Libyen im Februar 2011: Diktator Muammar al-Gaddafi kündigt an, er werde die Aufstandsbewegung in seinem Land mit allen Mitteln niederschlagen. Libyen werde „Haus für Haus“ von den „Verrätern, Ratten und Kakerlaken“ gesäubert. Der UN-Sicherheitsrat beschließt angesichts des brutalen Vorgehens des Regimes mit Bezug auf das Prinzip der Schutzverantwortung (Responsibility to Protect, R2P) Sanktionen, ein Waffenembargo und die Überweisung des Falles an den Internationalen Strafgerichtshof. Doch die Regimetruppen intensivieren ihre Offensive, rücken in den aufständischen Osten vor und kündigen eine Entscheidungsschlacht um die Stadt Misrata an. Daraufhin autorisiert der Sicherheitsrat am 17. März die Mitgliedstaaten, die „notwendigen Maßnahmen zu ergreifen“, um Zivilisten zu schützen. Bei der Abstim-mung enthalten sich die ständigen Ratsmitglieder China und Russland, außerdem Deutschland. Die NATO errichtet eine Flugverbotszone und bombardiert die Gaddafi-Truppen. Der Konflikt wird zugunsten der Aufständischen entschieden.

Mit der Libyen-Krise hat sich die internationale Diskussion um die Norm der Schutzverantwortung noch ein-mal intensiviert. Vor zehn Jahren, auf dem Weltgipfel im September 2005, hatte die Völkergemeinschaft R2P als ein Bündel von an Staaten gerichtete Verhaltenserwartungen einstimmig angenommen. Vorausgegangen waren Diskussionen über die Frage, wie Fehlschläge humanitärer Interventionen (wie in Somalia, Bosnien und Ruanda) künftig vermieden werden könnten. Bedenken einiger Staaten, eine R2P-Norm könne zu Missbrauch führen und westliche Staaten zu neokolonialen Abenteuern einladen, sollten verringert werden, indem die Anwendung der R2P auf die Extremfälle Genozid, Kriegsverbrechen, ‚ethni-sche Säuberung‘ und Verbrechen gegen die Menschlichkeit beschränkt wurde. Man verständigte sich da-rauf, dass R2P auf drei Säulen ruht: erstens auf der Verantwortung der einzelnen Staaten, ihre Bevölkerun-gen zu schützen, zweitens auf der Verpflichtung der internationalen Gemeinschaft, die einzelnen Staaten bei der Erfüllung ihrer Verantwortung zu unterstützen und drittens auf der Reaktion der internationalen Gemein-schaft in dem Fall, dass der Einzelstaat nicht willens oder in der Lage ist, seine Schutzverpflichtung gegen-über seiner Bevölkerung selbst wahrzunehmen. Während die erste und zweite Säule als unumstritten gelten können, wird die dritte – die Reaktionsnorm – kontrovers diskutiert. Einige Staaten (darunter Bolivien, Ecua-dor, Kuba, Nicaragua, Malaysia, Sudan), aber auch einige NGOs befürchten, sie könne als Rechtfertigung für militärische Interventionen ohne UN-Mandat missbraucht werden.

Mit der NATO-Intervention in Libyen, die durch die Koordination der Bombardements mit den Aufständi-schen offenkundig das Mandat des Sicherheitsrates überschritt, wurden derartige Befürchtungen erneut genährt. Dass China und Russland nach dem Chemiewaffeneinsatz in Syrien einen entsprechenden Sicherheitsratsbeschluss verhinderten, war auch auf die offensive Interpretation der Libyen-Resolution durch Frankreich, Großbritannien und die USA zurückzuführen. Aber die Libyen-Krise führte auch zu neuen Diskussionsbeiträgen, Präzisierungen und Übereinstimmungen. Brasilien, zu den Skeptikern gehörend, stellte sein Konzept der Responsibility while Protecting (RwP) vor, das militärische Interventionen nur als allerletztes Mittel vorsieht. China forderte unter dem Schlagwort Responsible Protection ebenfalls Regeln für die Anwendung der Schutzverantwortung.

Die sich im Nachgang der Libyen-Krise unter Regierungen, einschlägigen NGOs und interessierten Wissenschaftlern entwickelnden Diskussionen führten zu einer nahezu unüberschaubaren Zahl von Veröffentlichungen. Die vorliegende Bibliographie erlaubt, obschon sie keinen Anspruch auf Vollständigkeit erheben kann, die Diskussion nachzuvollziehen.

