Qualifying criteria.

A. Party should have done such or similar works during last five (05) years satisfactorily at Wanakbori TPS

or other Thermal Power stations of GSECL, NTPC or other Electricity Board in the later case.

Documentary proof of having executed such or similar orders will have to be produced along with

Technical bid. However, submission of such documentary proof by party will not automatically qualify

the party as to its capability to execute such or similar orders and the Corporation shall assess the

capability of the party at the time of evaluation of the Technical bid.

B. It is necessary for contractor to produce the latest solvency certificate from nationalized bank of 20%

value of estimated cost.

C. It is necessary for contractor to possess separate P.F. Code No. in their name (under Employee

provident fund organization, Regional office, Ahmedabad directive) obtained from the concerned

authorities of their respective jurisdictions. Up-dated copy for the same shall have to be submitted. In the

event of non-possession of the separate PF code number, No tender will be considered.

D. Contractor shall have to submit up date workman Group insurance policy covering all the labour who are

going to work at WTPS site.

E. Contractor shall have to submit up date valid labour license from the Asstt. Labour Commissioner,

Nadiad.

F. Contractor should possesses own service tax number. Document for the same shall have to be

submitted.

G. Contractor shall have to submit copy of PAN card.

H. Contractor shall have to submit list of tools & tackles and men power.

I. For fulfillment of all the Labour laws, liabilities before starting of the contract work, contractor should give

the assurance/indemnity bond on non judicial stamp paper of Rs. 100/- to GSECL, WTPS or as per the

tender amount.

Name of work: On line setting / testing of safety valves in Boiler Stage-II Unit 4,5 & 6 at WTPS. SCOPE OF WORK:

01 Party shall have to mobilize the site within 24 hours after intimation (verbal/on paper) from GSECL.

02 The scope of work envisages online pressure setting of M/s BHEL make spring loaded safety valves i.e. 1740 WD & 1750 WB on super heater and boiler drum respectively in boilers Unit No.4,5 &6 of 210 MW by agency.

03 Job will be required mostly during units overhauling or any breakdown of the units.

04 The agency will report to the site along with necessary/specialized tools and tackles, required for on line pressure setting of safety valves including necessary monitoring equipment like pr.gauge etc.

05 Minimum two personnel having experience in online pressure setting by trevitest will be required. The personnel should be capable enough to Suggest for sorting out of any problem of safety valves during its setting.

06 The representative of the agency shall report to EIC for taking necessary actions and work

would be executed according to his direction only.

07 Required pressure setting for safety valves and their technical details is to be provided at site before on line testing and setting purpose.

08 Necessary protocol and other observations and suggestions shall be explicitly handed to the Engineer-in-charge or his authorized representative by service personnel (Test report & graphically charts)

09 Any maintenance of the safety valve floating kit during execution of the job is to be maintained by the party.

10 To test the valves online to our satisfaction in the shortest time possible. Max.30 minutes per valve which will not include the material handling and mobilization.

11 The material /tools & tackles which are not mentioned in order but, required for safe and

efficient on line safety setting is to be arranged by the party without any additional cost.

12 Party shall have to submit test report with the graphical chart for the work carried out.

13 Minimum 04 valves per visit will be offered by GSECL for on line setting.

14 Conveyance is to be arranged by Party. 15 The working hour for pressure setting might be odd hours in day or Night depending upon

status of unit start up. All days including Sunday and Holidays shall be treated as working day.

16 Bill shall be made to the agency after completion of job against submission of invoice

indicating actual quantities of safety Valves setting done and on certificate of EIC. 17 The period of contract shall be One Year from the date of issue of work order. Exact date

shall be intimated well in Advance by the EIC. Time limit for completion of work is One day. 18 All the safety valve location is at an EL.56 mtr. in all boilers. 19 All the safety rules & regulation are to be followed strictly by the party during executing the

work at site.

20 GSECL will not be responsible for any accident/injury occurred to the party’s employees their deputed staff.

21 Necessary agreements are to be executed by the party as per GSECL rules and regulations.

22 If your work is not found satisfactory and not as per the terms of contract.GSECL reserve our right to cancel the contract at your risk & cost.

23 GSECL reserves the right to forfeit the security deposit in case of any breach of contract.

24 The rates given in schedule-B will be firm till completion of work in all units. Any type of price escalation will not be allowed against this contract.

25 In case of any delay in the work of safety valve setting due to any reason accountable to party, the recovery may be imposed against party as deemed fit or as per decision of C.A.

SCOPE OF GSECL:

01 GSECL will provide one gang for assisting the testing of valve at the work site.. 02 GSECL will provide lift for ease of transportation, if available 03 Accommodation will be arranged by GSECL in the guest house on chargeable basis

depending upon availability.

04 GSECL will provide free air, water and electricity at the work site for carrying out job.

05 GSECL will provide scaffolding if required.

06 GSECL will provide workshop facility, if available. [

TERMS AND CONDITIONS: 1. The time is the essence of the contract and the party will have to ensure that the work has to be

completed within stipulated period for the above work keeping manpower round the clock and if required necessary the additional resources are to be mobilized, so that the work can be completed as per schedule time period during A.O.H/C.O.H & short shutdown of boiler.

