The present Report on Scoping the Next Environmental Assessment of Complex(Consolidated) Safety Upgrade Program of Power Units of Nuclear Power Plants (CCSUP)presents the results of implementing the 1st stage of a Next CCSUP Environmental Assessment(regular EA), which was dedicated to its scoping, including relevant public consultations.

Fulfillment of a next EA is envisaged with the Environmental and Social Action Plan(ESAP), which is an integral part of the Loan Agreements with the European Bank forReconstruction and Development (EBRD) and the European Atomic Energy Community(Euratom) on crediting the CCSUP implementation.

This document was compiled by SE NNEGC “Energoatom” with support of the expertsof CCSUP implementation Project Management Unit Consultant – Consortium of AJCDeveloppement and EDF (France) companies.

1 INTRODUCTION1.1 Nuclear power plants currently provide for more than 50% of the national economy

demand for electric power.In the situation of the country’s dependence on import of energy carriers, their permanentprice raise and wear of thermal power plants equipment, the prior area of the state energypolicy was and is development of the national nuclear energy industry, improvement ofits safety level and reliable operation. Following this, safety upgrade measures for theoperated NPPs have been developed and implemented starting with the last century’s 90sin line with a number of consistent program documents. Complex (Consolidated) SafetyUpgrade Program of Power Units of Nuclear Power Plants (CCSUP) is the latest of suchdocuments.The accident at Japanese NPP “Fukushima-Daichi” in 2011 caused primarily by act ofGod (tsunami) has resulted in substantial economic losses of Japanese economy, inexceeding the set permissible release limits of radioactive substances into environment,in personnel and population exposure. Such negative consequences drew attention ofinternational community to safety provision level in the process of nuclear power use inpeaceful purposes and to necessity of reassessment of nuclear energy complex facilities’safety level under conditions when acts of God or other emergency situations occur.Having considered the mentioned events, such states as the Federative Republic ofGermany, Switzerland, Italy and Japan claimed the gradual refusal of nuclear energy,other EU member countries the need for reassessment of nuclear energy complexfacilities’ safety level and its increase.During the meeting of Ministers of Energy of EU member and neighbouring countriesheld on the 23d of June, 2011 in Brussels, a common Declaration was adopted oncomprehensive reassessment of risks and safety of nuclear power plants operation (stress-tests) and taking the appropriate actions; Ukraine has joined this Declaration.

1.2 CCSUP was approved by the Cabinet of Ministers of Ukraine №1270 dated 07.12.2011,its implementation was initially planned to be completed by end 2017. CCSUPimplementation term was extended to 2020 with the latest amendment to this resolutionin September 2015.The goal of CCSUP is:- Safety level upgrade of operation of power units of nuclear power plants and

reliability of their operation;- Decrease of accident risks at nuclear power plants when acts of God or other

emergency situations occur;- Increase of efficient management by design-basis or beyond design-basis accidents at

nuclear plants, minimisation of their consequences.1.3 CCSUP document set (consolidated CCSUP measures, their inventories by power unit

types, as well as cards of each CCSUP measure) was published (in the original language)and has been updated from time to time at the official web-site of SS NNEGC“Energoatom”. The latest version is posted at the following link:http://energoatom.kiev.ua/ua/actvts/integrated_security_program/40915-komplekt_dokumentv_z_kzppb.

1.4 To provide for financing CCSUP measures’ implementation during 2010-2014, activitiesto raise funds of International Financial Organisations were carried out.In 2013, SS NNEGC “Energoatom” has concluded loan agreements regarding attractionof funds with the European Bank for Reconstruction and Development and Euratom.

The Law of Ukraine № 1267-VII dated 15.05.2014 ratified the Guarantee Agreement(Ukraine: Complex (Consolidated) Safety Upgrade Program of Power Units of NuclearPower Plants between Ukraine and the European Bank for Reconstruction andDevelopment», which envisages provision of loan funds in the amount of 300,000,000(three hundred million) euro.The Law of Ukraine № 1268-VII dated 15.05.2014 ratified the Guarantee Agreementbetween Ukraine as Guarantor and the European Atomic Energy Community as Lenderin relation to the EUR 300,000,000 (three hundred million Euros) loan facility agreementdated 7 August 2013 between the State Enterprise National Nuclear Energy GeneratingCompany “Energoatom” and the European Atomic Energy Community for theimplementation of the Complex (Consolidated) Safety Upgrade Program of Power Unitsof Nuclear Power Plants”.

1.5 In compliance with the mentioned international agreements, one of crediting conditionsis implementation of environmental and social actions package. One of theseenvironmental actions is environmental assessment (EA) of CCSUP implementationevery 5 years.Since CCSUP envisages safety upgrade at all four operated Ukrainian NPPs without anew construction or capacity raise, CCSUP EA is not subject to state building code DBNА.2.2-1-2003 “Designing. Scope and Content of Materials for Environmental ImpactAssessment (EIA) in the process of Design and Construction of Enterprises, Houses andBuildings”.EA process is regulated with a separate regulatory act of the Company, SOU NAEK004:2011 “Environmental Assessment of Power Units of Nuclear Power Plants. GeneralRequirements to the Scope and Content of the Assessment Materials” (posted by the linkhttp://www.energoatom.kiev.ua/files/file/sou_naek_004_2011_en_(1).pdf ).The aim of Environmental Assessment is to review environmental impacts from theprocess and results of CCSUP measures implementation. EA does not comprise theimpact assessment issues on results of new construction of nuclear facilities, the existingnuclear facilities’ capacity increase or lifetime extension of the operated NPPs powerunits.The first CCSUP EA was carried out in 2011 by an independent international teamconsisting of the experts of “Rougu” company (Finland, France, Switzerland, Germany),Ukrainian Centre of Environmental and Water Projects and “АЕSКАR” company(Ukraine). CCSUP EA was carried out in line with the EBRD Environmental and SocialPolicy, EU environmental legislation, in particular, EU Directive 2001/42/EU, andcomprised the best international practices. Stakeholder Engagement Plan (SEP), Reporton Scoping EA Activities dated 02.05.2011 (hereinafter – EA-2011 Scoping Report),CCSUP Environmental Assessment Report dated 31.01.2012 (hereinafter EA-2012Report) and the relevant Statement on Environmental Consequences of CCSUPImplementation were published and stay available at the official web-site of SE NNEGC“Energoatom” by the link:http://www.energoatom.kiev.ua/en/actvts/integrated_security_program/.

