Executive Summary

Joose Environmental Consulting Inc. (Joose Environmental) and DE Jardine Consulting (DE

Jardine) were contracted by Maritime Select Lobster Inc. to complete an Environmental Impact

Statement for the purposed Lobster Holding Facility to be located Northport Harbour, Northport,

PEI

Maritime Select Lobster Inc. is proposing to construct a new lobster holding facility at Northport

Harbour, Northport, Prince County, PEI to store live lobster for several months prior to shipping

to market for fresh sales to enable them to sell lobsters on a year round basis.

The subject site is located on a select lot at 286 Northport Shore Road (Route No. 152),

Northport, Prince County, PEI and is identified as Parcel Nos.428847 and 526905 (refer to

Figure No. 1 and Drawing No. 1, Appendix A). The property is owned by the Government of

Canada and is operated by the Harbour Authority of Northport. The site is located on a

commercial fishing wharf in the community of Northport located south of the Town of Alberton.

The proposed project includes a new structure that will be connected to the current existing

building located on the designated lot.

The EIA for the proposed project was completed as per Section 9 of the PEI Environmental

Protection Act. The EIA evaluated the potential environmental effects of the proposed project

taking into consideration all activities required for the construction, operation and maintenance

of the facility.

As part of the EIS the following mitigation and environmental monitoring elements will be

adhered to during the construction and operation of the proposed facility, including:

• During construction and operation (including accidents, potential malfunctions and

unplanned events) all municipal, provincial and federal codes, standards and best

management practices will be followed; and

• During operation mitigation for non-hazardous waste will be conducted as outlined in

Table 3.1 in Section 3.2.9 of this report.

Environmental Monitoring

• During the construction period the construction manager will conduct regular

environmental monitoring site inspections to ensure all construction components (i.e., silt

fencing, erosion control, etc.) adhere to all municipal, provincial and federal regulations

and codes; and

• Monitoring of the effluent being discharged into the outfall pipe into Northport Harbour

including samples being collected and analyzed for parameters required by the owners

of the utility and the PEI Department of Communities, Land and Environment (PEIDCLE)

a minimum of two times per year (peak and low production periods).

Based on the information obtained during the completion of the EIA, it can be concluded that the

potential environmental effects of the proposed project on all valued environmental components

(VECs - listed in Section 6 of this report) would not be significant during the construction,

operation and maintenance of the proposed facility with the planned mitigation and monitoring

elements in place. Consequently, it is recommended that the proposed project should proceed

as described and outlined in this report.

Section 8.0, and are to be read in conjunction with the remainder of this report.

1.0 INTRODUCTION

Joose Environmental Consulting Inc. (Joose Environmental) and DE Jardine Consulting (DE

Jardine) were contracted by the Maritime Select Lobster Inc. to complete an Environmental

Impact Statement (EIS) for a proposed lobster storage facility to be constructed at the Northport

Harbour, PEI.

1.1 Project Name, Proponent Information and Authors of EIS

Information regarding the project name, proponent and authors of the EIS is provided in Table

1-1.

1.2 Project Information

1.2.1 Project Overview

The Maritime Select Lobster Inc. is proposing to construct a new lobster holding facility on a lot

at the Northport Harbour Wharf property located in within the municipality of Northport, Prince

County, PEI. The proposed facility is being developed to hold lobster in a dormant state for

several months in order to extend the season on a year-round basis.

1.2.2 Current Site Description, Historical and Adjacent Land Use

The subject site is located at Northport, Prince County, PEI and is identified as lot on Parcel No.

428847 and 526905 (refer to Figure No. 1 and Drawing No. 1 Appendix A). The site is located

on an active commercial fishing wharf operated by the Harbour Authority of Northport. The

property is owned by the Government of Canada. Based on historical aerial photographs for the

area it appears that the commercial Northport wharf was established by the early 1950s with

increased development of commercial structures and wharf improvements over the years to its

current configuration.

The Municipality of Northport doesn’t have a zoning plan with planning services provided by

Inspection Services branch of the PEI Department of Community Lands and Environment

(PEIDCLE). Based on the location and Federal ownership there is no zoning requirements in

effect for this property.

The proposed site is located on developed land which currently consists of paved access to the

existing building and wharf area used for fishery related activities.

