This has reference to your application No. Nil dated 10.10.2014 andsubsequent letters dated 26.11.2014, 20.01.2015, 22.01.2015, 30.01.2015 and10.03.2015 seeking prior Environmental and CRZ Clearance on the above-mentionedproject.

2. The Ministry of Environment, Forest & Climate Change has considered theapplication. It is noted that the proposal is for grant of Environmental and CRZClearance for Proposed construction of "Prerna Co-op Housing Society" at Plotbearing C.S. No.777(pt.), 778(pt.), 779(pt.), 780(pt.), New C.S. No. 1004 of Worli-Division known as "New Municipal Labour Camp, G/South Ward, at SasmiraMarg, Worli, Mumbai, Maharashtra by MIs. Saumya Buildcon Pvt. Ltd. Theproposal was considered by the EAC in its meetings held on 26th - 28th November,2014 and 28th - 30th January, 2015. The proponent has informed that:

11. CRZ Clearance obtained from MoEF on 24.01.2007.111. Got approval of Brihan Mumbai Mahanagarpalika for FSI of 2.0 vide letter No.

Basement + Ground +1st to 8th podium+ 9th (RG & Club house) + 10th to 32ndupper Floor.

viii. Total water requirement is 131 KLD which will be met through MunicipalCorporation and treated waste water. Fresh water requirement will be about58 KLD. The Wastewater generation is estimated to be 103 KLD which will betreated in two Sewage Treatment Plant of total capacity 115 KLD will beprovided. About 58 KLD of treated waste water will be reused (45 KLD forflushing and 13 KLDfor gardening).

IX. Construction waste is proposed to be reused in pavement. During operationalphase, the Solid waste generation is estimated to be 372 kg/day. It will besegregated into biodegradable (waste vegetables and foods etc.) and recyclable(paper, cartons, thermocol, plastics, glass etc.) components and collected inseparate bins.

x. Parking facility for 232 numbers for four wheelers, proposed to be providedagainst the requirement of 199 numbers (according to local norms).

Xl. Proposed energy saving measures would save about 22.97 % of power.Xll. Rooftop rainwater of buildings will be collected in RWH tanks of total 50 KLD

capacity for harvesting after filtration.xiii. There are encroachments by slum in the proposed site, owned by them, which

will be utilised for the inner roads.xiv. Trees cutting: 13 trees are to be cut, 21 tress to be transplanted and 31 tree

sapling to be planted.xv. Total cost of the project is Rs. 73.0651 crores.XVI. Wildlife issues: The project does not falls within 10 km of notified Protected

Area, hence no clearance from the NBWLis required. The project site is about16.50 km away from Sanjay Gandhi National Park.

XVll. MCZMA recommended the project vide letter No. CRZ-2013/CR-197/TC-3dated 14.11.2013. According to MCZMA, the site is in CRZ -II area onlandward side of Sasmira Marg.

XVlll. Public consultation was carried out on dated 20.06.2012.XIX. The Project Proponent vide letter no. Nil dated Nil has given undertaking that

they have obtained all the necessary approval required at this stage fordevelopment of the aforesaid property. The further approvals required for theproject will be obtained stage wise as per the development control regulation ofthe planning authority i.e. MCGM.

xx. There is no court cases/violation pending with the project proponent.

3. The proposal was considered by the Expert Appraisal Committee (EAC) andrecommended in its 144th EAC meeting held on 28th - 30th January, 2015 forgranting Environmental and CRZ Clearance. The Ministry of Environment, Forest &Climate Change hereby accords Environmental and CRZ Clearance for the above-mentioned Proposed construction of "Pre rna Co-op Housing Society" at Plotbearing C.S. No.777(pt.), 778(pt.), 779(pt.), 780(pt.), New C.S. No. 1004 of Worli-Division known as "New Municipal Labour Camp, G/South Ward, at SasmiraMarg, Worli, Mumbai, Maharashtra by M/ s. Saumya Buildcon Pvt. Ltd. under theprOVISIOns of the Environment Impact Assessment Notification, 2006 andamendments thereto and Circulars issued thereon and subject to the compliance ofthe following specific conditions, in addition to the general conditions mentionedbelow:

(i) The Project Proponent shall insure that the guidelines issued vide thiMinistry's OM No. 19-2/2013-IA.III dated 09.06.2015, to be followed fobuilding and construction projects to ensure sustainable environmentamanagement in pursuance of Notification No. 3252 (E) dated 2212.2014 under the EIA Notification, 2006, as applicable, are followed iithis project.

