REQUEST FOR THE INTER-AMERICAN COMMISSION ON HUMAN RIGHTS, THE OAS GENERAL SECRETARIAT, CIVIL SOCIETY ORGANIZATIONS, THE INTER-AMERICAN COURT OF HUMAN RIGHTS, AND THE INTER-AMEIRCAN JURIDICAL COMMITTEETO FORWARD THEIR PROPOSALS FOR IMPLEMENTING THE RECOMMENDATIONS

OF THE WORKING GROUP, BY OCTOBER 31, 2012

The Secretariat of the Permanent Council presents its compliments to the Inter-American Commission on Human Rights, the OAS General Secretariat, the civil society organizations, the Inter-American Court of Human Rights, and the Inter-American Juridical Committee – the other parties involved – and, on instructions from the Chair of the Permanent Council of the Organization, Ambassador Stephen C. Vasciannie, Permanent Representative of Jamaica to the OAS, wishes to remind them that on September 10, 2012, the Permanent Council adopted the Work Plan for Implementation of Resolution AG/RES. 2761 (XLII-O/12) “Follow-up on the Recommendations contained in the “Report of the Special Working Group to Reflect on the Workings of the Inter-American Commission on Human Rights with a View to Strengthening the Inter-American Human Rights System”” (CP/doc.4787/12 rev.4 corr.1 ).

According to the Work Plan, “the Permanent Council will request the member states to submit their proposals for application of the recommendations in writing. The Permanent Council will also invite the parties mentioned above…to present their proposals in writing.”

Therefore, the Secretariat of the Permanent Council hereby reiterates the request of the Permanent Council to forward said proposals for all or some of the recommendations, by October 31, 2012, to [email protected]. In order to facilitate compilation, please send your proposals in Spanish and English, electronically and in Microsoft Word format.

With a view to achieving a uniform format for the delivery of the above-mentioned proposals, the Secretariat of the Permanent Council has included Appendices to this document, which contain forms in English and Spanish with two columns, one with the recommendations of the Working Group and the second, with the corresponding spaces for entering the proposals that you wish to submit for the application of all or some of said recommendations.

We kindly request that you make an effort to limit your proposals to the maximum suggested length of 150 words for each of the recommendations on which you choose to opine. Please bear in mind that, as stated in the Work Plan, you will have further opportunities to present opinions and make additional contributions to this process through your participation in meetings where your comments on the proposals for applying the recommendations will be very welcome.

APPENDIX I

PROPOSALS FOR IMPLEMENTING THE RECOMMENDATIONS OF THE WORKING GROUP

(please make an effort to limit your proposals to the maximum suggested length of 150 words for each of the recommendations on which you choose to opine)

I. Challenges and medium- and long-term objectives of the IACHR

A. Recommendations to the Inter-American Commission on Human Rights:

a) Prepare a report on the impact of the non-universality of the American Convention on Human Rights and inter-American human rights instruments, as well as of the recognition of the contentious jurisdiction of the Inter-American Court of Human Rights, on protection and promotion of human rights in the region.

b) Actively incorporate as a priority in its strategies and work on human rights promotion, the signing of, ratification of, and accession to the American Convention on Human Rights and all other inter-American human rights instruments in those countries that have not yet done so.

c) Strike a better balance between the functions of promotion and protection of all human rights.

RECOMMENDATIONS



d) Continue to improve international human rights standards, in particular by deepening standards on enforceability and compliance of the states’ obligations in the area of economic, social, and cultural rights.

e) Strengthen its mechanisms for consultation with all users of the system.

f) Continue to periodically divulge the criteria used to define its programmatic priorities and measure their results.

g) Continue to disseminate annual statistics on petitions and requests for precautionary measures received; the total number of cases processed; the number of working groups in the IACHR Executive Secretariat, as well as their functions and staff, among other aspects.

h) In the near-term, draw up, in collaboration with the OAS General Secretariat, a proposal regarding the permanent functioning of the office of its president at headquarters.

i) Incorporate all rapporteur’s reports under a single chapter of its annual report.

