SESSION OF 2007 Act 2007-42 141 No. 2007-42 AN ACT HB 1295 Amending the act of April 9, 1929 (P.L.343, No.176), entitled, as amended, “An act relating to the finances of the State government; providing for the settlement, assessment, collection, and lien of taxes, bonus, and all other accounts due the Commonwealth, the collection and recovery of fees and other money or property due or belonging to the Commonwealth, or any agency thereof, including escheated property and the proceeds of its sale, the custody and disbursement or other disposition of funds and securities belonging to or in the possession of the Commonwealth, and the settlement of claims against the Commonwealth, the resettlement of accounts and appeals to the courts, refunds of moneys erroneously paid to the Commonwealth, auditing the accounts of the Commonwealth and all agencies thereof, of all public officers collecting moneys payable to the Commonwealth, or any agency thereof, and all receipts of appropriations from the Commonwealth, authorizing the Commonwealth to issue tax anticipation notes to defray current expenses, implementing the provisions of section 7(a) of Article VIII of the Constitution of Pennsylvania authorizing and restricting the incurring of certain debt and imposing penalties; affecting every department, board, commission, and officer of the State government, every political subdivision of the State, and certain officers of such subdivisions, every person, association, and corporation required to pay, assess, or collect taxes, or to make returns or reports under the laws imposing taxes for State purposes, or to pay license fees or other moneys to the Commonwealth, or any agency thereof, every State depository and every debtor or creditor of the Commonwealth,” providing for Commonwealth employees group life insurance; further providing for the State System of Higher Education and for budget implementation; providing for general budget implementation and for 2007-2008 budget implementation and restrictions on appropriations for funds and accounts; and making a related repeal. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. The act of April 9, 1929 (P.L.343, No.176), known as The Fiscal Code, is amended by adding a section to read: Section 1508. Use and Appropriation of Unused Commonwealth Funds.—(a) Whenever the Governor has declared a disaster emergency, the Governor may transfer any unused funds which may have been appropriated for the ordinary expenses of the State government in the General Fund to such Commonwealth agencies as the Governor may direct to be expendedfor relief of disaster in such manner as the Governor shall approve, and the funds are hereby appropriated to the Governor for such purposes. The total of the transfers under this subsection shall not exceed twenty million dollars ($20,000,000) in any one fiscal year except by action of the GeneralAssembly. (b) Whenever the Governor shall have proclaimed a disaster emergency under 35 Pa. C.S. § 7301(c) (relating to general authority of Governor), the Governor shall have power to transfer any unused funds

The General Assembly of the Commonwealthof Pennsylvaniaherebyenactsasfollows:

Section 1. The act of April 9, 1929 (P.L.343,No.176), known asTheFiscalCode,is amendedby addingasectionto read:

Section 1508. Use and Appropriation of Unused CommonwealthFunds.—(a) Wheneverthe Governorhas declareda disasteremergency,the Governor may transfer any unusedfunds which may have beenappropriatedfor the ordinary expensesof the Stategovernmentin theGeneral Fund to such Commonwealth agenciesas the Governor maydirectto be expendedfor reliefofdisasterin suchmannerastheGovernorshall approve,and thefunds are herebyappropriatedto the Governorforsuch purposes.The total of the transfersunder this subsectionshall notexceedtwenty million dollars ($20,000,000)in any onefiscalyearexceptbyaction oftheGeneralAssembly.

which may have been appropriated for the ordinary expensesofgovernmentin the GeneralFundto such Commonwealthagenciesas hemaydirect to be expendedfor reimbursementsasprovidedin 35 Pa.C.S.§ 7705(a) and (b) (relating to specialpowersof local agencies).Suchreimbursementsshall be made in accordancewith and to the extentpermitted by regulations issued by such agency or agenciesas theGovernor may designate to administer the reimbursementprogramsestablishedby 35 Pa.C.S.§ 7705(a) and (b). The total ofsuch transfersshall neverexceedfive million dollars ($5,000,000)in any onefiscalyearexceptbyaction oftheGeneralAssembly.