1.6 The Next EA is planned in the following stages:1) EA scoping, including public consultations regarding these scopes – completed in

June-July 2016;2) Conduct the Environmental Assessment itself, draft the appropriate report, discuss it

with public and disclose the final revision of the report –before 01.04.2017.

2 GENERAL DESCRIPTION OF CCSUP2.1 Characteristics of operated NPPs

CCSUP measures are being implemented at the sites of all four operated Ukrainian NPPs(Fig.1):- SS “Zaporizhzhya NPP”, (Zaporizhzhya region, Kamianka-Dniprovska district, next

to Kakhovska Reservoir, Energodar is the satellite town, nearly 380,000 persons livein the control area);

- SS “Rivne NPP” (Rivne region, Volodymyrets district, near Styr river, Varash is thesatellite town (before – Kuznetsovsk, nearly 130,000 persons live in the control area);

- SS “Khmelnitsky NPP” (Khmelnitsky region, Slavuta district, near Goryn river,Netishyn is the satellite town, nearly 196,000 persons live in the control area);

- SS “South-Ukraine NPP” (Mykolaiv region, Arbuzyn district, near Pivdennyi Bug river,Yuzhnoukrainsk is the satellite town, nearly 143,000 persons live in the control area).

Except for certain power units’ lifetime extension and further implementation of nuclearfuel of new modifications, information regarding characteristics of the operated UkrainianNPPs has not changed since the first EA-2011 Scoping Report, which was disclosed andstays available by linkhttp://www.energoatom.kiev.ua/ua/actvts/integrated_security_program/ 38715-zvt_pro_viznachennya_masshtabv_robt.Within 2010-2016, the Company extended lifetime of 6 NPP power units (Table 1).

Detailed information on lifetime extension of the mentioned power units is published onthe official site of SE NNEGC “Energoatom” by linkhttp://www.energoatom.kiev.ua/en/actvts/extension/, as well as on site of the relevant SSNPPs.Further introduction of nuclear fuel of new modifications included:- Activities to introduce fuel manufactured by “Westinghouse” company at power units

of VVER-1000 design;- Complete introduction of the second generation fuel manufactured by Open SC

“TVEL” at power units of VVER-440 design.Detailed information on the status of introduction of nuclear fuel of new modifications ispublished on the official site of SE NNEGC “Energoatom” by linkhttp://www.energoatom.kiev.ua/en/actvts/implementation/.

2.2 CCSUP substantiationGeneral information provided in the appropriate cl. 2.2 of EA-2011 Scoping Report hasnot changed.However, as it was already mentioned, the accident at NPP “Fukushima-Daichi” had setforth a new challenge: the need to reassess and provide for NPP safety under externalextraordinary natural impacts (including the impacts, the characteristics whereof exceedthe designed values). To check NPPs for provision of performing the principal safetyfunctions in conditions of systems and equipment failure, as well as availability ofnecessary actions to manage severe accidents, SE NNEGC “Energoatom” fulfilled anadditional dedicated reassessment of safety of SS NPPs power units accounting forexperience gained from the accident at NPP “Fukushima-Daichi” (stress-tests). Basedon the results of the relevant Consolidated reports on dedicated safety reassessment,additional safety upgrade measures were developed at the end 2012 aimed at preventionand/or decrease of consequences of severe accidents with core damage, which wereincluded into CCSUP.

2.3 CCSUP contentBeside CCSUP having been supplemented with the additional measures, the generalinformation provided in the appropriate cl. 2.3 of EA-2011 Scoping Report, has notchanged.The actual CCSUP version generally envisages realization of 1275 measures at powerunits of operated NPPs, 1097 of them were planned initially and 178 additional. 2.4 CCSUP measures implementation statusCCSUP measures implementation status has been published on a quarterly basis on theofficial site of SE NNEGC “Energoatom” The latest Non-Technical Summary of CCSUPimplementation (see Annex 2) stays available by link http://www.energoatom.kiev.ua/ua/actvts/integrated_security_program/45635-vikonannya_kompleksno_zvedeno_programi_pdvischennya_bezpeki_energoblokv_atomnih_elektrostantcyi_ukrani_u_imu_kvartal__roku/.In general, of 1275 CCSUP measures, 616 were completed as of 30.06.2016, 659 to becompleted yet, about 80 of them are planned for completion during 2016.

3 OVERVIEW OF THE NATIONAL AND INTERNATIONAL LAW3.1 Key principles

General information provided in cl. 3.1 of EA-2011 Scoping Report, has not changed. Inparticular, similarly to the first EA carried out in 2011, the next EA is carried out inaccordance with the requirements and provisions of:- international conventions and agreements ratified by Ukraine;- the national Ukrainian legislation;- the best international environmental and social practice, reflected in the EU Directives,

in the EBRD Environmental and Social Policy of 2008, and other documents.

