Good Afternoon Julia, Further to your recent email, I am grateful for your clarification of the access to the WTA to the west of Lighthouse Road and confirm this is in line with Mr. David’s understanding of the position. Whilst I believe we have now addressed and agreed upon the access and modifications in the vicinity of Fair Orchard Farm, Mr. David wishes to maintain his Objection to the scheme on the basis of the email submitted to you dated 30/04/2016. As you are aware the close proximity of the motorway and the realignment of the Lighthouse Road will have a major effect on Fair Orchard Farmhouse and Buildings which serve a very large and productive stock farm. The loss of such a large area of land as proposed by the scheme in close proximity to the farmstead will also make management of the farm more difficult as the land in question inevitably has a higher value to the unit than the off‐lying land to the west. Mr. David is a 4th generation farmer living at Fair Orchard and his initial thoughts are that he does not wish to be forced out by the proposed motorway. We recognise the difficulty in respect of a possible Blight Notice due to the majority of the land forming the holding not being affected by the proposed scheme. With this in mind we would like to reserve the position to discuss the possibility of a discretionary purchase as you have inferred that Blight would not be implemented in this instance. I trust you will realise from the likely effect on Fair Orchard that it is very difficult for the David Family to make a decision as to whether they wish to or can successfully continue to farm at Fair Orchard at the scale on which they are at the present time once the loss of land and effect of the road become evident. Hi Mike,
Thank you for your email. I have discussed this with Julia this morning and we both feel the WG will need more information about the parcels which are owned/tenanted/ rented before they can make any meaningful decision. Also, Julia has suggested may be meeting up with you in the next fortnight to discuss the position with the Ansteys, David Colley and any others you want to discuss before you are scheduled at the PLI.
I will also ask Joanna Vincent to ring you in the morning.

Further to our recent meeting at Fair Orchard to discuss the modification of the access into the farm, I attach as we discussed a plan showing the full extent of the land farmed by Derek David edged red.
I understand you and Julia are to consider the position regarding the possibility of “Blight” in connection with the implications of the scheme.

The land shown on the attached plan includes some Rented land, most of which is in the Marshfield area. Should you require a more detailed plan showing the acreages please let me know but in the meanwhile I trust the attached gives an indication of the extent and position of the land farmed by Derek David at the current time. Hi Mike
Thanks for your email. I have checked the details with Geraint. I think the numbering of two different sets of plans is causing some confusion. The 6/4 sequence is on the Land referencing plan and schedule and 5/6a is on the Side Roads Order. I am attaching the relevant CPO plan and Side Roads Order Plan to clarify the numbering.
However, we are all referring to the same access to the WTA to the west of Lighthouse Road and you are correct, the field access would be for Mr David’s sole use, and would have control of security for the gate. WG require periodic access for maintenance purposes to the pond.
I believe that this now answers the query from Derek and I would be grateful if you confirm that this addresses the remaining issue as outlined in your email of yesterday.

You will be aware that Geraint has recently forwarded Swept Path Analysis drawings of the access into Derek’s fields off New Dairy Lane. This appears to satisfactorily show the ability for articulated vehicles and tractors/trailers to access and egress without a problem and hopefully answers that question.

One point I would ask you to clarify is your response set out in your email of the 4th September 2017 in which you refer to the new private means of access (PMA 5/6a). I think we are at cross purposes as the PMA to which Derek referred was 6/4b. The question we were posing at the time was the fact that Derek would have over‐riding control of the new access at 6/4e and Welsh Government were merely acquiring a right of access to the ponds. As I understand it Derek would retain ownership and exclusive use of the severed fields to the north of 6/4b and have control for security purposes of the access referred to. James Following a recent discussion with Brian Greaves regarding the response received in your email of the 4th September 2017, I would be grateful if you could re‐visit this matter. The land in question to the east of parcel 14/5 will be severed from the remainder of my clients holding and as I have previously pointed out will have very limited agricultural use and value. Whilst I appreciate the statutory means of compensation to which you have referred, the disconnection from the main holding and reduction in size of the overall parcel due to the land taken for the scheme makes this piece unviable and I would ask whether there is any possibility of reviewing the position in relation to this piece of land. Dear Mr. Jones, Further to receipt of your copy correspondence ID 151 on the 30th November 2017, and subsequent to previous meetings and discussions held in respect of various client’s interests, I would reply on their behalf as follows:‐ Re: OBJ 235 – L.M. Prichard, The Beeches Farm, Undy NP26 3BX The closure of Knollbury Bridge for an extended length of time will cause extreme difficulty and add considerable journey time to Mr. Pritchard in accessing the majority of his farmland which is situated the south of Magor. The work entails daily husbandry tasks and feeding of livestock together with conservation of grass and haulage to The Beeches Farm. I understand this will be compensated for in the normal way once quantified on completion of the scheme. In respect of the suggestion for replacement of the caravans which will be necessary during construction, in addition to the proposals you have put forward there are likely to be difficulties in timing of availability of replacement caravans and storage until such time they can be moved. We have already highlighted the difficulties in scrapping redundant caravans due to the restriction on working space which will be available during and post construction. The Military Vehicles including tanks, armoured vehicles and guns are stored currently in fully enclosed buildings with close circuit television cameras. The suggestion has been made that availability of alternative buildings could be considered, however these would need to offer the same degree of security and accessibility to be viable. The current ability to live on site adjacent to the storage facility is of paramount importance and the lack of this may affect insurance issues. The Beeches Farm is a complex operation as three businesses are run from the holding which are: the Farming Enterprise, The Caravan Site and the Military Vehicle Hire. We are grateful to have had the opportunity to meet on several occasions to discuss accommodation works and alternative measures, however our clients remain to be convinced that they will be able to continue with the three enterprises above during and post construction of the proposed road. In respect of the Objection lodged with Welsh Government they are prepared to withdraw .4 (lack of forthcoming information) from their Objection but wish the previous three points to remain whilst understanding the efforts made by Welsh Government set out in the Rebuttal Statement.