In an unprecedented move, a Commission of Inquiry established by the UN's Human Rights Council accused the DPRK government of systematic violations of human rights amounting to crimes against humanity. In so doing, the Commission succeeded in putting human rights in the DPRK on the global agenda. Within months the UN's General Assembly and Security Council had joined the human rights body in examining the issue. This article explains the emergence of this new engagement with human rights in the DPRK, showing its relation to the ‘Responsibility to Protect’ principle. It charts the growing sense of frustration felt at the lack of progress on human rights in DPRK and shows how this was manifested in the General Assembly's decision to pursue the Commission's recommendations and call on the Security Council to take concrete steps. Despite this, however, the article shows that there are powerful obstacles in the way of a more robust international approach to human rights in the DPRK and counsels a less confrontational approach focused on engaging China and building trust within the Security Council. However, these institutions are now in crisis, due in large part to their failure to prevent or prosecute recent acute human rights abuses in Syria. There have been two responses to this crisis: the first assumes that the crisis is caused by the current structures of international governance, in particular the power of the United Nations Security Council (UNSC), and calls for radical reform. The second sees possibilities within the current structure and advocates making R2P and the ICC more closely aligned under UNSC control. The article argues that both responses are mistaken and sets out an argument in favour of refocusing on the complementary nature of each institution. Similarly, R2P works more successfully at preventing conflict and changing expectations of acceptable state behaviour than it does at confronting situations in which large-scale violence has begun. The article argues that the ICC and R2P should focus on ‘positive complementarity’ agendas, with the ICC devoting more resources to assisting states to build legal capacity in order to deter future conflict through stronger domestic criminal systems, and advocates of R2P focusing less on intervention in live conflict situations and more on building within states the capacity and resources to protect their own populations. Im April 1994 begann der Völkermord in Ruanda. In wenigen Wochen starben mehr als 800 000 Menschen. Um solche Verbrechen künftig zu verhindern, stimmten die Vereinten Nationen (UN) 2005 der Schutzverantwortung (Responsibility to Protect, R2P) zu. Damit bekräftigten sie die Verpflichtung aller Staaten, ihre Bevölkerung vor schwersten Menschenrechtsverletzungen zu schützen. Versagen die Staaten dabei, kann die internationale Gemeinschaft eingreifen. Das geschah 2011 in Libyen und der Elfenbeinküste. Der Sicherheitsrat billigte den Einsatz militärischer Gewalt, um die Bevölkerung zu schützen, da beide Staaten ihrer Verpflichtung nicht nachkamen. Ein Beschluss zum Eingreifen in Syrien ist dagegen nicht absehbar. Kritiker sehen darin bereits das Ende der Schutzverantwortung. Umstritten ist jedoch ihre Anwendung, nicht die Substanz. Die konzeptionelle und institutionelle Entwicklung deutet vielmehr darauf hin, dass die R2P sich zunehmend etabliert. Durch die Förderung präventiver Maßnahmen kann dies weiter vorangetrieben werden. Deutschland kann dazu wichtige Beiträge leisten. (SWP-Aktuell)

Der Fall ist deswegen besonders, weil erstmals eine Ermächtigung des Sicherheitsrats zum Schutz von Zivilisten genutzt wurde, um eine funktionsfähige Regierung in einem Mitgliedstaat zu beseitigen und auf diese Weise den Weg für eine politische Neuordnung zu ebnen. Sobald ein repressives Regime Massengewalttaten an der eigenen Bevölkerung verübt, ist es kaum mehr möglich, neutral und unparteilich auf die Konfliktparteien einzuwirken. Zwar hat sich die Staatengemeinschaft auf dem Weltgipfel der Vereinten Nationen im September 2005 zur Responsibility to Protect (R2P) bekannt. Die Kritik am Libyeneinsatz ist aber ein Indiz dafür, wie schwer sich die Staaten weiterhin mit der Übernahme kollektiver Verantwortung tun. Gestritten wird vor allem darüber, ob es zulässig und legitim ist, zu humanitären Zwecken einen Regimewechsel zu erzwingen. Die Studie befasst sich zum einen mit den völkerrechtlichen Spielräumen und Grenzen militärischer Interventionen in R2P-relevanten Bürgerkriegssituationen. Nach diesem Prinzip hat die internationale Staatengemeinschaft zwar nicht rechtlich, jedoch moralisch eine subsidiäre Verantwortung, massenhafte Menschenrechtsverletzungen notfalls auch mit militärischer Gewalt zu verhindern, wenn die Regierung des betreffenden Landes ihrer Schutzverantwortung gegenüber den eigenen Bürgerinnen und Bürgern nicht gerecht wird. Zwar ist die R2P-Diskussion eine Fortsetzung der alten Debatte um die „humanitäre Intervention“, sofern es um den harten Kern der Problematik geht – die Frage eines militärischen Eingreifens. Doch das R2P-Prinzip hat den Diskurs über den humanitär motivierten Einsatz militärischer Gewalt verändert: Im Falle schwerster Menschenrechtsverletzungen ist nicht mehr eine Intervention begründungspflichtig, sondern der Verzicht darauf. Die Berufung auf R2P begünstigt somit tendenziell einen Moralismus, der die Dilemmata humanitär begründeter Kriege eher ignoriert als in ihrer Vielschichtigkeit ethisch reflektiert. Notwendig ist indes eine politisch-ethische Bewertung, die dem komplexen Problem eines menschenrechtlich begründeten Einsatzes militärischer Gewalt gerecht wird. Dazu soll diese Studie einen Beitrag leisten. (SWP-Studie)