B. Recommendations to Member states:

a) If not yet parties, consider signing, ratifying, or acceding to the American Convention on Human Rights and all other inter-American human rights instruments, as well as accepting the contentious jurisdiction of the Inter-American Court of Human Rights.

b) Design and implement strategies aimed at achieving the universality of the IAHRS, working with the organs of the IAHRS and the relevant political bodies of the OAS, with support provided by the General Secretariat.

c) Prepare, through appropriate OAS procedures and bodies, and in consultation with the bodies of the IAHRS, a guide or reference document on successful experiences and best practices in the area of institutional mechanisms or domestic laws to assist in implementing the recommendations of the IACHR and the decisions of the Inter-American Court of Human Rights.

d) Exchange best practices in implementation of recommendations and decisions of the IAHRS organs.

e) Encourage cooperation agreements between domestic institutions and authorities with responsibility for

human rights and organs of the system in order to further common objectives and furnish mutual assistance.

II. Precautionary measures


a) Define and disseminate more precise objective criteria for granting, reviewing, and, as applicable, extending or lifting precautionary measures.

b) Confine the assessment for granting precautionary measures to the “seriousness” and “urgency” of situations, and avoid considerations on the merits of the matter.

c) Define objective criteria or parameters for determining “serious and urgent situations” and the imminence of the harm, taking into account the different risk levels.

d) In order to reinforce the temporary nature of the measures requested, clearly establish, in consultation with the parties, a work plan for the periodic review of precautionary measures with its corresponding schedule.

e) In extremely serious and urgent cases where precautionary measures have been requested without first soliciting information from the State, review such measures as soon as possible in consultation with the State.

f) Examine the rules on decision-making in cases of requests for precautionary measures where it has not been possible to request information from the State, so that said measures can be adopted by a special (qualified) majority.

g) State and give reasons for the legal and factual elements considered for granting, reviewing, and, as appropriate, extending or lifting precautionary measures. Disclose the factual elements that have been

presented to it, as well as evidence provided to corroborate the veracity of the events.

Provide a list of articles of international instruments authorizing the examination, by the IACHR, of petitions filed.

Provide a list of articles of international instruments that recognize the rights being protected against violation.

h) Improve the mechanisms for determining and individually identifying beneficiaries of precautionary measures.

i) Confirm, where appropriate, that potential beneficiaries of precautionary measures have granted authority or consent for requests to be lodged on their behalf.

j) Grant a reasonable amount of time for states to implement precautionary measures, taking into

consideration, not only the seriousness and urgency, but also the nature and scope of the measures, the number of beneficiaries, and, the overall circumstances of the case.

k) Establish that the beneficiaries’ refusal to accept precautionary measures, their misuse thereof, or a change in the circumstances that prompted them shall be cause for lifting them.

l) Refrain from adopting or maintaining precautionary measures when the Inter-American Court has refused an application for provisional measures for the same situation.


a) Seeks to exchange best practices in implementing and complying with precautionary measures.

b) Consider the possibility of consulting the Inter-American Court on the issue of precautionary measures, their rules, scope and practical application by the IACHR, defining the terms of said consultation through appropriate mechanisms and procedures.

III. Procedural matters in processing cases and individual petitions


a) Rigorously apply criteria for admissibility of petitions, including thorough verification of the exhaustion of local remedies to avoid parallel proceedings in domestic instances and the IACHR.

b) Develop and broaden the criteria or parameters for setting aside petitions and cases, including, in particular, those in which there has been a protracted period of procedural inactivity.

c) Put into effect deadlines (at least on an indicative basis) for each procedural stage.

d) Define objective criteria or parameters and provide cause and grounds for applying the exceptional mechanism of joining the admissibility and merits stages.

e) Establish mechanisms for determining and individually identifying alleged victims.

f) Ensure prompt notification of initial petitions

to states, immediately after they have been registered.

g) Provide factual updates on initial petitions that are transmitted to states a considerable time after registration or in the even of long periods of procedural inactivity.

h) Continue to develop objective criteria for setting priorities regarding treatment of petitions and other cases, considering the nature, complexity, and impact of the alleged situations.

i) Grant reasonable deadlines and extensions for states to relay observations on petitions, considering the time elapsed since the facts stated in the petition and the volume of the background material, and/or the complexity of the matter.

j) Grant reasonable deadlines and extensions for states to follow up on the recommendations of the IACHR in the light of their nature and the scope of the actions requested of the State, as appropriate, subject to applicable standards.

k) Improve mechanisms to enable states, petitioners, and victims concerned to access records of petitions and cases in electronic format in order to encourage the prompt solution of said cases.

l) Consider the development of an electronic mechanism designed to systematize background material, reports, and decisions of the IACHR.

Note:The Working Group did not make recommendations to the member states on this matter.

