WHEREAS, the Port Neches-Groves Independent School District (PNGISD) on the 26th day of September, 2008, has suffered widespread or severe damage resulting from Hurricane Ike, and WHEREAS, the Board President of the PNGISD has determined that extraordinary measures must be taken to alleviate the prolonged delay of resuming classroom instruction, NOW, THEREFORE, BE IT PROCLAIMED BY THE BOARD PRESIDENT OF PNGISD: That a declaration of emergency is hereby declared for the PNGISD relating

to storm damage to school facilities and equipment. Any delay will prevent or substantially impair the conduct of classes or other essential school activities for the purposes of Texas Education Code, Section 44.031(h).

Employees for Eight School Days The Texas Department of Agriculture is waiving the cost of food for school districts hit by Hurricane Ike. Therefore, the district will be able to offer free breakfast and lunch for all students beginning Thursday, September 25 and ending on Wednesday, October 8. By also providing free breakfast and lunch for employees, the district may be able to maximize their time on campus. This will be critical as the district deals with issues related to Hurricane Ike recovery including maintenance efforts and the possibility of new enrollees. Free meals for employees would begin on Monday, September 29 and end on Wednesday, October 8. If all 665 employees took advantage of both breakfast and lunch for eight days, it would cost the district approximately $18,620. Recommendation: It is recommended that the Board of Trustees of the Port Neches-

Groves Independent School District approve the recommendation to provide breakfast and lunch meals for employees for eight school days.

Attached is the waiver application required by TEA for instructional days that were missed due

to the Hurricane Ike evacuation and the subsequent power outages. The TEA Waiver attachment

was presented to the DEIC on Wednesday, September 24. If the Board of Trustees approves the

waiver, it will then be submitted to TEA for approval. Upon their approval of the waiver, the

District will not be required to use bad weather days since the evacuation was for a hurricane.

Recommendation: It is recommended that the Board of Trustees approve the application for

missed instructional days due to Hurricane Ike.

Whereas, from Thursday, September 11 through Tuesday, September 23, 2008, Hurricane Ike resulted in the closure of all schools and facilities in Port Neches-Groves ISD for the safety of students and staff; and Whereas, on August 31, 2008, county and city government officials ordered a mandatory evacuation of Jefferson County due to the imminent threat from Hurricane Ike; and Whereas, Port Neches-Groves ISD closed its schools and facilities because it must act in the best interests of, and for the safety of, its students and staff; and Whereas, the mandatory evacuation order was not lifted until September 20, 2008; and Whereas, in the aftermath of Hurricane Ike the Port Neches-Groves ISD was not able to re-open all of its school facilities because of structural damage and/or the lack of electricity; and Whereas, on September 26, 2008 the Superintendent has applied for the Waiver of September 11 through September 24, days missed due to Hurricane Ike; and Whereas, through circumstances completely beyond their control, employees were forced to miss work; and Whereas, to financially penalize employees who are acting in the interests of public safety potentially will be harmful in the future if these people fail to act in a safe and prudent manner during a required or recommended evacuation for fear of financial loss; and Whereas, it will be detrimental to the best interests of the District for the District to act in a way that may lead to unsafe conduct by its employees in a future natural disaster; and Whereas, Port Neches-Groves ISD and its students benefit from the professional services provided by PNGISD teachers, administrators, counselors, and other professional support staff employed by contract with the District; and Whereas, the continuing efforts of PNGISD contract personnel to motivate learning among its students as evidenced by state and national ratings of the District are of benefit to the District; and Whereas, the District has invested District funds to provide campus-based staff development for its contract employees and subsequently enjoys the benefit of staff trained for the specific needs of students on individual campuses; and Whereas, there is a public purpose served and a benefit to the District to encourage prudent and safe behavior in a natural disaster so that employees have the best opportunity of protecting their safety and being able to resume their duties; and Whereas, there is a public purpose served and a benefit to the Port Neches-Groves ISD to demonstrate support of its employees, enhance employee morale and support the retention of employees; and

Whereas, the Board believes that a public purpose exists for forgiving or excusing the absences of these employees subject to the Waivers of Instructional Days and Minimum Days of Service by the Texas Commissioner of Education; and Whereas, as a consequence of Hurricane Ike, certain PNGISD employees were called upon by the Superintendent, in accordance with her emergency powers, to perform extraordinary services to PNGISD above and beyond the duties ordinarily required for their respective positions; and Whereas, the school district’s attorney has previously advised the Board of Trustees that the payment of extra compensation over and above that originally budgeted for a particular position, in exchange for the performance of extra duties not originally contemplated for that position, is permissible under Texas law, and is not a violation of provisions of the Constitution of Texas; and Whereas, this resolution is not meant to excuse the failure to report to duty on these days by any employees who were instructed by the administration to do so or who were required by contract or job description to report for duty, and who are emergency services personnel or whose presence is necessary to provide for the safety and well-being of the general public and public property. THEREFORE, BE IT RESOLVED that the Board of Trustees of the Port Neches-Groves Independent School District has determined it to be of benefit to, and in the best interest of the District to pay contract employees their regular appropriated compensation for that period of involuntary absence from work on September 11 through September 23, 2008 due to Hurricane Ike, subject to the approval of Waivers of Instructional Days and Minimum Days of Service by the Texas Commissioner of Education and that payments for such days are necessary in the conduct of the public schools as provided by Texas Education Code § 45.105(c). THEREFORE, BE IT RESOLVED that the Board of Trustees of the Port Neches-Groves Independent School District has determined it to be of benefit to, and in the best interest of the District to pay at-will employees their regular appropriated compensation for that period of involuntary absence from work on September 2 and 3, 2008 due to Hurricane Gustav, subject to the approval of Waivers Minimum Days of Service by the Texas Commissioner of Education and that payments for such days are necessary in the conduct of the public schools as provided by Texas Education Code § 45.105(c). Further, be it resolved that PNGISD employees who performed additional duties at the request of the Superintendent be paid additional compensation, in lump sum, for those specific additional duties. Further, be it resolved, based on information provided to the Superintendent, that no further requests for additional compensation will be considered or granted for extraordinary duties claimed to have been performed due to Hurricane Gustav.
