    SECTION 1

    PRELIMINARY CLAUSES -" PART 1

    1.01 TYPE OF CONTRACT

    The contract shall be for a lump sum including any money prov~s~ons specified (See Condition No. 39 of the General Conditions of Contract).

    l.02 ALTERNATIVE PROPOSALS

    A Tenderer may offer, as alternatives, his or other standard equip-ment, plant or mate~ials, even though it may not comply completely with the Specification, SUT IN SUC~ CASES THE TENDERER SHOULD ALSO SUBMIT A TENDER COMPLYING COMPLETELY WITH THE SPECIFICATION, If an alternative is offered the Tenderer shall describe the equipment, plant or material which he is offering and fully and clearly state ho~w it differs r-rom that speci-fied. Any such alternatives will be considered on their merits as to suitability, quality and price.

    L.03 VARIATIONS IN WAGE ~~TES .~u ~~TERIALS COSTS

    The contract price shall be subject to rise and fall adjustments in labour and materials in accordance with Conditions No.1 and 2 of the Special Conditions of Contract annexed to the General Conditions of Con-t rac t ..

    1.04 LOCALITY

    The si te of the ',.;orks is on and adjacent to the Darwin River approxi-mately 45 miles by road south of Darwin, in the Northern Territory as shown on the Drawings.

    1.05 SURVEYS .~D SETTING OUT

    The Director of Works will establish necessary datum lines and the positions and reduced Levels of suitsbly located refe~ence bench marks to enable the Cont=actor to set out the works.

    1.06 EXISTING STRUCTuKES OR SERVICES

    (1) During the period of operation of the North Australia Railway in the vicini ty of the dams i te, the Con trac tor shall carry ou this ac ti vi-ties in accordance with clause 20.01 so as not to da~age o~ interfere with the operation of the ~ailway or telegraph lines.

    (2) The Contractor shall ~ai~tain the existing water supply to the c3u;.ping area un::il an alternative supply is provided in aeco:-dance i,.;ith clause 1. 20.

    (3) Any connection, disconnection or interference with services shall be done only under the supervision of a representative of the Di ree tor 0 f Works.

    1.07 EXTENT OF WORK

    The work to be carried out under the contract includes the following:

    (a) Preparation of foundations for and construction of an earthfill dam approximately 100 feet high and 1,900 feet long at crest level. The dam will contain approxi-mately 350,000 cubic yards of fill, including some zones of rockfill.

    (b) Construction of an outlet works consisting of a re-inforced concrete intake tower approximately 90 feet high and twin outlet conduits and associated gates, crane and mecalwork.

    (c) Construction of a steel girder and concrete slab footbridge to the outlet works tower.

    (d) Installation of approximately 1,800 feet of 60-inch diameter steel pipeline from the outlet conduit.

    (e) Excavation for an unlined spillway channel approxi-mately 100 feet wide and 700 feet long and construction in concrete of a control crest.

    (f) Dismantling and removal to storage of approximately one mile of railway track, including bridge girders.

    (g) Construction of minor works such as access road, parking areas, site amenities and beautification (landscaping).

    1.08 ESTIMATED QU&~TITIES OF CERTAIN ITEMS

    (1) The estimated quantities for certain items of work have been divided into two parts, (a) and (b): Each part has been listed separately for payment purposes only, and for all other purposes shall be considered as one item of work.

    (2) (a) The Contractor shall include in the unit price tendered for Part (a) of an item all overhead costs associated with the provision of labour, materials and equipment for all of the work covered by Part (a) and Part (b) of an item and the direct cost of performing a unit quantity of the estimated amount of work shown in the Schedule for Part (a).

    (b) The Contractor shall include in the unit price tendered for Part (b) of an item only the incremental cost of performing a unit quantity of the estimated amount of work show~ in the Schedule for Part (b).

    (3) (a) Should the actual quantity of work performed under the item be less than the estimated quantity show~ in the Schedule for Part (a) of an item, the Contractor will

    be paid at the rate tende~ed in the Schedule for Part (a) and will be entitled to recover that portion of the irreducible fixed costs included in the unit rate for Part (a) which would not otherwise be re-covered.

    Should the actual quantity of work be in excess of that show~ for Part (a), the Contractor will be oaid the total amount tendered for Part (a) and for that D~rtion of the work actually performed under Part (b); b~t shall not be entitled to any allowance or additional compensation above the unit prices tendered in the Schedule for the i tem~

    (4) For che purposes of those items which are divided into two parts, payment will be made for the actual quantities completed in accord-ance with this Specification and the requirements of General Condition No. 39 will not apply, with respect to lump sum payments.

    (2) Other Drawings and details suppLied during the currency of the contract shall form part of the contract.

    (3) The Contractor shall keep at least one copy of each reLevant DraWing, specification and instruction at the site of the works, available for inspection by any authorised representative of the Direc:or of Works.

    1.10 RECORDS ~~~ REPORTS FOR INFOfu~TION

    The following reports are made available for information and shall not form part of the contract:

    (a) Report on Geology and Sources of Construction M~terials

    (0) Report on Hydrology and Meteorology

    See also clauses 1.40 and 1.41.

    1.11 SCHEDULE OF QUANTITIES

    See General Condition No~ 39 and note the following:

    (1) A fully priced Schedule of Quantities with all rates and ex-tensions show~ and the total ip- agreement with the amount of the tender shall be lodged with the tender and be approved by the Director of Works as to rates before the tender is accepted.

    (2) ATIy tender in which the Schedule is not completed may be re-garded as inforDal and be rejected,

    (3) If a Tenderer notices any mistake in the Schedule of Quantities supplied to him, h~ shall draw attention to the mistake in his tender Letter to the Director of Works, but the tender price shall be based on the Schedule as it exists and no~ on an amended Schedule.

