The Owner (Town of Rocky Hill) through its Owner’s Representative (Colliers Project Leaders) and its Designers (QA+M Architecture) is soliciting bids for the construction of the a new addition to and renovation of the Rocky Hill Senior/Community Center. The Bid Documents, consisting of the Drawings and Narratives prepared by QA+M Architecture comprises the bidding and construction documentation for this project. This

Invitation to Bid provides an overview and logistics reflecting the bidding process and logistics for this project.
Project Description:
The primary scope of this project is to renovate and expand the Rocky Hill Senior/Community Center to provide additional program spaces for the Town’s services and programs. The project will include roughly 5,000 sf of renovation work within the existing Senior/Community Center and roughly 15,000 sf of new addition space. The work includes but not limited to several multipurpose spaces, art and crafts spaces, small library, fitness spaces, and small café space. There will also be utility work, telecom, and exterior improvement work including patio and playground space.
The existing Senior/Community Center is attached to the Town Hall building and share a Town campus with several other important Town facilities including Police, Fire, and Library.
The Construction Documents also lists several alternates which will be analyzed by the Owner and selections made based on cost and schedule.
Bid Document Availability:
An electronic copy of the Bid Documents will be posted after 12:00 PM, March 24, 2020 and will be on file and available within the Advanced Reprographics online plan room at https://www.advancedplanroom.com/jobs/public or by calling (860) 410-1020. Pre-Bid Conference:
A bidder’s pre-bid skype meeting and conference call for all contractors will be conducted at the date and time as specified above. Attendance is mandatory in order to receive important information on the project including existing conditions, construction logistics, etc. Please send an email to the below people/email addresses by Noon, Thursday, April 2nd, 2020 acknowledging your plan to attend and what company you’re representing. The Owner is undertaking a public bidding process for this project that includes soliciting complete project bids from General Contractors. The Owner will meet with the most competitive bidder to review the scope of work, discuss the approach to the project, and solicit recommendations to improve value in the project. After considering these factors, a successful bidder will be identified. Contractors shall honor their bid price for ninety (90) days from bid due date.
Form of Contract:
A lump sum contract, AIA Document A101 will be executed with the General Contractor for the construction of the entire project. No exception to the scope of work or contract will be considered unless such notification is given before the Bid Due date or within the Bid Submission.

ARTICLE 1 - DEFINITIONS
1.1 Bidding Documents include the Bidding Requirements and the Contract Documents.
The Bidding Requirements consist of the Invitation for Bids, these Instructions to Bidders,
the bid form, and other sample bidding and contract forms, and exhibits. The Contract
Documents consist of the form of the Agreement between the Owner and Contractor,
Conditions of the Contract, Drawings, Specifications and all Addenda issued prior to
execution of the Contract.
1.1.1 Drawings and Specifications are those drawings and specifications prepared for this
project by the Architect, QA+M Architecture, Farmington, CT and dated March 23,
2020.
1.2 Definitions set forth in the General Conditions of the Contract for Construction, AIA
Document A201, or in other Contract Documents are applicable to the Bidding
Documents.
1.3 The Town of Rocky Hill is the entity identified as the "Owner" in the Agreement. The terms
“Town of Rocky Hill" and "Owner" are used interchangeably through the Contract
Documents.
1.4 Addenda are written or graphic instructions issued by the Architect prior to the execution
of the Contract which modify or interpret the Bidding Documents by additions, deletions,
clarifications or corrections.
1.5 A Bid is a complete and properly signed proposal to do the Work for the sums stipulated
therein, submitted in accordance with the Bidding Documents.
1.6 The Base Bid is the sum stated in the Bid for which the Bidder offers to perform the Work
described in the Bidding Documents as the base, to which Work may be added or from
which Work may be deleted for sums stated in Alternate Bids.
1.7 An Alternate Bid (or Alternate) is an amount stated in the Bid to be added to or
deducted from the amount of the Base Bid if the corresponding change in the Work, as
described in the Bidding Documents, is accepted.
1.8 A Unit Price is an amount stated in the Bid as a price per unit of measurement for
materials, equipment or services or a portion of the Work as described in the Bidding
documents.