Section1.1. The act is amendedby addinganarticle to read:

ARTICLEXV-ACOMMONWEALTHEMPLOYEESGROUPLIFE INSURANCE

Section1501-A. Definitions.Thefollowing words andphraseswhen usedin thisarticle shall have

the meaningsgiven to them in this section unless the context clearlyindicatesotherwise:

“Annualpay rate.” The basepay rate annualizedand, in the caseofhourly eligible employees,computedon thebasisofexpectedwork hours.

“Department.” The Department of General Services of theCommonwealth.

“Employees.” A permanent,continuouslyscheduledemployeeoftheexecutive, judicial or legislative branch of the Commonwealth,itscommissions,boards,departmentsandauthorities.The term shall includemembersoftheGeneralAssembly.

“Life insurance.” Life insuranceprocuredunderthisarticle.“Secretary.” TheSecretaryofGeneralServicesoftheCommonwealth.

Section1502-A. Grouplife insurance.(a) Procurementbydepartment—Exceptasprovidedundersubsection

(b), the department,with theapproval ofthe Governorandwith theadviceof the InsuranceCommissioner,shall procurefrom one or more lifeinsurancecompanies,authorizedto do businessin this Commonwealth,apolicyorpoliciesofgroup life insurancecoveringeligible employees.

(b) Legislative branch.—Uponwritten notice to the secretary, anindividualagencyof the GeneralAssemblymayprocurelife insuranceforits eligible employees,including membersof the GeneralAssembly,inplaceof life insuranceavailable undersubsection(a). Any life insuranceprocuredunderthis subsectionshall,ata minimum,meetthe requirementsofsections1503-A,1504-A,1505-A,1506-A and1508-A.

(c) Eligibiity.—An employeeunder subsection(a) or (b) in activeserviceshall beeligiblefor life insuranceunderthisarticle if the employeehas completedthree months’ continuousservice as an employeeundersubsection(a) or (b). Temporaryemployeesshall notbe eligible.Section1503-A. Amount

(a) Schedule.—Theamountof life insurancefor anyeligible employeeshall be basedon the eligible employee’sannual pay rate from theCommonwealthin accordancewith a scheduleto besubmittedannuallybythesecretaryforpublication in thePennsylvaniaBulletin.

(b) Reduction.—Theamount of life insurancefor any eligibleemployees70 yearsofage or older shall be one-halfthe amount of lifeinsuranceprovidedundertheschedulepublishedundersubsection(a).

(c) Changein amount—Anychangein the amountoflife insurancemadenecessaryby a changein payshalltakeeffecton thenextsucceedingprogram anniversary.Section1504-A. Contributions.

(a) Eligible employeepayment—Exceptasprovidedundersubsection(b), each eligible employeecoveredby life insuranceshall pay, eitherdirectlyor by meansofa payrolldeductionauthorizedby the employee,thecostofthe insurancein an amountasmaybedeterminedfrom-time-to-timeon the basisof the actual total costsofthe life insurancepolicyorpoliciescontractedfor by the Commonwealth.

(b) Commonwealthpayment—TheCommonwealthmayagreeto payall oranyofthecostsfor life insurance.Section1505-A. Termination.

(a) Cessation.—Exceptasprovidedundersubsection(b), ljfe insuranceshall, subjectto any conversionprivilege, ceaseupon the occurrenceofanyof thefollowing:

(1) Terminationofemployment(2) Nonpaymentofanycontributionduefrom an eligible employee.(3) After12continuousmonthsofunpaidabsence.

(b) Disabiity.—Lifeinsuranceshall be continuedfor employeeswhoterminateafter becomingpermanentlyand totally disabledwhilecoveredunderthisprogram.Section1506-A. Automaticcoverage.

(a) Provisionfor coverage.—Anypolicy oflife insuranceshallprovidethatall eligible employeesshall be automaticallycoveredcommencingonthedatetheyfirst becomeeligible.

(b) Notice.—Anemployeedesiringnotto becoveredby life insuranceshallgive written noticeon a prescribedform to the employee’semployingoffice that the employeedesiresnotto be insured.If the noticeis receivedbeforetheemployeebecomesinsuredunder thepolicy, the employeeshallnot be insured. If the notice is receivedafter the employeebecomesinsured,the employee’sinsuranceunderthepolicy will ceaseeffectivenesswith the endofthepayperiod duringwhich the noticeis receivedby theemployingoffice.Section1507-A. Secretaryto beagent

(a) Agent—Exceptfor life insuranceprocuredundersection 1502-A(b), the secretaryis exclusivelyauthorizedand shall have the duty to

transact all businessnecessaryfor the purpose of contracting forinsuranceunderthisarticle.

