Section 139 Plans A Silver Lining in the COVID-19 Cloud Background: Following the attacks on September 11, 2001, Congress added Section 139 to the US Tax Code which allows employers to make tax-free “qualified disaster relief payments” to assist employees. On March 13, 2020 President Trump declared the coronavirus a national disaster under the Robert T. Stafford Disaster Relief and Emergence Assistance Act. In addition to delaying the tax filing deadline to July 15, 2020, this declaration also activated Section 139 that now allows employers to issue qualified disaster relief payments to their employees. The tax treatment of these “qualified disaster relief payments” is unique since: The employer receives a tax deduction for the payment at the federal and (in most cases) at the state level. The employer does not pay any payroll taxes on these payments (not subject to FICA, FUTA, and in most states, SUTA). 1 The employee does not recognize these payments as income and the payments are not reported on Form W-2, a Form 1099, nor are they treated as self-employment income. These payments are not subject to any annual nondiscrimination testing and no annual IRS reporting is required (such as Form 5500). The eligibility for this program is determined by the employer and can be as broad or as selective as the employer wishes. The Section 139 funding amount does not need to be a uniform amount across the company’s employees. 1 States generally either use the federal definition of wages for state income tax purposes or have their own definition that excludes qualified disaster relief payments.

• TheemployeedoesnotrecognizethesepaymentsasincomeandthepaymentsarenotreportedonFormW-2,aForm1099,noraretheytreatedasself-employmentincome.

• ThesepaymentsarenotsubjecttoanyannualnondiscriminationtestingandnoannualIRSreportingisrequired(suchasForm5500).

• Theeligibilityforthisprogramisdeterminedbytheemployerandcanbeasbroadorasselectiveastheemployerwishes.

• TheSection139fundingamountdoesnotneedtobeauniformamountacrossthecompany’semployees.

• Theemployer(oracontractedadministratorsuchas24HourFlex)doesnotneedtosubstantiatetheexpenseorcollectreceipts.

• Thereisnolimitontheamountorthefrequencyofthequalifieddisasterreliefpayments.

WhattypeofexpensequalifiesunderSection139?First,theexpensemustnotbecoveredbyinsuranceandtheemployeereceivingthereimbursementmustnotalsolistthisexpenseasataxdeductionorbereimbursedfortheexpensethroughsomeothermeanssuchasaflexiblespendingaccount.(Nodouble-dipping.)Second,theexpensemustbeincurredaresultofaqualifieddisaster.Third,theexpensemustbeincurredbytheemployeeoranymemberofhisimmediatefamily(spouseandeligibledependents).Afterthesehurdlesarecleared,thelistofeligibleexpensesisquiteextensiveandcaninclude:

• Over-the-countermedications• Medicalexpenses• Funeralexpenses• Handsanitizer• Homedisinfectantsupplies• Additionaltechnologyandsuppliesthatenabletheemployeetoworkfrom

homeincluding,computers,officeequipment,printer,supplies,internet,utility,cellphones

• Childcareincurredbecausethechildisnotallowedtoattendschool• Costsassociatedwithhomeschoolingincludingcomputer,internet,school

supplies,tutoring,andeducationalmaterialsPleasenotethatunlessSection139isactivated,payingtheaboveemployeeexpenseswillresultintaxableincometotheemployeeandadditionalpayrolltaxestotheemployer.Let’slookatanexample:

TheemployeralsobenefitsbygrantingthisvaluablebenefittotheemployeesincetheemployerdoesnothavetodeclaretheSection139grantasincometotheemployeethussavingthematchingFICA.Intheexample,theemployerFICAsavingswouldbe$76.50.2TheMechanics–HowthePlanWorksThroughtheadvancedtechnologyavailablethrough24HourFlex,aSection139accountcanbeestablishedwithadebitcardattachedtoitthatcanonlybeusedatcertaintypesofmerchants.EachmerchantthatenrollsintheVisaorMasterCardsystemisassignedaMerchantCategoryCodeandthe24HourFlexdebitcardcanbestructuredsothatitcanonlybeusedatthesetypesofmerchants.Further,eachSection139employeeaccountwillbegivenafundinglimit,establishedbytheemployer,andthisamountdoesnotneedtobeuniformforallemployees.TheSection139accountinformationwillbeavailabletotheemployeeviathe24HourFlexmobileappandthroughasecureonlineaccount.Theemployerwillalsohavecompleteaccesstoallplaninformationviathesecure24HourFlexportal.

2AnypotentialsavingsofFUTAandSUTAareusuallynotrelevantsincemostemployeesarewellabovetheFUTAandColoradoSUTAtaxablewagebasesof$7,000and$9,000respectively.NotethattheFICAwagebasein2020is$137,700andiftheemployeehasalreadyexceededthiswagebase,therewillonlybesavingsontheMedicaretaxof2.9%whichhasnowagebase.
