    ANNEXURE B (ENGLISH) As per the provisions of notification No.S.O. 1533 dated 14/09/2006 issued by Ministry of Environment and Forests, Government of India, New Delhi, Public Hearing is conducted for the project covered under Category A of the said notification for M/s Zydex Industries Pvt. Limited for its proposal to produce polymers, silanes, water based coating, starch blends and its related products at proposed location Survey No. 462, 469, 470-472 and 474-479, Padra Jambusar Road, Gavasad, Ta. Padra, Dist. Vadodara under the supervision of Shri V. Nehra, District Magistrate and District Collector, Vadodara. Shri A. A. Dolti, Regional Officer, GPCB and representative of Member Secretary, GPCB a panel member of public hearing committee; welcomed all present to the Public Hearing. He outlined the various provisions of the Notification and briefed the procedural details for conducting this public hearing including actions taken by GPCB for vide publicity of this public hearing and the advertisement given earlier in the local dailies. He announced that as per the provisions of Notification, only locally affected persons will be allowed to represent in the Public Hearing while others having plausible stake may give their representation in writing which would be included in the proceedings. He also informed the forum that three written representations were received prior to public hearing. One from Shri Pravinbhai Sheth, Ankleshwar; one from Shri Yogeshbhai P. Pandya, SHE Association, Bharuch and Shri Maheshbhai Pandya, Paryavaran Mitra-Ahmedabad, which would be included in proceedings. The same are enclosed as Annexure C1, C2 and C3 along with the replies submitted by the project proponent as Annexure D1, D2 and D3 respectively. He then opened the Public Hearing after due permission from the District Magistrate. He invited the Project Proponent to give their introduction and to make the presentation of their project. Shri Nitinbhai Shah, representative of the industry, gave a brief introduction of the Company and welcomed the gathering. Shri Ajay Ranka, CEO of the company informed the gathering that proposed project would be first of its kind based on Nano technology in the State of Gujarat. He then briefed about the usage of their proposed product e.g. in road, water proofing of leaking houses etc. He also pointed out that the proposed project would be based on best automated technology available and would be under close control system and therefore environmental impact to the surrounding area would be minimal. He also committed that they will act for the benefit of the local people. Then after power point presentation with recorded audio in Gujarati language covering introduction of the Company, technical information, details of proposed project, Environmental Management System, its impact on the environment along with proposed mitigation measures and industrys activities regarding Corporate Social Responsibilities was presented. After the presentation by project proponent, Regional Officer, GPCB with the due permission of the District Magistrate opened the forum for representations / suggestions / objections from the locally affected people. District Magistrate informed the gathering that forum is for them only and invited them to come forward with any kind of suggestions / objections / opinion / views they have. He also requested the

    gathering to first put forward their suggestions / objections / opinion / views to avoid duplication of points and directed project proponent to reply them simultaneously, then after.     Pointed out that at a distance of about 1 km, there is a Sardar Aavas residential area. It was also pointed out that in Gavasad area about 4500 people are residing and there are all chances of adverse effect to those residents due to air emission from the industry.

    Feared damage to the agricultural activities due to air pollution.

    Informed that due to pollution problem caused by the existing industries, crop of about 100 acre land have damaged.

    3 Shri Narendra Thakorbhai Patel, Farmer Vill. Gavasad.

    Requested not to bring pollution causing industry amidst the agricultural land.

    Opined that there is no other business for the local people than the agriculture and therefore industrialization in the area shall not be allowed.

    4 Shri Natubhai Vitthalbhai Patel, Postmaster, Vill. Gavasad

    Opined that available land for agriculture purpose has already reduced and is still reducing day by day on account of increased industrialization.

    Feared that pollution that may be caused by the proposed project may result into reduction in crop yield and adverse impact on human health.

    5 Shri Pravinsinh Sindha Vill. Muval

    Expressed his support to the points raised. Opined that day by day population increases where as

    available land for agriculture purpose decreases on account of selling of agriculture land at appreciated rates and demanded that industry there fore should provide employment to the local poor and land looser based on their eligibility.

    Demanded that industry shall take utmost care for the pollution control and shall ensure that there is no adverse health impact.

    Demanded that industry shall raise their proposed socio-economic fund of 2.5 Lakh/year.