Adjacent and surrounding land use to the proposed project site is summarized in Table 1-2.

1.3 Regulatory Framework

The EIS for the proposed project has been conducted based on the regulatory framework

outlined in Section 9 of the PEI Environmental Protection Act (EPA).

Section 9 of the PEI EPA sets out the requirements of the environmental assessment process

that the proponent of an undertaking must complete before a project can proceed. The term

“undertaking” as outlined in the PEI EPA includes any construction, industry, operation or other

project which will or may:

i. cause the emission or discharge of any contaminant into the environment;

ii. have an effect on any unique, rare or endangered feature or the environment;

iii. have a significant effect on the environment or necessitate further development

which is likely to have a significant effect on the environment; or

iv. cause public concern because of its real or perceived effect or potential effect

on the environment.

As stated in the subsections of Section 9 in the PEI EPA, the process must adhere to the

following:

(1) No person shall initiate any undertaking unless that person first files a written

proposal with the Department and obtains from the Minister written approval to

proceed with the proposed undertaking.

(2) The minister, in considering a proposal submitted pursuant to subsection (1),

may

- require the person submitting it to supply such additional information as

the Minister may require;

- require that person to carry out an environmental impact assessment

and submit an environmental impact statement;

- notify the public of the proposal and provide opportunity for comment.

(3) An environmental assessment and environmental impact statement shall/have

such content as the Minister may direct.

(4) The approval required by this section is in addition to any other requirements

imposed by the province or a municipality.

As part of the process, the environmental impact assessment (EIA) and corresponding EIS must

be completed and submitted to the Technical Review Committee (comprised of provincial

regulatory agencies and potentially federal regulatory agencies) for review of the proposed

project. At the end of the EIA process, a determination on the proposed project approval would

be made (i.e., not approved, approved or approved with conditions). Should the EIS be

approved, the Minister of the PEI Department of Communities, Land and Environment

(PEIDCLE) issues a written approval pursuant to Section 28 of the PEI EPA.

1.4 Regulations and Statutes for Assessing the Project

An outline of the environmental legislation, approvals and guidelines that may be applicable to

the proposed project is provided in Table 1-3.

2.0 PROJECT DESCRIPTION

The proposed project is the construction of a lobster holding facility that would be used to store

live lobster in a dormant state for several months prior to shipment for commercial sale to the

fresh markets during the lobster fishing off-season.

2.1 Project Background

Maritime Select Lobster Inc. has been in the sale of live lobsters since 1979 when it ran under

the name of W. Milligan and Sons. It was then incorporated to Milligan Fisheries Ltd. in 1983

and then in the spring of 2016 it was sold to Maritime Select Lobster Inc. The supply of lobster

will be from suppliers and lobster fishermen. Maritime Select Lobster Inc. wishes to extend the

season into off-season markets, to do this a lobster holding facility is required.

2.2 Alternatives to Project (Options Considered)

Alternatives to the project were limited as the proposed facility is basically an expansion of the

existing operation. The new facility will be attached to the existing building. An option to use a

saltwater supply well for the new facility was discussed with a local well driller but the area was

deemed to have a low potential to provide a viable drilled production well with high yield and

salinity. An option to connect to the Town of Alberton municipal sewer system was pursued with

the Town of Alberton and the Northport Development Corporation but approval has not been

received to date.

A review of alternative options for the proposed facility determined that different options were

not acceptable due to various factors including, but not limited to the following:

- Business needed to be adjacent to the existing facility and to the wharf;

- surrounding land use and development;

- availability of saltwater resource; and

- availability of infrastructure (i.e., water, sewer and discharge outfall).

2.3 Project Schedule

The proposed new facility will be completed in a one phase with an anticipated completion date

of October 2016 which will be in time for the Nova Scotia fall lobster season.

An overview of the proposed development is provided on Drawing No. 1, Appendix A.

3.0 PROJECT ACTIVITIES

A description of the project activities for the new facility has been broken down into four main

components including:

• Planning;

• Construction;

• Operation; and

• Decommissioning.

3.1 Planning Component

3.1.1 Property Acquisition

Maritime Select Lobster Inc. has obtained written permission from Small Craft Harbours of DFO

for the subject lot within the Northport Harbour, Northport property for the proposed project. The

Harbour Authority of Northport who operates the Northport Wharf has also granted written

approval for the site.