    1,12 TECHNICAL INFORMATION TO ACCOMPANY TENDER

    (1) Note that additional copies of Schedules Band C are attached and shall be completed, attached to L~e tender and shall consti~ute pa~t of the tender~ The completed Schedules of Technical Data will be used by the Department to assess the merits of tenders received,and the fact that the Schedules of the successful Tenderer will become part of the Contract Documents will not absolve the Contractor from complying with the guaran-tee and performance ~rovisions of this Specificationo

    (2) The Contractor shall submit with his tender a list of spare equipmen~ which he recommends for the gantry crane ip accordance with clause 4.20 of Specification No. MH-I.

    (3) Tenders wherein the Schedules of Technical Data are not properly completed may be rejected.

    (4) Tenderers must, in addition to information called for in these Schedules, supply a specification, together with illustrations and Drawings necessary to fully describe the offer.

    (5) The successful Tenderer will be required to submit guaranteed equipment rating and selection tables which will be used to establish guaranteed plant capacities if tests cannot be carried out under design cond i tions

    (6) All technical information supplied by the successful Tenderer will become part of the Contract Documents and two additional sets shall be supplied to the Director of Works upon request for this purpose.

    1.l3 TIME FOR COMPLETION fu~ LIQUIDATED DAMAGES

    See General Condition No. 30 and note the following:

    (1) The Contractor shall complete the separate parts and the entire works as specified, on or before the following dates:

    (a) By 1 December 1971, all work under the contract to permit the commencement of storage in the reservoir, including:

    (i) construction of the intake tower;

    (ii) installation of trashracks, gates and valves in the intake tower;

    (iii) construction of the access footbridge to the intake tower;

    (iv) construction of the dam embank~ent to crest level; and

    (v) construction of the spillway, including the concrete crest structure~

    (b) By 1 March 1972 all work required under the contract to permit the operation and use of the dam and appurtenant works, including:

    (i) construction of the steel pipeline from the outlet conduit; and

    (ii) construction of access road, crest roadway and parking areas.

    (c) By 1 ~~y 1972, all of the works, exclusive of maintenance, required under the contract,,_ including:

    (i) disrnantling and remova.l of the Contractorfs plant and facilities; and

    (ii) clean-up of the works area.

    (2) Should the Contractor fail to complete the separable parts of the work or the entire works described in this clause by the dates speci-fied herein or such other date or dates as may be fixed under the con-tract, the Contractor shall pay the Corrmonwealth as fixed, agreed and liquidated damages in accordance with General Condition No~ 30 the sums shown below for every week of delay for each separable part of the work and the entire works as the case may be until the works aTe completed.

    (a) The sure of one thousand five hundred and seventy-five dollars ($1575) for every week of delay in completing all of the work described ip. sub-clause (1) (a) of this clause"

    (b) The sum of four hundred and fifty-five dollars ($455) for every week of delay in co~pleting all of the work des-cribed in sub-clause (l)(b) of this clause.

    (c) The sum of seventy dollars (570) for every week of delay in completing all of the work described in sub-clause (l)(c) of this clause.

    (3) The above program shall not relieve the Contractor of any of his duties and responsibilities ur-der the contract and the Director of Works mav take into consideration the comoletion times of various Darts , . . of the work, in determining, in accordance with General Condition NOG 31, whether the works are being carried out at a rate of progress or in a manner strictly in accordance with the contract.

    (4) In the event of the time for completion of the entire works being extended pursuant to General Condition No, 35, the time and per-formance scheduLe ~ay be varied by the Director of Works in such a manner as he way determine, having regard to the ti~e for which the completion or the entire works is extended.

    1.14 CONSTRUCTION PROGRESS PL&~NING AND REVIEW

    (1) Each TendeLer shall submit with his tender a preliminary time and performance schedule showing the order of work and periods for accomp-lishing the various parts of the work within the specified tiU2 or times in the event of the tender being successful. This schedule shall be in the form of a preLiminary Critical Path Methods Network AnaLysis~

    In arranging his construction schedule for the orderly comple-tion of the work, the Contractor shall make allowance for the following!

    (a) the North Australia Railway line and the telegraph line through the site of the works will be in operation at least until 1 February 1971 and complete access to the site of the works and permission to dismantle these facilities might not be given to the Contractor until 1 March 1971;

    (b) delivery of the steel liners for the outlet conduits will not be made before 1 November 1970;

    (c) delivery of the pipe sections for the steel pipeline from the outlet conduit will not be made before 1 April 1971.

    (2) Information submitted with the schedule shall include the number of working days per week and the number of statutory and other planned holidays on which the schedule is based. The schedule shall also show the dates on which material to be supplied by the Commonwealth is required.

    (3) For the purposes only of preparing the schedule the Tenderer shall assume that he will be given Notice to Proceed with the works on 1 August 1970.

    (4) Within twenty-eight (28) calendar days of the date of notifi-cation of acceptance of his tender, the Contractor shall prepare and sub-mit for approval by the Director of Works a detailed construction program in the form of an Operational Network and Analysis in accordance with the attached Standard Specification for Critical Path Methods for Plar.ning and Review of Construction P~ogress6

    The approved Operational Network and Print-outs shall be used by the Contractor for purposes of detailed control of the works.

    The Network and ~alysis shall be up-dated every twenty-eight (28) calendar days. If the critical path has changed, or if it has been necessary to alter the logic of the network, then the revised Operational Network and Print-outs of the Analysis shall be submitted for the approval of the Director of Works.

    The current approved Operational Network and Print-outs shall be made available for inspection at any time on demand by the Director of Works.