    Demanded that industry shall contribute for health and education upliftment.

    6 Shri Thakorbhai Kashibhai Patel, Farmer, Vill. Gavasad

    Opined that there are around ten industries in an area and have neither provided employment to the local people nor have donated for upliftment of village as committed earlier by them and industries give false promises.

    District Magistrate congratulated participants for their disciplined representations which has covered all the relevant aspects. He also pointed out that some representations were not related to the proposal but were for other existing ones and informed that they shall not be treated at par; however, proposal of this industry shall be scrupulously scrutinized for its merit. It was pointed out that in democracy, voice of public is supreme. It was clarified to the gathering that land looser means one that has lost land on account of legal acquisition against ones willingness to do so and therefore one who has sold land to this company willingly at ones cost can not be considered as a land looser. However, he showed his concern for the farmers, workers who were earlier relying directly / indirectly on this land for their bread and butter and requested industry to give them priority. It was pointed out that as far as pollution is concerned, all that resides nearby are at par. He while drawing attention of the industry, informed that development of the industry is possible only in co-ordination and cordial relationship with the village where it is located and can not be compensated with money. Industry was directed to thrive for the solution to the problems of the village to the best of their resources limitations. Then after, District Magistrate summed up the representations / points raised and directed project proponent to reply. Shri Sudhir Verma, a representative of the industry, informed that points raised have already been covered in EIA reports and were also discussed during presentation viz. product slate, water consumption, waste water generation, waste water treatment methodology along with its mode of disposal. Regarding fear about air pollution, it was further clarified that there will be no process gas emission from the manufacturing process and there will only be generation of flue gas emission from their FO based boiler and thermic fluid heater and added that quality of emission would be within prescribed norms of GPCB. He further informed that they have a planning to use natural gas as a fuel in future, when made available. It was pointed out that as per the air modeling; settlement distance of flue gas emission is about 200-300 m which falls within their industrial premises itself and informed that there will be no impact to the surrounding agricultural crop. It was also informed that industrial waste water will be treated up to inlet norms of CETP-EICL, Umaraya in the proposed ETP and then will be disposed off to CETP-EICL which shall further dispose it off into ECP channel; hazardous wastes will be disposed off to TSDF-NECL at Nandesari and membership for the same have been obtained.

  • Shri Ajay Ranka, CEO of the industry further clarified the gathering that proposed project is not a chemical plant but is a water based polymer plant where in there is no process gas emission and will have only flue gas emission. It was then added that they will provide cyclone separator, latest injector for the control of air pollution due to flue gas emission. He informed that there is no pollution related problems due to their viiI. Luna based existinq industry to the surrounding area. About less industrial waste water generation against more water consumption, it was clarified that they have adopted water based technology in place of solvent and therefore water consumption is more wherein water will consumed in product itself.

    At the end of the public hearing proceed ings, the same was read over in the vernacular language to the audience expla ining the contents.

    The Public Hearing concluded with the vote of thanks.

Before constructing building blocks requiring air conditioning I refrigeration. please ensure to calculate proper R value & U factor for slab, roof, side walls, glasses to achieve maximum power saving.

    A detailed land use pattern of the study area is covered in chapter 3 of EIA report.

    6. You will use 576 MT/M DISTILLED METHANOL, a. Which statutory permissions you have / obtain to

    store / use/ recover/ disposal of Distilled Methanol? The unit is in inception phase. All the statutory permissions will be obtained for storage of distilled methanol before starting the production.

    b. What is reason that you cannot use fresh Methanol in process?

    Fresh Methanol will be used as makeup whenever required in the process, till then the methanol recovered after distillation will be used.

    c. How bye-product distilled Methanol generation is more than usage?

    Methanol is generated in Polyester resin and Silane Product and that is why production is more than reuse.

    d. Referring to process description, distilled Methanol input & output is ditto same!!! How that there is no process lose even at elevated temperature?

    Silane being an High Value Product ,where distilled methanol is reused. Distillation is a quality assurance process to ensue that no contamination has occurred during earlier process. Generally it is not expected to happen.

    7. One side table 1.13 & figure 1.5 refers cooling tower makeup water as 10 KLD whilst table 1.8 refers as 50 KLD ! what is correct data ? What is cooling tower efficiency ?