2. Overall time limit for works contract is 12 months, however, the quoted rates shall remain firm and no

escalation shall be given if the work extended beyond 12 months due to any reason or for balance quantity for any balance quantity of order when fronts are plan to release after overhauling works, the allotted works have to be completed within time limit on each occasion of any unit.

3. The time limit for completion of one boiler job is maximum 08 Hrs. therefore contractor shall have to

arrange the gangs to work round the clock so as to complete it within time limit. 4. Mobilization period three day’s time shall be allowed from date of telegraphic fax. Order or letter for

mobilization of contractor’s man, tools, tackles etc. commencement date for starting the works will be reckoned accordingly from the date contractor is permitted to start the works, mobilization for site, material collection period shall be excluded from working period.

5. The contractors have to keep authorized representative always available at site, to receive instruction

from GSECL EIC to execute the works. 6. Sub-letting the contract to other agency is not permitted unless and otherwise, the competent authority

approves it.

7. Party has to fill up the rates on total value of the tender with above/less percentage and no condition should be attached with the tender.

8. GSECL reserves right to split up in to more than one agency, if deemed fit to have availability of resources to complete the work in stipulated period.

9. The GSECL reserves the right to terminate the contract at any time without giving notice or any reasons thereof.

10. The scope of works shall include carting of materials from GSECL main stores and or BMD II stores as the case may be and as directed by GSECL EIC for which no extra payment shall be made.

11. All balance left out and scrap materials shall be credited to GSECL stores as directed by GSECL EIC, for which no extra payment shall be made.

12. The contractor shall be required to produce Challan/invoice copy for all consumable items, tools tackles etc. dully entered and signed by Security officer at concern maintenance section.

13. All necessary safety appliances such as safety shoes, helmets, welder’s apron, hand gloves, goggles, safety belts etc. shall be made available to the staff as and when required, by the contractor. All safety measures have shown elsewhere in this contract as well as factory rules shall have to be observed strictly by the contractor.

14. Working schedule is to be arranged in co-ordination with other working agencies to avoid any accident as well as for safety to personnel on job and resources are to be engaged for round the clock.

15. Payment shall be made as per actual works done only and availability of funds with GSECL.

16. Party has to execute the work as per instruction of GSECL EIC and technical specifications of the contract.

17. Rates are to be quoted firm and hence no price escalation and labour escalation will be applicable.

18. Contractors have to fulfill all the statutory requirements as per existing/modify labour laws in consultation with IRO/LWO with all legal aspects.

19. The electrical connection and electricity to the party’s welding generator sets and other equipments shall be given by GSECL free of cost at one point only near working place as directed by GSECL, EIC.

20. The contractor shall have to arrange, to remove the day-to-day scrap materials from site and deposit to GSECL main stores or BMD.II stores as per instruction of GSECL EIC. The site must have to be kept cleared before starting/commissioning of equipments, otherwise 5% of the contract value of the amount or expenditure actually incurred from the party’s bill without giving any reasons on the event of non removal of scrap materials.

21. In case of any dispute, the decision of the Chief Engineer, WTPS shall be final and binding to the contractor.

22. The party shall have to pay security deposit 5% contract value immediately in case, order is awarded to you. The party shall also have to enter in to agreement on stamp paper as per GSECL’s rules.

23. The payment to the workers shall be disbursed in the presence of Management representatives during the working hours in the factory premises and the contractor shall get the entries certified in the register of wages by the representative of the GSECL. The contractor shall pay minimum wages per day in time as per wages act.

24. Consumable items like oxygen and acetylene gas cylinder, MS welding rods, welding accessories like cutting torch, pipe, gas regulator, welding generator/transformer with cable, main switch ELCB etc. and all safety appliances shall be arranged by the contractor. However any special welding electrodes like S.S. welding electrodes, cut rods will given by GSECL free of cost.

25. Performance guarantee shall be liable and responsible for rectifying defective workmanship or any effect attributable to faulty workmanship or procedures followed or adjustments done on the times works covered in the contract period for 15 days from the date of recommissioning of the unit or taking full load or units Guarantee shall be covering all aspects noticed during period and shall be attended free of cost immediately, on when shutdown available any failure to do so, then shall be get done by GSECL at risk and cost of the contractor.

26. Party shall have to submit list of personnel they proposed to engage for above contract at the time of commencement of the work well in advance.

27. Contractor has to observe all safety and security norms of GSECL very strictly

29. Contractor has to indemnify the Bond as per standard format of the GSECL on a non-judicial stamp paper of Rs. 100/-. Also the contractor has to under take agreement with the GSECL as per standard format of the GSECL on non-judicial stamp paper of Rs. 100/-.

30. Service tax at the rate prevailing during period of execution and if applicable, will be paid on production of certified copy of Registration number and certified copy of paid challan for payment of service tax from time to time.