    Should the Director of Works consider that any network or analysis is unsatisfactory, the Contractor shall provide an amended net-work or analysis within seven (7) days of request.

    The Contractor shall report on the progress achieved and future planned progress at fifty-six (56) calendar days after notification of acceptance of the tender and thereafter as at the end of each period of twenty-eight (28) days, such reports to be provided within seven (7) calendar days of the end of each period and to be in accordance with the attached Standard Specification for Critical Path Methods. Two (2) copies of the report shall be provided.

    If the Contractor fails to submit network diagrams, analyses, print-outs and reports when and as required by the foregoing, the Director of Wo~ks may withhold the whole or portion of any progress payment until such time as the Contractor submits the information to the satisfaction of the Director of Works~

    Any application for extension of time claioed under Condition No, 35(1) of the General Conditions of Contract shall be sup?orted by data based on the network diagram and analysis and such data shall be sub~itted by the Contractor within t'",enty-eight (28) calendar days of the cause or occurrence~

    (5) The requiremenc for updating the network and analysis every ewenty-eight (28) calendar days required under sub-clause (4) above, sub-sequent to the initial one t shall be only upon the ~Litte~ request of the Director of Works o

    The Critical Path is the particular sequence of operations in the whole network that comprises the longest time duration through the network.

    (2) Operational Network Diagram

    Each network shall be "activity oriented" and shall meet the following requirements:

    (a) The network shall accurately represent the Contractor's program for carrying out the work.

    (b) The duration of each activity shall have one time estimate, expressed in days, weeks or other time unit, as agreed with the Director of Works.

    (c) In preparing the operational network the Contractor shall ensure that the total resources required for the execution of the work, according to his program, are at all times within the resources which he can provide. He shall also ensure that the requirements of all other parties associated with him in the execution of the work as to the sequence and estimated timeS for their operations are taken fully into account,

    (d) The duration of any operational activity should, as a general rule not exceed thirty (30) days, except in the case of procurement of materials, plant and equipment.

    (e) Each activity is to be represented by a description which will permit its easy identification, by reference to a specific portion of the works (feature, location, equipment, schedule, item, etc.)~

    (i) Activities completed during the period under review.

    (E) Activities scheduled to be completed during the period, but not completed.

    (iii) Any anticipated slippages which will affect the completion date or dates and the remedial action proposed by the Con trac tor.

    1.16 OVERTiME

    (1) The normal working period on Departmental Contracts is a five day week, from Monday to Friday inclusive, from 7.30 a.m. to 4.30 p.m. and excluding gazetted Public Holidays.

    (2) If it is necessary for the Contractor or any Sub-contractor to work on other than ordinary working week days or outside normal working hours, the Contractor shall give due notice of the intention to do so and obtain the prior approval of the Director of Works.

    However, if such work must be undertaken without notice because of an emergency, the circumstances shall be reported to the Director of Works as soon as possible thereafter.

    (3) The additional cost of wages and any other costs caused by overtime or shift work shall be borne in full by the Contractor, except that the Department will not charge for its supervision.

    1.17 MAINTENA.~CE

    See General Condition No. 36 and note the following:

    (1) In respect of electrical and mechanical equipment the mainten-ance period shall be fifty-two (52) weeks after the Director of Works

    L18 PAYMENT FOR "'-"TERIALS, ETC o

    1,19 LIGHT AND POWER

    (1) (a) A limited supply of electric power is available in the vicinity of the works area and the Contractor shalt make all necessary arrangeme~ts with the Northern Territory Administration for use of power from this supply, The amount of power available, the locatio~ of the supply point, the voltage and the rate to be charged for the use of power shall be the subject of negotiation between the Contractor and the supply authori ty.

    (b) It is anticipated that a 66 kV pOI-Ter line to the works area ~ll be brought into service by February 1971 and additional amounts of power may then be made available to the Contractor by the Northern Territory Administration~

    (2) The Contractor shall be responsible for the retic~~ation of the power supply for his OwTI use within the works area, including the instal-lation, operation and maintenance of all overhead lines, cables and sub-stations necEssary for the transmission of electrical energy~ The design of all electrical installations, including fuses and other protection apparatus shall be approved by the supply authority before erection is cornr.tenced~

    (3) (a) All electrical installations carried out by the Contractor shall comply with the general requirements for perQanent and temporary work, as the case may be of AS eCl, Rules for the Electrical Equipment of Buildings, Structures and Premises (known as the "S.AoA, Wiring Rules") Part I - '.iring Methods and Part II - ~..aterials,. The DirectDr of Works shall have the right to inspect the ContractorTs electrical ins talla tions before iui tia 1 energising and a t any other time and any such installation cons~aered to be unsatisfactory shall be varied or amended by and at che expense of the Contracto~.

    (b) All electrical plant and equipment installed by the Contractor shall comply with the most recent relevant Austr~lian or British Standards or such otheiSpecifi-cations as are approved~

    (4) Prior to commencement of erEction of any transmission line, the Contrac!:or shall submit to the Director of Works for approval a plan showing the proposed geographical location of linEs and cables. Line routes shall not encroach on the area shown on the Drawings for alloca-tion to other contrac.tors or the area show-u as required for par t of the works.

    (;) No overhead transmission line erected bv the Contractor shall be dismantl.ed or removed without the Contractor first giving the Common-wealth the option of taking over the line at a recovery value to be agreed. On the completion of the works, the Contractor shall dismantle and remove or otherwise dispose of all th~ Contractoris extensions except those for which the Commonwealth has elected to exercise its option of purchase.

    1.20 WATER

    (1) The water supply for existing camping areas in the vicinity of the damsite i$ obtained by pumping from the Darwin River to an over-head tank dO~15tream of the damsi~e1 in the location shown on the Drawings. The Contractor and other contractors working in the area will be permitted t.o obtain water from the camp supply tank for use in caops established in the vicinity of the damsite.