3.1.2 Project Survey

The subject property had a legal and topographical survey was completed by the Government

of Canada as the site in on Crown owned land. The topographical survey of the subject site will

assist with the layout and design of the proposed facility.

3.2 Construction Component

During the construction component it is expected that the equipment to be used will include, but

is not limited to excavators, bull dozers/earth movers, and tandem dump trucks. During the

construction period the project manager will conduct regular environmental monitoring site

inspections to ensure all construction components adhere to all municipal, provincial and federal

regulations and codes.

3.2.1 Site Preparation

The site preparation will involve removal of asphalt and substrate in the proposed development

area of the site. The top soil and fill materials grubbed from the areas to be developed will be

transported off site by a local excavation contractor. Select borrow and other aggregate fill

materials will be required to build up portions of the subject site during construction of the new

structure.

3.2.2 Site Access

Site access will be within the Northport Harbour, Northport via Northport Harbour. No significant

issues associated with the site access are expected, as the site is located in on an existing

commercial wharf which has a daily flow of trucks and other heavy equipment. As such, no

major impact on existing traffic flow is expected in the area due to daily operations on the site.

3.2.3 Site Structures

The development will include a single structure to be used as a lobster holding facility to be

located within proposed building. The new structure will be attached to the existing building

owned by Maritime Select Lobster Inc. The proposed lobster holding facility will be an ICF

(Insulated Concrete Form) constructed building with steel siding and a concrete floor slab. The

proposed building dimensions are 19.5 m x 27.5 m (64 ft. X 90 ft.) with a 3.7 m x 9.7 m (12 ft. x

32 ft.) attachment. The main building will be a two (2) storey structure with the lobster holding

tanks located on the lower level and the second level used for storage. The new building will

include a pump, mechanical and electrical rooms with associated office(s). A layout of the

proposed lobster holding building is provided on Drawing 2, Appendix A. The new structure

will blend in with other buildings in the area.

3.2.4 Site Services (Water, Sewer and Power)

Potable water will be provided to the proposed facility from the Town of Alberton municipal

system that is already connected to the existing building located on the subject site.

Sanitary sewage will be discharged to a holding tank to be built on the south side of the existing

building. This tank will be pumped out as required and the effluent treated at the City of

Summerside sewage treatment plant located in Summerside, Prince County, PEI. As

alternative Maritime Select Lobster Inc., has requested permission to connect to the Town of

Alberton municipal sanitary system as there is a lift station located approximately 150 m from

the location of the proposed site.

There is a power transmission line to the existing building within the Northport Harbour,

Northport. Power to the facility would be routed from this transmission line by Maritime Electric

Company, Limited. Three phase power will be required for site operations. In the event of a

power outage an on-site generator will be used to supply power to the facility on a temporary

basis.

3.2.5 Saltwater Supply for Lobster Storage

An intake line for saltwater supply will be installed out toward the channel of the Northport

Harbour. This will supply saltwater to the lobster holding facility. It is estimated that a maximum

volume of 680 L/min (150 igpm) will be required for operations. The saltwater intake line will be

installed directly east/northeast of the proposed new structure located on the designated lot.

The intake pipe will extend from the proposed new building along the east/northeast edge of the

existing wharf and extend approximately 120 to 140 m into the Northport Harbour (refer to

Drawing No. 1, Appendix A). The intake pipe will be anchored to the seabed using a concrete

anchoring system with the end of the line having a 25 mm (1inch) screen to filter the saltwater

prior to entering the fiberglass containment unit which will prevent the entry of plant material,

fish and debris. A second 25 mesh screen will be located within the fibreglass containment unit

prior to entering the holding tanks in the facility.

3.2.6 Storm Water Management

Storm water flow in the area being developed will be diverted away from the construction site to

the Northport Harbour. During the construction phase control measures including silt fencing will

be utilized to minimize run-off from the disturbed areas of the subject site and to mitigate any

potential environmental concerns.

Upon completion storm water will be managed in the same manner as prior to the new

development.

3.2.7 Fuel Storage

There will be no bulk fuel storage related to the operation of the facility as the new building will

be not be heated. A fuel storage tank is already in place for the existing building.