3.2 National legislationBesides the new regulatory and legislative acts specified below, the general informationgiven in clause 3.2 of EA-2011 Scoping Report, has not changed.Since 2012, the following laws have been adopted:- The Law of Ukraine "On Ratification of the Protocol Concerning the Registers of

Emissions and Transfer of Pollutants" № 980-VIII dated 03/02/2016;- The Law of Ukraine "On Ratification of the Protocol on Strategic Environmental

Assessment to the Convention on Environmental Impact Assessment in aTransboundary Context" № 562-VIII dated 01/07/2015.

In addition, the following draft laws have been elaborated (adopted by the VerkhovnaRada in the first reading as of 30/09/2016):- Draft of the Law of Ukraine "On Environmental Impact Assessment";- Draft of the Law of Ukraine "On Strategic Environmental Assessment";

3.3 Ecological Conditions of the EUBesides the changes specified below, the general information, given in clause 3.3 of EA-2011 Scope Report, has not changed.In 2011, the EU adopted Directive 2011/92/EU "On theAssessment of the Effects of Certain Public and Private Projects on the Environment". In2014, this directive was amended by EU Directive 2014/52/EU.In 2014, the EBRD approved a new revision of the document "EBRD Environmental andSocial Policy", but the document itself states that the new revision shall be applied to

projects launched after 07/11/2014. Therefore, the updated version of the document doesnot apply to CCSUP, the Loan Agreements on the funding whereof were concluded in2013.

3.4 Institutional documents and responsible organizationsWith the exception of the Protocol on Strategic Environmental Assessment to theConvention on Environmental Impact Assessment in a Transboundary Context, ratifiedby Ukraine in 2015, the general information given in clause 3.4 of EA-2011 ScopingReport has not changed. Herewith, the first EA was carried out in 2011 in accordance withthe specified Protocol, since it was considered the best world practice.

4 STAKEHOLDERS DESCRIPTIONThe general information given in clause 4 of EA-2011 Scope Report has not changed.That Report defined the Stakeholder Engagement Plan for the period of carrying out thefirst EA in 2011. According to its results, all discovered stakeholders were conditionallydivided into two categories of people, groups or communities (Fig.2):- have or may potentially have the impact of the Project;- interested in the Project.The first category of stakeholders included:- Personnel of SE NNEGC "Energoatom" and 4 NPPs, and personnel of SE NNEGC

"Energoatom" contractors, which perform works at sites;- Population of NPP satellite towns,- Population of settlements within the control area of 4 NPPs.The specified stakeholders are represented both personally and through self-governingauthorities, local administration, trade unions and other non-governmental organizationsor institutions. Among population of satellite towns and settlements near NPPs, specialattention is paid to vulnerable groups of population: the disabled, the elderly people,people with low incomes, etc.The second category of stakeholders includes:- Central and regional state bodies of governance, safety regulation and monitoring

authorities;- International institutions and organizations, in particular, financial institutions that are

involved in financing the Project;- All interested persons both inside and outside the country, represented both personally

and through self-governing authorities or non-governmental organizations andinstitutions; but for SSs referred to stakeholders.

- Mass media or their separate representatives;- Other interested national/state organizations and institutions

In 2015, an updated version of the Stakeholder Engagement Plan regarding CCSUP(SEP) implementation was approved, which had been elaborated with the support ofexperts of the CCSUP implementation Project Management Unit Consultant - theconsortium of AJC Developpement and EDF (France) companies. The updated SEPrevision was published on the official web-site of SE NNEGC "Energoatom" and isavailable under the linkhttp://energoatom.kiev.ua/ua/actvts/integrated_security_program/41088-plan_zaluchennya_zatckavlenih_storn/.Updated SEP aims at establishing and maintaining constructive long-term relations withboth categories of stakeholders during the whole period of CCSUP implementation. Thedocument covers environmental and social aspects in line with the provisions ofinternational conventions ratified by Ukraine, in particular, Convention on EnvironmentalImpact Assessment in a Transboundary Context (Espoo Convention), Convention ofAccess to Information, Public Participation in Decision-making and Access to Justice inEnvironmental Matters (Aarhus Convention), and requirements of national legislation,recommendations of international financial institutions, involved in financing of theProject (EBRD, Euratom).The document establishes clear mechanisms and procedures for disclosure of information,involvement of stakeholders in consultations, submission and review of remarks andcomments regarding CCSUP implementation. Separately, the SEP defines a certainframework of managing complaints and other citizens' appeals.

SEP also contains a list of stakeholders and their contact details, the schedule ofpreparation and implementation of the planned measures for informing and publicdiscussions of the CCSUP implementation and the Environment and Social Action Plan(ESAP). In particular, a SEP-assumed preliminary schedule of public consultationsregarding the next CCSUP EA is provided in Annex 3.

5 DESCRIPTION OF ENVIRONMENTAL AND SOCIAL ASPECTS, WHICHSHALL BE CONSIDERED DURING THE NEXT EA

5.1 General requirementsSimilarly to the first EA carried out in 2011, the next EA focuses on revision of positiveand negative impacts on the environment, social and anthropogenic environment in theprocess and according to the results of CCSUP implementation. The next EA also aims atfull-fledged public consultations concerning the CCSUP.Like the first EA, the next EA does not cover the issues of environmental protectionbeyond CCSUP, for example, those related to implementation of other measures of theEnergy Strategy of Ukraine, in particular, to construction of new reactors or thatconstruction alternatives, increased capacities and the lifetime extension of the operatednuclear power units, etc.Compared to the scope of works stipulated in cl. 5.1 of EA-2011 Scoping Report, it is notplanned to elaborate the Statement on environmental consequences of CCSUPimplementation during the next EA. At detection of significant changes in the forecastedenvironmental consequences on results of the next EA, the mentioned Statement will beupdated. By other aspects, the scope of works stipulated in cl. 5.1 of EA-2011 ScopingReport, has not changed.The key environmental and social aspects, which must be scrutinized during EA, aredefined by the requirements of SOU NAEK 004:2011 “Environmental Assessment ofPower Units of Nuclear Power Plants. General Requirements to the Scope and Content ofthe Assessment Materials"(http://www.energoatom.kiev.ua/files/file/sou_naek_004_2011.pdf).

