Welcome to the 2015 Southwest and Midcontinent Oil & Gas Awards commemorative Yearbook

hese were the 3rd Annual Awards for these regions and the organizations and individuals in this journal were acknowledged by the award’s judging panel to have excelled in their work in 2014, whilst also focusing on the industry core values of Health & Safety, Environmental Stewardship and Corporate Social Responsibility. The Oil & Gas Awards champion best practice and recognize organizations operating in the upstream and midstream sectors of the industry. The media and members of the general public do not distinguish between the different sectors of the industry, which is why the Awards incorporate categories for all parts of the upstream and midstream sectors. The absent mindedness of an individual on an assembly line can have dramatic consequences months later should equipment fail when being used in the field. This reflects badly on the industry as a whole, we therefore think it is extremely important that best practice is championed from top to bottom and the Awards are a platform to promote to the press and public the great work being done. The Oil & Gas Awards are unique in highlighting the incredible innovation and commitment to positive industry development and expansion, rebutting traditionally negative mainstream coverage. The Awards celebrate corporate success twinned with organization’s commitment to health & safety, environmental stewardship and corporate social responsibility.

In this 3rd year for the Awards in these regions we had the 2nd Industry Summit during the day immediately before the Awards gala dinner in the evening. In this yearbook you can read coverage from the Industry Summit keynote presentations and speaker panels discussing the challenges the industry faces. Dale A. Petroskey assumed the position of President and CEO of the Dallas Regional Chamber (DRC) on April 1, 2014. He works with the Board, staff, and more than 2,000 member companies to increase economic prosperity and enhance the quality of life throughout the region. The DRC focuses on economic development initiatives, improving education at all levels, and setting public policy direction designed to maintain a healthy business climate in North Texas.

Mr. Petroskey brings to the Chamber a strong background in public policy, strategic communications, and non-profit management, having held leadership positions in all three sectors – public, private, and nonprofit – for more than 30 years.

Early in his career he worked 18 years in Washington, D.C., where he served as Chief of Staff to Congressman Bill Goodling (PA), Assistant White House Press Secretary to President Ronald Reagan, Assistant Secretary for Public Affairs at the U.S.

Department of Transportation under then-Secretary Elizabeth Dole, and as Senior Vice President of Mission Programs at the National Geographic Society.

From 1999 – 2008, he served as President of the National Baseball Hall of Fame and Museum in Cooperstown, New York, and later as Executive Vice President of Marketing and Community Development for the Texas Rangers, and Vice President of Public Affairs for Occidental Petroleum Corporation, the nation’s fourth largest energy company.

A graduate of Michigan State University, Mr. Petroskey is a member of numerous Boards, including the Dallas Citizens Council, Dallas Medical Resources, the Dallas Convention and Visitors Bureau, Educate Dallas, The Alfalfa Club of Washington, D.C., and Clayton Kershaw’s Challenge. He is also a Senior Fellow at the Center for the Study of the Presidency and Congress in Washington, D.C. Mr. Petroskey and his wife, Ann, live in Dallas and have three grown children.

A fifth generation Texan, Don’s family has a strong legacy of hard work and faith in God.

Don’s family started out in Texas as farmers in Ellis County, working the land by hand. In 1924, Don’s grandfather started an automobile business – which the Huffines built into a thriving company that is still owned and operated by Don’s older brother. Don’s own business, Huffines Communities, is one of the largest real-estate developers in the Dallas/Fort Worth area.

Don and his wife Mary Catherine have raised four sons and one daughter. Hard work and faith are Don’s legacy: they have guided him to become an uncompromising advocate for liberty and personal responsibility while preserving family values.

As your State Senator in the 84th Texas Legislature, Don served on the Administration Committee, the Business & Commerce Committee, the Education Committee, and as Vice-Chairman of the Transportation Committee. keynote addressMatt Koch of the U.S. Chamber of Commerce sounded out why oil and gas executives must stay engaged in the industry.

The U.S. oil and gas industry is in a tough situation currently with prices of crude oil well below $40 per barrel as of late November 2015. Considering the countless challenges facing the domestic energy business – most prominently, OPEC’s manipulation of the international market and a longstanding ban on energy exports – there’s no need to add stifling regulations to the long list of existing rules that must be followed during this crucial time.

“Global demand is going to increase for oil and gas and energy, most of it in developing nations,” Matt Koch, Vice President of the U.S. Chamber of Commerce’s Institute for 21st Century Energy, said during his keynote presentation. “We have a tremendous need for oil and gas going up, and all at a time when there’s goals being set to reduce greenhouse gas emissions and big targets being put on the fossil fuel industry.”

There are plenty of rules regulating the oil and gas industry on the books as it is, but Koch pointed out two additional mandates recently enacted or about to be enforced. One is President Obama’s mandate to reduce all carbon emissions

by 80 percent or more by 2050. There also is the threat of the EPA reducing the current National Ambient Air Quality Standards from 75 parts per billion (ppb) to 65 or 70 ppb.

Even with these daunting stumbling blocks facing the oil and gas industry, Koch couldn’t help but be optimistic about the domestic energy sector’s outlook. The United States is now the world’s largest oil producing nation after experiencing a 40 percent increase in oil and gas projections since 2008. And that has led to a 60 percent reduction in imports, as well, shifting the geopolitical and economic landscape around the world.

