4 1 INTRODUCTION

This Plan of Management for major sportsgrounds describes • the current uses carried out on the land

• the existing level of facilities provided

• the range of activities which could form a part of such sites subject to the requirements of the Environmental Planning and Assessment Act 1979 and the Local Government Act 1993 and Regulations

and identifies • issues relevant to such lands

• management objectives and performance targets

• ways in which the objectives and targets can be met

• the manner of assessment of performance 2 LAND SUBJECT TO THIS PLAN OF MANAGEMENT

Section 36 of the Local Government Act 1993 requires that public land in the care and control of Council classified as “Community Land” is to be subject to a Plan of Management. Amendments to the legislation in 1998 incorporated changes contained in the Local Government Amendment (Community Land Management) Act 1998. The Act allows for more than one area of land to be covered by a single plan of management. This Plan of Management applies to the following major sportsgrounds in Orange City: Anzac Park Endeavour Oval Glenroi Oval Kart Racing and Trotting Track Max Stewart Park Moulder Park (that part excluded by the Crown Lands Act 1989)

Perry Oval Riawena Oval Ridley Oval Rosewood Oval Future sportsground (Kearneys Drive)

The parcels of land comprising the above sportsgrounds are detailed in the following table. Their locations within the City of Orange are shown on the attached maps 1 – 11 (in the Appendix). Some of the sportsgrounds have had previous plans of management prepared for them. This Plan will supersede such Plans.

3 USE OF THE LAND

Major sportsgrounds may be subject to • lease agreements between particular sporting organisations and Council. These lease

agreements allow for that part of the community land covered by the lease to be used and developed in accordance with the terms and conditions of a particular lease;

• sportsground allocations arranged between Council and community groups such as

schools or clubs. Sportsgrounds may be booked for use, subject to payment of a prescribed fee for a set period (usually a season of play).

The community land (including any buildings thereon) contained in this plan may be utilised for a variety of uses in accordance with the land use provisions contained in Council’s current Local Environmental Plan (Orange LEP 2000). Such uses may include temporary uses (Clause 9 of LEP 2000) for the purpose of one-off commercial events (whether or not for charitable purposes) and this would be subject to the consent of Council under the provisions of the Environmental Planning and Assessment Act 1979. The types of uses that may be acceptable at major sportsgrounds are listed under Section 7.

4 CATEGORY OF THE LAND

The lands the subject of this Plan of Management are categorised as “sportsground” under section 36F of the Local Government Act 1993.

5 OWNER OF THE LAND

The land contained in this Plan is owned by Orange City Council.

6 MANAGEMENT OF THE LAND

The land is managed according to the following objectives.

6.1 CORE OBJECTIVES The core objectives stipulated under the Local Government Act 1993 for areas categorised as “sportsground” are:

a to encourage, promote and facilitate recreational pursuits in the community

involving organised and informal sporting activities and games, and b to ensure that such activities are managed having regard to any adverse impact

on nearby residences. Additional objectives that apply to the sportsgrounds the subject of this Plan of Management are: c to facilitate, through Council’s Sports Facilities Reference Group, the operation

and development of sportsgrounds to achieve the best outcome (financial and social) for Council, taking into account the conditions of any current lease or licence agreement;

d non-active areas of each particular sportsground shall be developed to be

compatible with the main use of the land, provide pedestrian and cycle linkages to local streets where possible, provide play equipment as identified by need and enrich the planted environment;

e to provide efficient irrigation scheduling and drainage of the active areas and

allow for, where necessary, drainage retention in the form of detention basins to allow efficient stormwater management in the catchment;

f to provide safe, high amenity sportsgrounds; g any lease, licence or other estate entered into by Council shall be mindful of the

objectives of this Plan of Management.

6.2 ISSUES, PERFORMANCE TARGETS, HOW TO ACHIEVE OBJECTIVES/ PERFORMANCE TARGETS, HOW SUCCESS CAN BE MEASURED (summary in Table 4)

6.2.1 Financial (income, capital funding, tenure)

Issues This Plan of Management specifically provides for use of the land, and buildings contained thereon, to be used by sporting and community-based organisations. Approved activities or activities that are exempt development (under the Environmental Planning and Assessment Act 1979) may be subject to a lease, licence or grant of any other estate under the provisions of the Local Government Act 1993 between Council and a particular organisation, club or group. Such agreements generally involve payment of an annual fee or payment of monies for specific purposes. Some sportsgrounds are used on a seasonal basis for school or club sports in accordance with Council’s Sportsgrounds allocation program. Such use, which is subject to a fee, is reviewed on an annual basis. The cost of providing and maintaining sportsground facilities is shared between the groups who hire the facilities and the general community of Orange (through payment of rates and Section 94 Contributions (Environmental Planning and Assessment Act)).