1.9 A Bidder is a person or entity who submits a Bid.
ARTICLE 2 - BIDDER'S REPRESENTATIONS
2.1 The Bidder, by making a Bid represents that:
2.1.1 The Bidder has read and understands the Bidding Documents, and the Bid is made in
accordance therewith. By submitting a bid, the bidder further represents that he or she
has complied with the intent of paragraphs 2.1.2 and 3.2.1 of these instructions, and that
the Contract Documents are sufficient in scope and detail to indicate and convey
understanding of all terms and conditions for performance of the work of this contract.
2.1.2 The Bidder has visited the site, become familiar with local conditions under which the
Work is to be performed and has correlated the Bidder's personal observations with the
requirements of the proposed Contract Documents.
2.1.3 The Bid is based upon the materials, equipment and systems required by the Bidding
Documents, without exception.
3.1 COPIES
3.1.1 Bidders may obtain complete sets of the Bidding Documents at the location designated
in the Invitation for Bids, in the number and for the deposit sum stated therein. Costs for
printing or downloading of the Documents, if any, will be determined by the entity
providing the Documents.
3.1.2 Bidders shall use complete sets of Bidding Documents in preparing Bids; neither the
Owner nor the Architect assumes responsibility for errors or misinterpretations resulting
from the use of incomplete sets of Bidding Documents.
3.1.3 In making copies of the Bidding Documents available on the above terms, the Owner
and the Architect do so only for the purpose of obtaining Bids on the Work and do not
confer a license or grant permission for any other use of the Bidding Documents.
3.2 INTERPRETATION OR CORRECTION OF BIDDING DOCUMENTS
3.2.1 The Bidder shall carefully study and compare the Bidding Documents with each other,
shall examine the site and local conditions, and shall at once report to the Architect
errors, inconsistencies or ambiguities discovered.

3.2.2 Bidders requiring clarification or interpretation of the Bidding Documents shall make a
written request, which shall reach the Architect no later than the times and dates set
forth below. Questions must be sent in writing by email; verbal questions will not be
accepted and voicemails will not be returned.
3.2.2.1 General Bids: Requests for clarifications or interpretations will be accepted from
general bidders until 4:00 PM on April 13, 2020.
3.2.2.2 Address written comments and questions to the Project Architect, Rocco Petitto,
from QA+M and copy the Owners Project Manager, Matt Byrnes-Jacobsen from Colliers
Project Leaders. The emails for these contacts have been provided at the beginning of
these instructions.
3.2.3 Interpretations, corrections and changes of the Bidding Documents will be made by
written Addendum which will be issued to all bidders, and which shall be the sole and
exclusive means of communication with bidders.
3.2.4 Pre-Bid Meeting: An orientation, site inspection and pre-bid meeting will be held at the
place and on the date and at the time set forth in the Invitation for Bids. Bidders and
sub-bidders are required to attend this meeting.
3.3 SUBSTITUTIONS
3.3.1 The materials, products and equipment described in the Bidding Documents establish a
standard of required function, dimension, appearance and quality to be met by any
proposed substitution.
3.3.2 No substitution will be considered prior to receipt of Bids. Bids shall be based on the
products and materials specified.
3.3.3 Substitution of an item equal to that named or described in the Contract Documents will
be considered in accordance with provisions of the General Conditions, and the
Contract Documents, but is not guaranteed to be approved.
3.4 ADDENDA
3.4.1 Addenda will be delivered to all who are known by the issuing office to have received a
complete set of Bidding Documents.
3.4.2 Copies of Addenda will be made available for inspection wherever Bidding Documents
are on file for that purpose.

