and chrome producers to find long-term sustainable interventions.

Konchar urged the $100 duty imposition “as soon as possible” in order to encouragemore beneficiation of chrome ore within South Africa, thereby boosting domesticferrochrome production and yielding additional significant socioeconomic benefits for thecountry.

Similar duty regimes had been very successful in India and Kazakhstan and it was vitalthat the industry and government start a working group immediately. Another initiative thatrequires closer investigation was the possible establishment of a sales and marketingcompany to regulate the export of chrome ore, which had been successful in other markets,such as the oil industry. Export quotas could be directly beneficiation linked.

Alongside these two initiatives, Ruukki believed industry consolidation was alsonecessary.

Do you recogniseyour belongings?Burgersfort Police raided a house in Dresden village outside Burgersfort after a tip-offfrom the community. Inside the house a large number of stolen goods, includingelectronic equipment such as speakers, tv’s and dvd players were found. The Policerequest anyone who may recognise his/her belongings to contact them or to vie thegoods at Burgersfort Police station. At the time of going to press, the full details ofthe case was not known.

More dagga found

On 03 April 2012 Tubatse Police arrested a 59-year-old man and a 50-year-oldwoman in connection with cultivating and selling of dagga and also selling theconcoction. The Police were busy doing their patrols when they noticed some daggaplants at a house in Bothashoek- Pologong section. The Police then entered thepremises and searched all over the yard where they discovered some dagga plantsand they also searched the house where they found the concoction in bottles anddagga inside plastic bags and also inside match boxes.The two accused are expected to appear in the praktiseer magistrate‘s court soon. On 31 March 2012 Tubatse Police arrestedtwo males aged 41 and 49 and a female of63 years in connection with murder.

Their arrest follows an incident at GaMadiseng on Saturday 31 March 2012. Onthat day the Police received a report of adead person on the street in Ga Madiseng.Police made follow-ups and went to thescene and found the victim, a 52-year oldmale. Nearby people were questioned whosaid the deceased was dragged from ahouse by two men. Thereafter the policearrested the two men and a woman inconnection with the incident.

The three suspects Isaac Shai (41),Isaac Nkhuna (49) and Grace Shai (63)appeared in the Praktiseer Magistrate‘sCourt on 02 April 2012 and they were notgranted bail. The case was postponed to 17April 2012 for further investigations.

According to the Public Protector, Ms ThuliMadonsela, South Africa losesapproximately R30 thousand million everyyear to corruption.She was speaking at the InternationalWinelands Conference in Stellenbosch. Thetheme of the conference was: Integrity andGovernance: What is wrong? What is good?What is next?“We are at a tipping point and (formerPresident Nelson Mandela’s) warning that‘our hope for the future depends also on ourresolution as a nation in dealing with thescourge of corruption’, remains valid,” shesaid. In his famous speech in parliament in1999, Mandela said that when people inpower use public funds for their own benefitwe must admit to being ‘a sick society’.She added: “If we don’t deal with corruptiondecisively it will not only impact on goodgovernance, but has the potential to distortour economy and to derail democracy”.According to Madonsela the failure todeliver services is often intertwined withcorruption and maladministration. Shepointed out that the problem with rooting outcorruption is the fact that there seem to be‘protected people’ or ‘holy cows’ whichprevent the proper investigation andprosecution of guilty parties. To address theproblem properly there should be nountouchables.“We believe that public accountability iscritical for good governance and effectivecombating of corruption”. She told theaudience that South Africa is in need ofselfless leadership to help fight corruptionand maladministration. She alsoemphasised the importance oftransparancy. “Without transparancy,accountability is impossible. In this regard itis important to strengthen our whistle-blowerprotection and usage. Media freedom is alsoimportant”.We asked readers how they feel aboutcorruption in South Africa and if they canoffer any solutions to the problem we face.

Mr Sonnyboy Kumalo said: “Corruptionoccurs especially at the top. Governmentmust make sure that they get people whotake responsibility for their actions”.

Mr John Ndukwe said: “South Africadefinitely have a problem with corruption.If you look at the problems the Limpopoprovince is having as an example. If youallow this to continue you will not be ableto root it out. They must try and dilute itby putting in mechanisms to fish outcorrupt people. The law must preventcorruption from eating into the fabric ofsociety. People are naturally corrupt. Byimplementing these mechanisms, makinglaws that will ensure that the person willface the law squarely and go to jail iffound guilty it may get better”.

Pastor D Haimbili said: “People must liveaccording to Romans 10: 9 - 10 in theBible and not do corruption. They mustconfess if they did”.

Transparency International’s CorruptionPerceptions Index ranks countriesaccording to perceived levels of public-sector corruption.It gives scores to 183 countries with 10being “clean” and 0 being “highlycorrupt”.The 2011 Index ranks New Zealand (9.5),Denmark (9.4) and Finland (9.4) top thelist, with North Korea and Somalia at thebottom, both with a score of 1.0. Second Longtomvictory for Leboka

The Longtom Ultra and Half Marathon tookplace on Saturday last week.The 56km race from Sabie to Lydenburg isone of the toughest in the country and manyathletes test their preparation for theComrades with this event.The winner of the 56km men’s category wasLeboka Noto (photographs right) who camein three and a half minutes before the second56km runner. Leboka is an employee ofModikwa Platinum Mine and runs in thecolours of Nedbank. He finished the race in3:43:41. He is 41 years old and a multipleComrades gold medalist. He has won theLongtom Ultra Marathon twice. His first winwas in 2006. He is now focussed on theComrades marathon later this year.The women’s open category was won byJennifer Koech. She also runs for Nedbankand finished in a time of 5:04:36.The day started off cold and windy after amassive storm the day before, but this did notdeter the enthusiastic water point attendantsto do their best to encourage the athletes asthey came past.