The latter generally makes use of these open space areas in an informal and casual way. Tenure is also an important issue to sporting groups using ancillary facilities such as clubhouses, particularly where contributions may have been or may be made to improvements or new facilities on a particular site. Performance targets Council shall facilitate, through Council’s Sports Reference Group, the operation and development of major sportsgrounds to achieve the best possible outcome (financial and social) for Council as representative of the general community of Orange City, taking into account the conditions of any current lease, licence agreement or other agreement. Funding of sportsgrounds through contributions from user groups is consistent with Council’s user pays approach. Any lease, licence or other estate entered into by Council in relation to the subject lands shall be in accordance with the objectives contained within this Plan of Management. Means of achievement of objectives Fees and Charges applicable to sportsground users through Council’s Sports Allocations Program, are in accordance with a scale of fees approved by Council and indexed annually. A condition shall be attached to any lease, licence and other estate granted over any lands the subject of this Plan of Management requiring the lease etc to be in accordance with the objectives of this plan and section 46(1)(b) of the Local Government Act 1993. Lessees/licensees comply with the terms of their lease or licence. Council shall actively seek to obtain capital funding support from local organisations to augment the quality of sporting facilities. Works undertaken by Council for sportsgrounds shall be in accordance with programs identified in Council’s annual management plans.

Manner of assessment of performance Payment of appropriate fees and charges within reasonable time. No complaints received by Council relating to the use of sportsground facilities by lessees. Maintenance and upgrade work in accordance with identified programs and lease/licence agreements.

6.2.2 Maintenance and development

Issues The facilities provided at the sportsgrounds the subject of this Plan of Management are included in Table 2 (page 15). Sports field development and maintenance regimes must take account of • the type, age and condition of the facilities • the level of use • the standard of sport played (eg junior/senior, local/district, regional) • future planning for the particular sportsground (through Sports Facilities Reference

Group) • public demand • the season

Performance targets Sportsground activities, including new development, shall be managed having regard to potential adverse impact on adjoining residences. Council shall provide safe, high amenity sportsgrounds. Means of achievement of objectives The sportsgrounds shall continue to meet the basic needs of users within the annual budget framework.

That the land be maintained in a clean and tidy condition such that community use and participation is encouraged. Maintenance regimes are seasonal in nature and are designed to ensure that an existing level of service and quality is maintained. Regular inspections of grounds and facilities are carried out by either Council, the user or the lessee etc under the requirements of the Occupational Health and Safety Act 2000. Manner of assessment of performance Prompt response to identified damage. Number of complaints logged on Council’s Customer Action Requests System concerning condition of grounds and facilities is reduced. 6.2.3 Safety/risk management Issues Council, in conjunction with sporting organisations using the facility, must provide for an adequate level of safety for sportsground users (such as players, spectators and casual users of the area) as well as for owners and occupiers of adjoining land. A reasonable level of safety can be provided through appropriate inspections and facility planning. Council has a “duty of care” for community land under its jurisdiction. Accordingly, Council has a Risk Management Policy that applies to parks and reserves. This system provides for Council to act immediately on complaints that raise an issue of safety. Performance targets Council acts in accordance with the legal principles of “reasonableness” regarding mitigation of safety risks. To provide safe, high amenity sportsgrounds. Means of achievement of objectives Nil injuries as a result of facilities provided at sportsgrounds. Safe use of sportsgrounds is encouraged through: • adherence to a regular inspection program (carried out directly by Council or by the

user, relevant lessee or licensee through obligations contained within a lease or licence agreement), which would include condition assessment

• carrying out maintenance works in accordance with Council’s safety and risk management programs

• ongoing implementation of Council’s risk management policy for parks and gardens

• provision of adequate warning of potential safety risks in the area

• prompt response following notification of identified hazards. Manner of assessment of performance Number of recorded injuries is reduced. Number of complaints logged on Council’s Customer Action Requests System concerning level of safety/risk is reduced. 6.2.4 Access Issues Access to sportsgrounds is necessary for vehicular and pedestrian purposes. Disabled, emergency or service types of access must also be provided. Planning for access must consider • the nature and characteristics of each site • need for efficiency • cost • safety • amenity • dual use • the provisions of the Disability Discrimination Act 1992 and Anti Discrimination Act

