The ‘Ley de la Función Estadística Pública’ makes it mandatory for all natural and legal persons resident in Spain to supply the data required. There may be penalties for those failing to do so.

Confidentiality of data is governed by the Ley de la Función Estadística Pública. Article 13 of the Act states that any data obtained by statistical departments both directly from respondents and via administrative sources will be protected and remain confidential.

In industry the principal activity of a unit is the activity for which the value added of production is the highest. When the latter is unknown, the highest value of production and the number of employees are used as criteria. In services the principal activity is determined by the number of employees. In cases where this information is not available, the main activity is based on the conversion of the activity codes in the administrative files, but where these do not correspond with the CNAE there are

some uncertainties (around 8%). For the census of business premises the principal activity was defined as that which generated the highest value from production, sales or the supply of services. When these criteria were not relevant the principal activity was taken to be that which employed the largest number of persons.

Concepts linked to statistical units are trying to adapt definitions included in the Council Regulation (EEC) No 696/93. In this way:

Enterprise is an organisational unit producing goods or services, having legal basis on a natural person or a legal person or a combination of them, and carrying out one or more activities at one or more locations.

Local unit is an enterprise or part thereof (e.g. a workshop, factory, warehouse, office, mine or depot) situated in a geographically identified place. At or from this place economic activity is carried out for which one or more persons work (even if only part-time) for one and the same enterprise.

Directorio Central de Empresas (DIRCE) - Central Business Register.

Institution responsible for the register

DIRCE (Spanish Business Register) is compiled directly by INE (National Statistic Institute of Spain), and the department responsible is the Methodology and Statistical Techniques Directorate.

Purpose of the register

Basis for sampling frames.

Tool for developing and harmonizing business surveys.

To provide structural and business-demographic statistics.

To meet information requirements of international organisations.

Means to control informative burden on enterprises.

To provide comparability in time series.

Legal basis

In addition to Council Regulation (EEC) No 2186/93, Spain has in his legislation the ‘Ley 12/1989 de la Función Estadística Pública’ (Spanish Statistic Basic Act) which set up that INE is required to compile and to update a Business Register.

Obligation to register for births and deaths

New units (and units that close) are not obliged to inform INE of this fact, but there is a legal obligation for the administrative sources used for updating the business register.

Date of creation and major changes

The first (provisional) release of DIRCE was obtained in 1990. Since then, successive yearly updating has been produced. Changes have been caused mainly because of increasing demands of users and future requirements of legal frame.

Date first used for structural business statistics

DIRCE was used for the first time in 1990 for the 1989 Survey on the Structure of Enterprises in Catering (Service Sector Statistics).

Limits of legal right of access

DIRCE (individual data) can be only used by National Statistical Authorities.

Activities covered

DIRCE covers all compulsory economic activities included in Council Regulation (EEC) No 2186/93. Recently economic activities from NACE-93 Rev. 1.1 Sections A, B, L, P and Q, are being incorporated to DIRCE in a progressive way. At present, coverage levels of these new activities can be considered as acceptable.

DIRCE contains information on all national territory.

Size classes covered

There are no exclusions with regard to size class.

Other inclusions or exclusions

There are no additional criteria to include or to exclude units.

Coverage rate

External checks on employment allow us to infer a very high level of coverage in DIRCE.

Main economic activity is classified to 4-digit level of NACE Rev. 1.1. Secondary activities carried out by the enterprises, up to a maximum of three, can be obtained.

Level of geographical location recorded

The level of geographical location recorded for all units of DIRCE is NUTS 5. Full address is also recorded.

Method of size registration

Three variables are used as measures of size in the register:

- employees

- persons employed (estimate)

- turnover (estimate for small units)

Single value is available for all units.

Registration or not of legal form

Yes, on the basis of the first character in the legal identifier NIF (Fiscal Identification Number).

Registration or not of foreign ownership

Yes. This information is collected from external private sources (D&B).

Registration or not of public ownership

Yes. Information on Public Enterprises is collected from external administrative sources (National Audit Office and Central Bank).

Registration or not of inter unit links

Yes, there are links for all kinds of units registered in DIRCE.

Distinction between market oriented and non-market units

Nowadays there is a work-in-progress in order to incorporate Institutional Sector as a new variable in DIRCE. This variable combined with legal form and economic activity code will allow us to distinguish between marked oriented and non-market units.

List of economic variables registered

Economic variables correspond to which are used as measures of size (employees, persons employed and turnover), such as we pointed out above.

These variables adapt definitions included in manuals and methodologies proposed for economic statistics implementation.

- Location variables (Full Postal Adress, Geographical Code NUTS 5)

List of main sources of information for updating

The model for the generation and maintenance of the information system is based on the use and exploitation of external sources of different nature. In the first developments, only administrative sources were considered. Later, the putting into practice of processes to improve the quality has allowed incorporating the changes detected in the own statistical operations. Next, the main used sources are related:

Tax sources:

• Economic Activities Tax (State and Navarre Community scope).

• P.A.Y.E. Deductions.

• INTRASTAT and EXTRASTAT register.

Social sources:

• Social Security Counts.

Statistical sources:

• Directory of economic activities (Basque Country)

• Current statistical operations.

Legal sources and other types of sources:

• Mercantile Register

• Public Companies of the National Audit Office (Ministry of Finance)

Private sources:

• Dun and Bradstreet data base.

DIRCE is an important toot for statistical production. Access to aggregated data is free. An annual standard publication is available at INE Website (INEbase), including the main methodological subjects. Department managing DIRCE also offers a customized information request service. At present, DIRCE is one of the more demanded products of INE.

An industrial survey is carried out annually. A separate annual survey is conducted in the construction sector. The development of statistics on the service sectors has been underway since the late 1980s. Since year 1998 an annual survey is carried out. A census of business premises was carried out in 1990.