    (2) (a) The Contractor shall not make any connection to the existing camp water supply system until approval has been given by the Director of Works.

    (b) At least fourteen calendar days before the date proposed for making connections to the camp water supply SYSLEffi, the Contractor shall submit to the Director of Works for approval, the full details of proposed connections and extensions.

    (3) The Contractor shall no!: incerfere with the existing pu~ping facilities or carry out any work in the vicinity of t.he Darwin River whic.h will in any way affect the operation of the pumps or the quality of the water being pumped, until alternative pumping facilitie3 have been pro-vided.

    (4) (a) The Contractor shall install and operaLE a camp water Supply system:, consiscing of a pump and piping to supply water from a bore holE or from the Darwin River at a point up~tream of thE damsite~ to the Existing supply tank downstream of the damsite. The water supply system shall include a chlorinator attached to the line leading to the supply tank.

    . (d) If the water supply i3 to be obtained from the river the pToposals shall include details of river works necessary to maintain the required flow of potable wate~. River works shall include coffer dams to retain water stored in the river channel during dry periods and excavations to release water from pools or temporary storages in the river channel further upstream.

    (e) The proposals shall include details of the chlorinator which shall be designed to control and meter the rate of application of chlorine to the water.

    (f) T~e Contractor shall be responsible for the operation and maintenance of the water supply system, including the application of chlorine at a regular and uniform rate appToved by the Director of Works~

    Ca) The Contractor shall install and operate a separate water supply system to provide water for his ow~ construction requirements~

    (b) Water from the camp supply system shall not be used for construction purposes without the orior approval of the Director of Works~

    (6) At the completion of the contract the Contractor shall remove all connections to the existing camp water supply system, unless other-wise directed by the Director of Works.

    1.21 SANITARY ACCO~~ODATION

    (1) The Contractor shall provide adequate, approved, latrines for the use of workmen employed on the site, keep tidy and disinfected until completion of the works a~d then traces of latrines and disinfect the groundo

    (2) Ca) The Contracto~ will be permitted to make use of the toilets constructed in the recreaction area downstream of the da~, in accordance with clause 22 0 01, until the area is handed over to the Director of Works.

    (b) The Contractor shall be responsible for the upkeep, maintenance and repaiJ' of permanent .. toilet facilities while they are being used by the Contractor's personnel, and until such time as they are accepted by the Director of Works.

    1. 22 TELEPHONE

    (1) A small telephone exchange is to be established in the Depart-ment of Works site office and will be manned during the hours of 8.00 a.m, to 4.21 p,m. by a Department of Works employee at no cost to the Contractor.

    (2) The Contractor shall arrange with the P.M,G. for all services and connections to this exchange.

    (3) In addition to telephone facilities required by the Contractor, the Contractor shall arrange for the installation in the Department of Works site office of a telephone for the sole use of the Director of Works or his appointed officers a

    (4) The Contractor shall pay costs of installation, rental and calls until the completion of the contract.

    1.23 NOTICE BOARD

    Within two weeks of the date of notification of the acceptance of his tender, the Contractor shall provide and erect on site in a position designated by the Director of Works, a Project Notice Board. The size, method of construction and details of lettering shall be in accordance with details shown on the Drawings.

    1.24 SITE CONTROL

    (1) The Contractor and all Sub-contractors shall observe all rules and regulations in force in the area in which the works are to be carried out and shall comply with all notices and instructions issued by the Director of Works.

    (2) No new tracks shall be formed, existing tracks altered, camps erected, fences cut, water, sewerage or power lines cut or any other such thing done without the approval of the Director of Works.

    (3) Under no circumstances whatever shall fires be lighted before permission is obtained from the Director of Works.

    (4) The Commonwealth and its ether contractors shall have the right to use without charge the roads, bridges and other installations which have been confided to the care of the Contractor by the Co~~onwealth or which have been constructed or acquired by the Contractor for the purposes of the contract.

    1.25 EXPLOSIVES

    (1) Where it is necessary to use explosives, explosive powered

    tools or the like, the Contractor and all Sub-contractors shall comply with the requirements of clause 4 0 02 and wi~h all by-laws, regulations, acts and authorities governing their use, and storage, and will be held strictly resoonsible for and shall settle, at his ow~ expense, any claims for damage or injury resulting~

    (2) If the Contractor desires to use explosives, he shall give written notice, seven (7) days in advance, to the Director of Works, who will advise whether any requirements of the Commonwealth decided subse-quent to receipt of tenders necessitate special conditions or precautions in the use of explosives on the works, and who will instruct the Contrac-tor accordingly.

    1.26 SALVAGED MATER~.L

    Except as otherwise provided in clause 20 0 02 for the removal of metalwork fro8 the railway, all materials salvaged from the works, other than that specified to remain on the property of the Director of Works, shall become the property of the Contractor, either for re-use in the work as may be specified, or, if not so re-used, for disposal by the Con-tractor in approved disposal areas.

    1.27 PROTECTION A.~D PROVISION FOR TIl~FIC

    The Contractor shall provide all necessary lights, barriers, flags and the like at all times during the contract period to ensure the safety of all persons, vehicles and animals.

    1.28 CONTRACTOR'S DRAWINGS AND OTHER INFORK~TION

    (1) Shop or detail drawings required by the Specifications shall be submitted by the Contractor to the Director of Works and approval of the Director of Works shall be obtained before the relevant portion of the work is commenced. Five (5) copies of each drawing shall be sub-mitted and the Director of Works, when giving his approval, shall return two (2) copies appropoiately endorsed.