ANNEXURE ‘A’

All necessary tools and tackles such as chain pulley blocks, welding generator sets, hook-chooks, wire slings, spanner, gas cutting sets, welding cables, grinding machines etc. shall be arranged by the party at his own cost. At any time it is found that work force of the party is inadequate and progress of the work is not be to the satisfaction of GSECL, other agencies/departmental personnel will be put to carry out work. Amount so incurred will be recovered from the party’s bill. In this case the decision of the Engineer in charge of WTPS shall be final and binding on the contractor/party. The time is the essence of the contract and the party shall have to ensure that work is completed within stipulated period, in the contract, keeping personnel round the clock otherwise penalty will be charged at the rate of ½% per day subject to maximum of 10% of the contract value as per the Corporation’s rules. Party shall indemnity GSECL against for any injury and/or damages that may be caused in his man or material. Moreover the party shall be fully responsible for any damaged caused to the Corporation’s properties done by his men/materials, while executing the work. The CORPORATION will be entitled to recover the damages from the party’s bill. Party should take all necessary precautions during execution of the work and all labours of the party should utilize all types of safety applications during work in plant area to prevent the accident as per factory acts/rules. The electrical connection and electricity to the party’s welding generator sets and other equipments such as grinding sets etc. shall be given by the GSECL free of cost at one point only near to working place, as directed by EIC. This is a rate contract for a period of 12 months. The CORPORATION reserves the right to extend this a nnual contract for further six months period, as deemed s uitable, considering the balance quantities yet to complete, and it will be binding to the party. The rates and other terms and conditions will remain sa me as per original order for the extended period. The tender shall be submitted along with EMD without which no tender will be considered. The conditional tender will not be accepted withdrawal of condition unilaterally after opening of tender will not be permitted. Chief Engr., WTPS reserves right either to accept or reject under all tender without assigning any reasons. The labour laws in existence and which may modify from time to time shall be binding to the party. The party will have to execute an indemnity bond on non judicial stamp paper of appropriate value. The cost of the stamp shall be borne by the party. The CORPORATION reserves the right to split each item in to more than one agency and place the order accordingly. All parties should therefore, carefully evaluate and fill up the rate item wise keeping themselves ready to execute order for any one or more allotted to them by the CORPORATION. The CORPORATION reserves the right to terminate the contract at any time during is tendency by giving seven days notice to the party without entertaining of claim/compensation. The contractor shall have to arrange to remove the day to day scrap materials from site and deposit to GSECL main stores/BMD.II site stores as per the instruction of Engineer in charge. The site must have to be kept cleared before starting/commissioning of equipments/unit otherwise 5% of the contractor order value of the amount or expenditure actually incurred will be recovered from the party’s bill without assigning any reason in the event of non removal of scrap. Rates are quoted to be firm and hence no price and labour escalation will be applicable. All consumables like cotton waste, kerosene/diesel/rustolene, welding electrodes, Oxy-acetylene gas shall be arranged by the party at his own cost. The quantity of welding electrodes to be used MS general purpose only confirming to AWS-6013 series.

The spares, pertaining to equipment components, packing ropes, MS plates / Angle / Beam / Channel / pipe of required size, gasket etc. will be issued free of cost from GSECL store as per requirement of the work. Over all time period for this contract would be 12 months counted from the date of commencement of the work and can be same rates and terms. Contractor shall have to prepare the material account and shall have to submit the same in triplicate along with the bill. The RA bills may be raised by the party on completion of works per unit quantity wise. The party has to arrange for 24 V transformer/battery torches to be utilized as safety equipment while carrying out work inside of equipments/at higher elevation. The party has to provide required capacity of welding machine. You are therefore requested to offer your most competitive rates in schedule ’B’ in sealed envelope by RPAD only along with non refundable tender fee paid in cash by our cash counter or by Demand Draft in favour of GSECL drawn on Dena bank, WTPS as to reach this office on or before the date of submission of the tender mentioned in the tender notice. NOTE: Over writing while filling rates in schedule ‘B’ of tender copy is not permitted and if any over writing is there, tender can be rejected. Sign of Contractor

GENERAL CONDITION AT CONTRACT

1. WAGES TO BE PAID & TIME OF PAYMENT ETC. BY THE C ONTRACTOR:

(a) The contractors shall pay minimum rates fixed under the minimum wages act. The wages of every contract labour employed by him under this contract shall be paid by him before the expiry of 7th day of the last day of the month in respect of which the wages are payable (i.e. wages of a month have to the paid by him in the first week of the next month). The payment shall be disbursed in the presence of management representative during the working hours in factory premises and the contractor shall get the entries certified in the register of wages by the representatives of the company. Any default will result in cancellation of contract forthwith or also the contract shall be punishable to the extent of Rs. 100/- fine per each day.

(b) The contractor shall be give his telephone number and address to the Board so that in case of labour trouble etc. the contractor can be contacted. The contractor shall arrange to have his office outside the factory premises and the contractor shall keep himself present through out the work hours.

2. LABOURS LAWS:

(a) Person below the age of 18 years shall not be employed for the work. (b) No female worker shall be employed in the night shift between 07-00 PM to 06-00 AM. (c) Contractor shall maintain a valid labour license under the contractor labour (Regulation and Abolition) Act

for the employing necessary manpower to be required by him in the absence of such license the contractor shall be liable to terminated without assign any reasons thereof.

