Dear Students,

AttheoutsetletmeWelcometoyouallonbehalfofVidyaPratishthan’sVasantraoPawarLawCollege,Baramati.Asyouknowthatthefirststeponlyleadstothethousandsofstepsinourlife.Icongratulateyouforchoosingyourfirststeptojoinincareerorientedlawcoursewhichisanexcitingaswellassolvingmanylegalproblemsinthesociety.

VidyaPratishthan’sVasantraoPawarLawCollegeBaramatiwasstartedintheyear1999.Presentlythelawcollegeisrunningboth3yearsLL.B.and5yearsB.A.,LL.B.coursesandalsothediplomacourseslikeDLL.&LW,CyberLawandDTL.Sofar15batchesofLL.Bstudentshavepassedoutfromthiscollegeandtheyareimmenselyhelpingthesocietytosolvelawrelatedproblemsindifferentregions.

Infact,teachingoflegaleducationisablendingandmixtureofboththeoryandpractice.Forachievingthisobjectiveandimprovingtheskillsofadvocacythecollegeisprovidingclinical legal education.Apart from thiswealso encourageour students toparticipate inMootcourt,debate,mocktrialandpersonalitydevelopmentProgrammes.Weemphasisoncurricular,andextra-curricularactivitiesinthecollege.

Isincerelyfeelthatimpartingqualitybasedandstandardlegaleducationisessentialineverylaw collegebut it is lacking inmost of the law colleges.We share this concern andourmottoistoadopttheappropriateandinnovativemethodsofteachingskillsforupholdingthequalitylegaleducation.

VidyaPratishthanisasocietyregisteredunderSocietiesRegistrationActandalsoatrustregisteredunderBombayPublicTrustAct.FormerUnionMinisterforAgriculture,GovernmentofIndiaHon’bleSharadchandraGovindraoPawaristhefounderPresidentofVidya Pratishthan.Vidya Pratishthan’sVasantrao Pawar LawCollegewas established in1999atBaramatiwiththeobjectofimpartingqualitylegaleducationtothestudentsinruralareaataffordablecost.TheCollegeisnamedafterlateAdv.VasantraoPawarwhousedtorepresentpoorlitigantsincourtsoflawwithoutcharginganyfee.

TheCollegeisrecognizedbytheBarCouncilofIndia,NewDelhi.Itisaffiliatedto Savitribai Phule PuneUniversity.This year theCollegewill be accredited for qualitybyNationalAssessment andAccreditation Council, Bangalore. The College has alreadysubmittedSelf-StudyReportforthepurposeofNAACaccreditation.

TheCollegepresentlyoffersThreeyearsLL.B.&FiveyearsB.A.,LL.B.coursesforwhichithasreceivedpermanentaffiliationfromSavitribaiPhulePuneUniversity.ThreeyearsLL.B.courseisaided,whileFiveyearsB.A.,LL.B.courseisunaided.TheCollegealsooffersDiplomainLabourLawandLabourWelfareandDiplomainCyberLawasthevalueaddedcourses.

The College promotes students’ diversity and provides reservation as per theapplicablerulestotheweakersectionsofthesociety.TheCollegelaysemphasisonclinicallegaleducationbyconductingmootcourts,mocktrialsandlegalliteracycampsinnearbyvillages.Italsohelpsstudentsbelongingtoweakersectionstogetgovernmentscholarshipsandfreeships.

Inorder todeveloptheadvocacyskillsamongthestudents the theorypapersareblended with practical sessions and it help the students in future in court practice. TheCollegealsoprovidesguidancetothestudentsappearingforJMFCexaminationconductedbyMPSC.StudentCounsellingCentreisalsoestablishedbythecollege.GrievanceRedressalCellisalsoestablishedforpromptredressalofgrievancesofthestudents.

Inordertoimprovethequalityofteachingandlearningandotherservicesprovided,thecollegecollectsfeedbackfromstudents,alumni,advocatesandparents.

GENERAL INSTRUCTIONS TO THE STUDENTS

1. The college has prescribedUniform for the students and it is white shirt and blacktrouser.GirlsmaywearwhitePunjabidressalso.UniformiscompulsoryonallworkingdaysexceptWednesday.

2. 75%attendance ismandatory for the students as per theBarCouncil of India rules,failingwhichthestudentwillnotbeallowedtoappearfortheUniversityexamination.