5.2 Impact on the EnvironmentGeneral information regarding the reviewed components of the environment and theterritory of impacts assessment provided in cl. 5.1 of EA-2011 Scoping Report has notchanged (Fig.3).The initially analyzed territory will correspond to NPPs control area. At the same time, ifon EA results it will prove that a significant impact during the CCSUP implementationand/or on its results is observed or forecasted beyond the control area, the analyzedterritory will be increased appropriately.

5.3 Impact on the Social EnvironmentGeneral information provided in cl. 5.2 of EA-2011 Scoping Report has not changed. Inparticular, according to SOU NAEK 004:2011, the impact in the process and on resultsof CCSUP implementation on the following social environment components will beanalysed:- Health of population;- Social conditions of population (living conditions and satisfaction of needs).The analysed territory will be determined by the scope of the relevant impacts similarlyto cl. 5.2.

5.4 Impact on the Anthropogenic EnvironmentGeneral information provided in cl. 5.3 of EA-2011 Scoping Report has not changed.Anthropogenic environment subject to a review includes a NPP itself and other sensitiveman-made facilities within the NPPs control area.

The basic input information sources during EA will bethe data of the earlier performed EIA, Reports on periodic re-assessment of NPPs safety,technical substantiations of nuclear power units safety, reports of SE NNEGC"Energoatom" regarding the results of ecological monitoring within NPP control areas,environmental reports of other organizations and the opinions of the state expertappraisals.

7.2 Impact identificationGeneral information given in cl. 7.2 of EA-2011 Scoping Report has not changed. Inparticular, the list of the analysed types of impacts of nuclear power units on theenvironment will include:- radiation impact factors;- chemical impact factors;- physical impact factors;- assessment of the combined action of impact factors;- indirect impacts.

7.3 Assessment MethodologyGeneral information provided in cl. 7.3 of EA-2011 Scoping Report has not changed.Given the already performed within EA-2011 evaluation of the initially planned measuresimpacts importance, in the framework of the next EA this procedure will be applied toadditional CCSUP measures not studied during EA-2011. Regarding the initially plannedmeasures, re-evaluation of their impact importance will be carried out only whennecessary.

Alldocuments, except for the minutes of public meetings, were published in Ukrainian andEnglish. Minutes of the meetings were compiled and published in the original language(Ukrainian).All the question, proposals and comments of the public received at this stage have beensummarised and the detailed competent answers to them have been given. Summarisedquestions and answers to them are given in Annex 10.The mentioned personified questions, proposals and comments with reference to thesummarised questions, as well as competent answers, will be systematized in topical areasand incorporated in the next Addendum to the Book of Questions and Answers RegardingCCSUP and CCSUP EA, publication whereof is planned in the 4th quarter of 2016(Ukrainian and English versions of the document are foreseen).

Implementation of the Complex (Consolidated) Safety Upgrade Program of Power Unitsof Ukrainian Nuclear Power Plants during the IInd Quarter, 2016

The Complex (Consolidated) Safety Upgrade Program of Power Units of Ukrainian NuclearPower Plants (CCSUP) was approved by the Decree of the Cabinet of Ministers of UkraineNo1270 of 07.12.2011. In 2012 the CCSUP was supplemented with additional measuresaccording to conclusions of the National Report of Ukraine on results of specific reevaluation ofnuclear facilities situated on NPP sites (“stress-tests”), taking into account the lessons fromJapanese NPP “Fukushima-Daichi” accident of March, 2011.

Annex 4STATEMENT OF INTENT REGARDING THE NEXT ENVIRONMENTAL

ASSESSMENT OF THE COMPLEX (CONSOLIDATED) SAFETY UPGRADEPROGRAM OF POWER UNITS OF NUCLEAR POWER PLANTS

According to the Energy Strategy of Ukraine for the period until 2030 approved by theorder of the Cabinet of Ministers of Ukraine No.1071-р of 24.07.2013, with the aim of furthersteady improvement of nuclear safety, assurance of efficient and reliable operation of theenergy sector, bringing safety of nuclear power units of Ukraine to the level, which is incompliance with the internationally recognized requirements for nuclear safety andenvironmental protection, SE NNEGC "Energoatom" is implementing the Complex(consolidated) Safety Upgrade Program of Power Units of Nuclear Power Plants (CCSUP).

CCSUP was approved by resolution of the Cabinet of Ministers of Ukraine No.1270 of07.12.2011. In 2012, all CCSUP measures were supplemented with additional measuresaccording to the conclusions of the National Report of Ukraine regarding the results of thetarget safety reassessment of nuclear facilities located at NPP sites ("stress tests"), taking intoaccount the lessons of the accident at the nuclear power plant "Fukushima-Daiichi" in Japan,which occurred in March, 2011. Statement of Intent regarding CCSUP, consolidated CCSUPmeasures, their lists according to the power unit types, as well as the cards for each CCSUPmeasure were published and remain available on the official web-site of SE NNEGC"Energoatom" under the link

Funding of CCSUP measures is provided with own funds of the State Enterprise "NNEGC"Energoatom", as well as with loan funds granted by the European Bank for Reconstructionand Development (EBRD) and the European Atomic Energy Community (Euratom). Beforemaking a decision on the Project crediting, the Lenders and the Borrower had agreed to performa CCSUP Environmental Assessment (CCSUP EA). Such assessment was performed in 2011by an independent international team with the participation of the experts from the "Poyry"company (Finland, France, Switzerland and Germany), the Ukrainian Center of Environmentaland Water Projects, and the company "AESKAR" (Ukraine). EA CCSUP was carried out inaccordance with the EBRD Environmental and Social Policy, environmental legislation of theEuropean Union, in particular the EU Directive 2001/42/EU, and took into account the bestworld practices. Stakeholder Engagement Plan (SEP), Report on works scoping, Report onCCSUP EA and the corresponding Statement on the environmental consequences of CCSUPimplementation were published and remain available on the official web-site of the StateEnterprise "NNEGC "Energoatom" under the above mentioned link.

