Bidder shallbe the sole judge of value.

2. Every effort is made to “guard” merchandise throughout theauction. However, the Bidder becomes solely responsible for allitems purchased immediately following the winning bid.Therefore, the Bidder is advised to further guard their items attheir own discretion.

3. The Bidder is responsible for knowing which item is being bidon. If the Bidder is unsure, they should inquire or not bid. Whenbecoming the winning bidder at auction you have effected acontract and will be expected to pay for items in which you wereevidenced to be the successful bidder. Auctioneer will not honor“mistakes”.

4. The Auctioneer reserves the right to accept bids in anyincrement he feels is in the best interest of his client, the Seller.The Auctioneer reserves the right to reject thebidding of any person whose conduct, actions, or adverse

comments he feels are not in the best interest of the Seller.

5. Titles will be disbursed on auction day only if payment ismade in cash; otherwise they will be mailed when the checkclears the bank.

6. Sales tax will be added to the purchase of all taxable items.Dealers who purchase for resale must file their resale permitnumbers.

7. Purchaser does hereby indemnify and hold harmlessAuctioneer and Seller from any and all damages, claims orliabilities from injuries to persons or property of any typewhatsoever caused during the sale or by the removal of itemspurchased. Purchaser assumes all risk and liability whatsoeverresulting from the use of the item(s) soldhereunder; and shall defend, indemnify, and save harmlessAuctioneer and Seller from any liability.

8. If the foregoing conditions or any other applicable conditionsare not complied with, in addition to other remedies available toAuctioneer and Seller by law, includingwithout limitation, the right to hold the purchaser liable for thebid price, the Auctioneer, at their option may (1) resell theproperty publicly or privately, with purchaser being liable for thepayment of any deficiency plus all costs incurred, or (2) cancelthe sale, retaining liquidated damages on all payments made bypurchaser, Auctioneer commission and all other incidentaldamages will be charged.

11. There will be no shipping of items Won via AbsenteeBidding. Local Pickup Only. Pick Up times until 5 PM on theDay of Auction. 9 - 3 PM on Friday Oct. 11th or byAppointment only.

12. AUCTION FORMAT: This will be a live Auction starting at10 AM on Thursday Oct. 10th, 2013. Absentee Bidding will beavailable through the Auction Co. Website. Absentee Bids mustbe received no later than 5 PM on Wednesday Oct. 9th, 2013.The data will be downloaded from the Webserver to our MobileAuction Trailer and then executed the following day. We willstart the lot bidding at the high absentee bid that is in ourcomputer. If someone in the crowd bids beyond the high

absentee bid amount than the live bidder will win the bid. If noHigher bids are received over the high absentee bid durning thelive auction the online absentee bidder will win the bid.

13. Payment: Payment required via Cash, Credit card or certifiedfunds. No Personal checks will be accepted for online absenteebidding. There will be a 15% Buyer Premium for all onlineabsentee bids. Example. If you bid $100 on an item. There is a15% Buyer premium added to the bid price for a total of $115.Live bidders pay 13% and that is reduced to 10% if they paywith a cash or check. The 15% Buyer Premium stands regardlessof absentee bidder payment type.