IV. Friendly settlements


a) Gradually strengthen the working group on friendly settlements.

b) Give a commissioner direct responsibility for the working group on friendly settlements to be created.

c) Broaden the availability of friendly settlements to not only during the petition’s examination, but also, as appropriate, after it is registered and even after the report on merits is issued.

d) Set deadlines in order to expedite the issuance of reports on friendly settlements after the IACHR has been notified of the agreements.

e) Prepare a practical guide or manual on friendly settlements to include, inter alia, the status of their regulation in the IAHRS, a compendium of successful experiences and best practices in their use, a list of possible reparation measures, etc. Educational institutions or professional associations might be enlisted to help draft it.

f) Provide training to IACHR staff on facilitation of friendly settlement processes.


V. Criteria for preparing Chapter IV of the annual report of the IACHR: Development of Human Rights in the Region


a) Reflect on the usefulness of Chapter IV of the Annual Report of the IACHR in promoting human rights in the Hemisphere.

b) Revise the criteria, methodology, and procedure for preparing

Chapter IV, including the use of public and private sources.

c) Broaden the scope of Chapter IV of the Annual Report of the IACHR for it to analyze objectively and comprehensively the human rights situation in all countries of the region, regardless of whether or not they are states parties to the inter-American human rights instruments.

d) In preparing Chapter IV, consider not only civil and political rights but also economic, social, and cultural rights.


VI. Promotion of human Rights


a) Continue to engage in human rights promotion activities in coordination with interested states

b) Collaborate with states in strengthening their domestic law enforcement and justice administration institutions or authorities, including in the training of their officials.

c) Contribute to the strengthening of national human rights protection institutions through cooperation agreements with them.

d) Disseminate more widely the promotion work it carries out.

e) Identify and group for each state the most recurring problems in the petitions submitted, in order to cooperate with national authorities in dealing with them, seeking comprehensive and lasting solutions.

f) Provide advisory services to the states for compliance with the IACHR’s recommendations.

g) Introduce a code of conduct to govern the management of IACHR rapporteurships in order to ensure the requisite coordination between those mechanisms and states.


a) In collaboration with the IACHR, encourage greater cooperation and exchange of best practices among states, after identifying each other’s areas of strength and opportunity.

VII. Financial strengthening of the IAHRS

A. Recommendations to Member states:

a) Gradually increase the resources allocated to the IAHRS organs from the Regular Fund of the OAS, in a manner commensurate with the needs and priorities identified by those organs and themselves.

b) Take concrete steps toward that objective, preferably in the first half of 2012.

c) As one way of moving toward effective financial strengthening of the IAHRS, consider a system of two parallel and complementary tracks: (i) financing of the IAHRS from the regular budget of the OAS (a medium term solution); and (ii) mixed financing for the IAHRS with resources from the regular budget and from voluntary contributions or other sources (a short term solution until the medium term solution is achieved).

d) Create or establish a mechanism or technical group—with participation of the member states, the OAS General Secretariat, and the IAHRS organs—whose task would be to identify the financial needs and establish alternatives for achieving the financial strengthening of the IAHRS organs, as well as to explore more efficient management mechanisms, document.doc

taking into consideration the Strategic Plan 2011-2015 of the IACHR and the Guidelines 2011-2015 of the Inter-American Court of Human Rights.

e) Until the objective of providing the IAHRS with sufficient resources from the regular budget is achieved, make voluntary non-earmarked contributions. The same recommendation is made to the Permanent Observer states and other institutions that make financial contributions.

B. Recommendations to the Inter-American Commission on Human Rights:

a) Include clear and accessible information in its annual report on the management of resources received.

b) Invite donors to make their voluntary contributions without specifying the purposes, while the goal of providing the IAHRS with sufficient resources from the regular budget is being fulfilled.

c) Assign adequate, sufficient, and balanced resources to all its rapporteurships, working groups, and units, as well as an efficient and transparent management of those resources.

C. Recommendations to the Secretary General of the Organization:

a) Prepare and submit a proposal setting forth strategies to achieve an effective increase in financial resources allocated to the Inter-American Court of Human Rights and to the IACHR in the program-budget of the Organization.