“We’re not just a consumer anymore – we’re a producer now,” Koch said. “It’s changed the whole geopolitics of what’s happening around the world. It’s changed how the industry is being perceived in the United States. And it’s coming at a time when we’re facing tremendous oversupply, we’re facing policies that are trying to move us away from fossil energy and we have to try to determine what we’re going to do about it.”

To help oil and gas executives, Koch broke down the strategies his institute has developed into six digestible sections represented by each of the vowels.

“A” is for access, which the industry solved through hydraulic fracturing and horizontal drilling of unconventional plays. Koch told the audience the Monterey Shale in California, which has yet to be tapped, potentially holds double the resource of North Dakota’s Bakken Shale. However, in October 2015, the U.S. Geological Survey’s new study said the Monterey Shale holds just 21 million barrels of oil that could be recovered by fracking, as opposed to the estimated 13.7 billion U.S. government estimate in 2011.

There is still offshore oil and gas to be had, Koch said, and the federal government still has banned access to a great deal of those resources. The U.S. Bureau of Ocean Energy Management estimates of oil and gas resources in undiscovered fields on the outlier continental shelf total about 89 billion barrels of oil and 398 trillion cubic feet of gas.

Exports is represented by the letter “E,” and the ban on energy exports in the wake oversupply in the domestic market has been scrutinized greatly in the last few years. That scrutiny will continue to intensify as the price of oil continues to dwindle due to the oversaturation of the U.S. supply.

Koch said there is plenty of support for a bill that would lift the ban that has been in place for over four decades. The bill already has passed the U.S. House of Representatives, and a broad energy infrastructure bill that includes mandating an end to crude oil export limits is on the agenda for the next Congressional session, according to Platts.

“We’re trying to tout it as not only good for industry, but when you look at the tremendous benefits it has to American consumers, to our economy, but also benefits it has for changing global landscape even further,” Koch said. “We need exports. We need to help with our oversupply problem in the industry. This is going to help with the global energy picture and it is going to continue to help with not only our dominance, but funding and keeping the energy mechanisms moving in this country.”

Infrastructure – the “I” installment – was a heated topic when Koch delivered his remarks as the oil and gas industry awaited the decision on TransCanada’s permit to build the Keystone XL pipeline (it was denied in November 2015). Koch railed against environmentalists who opposed any new infrastructure projects considering the 2.5 million miles of natural gas and 180,000 miles of oil pipeline in the United States already, according to his statistics.

“It’s now having an effect on other projects,” Koch said. “We have to get engaged on the local level and convince people what the benefits are and how they operate safely.”

The money left on the table by the delay or stymying of energy projects is staggering. According to research conducted by the U.S. Chamber of Commerce a few years ago, 350 energy projects stalled within a five-year period represented half a trillion dollars of investment – and 48 percent of projects were for renewable energy.

“O” is for “outreach,” which Koch said needs to vastly improve in order to fight disinformation about the oil and gas industry. Koch said there were 464 actions fighting fracking at the municipal level in the last few years alone. Koch asked people in the oil patch to discuss the issues with friends and relatives not just for the power that comes with numbers, but because they are the true experts.

“You’re much more familiar with the issues,” Koch said. “Talk to folks who don’t necessarily work in the oil patch and ensure that they understand why it’s important to the nation and your communities.”

“Unfair regulations” occupied the “U” entry for Koch, which will be particularly difficult for states including Texas, Oklahoma, Colorado, New Mexico and a large swath of the Mountain West region, where communities are facing population booms. With the NAAQS mandates set to reach unattainable levels, the time is now to make sure the federal government doesn’t impose regulations that could take years to reverse and millions of dollars to uphold.

“What’s even more challenging is there isn’t enough technology available to bring the emissions down to a level that is achievable,” Koch said. “What’s even more difficult is looking at areas of Yellowstone National Park that don’t meet attainment. What are they supposed to do?”

Although engagement with the federal government is a must, Koch used the sometimes “Y” vowel to reiterate “why” this is such a critical time in the U.S. oil and gas industry’s history. There are countless benefits to nurturing a thriving domestic energy industry in the United States, and the misconception that it must come at the cost of environmental sensitivity must be debunked.

“All this great economic growth and all that we’re doing in the oil and gas business doesn’t have to come at the expense of environmental progress,” Koch said. “Don’t let people put that box and get pushed in a corner that progress is at the expense of the environment.”

One of the most challenging aspects of the oil and gas industry is to remain environmentally friendly while maintaining safety and profit margins. Water costs are at all-time highs, sand disposal is costly and time-consuming, and some companies halt drilling because they have no solution for exceeding emission quota limits.

Sand X is a stand-alone application that uses eco-friendly technology to clean the sand; rendering it non-hazardous and safe for any reuse application. This proprietary process separates oil as it cleans and recycles flow-back water to be stored and reused, reducing water costs and safety risks in the drill out and flow back.

Super Loop closes the loop on hazardous gas, reducing 99.8% of emissions by sending it to a flare or containment system, eliminating on-site disasters due to deadly

and explosive hazardous gases, keeping the work place safe and in compliance. Companies using radioactive tracers a utilize the Sand X and SuperLoop combo to the retrieve radioactive materials and contain them separately for safe disposal and in some cases, reuse.

Sand X and Super loop, result in a lower costs and a much safer workplace for crew members, while saving money and helping companies remaining in compliance.

leadershipDecision-makers at U.S. oil and gas firms must make difficult choices in the face of adversity to remain profitable.