(ii) The Project Proponent shall obtain all necessary clearance/permissionfrom all relevant agencies including town planning authority beforecommencement of work.

(iii) "Consent for Establishment" shall be obtained from State PollutioiControl Board under Air (Prevention and Control of Pollution) Act, 198:and Water (Prevention and Control of Pollution) Act, 1974.

(iv) Total plot area is 7872.14. FSI area shall be 15,645.70 sqm and totalconstruction built-up area shall be 44,582.38 sqm. The proposedproject will consist of 4 Nos of building- redevelopment building -Ground/Stilt + 13 upper floors with 99 flats and three shops andshopping building -G+1 with 6 shops, sale building -Basernent +Ground +1st to 8th podium with 30 flats.

(v) Total water requirement is 131 KLD which shall be met throughMunicipal Corporation and treated waste water. Fresh waterrequirement will be about 58 KLD. The Wastewater generation is 85KLD which shall be treated in two Sewage Treatment Plant of totalcapacity 115 KLD shall be provided. (ix) There are encroachments by slum in the proposed site, owned by them,which shall be utilised for the inner roads.

(x) 13 trees are to be cut, 21 tress to shall be transplanted and 31 treesapling shall be planted.

(xi) All the conditions stipulated by Maharashtra Coastal Zone ManagementAuthority (MCZMA) vide letter No. CRZ-2013/CR-197/TC-3 dated14.11.2013, shall be complied with.

The project proponent shall comply withNOC/Clearance obtained from Fire Department.

(xiii) All the construction shall be in accordance with the local buildingbyelaws. The Project Proponent shall obtain all necessary clearances.

(xiv) The Project Proponent shall put in place a credible enforcementmechanism for compliance of energy conservation measures with itsallottees, as projected, as projected, in perpetuity. This would bemonitored by the designed Energy Conservation/ efficiency Authority inthe State. This would be monitored by the designed EnergyConservation/ efficiency Authority in the State.

(xv) Suitable toilet fixtures for water conservation shall be provided.

(xvi) Proponent shall obtain permission for ground water withdrawal fromState Ground Water Authority.

(xvii) The rainwater harvesting plan should be incorporated by the CGWA.

(xviii) Provision shall be made for the housing of construction labour within thesite with all necessary infrastructure and facilities such as fuel forcooking, mobile toilets, mobile STP, safe drinking water, medical healthcare, creche etc. The housing may be in the form of temporary structuresto be removed after the completion of the project.

(xix) A First Aid Room will be provided in the project both during constructionand operation of the project.

(xx) All the topsoil excavated during construction activities should be storedfor use in horticulture/landscape development within the project site.

(xxi) Disposal of muck during construction phase should not create anyadverse effect on the neighbouring communities and be disposed takingthe necessary precautions for general safety and health aspects ofpeople, only in approved sites with the approval of competent authority.

(xxii) Soil and ground water samples will be tested to ascertain that there is nothreat to ground water quality by leaching of heavy metals and othertoxic contaminants.

(xxiii) Construction spoils, including bituminous material and other hazardousmaterials, must not be allowed to contaminate watercourses and thedump sites for such material must be secured so that they should notleach into the ground water.

(xxiv) Any hazardous waste generated during construction phase, should bedisposed off as per applicable rules and norms with necessary approvalsof the State Pollution Control Board.

(xxv) The diesel generator sets to be used during construction phase shouldbe low sulphur diesel type and should conform to Environment(Protection) Rules prescribed for air and noise emission standards.

(xxvi) The diesel required for operating DG sets shall be stored in undergroundtanks and clearance from Chief Controller of Explosives shall be taken,as applicable.

(xxvii) Vehicles hired for bringing construction material to the site should be irgood condition and should have a pollution check certificate and shoukconform to applicable air and noise emission standards and should b:operated only during non-peak hours.