I. Desafíos y objetivos de mediano y largo plazo de la CIDH

a) Elaborar un informe sobre la incidencia de la no universalidad de la Convención Americana sobre Derechos Humanos y de los instrumentos interamericanos de derechos humanos, así como del reconocimiento de la jurisdicción contenciosa de la Corte Interamericana de Derechos Humanos, en la protección y promoción de los derechos humanos en la región.

b) Incorporar activamente y como asunto prioritario en sus estrategias y labores de promoción de los derechos humanos, la firma, ratificación o adhesión a la Convención Americana sobre Derechos Humanos y demás instrumentos interamericanos sobre derechos humanos en los países que aún no lo hubieren hecho.

c) Lograr mayor equilibrio entre las funciones de promoción y protección de todos los derechos humanos.

d) Continuar el perfeccionamiento de estándares internacionales de derechos humanos, profundizando en particular los estándares de exigibilidad y cumplimiento de obligaciones de los Estados en materia de derechos económicos, sociales y culturales.

e) Fortalecer sus mecanismos de consulta con todos los usuarios del sistema.

f) Continuar difundiendo periódicamente los criterios utilizados para definir sus prioridades programáticas y la medición de sus resultados.

g) Continuar difundiendo anualmente información estadística sobre las peticiones y solicitudes de medidas cautelares recibidas; el total de casos que se tramitan; el número de grupos de trabajo con que cuenta al interior la Secretaría Ejecutiva de la CIDH, las funciones de éstos y el personal con que cuenta, entre otros.

h) Elaborar en el corto plazo una propuesta, en colaboración con la Secretaría General de la OEA, sobre el funcionamiento permanente de su Presidencia en la sede.

i) Incorporar todos los informes de las relatorías en un capítulo único de su informe anual.

B. Recomendaciones a los Estados Miembros de la

OEA:

a) Si aún no son Parte, considerar la firma y ratificación, ratificación o adhesión a la CADH y a todos los instrumentos jurídicos interamericanos de derechos humanos, así como la aceptación de la jurisdicción contenciosa de la Corte Interamericana de Derechos Humanos (Corte IDH).

b) Diseñar e implementar estrategias orientadas a alcanzar la universalidad del SIDH, en colaboración con los órganos del SIDH, con los órganos políticos pertinentes de la OEA y con el apoyo de la Secretaría General.

c) Elaborar, a través de los procedimientos e instancias correspondientes de la Organización, y en consulta con los órganos del SIDH, una guía o documento de referencia sobre experiencias exitosas y buenas prácticas en materia de mecanismos institucionales o legislaciones nacionales que colaboran en la implementación de las recomendaciones de la CIDH y el cumplimiento de las decisiones de la Corte IDH.

d) Procurar el intercambio de buenas prácticas en materia de implementación de recomendaciones y decisiones de los órganos del SIDH.

e) Promover la cooperación entre las instituciones y autoridades nacionales con competencia en materia de derechos

humanos y los órganos del Sistema para avanzar hacia objetivos comunes y brindarse asistencia mutua.

II. Medidas cautelares


a) Definir y divulgar criterios o parámetros objetivos más precisos para el otorgamiento, revisión y, en su caso, prórroga o levantamiento de medidas cautelares.

b) Circunscribir la valoración para el otorgamiento de medidas cautelares a la “gravedad” y “urgencia” de las situaciones, evitando consideraciones sobre el fondo del asunto.

c) Definir criterios o parámetros objetivos para determinar qué situaciones reúnen la “gravedad” y “urgencia” requeridas, así como para determinar la inminencia del daño, tomando en consideración los distintos grados de riesgo.

d) Para reforzar el carácter temporal de las medidas solicitadas, establecer claramente, en consulta con las partes, un plan de trabajo para la revisión periódica de las medidas cautelares vigentes con su correspondiente cronograma.

e) En casos de extrema gravedad y urgencia en que se hayan solicitado medidas cautelares sin requerir previamente información al Estado, revisar dichas medidas a la mayor brevedad posible en consulta con el Estado.

f) Examinar las reglas de toma de decisiones para casos de solicitudes de medidas cautelares en los cuales no haya sido posible requerir información al Estado, a fin de que éstas sean adoptadas por una mayoría especial (calificada).

g) Fundar y motivar, jurídica y fácticamente, el otorgamiento, revisión y, en su caso, prórroga o levantamiento de medidas cautelares.o Explicitar los elementos factuales que le sean

presentados, así como los elementos ofrecidos que comprueban la veracidad de los hechos.

o Proporcionar una lista de los artículos de los instrumentos internacionales que permiten el examen de la CIDH de la petición presentada.

o Proporcionar una lista de los artículos de los instrumentos internacionales que reconocen los derechos cuya lesión se pretende evitar.

h) Mejorar los mecanismos para determinar e individualizar a los beneficiarios de medidas cautelares.

i) Verificar, cuando resulte procedente, que los posibles beneficiarios de medidas cautelares hayan otorgado autorización o consentimiento para que se presenten solicitudes en su nombre.

j) Otorgar plazos razonables a los Estados para implementar medidas cautelares, tomando en consideración, además de la gravedad y urgencia, la naturaleza y alcance de dichas medidas, el número de beneficiarios y, en general, las circunstancias del caso.

k) Establecer como motivo de levantamiento de medidas cautelares, la negativa de los beneficiarios a recibirlas, el mal uso que hagan de ellas o el cambio de las circunstancias que las motivaron.

l) Abstenerse de adoptar o mantener medidas cautelares cuando la Corte IDH haya rechazado una solicitud de medidas provisionales sobre la misma situación.