    Details in table 1.8 refers to water consumption details. The details in table 1.13 refers to waste water generation. In table 1.13, the word makeup should be read as blowdown. The typographical error is regretted

    The distillation bottom residue will be a mixture of non recoverable organic material (Fatty acids, acrylic polymers, silane monomers etc). It will be packed in drums and sent to NECL, Nandesari

    d. Any chance of generating furan / Dioxan during incineration ?

    There will be no inhouse incineration process carried out in the plant. Membership from NECL, Nandesari has been taken to avail the facility of incineration. The residue will not generate any furan or dioxane during incineration.

    21. Is there any exothermic reaction evolved in any process if so, pl. provide Risk Assessment plan.

    Few reactions involved are mildly exothermic polymerization reactions. Detailed risk assessment report has been prepared.

    22. In case of handling any declared emergency , a. a. What is evacuation procedure ? Evacuation procedure will be prepared

    and will be submitted in final onsite emergency plan when the unit comes operation.

    b. b. What is path of evacuation ? Pl. provide plan layout

    Evacuation plans and procedure will be prepared and evacuation drill will be conducted regularly. Evacuation plan will be displaced at prominent location.

    c. c. Do you have any mutual aid written agreement with near by industries ? if so pl. provide copy of this

    Mutual aid agreement with nearby industries once the industry goes into production.

    23. Pl. Provide details of fire extinguishers will be We will provide fire extinguishers as per

    24. What inventory of foam compound (for solvent fire extinguishing) will be maintained at any point of time ?

    Foam compound AFFF will be kept ready at site near hydrant monitors ( 20 Lits. Carboys at each hydrant monitor locations.

    25 Pl. provide de-contamination procedure for discarded barrels before reuse disposal.

    Methodology of de-contamination and disposal of discarded containers Empty barrels/Containers will be reused

    as required or sold to authorized scrap vendors.

    Drums containing water soluble chemicals will be rinsed twice with water, dried and then disposed off to authorized dealer.

    Drums containing water insoluble raw material will be rinsed with hot water and (0.1%) caustic solution and again will be rinsed twice with water and will be reused again and again before it is sent to ETP.

    A record of the above mentioned process along with its numbers will be kept.

    26. How do you ensure that in hot summer hot water will not run through eye wash fountains / shower bath ? if proposed to be installed .

    Pipeline connected to safety shower/ eye wash fountains will be jacketed by cooling tower water to ensure cool water at point of discharge.

    27. Pl. Provide solvent tanker / drum unloading procedure?

    1. Safety permit for hazardous material loading unloading will be prepared and implemented.

    2. Earthing of all plant equipment and earthing of vehicles under unloading operations.

    3. Provision of Spark Arrestor/Muffler at the security gate to each vehicle will be implemented for tankers/Vehicles which comes in to the tank farm for unloading.

    28. During last 3 years, has GPCB issued any show cause / closure notice to any of your group company ?

    The sampling have been conducted in villages and the power connection was taken from the nearest dwelling. The GPS readings of the locations of the sampling stations superimposed on google earth

    studies samples were analysed ? The samples have been analysed by the consultants engaged for preparing the EIA report.

    30 You will store quite huge quantity of solvents, a. How do you ensure zero static charge before allowing

    solvent tankers / drums to enter the factory premises ? Earthing of all plant equipment and earthing of vehicles under unloading operations. Static earthing point will also be provided at drums unloading point and static discharge will be done before activity start.

    b. How many & what types of sensors will be installed in fire alarm system ?, How you will ensure that such system will not raise FALSE Alarms repeatedly ?

    Local call points will be installed and Gas detection (LEL % base will be procured and checked regularly and record will be maintained.

    c. How many lightning arrestor will be installed at solvent storage / usage / recovey area ?

    Lighting arrestors will be provided on plant building as on chimney.

    31.a. How long construction period will continue ? Construction work will continue for a maximum of 12 months

    b. What are provision for drinking water & sanitation facilities ?

    Drinking water facilities would be aqua guard/RO type facilities. The domestic waste water generated will be sent to soak pit which will be created during the construction phase.

    c. What will be EMP to over come negative adverse Impact like habitat disturbances ?