When the cyclical oil and gas industry hits a bust period, companies often react in one of two ways – stand pat and wait for the economy to right itself, or make the necessary adjustments to remain profitable in the downturn, which often leads to high revenues when the market returns to normalcy.

Panelists during the Industry Summit agreed that a slow period like this in the oil and gas industry is no time to remain stagnant. Carol Van Zandt Jones and Bill Ward shared how their respective companies are coping with the low commodity prices, but they agreed that executives at energy firms must take the reins during these trying times to make sure their businesses see the other side of the downturn.

One thing oil and gas decision-makers must do is come to terms with operating with the realities of the low-cost market instead waiting for commodity prices to return to a comfortable level. Most in the oil industry would agree that trying to remain profitable with WTI crude sitting at about $41 per barrel, as reported by CNBC in November, isn’t ideal. However, Ward admitted the oil industry has a tendency of doing itself in through greedy intentions by demanding unrealistic prices for oil.

“The magical number we always talk about it is, if we get into $65 or $70 [per barrel], we should be happy folks,” Ward said. “But we always kind of are our own demise. When we run at $100 a barrel, everybody is happy, but if we could ever get everybody on the same line to say, ‘Let’s dial in at $70 to $75 and we’ll all be happy troopers,’ it’d be great. But it’s that free enterprise system where people want to get more and get bigger.”

The companies who grew too large too quickly when oil cost around $100 per barrel may find themselves struggling the most in 2015. Those who will survive this downturn, according to Ward, are the companies who can make a profit with pricing at half that figure or even lower.

“As a team, you need to look at your strategy and where you want to be and the cost consequences,” Ward said. “Margin-wise, how can you be more efficient? Anybody can

drill a well at $100 a barrel. When you get to 50 bucks a barrel, we’ll see how good he is a drilling that well because of costs.”

Moderator Robert Clarke, Research Director, Global Unconventional Oil and Gas for Wood Mackenzie, said picking one price, setting an operating budget and hoping commodities reach that mark isn’t a sound plan for success.

“You can’t just pick this one planning price now and say, ‘This is what I’m going to use for the next couple of years because sometimes the answer is, ‘I don’t know. I need to do all sort of sensitivities to help figure out how we’re going to navigate the waters for the next 24 to 36 months,’” Clarke said.

Unfortunately, cutbacks often are a necessary evil during slowdowns, which means there are bound to be layoffs during difficult times. In fact, Forbes magazine reported in October that the collapse in oil prices had cost over 200,000 jobs internationally thus far.

“Within our organization, you end up with the talent that is going to get you through these turbulent waters,” Van Zandt Jones said. “If you need more talent, there’s a lot readily available.”

However, there are two sides to the employment issue during a recession – retaining key employees and dealing with layoffs.

Van Zandt Jones believes periods like this without a great deal of work to be done is an ideal time to develop the next wave of leadership within an organization.

“Capture those people that are good managers, good sales teams – just good talents – and work with them during these turbulent times,” she said. “And then when things pick up – and they will eventually – then you’ve got a really strong, sound base.”

For a small company like VZ Environmental, Van Zandt Jones realized her firm had to come up with a recruitment tool to better compete with larger entities for employees. Her company partnered with a larger firm that required

oilfield experience for new hires, and VZ Environmental sought employee candidates new to the oilfield who needed that experienced. VZ Environmental would bring these employees up to speed on the oilfield for one year before they moved to a role with the larger partner.

Ward agreed that retaining key members of the workforce is imperative during downturns like this because many of these talented employees will not return to the oil and gas industry once they leave. He said this is especially important considering many other sectors of the economy like construction are in much better shape than oil and gas, and technical experts can get jobs in these industries easily.

In order to keep technical employees on staff, Ward suggested cross-training the workforce to make sure they can take on multiple tasks.

“If you go into this for about a two-year cycle, they’re going to find something else,” Ward said. “You try to take somebody that’s doing one thing and try to diversify them into other areas like project management or reverse engineering.”

During the question-and-answer portion of the session, Dr. Rich Haut, Program Director, Energy Production, for the Houston Advanced Research Center, discussed the difficulties many companies encounter with employees from the millennial generation, citing that these younger workers often do not like face-to-face interactions while preferring working through screens only.

Ward said although this can be the case, he has come to realize the millennial generation of the labor force is a competitive one, and he is more than willing to share tips of the trade with new people entering the industry who want to seal deals.

“They like to win, so when I sent them out with some of my other folks and they see how that experienced folk is getting the deal done through interactions, they pick up on it,” Ward said. “The sooner I can get them to do a deal, they get hooked on this is how we do it.”

Companies also should take the downturn in the oil and gas industry as an opportunity to weed out employees who may not be the right fit for a particular firm. Ward said he prefers having employees willing to engage in cross-training as much as possible versus those who are inflexible.

“It’s a body count, and you get some good ones, and you get some bad ones,” Ward said. “In this day and time, I’d rather have somebody who is willing to roll up their sleeves and not whine and complain about, ‘Well, that’s not my job description.’ I’d rather have someone who says, ‘What can I do for you? Where do you need me to be?’”

Along with relationships with employees, panelists stressed leaders must maintain relationships customers, suppliers and vendors, as well, during bust cycles in the oil and gas industry. Ward suggested educating vendors and customers alike about the struggles a company has making appropriate margins. Both sides of the operation typically will amend their needs accordingly.