B. Recomendaciones a los Estados Miembros de la OEA:

a) Procurar el intercambio de buenas prácticas respecto de la implementación y cumplimiento de medidas cautelares.

b) Considerar la posibilidad de elevar en consulta a la Corte IDH el

tema de las medidas cautelares, su reglamentación, así como su alcance e implementación en la práctica de la CIDH, definiendo los términos de dicha consulta a través de los mecanismos e instancias correspondientes.

III. Asuntos de procedimiento en la tramitación de los casos y peticiones individuales


a) Aplicar rigurosamente los criterios de admisibilidad de peticiones, incluida la verificación exhaustiva del agotamiento de recursos internos para evitar procesos paralelos entre instancias nacionales y la CIDH.

b) Desarrollar y ampliar los criterios para el archivo de peticiones y casos, incluyendo principalmente aquellos de larga inactividad procesal.

c) Poner en práctica, plazos (al menos indicativos) para cada etapa de procedimiento.

d) Definir criterios o parámetros objetivos y fundar y motivar la procedencia del mecanismo excepcional de acumulación de las etapas de admisibilidad y fondo.

e) Establecer mecanismos para determinar e individualizar a las presuntas víctimas.

f) Asegurar una pronta notificación de peticiones iniciales a Estados, inmediatamente después de terminada la etapa de registro.

g) Una actualización de los hechos materia de las peticiones iniciales cuando sean transmitidas a los Estados con considerable posterioridad a su registro, o bien en casos de larga inactividad procesal.

h) Continuar desarrollando criterios objetivos para determinar prioridades en cuanto al tratamiento de peticiones y otros casos, a la luz de la naturaleza, complejidad e impacto de las situaciones alegadas.

i) Otorgar plazos y prórrogas razonables a los Estados para transmitir observaciones, tomando en cuenta la antigüedad de los hechos reclamados en la petición, el volumen de sus antecedentes y/o la complejidad del asunto.

j) Otorgar plazos y prórrogas, razonables a los Estados para el

seguimiento de las recomendaciones que la CIDH formule, a la luz de la naturaleza de éstas, así como del alcance de las acciones que se requieren del Estado, según corresponda, conforme a la normatividad aplicable.

k) Mejorar los mecanismos de acceso a expedientes en formato electrónico de las peticiones y casos a los Estados, peticionarios y víctimas concernidas a efecto de promover la pronta solución de dichos asuntos.

l) Considerar el desarrollo de un mecanismo electrónico que tienda a la sistematización de los antecedentes, informes y decisiones de la CIDH.

Nota:El Grupo de Trabajo no formuló recomendaciones para los Estados Miembros en este tema.

IV. Soluciones amistosas


a) Fortalecer progresivamente al grupo de trabajo sobre soluciones amistosas.

b) Depositar en un comisionado la línea de mando del eventual grupo de trabajo sobre soluciones amistosas.

c) Ampliar la disponibilidad del proceso de solución amistosa, a fin de que no sólo se contemple en la fase del examen de petición, sino también, de ser el caso, desde el registro de la petición e incluso después de la emisión del informe sobre el fondo.

d) Establecer plazos para agilizar la emisión de informes sobre procesos de solución amistosa, una vez que los acuerdos sean notificados a la CIDH.

e) Elaborar un manual práctico o guía sobre soluciones amistosas, que incluya, entre otros, el estado de su reglamentación en el SIDH, un compendio de experiencias exitosas o buenas prácticas registradas, un catálogo de posibles medidas de reparación, etc. Podría explorarse la posible cooperación de instituciones educativas o asociaciones profesionales para su elaboración.

f) Brindar capacitación sobre facilitación de procesos de solución amistosa a personal de la CIDH.