3.4.3 No addenda will be issued later than three days prior to the date for receipt of Bids,
except an Addendum withdrawing the request for Bids or one which includes
postponement of the date for receipt of Bids.
3.4.4. Each Bidder shall be responsible for ensuring, prior to submitting a Bid, that the Bidder has
received all Addenda issued, and the Bidder shall acknowledge in the Bid Form, in the
space provided, the receipt of all Addenda.
ARTICLE 4 - BIDDING PROCEDURES
4.1 FORM AND STYLE OF BIDS
4.1.1 Submit Bids on forms identical to the form bound into the Project Manual. Unbound bid
forms may be obtained from the Architect at the location given for obtaining the Bidding
Documents. Bids in any other form shall be rejected.
4.1.2 Follow the instructions in the bid form, and fill in all the blanks. Use typewriter, ink or
suitable electronic format; bids written in pencil will not be accepted. Where the bid
form requires sums to be expressed in both words and figures, in the case of discrepancy
between the two, the amount written in words shall govern. If a mistake is made, Bidders
may make a correction by interlineation, striking out, or "whiting out" and writing over;
such corrections must be initialed by the signer of the Bid.
4.1.3 Bid on all of the Alternates. Fill in the "Add" line if Owner's acceptance of the alternate
will increase the proposed Contract Price; fill in the "Subtract" line if Owner's acceptance
of the alternate will decrease the proposed Contract Price. If an alternate does not
affect the proposed Base Bid price, enter $0 or "No Change."
4.1.4 Each copy of the Bid shall include the legal name of the Bidder, and shall be signed by
the person or persons legally authorized to bind the Bidder to a contract.
4.1.5 Certifications by the General Bidder: Each General Bid shall include the following
certifications; certification language is included in the General Bid Form, and shall be
deemed to be given by the Bidder's signature on the Bid Form.
.1 Connecticut Sales Tax exemption:
The Contractor shall pay sales and use tax, consumer, use and similar taxes for the
Work provided by the Contractor that are legally enacted when bids are received
or negotiations concluded, whether or not yet effective or merely scheduled to go
into effect. However, the Contractor shall not pay, and the Owner shall not
reimburse or pay the Contractor for, any sales taxes and use tax for building
supplies or materials for which an exemption is provided. The Owner’s tax
exemption number to be used by the Contractor in this regard, if not set forth in the

Contract Documents, shall be furnished to the Contractor upon request after
execution of the Contract.
.2 Waiver of Fees:
Unless otherwise provided in the Contract Documents, the Contractor shall secure
and pay for the building permit and the certificate of occupancy as well as for
other permits, fees, licenses, and inspections by government agencies necessary
for proper execution and completion of the Work that are customarily secured
after execution of the Contract and legally required at the time bids are received
or negotiations concluded.

4.2 BID SECURITY
4.2.1 Each General Bid shall be accompanied by a bid security pledging that the Bidder will
enter into a Contract with the Owner on the terms stated in the Bid and will, furnish bonds
covering the faithful performance of the Contract and payment of all obligations arising
thereunder.
4.2.2 Amount of Bid Security: The bid security furnished under paragraphs 4.2.1 and 4.2.2 shall
be in the amount of 5% of the bid or sub-bid amount, in the form of certified check or
treasurer's or cashier's check issued by a responsible Connecticut bank or trust company,
payable to Town of Rocky Hill, or in the form of a bid bond issued by a surety company
listed on the Connecticut Certified Insurance Company List and payable to the Town of
Rocky Hill. Should the Bidder refuse to enter into such Contract or fail to furnish the
required performance and payment bonds, the amount of the bid security shall be
forfeited to the Owner as liquidated damages, not as a penalty.
4.2.3 Form of Bid Bonds: A bid bond shall be in a form satisfactory to the Owner. Unless
otherwise required by the Owner, a bid bond shall be written on AIA A310, Bid Bond, and
the attorney-in-fact who executes the bond on behalf of the surety shall affix to the bond
a certified and current copy of the power of attorney.
4.2.4 The bid security of other general bidders will be returned within 20 days, Saturdays,
Sundays and legal holidays excluded, after the opening of the General Bids.
4.3 SUBMISSION OF BIDS
4.3.1 Enclose the completed Bid form, bid security, and other documents required to be
submitted with the Bid in a sealed opaque envelope. Identify bids with the project