(b) Commission.—Thelife insurancecompanyor companiesfromwhom life insurance is procured by the secretary shall computecommissionsin accordancewith their standardpracticefollowed in othersimilar plans. The commissionsshall be paid to the secretaryto offsetadministrativeand other expensesincurred in the administrationof theinsuranceplan.Section1508-A. Applicabilityofinsurancelaws

All life insuranceshall be subjectto the laws of this Commonwealthrelating to insurance.

Section 2. Section 1737-B of the act, addedJuly 5, 2006 (P.L.296,No.66),is amendedto read:Section1737-B. StateSystemof HigherEducation.

I(Reserved).JThefollowingshall apply to executiveauthorizationsfrom theKeystone

Recreation,Park and ConservationFundfor the StateSystemofHigherEducation:

(1) Notwithstandingtheprovisionsofsection12(b)ofthe actofJuly2, 1993 (P.L.359,No.50),knownas theKeystoneRecreation,ParkandConservationFundAct,forfiscalyear2006-2007, theentireamountofthe transferundersection1106-C(d)ofthe actofMarch 4, 1971 (P.L.6,No.2), known as the Tax Reform Code of 1971,shall bepaid to theStateSystemofHigherEducation.

(2) (Reserved).Section 3. Section 1720-C(c)of the act, addedJuly 5, 2006 (P.L.296,

No.66), isrepealed:Section 1720-C. StateGamingFund.

1(c) Transfers for Volunteer Fire Company GrantProgram.—Coñimencingwith Fiscal Year 2006-2007 and continuingannually thereafter,the sumof $25,000,000shall be transferredfromthe StateGamingFundto theGeneralFundandis herebyappropriatedto the VolunteerFire CompanyGrantProgramon a continuingbasis.I

Section1 712-E. ExecutiveOfficesThefollowingshall apply to appropriationsfor theExecutiveOffices:

(1) PennsylvaniaCommissionon Crime andDelinquency.Fundsremainingafter applicationofsection202 ofa GeneralAppropriationActfor theappropriationfor grants-in-aidfor intermediatepunishmentprograms shall be distributed to counties based on the followingformula:

(i) Fifty percentshall be basedon theproportion of offendersdiverted from the county prison systemto county intermediatepunishmentprograms

(ii) Fifty percentshall be basedon the proportion of offendersdivertedfrom the State correctional systemto the countyprisonsystem.(2) Grantsfor specializedprobation services, including school-

(c) Prohibition.—No contract àr written agreementbetween theCommonwealthand a hospitalplan corporation or professionalhealthservicesplan corporationmaybeenteredinto relating to thedisbursementor spendingof the economicbenefits,proceeds,savings,funds or othermoneyresultingfrom the merger, consolidationor other acquisition ofcontrol ofa hospitalplancorporationorprofrssionalhealth servicesplancorporationuntilfundsareappropriatedundersubsection(d).

(d) Appropriation.—Nofund or moneymay be transferred or paidfrom the accountunlessappropriatedby the GeneralAssemblyfor health-relatedpurposes.Section1717-E. DepartmentofAging(Reserved).Section1 718-E. DepartmentofAgriculture.

The following shall apply to appropriationsfor the DepartmentofAgriculture:

(1) No expendituresmaybe madefrom the appropriationfor thepaymentto the StateFarm ProductsShowFund or from the StateFarm ProductsShowFundfor anyactivitiesassociatedwith thePAFEunlesssuch activities takeplace on the premisesof the Farm ShowComplex,Harrisburg, Pennsylvania.

(2) The departmentmay makeallocations of appropriationsfordevelopmentandoperationofan openlivestockshow,for planningandstaging of an open dairy show and for promotion and holding ofannual local, regional and State 4H clubs and Future Farmers ofAmericadairy showsas it deemsappropriate,to an associationwhosepurposes are in accord with the purposes and intent of theappropriations Allocationsunder thisparagraphshall be usedfor thedevelopmentandoperationofLivestock,Dairy andJuniorDairy Showsin the PennsylvaniaFarm Show Complex,provided that the fundsallocatedby the departmentshall only be usedfor the specific itemsapprovedbythedepartmentin advance.