“I think it’s real important that we educate our vendors and educate our customers when there are cost-cutting methods,” Ward said. “If you got a good customer and you’ve got an open relationship and you’re losing money, or you’re not making as much margin, or you’re over extended – the best way is to try to be as honest with your good customer as you can. Explain to them, ‘Here’s how we operate, and here’s why we’re asking for this.’”

health & safetyOil and gas operators should take it upon themselves to improve their health and safety culture before regulators do it for them.

There are many factors that speak to a company’s willingness to prioritize health and safety when working within the oil and gas industry. Naturally, a commitment to the overall well-being of employees, the environment and members of the communities where companies operate are at the top of the list.

But when health and safety measures can be quantified into savings for companies, as well, there is an extra incentive for businesses to stay on top of the latest advancements in staying out of harm’s way.

“In Texas, we see more and more awareness from landowners and society in general amongst the operators and drilling contractors that operations have to be sustainable and that prevention is cheaper that solving problems afterward,” Dave Nygaard, Director of KatchKan, said at the panel discussion on health and safety. “We’re trying to do what we can to educate about the options that are out there for prevention rather than remediation. The same goes for the safety side.”

This discussion was of particular importance at this year’s Industry Summit considering the rise in fatal work injuries for the oil and gas sector in 2014. According the U.S. Department of Labor’s Bureau of Labor Statistics, the number of fatal work injuries in the oil and gas extraction industries rose to 142 in 2014 from 112 in 2013, a 27 percent jump.

The underlying theme in the remarks from the panelists was that creating a culture of health and safety at any company begins and ends with the highest levels of leadership. Also, culture is not something that will take hold in within a company’s operations overnight, so leaders should not abandon a plan to embrace new philosophy if the workforce doesn’t respond immediately.

“As leaders, we have the greatest impact of changing culture,” said Stephen Chaplin, Vice President, Health and Safety and Environment for Aveda Transportation and Energy Services. “There’s no magic wand – just hard work and committed leadership. It takes, in my experience dealing with companies, about three to five years to really see a shift in culture.”

One way leaders can get the culture shift started with better success is to implement systems and processes that build health and safety practices directly into operations. Chaplin said this is especially important for Aveda, which is constantly acquiring complementary businesses to add to its capabilities in Canada and the United States. He typically looks for performance indicators that help determine whether an acquisition’s health and safety standards live up to Aveda’s loft standards, including the number of incidents, employees turnover and the engagement of leadership.

“I start to evaluate people on their actions and how they’re committed,” Chaplin said. “When improving culture throughout the organizations we’ve acquired, the areas I look at are focus on proper onboarding, consistency in our approach and systems, common messaging from the leadership, and expectations and accountability.”

Companies are turning to technology to stay compliant with various local, state and federal health and safety regulations, as well. Technology startups like OmniCert are filling the void for solutions through its mobile app, which gives clients and contractors access to the certification records of laborers in the field through any device with the software.

“The idea of health and safety and culture go hand in hand with increasing safety transparency,” said Vance Elmore, President of OmniCert. “I think if you can do that on an industry level, then you could really start to hone in on whether these accidents and incidents are really coming from a lack of training, or are they coming from a lack of safety culture.”

The goal for OmniCert’s technology is to offer a “Big Brother” perspective that keeps all parties involved in a project honest with regard to safety training and certifications.

“With that little bit of pressure knowing somebody can check you at any given moment, I think that there’s a little bit more demand to get those trainings and certifications renewed,” Elmore said. “And with that, I truly feel that you can revolutionize safety culture as an industry.”

This is especially important as all signs indicate OSHA and other regulating bodies intend to increase regulations in the near future according to Elmore, especially in California, where OmniCert is based. Responding to a question from the audience, Elmore admitted his fledgling business would only grow from additional regulations in California as well as throughout the United States.

“Specifically in California, we don’t see any slowdown at all in regulation – in fact, it’s only going to get worse and worse with all of the governmental regulation and OSHA and EPA regulation,” Elmore said. “I would like to see more prescriptive regulation, but for my own business, being able to handle those regulations better while you are in the field or out of the field is really the key to success for us.”

In fact, in November, the Pittsburgh Post-Gazette reported Congress included a provision in the budget bill signed by President Obama that would hike maximum penalties by about 78 percent.

Chaplin said he believes companies in the oil and gas industry should focus more on their internal practices as a good corporate citizen rather than have the government regulate their operations any further.

“I would rather see the company create more best practices in terms of where we want to go for safety rather than have a regulator come by and mandate,” Chaplin said. “That goes back to a cultural perspective – if we’re doing what we’re supposed to be doing, the regulators shouldn’t have to come by and implement.”

One way Aveda is able to maintain compliance with U.S. regulations is by taking the mandatory audit certification standard used in Canada and applying it to all its operations in the United States. Major gas firms must reach a minimum of 80 percent on this systems-based audit in order to work in Canada.

“What I’m doing now on our U.S. side is taking that same audit and applying across our U.S. operations to see that there is consistency on both sides, and that really drills into operations, interviews, talking to employees and looking into systems,” Chaplin said. “Let’s not be overly regulated,

but let’s rely on ourselves to focus on the best practices.”

Along with focusing on best practices instead of relying on regulating agencies to tell oil and gas firms how to operate, Moderator Dr. Richard Haut, Program Director for the Houston Advanced Research Center, also reminded the audience that oil and gas companies must do a better job of promoting their efforts to be a safe and environmentally friendly corporate citizen. Chaplin agreed, and also said Aveda could improve in this regard, as well.