3. The consumption of tobacco and gutka is strictly prohibited in the college and thecampus.

4. Pre-semesterexaminationismandatoryinordertoappearfortheUniversityexamination

5. ThemediumofinstructionforalltheprogrammesisEnglishonly.

6. The students shall complete the research projects given from time to time by theconcernedfaculty.

7. Thestudentsshallusetheinfrastructuralfacilitieswithduecareandcautionandshallnotcauseanydamagetothesame.

8. ThestudentsshallmakeuseofOPACandManupatra legaldatabaseavailable in thecollege.

9. Anyactofraggingisprohibitedinthecollegecampusandhostels.Criminalandotherappropriateactionwillbetakenagainstthestudent/sfoundguilty.

10. Sexual harassment is strictly prohibited. The victim shall approach the complaintsredressalcommitteebywayoffilingacomplaint.

11. Thecollegeadoptsinclusivepolicyandhencenoadversediscriminationonthegroundofgender,caste,religionorplaceofbirthisallowed.

12. Thestudentsshallgiveallthepossiblecooperationforeffectivefunctioningandbetterresults.

GENERAL RULES OF ADMISSION

RESERVATION CANDIDATES

Students seeking benefit of reservations must produce original documents of the CasteCertificate.Inthecaseofsuchsub-categoriesamongNT,VJNT,SC,ST,OBC,EBCtowhomthecreamy-layercriteria isapplicable,avalidandsubsistingcertificatefromtheappropriateauthoritythatthestudentdoesnotbelongtotheCreamyLayershouldbeproducedatthetimeofadmission.Ifthestudentseeksadmissionandbenefitsincategoriesreservedotherthanforbackwardclasses,avalidandsubsistingcertificatefromtheappropriateauthorityindicatingthatthestudentbelongstosuchcategory.

i)AnapplicantwhohasgraduatedinanydisciplineofknowledgefromaUniversityestablishedbyanActofParliamentorbyaStatelegislatureoranequivalentnationalinstitutionrecognisedasaDeemedtobeUniversityorforeignUniversityrecognizedasequivalenttothestatusofanIndianUniversitybyanauthoritycompetenttodeclareequivalence,mayapplyforathreeyeardegreeprograminLawleadingtoconfermentofLL.B.degreeonsuccessfulcompletionoftheregular programmeconductedbyUniversitywhosedegree inLaw is recognisedby theBarCouncilofIndiaforthepurposeofenrolment.

A student passingBachelor’s degree examinationwithminimum45%marks in any faculty

2) INTEGRATED FIVE YEAR DEGREE LAW COURSE (B.A.,LL.B):i)An applicant who has successfully completed Senior Secondary School Course (‘+2’) orequivalentsuchas11+1,‘A’levelinSeniorSchoolLeavingcertificatecourse)fromarecognisedUniversity of India or utside or from a Senior Secondary Board or equivalent, constitutedor recognised by theUnion or by StateGovernment or from any equivalent institution froma foreign country recognised by theGovernment of that country for the purpose of issue ofqualifyingcertificateonsuccessfulcompletionofthecourse,mayapply forandbeadmittedintotheprogrammeoftheCentresofLegalEducationtoobtaintheintegrateddegreeinlawwithadegreeinanyothersubjectasthefirstdegreefromtheUniversitywhosesuchadegreeinlawisrecognisedbytheBarCouncilofIndiaforthepurposeofenrolment.Providedthatapplicantswhohaveobtained+2HigherSecondaryPassCertificateorFirstDegreecertificateafterprosecutingstudiesindistanceorcorrespondencemethodshallalsobeconsideredforeligibleforadmissionintheintegratedFiveYearsorthreeYearsLL.BCourse,asthecasemaybe.Explanation:Theapplicantswhohaveobtained10+2orgraduation/post-graduationthroughopen universities systemdirectlywithout having any basic qualification for prosecuting suchstudiesarenoteligibleforadmissioninthelawcourses.Ref:(Rule5(b)ofBarCouncilofIndiaRulesofLegalEducation,2008)

3) PROHIBITION TO REGISTER FOR TWO REGULAR COURSES OF STUDY :NostudentshallbeallowedtosimultaneouslyregisterforaLawdegreeprogrammewithanyothergraduateorpostgraduateofcertificatecourserunbythesameoranyotheruniversityoraninstitutionforacademicorprofessionallearningexceptingintheintegrateddegreeprogrammeofthesameinstitution.Provided that any short period part time certificate course on language, computer science orcomputerapplicationofaninstituteoranyrunbyacentreforDistanceLearningofaUniversityhowever,shallbeexempted.Ref:(Rule6ofBarCouncilofIndiaRulesofLegalEducation,2008)