name, Rocky Hill Senior/Community Center Project and for general bids, the words
GENERAL BID.
4.3.2 Address and deliver the bid to the location stated in the Invitation.
4.3.3 The dates and times for Submittal of General Bids are as set forth in the Invitation. Bids
received after that time will be rejected.
4.3.4 The Bidder shall assume full responsibility for timely delivery at the location designated for
receipt of Bids.
4.4 MODIFICATION OR WITHDRAWAL OF BID
4.4.1 Bids may not be modified, withdrawn or canceled by the Bidder for ninety (90) days,
Saturdays, Sundays and legal holidays excluded, from the date designated for the
receipt of General Bids, and each Bidder so agrees in submitting a Bid.
4.4.2 Prior to the time and date designated for receipt of Bids, a Bid submitted may be
modified or withdrawn by notice to the party receiving Bids at the place designated for
receipt of Bids. Such notice shall be in writing over the signature of the Bidder. A change
shall be so worded as not to reveal the amount of the original bid.
4.4.3 Withdrawn Bids may be resubmitted up to the date and time designated for the receipt
of Bids, provided that they are then fully in conformance with these Instructions to
Bidders.
4.4.4 Bid security shall be in an amount sufficient for the Bid as modified or resubmitted.
ARTICLE 5 - CONSIDERATION OF BIDS
5.1 OPENING OF BIDS
5.1.1 Bids will be opened and reviewed by the Owner publically at Rocky Hill Town Hall, Town
Council Chambers on April 23rd, 2020 following the 2:00pm submission deadline.
5.2 REJECTION OF BIDS
5.2.1 The Owner shall have the right to reject any or all Bids, reject a Bid not accompanied by
a required bid security or by other data required by the Bidding Documents, or reject a
Bid which is in any way incomplete or irregular. The Owner shall further have the right to

reject any sub-bid if the Owner determines that such sub-bid does not represent the bid
of a person competent to perform the work as specified.
5.3 ACCEPTANCE OF BID (AWARD)
5.3.1 It is the intent of the Owner to award the project to the lowest responsible, qualified and
eligible Bidder on the basis of the proposed Contract Price. The award of Contract will
be made within ninety (90) days, Saturdays, Sundays and legal holidays excluded, after
the opening of General Bids.
5.3.2 The Owner shall have the right to waive informalities and irregularities in a Bid received
and to reject any or all bids if it is in the Towns interest to do so.
5.3.3 Alternates will be accepted as determined by the Town.
ARTICLE 6 - POST BID INFORMATION
6.1 POST-BID SUBMITTALS
6.1.1 The submittals required by this Article shall be made by the General Bidder to whom
award of a Contract or subcontract is under consideration, prior to the time established
for execution of the Contract.
6.1.2 Organizational Structure and Corporate Authorization: If the bidder is a corporation,
furnish a certificate of corporate vote authorizing execution of the contract. If the bidder
is a partnership, furnish a list of the names of all partners. If the bidder is a foreign
corporation (incorporated in a state other than Connecticut), submit a copy of the
Connecticut Foreign Corporation Certificate.
6.1.3 The General Bidder will be required to establish to the satisfaction of the Architect and
Owner the reliability and responsibility of the persons or entities proposed to furnish and
perform the Work described in the Bidding Documents.
ARTICLE 7 - PERFORMANCE BOND AND PAYMENT BOND
7.1 BOND REQUIREMENTS
7.1.1 General Contractor: The successful general bidder may be required to furnish a
Performance Bond and a Payment Bond, each of a Surety Company qualified to do
business under the laws of the State of Connecticut and acceptable to the Town of
ROCKY HILL SENIOR/COMMUNITY CENTER MARCH 24TH, 2020 (REV. 3/30/20 – ADDENDUM 01)

Rocky Hill and each in the amount of 100% of the Contract Price. The cost of such bonds
shall be included separately on the Bid Form.
7.2 TIME OF DELIVERY AND FORM OF BONDS
7.2.1 The successful General Bidder shall deliver the required bonds to the Owner prior to the
execution of the Contract between the Owner and the Contractor.
7.2.2 Bonds shall be written on forms bound into the project manual.
7.2.3 The attorney-in-fact who signs the bonds on behalf of the surety, must affix to each bond
a certified and current copy of the power of attorney.
ARTICLE 8 - FORMS OF AGREEMENT
8.1 FORM TO BE USED
8.1.1 The Agreement between the Owner and the Contractor for the Work will be AIA
Document A101-2017, "Standard Form of Agreement Between Owner and Contractor
Where the Basis of Payment is a Stipulated Sum."
8.2 COMMENCEMENT OF WORK AND TIME OF COMPLETION
8.2.1 The selected General Bidder must agree to commence the Work within five business
days after receipt of a Notice to Proceed issued by the Owner, and to substantially
complete the Work within the time for completion stated in the Contract Documents.
8.2.2 Liquidated Damages: In case the Work is not completed within the time specified, it shall
be understood and agreed that the Contractor shall pay the Owner, not as a penalty,
but as liquidated damages, the amount stated in the Contract Documents.