“Unfortunately, what I see with most companies is we typically don’t engage the public until something has happened in a negative way,” Chaplin said. “Companies typically don’t do a good job being proactive about the good things they are doing.

“I would say we’re probably being more public with the company’s that we’re working for, but really talking about the leadership aspects, the systems that we’re implementing, and where we’re trying to get to as an organization for building on the systems and processes, we’re starting to engage more to get the messaging out,” Chaplin said.

panel Discussion: Don’t waste waterWater is the lifeblood of hydraulic fracturing, and the oil and gas industry has taken steps to reduce cost and eliminate waste in the face of depressed commodity prices.

Long before low commodity prices brought the oil and gas industry to a standstill, sourcing water was a problem on the forefront of countless industry leaders throughout the United States. The Midcontinent and Southwest regions have been hit particularly hard as these typically arid regions have been forced to divvy water even more carefully than usual, with local, state and the federal governments implementing more conservation regulations and costs rising as resources become scant. And there is no way around it – the energy industry is water-intensive.

“The energy needs water,” said John Tintera, President of the Texas Water Recycling Association. “Just look at unconventional. That’s intuitively obvious to the most casual of observers in hydrofracturing. But also don’t forget nuclear power plants – they need water. Let’s not forget hydroelectric dams – they need water. There’s virtually no part of the energy grid system that does not in some way have a water demand. And that water has become competitive.”

In some parts of the country, drought conditions combined with the insatiable demand for water have converged to create desperate situations. For example, Tintera cited a proposal to ship 9 billion gallons of water annually to California from Alaska. In October, USA Today reported U.S. Rep. Janice Hahn arranged an exploratory meeting with several officials after reading about the concept in the newspaper in August, calling it “an idea worth exploring” since California’s drought is in its fourth year an encompasses 97 percent of the state.

The situations in Texas and Oklahoma might not be as dire, but government officials and private industry alike are planning for the possibility that the water situation in those states may head that way. No matter how bad things get, however, the conservation, recycling and repurposing of water will come down to economics, according to Bryan Mitchell, Vice President/Oklahoma Area Manager for CH2M. In Oklahoma specifically, the agriculture industry is the largest consumer, but adding energy to the fray poses its own challenges.

“The water distribution of use in Oklahoma is pretty unique,” Mitchell said. “We have a very large industry

demand for agriculture, whether it be crops or livestock, and they are the largest water user. Energy uses a tremendous amount of water for hydroelectric.”

However, energy water use isn’t the best place to focus. According to Mitchell, energy uses a fraction of the water resources in Oklahoma, especially when compared to the agriculture industry.

“In Oklahoma, water use by the energy sector really uses a very small sliver of the total assets of water use within the state of Oklahoma, and people tend to forget that,” Mitchell said. “But its importance is very astounding. You see the price of oil drop, everybody slows down, and state’s gross production tax revenues and everybody is all of a sudden feeling the pain – all from this group that uses a very small amount of water.”

Mitchell said there is a balance to be struck between municipal and industry water usage, and that common ground can only be found through communication with all interested parties.

Tintera’s organization has been tasked with helping find ways to conserve and reuse water in a cost-effective manner in Texas. He reminded the audience that the Texas oil industry disposes of 7 million barrels of water into ejection wells annually, and if the water could be treated and the right regulatory framework existed to allow it to be used, Texas would have a new source of water instantly.

After a study conducted by the Texas Railroad Commission focused on reused water for oilfield purposes, the Texas Water Recycling Association launched its “frack to tap” initiative. Now that the technology exists where any constituents added to frack water can be removed, the long-term goal is to create the regulatory framework to foster the ability to use some of the fracking flowback and produced water in areas afflicted by droughts, according to Tintera.

In early 2014, the North America Shale Blog by law firm BakerHostetler reported Apache personnel disclosed that it cost the company between $2 and $2.50 per barrel to dispose of water in the Barnhart, Texas, area. It also only cost 29 cents per barrel to recycle it.

“In much of west Texas are major old oilfields that have a significant amount of produced water in them,” Tintera said. “That water is coming up to the surface, and I would say with today’s technology, salty water is no longer just a waste. It can be considered an asset.”

While the oil and gas industry isn’t entirely against the regulation of its operations, overregulation is a clear and present danger, according to Tintera. He cited the lawsuit by environmental groups – led by Earthworks – filed against the EPA demanding regulations to stop oil and gas companies from dumping drilling and fracking waste in ways that are harmful. Tintera says that would affect about 100 hazardous wastes streams in Texas, but new rules could also affect 10,000 disposal wells for water from the oil and gas industry.

“You can see this would be a chokehold on the oil and gas industry, so they’re very concerned about this and the politics of that and the geopolitics of that,” Tintera said. “This is completely intertwined right up there with the price of oil. On a state basis, there are some significant actions that can be taken. On a national basis, there are, but we always have to remember we’re working in a geopolitical realm when it comes to energy prices, commodities that make up the energy world, and the role that water plays in front of them.”

With the drought conditions Texas has faced recently, Moderator Dr. Rich Haut, Program Director for the Houston Advanced Research Center, reminded the audience of how fortunate Texas is because of the number of desalination plants located in the state. This has helped add to the amount of drinking water available to state residents, whether they know it or not.

“They’re scattered throughout Texas,” Haut said. “Even inland, people just don’t recognize that we’re taking that brackish water and turning it into drinking water.”