V. Criterios para la elaboración del Capítulo IV del Informe Anual de la CIDH: Desarrollo de los Derechos Humanos en la Región

a) Reflexionar sobre la eficacia del Capítulo IV del Informe Anual de la CIDH en la promoción de los derechos humanos en el hemisferio.

b) Revisar los criterios, metodología y procedimiento para la elaboración del Capítulo IV, incluyendo el uso de fuentes públicas y privadas.

c) Ampliar el espectro del Capítulo IV del Informe Anual de la CIDH para que se analice de manera objetiva e integral la situación de los derechos humanos en todos los Estados de la región, independientemente de que sean estados parte o no de los instrumentos interamericanos de derechos humanos.

d) Considerar en la elaboración del Capítulo IV no solo derechos civiles y políticos, sino también los derechos económicos, sociales y culturales.


VI. Promoción de los derechos humanos

RECOMENDACIONES





a) Continuar realizando actividades de promoción de derechos humanos en coordinación con los Estados interesados.

b) Colaborar con los Estados en el fortalecimiento de sus instituciones o autoridades nacionales de administración y procuración de justicia, incluyendo la capacitación de sus funcionarios.

c) Contribuir al fortalecimiento de las instituciones nacionales de protección de los derechos humanos, mediante acuerdos de colaboración con las mismas.

d) Procurar mayor difusión de las labores de promoción que lleva a cabo.

e) Identificar y agrupar, respecto de cada Estado, las problemáticas de mayor incidencia en las peticiones que se le presentan, a fin de colaborar con las autoridades nacionales en la atención de las mismas, procurando encontrar soluciones integrales y duraderas.

f) Prestar asesoría a los Estados para el cumplimiento de las recomendaciones que la propia CIDH formule.

g) El establecimiento de un Código de Conducta que regule la gestión de las Relatorías de la CIDH, para asegurar la coordinación que debe existir entre dichos mecanismos y los Estados.

B. Recomendaciones a los Estados Miembros de la OEA:

a) En colaboración con la CIDH, fomentar mayor cooperación e intercambio de buenas prácticas entre Estados, tras identificar áreas de fortaleza y de oportunidad de unos y otros.

VII. Fortalecimiento financiero del SIDH

A. Recomendaciones a los Estados Miembros de la OEA:

a) Incrementar progresivamente los recursos asignados a los órganos del SIDH provenientes de fondo regular de la OEA, de manera adecuada a las necesidades y prioridades identificadas por los mismos órganos y por los propios Estados.

b) Dar pasos concretos hacia dicho objetivo, preferentemente en el primer semestre de 2012.

c) Considerar como una alternativa para avanzar hacia el efectivo fortalecimiento financiero del SIDH un esquema de dos vías paralelas y complementarias: i) financiamiento del SIDH proveniente del presupuesto regular de la OEA (solución de mediano plazo); y ii) financiamiento mixto del SIDH, mediante recursos provenientes del presupuesto regular y recursos provenientes de contribuciones voluntarias u otras fuentes (solución para corto plazo en tanto se logra la solución de mediano plazo).

d) La creación o establecimiento de un mecanismo o grupo técnico –con la participación de Estados Miembros, la Secretaría General de la OEA y los órganos del SIDH-, cuya labor sea precisar los requerimientos financieros y establecer alternativas para lograr el fortalecimiento financiero de los órganos del SIDH, así como analizar mecanismos de gestión más eficientes, considerando el Plan Estratégico 2011-2015 de la CIDH y los Lineamientos 2011-2015 de la Corte Interamericana de Derechos Humanos.

e) Mientras se alcanza el objetivo de dotar al SIDH de recursos suficientes con cargo al presupuesto regular, realizar sus contribuciones voluntarias sin fines específicos. Igual recomendación se extiende a los Estados Observadores y otras instituciones que realizan contribuciones financieras.

B. Recomendaciones a la Comisión Interamericana de Derechos Humanos:

a) Incluir en su informe anual, de forma clara y accesible, información sobre la gestión de los recursos recibidos.

b) Mientras se alcanza el objetivo de dotar al SIDH de recursos suficientes con cargo al presupuesto regular, invitar a los donantes a que realicen sus contribuciones voluntarias sin fines específicos.

c) Asignar recursos adecuados, suficientes y balanceados a todas sus relatorías, grupos de trabajo y unidades, así como un manejo eficiente y transparente de esos recursos.

C. Recomendación al Secretario General de la Organización

a) Elaborar y presentar una propuesta que planteé estrategias para lograr un incremento efectivo de los recursos económicos asignados a la Corte Interamericana de Derechos Humanos y a la CIDH en el programa-presupuesto de la Organización.