(xxviii) Ambient noise levels should conform to residential standards botlduring day and night as per Noise Pollution (Control and RegulationRules, 2000. Incremental pollution loads on the ambient air and noisrquality should be closely monitored during construction phase. Adequatrmeasures should be made to reduce ambient air and noise level durin 1construction phase, so as to conform to the stipulated standards b_CPCB/ SPCB.

(xxix) Fly ash should be used as building material in the construction as pethe provisions of Fly Ash Notification of September, 1999 and amenderas on 27th August, 2003.

(xxx) Ready mixed concrete must be used in building construction.

(xxxi) Storm water control and its re-use as per CGWB and BIS standards fo:various applications.

(xxxii) Water demand during construction should be reduced by use of premixed concrete, curing agents and other best practices referred.

(xxxiii) Permission to draw ground water shall be obtained from the competenAuthority prior to construction/ operation of the project.

(xxxiv) Separation of grey and black water should be done by the use of duaplumbing line for separation of grey and black water.

(xxxv) Fixtures for showers, toilet flushing and drinking should be of low floveither by use of aerators or pressure reducing devices or sensor basercontrol.

(xxxvi) Use of glass may be reduced by up-to 40% to reduce the electricitjconsumption and load on air-conditioning. If necessary, use high qualitjdouble glass with special reflective coating in windows.

(xxxvii) Regular supervision of the above and other measures for monitoringshould be in place all through the construction phase, so as to avoicdisturbance to the surroundings.

(xxxviii)Under the provisions of Environment (Protection) Act, 1986, legal actiorshall be initiated against the project proponent if it was found thaconstruction of the project has been started without obtaininjenvironmental clearance.

II. Operation Phase

submitted to the Regional Office, MoEF&CC along with six monthlyMonitoring reports.

(ii) The treated wastewater of 58 KLD shall be recycled and reused forflushing of toilets (45 KLD) and gardening (13 KLD) to reduce thedemand of fresh water as committed.

(iii) Solid waste management shall be collected, treated disposed inaccordance with the Municipal Solid Waste (Management & Handling)Rules, 2000. No municipal waste should be disposed off outside thepremises.

(iv) The Operation and Maintenance of STP shall be made in the MoU withSTP supplier. Project Proponent shall ensure regular operation andmaintenance of the STP.

(v) Parking facility with 9 m clear driveway shall be provided, as committed.

(vi) The Project Proponent shall explore the possibilities of reusing thetreated wastewater from nearby projects.

(vii) D.G sets shall be at least 6 m away from the boundary.

(viii) The installation of the Sewage Treatment Plant (STP) should be certifiedby an independent expert and a report in this regard should besubmitted to the Ministry before the project is commissioned foroperation. Treated affluent emanating from STP shall be recycledjreused to the maximum extent possible. Treatment of 100% grey waterby decentralized treatment should be done. Discharge of unused treatedaffluent shall conform to the norms and standards of the State PollutionControl Board. Necessary measures should be made to mitigate theodour problem from STP.

(ix) The solid waste generated should be properly collected and segregated.Wet garbage should be composted and dry j inert solid waste should bedisposed off to the approved sites for land filling after recoveringrecyclable material.

(x) Diesel power generating sets proposed as source of back -up power forelevators and common area illumination during operation phase shouldbe of enclosed type and conform to rules made under the Environment(Protection) Act, 1986. The height of stack of DG sets should be equalto the height needed for the combined capacity of all proposed DG sets.Use low sulphur diesel. The location of the DG sets may be decided within consultation with State Pollution Control Board.

(xi) Noise should be controlled to ensure that it does not exceed theprescribed standards. During night time the noise levels measured atthe boundary of the building shall be restricted to the permissible levelsto comply with the prevalent regulations.

(xii) The green belt of the adequate width and density preferably with localspecies along the periphery of the plot shall be raised so as to provideprotection against particulates and noise.

(xiii) Rain water harvesting for roof run-off and surface run-off, as plansubmitted should be implemented. Before recharging the surface runoff, pre-treatment must be done to remove suspended matter, oil andgrease. The borewell for rainwater recharging should be kept at least 5mts. above the highest ground water table.