Section1 719-E. DepartmentofCommunityandEconomicDevelopmentThe following shall apply to appropriationsfor the Departmentof

CommunityandEconomicDevelopment:(1) No morethan20% offundsappropriatedfor grantsunder the

act ofMay 20, 1949 (P.L.1633,No.493), known asthe HousingandRedevelopmentAssistanceLaw, shall be allocatedto any onepoliticalsubdivision.

The following shall apply to appropriationsfor the DepartmentofPublic Welfare:

(1) Any rule, regulation or policy for the Federal or Stateappropriationsfor thecash assistance,outpatient,inpatient, capitation,behavioral health, long-term care and SupplementalGrants to theAged, Blind andDisabled,Child Care andAttendantCare programsadoptedby theSecretaryofPublic Welfareduring thefiscalyearwhichaddsto thecostofanypublic assistanceprogram.shallbe effective-onlyfrom andafterthe dateupon which it is approvedas to the availabilityoffundsby theGovernor.

(2) FederalandState medicalassistancepayments.Thefollowingshall apply:

(i) (Reserved).(ii) (Reserved).(iii) (Reserved).(iv) (Reserved).(v) (Reserved).(vi) (Reserved).(vii) Thefollowing shall apply to eligibility determinationsfor

servicesundermedicalassistance:(A) Unlessthe custodialparentor legally responsibleadulthas

provided to the department, at application or redetermination,information required by the departmentfor inclusion in theannualreport underclause(B), nofundsfrom an appropriationfor medicalassistanceshall be usedtopayfor medicalassistanceservicesfor a childunder21 yearsofage:

~) who hasa SupplementalSecurityIncome(SSI)levelofdisability; and

(II) whoseparental incomeis not currently consideredintheeligibility determinationprocess(B) The departmentshall submit to the Public Health and

Welfare Committeeof the Senateand the Health and HumanServicesCommitteeofthe HouseofRepresentativesan annualreport includingthefollowingdata:

(I) Familysize.

(II) Householdincome.(III) Countyofresidence.(Th9 Lengthofresidencein this Commonwealth.(J~9Third-partyinsuranceinformation.

(ii) Thedepartment,upon approvalof thesecretary,maytransferFederalfundsappropriatedfor CCDFBG Child Care Assistancetothe CCDFBG Child Care Servicesappropriation to provide child-care servicesto additional low-incomefamilies, provided that thetransferoffundswill notresultin a deficit in theappropriation. Thesecretaryshallprovidenotice ten daysprior to a transfrr under thissubparagraph to the chairman and minority chairman of theAppropriationsCommitteeof theSenateand the chairman and theminoritychairmanoftheAppropriationsCommitteeoftheHouseofRepresentatives.(2) Federaland Statemedicalassistancepayments.Thefollowing

shallapply:(i) Whenmakingpaymentsfor medicalassistanceoutpatientor

capitation services,the departmentshall notrequire a recipient toobtaina physicianreferral in order to receivechiropracticservices

(ii) Nofundsappropriatedfor approvedcapitationplansshall beusedto pay a provider who fails to supply information in a formrequiredby the departmentin order tofacilitate claimsfor Federalfinancial participation for servicesrenderedto general assistanceclients.

(iii) For fiscal year 2007-2008, additional Federal and Stateinpatientfundingis includedtoprovidefor CommunityAccessFundpayments.Paymentsto hospitalsfor CommunityAccessFundGrantsshall be distributedunder theformulasutilizedfor thesegrants infiscalyear2006-2007.

(iv) QualifyingState-relatedacademicmedicalcentersshall notreceiveany lessfundingthanreceivedfor thefiscalyear2004-2005

(v) Funds appropriatedfor medical assistancetransportationshall only be utilized asa paymentof last resortfor transportationfor eligible medicalassistancerecipients.(3) (Reserved).(4) Women’sserviceprograms.Thefollowingshall apply:

(i) Fundsappropriatedfor women‘s serviceprogramsgrants tononprofit agencieswhoseprimaryfunctionis toprovidealternativesto abortion shall be expendedto provide services to women untilchildbirth andfor up to 12 monthsthereafter, including food,shelter, clothing, health care, counseling, adoption services,parenting classes, assistancefor postdelivery stress and othersupportiveprogramsandservicesandfor relatedoutreachprogramsAgencies may subcontract~with other nonprofit entities whichoperateprojectsdesignedspecificallyto provideall or a portion ofthese services Projects receiving funds referred to in thissubparagraphshall notpromote,referfor or perform abortionsorengage in any counseling which is inconsistent with theappropriation reftrred . to in this subparagraph and shall bephysicallyandfinanciallyseparatefrom anycomponentofanylegalentityengagingin suchactivities.