For EBRD financed projects, the bank defined particular Project ImplementationRequirements (PIR) for key aspects of environmental and social issues and impacts. If, as incase of CCSUP, the proposed activities relate to the existing facilities or sites, the borrowershould adopt and implement the Environmental and Social Action Plan (ESAP), as well asprepare, publish and implement the Stakeholder Engagement Plan (SEP) during Projectimplementation. Against this background and based on the results of CCSUP EA, acorresponding Environmental and Social Action Plan has been elaborated and approved as oneof the documents of the financed Project. ESAP and an updated SEP were disclosed and remainavailable on the official web-site of the State Enterprise "NNEGC "Energoatom" under theabove mentioned link.

Loan Agreements with EBRD and Euratom became effective on 19.12.2014 and28.05.2015 accordingly. Significant delay from the initially scheduled terms of CCSUPimplementation (until the end of 2017) due to the limited tariff and delays in obtaining theEBRD/Euratom loans resulted in the extension of the CCSUP completion date till the end of

2020, which was approved by resolution of the Cabinet of Ministers of Ukraine No.776 of30.09.2015.

The aim of the next CCSUP Environmental Assessment is the reassessment of the impacton the environment during CCSUP implementation with regard to modifications made inCCSUP in 2012 - 2015, its measures, completed during that period, as well as the actualchanges in the environmental situation and its monitoring procedures, which took place sincethe completion of the previous CCSUP EA.

The scopes of the next CCSUP EA (analysed aspects, elements of the environment,sources, types and factors of the impact, etc.) are planned to meet the scopes of the previousCCSUP EA, defined according to the document SOU NAEK 004:2011 “EnvironmentalAssessment of Power Units of Nuclear Power Plants. General Requirements to the Scope andContent of the Assessment Materials” approved by the Ministry of Ecology and NaturalResources of Ukraine (the document is available under the link). A clear reference to theprevious CCSUP EA Report results dated 31.01.2012, is admissible in the part, which does notrequire an adjustment, without its materials’ duplication.

Implementation of the next CCSUP EA will include:- Specification of the Environmental Assessment scopes;- Initial data collection and analysis;- CCSUP EA Report drafting;- Disclosure of a draft CCSUP EA Report and its public discussions according to

SEP;- Finalization and publishing of the final revision of CCSUP EA Report.

With the purpose to specify the scopes of the next CCSUP EA, according to SEP, SENNEGC "Energoatom" plans to hold consultations with the public, particularly, meetings withstakeholders in satellite towns of the operating Ukrainian NPPs according to the followingschedule:

- Energodar (SS "Zaporizhzhya NPP") - July 1, 2016;- Yuzhnoukrainsk (SS "South-Ukraine NPP”) - July 6, 2016;- Kuznetsovsk (SS "Rivne NPP") - June 23, 2016;- Netishyn (SS "Khmelnytska NPP") - June 22, 2016.

Significant delay from initially scheduled terms of CCSUP implementation (untilthe end of 2017) due to the limited tariff and delays in obtaining EBRD/Euratom loans resultedin the extension of the CCSUP completion date till the end of 2020, which was approved bythe resolution of the Cabinet of Ministers of Ukraine No.776 of 30.09.2015.The aim of the next CCSUP Environmental Assessment is the reassessment of the impact onthe environment during CCSUP implementation with regard to modifications made in CCSUPin 2012 - 2015, its measures, completed during that period, as well as the actual changes in theenvironmental situation and its monitoring procedures, which took place since the completionof the previous CCSUP EA.The scopes of the next CCSUP EA (analysed aspects, elements of the environment, sources,types and factors of the impact, etc.) are planned to meet the scopes of the previous CCSUPEA, defined according to the document SOU NAEK 004:2011 “Environmental Assessment ofPower Units of Nuclear Power Plants. SE NNEGC "ENERGOATOM" HAS HELD A BRIEFING ON PUBLICCONSULTATIONS CONCERNING THE SCOPE OF THE NEXT CCSUP