A new back-up diesel generator will be located on a concrete pad along the exterior of the site

building. The back-up diesel generator is a single unit with a built in 1,100 L capacity double

walled fuel tank. The back-up diesel generator and associated built in fuel tank will be

manufactured to ULC standards and operated according to the 2015 edition of the National Fire

Protection Association (NFPA) 30 Flammable and Combustible Liquids Code.

3.2.8 Hazardous Materials Storage

No hazardous materials are proposed to be stored on site. It should be noted that there will be

no cleaning chemicals used for the holding tanks and tanks will be scrubbed by manual

methods and rinsed with a pressure washer when necessary.

Entry doors will be kept closed when not in use to prevent entry of insects. There will be daily

examination for signs of rodents. Commercial pest control will be used to control rodents and

insects. Screens will be on any windows to keep insects out. Flying insects will be controlled by

ultraviolet lights if necessary.

3.2.9 Non-Hazardous Materials Storage

Materials stored on site will be those typically involved in the holding and shipping of lobsters.

Solid waste materials generated on site will be disposed as per the requirements of the Waste

Watch program operated by Island Waste Management Corporation.

There are quantities of non-hazardous material which will be stored at the site. A list of these

with suggested mitigation procedures is provided Table 3-1.

In the event of a significant loss the product will be removed immediately to a proper disposal location to avoid any odour issues.

3.3 Operation Component

Site operations are expected to begin in the fall of 2016 upon completion of the building and

installation of the holding tanks and water systems.

3.3.1 Use of Facility

The site will be mainly used by staff of the Maritime Select Lobster Inc. and suppliers/buyers of

live lobster to or from the holding facility. The number of staff at the expanded facility is

expected to increase up to a total of approximately 20 persons which is 15 more than the

current staff compliment of approximately 5 people for the existing operation.

The site will not be accessible to the general public for security and food safety reasons.

3.3.2 Operating Hours

The regular operating hours for the facility when in operation will typically be 7:00 am to 5:00

pm. During peak season trucks delivering and removing lobsters from the facility may operate

outside the regular operating hours during various periods.

3.3.3 Holding Tanks Operation

The general process flow for the live lobster stored on the property will be as shown below.

Lobsters will be delivered starting in October 2016, with a build up to 60,000 at full capacity.

The number of lobsters kept in storage will fluctuate according to availability of supply and

market demand. Lobsters will be sourced locally during the lobster fishing seasons. Lobsters

will be sourced from other Maritime locations as necessary. At the beginning of the season the

long term holding tank and purge tanks will be filled. The purge tank will operate as a flow

through system and hold the lobsters for a period of 72 hours and then transferred to the long

term recirculating holding tank with a 10 to 15 percent flow thru. The lobsters will be rubber

banded (to prevent product damage and employee safety) and stored individually until they are

shipped to market.

3.3.4 Wastewater Management

Sanitary sewage from the facility will be discharged to the new holding tank which will be

installed to the south of the existing building. Maritime Select Lobster Inc. will obtain the

necessary approvals. The quantity and quality of sewage discharged will not significantly impact

the City of Summerside treatment system. The proponents have applied to the Town of Alberton

and the Municipality of Northport about the possibility of connecting to the Town of Alberton

sewage treatment facility which has a lift station within 150 metres of the site.

Water from the lobster purge and long term holding tanks will be discharged into the Northport

Harbour via a discharge line installed directly east/northeast of the proposed new structure and

extend 5 to 10 m into the Northport Harbour (refer to Drawing No. 1, Appendix A). The

discharge pipe will be anchored to the seabed using a concrete anchoring system. A 25 mesh

screen will be placed on the discharge line to prevent any rubber bands that are accidentally

dislodged from entering the waste stream. The proponent has received approval for installation

of these lines from the Northport Harbour Authority and DFO. The effluent quality of the

wastewater being discharged from the facility is expected to be very low in dissolved or

suspended matter as the lobsters are not being fed or treated in any manner. It should be noted

that there will be no cleaning chemicals used for the holding tanks and tanks will be scrubbed by

manual methods and rinsed with a pressure washer when necessary.