(ii) Fundsappropriatedfor women‘s serviceprogramsshall beused for women‘s medical services, including noninvasivecontraceptionsupplies

(iii) Federalfunds appropriatedfor TANFBGAlternativestoAbortionshall be utilizedsolelyfor servicesto womenwhosegrossfamily incomeis below185%oftheFederalpovertyguidelines(5) . Behavioral health services. All available intergovernmental

transfrr fundsappropriatedto augmentappropriations,includingprioryearcarryoverfunds,shallbespentprior to Commonwealthfunds

(6) CountychildrenandyouthprogramsThefollowingshallapply:(i) No more than 50% of funds allocated from the State

appropriation for county children and youth programs to eachcounty shall be expendeduntil each county submits to thedepartmentdata for the prior State fiscal year, and updatedquarterly, on the unduplicatedcaseloads,unduplicatedservicesandnumberofcaseworkersby countyprogram.Data shall be submittedin a form acceptableto the departmentA copyofthe data shall besentto the chairmanand minoritychairman ofthe AppropriationsCommitteeof the Senateand to the chairman and the minoritychairman of the Appropriations Committee of the House ofRepresentatives

It is the intent of the GeneralAssemblythatcountiesdo not experienceany adversefiscal impactdueto thedepartment’smaximizationefforts.(7) TANFtransition. Fundsappropriatedfor Child WelfareTANF

(8) Behavioral health servicestransition. The department,uponapproval of the secretary, may transfer Federal and State fundsappropriatedfor behavioral health servicestransition to counties toprovidefor children and youth programs, child abuse and neglectpreventionormedicalassistancecapitation.

(9) Community-basedfamily centersNo funds appropriatedforcommunity-basedfamily centersmaybe consideredaspart of the basefor calculation of the countychild welfare needs-basedbudgetfor afiscalyear.

Section1792-F. Seniorjudges.(a) Health benefits.—Subjectto subsection(b),appropriationsfor the

Superior Court, Commonwealth Court, courts of common pleas,communitycourts, magisterialdistrict judges,the PhiladelphiaMunicipalCourt and the PhiladelphiaTraffic Court may be usedto payfor healthbenefitsfor senior judges working as active or senior judges for aminimumof75 daysin theprior calendaryear.

(b) Limitation.—Seniorjudgesofthecourtsofcommonpleasshallnotbe assigned unless adequatefunds are appropriated to providecompensation.A seniorjudgeassignedin excessofexistingappropriations

shall becompensatedfrom theappropriationfor theSupremeCourtSection1793-F. TransferoffundsbySupremeCourt

Fundsallocatedfrom the appropriationfor the BenFranklin Centersfor fiscal year2007-2008shall not be less than the allocationfor fiscalyear2006-2007.Section1 715-G. TobaccoSettlementFund.

(a) Deposits—(1) Notwithstandingsections303(b)(3) and(4) and306 ofthe act of

June26, 2001 (P.L. 755,No.77), knownas the TobaccoSettlementAct,thefollowingshall apply:

(i) For fiscalyear2007-2008,$14,033,000ofthefundsderivedunder section 303(b)(3) of the TobaccoSettlementAct shall bedepositedinto the TobaccoSettlementFund. This subparagraphincludes $2,783,000 depositedin the fund under section 1715-C(a)(1)(i), butnotappropriatedin theact ofJuly2, 2006 (P.L.1640,No.2A),knownasthe GeneralAppropriationActof2006.

(ii) For fiscalyear2007-2008,$48,062,000 of thefundsderivedunder section 303(b)(4) of the TobaccoSettlementAct shall -bedepositedinto the fund~This subparagraphincludes $8,062,000deposited in the fund under section 1715-C(a)(1)(,), but notappropriatedin the GeneralAppropriationActof2006.