(d) The contractor shall at his own expense comply with all labour laws and keep the Board indemnified in respect thereof. Some of the major liabilities under various labour and industrial laws which the contractor shall comply with are as under:

1. Payment of contributing of way of Employer’s contribution towards provident fund, family pension scheme, deposit linked insurance scheme, administrative charges etc. at the rates made applicable from time to time by Government of Gujarat/ Government of India or other Statutory Authorities.

2. Payment of deposit in respect of each contract labour at rate of Rs. 30/- with the office of Commissioner of Labour as per contract labour (Regulation and Abolition) Act.

3. License as prescribed under the contract labour (Regulation and Abolition) Act and rules framed there under depending upon the number of workman employed by the contractor License is compulsory it ten or more labours engaged due date.

4. Identity cards as prescribed under the factories act. With photo affixed there to the same for identification

5. Payment of retrenchment compensation, notice pay and other liabilities as per Industrial Disputes Act. Any payment to the contractor’s employees arising out of any claim or disputes under the industrial Disputes Act. 1947 or any other labour laws.

6. Payment of compensation in case of accidental injury.

7. Provision of creche if female labour employed is more than 30 numbers.

8. Maternity leave as per the provision of the Maternity Benefit Act.

3. PROVIDENT FUND AND FAMILY PENSION SCHEME.

The contractor shall submit along with his bill (month wise) a statement regarding deductions against employees provident fund and family pension scheme in respect of each concerned employees. Provident fund and family pension scheme at the rate of 8.33% (or at the rate made applicable by the Government from time to time) of Wages. The contractor’s contribution and his workers contribution towards provident fund and family pension scheme shall be deposited by the contractor with Regional Provident Fund commissioner, Ahmedabad.

4. DEPOSIT LINKED INSURANCE SCHEME:

The contractor shall have to deposit 1/2 % of the wages in respect of employees who is a member of the provident fund as the contribution to the Deposit linked insurance scheme with Regional Provident Fund Commissioner, Ahmedabad.

5. ADMINISTRATIVE CHARGES :

Administrative charges for maintaining Provident fund account shall be deposited by the contractor with Regional Provident Fund Commissioner, Ahmedabad at the rates applicable.

6. PAID LEAVE FACILITY: Paid leave facility at the rate of one day for every 29 days worked by the contractor labour shall be provided

by the contractor to his workers. He shall maintain leave records/leave cards for individual labourers which shall be duly verified and approved certified by the authorized officer of the Board.

7. WORKMEN’S COMPENSATION FUND AND EMPLOYERS LIABIL ITY INSURANCE:

The contractor shall cover all his employees under workmen’s compensation fund and under the liability Insurance.

8. The contractor shall employ adequate number of experienced staff at site for daily supervision and for maintenance of various registers and records required under the law and contract no payment for supervision shall be admissible.

9. CONTRACTOR TO INDEMINITY THE BOND:

The contractor shall indemnity and keep indemnified the Bond and every member, officer and employees of the G.S.E.C.L. also Engineer in charge and his staff against action proceeding claims, demands, costs and expenses whatsoever arising, out of or in connection with the maters referred in above clauses and elsewhere and against all actions claims, demands, cost and expenses which may be made against the G.S.E.C.L. by any workmen / employees of the contractor or any sub contractor and/ or contractor from any liability any wise any workman employees of the contractor or sub contractor under any laws rules or regulation having the force of low including but not limited to claims against the owner workmen compensation Act 1923.

The employees Provident Fund 1952, and or/ the Contract labour (Abolition and Regulation) Act. 1970 the G.S.E.C.L. shall not be liable for in respect of or in consequence of any accident or injury to workman of other person in the employment of the contractor or his sub contractor and the contractor shall identify workman in the G.S.E.C.L. against all such damage and compensation and against all claims, demands, proceeding costs charge and expenses what so ever in respect there of or in relation there to.

10. WORKMAN’S COMPENSATION & EMPLOYER’S LIABILITY I NSURANCE:

Insurance shall be affected for all the contractor’s employees engaged in the performance of these contractors. If any of the work is subjected, the contractor shall require the sub contractor to provide workman’s compensation and Employers Liability Insurance for the letter’s employees are covered under this scheme.

11. The Company reserves the right to terminate this rate contract at any time during contract period without giving notice of termination of any reasons thereof.

12. The Company will be entitled to deduct directly from the bills, to be paid to the contractor any sum of sums payable by the contractor and which sum/sums the GSECL is required to pay as a principal employer on account of Contractor default in respect of all liabilities referred to in above clauses.

13. Nothing in the contract document stated shall anywise constitutes any workman/ employees of the contractor or any sub contractor as or to be workman employees of the owner or place obligationary liability in respect of any such workman/ employee upon the GSECL.

14. Office Correspondence will be carried out in English and if at any time to facilitate the contractor, Gujarati Translation may be furnished if deemed fit the English version will be the contract one the same only will held good for legal matter.