    The site is devoid of any habitation, so relocation of people will not arise

    d. How many % local people will be given employment ?

    Employment to local people will be given as per the guidelines of Gujarat Government.

    e. What will be provision for compensation package for employees dependents in case accidental casualty during employment ?

    The workers will be covered in Workman Compensation Policy.

    32. What was noise level at environmentally sensitive places ?

    The noise level were found to be falling with the prescribed limits given by Noise Damage Risk Criteria Of OSHA. The details for same are given on page no. 75 of EIA report.

    33. How funds enmarked for development of villages considered towards ENVIRONMENT PROTECTION MEASURES ?

    The funds earmarked for the development of villages will include the developmental activities of roads, school and green belt of the area.

    34.a. Have you carried out compatibililty studies of raw materials before designing storage tank installation? If so please provide details.

    SUGGESTIONS (To be implemented if worth acceptable & economical) 35. In case of declared emergency it will be very difficult

    to send your employees to nearest Doctor /Hospital for further in time treatment WITHOUT HANDY CASH FLOW. So it is suggested to have an agreement with such nearest healthcare centers to start medical treatment without cash flow or workout any other better alternative.

    Occupation Health Centre will be provided at site and primary medical emergency equipment like oxygen set, antidote kit, medicines etc. will be provided. Ambulance will be available will available round the clock at OHC with driver.

    36. Before construction building blocks requiring air conditioning / refrigeration, please ensure to calculate proper R value & U factor for slab, roof, side walls, glasses to achieve maximum power saving .

    Necessary precautions will be undertaken for selection of construction materials

    37. Please encourage timber free construction wherever possible & use eco-friendly construction material

    Eco friendly construction material for shed and utilities will be used.

    38. In order to encourage energy conservation drive, please use solar system (street lights, garden lantern, heater, pumping water to overhead tank, etc.) Also use CFL lamps (with due care to handle discarded lamps to avoid mercury pollution)

    Solar hot water system will be installed for canteen.

    39. Restrict use of CFC & alternates should be encourage to avoid Global warming & to honour national drive campaign. Other green gases emissions should be kept at possible minimum level.

    Necessary precautions will be taken and use of CFC will be avoided.

    40. For Equipments generating noise , it is advisable to specify in purchase order itself to specify suitable acoustic measures with permissible dBA.

    Sr.no. Query Reply 1. The basic concept of the Environment Impact

    assessment is to study the Environmental status of the concern area whereby any new set up or explanation will took place. We are of the firm opinion that such type of EIA should be region wise. Which gives the complete status of water, air, solid pollution level, socio - economic status, flora fauna etc. through some institution like NEERI, Gujarat Ecology Commission, CSMCRI etc. The EIA report of M/s. Zydex Industries Pvt. Ltd. is not giving the correct picture of Env. Status at Gavasad, Reporter should mention the pollution load caring capacity of the area and against that what is the situation as on today, after new expansion what will be scenario. As per our knowledge and information that Padra - Taluka has crossed the level of saturation for the Chemical Industries. Hence no further new setup or expansion is desire at this area. The capacity of effluent channel pipe line is also not satisfactory and there are many environment related issues at Mahi river basin. EIA reporter should be specific so far as environment pollution load caring capacity and such study should be constantly revised by state government with scientific study of Mahi river basin ecology and accordingly allow the numbers of industrial development time to time.

    EIA has been prepared as per the TOR issued by MOEF, New Delhi.

    2. The ground water requirement for the project 338 KL / day for which whether the M/s. Zydex Industries Pvt. Ltd. has procured the permission from Gujarat water and Sewage Board as well as central ground water authority for ground water consumption? We firmly believe that any new chemical industries coming up on basis of ground water is dangerous for environment preservation.

    The site does not fall under dark zone areas as listed by Central Ground Water Authority report. Details given on Annexure-2, page 190 of draft EIA report.

    3. The generation of effluent will be 24.5 KL/day. Is there any action plan to recover, recycle and by that the effluent will be lessthan 24.5 KL/day.

    The unit has already committed for the reuse of RO reject which will reduce the effluent load. Details are covered in Chapter 1 of EIA report, Pg no. 27 & 28.