(iii) For fiscal year 2007-2008, one-fourth of the moneyappropriatedundersection306(b)(1)(iii) of the TobaccoSettlementAct maynotbe expended,transferredor lapsedbutshall remain inthefund.

(iv) For fiscal year 2007-2008, one-third of the moneyappropriatedunder section306(b)(1)(vi) of the TobaccoSettlementAct maynot be expended,transferredor lapsedbut shall remain inthefund.(2) Money depositedinto thefund underparagraph (1) shall be

appropriatedfor health-relatedpurposes If applicable, the amountappropriatedunder thisparagraphshall be matchedby appropriatedFederalaugmentingfunds.(b) Allocation.—Fundingfor local programsunder section708(b) of

the act of June 26, 2001 (P.L. 755, No.77), known as the TobaccoSettlementAct, shall beallocatedasfollows:

(1) Thirtypercentofgrantfunding toprimary contractorsfor localprogramsshall beallocatedequallyamongeachofthe67 counties.

(2) The remaining70% ofgrantfundingto primary contractorsforlocalprogramsshall be allocatedon aper capita basisofeachcountywith apopulationgreaterthan60,000. Theper capitaformula shall beappliedonlyto thatportionof thepopulationthat isgreaterthan60,000for eachcounty.

(3) Budgetsshall be developedbyeachprimary,contractorto reflectserviceplanning and expenditures in each county. Each primarycontractor will ensurethat servicesare available to residentsofeach

countyand must expendthe allocatedfunds on a per-county basispursuanttoparagraphs(1) and (2).

(4) TheDepartmentofHealthshall compilea detailedannualreportofexpendituresper countyand the specificprogramsoffered in eachregion. This report shall be made available on the DepartmentofHealth’spublicly availableInternetwebsite60 daysfollowingthe closeofeachfiscalyear.

(5) During the third quarterofthefiscalyear,fundswhichhavenotbeen spent within a service area may be reallocated to supportprogrammingin thesameregion.

Section1 716-G. CommunityHealthReinvestmentRestrictedAccount(a) Establishment—Thereis establishedin the State Treasury a

restrictedreceiptsaccountin the TobaccoSettlementFundto beknown asthe CommunityHealth ReinvestmentRestrictedAccountInterestearnedon moneyin theaccountshallremain in theaccount

(b) Agreementon community health reinvestment—Eachcalendaryear, a corporation under 40 Pa.C.S. Ch. 61 (relating to hospitalplancorporations) or 63 (relating to professional health services plancorporations) that is a party to the Agreementon CommunityHealthReinvestmententeredinto February2, 2005,by theInsuranceDepartmentand the Capital Blue Cross,Highmark, Inc., HospitalServiceAssociationofNortheasternPennsylvaniaandIndependenceBlue Crossandpublishedin the PennsylvaniaBulletin at35 Pa.B. 4155 (July 23, 2005)shallpaytothe accountthe amountcalculatedfor suchcalendaryearin section5 ofthe agreement,publishedat35Pa.B. 4156.

(c) Appropriation.—Themoneyin the account,including all interestearned, is appropriated to the Insurance Department to be used inaccordance with the agreementon community health reinvestmentdescribedin subsection(b).Section1717-G. Health CareProviderRetentionAccount(Reserved).Section1 718-G. (Reserved).Section1 719-G. RestrictedReceiptAcCounts.

(a) Deduction of certain appropriations—Notwithstandingtheprovisionsofsection504(c)(1) of the act ofJune27, 2006 (1st Sp.Sess.,P.L.1873,No.1), knownas the TaxpayerReliefAct,fundsappropriatedtothe PennsylvaniaGaming Control Boardfrom the State Gaming Fundshall be deductedfrom theamounttransferredto the Property TaxReliefReserveFund undersection504(b)ofthe TaxpayerReliefActand loanedto the PennsylvaniaGaming Control Boardfor paymentof the board’sadministrativeandoperatingexpensesfor thefiscalyearcommencingJuly1, 2007.Fundsloanedto theboardunderthissectionshall be repaidfromthe accountsestablishedunder4 Pa.CS.§ 1401 (relating to slot machinelicenseedeposits)in accordancewith subsection(b).