ENVIRONMENTAL ASSESSMENTSE NNEGC "Energoatom" has held a briefing for the media and other stakeholders regardingpublic consultations concerning the scope of the next Environmental Assessment of theComplex (Consolidated) Safety Upgrade Program of Power Units of Nuclear Power Plants(CCSUP). The event took place on June 22 at the premises of SS "Atomproektinginiring" withthe participation of the CCSUP Project Management Unit (PMU) Leader Gennadi Sazonov,PMU Consultant Leader Michel Levy, and Environment, Health and Safety Expert LudvigLitvinsky.It was informed during the briefing that the aim of the next CCSUP Environmental Assessmentis the reassessment of the impact on the environment as the result of the CCSUPimplementation with regard to modifications made in CCSUP in 2012 - 2015, its measures,completed during that period, as well as the actual changes in the environmental situation andits monitoring procedures, which took place since the completion of the previous CCSUP EAin 2011. In particular, EA includes such tasks like the assessment of the results of the CCSUPimplementation at each Ukrainian NPP, the assessment of a possible impact of the CCSUPimplementation in a transboundary context, public consultations regarding the CCSUP andCCSUP EA implementation, update and, if necessary, supplement of the list of mitigation oroptimization measures etc.In line with the consultations schedule, the first regional meeting with the public in NPP satellitetowns took place on June 22 in the Information Centre of Khmelnytsky NPP; on June 23 themeeting took place at RNPP; on July 1 the consultations will be held at ZNPP; and on July 6they will be held at SUNPP.During the briefing Gennady Sazonov reminded that the Company had been implementing theCCSUP since 2010. The program foresees 1275 measures, which should be implemented at all15 Ukrainian nuclear power units until 2020. "The total value of the program is estimated at1.4 billion Euro, whereof 600 million Euro will be provided in loans by EBRD and Euratom,the rest - about 800 million Euro SE NNEGC "Energoatom" has to finance at its own expense.As of 2016 all issues of CCSUP financing have been addressed. Within the framework of theLoan Agreements, SE NNEGC "Energoatom" has undertaken to implement the Environmentaland Social Action Plan. Based on this plan, the CCSUP Environmental Assessment should becarried out every five years. In 2011, the first Environmental Assessment of the Program wasperformed by an independent international group of experts. Now we have launched anotherEnvironmental Assessment, and we expect to complete this process until the middle of 2017",- explained G.Sazonov.Ludvig Litvinsky specified that the scope of the next CCSUP EA will be in compliance withthe first Environmental Assessment without unnecessary duplication of information, presentedin the previous report. "If there are no comments and proposals from the public, the nextEnvironmental Assessment will differ from the first one only in terms of modifications in thenational Ukrainian legislation which took place during the past five years. The EA reportstructure foresees four sections - for each nuclear power plant, as well as general sections that

program, but a compulsory condition precedent to the loan is to carry out a strategic analysis(EA) every 5 years before the end of the loan.Environmental Assessment includes the following tasks: Assessment of impacts on theenvironment, social and industrial environment, complex measures regarding the assurance ofthe standard conditions of the environment and its safety, changes of the environmental impactduring CCSUP implementation, EA results of the CCSUP implementation for the UkrainianNPPs, assessment of a possible impact of the CCSUP implementation in a transboundarycontext and activities in informing the bordering countries, public consultations on the CCSUPimplementation, mitigation or optimization measures and conclusions.The activity of SE NNEGC "Energoatom" is closely monitored by the public, so theimplementation of the measures regarding this Program implementation is a really necessarycondition nowadays. Questions, comments and proposals will form the basis for a final report,- said Danylo Lavrenov.One of the urgent questions was the question about the possibility of the Programimplementation while Energoatom's accounts are blocked. Maksym Pyshny answered to this,that the structure of banks funding foresees the payment for the supplied equipment directly tocontractors. SE NNEGC "Energoatom" does not receive money. in 2012 - 2015, its measures, completed during that period, as well as the actual changes in theenvironmental situation and its monitoring procedures, which took place since the completionof the previous CCSUP EA.Speaking at the meeting, Oleksandr Nemtsov, the Head of the Executive Directorate for NRSand Scientific and Technical Support remarked: "The precondition for such a massive work isthe ratification by the two Ukrainian laws of the Loan Agreements between EBRD, Euratomand SE NNEGC "Energoatom" in terms of granting loan funds in the amount of 600 millionEuro to finance CCSUP measures. One of the conditions of these agreements is theEnvironmental and Social Action Plan, under which SE NNEGC "Energoatom" is to carry outthe Environmental Assessment of CCSUP implementation every 5 years and bring its resultsto the public for consideration.The Reporter informed that the first Environmental Assessment was performed in 2011 by anindependent international team with the participation of the experts from the company "Poyry"(Finland, France, Switzerland and Germany), the Ukrainian Center of Environmental andWater Projects, and the company "AESKAR" (Ukraine). According to the internationalexperience, the report will also be submitted for public discussion with a parallel conducting ofthe State Ecological Expertise. The final approval of the document is scheduled for March. Atthe same time, similarly with the first report, it will be published on the website of the company.The assessment of the CCSUP impacts on the environment will cover the followingcomponents: climate and micro climate, soils, air, geological environment, water environment,flora and fauna, as well as protected objects. Radiation, non-radiation, chemical, thermal,electromagnetic, and acoustic impacts will be analysed within its framework. Besides, apossible impact of the CCSUP implementation in a transboundary context and activities ininforming the bordering countries will be evaluated.In his address to the attendees, Danylo Lavrenov, the Deputy Director of the ExternalInformation Communication Centre of SE NNEGC "Energoatom" highlighted that the South-Ukraine NPP is the last one among the nuclear sites where public consultations concerning thescope specification of the next CCSUP Environmental Assessment are held. He called foractive cooperation and highlighted that all questions, proposals and comments of the publicwith full and complete answers of specialists will be studied and taken into account in theCCSUP EA final report. They can be provided during one month - until August 6, 2016. What is the current statusof CCSUP ESAP? Is itplanned to publishreports on itsimplementation, inparticular within theframeworks of EA?

CCSUP ESAP is an integral part of Loan Agreements with EBRD and Euratom.Non-technical Summary of CCSUP and CCSUP ESAP is annually published onthe official web-site of the State Enterprise NNEGC "Energoatom" (the last NTSwas published on 10.11.2015 [79], the next one is planned for 2016). The statusof CCSUP and CCSUP ESAP implementation is at times also discussed at publicmeetings according to CCSUP SEP. Last meetings took place in November 2015,the next ones are planned for 2017. ESAP progress will also be covered in the nextCCSUP EA Report. The Annual Report on Environmental and Social Matters,envisaged by ESAP, clause 1.6, is an internal reporting of SE NNEGC"Energoatom" to the Lenders. Its disclosure is not required and is not planned.

Why is the relativeportion of CCSUPmeasures (both initiallyplanned and additionalones), implemented atZNPP and KhNPP,noticeably smaller thanat RNPP and SUNPP?