This division contributes to the lack of collective action with respect to the situation in Syria, where mass atrocities are being committed regularly. In order to build a consensus about an appropriate prevention strategy, the concerns that were raised by some states about the illegitimate use of R2P in the case of Libya have to be addressed. These concerns focus on issues such as (1) the relation between R2P and regime change, (2) the need for enhanced accountability of the mandate-taker towards the mandate-giver and (3) the role of regional organisations. Improving the legitimacy and effectiveness of mass atrocities prevention requires a clear, consistent and convincing set of guidelines. These guidelines should be jointly developed with emerging democracies such as Brazil, India and South Africa.

Since state actor, in many cases, is the perpetrator of crimes included in RtoP, the role of civil society is indeed crucial to put pressure toward the government to fulfill its responsibility to protect its populations. This article aims to describe Indonesia's position so far in responding to this RtoP principle. It tries not to cover only the government's position, but instead to also delineate the civil society's standpoint, which is an important element particularly, to provide a more comprehensive overview. As based on the latest elaboration of RtoP within the UN Outcome Document (2005) into three strategic pillars, it is interesting to observe whether both sides, the government and civil society are comfortable to recognise all pillars altogether or rather incline to take one or two pillars only. Nevertheless, robust development of civil society in Indonesia, as one of positive implications from process toward democracy has opened ample opportunities for the application of RtoP principle. Local NGOs that particularly focus on human rights issue have demonstrated the ability to put pressure on the government to exercise its responsibility as reflected in te first and second pillars. Since the government has stressed upon the importance of prevention to implement RtoP principle, the involvement of civil society is a must, particularly to carry out the role of early-warning to prevent the outbreak of mass atrocities that fall within the scope of RtoP, which can become another worthy discussion to elaborate. Finally, RtoP is all about implementation. Genuine political will from the government would be needed while partnership with the civil society element is nothing but important. (Pac Rev/GIGA)

As is the case in a number of regions, however, there is a strong sense of caution - if not hostility - in Southeast Asia (and East Asia more broadly) towards the Responsibility to Protect's provision for military interventions as a last resort, in order to protect populations from such harm. Furthermore, there is an accompanying, more general ambivalence towards the perceived relevance of the norm for Southeast Asia, due to the perceived nature and/or intensity of conflicts in the region. Against this backdrop, this article attempts to shed light on a sub-altern discourse in the region that argues that the RtoP is not only relevant, but that it is critical it be operationalised in light of the various manifestations of conflict that plague the region. This article critically explores the spread of R2P in Southeast Asia against the backdrop of recent scholarship on norm localization. It argues that, contrary to some recent analyses, the R2P norm has not been localized in Southeast Asia. Constitutive localization requires the active borrowing of transnational norms by local or regional actors who build congruence with local practices. Although some regional states have used the language of ‘sovereignty as responsibility’ there are few signs that local actors are driving the reception of the norm in the region, nor have they institutionalized it. Rather, outsider proponents are the primary advocates and the norm lacks a champion or well-connected ‘insider’ proponent among regional governments or civil society groups. Second, despite an energetic campaign by advocates, emphasizing consensual and capacity-building activities, many governments are still wary of R2P as a potential threat to sovereignty and regime security. As a result, regional states have taken an ‘à la carte’ approach to R2P, accepting aspects of the R2P agenda that they find least threatening or that support their national interests, while ignoring or quietly resisting those they find challenging. Rather than localization, what we are seeing with respect to R2P in Southeast Asia is a dramatic change in the way outsiders are reframing the norm. (Pac Rev/GIGA)

