Question: My question is regarding ourinterest-only mortgage.We are still in our house almost two

and a half years after refinancing, andthe interest rate on our loan is 6.5 percent.

If I have $10,000 that I will not be needingin the foreseeable future, can I send thatamount in with our next payment to help paydown the principal on the loan? Or am I bet-ter off investing that same amount of moneyat current interest rates — which, of course,are much lower?

It seems to me that paying 6.5 percent onthat $10,000 is akin to earning that sameamount of interest. Am I wrong?

Answer: You seem hesitant to prepay yourmortgage, but if you’re going to put themoney into the bank and earn less than 1percent, you might as well pay down yourmortgage and effectively earn a much higherrate of return.

If you know you can spare the money, youshould always pay down high interest debtfirst then move to lower interest debt. If youhave credit card debt at 30 percent, youwould be better off using that money to payoff that debt.

In your case, if your only debt is the mort-gage, you should use your extra funds to startpaying down the balance of the loan. Whenyour loan resets, your payment should godown (unless interest rates skyrocket) be-cause you’re paying interest on a smaller bal-ance.

Some in your situation would prefer tokeep the cash in hand for various reasons, es-pecially if they anticipate needing thosefunds at some date in the near future. Onceyou pay down your mortgage balance, it maybe harder for you to tap that equity (if youhave positive equity in the property) whenyou need it.

For other people, taking out a long-termloan now at historically low interest rates

seems like a reasonable thing to do. Lockingin a long-term loan today, when interest ratesare at 40-year lows, means you’re bettingthat interest rates will be higher in the futureand you want to have cash to invest later on.

L et’s say that five years down the line, in-terest rates are higher than your mortgageloan interest rate. In that case, you could in-vest the money in the bank at a rate that ex-ceeds your mortgage interest rate and actual-ly make money in the process.

Your choice also depends on what your jobprospects are, your wife’s employment situa-tion, your current savings, current investableassets, and what your income stream will bein retirement.

If life looks a little uncertain for you, youshould take your $10,000 and stick it some-where safe. If, on the other hand, you feelcomfortable with the current state of your fi-nances, you should feel free to start payingdown your loan.

Question: I’m trying to refinance my con-do. My credit was approved, but now the bankwon’t approve the loan because the condo as-sociation’s fidelity bond is too low.

It’s clear that I won’t be able to sell theproperty if I can’t refinance because of this is-sue. What should I do?

Answer: Yo u ’ve run smack into the topproblem condo buyers and condo owners willhave this year: If the condo building isn’t ap-proved by Fannie Mae, Freddie Mac and FHA,buyers will have trouble getting a mortgagefor a condo and condo owners won’t be ableto refinance.

You should work with your condo associa-tion to get it the condominium documenta-tion up to the standards required by FannieMae and Freddie Mac. Consider getting theassociation approved by FHA. If you don’t getthe association approved, or your documen-tation does not comply with the guidelinesrequired by Fannie Mae or Freddie Mac, I’mafraid your property values will tank becauseno one will be able to finance their purchase.

Insurance is a hot topic with Fannie Maeand Freddie Mac. Talk to a good mortgage

lender in your area and assess what kindsof insurance coverage you need to con-form to lending guidelines.

While you do that, have that samelender review the association’s budgetand financials to determine whetherthere are any issues in those documentsas well. Homeowner associations run into

trouble if their cash reserves are too low or theirannual budgets don’t allocate enough money to-ward replenishing reserves. Some of these issuesarise especially in parts of the country where realestate values have declined significantly and con-tinue to fall.

Once you know what problems your associationfaces, you need to get the board of directors totake the right measures. Don’t work alone. Talk toyour neighbors and alert them to the problem.

Your condo board may not even be aware there isa problem if you’re the first person to try to buy inthe building or refinance in the last year. They maynot realize they have to apply to be approved byFannie Mae, Freddie Mac and FHA, and how long itwill take to get that approval in place.

Question: I’d like some information about howto sell our townhouse to the current tenants. Wewould hold the mortgage. Have you written an arti-cle in the past on this subject? Can you recom-mend a good book?

Answer: Rent-to-own, also known as lease with anoption to buy, can be a way for homeowners tohome-grow future home buyers. You can structurethe deal so that the tenant pays you a one-time op-

tion fee in addition to the monthly rent.The option fee gives the tenant the right to pur-

chase the property at a pre-determined price withina year. If the purchase doesn’t happen, the tenantcan renew the option by paying another fee, plushis or her rent. You would want to make it clearthat the option fee is non-refundable if the tenantfails to buy the property. You can also structure thedeal so that a portion of the rent paid is creditedtoward the buyers as a down payment.

If you go down the path of the rent-to-own optionand your tenant is ready to buy your property, youshould hire a real estate attorney to get a contracttogether, inform you of what you need to do interms of required seller disclosures, help arrangefor title, negotiate the contract and make sureyou’re protected. If you are already at the pointthat the tenant wants to buy the property from youbut needs assistance from you in the form of a sec-ond mortgage, you’ll also want to run credit andbackground checks on the buyers and make sureyou know exactly how much money they’ll have onhand to make the payments.