1977 Vehicular access to parkland by the general public is provided in the form of driveways and designated car park areas. Performance targets To ensure sportsgrounds activities are managed having regard to any adverse impact on nearby residences. To provide safe, high amenity sportsgrounds with the provision of adequate access (consistent with the level of use). Means of achievement of objectives Informal vehicular access to sportsgrounds is not permitted (with the exception of emergency or service vehicles). General vehicular access may be permitted at other times as part of a lease agreement for a special event or as provided for by a development consent issued by the Council under the provisions of the Environmental Planning and Assessment Act 1979 for a community purpose. Assessment of adequacy of access at each site. Maintenance of access points provided.

Manner of assessment of performance All major sportsgrounds be provided with the standard of access provided for in the Orange City Development and Subdivision Code. Reduced complaints received by Council concerning site access. 6.2.5 Traffic and parking Issues Adequate parking should be provided on site, or nearby as public parking, at all major sportsgrounds. New parking areas will be constructed in accordance with Orange City Council’s Development and Subdivision Code and provided in accordance with the standards contained in Part 15 – Car Parking of Council’s Development Control Plan 2004 and in the Building Code of Australia. Existing parking facilities, listed in Table 2, should be maintained and upgraded on a basis of need.

Car Park, Max Stewart Oval

Parking for disabled persons and emergency vehicles is required to be provided in car parks in accordance with the Building Code of Australia. Parking facilities may be strained at times of peak demand, particularly at Glenroi Oval, and Moulder Park causing overflow parking in local streets and possible nuisance to local residents. In a situation where action by Council is warranted, Council must weigh up the benefits of providing additional on-site parking against the loss of open space area.

Performance targets Facilitate use of major sportsgrounds through adequate provision of on-site parking. This includes provision for disabled and emergency parking. To ensure that such activities are managed having regard to any adverse impact on nearby residences. Means of achievement of objectives On-site parking provided that satisfies normal level of usage for the particular sportsground. Off-street parking shall be provided at all sportsgrounds where leased buildings are provided on-site. All sportsgrounds shall be progressively provided with sealed parking areas. Safe use is encouraged through design. Manner of assessment of performance Nil complaints concerning traffic and parking. Progressive improvement of parking facilities. 6.2.6 Security Issues Security of sportsgrounds is necessary in order to avoid inappropriate use and vandalism. The annual cost for Council or individual lessees or to insurers to repair damage caused by acts of vandalism is significant in terms of reduced asset value and repair to damaged facilities. Security can be provided in the form of sensitive building design, landscaping, lighting, fencing and/or security locking. This cost may either be the responsibility of the Council, the individual lessees or shared. Performance targets To provide safe, high amenity sportsgrounds through provision of an adequate level of security.

Riawena Oval One turf cricket wicket table, three practice cricket nets, children’s playground, clubhouse with amenities, fencing, spectator seating, car park.

Ridley Oval 1 cricket field, concrete cricket wicket, landscaping. Trotting Track and Kart-racing Track

Overspill lighting has the potential to cause nuisance for adjoining or nearby residences. Any future upgrades will require that a development application be lodged with Council and potential impacts assessed under section 79C of the Environmental Planning and Assessment Act 1979. Such an assessment will take into account potential impacts on adjoining land. The following new sportsground facilities are scheduled to be installed in the short to medium term under Council’s Management Plan 2004-2007. Automated irrigation controllers are provided to Anzac Park, Glenroi Oval, Max Stewart Park, Riawena Oval and Rosewood Oval. Endeavour Oval has a quick coupler automated system, accessing water from a bore. The synthetic surface of Moulder Park netball courts does not require irrigation. Performance targets Council aims to provide facilities that are adequate and appropriate for the level of use, the nature of use and expected users (players, spectators and casual). Means of achievement of objectives Facilities should match user needs. Facilities should be maintained to a satisfactory standard. Manner of assessment of performance Number of users who rate the sportsground as satisfactory. Reduction in complaints or matters of concern reported to Council. Completion of works scheduled under Council’s annual management plan.