15. Contractor will be responsible and liable to pay difference in wages if any and or observe the revised service conditions that may be awarded by the honorable Industrial Tribunal effective from the dated directed in the award.

16. Rates quoted are firm and hence no price escalation or labour escalation will be applicable towards execution of work.

17. In case of delay in execution of work the penalty as Cl. No. 3 of Tender and contract for work will be applicable.

18. Party shall have to provide at their own the required personal protective equipments of standard make (ISI approved) to their staff during work execution and it will be your responsibility to see that the same are by your staff while at work.

19. The contractor shall deposit 15 days salary at the rate of last drawn salary for every completed one year services for each worker for liabilities of gratuity.

GENERAL CONDITIONS OF CONTRACT SECTION:

1. The contractor shall at their own expense make all necessary provision for housing water supply and

sanitary arrangement for their employee as well as for works and shall pay direct to the authorities concerned all rates and taxes.

2. The contractor shall make their own arrangements for the necessary approach road, for transport of their

materials and be responsible for the Compensation on account of damage to crop on Corporation’s property.

3. All the royalty charges octroi other duties will be paid by the contractor and no extra could be claimed on this

account. 4. The organization will supply articles at the place and rates mentioned in schedule `A’ of Tender form. In case of the materials issued either through or with the recommendation of this organization it will be

absolutely necessary for the contractor to maintain a correct and honest record of the daily consumption of the said materials/with inside particular reference to the work during the day.

The Engineer-in-charge of this department or his authorized agent shall have the right to inspect and check

the stores containing these materials and the account for these materials shall be presented for inspection whenever asked for by them. Every facility shall be afforded by the contractors for all these inspections Engineer-in-charge will supply the materials in any quantity as deemed fit.

5. Godown or sheds hired or constructed for storage of controlled materials and more/ particularly of cement

shall be such as would prevent the materials from getting damages in any way. 6. It will be absolutely incumbent the contractors to have on the site of work only such of the materials as have

been dully passed by the Engineer-in-charge Materials that have been rejected must on no account be allowed to remain on the side and in spite of written order to do so any such rejected material is on the site beyond a period of 48 hours, notice the Engineer-in-charge shall have the right to remove it at the risk and cost of the contractor and even destroy it.

7. It must be distinctly understood that the conditions of the contract and of claims in respect of extra work will

not be allowed, unless the works to which they relate is clearly without the spirit and meaning of the specifications or unless such work are ordered in writing by the Engineer-in-charge and claimed for in specified manner.

8. On completion of the work, the site shall be cleared by the contractors within the stipulated period, and

ground brought to original state and they shall not be entitled for any extra claim on this account. 9. General specification of the latest edition of the P.W.D. Hand Book volume I & II shall also apply. 10. When cement is obtained through or with the recommendation or issued by the Corporation it should be

understood that the contractors will have to be very careful regarding the handling of the cement bag so as to preserve their serviceability and quality.

11. DAMAGE CAUSES TO WORKS : The work whether fully constructed or not, and all materials, machinery

plant tools, temporary building and other things connected there shall be at the risk and in the sole charge of the contractor until the works have been delivered, completed to the Engineer- in-charge and certificate from him to that effect obtained until such delivery the contractor shall at their own cost take all the precautions reasonably necessary to keep all the aforesaid works materials machinery, plant, tools, temporary building and other things connected with the work, free from any loss or damage and in the event to the same or any part there of being lost or damage shall from with within possible speed, reinstate and make good such loss or damage at contractor’s own cost.

12. Supply of controlled articles will be invariably recommended after the actual requirements have been

carefully scrutinized. In the event of any such materials remaining in surplus in charge of the contract, on account of some modifications either in the design or changes in construction or any other reason will be returned to the department.

13. There will be generally no objection on the component parts of the works being given over to responsible

sub contractors but it must be borne in mind that this department would under no circumstances recognize these sub contractors and responsibility of executing the work in accordance with the condition of the contract will entirely rest on the main contractors. The main contractors will therefore always have the very responsible member preferably a technical hand, present on the works with power to sign all work order issued on the site of work and to take requisite actions in the interest of very efficient execution of works.

14. With a view to ensure rapid progress on the works purchaser may store at work sites certain quantities of

the materials such as cement etc. and it will be incumbent on the tender to purchase these materials, at the rates mentioned in schedule `A’ of tender form for supply of necessary articles, all necessary help will be tendered but in must be clearly understood that the purchases does not accepted and responsibility for the delay that may be cause in their supply on account of circumstances beyond the purchaser’s control.

15. The Engineer-in-charge will fix the hours of work and no work shall be executed beyond that period during

night time or in absence of the Engineer-in-charge or his authorized agent. The box measures shall be filled only in the presence of the Engineer-in-charge or his authorized agent.

16. Contractor will be asked to present the sample of materials and the approved sampled will be preserved at

the site of work and no change in the approved sample will be allowed without the written permission of the Engineer-in-charge.

17. If any work is not executed according to the specifications and the directions of the Engineer-in-charge the

same will be rejected or reduced rate will be allowed as deemed fit by the Engineer-in-charge. 18. Contract will have to communicate the name of his authorized agent who shall be presentation the works

and shall be authorized to sign the materials requisitions receive instruction given verbally, or on the order book on behalf of the contractor.