    (2) Approval of any such drawing, whether it is acceDted with or without amendment, shall not relieve the Contractor of the responsibility for compliance with the Specific2tions and for the satisfactory operation of any plant and equipment.

    (3) On completion of the work, the Contractor shall supply to the Director of Works two (2) complete sets of each of:

    (a) Appropriate operating and maintenance instructions

    (b) Wiring diagrams

    (c) Functional diagrams

    for any plant or installation~ Non-provision of any of these may be suf-ficient cause for withholding paj;ment,

    (4) The Contractor shall be responsible for and shall bear the cost of any ahterations to the works arising from discrepancies or errors in or omissions from the drawings or other information issued by him whether such drawings. or other information have been a~proved by the Director of Works or not.

    1.29 REMOVAL OF RUBBISH AND FINAL CLEANING UP

    (1) The Contractor shall ensure that all ground areas, including areas under floors, are finished to uniform grade free of depressions and rubbish and that all backfilling finishes level with graded surfaces un-less otherwise specified.

    (2) The Contractor shall remove from the site from time to time as is necessary or as directed all rubbish and debris resulting from his activi ties.

    (3) On completion the Contractor shall ensure that the premises and/or site are cleaned, surplus materials, tools, sheds, debris and the like are removed so that the whole is left fit for immediate occupation or use.

    1.30 LOADING AND SIZE OF VEHICLES

    (I) The Tenderer's attention is directed to the Northern Territory Control of Roads Ordinance, 1953 and amendments which prescribe limits on axle and wheel loads and on sizes of vehicles using public roads, Any vehicle used by the Contractor for carting or similar operations on exist-ing Northern Territory roads in connection with the work covered by this Specification shall comply with the conditions of the aforesaid Ordinance.

    (2) For the guidance of Tenderers, the loading limits are as set out below for pneumatic tyred vehicles:

    (a) the axle load on any axle of the vehicle must not exceed eighteen thousand (18,000) pounds

    (b) the wheel load on any wheel of the vehicle or trailer must not exceed nine thousand (9,000) pounds

    (c) the load on a tyre of the vehicle or trailer must not exceed five thousand (5,000) pounds

    (d) the pressure in a tyre of the vehicle or trailer must not exceed one hundred (100) pounds per square inch

    (e) the load on a bogie axle of a vehicle or trailer must not exceed thirteen (13) tons,

    1.31 ACCESS TO WORKS

    (1) Road access to the site from Darwin consists of:

    {a) approximately 33 miles of the Stuart Highway, which is sealed and trafficable during wet weather, and

    (b) approximately 12 miles of unsealed gravel road with limited access during wet weather. During the wet season portions of this road might become inundated in the vicinity of l07w level creek crossings.,

    (2) During the period of time covered by the contract, the Co~~onwealth and other contractors will be engaged on other works in the vicinity of the works covered by this Specification. The Contractor shall allow the Director of Works and such other contractors free and unrestricted use of the existing access roads and any additional roads constructed by him in the vicinity of the works.

    (3) (a) Any roads constructed by the Contractor shall be maintained by him in a reasonably trafficable condition during the period of the contract.

    (b) Any damage caused to existing roads by the operations or plant of the Contractor shall be repaired ir.~ediately by the Contractor as directed by the Directo= of Works.

    (4) (a) Railway access to the site is via the North Australia Railway which passes in the vicinity of the damsite, but which will be deviated around the da~site during the period of the contTact~

    (b) The use of the railway for the transport of plant and equipment to the site of the works shall be the subject of negotiation between the Contractor and the Com~onwealth Railways;

    (l) The Contractor shall, at his expense, provide appropriate acco~odation for his workmen or make arrangements satisfactory to the Director of Works for their transport to the site of the works.

    (2) (a) The Contractor shall indicate at the time of tendering the location and type of all camps proposed for ~he use of workmen~

    (b) The Contractor shall, within twenty-eight (28) days of the execution of a fODmal contract submit full details of proposed camps to the Director of Works for approval~

    (3) All camps constructed by the Contractor for use by his workmen shall have electric lighting and shall contain adequate facilities for tOilet, ablution, fire-fighting, laundry, drying and change house purposes. Details of all sewerage facilities proposed by the Contracto.r for instal-lation in camp sites shall be submitted to the Director of Ivorks for approval before construction of the facilities is commenced.

    (4) The cost of electricity supplied to the Contractor's camp accommodation and other facilities will be borne by the Contractor.

    (5) The Contractor shall at all times be responsible for the well-being and discipline of his employees and shall ensure that during the occupation of the accommodation at the site of the works, the camp is maintained in a clean and hygienic condition.

    (6) All camps and camping facilities constructed by the Contractor shall be removed by the Contractor at the completion of the contract and all areas occupied by such camps and facilities shall be restored to their former condition to the approval of the Director of Works.

    1.33 SAFETY

    20

    (1) (a) The Contractor shall at all times exercise all necessary precautions for the safety of his employees, appropriate to the nature of the work and the conditions under which the contract is to be performed, and in compliance with all statutory requirements and such directions as the Director of Works may from time to time consider necessary or desirable.

    (b) Safety precautions as applicable shall include, but not be limited to adequate life protection and lifesaving equipment, adequate illumination for night operations, adequate ventilating equipment for enclosed places, instructions in accident pre-vention for all employees, including, where necessary, care in the use of explosives, adequate traffic con-trol, such machinery guards, safe walkways, scaffolds, ladders, bridges, gang planks and other safety devices, equipment and apparel as are necessary to prevent accidents, injuries or fires, and adequate facilities for the proper inspection and maintenance of all safety measures.