  • 4. The project proponent made Statement about the ground water harvesting/recharging system but no technical details is given in this report. As mentioned in the EIA report about rainwater rooftop harvesting is not eco friendly and will create many Env. issues. The project proponent should spend handsome budget for rainwater recharge development of talavadi / chekdam in the village and near by the factory area.

    Rain water harvesting methodology is explained in chapter 5, pg no. 105 of EIA. As per the commitment, the collected water will be used in raw water tank and fire water tank. There will be no recharge of bore.

    5. M/s. Zydex Industries Pvt Ltd. Mentored in the EIA report about solid waste disposal. i. Glycol distillate 69.M.T./month will be sold. ii. Distilled methanol 66 M.T/month will be sold.     The required permission from the GPCB will be taken on applying for NOC & CC&A as per the format once the clearance is obtained. Details will be provided in form 3 & form 4 as per the GPCB requirement.

    No, the project is in inception stage. Necessary clearances will be obtained once environmental clearance is obtained.

    Trees like Beganvilas, Ber, Imli, Neem, Peepal, etc will be grown in the area. A total fund of Rs. 0.6 Lacs as capital cost and Rs. 0.5 Lacs as Recurring cost per year is already earmarked for the greenbelt development. As given on pg no. 103 of EIA report, greenbelt monitoring will be carried out by the in-house team members.

    2 What is the name and distance of the sister concern of this unit?

    The sister concern M/s. Zydex Industries is a proprietory firm and is located at Luna, Padra. The sister unit is located at a distance of approximately 16 km NE of the proposed unit

    3 Whether company has Environment -Clearance for its existing sister concern? If yes, give copy of clearance and compliance report thereof. Also, provide compliance report of EC

    The unit did not require Environment Clearance. However the unit has the required NOC and CC&A valid upto 19/9/2013

Also it is mentioned that total land is 25 acre while for the 85867.54 Sq.m land, it is 21.218 acre. 86342.54 square meter = 21.33 acre. 101171.41 square meter = 25 acre. 101171.41 - 86342.54 =14828.87 acre 14828.87 square meter= 3.66 acre. So, give a clarification of 3.6 acre land, this is the misleading information about land.

    The area of 25 acres was written approx. since Banakhat were done but for few acres the land sales could not be completed when these figures were compiled. Once these are complete it will be approx. 25 acres.

    10 What is the use of open space & others in land break up table?

    Open space and others are kept for expansion in future.

    11 Have you obtained permission for extracting 338 KL/D water from bore well from concern authority?

    BOD level is 641mg / L while in ETP inlet norms BOD level is 500 mg/L so, what are the steps taken by the company to reduce the BOD level to fulfill the norms?

    The treatability study given in the EIA report is based on the composite sample made from the process. The COD and BOD measured was 1700 mg/L and 918 mg/L. This stream volume will be about 9.5 KL/day. After treatment when mixed with blowdown of boiler and cooling tower ( 15 KL/day), the final values of COD/BOD will be very less 570/280 mg/L which is well within the CETP inlet norms

    13 Give names of Authorized brick Manufacturer to whom fly ash would be sold

    Mostly FO will be used. The 2nd option will be use of agro waste. Coal will be used only if FO or agro waste is not available. If natural gas is available, preference will be given to use of Natural Gas. If coal/agrowaste flyash will be sold to brick manufacturers. The details of the sale will be provided in form 3 and form 4 as per the requirements of GPCB when the plant is in operation

    14 Please give details on area of green belt, no. of trees and types of trees to be planted and water requirement for green belt.

    Greenbelt will be developed in 28,500 m2 area. Trees to be grown in the green belt are given below:

    GPCB norms of 1000 trees per acre will be followed for green belt development

    15 How many local skilled and unskilled people will get employment from this project, both at construction and operation phase of plant?

    Employment to local people will be given as the guidelines of Gujarat Government.

    16 In the EICL membership certificate it is written that industry is allowed to discharge 25 KL per day of wastewater while in EIA report it is written that they would dispose 39.5 KL per day of wastewater 39.5 - 25 = 14.5 where are you going to discharge this 14.5 KL/D surplus water?

    15 KL is on domestic waste water to be absorbed in soak pit. So the balance is 24.5 KL which will be sent to EICL.