3.3.5 Air Quality and Noise

The main air quality issues associated with the new facility would include:

• emissions from vehicles;

• emissions from back-up diesel generator when operational; and

• Vehicles and equipment operating on site will also be expected to meet provincial

vehicle and equipment inspection requirements including emissions from exhaust

systems.

Noise is not expected to be a major issue thus noise measures other than those listed will not

be necessary.

3.3.6 Site Security

Access to the site will be limited to employees and visitors who are conducting business.

Security for the site will be limited to exterior doors having locks and the facility being equipped

with security cameras. Security measures will be implemented as necessary for protection of

the food product (lobsters) stored on site.

3.3.7 Emergency Response and Training

Fire extinguishers will be provided inside all buildings and emergency call numbers for the local

fire department, EMS, RCMP and environmental emergency response will be posted in

prominent locations. The site is located in the Town of Alberton Fire District and a fire hall is

located within 2.0 km of the proposed site. Upon completion of the building the management will

arrange for a tour of the new structure by Fire Department staff to acquaint them with the

building components.

All site staff will be trained in emergency response basics and will be aware of all protocols for

notification in the event of emergency situations.

3.3.8 Litter

Litter is not expected to be a major issue on the site and litter picking will be conducted when

necessary.

3.4 Decommissioning

It is expected the life capacity of the proposed facility will be a minimum of 50 years. At some

point it is understood the proposed facility will be decommissioned at the end of its service life.

It is expected that the decommissioned building materials including concrete foundations would

be removed and disposed of in accordance with the applicable standards, guidelines and

regulations for that period.

4.0 SCOPE OF ENVIRONMENTAL IMPACT ASSESSMENT

The details of the environmental impact assessment including methodology and consultation

process are outlined in the following sections.

4.1 Methodology of Environmental Assessment

An EIA is an important process for reviewing potential environmental effects associated with the

development of proposed projects. In order to enable the review of potential issues, an

understanding and description of the environment where the proposed development will occur,

or have a possible impact on, was developed from the review of existing information available

for the area. The potential positive and negative interactions between the proposed project

activities and the environment were identified. In the event negative interactions were

anticipated and the potential effects were deemed a concern, mitigation methods were put forth

for consideration.

As identified in the PEIDCLE Environmental Impact Assessment Guidelines (Revised January

2010) a complete process is completed in stages as outlined below:

• Stage 1: Describing the proposed project and establishing environmental baseline

conditions for the subject site.

• Stage 2: Determining the potential environmental issues and limits of the EIA in relation

to the proposed project.

• Stage 3: Accessing the potential environmental effects of the project.

• Stage 4: Identifying mitigation measures to remove/minimize potential adverse effects to

the environment.

• Stage 5: Establish environmental monitoring and follow-up programs (if required).

The EIA focuses on the evaluation of Valued Environmental Components (VECs) that are those

aspects of the ecosystem of associated socio-economic systems that are important to the public

and other stakeholders. The VECs for the proposed project were selected based on the

interactions between the proposed project activities and the environmental and known or

perceived public concerns related to social, cultural, economic or aesthetic values. All Phases

of the proposed project are assessed including:

• Construction;

• Operation and Maintenance;

• Accidents or malfunctions; and

• Unplanned events due to weather or other factors.

4.2 Consultation

As part of the consultation process meetings were held with representatives of the PEIDCLE to

discuss the proposed project in order to determine the required scope of the environmental

assessment and the overall level required for the biophysical component of the study. Maritime

Select Lobster Inc. representatives also met with their design consultant and the following

provincial and federal organizations:

• PEI Department of Agriculture and Fisheries;

• PEI Department of Communities, Land and Environment;

• Federal Department of Fisheries and Oceans;

• Innovation PEI; and

• Atlantic Canada Opportunities Agency (ACOA).

The proposed site was visited by the consultant (Joose Environmental and DE Jardine

Consulting) in order to review what current site conditions and operations on the adjacent

properties.

Personnel from Maritime Select Lobster Inc. met with representatives for the Municipality of

Northport to advise them of the proposed project and to receive initial feedback regarding the

proposal.

PEIDCLE is reviewing the proposed facility and will lead any required aboriginal consultation.