The Texas Railroad Commission is on the forefront of regulatory framework that permits the use of brackish water for human consumption, but that is not the case in every state, Haut warned. According to the panelists, if the rest of the country to catch up with Texas, it will come down to cost, perception and regulatory willingness.

“Those are the three aspects of it right now that really curtail our ability to frankly solve the water problems that exist in the arid parts of the United States, of which at least 1/3 of the United States has that problem,” Tintera said.

Oklahoma specifically is looking at ways to use disposed water more frequently, according to Mitchell, and he said the perception of the oil and gas industry’s usage will be the biggest barrier moving forward. This is especially true for areas of the state with increased seismic activity, whether or not E&P activities are the true culprit for movement.

“They are looking at ways of using as much as you can so you’re not competing with all the other needs of the state,” Mitchell said. “For induced seismicity, the ironic thing is for the events going on fairly commonly these days is in an area not having a lot of E&P activities. Induced seismicity stirs up a lot of emotion, but in Oklahoma, you’re either a true believer or you’re trying to get your hands around it. Perception will get you.”

cheap oil — who wins? who loses? Not many winners are coming out of the current bust cycle in the oil industry, which means the rebalancing of the market may happen toward the end of 2016.

The world oil market is in an unfavorable position today with commodity prices continuing to drop. However, Bruce Bullock, Director of the Maguire Energy Institute at Southern Methodist University, said he believes North America is in an enviable position to take advantage of the lag in the market – if the U.S. industry receives cooperation.

“I’m afraid we’ve got a unique opportunity now that we may miss,” Bullock said during his keynote presentation. “Mexico is opening its access; Canada is our largest source of imports of oil; we have the ability now to export oil ourselves but we don’t have the law; and we have the potential to form a North American common market amongst ourselves. But because of policies in Washington that insult our neighbors and are very anti-hydrocarbon, this is a unique moment in time that I’m afraid we’ll miss.”

OPEC believed it would win the battle over market manipulation when it decided its member countries would maintain production despite a glut of excess supply due to the U.S. shale revolution. This has forced to the United States to serve as the swing producer, which Bullock believes the nation can handle.

“They’re looking now to the U.S. shale industry instead of themselves to be the swing producer,” Bullock said. “And the good news is that, albeit with some pain, the U.S. industry is probably well-positioned to perform that role if we have to. The shale industry has gotten very efficient, and we can ramp production up and down relatively quickly if we have to.”

That’s good news for the domestic industry considering experts have varied opinions about the sector’s return to normalcy. Bullock said his best guess is the price of oil will return to about $60 a barrel by the third or fourth quarter of 2016, but that is the roughest of estimates based on the market rebalancing. In November 2015, the U.S. Energy Information Administration reported global oil inventory builds in the third quarter of 2015 averaged 1.6 million barrels per day, down from 2 million in the second quarter.

“If that were to occur quickly, then prices would recover quickly,” Bullock said. “If we’re sitting here this time next

year with that same 2 million barrel a day overhang, then we’ll still be sitting at $45 a barrel.”

Although the United States is hurting, it is not breaking, Bullock said, due to a relatively strong domestic economy. The same can’t be said for the rest of world oil market, which has seen a number of major players brought to their knees as oil prices have plummeted.

According to Bullock, countries that can rely on a large sovereign wealth fund like Saudi Arabia, Kuwait and the United Arab Emirates can ride out the downturn a little longer than other oil-producing nations, but there’s no telling how long they’ll be willing to do that. For example, Bullock said Saudi Arabia already has spent about a third of its $1.5 trillion reserve since July 2014.

This ability to stand pat in the face of declining oil prices may fracture OPEC, however. Venezuelan society is in shambles for a variety of reasons, one of which is its dysfunctional oil industry. In December, Vox reported the oil sector represents 25 percent of the country’s GDP, but production has barely increased since 2004.

Nigeria may have a large oil play in the Lake Chad Basin, according to Al Jazeera, but disputes with the nation of Chad over ownership as well as Boko Haram’s insurgency has quelled efforts to drill.

As far as non-OPEC nations are concerned, they also are facing dire times. Bullock reported China’s economy has not grown at the expected 12 percent or more rate, which has decreased the projections for their energy consumption. Russia has an economy in shambles due to its reliance on oil – Bullock said 20 percent of the country’s GDP comes from oil, 50 percent of the government’s revenue stems from oil and 70 percent of Russia’s exports are represented by oil.

“I think OPEC would still like to see a little more pain on this side of the Atlantic, and we may see that in the first and second quarter of next year before we see a whole lot of production reductions out of them,” Bullock responded. “But the fact that Russia is willing to come to the table I think is huge – maybe the first crack in the wall.”

Along with a desperate need for affordable energy resources internationally, the domestic market is making exports of crude oil appear even more attractive – assuming the federal government ever lifts the ban.

Gasoline consumption in the United States has dwindled for a number of reasons, according to Bullock. For one, fuel economy on vehicles has improved drastically after consumption had stayed relatively flat primarily due to increased fuel economy standards on automobiles.

Also, the millennial generation – especially those who live in metropolitan areas with public transportation options – are not buying and driving cars the way previous generations have.

“It is not a generation that is tied to its cars the way we all were,” Bullock said. “With the whole sharing economy, Uber is their way to get around, and they’re just fine with that. Their identity is not tied to their cars. It is not a driving generation certainly in the way we were, and going forward that certainly is going to have more impact in the next few years.”

energy/natural resources committee education panelTexas state representatives Paddie and Wu agree on HB 40 in principle, but they want there are fundamental differences on where they stand on the information regarding seismic activity studies.