CCSUP was approved by the resolution of the Cabinet of Ministers of UkraineNo.1270 of 07.12.2011. In 2012 all CCSUP measures were supplemented withadditional measures according to the conclusions of the National Report ofUkraine regarding the results of the target safety reassessment of nuclear facilities,located at NPP sites ("stress tests"), taking into account the lessons of the accidentat the nuclear power plant "Fukushima-Daiichi" in Japan, which happened inMarch 2011. A significant gap from initially planned dates of CCSUPimplementation (before the end of 2017) happened due to a limited tariff anddelays in obtaining EBRD/Euratom loan. It resulted in the shifting of CCSUPCompletion Date for the end of 2020, which was approved by the Cabinet ofMinisters resolution № 766 dated 30.09.2015. Under the conditions of a shortageof funding resources during 2011-2015, the priority was given to urgent measuresat all NPPs and to safety upgrade measures of the earliest power units - RNPP-1,2, SUNPP-1,2. That is why there was a slight lag for ZNPP and KhNPP. In 2016the financing of CCSUP implementation significantly improved through theinclusion of appropriate expenses in the tariff for SE NNEGC "Energoatom" andthe use of loan funds. Besides it should be noted that a simple comparison of thenumber of completed measures is not totally correct due to a significant differencebetween their cost, conditions and duration of their implementation.

Why are the "post-Fukushima" CCSUPmeasures implementednoticeably slower thanthe initially plannedones?

CCSUP was approved by the resolution of the Cabinet of Ministers of UkraineNo.1270 of 07.12.2011. In accordance with the "Adjusted Investment Program of SE NNEGC"Energoatom" for 2016", approved on 22.07.2016, the planned costs for CCSUPimplementation amount to approx. 4,137 billion UAH, which includes: with ownfunds of the Company - approx.1,967 billion UAH, with proceeds of theEBRD/Euratom loan - approx. 2,170 billion UAH. In line with the "Mid-termInvestment Program of SE NNEGC "Energoatom" for 2016-2020", the expenses,

Does SE NNEGC"Energoatom" performtariff calculationsnecessary to cover allexpenses?

Yes, it does. Calculations of tariffs for electric energy and heat energy, generatedby NPPs, are performed by SE NNEGC "Energoatom" and submitted to NEURCas supporting materials for its approval of relevant tariffs in accordance with therequirements of the current legislation.

What is the status ofCCSUP measuresimplementation inassurance of theemergency power supplyin case of long termblackout of NPPs?

At power units SUNPP-1,2 these measures were completed in 2013 and in 2015;at other units of all NPPs their completion is scheduled before the end of 2017. (inparticular, at ZNPP-1,2 in 2016 a non-stationary connection of mobile diesel-generators was carried out). The financing of these measures is carried outexclusively at the expense of own funds of SE NNEGC "Energoatom". The use ofloan funds is not envisaged by loan agreements.

According to the Non-Technical Summary"Implementation ofComplex (Consolidated)Safety Upgrade Programof Power Units ofNuclear Power Plants in2nd quarter 2016" [88],as of 30.06.2016, 616CCSUP measures out of1275 have beencompleted. Does it meanthat nearly half of theProgram has beencompleted?

Unfortunately, not. A simple comparison of the number of completed and plannedmeasures is not demonstrative due to a significant difference of their cost,conditions and duration of their implementation. Due to the limited tariff and thedelay in obtaining EBRD/Euratom loans during 2011-2015, the priority was givento urgent measures at all NPPs and to safety upgrade measures of the earliestpower units - RNPP-1,2, SUNPP-1,2. At the same time the implementation of themost expensive measures at other power units was postponed due to lack of funds.In 2016 the financing of CCSUP implementation significantly improved throughthe inclusion of appropriate expenses in the tariff for SE NNEGC "Energoatom"and the use of loan funds.

Is any public meetingregarding the scope ofCCSUP EA planned inKyiv?

On 24.06.2016 a briefing for media and other stakeholders was held in Kyiv [89].Meetings with the public and other stakeholders regarding the scope of the nextCCSUP EA have been planned and have taken place in NPP satellite towns. Inline with the SEP, according to the results of the next CCSUP EA, public meetingsfor their discussion are planned both in NPP satellite towns and in Kyiv.

What were the mainfindings andrecommendations of thefirst CCSUP EA?

The main findings and recommendations of the first CCSUP EA are provided inthe document "Environmental Assessment Report. Main Report. Complex(consolidated) Safety Upgrade Program of Power Units of Nuclear Power Plants:Environmental Assessment", section 9, page 3, which was published and isavailable on the official web-site of SE NNEGC "Energoatom". All therecommendations of the report are reflected in CCSUP ESAP, which is beingimplemented by the Company.

During 2nd quarter 2016the bank accounts of SE"NNEGC "Energoatom"were blocked accordingto the court decision.How were CCSUPmeasures implementedin these conditions?

Loan funds of EBRD/Euratom are used solely for the procurement of a part of theequipment required for CCSUP measures implementation. Proceeds of the EBRDloan are not received on SE NNEGC "Energoatom" account, but are transferreddirectly to suppliers. As for the proceeds of the Euratom loan, the Companyopened a special account, on which a moratorium was imposed regarding itsblocking until the end of the Project. Therefore there were no problems with usingloan funds. Supply of another part of the equipment, as well as construction,erection, and start-up and adjustment works are financed with own funds of theCompany. Blocking of the accounts temporarily complicated this activity during2nd quarter 2016, On 08.07.2016 the decision on accounts blocking was revoked.