19. The materials issued to the contractor as per schedule `A’ of the tender shall not be removed from the work and all surplus material at the end of the works which is considered serviceable shall be returned to the organization even the unserviceable material shall be removed only with the prior permission to the E.E. in writing.

20. The contractor will have to sign the conditions of the contract and execute the agreement, send the list of

previous works executed solvency certificates and pay up the security deposits, failing to that the tender will be rejected and earnest money deposit will be forfeited. The value of the stamp paper and stamp duty charges shall be borne by the contactor.

21. The contractor must arrange for all transport of materials weighting of material issued at department stores and all such cost include in the rates of schedule `B’ with the loss or above percentage quoted by the contractor for finished work.

22. The competent authorities can delete to any items in the schedule `B’ of the tender order if they fill that the

items is not essential to be executed. 23. A schedule of quantities is included in the tender document it shall definitely understood that the Corporation

does not accept any responsibility for the correctness or complication of this schedules and this schedule is liable to alterations by commissions, deduction or additions at the description of the Chief Engineer of as set forth in conditions of contract specific percentage less or above shall be quoted by the contractor below the total amount of schedule B. The tender documents shall be written legibly and free from grouser, over written on conversion of figures correction where unavoidable shall be made by crossing out initialing dating and rewriting both in figures and in words in case of my discrepancy in figures the price quoted in words shall prevail.

24. This notice to tenders shall form a part of the contract. 25. The entire work is to be completed within the stipulated time limit from the date of work order. The contractor

will not be eligible for any extra for the idle period of work or waiting period that may be required to suit other considerations and no claim for compensation on account of such will be considered. However in case or delay due to circumstances beyond the control contractor either in date of commencement or due to waiting during construction extension time may be considered for completion of work.

26. In case contractor is unable to account for full quantity of materials issued to him from the department

stores, recovery will be effected from him at cost rates or market rates prevailing at the time of issue whichever is higher, plus 15% to cover Corporation’s departmental supervision charges for all material unaccounted for.

27. Scrap from reinforcement (bars below 1.25 M lengths) not be accepted back and the contractor will be

authorized to remove it from the site after completion of works and rendering of accounts with written permission of Engineer in charge not below the rank of Executive Engineer.

The corporation will not be responsible for any delay in supply of controlled materials such as M.S. Reinforcement Bars cement etc. however it will hand over to see that there in no delay of materials.

Due consideration will be given in granting extension of time for completion of the work if found necessary on account of delay supply of materials. No claim for compensation or for damages for extension in time shall be entertained in this account.

All materials inquired by the contractor shall be drawn from the stores by requisition given in writing by the contractor at least one week before the requirement of work. The recoveries will be affected in running payment for all material issued up to the date of measurements for the particular bill or the quantities used in the works measured at the description of the Executive Engineer in charge of work.

28. The contractor shall keep one full time qualified engineer at site who shall be fully authorized to receive and

comply with such instructions as given by the Executive Engineer. The names of such Engineer with his qualification and experience shall be intimated by the contractor. The E.E. shall have the right to demand the removal of any technical person. Skilled or unskilled work men who in his opinion are considered to cause bad workmanship in the execution of work or to cause indiscipline.

29. Bill shall be submitted by the contractor monthly on or before the date fixed by the E.E. for all works

executed in the previous months. 30. SUPPLY OF WATER AND ELECTRICITY: If possible water for work purpose only may be supplied by the

Corporation at one point as decided by the Engineer & recovery for water charges shall be affected at two percent of cost of time as executed in which the water supplied by the Corporation is used as certified by the Engineer in charge. Electric supply is required the contractor shall be given Free of cost by GSECL.

31. Should this tender be accepted I/We have agreed to abide by and full fill all the terms and provision of `Tender and Contract of works’ as applicable and in default there to forfeit and pay to the Corporation the some of money due.

32. The work will have to be carried out in co ordination with other Agencies on the same site on account of this

in case the contractor has to stop or delay his works for same time he will not claim anything extra only Corporation may consider to give suitable extension in time limit if necessary on such account.

33. Any disputes arising out of the contract if not settled mutually, than the same shall be settle by Gujarat Public Work Arbitration Tribunal act-1992. Note: - Following clauses are excluded i.e. 2,3,4,6,9,10,12,14,16,27 & 29.

TAL.THASRA DIST.KHEDA (GUJARAT) CIRCULAR-1 The following are the major obligations to be fulfilled by the Contractors as per the Contract Labour (R&A) Act 1970 and rules mentioned there under. 1. License to be obtained before starting the work where number of contract labours in ten or more. 2. Payment to contract labourers has to be made in presence of IRO/LWO. Wages rates for contract labourers

are applicable as per the terms and a condition of the license. Minimum rate of the wages for unskilled labour, semiskilled labour and for skilled labour notified from time to time by the competent authority under the said Act.