Stakeholders and the general public will be invited to participate in the environmental

assessment process of the proposed project. It has been determined, in consultation with

PEIDCLE and Maritime Select Lobster Inc. that a Level I Public Consultation will be required for

the proposed project. The purpose of the public consultation is to inform the residents in the

local area and general public about the proposed project and any potential environmental

issues. Upon submission of the EIS document, Maritime Select Lobster Inc. posted a notice in

the local newspaper to advise the public of the proposed project and provide contact information

for the PEICLE assessment coordinator to provide comments and request additional

information. The EIS was posted on the Government of PEI website (www.gov.pe.ca) along

with other related information regarding the proposed project.

Comments/questions regarding the proposed project were submitted to the PEICLE

assessment coordinator for a period of ten (10) days following the posting of the notice within

the local newspaper. Comments/questions regarding the proposed development obtained from

the public and the technical review committee is outlined in Table B-1 (Appendix B) along with

corresponding answers/responses.

5.0 SUMMARY OF EXISTING ENVIRONMENTAL SETTING

The following sections provide an overview of the existing environmental setting at the subject

site.

5.1 Physical Setting

5.1.1 Surficial Geology

Based on an available surficial geology map, the native surficial soils of the subject site consist

of glacial till deposits, principally comprised of a combination of gravel, sand, silt and clay.

Information obtained for agricultural soils for the area (PEI Department of Agriculture and

Forestry - 1:5,800 mapping and Soils of Prince Edward Island, Prince County - 1:75,000

mapping) indicates that the surficial soil type at the subject site consists of a Kildare (Ki) map

unit. The Ki soils are noted to be sandy and porous resulting in good drainage and permeability

characteristics with the potential for some pockets of imperfectly drained soil near the bedrock

interface.

5.1.2 Bedrock Geology

Geological mapping indicates that the bedrock underlying the site is part of the Upper Paleozoic

- Stepanian/Upper Pennyslvanian - Megacyclic Sequence II as mapped by Van de Poll, 1983.

The Northport Harbour, Northport area is characterized by approximately 5 to 10 m of reddish-

brown, silty sand till overlying sandstone interbedded with conglomerate and mudstone bedrock.

The dominance of conglomerate and coarse-grained sandstones accounts for the high

permeability of this bedrock.

5.1.3 Topography and Regional Drainage

The proposed lobster holding facility is situated within 20 meters of the edge of the wharf at

Northport Harbour. The topography in the nearby area all slopes gently towards the Northport

Harbour. Drainage from the nearby road will also drain into the Northport Harbour.

5.1.4 Surface Water Drainage

Surfaces at the site currently consist primarily of asphaltic surfaces. Surface water at the

subject site is anticipated to drain by overland flow toward the north/northeast into the nearby

Northport Harbour. All surface drainage is expected to flow towards the north/northeast and into

Northport Harbour.

5.2 Surface and Groundwater Resources

The subject site is located within a coastal watershed within 20 metres of the harbour with no

watercourses or wetlands on the proposed site. The subject site is currently supplied potable

water via the Town of Alberton municipal supply which will also supply the proposed new facility.

The proposed lobster holding facility and extraction of saltwater from the harbour followed the

DFO and PEIDCLE regulatory process. The extraction of saltwater from the intake pipe located

near the channel of the harbour is not deemed to have a significant influence on the surface and

groundwater resources in the area.

5.3 Atmospheric Environment

Air quality in the area surrounding the subject site is affected by activities associated with local

traffic, commercial/industrial operations, such as the operation of fishing boats in the harbour,

loading and unloading of fish products into transport vehicles and vehicular traffic to the nearby

tourism establishment. The proposed facility is also located in close proximity to the wharf and

may be subject to typical odours related to the fishery. In general, the air quality in the area

surrounding the proposed project site meets the air quality standards as set out by the PEI EPA

Air Quality Regulations and the proposed plant is not anticipated to produce any significant

odours

The nearest climate station with more than 30 years of record was located at Kildare (Latitude

46° 51’ N, -64° 01’ W), which is located within 5 km of the proposed site. Climate records are

available for this station from 1969 to 2008. Climate normal data is available from Environment

Canada for the 1981 to 2010 time period with Table 5-1 showing the normal values for each

month during this time interval.

• Extreme snow depth: 193 cm recorded on March 3, 1982;

• Maximum hourly wind speed: 69 km/hr recorded on April 9, 1972;

• Average date of last spring frost: May 26th;

• Average date of first fall frost: October 5th; and

• Average length of frost free period: 131 days.