"The structure of the section "Social Environment Impact Assessment" of theCCSUP EA Report is defined by the document SOU NAEK 004:2011"Environmental Assessment of Power Units of Nuclear Power Plants. GeneralRequirements to the Scope and Content of the Assessment Materials", which waspublished and is available on the official web-site of SE NNEGC "Energoatom".The following sections shall be prepared separately for each NPP and shouldcontain the following sub-sections:- Summary of the current situation within the control area (gender and age scheme,

employment, migration, population, morbidity and needs);- Forecast of impacts on health of population in case of refusing from CCSUP

implementation (under normal conditions and in case of accidents at NPPs);- Impact of CCSUP measures on the results of the forecast regarding the health of

population;- Possible impacts from CCSUP implementation on social conditions of life and

meeting the needs of the local people.Is the Report on the nextCCSUP EA subject toapproval by localauthorities and/or self-governing authorities?

No, it's not. Only informing and consultations regarding the venue and the formof holding the public discussions of the CCSUP EA results are foreseen.

How is the EIA for theearliest nuclear powerunits performed, since,according to therequirements of theEspoo Convention, it isone of the conditions oftheir lifetime extension?

This issue goes beyond CCSUP and CCSUP EA, but relevant aspects of theactivity are included in CCSUP ESAP. The 6th Meeting of the Espoo Conventionparties took a decision that Ukraine had not met the requirements of theConvention for power units RNPP-1,2. According to this, SE NNEGC"Energoatom" planned to carry out the EIA for these units together with anotherre-evaluation of their safety (before 2020). The term of validity of previouslicenses for these units was limited by a specific date that corresponded to a 30-year-term of their operation. Regarding other units of the operating NPPs, thevalidity of their licenses is limited until the beginning of the next stage of their lifecycle - decommissioning. As of the end of 2nd quarter 2016, the nationallegislation regarding EIA has not been finally brought into compliance with theprovisions of the Espoo Convention provisions. Due to the uncertainty of theseissues at the legislative level, in 2015 SE NNEGC "Energoatom" on its owninitiative performed EIA and constituted drafts of the relevant reports for ZNPPand SUNPP (for all units in operation at the sites). Environmental expertize ofthese reports is ongoing as of the end of 2nd quarter 2016. Decision about thenecessity of transboundary consultations will be taken based on the findings of theenvironmental expertize.

The order and the procedures for the stakeholder engagement is defined in CCSUPSEP, which was published and is available on the official web-site of SE NNEGC"Energoatom". In particular, questions, remarks and comments can be submittedby mail, fax, e-mail or given personally to the information centers of the StateEnterprise "NNEGC "Energoatom", as well as expressed orally or in a writtenform during public meetings in Kyiv and in NPP satellite-towns.

"Energoatom" in social networks;- Information messages, themed programs, interviews and broadcast on local,

regional and national TV and radio channels;- Publication of information messages, themed articles and interviews in printed

media; - Updated information messages on telephone answering machines;- Emailing of information messages and materials;- Mailing of printed copies of information materials under stakeholders' requests,

in cases and in accordance with the procedure established by the legislation;- Distribution of information messages and materials through the External

Information Communication Center of SE NNEGC "Energoatom" andInformation Centers of 4 NPPs;

- Distribution of information messages and materials through other non-electronicinformation channels.

In general, both the list of channels and the volumes of the distributed informationregarding CCSUP and CCSUP ESAP implementation are in compliance with thebest international practice and are considered sufficient.

With the purpose of thedeeper cyclic use of thetechnical water and inorder to increase thelevel of waste watertreatment, it is proposedto carry out water intakefor RNPP needs of fromthe river Stirdownstream the wasteoutflow of RNPP.

Indeed, the waste water from the industrial storm water discharge system of RNPPgoes to the river Stir through one outflow, which is located 30 m downstream thewater intake. This water is formed, in particular, through a blowdown ofcirculating systems, the necessity whereof is determined by the impossibility offurther cyclic use of technical water due to its increased mineralization. Thereforethe suggested resolution would be senseless. Herewith it should be noted that thecontent of chemical substances in the waste water is constantly monitored anddoes not exceed the permissible concentration, and the constant monitoring of thewater indicators in the river Stir upstream and downstream the NPP confirms theslighting impact of the return water on the quality of the river water.

Public hearingsregarding the lifetimeextension of operatingUkrainian NPPs showeda negative public attitudeto this issue.

This issue goes beyond CCSUP and CCSUP EA, but relevant aspects of theactivity are included in CCSUP ESAP. The above statement does not reflect thereality, because during public discussions both negative and positive or neutralattitude was expressed. In addition, the subject of these discussions, in particularof public hearings, was the completeness and accuracy of the safety validation ofthe power units future operation, and not the personal perception or rejection ofsuch activity.

How much will thescope of the nextCCSUP EA differ fromthe first EA, carried outin 2011, in particular,due to changes oflegislation?

Similarly to the first CCSUP EA, the scope of the next EA will be defined inaccordance with the document SOU NAEK 004:2011 "EnvironmentalAssessment of Power Units of Nuclear Power Plants. General Requirements to theScope and Content of the Assessment Materials", which was published and isavailable on the official web-site of SE NNEGC "Energoatom". The next EA takesinto account the changes that have taken place during 2011-2016, in particular:- in the national legislation;- in the scheduled lifetime of power units operation, where CCSUP will beimplemented;- in the list of measures and terms of CCSUP implementation, and also in thescopes of the actually completed works under the Program;- in the state of the environment and procedures of its monitoring.In particular, changes in the legislation took place in terms of financial andeconomic aspects of CCSUP implementation, the volumes of control andadmissible levels of the impact on the environment, frequency and forms of therespective reporting, etc.

Is SE NNEGC "Energo-atom" getting readyalready now for thefuture SNF managementafter the termination ofits long-term storage inthe plant storage facilityof ZNPP?