You will also need to assess the risk you take inhanding over the title of the home to the buyer be-fore you have received payment in full.

Should you hold the paper? It’s very risky. You’dbe better off having your buyers get a regular mort-gage, if they can qualify for one.

But if your buyers don’t qualify for a loan from a

conventional lender, you’ll need to decide whetheryou want to bear the risk of having to foreclose onthe buyers to get the title back and then resell theproperty again. And if they do qualify for a conven-tional mortgage but need some additional funds toclose, you’ll need to make sure that they still quali-fy for the conventional mortgage if you give themadditional financing.

If you do give them some of the financing, yourun the risk that you may lose the entire amountthey financed. As you may have read recently, manybanks are finding that the second mortgages grant-ed to borrowers are virtually worthless when theproperty falls in value. If the borrower defaults onthe primary mortgage, the primary lender foreclos-es on the property and generally wipes the secondloan out.

One other option available is to sell the propertyin installments. You would still hold the title to theproperty but your buyer would pay you over time.The buyer would be unable to get new financing ormake changes on the title to the property withoutyour consent, but you would have to wait for yourbuyer to finally come up with all of the money totransfer the title to him or her.

Even this situation carries risks, and you are welladvised to talk to a real estate attorney about anydecision you make.

You need to make sure you’re protected all theway around.

If you were to ask a gardener“what’s in your wallet?” at thistime of year, the answer would

probably be “very little.” We ’ve spentour money keeping something elsefull: our gardens. As spring creepscloser and thoughts turn to growing,take a look at what a few experts aregrowing in their own backyard.

“I’m a big fan of lettuce mixes andlettuce in general,” said Curtis Joneswho, with his wife Judy Seaborn, ownsBotanical Interests seed company inBroomfield (botanicalinterests.com).“There’re so many cool shapes andcolors, and you don’t have to usethem just for salad. You can hollowout Butterheads and put anything inthem: meat, sauces.”

Don’t forget the things you can addin to make it a salad, like spicy microgreens, mild corn mache salad, orradishes. “You can grate them overthe salad for a little spice if you don’tlike the whole thing. Red mustard is

really good; it tastes like horseradishand is a fast growing green for salads.”

Peas never end up in their kitchen,although Jones wishes they did. “Weeat them out in the garden whileworking. We dig up a bed, then go eata few peas, dig another bed, then eatsome more.”

Seaborn nods at the list of vegeta-bles they grow for their family, thenadds her favorites. “A must have is Di-nosaur kale, which is so delicious ourdaughters beg for it. Sautéed witholive oil and tossed with pasta, oh thatis delicious.”

Pointing to their black Lab, Buddy,dozing on the floor between us, shetalked of the near-mystical sweetnessof fresh carrots. “They’re irresistible,even Buddy loves them. One day Ifound him in the garden, gentlypulling up carrots by their tops withhis teeth, then eating them. Youshould have seen his face, with a hugegrin and his tail was wagging likec r a z y. ”

Jones is passionate about beets andincluded them in his donation of 30

types of vegetables he sent to theWhite House garden. “We sent thatbecause the beet mix is a great vari-ety, and there are some vegetablesthat are so much better fresh, whenyou taste them it’s like eating anothervegetable altogether. But will itchange the President’s mind aboutbeets?” He laughed. “I don’t know, Ithink we should all be allowed to dis-like something.” Jones plans to in-clude them again in this year’s dona-tion.

Catherine Harley, co-owner withDale Zigelsky of Boulder-based Person-al Family Farmers, said “what I eat is alittle unusual. I love to eat salads ofhardy greens, so I grow kale, collards,and spring greens like mesclun mixand tatsoi to fluff it up. If you want de-licious salads, grow those, plus arugu-la and radicchio.”

Some early starters are popped inthe ground now, but harvested later.Brussels sprouts are something shethinks everyone should grow becausethe flavor when fresh-picked is deli-cious. They’re worth the wait and the

space, said Harley, and she shouldknow — her company builds, installs,and plants garden boxes for square-foot gardening.

“If it’s in your backyard garden ittastes so much better than what youbuy at the supermarket. The attentiona plant gets from you helps it thrive;once you start gardening you find outwhat the plant needs and how to nour-ish it.”

Start getting ready now, said Harley,who recommends shopping at localgarden centers to take advantage ofearly season availability. But if youhaven’t started purchasing your seedsyet, don’t worry, Jones said. “Most ofthe country is buried under badw e a t h e r, ” so people are slow to thinkof gardening. Choose what you love toeat, then get shopping; you’ll be har-vesting your spring vegetables just likethe pros.

Question: I read your articleabout sealing around win-dows and doors by remov-

ing wood trim to use foam sealant.Are you talking about removing theinterior or exterior wood trim? An-other item is exhaust fans forkitchens and bathrooms. Are thevents OK being exhausted to the at-tic (provided there is sufficient ex-haust venting to the outside), ormust they be exhausted throughthe roof?

