1. Location

The Queens Square is a large and popular neighbourhood shopping centre located in Hemel Hempstead. The subject premises are located in a prominent and central location, between existing businesses, Nelsons Butchers and Lloyds Pharmacy. No. 36 is a ground floor shop.

2. Description

The property has a net internal floor area of approximately 91 square metres, with a shop frontage of approximately 5.6 metres (18 feet). The current shop layout includes two connected retail areas, separate kitchen, two store rooms and two toilets.

The property has previously benefitted from a gas supply, although this is not currently connected (any connection would be at the tenant’s expense).

3. Tenancy

The premises will be let under the main heads of terms attached. It is expected that offers of rent will be in excess of £14,700 per annum plus VAT. This figure is given as a guide only and, if necessary, you should consult your own Professional Advisors.

4. Rates

The tenant will be liable for business rates payable on the premises. The current Rateable Value is

£11,000 and the standard business rates payable (2021/22) at a uniform business rate of 0.51p is

£5,632 per annum exclusive. This figure does not take into account any relief deductions which may

specifically apply to the tenant (i.e. small business or retail discount). The tenant is advised to make

5. Use

The previous use of the property was a hairdressing salon, and the current planning classification for the premises is E (Commercial, Business & Service). The use of the premises is to be agreed with the Landlord and must also be in accordance with any statutory consents. The Council has a management policy for its neighbourhood parades that has a preference not to duplicate existing trades within the shopping centre, if at all possible. Fixtures within the Property There are certain trade fixtures within the property to include the wall mounted mirrors and styling stations, and back wash unit & fixed chair, that are not owned by Dacorum Borough Council but a third party. These may be available to purchase by separate negotiation or will be removed, by the third party, and made good prior to the grant of any new tenancy. 7. Applicants may be asked to attend an interview on-line. The selected applicant will be required to provide satisfactory references. In the case of a person new to business, or if satisfactory references cannot be provided, a guarantor and/or a rent deposit will also be required. 11. MAIN HEADS OF TERMS FOR LEASE SUBJECT TO CONTRACT

Term: 5, 10 or 15 years from a date to be agreed. LTA 1954: The Lease is to be outside of the Landlord and Tenant Act 1954 -

s24-28 (Security of tenure provision) to be excluded. Rent: £ (to be confirmed on acceptance of bid) per annum plus VAT. The

rent is payable quarterly in advance by Direct Debit. Rent Free Period: None Rent Review: Rent to be revised upwards only at the end of every fifth year if

occupying on a 10 or 15 year lease. Insurance: Tenant to pay the Council’s annual premium for effecting insurance

cover of the premises. The annual premium (for 2021/22) has been estimated at £634 including insurance premium tax.

Repairs & Maintenance: Tenant to be responsible for all internal repairs and maintenance to

the premises including external repairs and decoration to the shop front, all doors, windows and glass therein. This responsibility includes putting items into good repair if found in disrepair at the outset of the lease.

Alterations: External & Structural alterations are strictly prohibited. Any other

alterations (including non-structural alterations) are subject to Landlord’s consent not to be unreasonably withheld.

Service Charge Provision: Tenant to pay a fair and reasonable apportionment of the service

charge. Such apportionment to be determined by the Landlord’s Surveyor, to cover the Landlord’s costs of repair, renewal, maintenance etc. of the common parts and shared facilities including cleaning of the Estate and the building which are used in common with others. As a guide, the estimated service charge budget (2020/2021) for a similar property is £395 plus VAT.

Outgoings: Tenant is to pay all rates, taxes and any other outgoings. Use: To be agreed with the Landlord and in accordance with Statutory

consents. Current classification is use class E. Alienation: The tenant is not to charge, assign, sublet or part with possession of