3. Every contractor shall have to maintain the muster roll and wedges register in respect of his contract

labours. 4. Every contractor is required to issue employment card to their labours. 5. The Contractor has to maintain the register No 13 containing the details of contract labours employed by

him. 6. Earned leave / card as per factory Act and rules. 7. Other registers required under Contract Labour rules and the Factory Act & rules. 8. Every Contractor shall have to obtain Insurance Policy in respect of the contract labours engaged by him to

cover them under Workmen’s Compensation Act. 9. To send half yearly return to licensing officer as per rule-82 (1) as per schedule time. 10. Before starting the work as per contract awarded to him, he should make arrangement to enter in to

agreement in the prescribe format on the stamp paper as applicable. Before fulfilling the above requirement the contractor is instructed not to start the work. The responsibility will be on his head in case he fails.

11. Contractor should posses separate P.F. code on their Firm name otherwise their offer may not be considered.

All the contractors are informed to adhere to the rules and regulations applicable to them, particularly in respect of the labours engaged by them. The contractor not fulfilling the obligations will not be allowed or continue with work / not be held qualified to carry out the work at Wanakbori TPS.

General Safety Rules / norms To Be Observed By The Contractors. - Safety measures regarding Fatal

accident in the project All the contractors working at Thermal Power Station for Project Erection testing, commissioning shall strictly observe the following Safety Rules. Concerned Contractors are responsible for informing & observance of these rules by their supervisors/employees/ labours as well as the supervisors/ employees/ labours of agencies/ sub-Contractors engaged, if any, by them for the work contract awarded to them. Prior to commencement of the work, Contractor shall submit a written assurance on their letterhead to the concerned Sectional Head / Engineer-in-charge that they have thoroughly gone through these Rules, have educated their employees / employees of their sub contractor and will strictly observe the said Rules while execution of work under work contract awarded to them. They shall indemnify the Corporation for any loss or damage / accident / injury to the Corporation’s property / employee or employee of their own in default due to non - observing these rules.

1. Persons to be employed for carrying out the work shall possess required qualification, are fully trained and

conversant for the works to be done. All persons should have gate pass. Register consisting the full details i.e. address, phone number nearest relative. of all persons to be maintained. During the work execution, one trained & competent supervisor shall always remain present at site.

2. The contractor shall take all the required safety measures prior to commencement of work on dangerous

substances, machineries or area at which cautionary notice is displayed and obtain `Line Clear` or `Work Permit` through the concerned Department / Section.

3. Prior to carrying out welding, gas cutting, furnace heating or any other hot work job, remove all the inflammable

material lying at or nearby worksite or cover it properly by suitable protective covering. Also, special care shall be taken before carrying out such job & see that all possible contributing factors to set fire shall be removed / vanished prior to commencement of the work. Advance intimation shall be given to concerned section / Fire Section to commence the work in fire prone areas. They should also keep ready all the First Aid & Fire Extinguishers / equipments & fire extinguishing media / material like sand / water buckets or other appropriate equipment at such place.

4. While carrying out work in confined space or inside vessel, obtain necessary `Confined Space / Vessel Entry Permit` from concerned department prior to commencement of the work. For lighting in such areas, only 24-volt (ISI certified & with proper guard) hand lamp shall be used. For taking care of the persons working inside the confined space / vessel, a supervisor / person capable to keep continuous watch on person(s) working inside, assist them incase of emergency or arrange to get immediate outside help, shall remain present at entry point. (Use full body safety belt without failed.) While working inside sewage, trench or at-depth, a person to warn outsiders / entrants / passers etc shall remain available near entry point or the entry point shall be cordoned by a barricade tape with a cautionary notice. After completion of the works, all the lids / covers / grills / grits opened, shall be re-fixed / re-placed in the original position as it were prior to commencement of the work and leave the work place in safe condition in all respect, so as to prevent accident to fellow workers.

5. Do not work on or block (by stacking material, spare parts, tools-tackles, equipments etc), any passages / walkways / gangways / aisles / staircases / ladders / lifts or any other approaches / roads leading to plans or its auxiliaries, on which there is traffic movement or possible traffic movement in case of emergency. Such passages are meant for safe escape in the event of emergency. If it is utmost necessary to carry out work in such area with blocking of passage, prior permission of Competent Authority or the Engineer-In-Charge shall be obtained. To demarcate / declare the area as UNSAFE, cordon it using barricading tape & display suitable caution notice or keep a person to restrict / divert the traffic on this route through other safe passage.

6. Prior to use of power / electrically operated hand tools / equipments / machines / gadgets like welding machine, hand grinder, hand drill etc, ensure for its safe operation & use it only if it is found safe to use. Do not use defective, unsafe or improperly maintained equipments. The electrical power supply required to run such equipments shall not be taken directly at their own but shall be obtained through concerned Electrical Maintenance Departments or their authorized persons or under their observations / guidance only. The Electrical Section shall provide temporary electrical connection up to contractor’s Mains Board on which it is compulsory to install mains switch, ELCB & fuses of adequate capacity. All such equipments shall invariably be earthed adequately to prevent electrical shock, sparking, short circuit etc. Power cord to be used shall be of adequate capacity, without any joint & shall consist of earth wire also. Hence, it is necessary to use adequate capacity 3-wire power cord for single & 5-wire power cord for three phase power connections. The plugs, receptacles, pins, holders etc shall be of adequate capacity & safe to use.