4) MINIMUM MARKS IN QUALIFYING EXAMINATION FOR ADMISSION :BarCouncilofIndiamayfromtimetotime,stipulatetheminimumpercentageofmarksnotbelow45%ofthetotalmarksincaseofgeneralcategoryapplicantsand40%ofthetotalmarksincaseofSCandSTapplicants,tobeobtainedforthequalifyingexamination,suchas+2examinationin case of integratedfive year course or degree course in any discipline for three yearLL.Bcourse,forthepurposeofapplyingforandgettingadmittedintoaLawdegreeprogramofanyrecognisedUniversityineitherofthestreams.ProvidedthatsuchaminimumqualifyingmarksshallnotautomaticallyentitleapersontogetadmissionintoaninstitutionbutonlyshallentitlethepersonconcernedtofulfilotherinstitutionalcriterianotifiedbytheinstitutionconcernedorbytheGovernmentconcernedfromtimetotimetoapplyforadmission.Ref:(Rule7ofBarCouncilofIndiaRulesofLegalEducation,2008)

5) PROHIBITION AGAINST LATERAL ENTRY AND EXIT :ThereshallbenolateralentryonthepleaofGraduationinanysubjectorexitbywayofawardingdegree splitting the integrated double degree course, at any intermediary stage of integrateddoubledegreecourse.”However aUniversitymay permit any person to audit any subject or number of subjects byattendingclassesregularlyandtakingthetestsforobtainingaCertificateofParticipationfromtheUniversity/FacultyaccordingtotherulesprescribedbytheUniversityfromtimetotimeandgiveaCertificatetherefore.Ref:(Rule13ofBarCouncilofIndiaRulesofLegalEducation,2008)

6) AGE FOR ADMISSION:Themaximumage limit for admission into 3Year and5YearLawcourses specifiedbyBarCouncilofIndiaatClause-28,Schedule-III,Rule11oftheRulesofLegalEducation,2008hasbeenwithdrawnbytheBarCouncilofIndia.Ref:(ResolutionofBarCouncilofIndiaatitsmeetingheldon29-9-2013videItemNo.331/2013)

7) NORMS OF ELIGIBILITY FOR GRADUATES AND POST GRADUATES OF OPEN UNIVERSITIES.

i) The applicants who have obtained 10 + 2 or Graduation / Post Graduation through openUniversitiesSystemdirectlywithouthavinganybasicQualificationsforprosecutingsuchStudiesarenoteligibleforadmissioninlawcourses.Ref:(BarCouncilofIndialetterNo.BCI:D:1823/2010(LE)Dated30-11-2010)

ii)“InviewofRulesofLegalEducation2008,nocandidatefromtheopenUniversityhavingadegreecontraryoftheU.G.C.ActandregulationsandcontrarytolegalEducationRules2008shallbeadmittedintolawcourse”.Ref:(BarCouncilofIndialetterNoLE/Cir02/2010dated20/2010)

iii) “No students shall be eligible for the awardof the1stDegreeunless hehas successfullycompletedathreeyearcourse…ProvidednostudentshallbeeligibletoseekadmissiontotheMaster’scourseinthesefaculties,whohasnotsuccessfullypursuedthefirstDegreecourseofthreeyearsduration.Ref:(U.G.C.Regulations1985regardingtheMinimumStandardsofInstructionsfortheGrantofthefirstDegreethroughFormalEducation:(U.G.C.letterNo.F-1-117/83(CP)dated25-11-1985)–Para2(3))

8) ADMISSION TO SECOND YEAR LL.B COURSE :AstudentwhohastakenadmissiontoIILL.B.courseofthisUniversity,afterpassingtheFirstLL.B.examinationfromanyotherUniversityrecognisedbyAIUandBarCouncilofIndiawillhavetoappearandpassinthesubjectsofFirstLL.B.courseofthisUniversityinwhichthehasnotalreadypassed,inhisparentUniversity.Further,ifhesodesires,hewillbeexemptedinanyofthesubjectsoftheSecondLL.B.examinationofthisUniversityinwhichhehasalreadypassedintheparentUniversity.Further, if he so desires, he will be exempted in any of the subjects of the Second L.L.B.examinationofthisUniversityinwhichhehasalreadypassedintheparentUniversity.

9) ADMISSION TO THIRD YEAR LL.B COURSE :AstudentpassingtheSecondYearLL.B.(LL.B.General)examinationfromaStatutoryIndianUniversityrecognisedbyAIUandBarCouncilofIndiaisallowedtoseekadmissiontotheThirdLL.B.CourseinhisUniversityontheconditionthatheshallappearforandpassinallpapersprescribedfor theFirstandSecondYearLL.B.Courseof thisUniversityofwhichhehasnotpassedinhisparentuniversity.Furtherifhesodesires,hewillbeexemptedinanyofthesubjectattheThirdLL.B.examinationofthisUniversityifhehasalreadypassedinthosesubjectsintheparentUniversity.However,insuchacase,hewillberequiredtoappearandpassinthedeficientpapersaccordingtosyllabusofFirstLL.B./SecondLL.B.ofthisUniversity.