5.4 Terrestrial Environment

No rare or native plant species or endangered wildlife are suspected to be present on the

subject site as the property has been developed and used for commercial fisheries related

activities dating back to at least the early 1950s. All development will be located within the

existing parking and wharf access area which is currently covered by asphalt pavement.

The Species at Risk Registry Public Registry was consulted to identify any species which may

be of concern within 10 km of the area. The Second Atlas of Breeding Birds of the Maritime

Provinces and Ebird.org were also consulted. Table 5-2 provides a summary of the findings

from searches of this information. No issues with any of the species listed on this table are

anticipated from the proposed development.

5.5 Human Environment

Maritime Select Lobster Inc. has received written permission from DFO for the use of the

selected lot on Parcel Nos. 428847 and 526905.

The site has been used in the fishing industry and has had a pavement surface for many years

thus no archaeological issues are anticipated.

6.0 PROJECT INTERACTIONS WITH THE ENVIRONMENT (VECS TABLE)

A qualitative review of the potential interaction that the construction and operation of the

proposed lobster holding facility would have on the specific VECs that are of particular value or

interest to regulatory agencies, the public and other stakeholders are outlined in Table 6.1.

The residual impacts rating for each of the VECs assessed is based on the following

significance:

0 = No residual impacts expected as the environmental effects are not considered

significant.

1= Insignificant - interaction occurs however based on the mitigation in place the

environmental effects are not considered significant.

2= Significant - interaction could result in an environmental effect even with

mitigation in place.

7.0 CONCLUSION AND RECOMMENDATIONS

The EIA for the proposed project was completed as per Section 9 of the PEI EPA. The EIA

evaluated the potential environmental effects of the proposed project taking into consideration

all activities required for the construction, operation and maintenance of the facility. As part of

the EIS the following mitigation and environmental monitoring elements will be adhered to

during the construction and operation of the proposed facility, including:

Mitigation

• During construction and operation (including accidents, potential malfunctions and

unplanned events) all municipal, provincial and federal codes, standards and best

management practices will be followed; and

• During operation mitigation for hazardous waste and non-hazardous waste will be

conducted as outlined in Tables 3.1 in Section 3.2.9 of this report.

Environmental Monitoring

• During the construction period the construction manager will conduct regular

environmental monitoring site inspections to ensure all construction components (i.e., silt

fencing, erosion control, etc.) adhere to all municipal, provincial and federal regulations

and codes; and

• Monitoring of the effluent being discharged into common outfall line for the Northport

Harbour, Northport including samples being collected and analyzed for parameters

required by the owners of the utility and the PEIDCLE a minimum of two times per year

(peak and low production periods).

Based on the information obtained during the completion of the EIA, it can be concluded that the

potential environmental effects of the proposed project for all VECs would not be significant

during the construction, operation and maintenance of the proposed facility with the planned

mitigation and monitoring elements in place. Consequently, it is recommended that the

proposed project should proceed as described and outlined in this report.

8.0 CLOSURE

1. Question/Comment: Please clarify the operating period of the facility, i.e. the months when lobster will be held.

Answer/Response: The facility will be operational year round - refer to Section 1.2.1 of the EIS report.

2. Question/Comment: Please describe the process for seasonal start-up and shut-down of the facility.

Answer/Response: The facility will be operational year round and not seasonal - refer to Section 1.2.1 of the EIS report.

3. Question/Comment: Please clarify where the lobsters to be held will be obtained (PEI, NS, etc.).

Answer/Response: The lobsters will be obtained throughout the Maritimes depending on the fishing seasons in the various sectors of PEI, NS and NB.

4. Question/Comment: Please confirm that only live lobster will be held in the new facility and that no lobster (or other) processing will take place.

Answer/Response: The proposed facility is a lobster holding only and no processing will be carried out at the subject site.

5. Question/Comment: Page i, Executive Summary "...is identified as Parcel Nos. 428847 and 526905...” Note that it appears that construction will also take place on PID # 111111.

Answer/Response: The construction will occur on the parcels indicated in the Executive Summary.