All electrical & mechanical equipments / tools-tackles viz. welding machine, cutting machine, Grinder, Drill, Chain Pulley Blocks, Hook chooks etc required to be used during work execution shall be of standard make & bear ISI certification mark on it. The consumables like welding electrodes, grinding wheels / discs etc which has specific prescribed life span shall not be used in any case if its expiry date is over.

7. It is compulsory to use standard make Personal Protective Equipments (P.P.Es.) as per the job requirement. Do not work without use of required P.P.Es. Contractor is responsible to provide standard make (ISI approved) Personal Protective Equipments / Safety Gadgets suitable to give sufficient protection against hazards involved in their work / job to their staff, as per the job requirement and insist / enforce their staff to put on the same while at works. The ongoing work is liable to be stopped at any time if any staff is found working without P.P.Es. Following is the list of various P.P.Es. to be used for various works / worksites.

For body protection against chemicals, oils, sharp edged objects, heat, hot objects etc.

06 Gloves (Rubber/PVC, Asbestos, Leather, Electrical shock proof).

For protection of hands against chemicals, oils, sharp edged objects, heat, hot metals/objects, electricity etc.

07 Safety / Leather / Asbestos shoes, Gum Boots etc.

For protection of leg/feet against falling objects, sharp edged objects, heat, hot metals/objects, electricity etc..

08 Safety Belt(full body) / Rope / Life line / Fall prevention system etc.

For fall prevention while working at heights or in depth, working in vessel or in confined space.

09 Dust Respirator / Scarf. Protection of respiratory system against dust.

12 Air supply respirators. Working in oxygen deficient zone.

8. Before using lifting machines / tackles (like C.P.Bs., Hook chooks, winch, forklift, mobile crane, EOT crane etc) & its attachments (like D-shackles, slings, U-clamps, Eye bolts or any fixtures), it shall be checked and used only if found safe to use. Also, ensure that these are tested, examined & certified in form no 9/10 by Competent Authority Person as per the Factory act-1948 and its validity not expired. Further, it shall be fixed properly and firmly prior to lifting the weight.

9. Scaffoldings to be used for working at height shall be of adequate size & capacity. Obtain the work permit when working at height. While climbing on such scaffolding or working on any structure at height, use of full body safety belt & Helmet is compulsory. It is also necessary to fasten chinstraps of the helmet.

10.Contractor or their employee shall not interfere in day-today routine plant activities / works except the work assigned to them, shall not loiter in the areas other than their work jurisdiction, as well as shall not temper / operate / touch the machineries/equipments/auxiliaries with which they are not concerned. Also, the contractor shall strictly instruct their staff for not to sit or take rest at/near/below running plants, auxiliaries, systems or any place which is risky, hazardous & prone to accident.

11.The cylinders containing poisonous / toxic or inflammable / explosive gas like Oxygen, Acetylene, LPG, Hydrogen, Ammonia, Chlorine, CO2 etc shall be handled safely taking due care. To handle / shift such cylinders a special trolley /cage meant for it must be used but in no case it should be rolled.

12.On completion of the work, cotton waste, spilled oil / grease, pieces of welding rod & other waste material shall be removed from work site and the area shall be left safe, neat & clean.

13. In case of any injury / accident while working, it shall immediately be reported to Safety Department through concerned Sectional Head / Engineer. The prescribed Form No.21 may be obtained from concern section or Safety Officer. For any incident occurred but have no injury to any persons should also informed to safety officer as Near Miss Incident.

14. In all risky job, before start the work contractor should obtained General Safety Work Permit through concerned section from safety dept in well advance.

15. For performance evaluation of contractor safety factors of work accident, fire incident & near miss accident will be consider. Steps can be taken to review the job assignment up to cancellation for negligence.

16. In case of noticing smoke or fire during their work execution, they shall make immediate efforts to extinguish / control it and simultaneously inform the Fire Brigade on phone. Shift the casualty to nearby hospital after rendering first aid in case of accident.

17. Over & above these, contractor shall follow all the safety requirements / rules & regulations / norms and legal provisions laid down in various statutes. Particularly the provisions of The Factories Act-1948 & The Gujarat State Factories Rules-1963 (Amended up to date) shall be followed strictly. The contractor shall also obey the rules / regulations / instructions of the local Competent Authority for safety requirements.

18. Work permit system for (a) Hot job work (b) Working at height to be introduced. 19. One Safety Officer / Safety Supervisor to be deployed to look after safety measures at the site. 20. All accidents / incident to be reported immediately to C.E. (G) and safety officer. 21. Safety talk to all sub contractors workers to be delivered by site engineer of contractor regarding safety measures

and awaring hazards associated with work. 22. Safety Posters to be displayed at site of work to create awareness regarding safety to contractor workers. 23. At site before starting the work precautionary sign Board to be displayed i.e., "Dangerous" work is going on Do-