(b) Assessmentfor repayment—Notwithstandingtheprovisionsof 4Pa.C.S. § 1901.1 (relating to repaymentsto State Gaming Fund), thePennsylvaniaGaming Control Board shall assessslot machinelicenseesfor repaymentof funds transferred and loaned to the board undersubsection(a) from the StateGamingFundin accordancewith 4 Pa.C.S.§1402 (relatingto grossterminalrevenuedeductions)for repaymentto thePropertyTaxReliefReserveFundat suchtimeasat least11 slotmachinelicenses have been issued and 11’ licensed gaming entities havecommencedthe operation of slot machines. The board shall adopt arepaymentschedulethat assessesto eachslotmachinelicenseecostsforthe repaymentofamountsappropriatedunder this section in an amountthat isproportional to eachslot machinelicensee’sgrossterminalrevenue.’

(c) Propertytaxrelief—(1) Notwithstandingtheprovisionsofsection504 of the Taxpayer

ReliefAct, until the loan to the PennsylvaniaGamingControl Boardundersubsection(a) is repaid,theSecretaryoftheBudgetis authorizedtoprovidefor property tax reliefundersection503(d) of the TaxpayerReliefAct, regardlessofwhetherthe amountdepositedin the PropertyTax ReliefReserveFund is less than required by section 504 of theTaxpayerReliefAct

(2) Notwithstandingtheprovisionsof4 Pa.CS. §1901.1,beginningJanuary1, 2011, if the Secretaryof the Budgetdeterminesthat themoneysin the Property Tax ReliefReserveFund are neededforpropertytax relief the secretaryshall notify the PennsylvaniaGamingControl Board and upon notification, the board shall immediatelyassesseachslot machinelicenseefor the repaymentof the loan in anamount that is proportional to each slot machine licensee’sgrossterminalrevenue.(d) Otherappropriationssolelyfrom assessment— ‘

“issuedand II slotmachinelicenseshavebeenissuedandII” in enrolledbill.

(1) All fundsfor the operationof the PennsylvaniaStatePolice,DepartmentofRevenueandAttorneyGeneralare appropriatedsolelyfrom an assessmenton grossterminalrevenuefrom accountsunder4Pa.CS.§ 1401 in an amountequalto thatappropriatedby the GeneralAssemblyfor fiscal year 2007-2008. The PennsylvaniaStatePolice,Attorney Generalor Departmentof Revenueshall not assessanycharge,fee,costofoperationsorotherpaymentfroma licensed-gamingentity in excessof amountsappropriatedfor fiscal year 2007-2008unlessspecjfically authorizedby law.

(2) This subsectionshall notapply to any voluntarypaymentmadeby a new slot machinelicenseein accordancewith ,similar paymentsvoluntarilymadeby existinglicenseesSection5. Repealsare asfollows:

(1) TheGeneralAssemblydeclaresthattherepealunderparagraph(2)is necessaryto effectuatetheadditionof Article XV-A of theact.

(2) The act of September26, 1961 (P.L.1661,No.692),known astheStateEmployesGroupLife InsuranceLaw, is repealed.

(3) The GeneralAssemblydeclaresthat the repealsunderparagraph(4) arenecessaryto effectuatetheadditionof section 1508 oftheact.

(4) Theprovisionsof 35 Pa.C.S.§~7307 and7705(c)arerepealed.Section6. The additionof Article XV-A of the act is a continuationof

the act of September26, 1961 (P.L.l661, No.692), known as the StateEmployesGroup Life InsuranceLaw. Except as otherwiseprovidedunderArticle XV-A, all activities initiated underthe State EmployesGroup LifeInsuranceLaw shall continueandremainin full force andeffect andmaybecompletedunderArticle XV-A. Orders, regulations,rules and decisionswhich weremadeunderthe StateEmployesGroupLife InsuranceLaw andwhich arein effect on theeffectivedateof section 1.1 of this act shallremainin full force andeffectuntil revoked,vacatedor modifiedunderArticle XV-A. Contracts,obligationsandcollectivebargainingagreementsenteredintounder the State EmployesGroup Life InsuranceLaw are not affectednorimpairedby therepealof the StateEmployesGroupLife InsuranceLaw.

Section 7. The amendmentof section 1737-B of the act shall applyretroactivelyto July1, 2006.

Section8. This actshall takeeffectimmediately.
