Public Prosecutor's Office violates principle of specialty regarding Ricardo Martinelli Pol itical overtones continue to mark the selective j ustice that exists against former president Ricardo Martinel li, who is accused of alleged wiretaps .

Since former president Ricardo Martinelli Berrocal was extradited to Panama from the United States, in all of the documentation submitted to Panamanian authorities, it was c lear that he cannot be tried for any crime other than those stipulated in the extradition.

This would derail the new move that the Public Prosecutor 's Office (MP), headed by Kenia Porcell , is trying to make to investigate the former president, since it would be a

flagrant violation of the specialty of extradition of which Ricardo Martinelli was the subject. Yesterday, in a press conference, the First Prosecutor’s Office for Organized Crime explained that they are in the phase of evaluating the condition of specialty of the extradition of Martinelli, to bring another charge against him, different from the alleged wiretaps, this time related to the New Business Investigation. To reach Ricardo Martinelli and to try to bring a new charge against him, the Attorney General’s Office used Blue Apple as the basis for a predicate offense in New Business. According to prosecutor David Mendoza, who heads up the First Prosecutor’s Office for Organized Crime “Ricardo Martinelli’s name appears at the end of the investigation” and they are analyzing the situation.

Meanwhile, prosecutor Mendoza insisted repeatedly that “he (Martinelli) had a special condition that prevented conducting an investigation against him. Today, he does not have that prerogative.” In addition, he emphasized the issue of the lifting of the electoral criminal immunity, since last year, the former president resigned as a deputy in the Central American Parliament (Parlacen), losing his special rights. But Luis Eduardo Camacho insisted that, “like it or not,” Martinelli can only be tried for the matter for which he was extradited. “The United States put it down in writing and very clearly.” Meanwhile, the insistence by the Public Prosecutor’s Office and President Juan Carlos Varela himself in involving the former president in other crimes again marks the selective justice that there is in the country for handling some cases. “Varela has been exercising his power against Ricardo Martinelli from the Supreme Court,” said Camacho González about the political persecution that Martinelli is suffering. Juan Carlos Varela Varela disclosed in a 2014 interview that requesting the $40 million from the contractors for the My First School program was to “morally” resolve a problem of cases of bribes that some 20 contractors paid.

Entre tanto, el fiscal Mendoza insistió en reiteradas ocasionesque "él (Martinelli) tenía una condición especial que impedíaque se adelantara una investigación en su contra. Hoy, endía, no tiene esa prerrogativa".

Además, hizo énfasis en el tema del levantamiento del fueropenal electoral, ya que desde el año pasado, el expresidenterenunció el 21 de junio como diputado del ParlamentoCentroamericano (Parlacen), perdiendo sus derechosespeciales.

Pero, Luis Eduardo Camacho insistió que "le guste a quien leguste", Martinelli solo podrá ser juzgado por la causa que fueextraditado. "Estados Unidos lo dejó consignado y muyclaro".

Entre tanto, la insistencia del Ministerio Público y el propiopresidente Juan Carlos Varela por involucrar al expresidente enotros delitos, vuelve a marcar la justicia selectiva que hay en elpaís para tratar algunos casos.

"Varela ha venido ejerciendo su poder contra Ricardo Martinellidesde la Corte Suprema de Justicia", dijo Camacho González,sobre la persecución política que sufre Martinelli.

Por el caso Blue Apple, los fiscales prefirieron proteger laidentidad y posible inocencia de 61 implicados y 3 detenidos. Se

responsabil idad y buscan un acuerdo de la pena".

Por otra parte, el Ministerio Publico volvi6 a demostrar la

selectividad de sus investigaciones al omitir toda diligencia para

para el proyecto "Mi Escuela Primero" a cargo de su curiada