(xiv) Energy conservation measures like installation of CFLs/TFLs for thelighting the areas outside the building should be integral part of theproject design and should be in place before project commissioning. UseCFLs and TFLs should be properly collected and disposed off/ sent forrecycling as per the prevailing guidelines/rules of the regulatoryauthority to avoid mercury contamination. Use of solar panels may bedone to the extent possible.

PART - B. GENERAL CONDITIONS

(i) A copy of the environmental clearance letter shall also be displayed 01

the website of the concerned State Pollution Control Board. The EC letteshall also be displayed at the Regional Office, District Industries centnand Collector's Office/ Tehsildar's office for 30 days.

(ii) The funds earmarked for environmental protection measures shall b.kept in separate account and shall not be diverted for other purposeYear-wise expenditure shall be reported to this Ministry and it:concerned Regional Office.

4. Officials from the Regional Office of MoEF&CC, Nagpur who would b:monitoring the implementation of environmental safeguards should be given fulcooperation, facilities and documents/data by the project proponents during theiinspection. A complete set of all the documents submitted to MoEF&CC should brforwarded to the CCF, Regional office of MoEF&CC, Nagpur.

5. In the case of any change(s) in the scope of the project, the project woukrequire a fresh appraisal by this Ministry.

6. The Ministry reserves the right to add additional safeguard measure:subsequently, if found necessary, and to take action including revoking of theenvironment clearance under the provisions of the Environmental (Protection) Act1986, to ensure effective implementation of the suggested safeguard measures in ctime bound and satisfactory manner.

7. All other statutory clearances such as the approvals for storage of diesel frorrChief Controller of Explosives, Fire Department, Civil Aviation Department, ForesConservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, asapplicable by project proponents from the respective competent authorities.

8. These stipulations would be enforced among others under the provisions 0

Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and controof Pollution) act 1981, the Environment (Protection) Act, 1986, the Public Liabilitj(Insurance) Act, 1991 and EIA Notification, 2006.

9. The project proponent should advertise in at least two local Newspapers widefcirculated in the region, one of which shall be in the vernacular language informiruthat the project has been accorded Environmental Clearance and copies of clearancrletters are available with the State Pollution Control Board and may also be seen orEC_Saumya Buildcon ~ Page 7 of 8

the website of the Ministry of Environment, Forests & Climate Change athttp://www.envfor.nic.in. The advertisement should be made within Seven days fromthe date of receipt of the Clearance letter and a copy of the same should be forwardedto the Regional Office of this Ministry at Nagpur.

10. This Clearance is subject to final order of the Hon'ble Supreme Court of Indiain the matter of Goa Foundation v j s. Union of India in Writ Petition (Civil) No.460 of2004 as may be applicable to this project.

11. Any appeal against this clearance shall lie with the National Green Tribunal, ifpreferred, within a period of 30 days as prescribed under Section 16 of the NationalGreen Tribunal Act, 2010.

12. A copy of the clearance letter shall be sent by the proponent to concernedPanchayat, Zilla ParisadjMunicipal Corporation, Urban Local Body and the LocalNGO, if any, from whom suggestionsj representations, if any, were received whileprocessing the proposal. The clearance letter shall also be put on the website of thecompany by the proponent.

13. The proponent shall upload the status of compliance of the stipulated ECconditions, including results of monitored data on their website and shall update thesame periodically. It shall simultaneously be sent to the Regional Office of MoEF&CC,the respective Zonal Office of CPCB and the SPCB. The criteria pollutant levelsnamely; SPM, RSPM, S02, NOx (ambient levels as well as stack emissions) or criticalsectoral parameters, indicated for the project shall be monitored and displayed at aconvenient location near the main gate of the company in the public domain.

14. The environmental statement for each financial year ending 31 st March inForm-Vas is mandated to be submitted by the project proponent to the concernedState Pollution Control Board as prescribed under the Environment (Protection)Rules, 1986, as amended subsequently, shall also be put on the website of thecompany along with the status of compliance of EC conditions and shall also be sentto the respective Regional Offices of MoEF&CC bye-mail.