TheCoursefeesareasperthenormsofSavitribaiPhulePuneUniversityandtheGovernmentofMaharashtra.Notwithstandinganythingprovidedotherwise,thetuitionfeesandlibraryfeesprescribedfortheStudentshallbesubjecttofollowingconditions:

Students of MaharashtraItmeansacandidatepassingS.S.C.orH.S.C.orBothfromarecognizedinstitutioninthestateofMaharashtra.ThecandidatehastopaytheTuitionfeesprescribedbytheCollegeandStateGovernment.

Students outside Maharashtra:ItmeansacandidatewhoseDomicilestatusisoutsideMaharashtraandhaspassedhisqualifyingexaminationformaUniversityoutsideMaharashtra.ThetuitionfeesforthecandidatesoutsidethestateofMaharashtrawillbedoubleofthetuitionfees.(Fordetailedfeestructurepleaseseethelastpage.)

(Firstpublished,afterhavingreceivedtheassentoftheGovernorinthe“MaharashtraGovernmentGazette”,onthe15May1999.)AnActtoprohibitraggingineducationalinstitutionsintheStateofMaharashtraWHEREASitisexpedientto-enactaspeciallawtoprohibitraggingineducationalinstitutionsintheStateofMaharashtra.ItisherebyenactedintheFiftiethYearoftheRepublicofIndiaasfollows:(1)Shorttitleandcommencement:ThisActmaybecalledtheMaharashtraProhibitionofRaggingAct,1999.ItshallcomeintoforceonsuchdateastheStateGovernmentmay,bynotificationintheOfficialGazette,appoint.(2)Definitions1.”Educational institution”means and includes a college, or other institution bywhatever namecalled,carryingontheactivityorimpartingeducationtherein(eitherexclusivelyoramongotheractivities);andincludesanorphanageoraboardinghomeorhosteloratutorialinstitutionoranyotherpremisesattachedthereto;2.“Headoftheeducationalinstitution”meanstheVice-ChancelloroftheUniversity,deanofMedi-calFaculty,DirectoroftheInstitutionorthePrincipal,headmasterorthepersonresponsibleforthemanagementoftheeducationalinstitution;3.“Ragging”meansdisplayofdisorderlyconduct,doingofanyactwhichcausesorislikelytocausephysicalpsychologicalharmorraiseapprehensionorfearorshameorembarrassmenttoastudentinanyeducationalinstitutionandincludes(i)teasing,abusing,threateningorplayingpracticaljokeson,orcausinghurtto,suchstudent;or(ii)askingastudenttodoanyactorperformsomethingwhichsuchstudentwillnot,intheordinarycourse,willingly,do.(3)ProhibitionofraggingRaggingwithinoroutsideofanyeducationalinstitutionisprohibited.(4)PenaltyforraggingWhoeverdirectlyorindirectlycommits,participatesin,abetsorpropagatesraggingwithinorout-sideanyeducationinstitutionshall,onconviction,bepunishedwithimprisonmentforatermwhichmayextendtotwoyearsandshallalsobeliabletoafinewhichmayextendtotenthousandrupees.(5)DismissalofstudentAnystudentconvictedofanoffenceundersection4shallbedismissedfromtheeducationalinstitu-tionandsuchstudentshallnotbeadmittedinanyothereducationalinstitutionforaperiodoffiveyearsfromthedateoforderofsuchdismissal.(6)Suspensionofstudent1.Wheneveranystudentor,asthecasemaybe,theparentorguardian,orateacherofaneducationalinstitutioncomplains,inwriting,ofraggingtotheheadoftheeducationalinstitution,theheadofthateducationalinstitutionshall,withoutprejudicetotheforegoingprovisions,withinsevendaysofthereceiptofthecomplaint,enquireintothemattermentionedinthecomplaintandif;primafacie,itisfoundtrue,suspendthestudentwhoisaccusedoftheoffence,andshall,immediatelyforwardthecomplainttothepolicestationhavingjurisdictionovertheareainwhichtheeducationalinstitu-tionissituated,forflirteraction.2.Where,onenquirybytheheadoftheeducationalinstitution,itisprovedthatthereisnosubstance,primafacie,inthecomplaintreceivedundersub-section(1),heshallintimatethefact,inwriting,tothecomplainant.3.Thedecisionoftheheadoftheeducationalinstitutionthatthestudenthasindulgedinraggingundersub-section(1),shallbefinal.