    (c) The Contractor shall require that all persons employed by him on the site sign an undertaking concerning the observance of safety practices, such undertaking to be in a form approved by the Director of Works. Signing of the undertaking shall be a condition of employment. All under-takings signed by employees of the Contractor shall be available for inspection by the Director

    of Works within one week of commencement of employ-ment. Two copies of all safety instructions issued by the Contractor to his employees shall be forwarded to the Director of Works for information.

    (2) (a) The Contractor shall promptly report to the Director of Works in the form to be prescribed, all accidents involving the death or serious injury to staff or workmen.

    (b) Monthly reports of all accidents involving loss of tiine, giving such information as may be prescribed by the Director of Works, shall be promptly submitted by the Contractor~

    (3) The Contractor shall supply to the Director of Works a copy of the code of blasting signals used on the works and shall observe the details of the code in all blasting operations.

    1.34 FIRST-AID ~~~ ~lliDICAL FACILITIES

    The Contractor shall in all respects be fully responsible for ensur-ing necessary first-aid services to his staff and workmen including trans-port for injured personnel to hospital or other appropriate accommodation as and when required~

    1,35 WORKERS' COM~ENSATION INSURk~CE

    (1) Prior to the commencement of any work under the contract, the Contractor shall, at his own expense, effect a satisfactory policy of insurance as set out in this clause, with an insurance company approved by the Director of Works, in favour of the Contractor and the CO~ilonwealth, and shall deposit the policy therefor with the Director of Works, and shall also deposit with the Director of Works the renewal receipt or other evidence that the policy is in full force and effect~

    (2) The ~olicy shall indemnify the Contractor and the Comoonwealth from and against all liability as a contractor and as a principal res-pectively under any and all legislation for the tiill being in force in respect of any accident or' injury to or death of or any ocher liability to workers employed by the Contractor in or about or in connection with the works.

    (3) The Contractor shall indemnify the Commonwealth during the con-tinuance of the contract from and against all liability for the death or injury of any employees of the Contractor not due to the negligence of the Comrnonwealt~ or its agents or servants.

    (~) The Contractor shall ensure that every sub-contract shall contain provisions in respect of employees of the sub-contractor employed in or about or in connection with the works in accordance with this clause~

    1.36 FIRE PREVENTION

    (1) (a) The Contractor shall be responsible for the fire protection of his buildings, plant and equipment in the Works Area and shall take action to prevent the damage to or destruction by fire of forests, trees, shrubs or grasses.

    (b) The Contractor shall assist in the fire protection of the buildings, plant and equipment of the Common-wealth and other contractors by the provision of personnel and fire-fighting equipment.

    (2) (a) The Contractor shall provide and maintain the follow-ing fire-fighting equipment:

    (3)

    (i) Two fixed 2 gallon soda-acid type extinguishers

    (ii ) Two portable 2 gallon soda-acid type extinguishers

    (iii) Two fixed 2 gallon foam type extinguishers

    (iv) Two portable 2 gallon foam type extinguishers

    (v) Four portable knapsack sprays, manually operated

    (b) The positions for fixed equipment will be nominated by the Director of Works and the Contractor shall install the equipment within fourteen days of such nomination. The portable equipment shall be readily available at all times when the Contractor has staff present. The fixed equipment shall be available at all times.

    (e) The Contractor shall maintain the equipment in a condi-tion satisfactory to the Director of Works and shall recharge extinguishers after use, regardless of by whom they were discharged. Stocks of fresh chemical charges shall be kept in readiness on site.

    (d) A minimum of 500 gallons of clean water shall be stored by the Contractor for the recharging of knapsack sprays,

    (e) All fire-fighting equipment provided under this clause shall remain the property of the Contractor and shall be removed by the Contractor when directed by the Director of Works at the completion of the contract.

    (a) The Contractor shall nominate five (5) employees who shall be made available as required by the Director of Works for two hours initial training in fire-fighting duties and subsequently for periods not exceeding one hour each week for fire-fighting drill and servicing of fire-fighting equipment. They shall be available for fire-fighting duties at all times they are on the site ..

    (4) Where there is a ~articular fire hazard at any point in the works, the Cont~actor shall ensure that his employees engaged in the vicinity of such points are properly tLained in the use of the appropriate fire-fighting equipment and that such equipment is at hand.

    (5) The Contractor shall comply with all statutory provisions which may be in force from time to time in relation to bushfire danger or to restrictions on the lighting of fires in the ooen.

    10 37 SOIL CONSERVATION

    ALL proper precautions shaLL be taken by the Contractor to prevent the erosion of soil from any lands used or occupied by the ~ontractor and of the bed or banks of any stream and the deposition of excavated or eroded material in any stream, lake or reservoir that may result from the execution of the works~

    1.38 USE OF FOREIGN ~~TERIALS

    (1) Should the Contractor w~sh to use in the works any ~aterials not of Australian manufacture, he shall first obtain the approval of the Director of Works. In seeking such approval the Contractor shall nomina~e the positions where non-Australian material is to be used and shall state the manufacturer's name and provide a certificate of quality.

    (2) No non-Australian material shall be placed before a~proval is given by the Director of Works.

    (2) The materials furnished by the Commonwealth in accordance with this clause will be delivered to the site of the works and stored in an area nominated by the Director of Works.

    (3) The Contractor shall show in his construction network submitted in accordance with clause 1.14 the logical sequence in which the materials furnished by the Co~~onwealth are required. The dates set out in sub-clause (1) of this clause shall be considered as restraints in the net-work and delivery of the materials earlier than these dates shall not be programmed unless otherwise approved by the Director of Works.