6. Question/Comment: Section 3.2.5- "...a maximum volume of between 680 L/min (150 IGPM) will be required...” Please clarify the anticipated range of water usage.

Answer/Response: Typo “between” has been removed.

7. Question/Comment: Section 3.2.5 - Please confirm the mesh size of the screen on the intake line.

Answer/Response: The screen size for the end of the intake line in the Northport Harbour will be 25 mm (1 inch). This information has been included in Section 3.2.5 of the EIS report. Please note based on updated information provided by Maritime Select Lobster that the intake line will extend approximately 120 to 140 m into the Northport Harbour (additional details provided in Section 3.2.5 of the EIS report.

8. Question/Comment: Please provide details on any chemicals that will be used to clean/disinfect the facility. The details should include the product name, SOP and describe any requirement for special handling/disposal requirements.

Answer/Response: Maritime Select Lobster has indicated no cleaning chemicals will be used. When required the tanks will be scrubbed by manual methods and rinsed with a pressure washer (information added to Sections 3.2.8 and 3.3.4 of the EIS report).

9. Question/Comment: Please be advised that the location of the proposed facility is in an area considered to be of moderate to high risk for coastal flooding caused by global warming.

Answer/Response: An occasional flood during a storm surge should not cause any environmental impacts in the proposed facility.

10. Question/Comment: Please be advised that an Approval to Proceed from the Department of Transportation, Infrastructure and Energy (TIE) is required prior to conducting any work within the Provincial Right-of-Way.

Answer/Response: Maritime Select Lobster will obtain the proper approvals from PEIDTIE.

11. Question/Comment: Please be advised that Mark Sherren, Regional Engineer, TIE, should be contacted (902-888-8273) if asphalt located in the Right-of-Way is disturbed and/or requires repairs as part of the construction.

Answer/Response: Maritime Select Lobster will contact the Mr. Mark Sherren as required prior to construction if the right-of-way is to be disturbed during construction activities.

12. Question/Comment: Please be advised that the backup generator (with built in double walled fuel tank) should be installed and operated according to the 2015 edition of the NFPA 30, Flammable and Combustible Liquids Code and that the storage tank must be ULC approved.

Answer/Response: Maritime Select Lobster will ensure the back-up generator is installed to meet all applicable codes as per federal and provincial regulations (reference included in Section 3.2.7 of the EIS report).

13. Question/Comment: Please clarify the method to be used in handling sanitary waste. Please be advised that a connection to the Town of Alberton's system may require approval from the Department of Communities, Land and Environment (DCLE). Also be advised that the use of a holding tank for temporary storage is required to meet the Sewage Disposal System Regulations and that disposal must occur at a wastewater treatment facility that has adequate capacity to accept the material.

Answer/Response: Refer to Section 3.2.4 of the EIS report - Maritime Select Lobster will ensure the all applicable provincial permits/approvals will be obtained (refer to Section 1.4 of EIS report).

14. Question/Comment: Please clarify the source of the domestic water supply. If connected to a municipal system, the proponent should make the operators aware of the expansion plans.

Answer/Response: Domestic water will be supplied to the subject site by the Town of Alberton municipal supply that is already connected to the existing facility located on the property. The reference indicated that the supply would be provided by an existing potable well located on the property in Section 5.2 of the EIS report has been removed and the above noted information has been added to Section 3.2.4 of the EIS report.

15. Question/Comment: Section 3.2.5 - The salt water intake line extends from the building only a short distance (...3 to 5 m...") into the harbour. The applicant should follow existing regulations, standards, guidelines and accepted good practices for locating the intake line.

Answer/Response: Maritime Select Lobster will ensure that the salt water intake line meets all applicable federal and provincial standards and guidelines.

16. Question/Comment: Please be advised that a Watercourse, Wetland and Buffer Zone Activity Permit is required from the DCLE for any construction work (including placement of any water lines) that will take place within 15 m of the waters off the harbour.

Answer/Response: Maritime Select Lobster will obtain the applicable approvals and permits (refer to Section 1.4). Please note based on updated information from Maritime Select Lobster the intake line will now extend approximately 120 to 140 m into Northport Harbour and they will have their own discharge line that will extend approximately 5 to 10 m into the Northport Harbour. Both DFO and the local Harbour Authority have approved the intake and discharge lines for the facility.