Two hot-button issues staring down the oil and gas industry in Texas may seem like they don’t have much in common. Seismicity is a matter of finding new ways to dispose of frack flowback, of course, and House Bill 40 makes it more difficult to place bans and moratoriums on fracking activities.

However, the common thread between the two issues is the information – or lack thereof, or misinformation – the general public has regarding how the oil and gas industry truly affects their day-to-day lives.

That is truly the case for HB 40, which was passed this year to give exclusive jurisdiction to the state to regulate oil and gas operations and express preemption of local regulation of oil and gas operations. This bill was prompted by the fracking ban voted into law in Denton, Texas, in 2014, which Gene Wu, Texas State Representative for District 137, said forced the legislature into action.

Wu, a member of the House Committee on Energy Resources, admits industry came away with a victory with this new law, especially in smaller towns with budget limitations. Wu said he was fine with not allowing municipalities the right to ban fracking, but when litigation comes into play, small towns could be in trouble.

“My big concern with all of this is that it’s going to enmesh the state and the companies into endless rounds of litigation,” Wu said. “For a city like Houston, with basically an endless litigation budget, I don’t really care. For a small town in east Texas that has a total city budget of about $50,000 a year, they’re going to have to fold or not be able to deal with it.”

Chris Paddie, State Representative for District 9 and Vice Chairman of the House Committee on Energy Resources, took a different view of the final result of HB 40. He said the bill strikes a proper balance between regulation and free enterprise once the municipalities realized this was a good as it was going to get for their efforts. Texas already has a regulating body in place – the Texas Railroad Commission – which oversees oil and gas, so allowing municipalities to have more of a say in the matter would create duplicity.

The crux of the issue, according to Paddie, is that oil and gas companies were being punished for the misdeeds of the cities. For example, the reason for many fracking bans is because the wells were in violation of setback laws, putting them too close to residential areas. However, despite not working on wells for years, urban sprawl had led developers to build communities in close proximity to these job sites. When operators came back to work on land they had leased years earlier, protests would begin.

Paddie said he is working on a related bill for the next legislative session that addresses this conflict.

“We need to make sure the cities are doing what they should be doing in the way of being responsible as they grant variances to setbacks,” Paddie said. “In many cases, the setback is in place there, and to approve of a new subdivision, they’ll approve a variance.

“Then there needs to be some notification involved with that, some education of those who choose to build a home in that neighborhood so they know what they’re getting into,” Paddie added.

Robert Clarke, Research Director, Global Unconventional Oil and Gas for Wood Mackenzie, admitted notifications would be an interesting solution for many reasons, especially during the downturn in the oil and gas industry.

“With drilling budgets being what they are now and that activity is being scaled back, or if urban development continues and the company wants to come back and drill in three or four years, once it’s already built up, you could have more friction there,” Clarke said.

Paddie’s idea is to include any setbacks and variances related to oil and gas operations during the title search of any property up for sale. With the oil and gas industry in a period of slow or no activity, this could be a good time to push this legislation through, Paddie said.

“If I’m going to buy a lot in this community, there would be a way for that to show up on the report itself,” Paddie said. “As a homebuyer or a homebuilder, then I knew I was within a certain setback of potentially a well. That, to me, would be incumbent on the city to do that, and also the same would be if they were granting a variance.

“At a minimum, it would make the cities take responsibility for the fact that they contributed to this problem because they gave a variance,” Paddie continued. “They can’t just point their finger at the industry and say, ‘It’s their fault.’”

Speaking on seismicity, Paddie and Wu had quite different opinions on the severity of the issue as well as the information produced on the issue itself.

Paddie said he believes the seismic activity is not directly connected with injection wells despite reading the Southern Methodist University-led study that directly linked the combination of gas field fluid rejection and removal as the most likely cause of earthquakes in 2013 and 2014 near Azle, Texas.

He added that the issue has been muddled – much like the events that led to the fracking ban in Denton – due to all the information coming from a variety of sources, including those who worked directly on the SMU study.

“We know that this could be a natural occurring situation because no situation is the same, and they can’t say with certainty whether or not it is caused by any activity related to the oil and gas industry,” Paddie said. “You have all these different groups that have their ‘research’ and opinion and really smart people that have ‘Ph.D.’ at the end of their name write these papers and make a whole lot of assumptions.”

Wu disagreed with everything Paddie stated about seismicity. He argued that the SMU study may not be perfect, but it was scientifically sound when it discovered links to injection wells and seismic activity. He also reminded the audience of the immense resistance the oil and gas industry put up to shortly after SMU released its finding, stating such attempts to discredit credible reports must stop for the sake of progress toward solutions.

“While the study says injection wells could cause seismic activity, it also clearly says fracking is not one of those causes,” Wu says. “You have a good and a bad there, and you need the public to be able to trust that and say that is something we can rely on and tell our legislators to make policy based on that.”

the most visible part of our industry - transportationThe trucking industry is vital to the oil and gas industry, so insiders and outsiders are working together to fill the labor shortage and adhere to emissions regulations.

With the rejection of pipeline infrastructure projects and a slew of energy-related train accidents the last few years, the trucking industry has entered the fast lane as the most reliable mode of transporting oil and gas commodities. However, with this popularity has come a series of new challenges for the sector as it attempts to keep up with demand for services.

