What is Port State Control?

Port State Control:

Is a spot-check on visiting foreign merchant ships, not a full

survey

Is a harmonized system,

Is enforcing compliance where the owner and flag State have

failed in their responsibilities

Requires deficiencies to be rectified

Can detain the ship if unseaworthy

Can refuse access to the region

Port State Control is laid down in International Maritime

Conventions of the ILO and IMO.

Regional agreement is laid down in Paris MoU on Port

State Control

Legally binding for EU Members through EC Directive

on Port State Control 2009/16/EC.

– Any other EC Directive requirements exceeding the

requirements of the IMO/ILO Conventions can be

inspected/enforced by EU-member States PSCOs, but shall not

be recorded on the Paris MoU on PSC inspection forms, nor

entered into THETIS. Any EC Directive related deficiencies

found, should be recorded on a separate national inspection

form.

Additional Inspections

Unexpected factors are Priority II – for example:

• Ships reported by pilots, VTS, master, crew member or

others with a legitimate interest in the safe operation of the

ship, shipboard living and working conditions or the

prevention of pollution.

• not complying with reporting obligations

• outstanding deficiencies

• previously detained ships (after 3 months)

• cargo problems

• RO recognition withdrawn