6.2.8 Waste management Issues Litter and general waste generated by sportsground use requires safe and efficient disposal. General waste rubbish bins are provided at all sportsgrounds. The type and level of service provided at each sportsground is influenced by cost, level of waste and the nature of waste. Sportsground waste comprises a high level of recyclables in the form of drink containers. To reduce the amount going to landfill, Council shall, on a site which includes buildings for use by clubs or for other community purposes, investigate inclusion of recycling bins. Performance targets Investigate nature of waste generation. Means of achievement of objectives Provision of recycling services where needed at individual sportsgrounds. Reduce litter through provision of adequate volume waste receptacles, appropriate siting and/or signage as required. Clubs and organisations using the sportsgrounds take a positive role in waste management. Manner of assessment of performance Reduction in complaint reports to Council concerning litter. Reduced littering identified by Council ground staff or site lessees. 6.2.9 Irrigation and drainage Issues The quality of drainage on playing fields determines • the speed at which a playing field dries out after a rain event • the intensity of maintenance • the ground’s toleration of high sport use Works that facilitate drainage of grassed or synthetic sportsgrounds can include the shaping of the ground surface, provision of perimeter dish drains and the installation of subterranean drainage lines. Drainage provision varies among the sportsgrounds the subject of this Plan of Management and is dependent on the level of sport played at the site. Irrigation at sportsgrounds, both public and private, is influenced by Council’s water restrictions, which are in force at times.

Correct irrigation scheduling results in greater efficiency of water use, minimising runoff (and therefore the impact on water quality of streams and creeks) and contributing to the longevity of the playing surfaces. Irrigation scheduling should achieve optimum delivery. If necessary, Council may utilise part of the area of a major sportsground site for provision of drainage retention. Such retention may be required to assist in stormwater management in the catchment. Currently a stormwater retention basin is provided at Rosewood Oval and this area allows for informal open space use by the community at large for most months of the year. It also doubles as a leash-free area for dog exercise. Performance targets To provide efficient irrigation scheduling and drainage of the active areas. Improved efficiency of water use – ie, reduced water use. 6.2.10 Amenity Issues Residents in the vicinity of a sportsground, whilst they may experience the benefits of close proximity to that facility, may also experience negative impacts arising from inappropriate use, overspill lighting, noise, litter, traffic and parking. Performance targets Minimise detrimental impact wherever possible through implementation of Council programs (such as tree planting or maintenance programs), through strategic planning (siting and design of new facilities) or through conditions of a particular lease or licence agreement.

To this end, Council has erected advisory signage at the main entry points to parks and sportsgrounds throughout the City.

It is an offence under this Act to take a dog on to a public place (ie, a street or park) without it being on a leash unless the area is specifically designated as a leash-free area. Council has identified several “leash free areas” within the City, two of which are located on sportsgrounds contained in this Plan of Management - namely Rosewood Oval and Anzac Park (see attached maps) Such areas are provided with waste disposal bins. Use of sportsgrounds for exercising dogs can result in damage to sporting surfaces. In Orange City, Council policy states that all dogs are prohibited from an area set aside for the playing of organised games (ie, sporting fields) and within 10 metres of any playing apparatus for the use of children. This policy is notified to the public via appropriate signage at each sportsground, through the media (free brochure, radio or newspaper articles) and through ranger activity.

Such notices may inform the general public of appropriate use and behaviour, in particular information concerning acceptable access, littering, dogs, uses and cautions. Advice may also be given as to fines that may be levied as a result of failure to comply with the relevant notices.

Signage may also be erected by sporting organisations or community groups at particular sportsgrounds as exempt development under the Orange Local Environmental Plan 2000. Exempt development signage is limited to an association with sporting events only, located on or adjacent to playing fields and orientated towards spectator areas.

7 FUTURE USE OF THE LAND

Council’s management of sportsgrounds is assisted by the Environment and Natural Resource Management Advisory Committee and the Sports Facilities Reference Group. The level of improvements planned for individual sportsgrounds depends upon the need for improved or increased facilities as identified by relevant sporting organisations in conjunction with Orange City Council. Improvements that may be proposed in the future, subject to individual assessment, include the following:

8 LEASES, LICENCES AND OTHER ESTATES

Approved activities or activities that are exempt development under the Environmental Planning and Assessment Act 1979 may be subject to a lease, licence or grant of any other estate under the provisions of the Local Government Act 1993 between Council and a particular organisation, club or group. Most of the sportsgrounds included in this plan have been subject to lease agreements between Council and particular sporting organisations for many years. These lease agreements allow for the land to be used and developed in accordance with the terms and conditions of the particular lease.

To maximise the use of sportsground facilities, Council may at times authorise the use of buildings on the subject land for non-sporting community uses.