    (4) The Contractor shall:

    (a) except as otherwise specified, be responsible for the proper care and protection of the materials after delivery;

    (b) provide suitable warehouses or other adequate means of protection for such of the materials as require storage or protection, and shall store and care for materials in the most suitable manner to protect them from distortion or other damage, and if it is necessary for their proper protection, shall place the materials on timber blocking furnished by the Contractor.

    (5) The Director of Works reserves the right to direct the Con-tractor to provide the means of ~rotection for materials furnished by the Commonwealth which might reasonably be required for their storage and care; but the exercise of, or failure to exercise, this right shall not be deemed to relieve the Contractor of his primary responsibility for pro-tecting these materials.

    (6) The Contractor shall report to the Director of Works within seventy-two hours after taking delivery, any excess of, shortage in, or damage to materiaLs when delivered.

    (7) The Contractor will be charged for, or required to replace, as hereafter provided in this clause, any material Lost or damaged after delivery.

    (8) The cost of storing, transporting from the storage area, hand-ling and caring for all the materials furnished by the Commonwealth except where otherwise specified shall be included in the prices set out in the Schedule for the work in which the materials are to be used.

    (9) Any materials damaged after delivery to the Contractor which can be repaired satisfactorily as determied by the Director of Works shall be so repaired at the expense of and by the Contractor.

    (10) Where any materials which, after delivery to the Contractor, are lost or damaged beyond repair or are not incorporated in the works and are not returned, the Contractor will be charged:

    (c) The location of all major working areas and all major construction facilities to be erected on site, including workshops, offices and storage areas; materials handling, processing and crush-ing plants; and concrete mixing and batching plants~

    (d) The proposed method of operation of the borrow areas, including facilities for addition of water.

    (e) The proposed method of dewatering the damsite and handling and controlling the flow in the Darwin River during construction.

    1.44 SUB-CONTRACTORS

    (1) The Tenderer shall include with his tender a list of the items of work which he proposes to sub-let, together with a list of the proposed Sub-contractors,

    Where, in this Specification or on the Drawings, trade na~es, brands and/or catalogue numbers are referred to, sole preference to any material or equipment is not intended. The Contractor shall be at liberty to sub-stitute other material or equip~ent provided that t in the opinion of the Di rector of i,Jorks, the charac teris tics of type, qual i ty, appearance, fini sh, method of conscruction and/or perfor.nance are not less than specified and provided also that the approval of the Director of Works is first obtained.

    2.03 CONT~~CTOR'S COMPETENCE AND FIN.~CE

    Tenderers~ where called upon in writing by the Director of Works to do SO~ shall, within seve~ (7) days of recei!?t of such request, submit evidence as -required by the Director of II/orks in regard to their co.o.pet-ence and financial ability to satisfactorily complete the works.

    If a Tendere7 is, in the oDinion of the Director of Works, incapabLe of executing the work of the contract in a satisfactory manner within the specified completion time, or if a Tenderer fails to furnish the evidence required and referred to above, within the stipulated time, then such cir-cumstances either together, or anyone of them, may be the cause for re-jection of the tender.

    2.07 SALES TAX

    Sales Tax is not payable by the Contractor on the purchase of any ~aterials, plant or equipment to be used in, so as to form part of, the completed works of the contract, and Tenderers shall, therefore, exclude sales tax from the tendered prices.

    2.08 PAY-ROLL TAX

    Tenderers shall allow for pay-roll tax.

    2.09 INSURANCE

    See General Condition No. 10.

    (l) Works

    The Contractor shall insure against all risks of loss or dam-age from any cause whatsoever, all constructional plant and equipment on the site; and all materials, plant and equipment to be built into the job which are on the site, but not built in. He shall also insure the com-pleted works against the risks of loss or damage from any cause whatsoever, until the whole of the completed works are handed over to the Director of Works.

    The Contractor shall take out an all risks insurance policy covering life, property and liquidated damages claims due to loss of rail-ways freight time and claims on the Commonwealth Railways arising out of injuries or damage sustained as a result of the Contractor's activities.

    Nothing in this clause shall be interpreted to relieve the Contractor of any liability for loss or damage arising from negligence, default or inefficiency of the Contractor or his employees or Sub-con~ tractors.

    (2) Inspection of Policies

    The insurance policy relating to the operation of the railway shall be presented by the successful tenderer at the time of signing of a formal contract.

    The Contractor shall produce and hand over to the Director of Works whenever required to do so, the policy or policies in respect of any in-surance effected pursuant to the contract and receipts evidencing payment of all premiums necessary to keep such policy or policies in full force and effect.

    2.10 BY-LAWS, FEES &~D NOTICES

    The Contractor is not required to submit building plans to Local or other Authorities nor to pay building permit fees. The Contractor shall pay any other fees due to such Authorities.

    (b) The Director of Works, before acce~ting the product as comply-ing \,iith the Australian Standara, :nay require so:ne or all of the tests set out in the Australian Standard to be done and passed and ma.y require inspectio:l 0': manufacture by his re-~rese:lta;:ive.

    Such acceptance will not cancel any prov1s1on of the Specification that the product meet requirements other than those of the Australian Standard.

    Before acc?cance under (a) above, the Director of Works way require fTom the Contractor a written declaration satisfactory to the Director of ',{orks that the ~roduct. f,.;as ~anuactured during the currency of the rele-vant licence of the Standards Associa~ion of AustraLia.

    2.14 INTERPRETATION OF D~~WINGS

    The Contractor or any Sub-contractor shall check all relevant dim-ensions on site before ~roceeding with the work. Under no circumstances shalL dimensions be scaled from Drawings.

    The layout of plant and equipment as shown on the Drawings shall be taken as diagrammatic only and all measurements and other information required to carry out the works specified shall be obtained by the Con-tractor on the site\:,' No claim for extras arising from failure to obtain measurements and other information on site will be allowed.