Answer: The article referred toremoving the inside trim of thewindow and then filling the voidswith low-expanding spray-foam in-sulation. All vent fans should be tothe exterior of the home to reducethe humidity levels that might ac-cumulate in the attic. Even a well-ventilated attic can be subjected tohigh humidity levels that can dam-age both the structure of the homeand the attic's insulation.

You can vent a bath fan throughplastic hose, laying the hose under

the attic's insulation and extendingthe hose to the overhang by thegutters. Make sure that the hoseterminates near an opening in theoverhang. Kitchen fans, if vented,must be vented in an approved met-al pipe and through the roof orsidewall. The purpose of the metalis to protect the home from a possi-ble kitchen fire. If the range hood isthe ventless type, there is no re-quirement to vent it to the attic orto the outside. Most ranges are lo-cated near an exterior wall, where itis easier to vent the range hood di-rectly through the wall to an ap-proved vent cap, but again theopening in the wall must be fire-re-sistant. Use the fans often to re-duce both humidity levels andodors from inside the home.

According to the most recent Realtors Confi-dence Index, buyers continue to be discour-aged with the extended short sale process,

resulting in foreclosures that could have been pre-vented. New resources from the National Associa-tion of Realtors aim to help Realtors and con-sumers successfully navigate the short sale pro-cess to help more homeowners avoid foreclosure.

“Our members report that short sales are oftenriddled with delays and red tape,” said NAR Presi-dent Vicki Cox Golder. “As the first, best sourcefor real estate information, Realtors are dedicatedto help streamline and improve the short sale pro-cess for both buyers and sellers. NAR has workedtirelessly to provide Realtors with the resourcesthey need to navigate short sale transactions, aswell as provide guidance on helpful governmentprograms designed for homeowners facing thep ro c e s s . ”

On April 5, 2010, the U.S. government will im-plement the Home Affordable Foreclosure Alterna-tives Program. Part of the Home Affordable Modifi-cation Program, HAFA helps homeowners who areunable to retain their home under HAMP by sim-plifying and streamlining the use of short salesand deeds-in-lieu of foreclosures. Homeownersmust meet certain requirements to participateand incentive payments are provided to homeown-ers and servicers.

To help Realtors understand HAFA and its guide-lines, NAR has released a brochure about theHome Affordable Foreclosure Alternatives Pro-gram and additional resources online, includinggovernment forms and guidelines, a video explain-ing the new federal guidelines, and frequentlyasked questions. Designed to help Realtors explainthe new program to homeowners, NAR’s HAFA re-sources explain how the program aims to stream-line short sales and, in the process, save more fam-ilies from foreclosure.

“The new guidelines and incentives as part ofHAFA are a crucial step towards reducing prob-lems with the short sale process, and Realtors areready to help make this new program a success,”Golder said.

In addition to its resources on HAFA, NARlaunched a Short Sales and Foreclosures Certifica-tion Program in August 2009. The SFR program isoffered by the Real Estate Buyer’s Agent Councilof NAR and includes training on how to manageshort sale, foreclosure and real-estate ownedtransactions.

kitchen into the current decade.The cramped kitchen didn’t leave

much room for entertaining, and itwas closed off from the adjoiningliving and dining rooms. So, Ikicked things off by knocking downa few walls and opening up thewhole space. I also added windowsand new glass doors so the lovelybackyard would be in full view.

I then got started on my quest topay homage to the home’s mid-century design, while turning thespace into a modern kitchen. Iripped out the old appliances, toreout the cabinets, replaced theflooring with charcoal porcelain tileand put up a fresh coat of paint.Then, I sectioned the large spaceinto a two rooms — a kitchen and adining room that flow seamlesslyinto one another and blend intothe adjacent living room.

In the kitchen, I created a longcontinuous flow of white quartzcounters, zebra-wood cabinetry andwindows along the back wall. Be-cause I wanted to maximize theoutdoor view, I put in very few up-per cabinets, and put most of thenew appliances below the counters,including the new double ovens, adishwasher and a microwave. I alsohid a fridge/freezer behind somepanels that blend in with the rest of

the cabinetry.The focal point of this room is a

large kitchen island. Part of the is-land functions as a food-prep andcooking area, and contains a blackmarble surface with a sleek cook-top. I designed the other half of theisland for eating and entertainingby installing a higher white quartzperimeter countertop and puttingfunky bar stools around it.

In the dining-room area, I put ina bar that contains a marblecounter and more dark wood cabi-netry, and decked it out with astate-of-the-art wine fridge and cof-fee maker.

I kept Tracey and Terry’s existingdining-room table, but added newdining-room chairs in a creamy fab-ric. I also installed a gorgeous ele-vated fireplace that can be enjoyedfrom anywhere in the room.

Additionally, I put up five retropendants over the island and in-stalled a funkadelic fixture abovethe dining-room table.

This dysfunctional 1960s kitchenwas way past its best before date.So I blended modern conveniencewith retro charm and created theperfect recipe for a beautifulkitchen — and a beautiful compro-mise for Tracey and Terry. Nowthat’s divine.