Between a massive labor shortage and new safety and environmental regulations, the trucking industry finds itself pulled in a number of directions to adapt to changing times. OEMs and service providers alike are stepping up to keep up with the trends.

A shrinking labor pool is one of the most difficult challenges the trucking industry faces these days. In October, the American Trucking Associations (ATA) announced that in the next 10 years, the industry will need to hire 89,000 drivers a year. About 45 percent of the demand will stem from the need to replace retiring drivers. Projected industry growth is the second-largest factor, representing 33 percent of the need.

The growing need for drivers is pushing up salaries, as well. The ATA also reported driver wages are beginning to increase significantly due to the labor shortage. Most fleets instituted large pay increases in the summer of 2014, with many having to do so again in 2015. Sign-on bonuses are being awarded in the industry, too. According to John Scolastico, National Accounts Manager for Bendix Commercial Vehicle Systems, the average salary for truckers can be as high as $73,000, and retirees from other industries are forming husband/wife drive teams to see the United States while they work.

If technology continues to progress as fast as it has through the OEM market, the shortage of drivers might not matter for much longer.

One of the many safety features Peter Arrigoni, Vocational Fleet Sales Manager for Kenworth Trucks, discussed was the advancement of Kenworth’s autonomous trucking systems. He said the first completely automated vehicles

could be running short-route corridors within the next 10 to 15 years as the systems that exist today – 360-degree sensors and anti-collision aides – are put together to form a continuous operating model.

“Our solution moving forward is basically an evolution of all these different systems you’re seeing incorporated onto these trucks today,” Arrigoni says.

While increased autonomy on trucks will reduce human involvement and therefore decrease the risk of accidents, it won’t entirely eliminate them, Arrigoni warned.

“It won’t eliminate accidents,” Arrigoni said. “The most difficult aspect of getting some like an autonomous vehicle in applications that we all see every day is what is public’s willingness to accept accidents by a vehicle that is being driven by itself? How are you going to insure those vehicles in the event that happens? There are just certain occasions where you won’t be able to control the driver next to you.”

There will be levels of autonomy along the way before the first driverless truck hits the streets, according to Scolastico. He said many autonomous trucks in production today require a driver to be in the cab of the vehicle, although he or she may not be working any controls. Many companies already rely on “platooning,” in which a lead driver leads a convoy of two or three additional trucks drafting it. When the lead truck breaks, all following trucks break, as well.

Arrigoni also said there could be a drastic reduction in the number of accidents. The industry has done a good job of that through increased technology over the years as well as driver training. Citing statistics from the National Highway Traffic and Safety Administration, Arrigoni said since 1975, the number of accidents involving heavy-duty trucks by about 75 percent. The number accidents that are left are about equal with car per 1 million vehicles. Unfortunately, of those where the trucks and cars collide, 80 percent of fatalities occur within the passenger car.

Along with autonomy, OEMs like Kenworth have been busy updating active and passive safety systems for their cars to

save lives as well as the bottom line for clients. According to Scolastico, who cited government statistics, the average cost of property damage is $63,000, injury is $480,000 and a fatality is $10.9 million.

Considering many of these autonomous systems record driver behavior and document accidents in real time as a way to reduce those potential settlement costs, drivers have been known to be leery of such systems at first. As Director of Safety and Compliance for Tutle & Tutle Trucking, Perry Brock says he can’t wait for more autonomous technology becomes available for his company’s fleet considering the cost-savings involved, and his drivers eventually warm up to the idea of having documentation corroborating their version of events.

“I’ve seen nothing but good things from it across the board,” Brock said. “About 70 to 80 percent of the time the driver is telling the truth, and that would go such a long way in any accident reconstruction. The sooner it could happen, the better it could happen.”

Moderator Jennifer Larivey, Owner of Texas Oil & Gas, said many trucking companies often implement the examples from safety system documentation into training initiatives to show the right and wrong way to operate a truck.

“Implementing those type of examples into the training of how it is saving them and their liability as a driver helps them accept the safety and accountability for the fleet truck,” Larivey said.

Along with stringent safety standards, the trucking industry may have to conform to tightened greenhouse gas emissions regulations soon, as well. In June 2015, Reuters reported on the Obama administration’s proposed rules calling on a variety of commercial vehicles, including 18-wheel tractor-trailers to reduce fuel consumption by 24 percent by 2027 from anticipated 2018 levels.

As daunting as this new standard may appear, Arrigoni said it doesn’t have to be. As long as fleet managers maintain strong partnerships with their OEM providers, they can work together to develop new products that

meet these regulations affordably.

“If you have a good relationship with your OEM provider, you absolutely should be having very in-depth conversations about your equipment down to the last detail,” Arrigoni said. “I think the EPA is looking at every last thing they can do and they’re essentially forcing people to do their due diligence and sweat the details. If you’re already doing this, your impact is going to minimal.”

Communicating with OEM providers is one thing, but trusting them is another, according to Scolastico. He said too many fleet managers want to stay with the same old specs for too long. He advised it is a great time to move forward now that regulations will mandate new emissions controls.

“I understand the need for reliability,” Scolastico said. “I’m not saying every salesman is a great guy, but you have got to listen to what they say. In sweating these details, take advantage of the new technology.”

Brock is one manager who is more than ready to move on from outdated technology. There is nothing but good things to come from being more efficient.

“We need to be able to have more fuel-efficient fleets out there, period,” Brock said. “It’s just going to reduce operating costs and it’s going to assist us in helping the environment, too.”