    2.15 CONTRACTOR'S REPRESENTATIVE

    See General Condition No. 18 (1)

    Such responsible representative shall have sufficient command of the English language and Australian building and technical terminology to be able to read, converse and receive instructions in English and shall be on the site of the works and available at all times for discussion with the Director of Works when work is being carried out by the Contractor or any Sub-contractor.

    2.16 CO-ORDINATION OF WORK

    At the commencement of work and from time to time, the Contractor shall confer with the Sub-contractors, persons engaged on separate con-tracts in connection with the works and with the Director of Works for the pur~ose of co-ordination and execution of the various phases of the work. The Contractor shall be responsible for arranging that each trade shall attend upon and assist the other trades.

    2.17 CUTTING .~~D MAKING GOOD

    The Contractor shall ascertain from the Sub-contractors and persons engaged on separate contracts in connection with the works, the extent of all cutting and forming of openings, holes, chasings and grooves as may be required to acco~~odate the various services. The Contractor shall ascertain the routes of all services and the positions of all floor out-lets, traps, conduits, pipes and cables in connection with the installat-ion of plant and services and arrange for the const~uction of work accord-ingly. The breaking or cutting of completed work must be avoided where-ever possible. The damage caused in the course of the works shall be made good by the appropriate trades and the surface finished to match adjacent surfaces. All cutting, forming and maK~ng good of openings required for the work shall be the responsibility of the Contractor.

    2.18 DRILLING, CUTTING AND FASTENING

    Drilling, cutting or application of heat to structural or reinforc-ing steel will not be permitted except as expressly mentioned in this Specification or for which approval is given by the Director of Works.

    Reinforced concrete may be cut away or drilled only in positions and to the extent approved by the Director of Works.

    Explosive power fastenings shall not be of greater diameter or have greater penetration than permitted by the" Director of Works.

    Before commencing work on the contract, the Contractor shall ascert-ain what restrictions will apply to the various parts of the works in

    2.19 DAr~GE TO SERVICES

    (L) The Contractor shall contact the Director of works before work commences and check the location of all services. He shall immediately notify the Director of Works in the event of damage to any water, comp-ressed air, electric, drainage, sewerage, tele~hone, fire alarm, control cable or other services in the area~ He shall render any assistance re-quired in connection with any such incident, but otherwise wo~k in that vicinity shaLL be stopped i~~ediately and not recommenced until in5tructions are received from the Director of works.

    (2) ~'ine;::-e r.ne service is indicated in the Drawings and/or in the Specification, or is evident on the site or has been pointed out by the Director of Works the Contractor shall be liable for the cost of any nec-essary re!?airs.

    (3) wnere the Contractor encounters any services, details of which are not given in the Drawings ~~d/or Specification and which are not evid-ent on the site or which have not been pointed out to hi~ and has carried out his o!?erations with reasonable care, the cost of reinstatement, div-ersion or other associated work u~y be paid as an extra to the contr~ct.

    2.20 LABORATORY TESTS

    Tests required by this Specification which must be cione in Laborat-ories will be carried out in the Department:s laboratories, using the nonnal methods of these laboratories~ exce~t when it is stated i~ the Specification that other laboratories or methods shall be used. If the Department ts laboratories are. not able to carry out any such test, that tEst shall be done in a laboratory nominated by the Director of Works~

    Samples for testing shall be taken by persons authorised by the Director of Works exce?t when the S~ecification states that Tenderers or the Contractor shall provide samples. The Contractor or his representat-ive shall have the righ~ to be present ~hen a sample is take~ by a re-presentative of the DepartGlent of Horks and for that purpose he or his authorised representative (see General Condition No. 18) shall be given advance notice, the period in advance being as deter4:lined by the Director of Works having regard to the nature of the material to be sampLed, the situation of the work and other relevant circumstances. Like facilities shall be provided to the Director of Works by the Contractor when a sample is to be provided by him~

    In the case of dispute by the Contractor of acy test result~ he may have a check test don.e at his ow"'TI. expense at an independent laboratory app:-oved by the National Association of Testing Authorities for ::he re-levant type of test. ~~y sampling rOT check test shall be done, either:-

    (a) By a representative of the Director of Works, if so desired by the Contractor; or

    (b) Otherwise, by a representative of the Contractor, using proce-dure approved by the Director of Works and in the presence of a representative of the Director of Works authorised by him to attend such sampling.

    2.21 PRECAUTIONS IN CARRYING OUR WORK

    See General Conditions No. 12 and 26.

    In carrying out the work, the Contractor and Sub-contractors shall comply with all requirements under Acts, Regulations, Ordinances, By-Laws, Orders and Rules and other special requirements of proper Authorities concerning storage, transport and use of materials, plant, equipment~ work processes and safety precautions.

    wnere any current Australian Standards published by the Standards Association of Australia is appropriate to storage, transport and use of materials, plant, equipment, to work processes or to safety precaut-ions the provisions of such Standard shall be observed except if they conflict with any statutory or special requirements of proper authority in which case the latter shall apply.

    In the absence of any such statutory or special requirements or relevant Australian Standard, the Contractor and all Sub-contractors shall ensure that suitable procedures are observed, all proper care is taken and the instructions of the Director of Works carried out.

    2.22 BILLS OF QUANTITIES

    Notwithstanding the prov"s"ons of sub-clause 39 (3) of the General Conditions of Contract, the Contractor shall only be entitled to the benefit of that sub-clause if at the date of his application to the Dir-ector of Works under paragraph 3(c)(i) of clause 39 of the General Con-ditions of Contract the contract as varied by variation orders or other-wise still requires the Contractor to supply the quantity or item to which his claim relates and he has in fact supplied it.