Why has Japan been unenthusiastic about actively engaging in the R2P discourse? What is the impact, both domestic and international, of incorporating R2P in its diplomatic agenda? In examining these questions, we first identify different perceptions about R2P among policy-makers and civil society in Japan. We then analyze the post-Cold War politics of diplomatic initiatives concerning Japan's human security doctrine. Third, we assess opportunities (and limitations) of synchronizing R2P with Japanese diplomatic agendas. Throughout the article, we argue that rather than distancing itself from R2P, as typically seen in official statements, actively embracing R2P may provide greater benefits for Japan both in terms of enhancing its diplomatic influence and mobilizing domestic political support. More importantly, their inclusion in the Outcome Document has effectively committed its signatories to RtoP as briefly outlined in the Document. The question, however, is whether or not states will hold themselves to this commitment? Among the member-states of the Association of Southeast Asian Nations (ASEAN), the commitment to RtoP under the Outcome Document is clearly at odds with the oft-emphasized commitment to the principle of non-interference that the members of the Association have long identified with. The establishment of new institutional forms, mechanisms, and blueprints within ASEAN, however, create opportunities for introducing emergent norms into the region. The ASEAN Inter-governmental Commission on Human Rights (AICHR) is representative of these new institutional forms. It is the immediate manifestation of the ASEAN declaration of support for the promotion and protection of human rights in the region. Though criticized as “lacking in teeth” especially on the provisions that have to do with the protection of human rights, the AICHR's mandated functions are very generally ambiguous in the way they are presented in its Terms of Reference. These “ambiguities” arguably open up the interpretation of its functions to a more liberal perspective, more so in terms of opening the envelope on the protective functions of the AICHR. In the same context, the same ambiguities in the TOR of the AICHR may be utilized as entrypoints for introducing elements of RtoP into the region. It also illustrates the need to consider a strategy of incremental localization in pushing the normalization of RtoP in Southeast Asia. (Pac Rev/GIGA)

The interview results reveal that Thailand's position on RtoP is mixed. While the country is willing to support the international community implementing RtoP through UN humanitarian operations, it is inclined not to define any of its own internal security problems as an RtoP-type situation. The paper highlights the challenges posed by separatist insurgents in Southern Thailand, and the recent violent political confrontation during April and May 2010, two internal security cases viewed by some observers as RtoP-type situations. But from Thailand's perspectives, almost all those interviewed insist that these situations are matters of internal security affairs. In addition, the preventive dimension of RtoP has not received much attention and has rather been challenged as to how such measures for the prevention of RtoP crimes differ from those more broadly undertaken to achieve the same goals as RtoP, but are not being called as such. Therefore, given the present context, Thailand's position on RtoP will unlikely change for the better if RtoP continues to be advocated as a concept in its current state. (Pac Rev/GIGA)

However, there has not been any significant effort to discuss how the R2P might be applicable to the region and the issue remains a marginal one to ASEAN. However, the adoption of the ASEAN Political-Security Community (APSC) by ASEAN could provide a logical start for the maintraiming of R2P in ASEAN's discourse and practice. Some elements of the APSC appear to have characteristics in common with the R2P principle. While the APSC may provide broad and indirect support for building the capacity of States to recognise, prevent and respond to the situations of conflict, its immediate utility for preventing the four crimes of genocide, ethnic cleansing, war crimes and crimes against humanity nonetheless remains to be seen. International society's relatively decisive responses to recent crises in Côte d'Ivoire and Libya has provoked significant commentary, suggesting that something has changed about the way the world responds to violence against civilians. Focusing on these two cases, this article examines the changing practice of the UN Security Council. It argues that we are seeing the emergence of a new politics of protection, but that this new politics has been developing over the past decade. Four things are new about this politics of protection: protecting civilians from harm has become a focus for international engagement; the UN Security Council has proved itself willing to authorize the use of force for protection purposes; regional organizations have begun to play the role of ‘gatekeeper’; and major powers have exhibited a determination to work through the Security Council where possible. However, the cases of Côte d'Ivoire and Libya also help to highlight some key challenges that might halt or reverse progress. Notably, states differ in the way they interpret mandates; questions are being asked about the UN's authority to act independently of specific Security Council authorizations; the overlap of regional organizations sometimes sends conflicting messages to the Security Council; and there remains a range of difficult operational questions about how to implement protection mandates. With these in mind, this article concludes with some suggestions about how the future challenges might be navigated in order to maintain the progress that has been made in the past decade. At first glance, the latter two elements of this principle seem to require behaviour that contradicts the principle of non-interference. This raises questions as to why R2P was endorsed by Southeast Asian governments and whether it can be localised in a region whose politics are underpinned by non-interference. This article argues that pro-cesses of norm localisation are producing an accommodation between the two principles. This accom-modation involves the formal retention of both principles but the subtle realignment of each in order to make them compatible and make support for both coherent. It is this third explanation, we argue, that best explains the relationship between R2P and non-interference in Southeast Asia: R2P has been revised to limit its capacity to legitimise coercive interference, whilst non-interference is in the process of being recalibrated to permit expressions of concern, offers of assistance and even the application of limited diplomatic pressure in response to major humanitarian crises. Thus, whilst the region remains largely hostile to doctrinal revisions to non-interference, subtle changes are evident in practice. This article outlines the evolution of R2P as a challenge to traditional notions of state sovereignty, provides an overview of non-interference and past efforts to revise the principle, and examines two case studies to understand how the two principles are being accommodated in practice.
