REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1918.

I THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council,

PART I.

PRELIMINARY.

1. These Regulations may be cited as the Naval Financial Regulations. Citation.

2. The Naval Financial Regulations (Statutory Rules 1924, No. 34, Repeal. as amended to present date) are repealed as from the commencement of these Regulations save as to anything lawfully done, or any right, privilege, obligation, or liability acquired, accrued, or incurred thereunder.

3. These Regulations are divided into Parts as follows :- Parts.

Part I.—Preliminary. Part IL—General. Part III.—Pay and Allowances. Part IV.—Victualling. Part V. Compensation for Injuries. Part VI.—Travelling, and Travelling Allowances. 4. In these Regulations, unless the contrary intention appears- Definitions.

" Minister " means the Minister of State administering the Naval Defence Act 1910-1918.

" Naval Board " means the Board of Administration for the Naval Forces.

" Secretary " means the Officer appointed to be Secretary to the Naval Board, or such other official as the Naval Board may authorize to act for him.

" Commanding Officer " means the Officer in actual command of one of H.M.A. Ships or Naval Establishments.

" Officer-in-Charge " means the Officer in charge of a Naval Establish-ment or Office or District Naval Officer appointed to command a District.

"Director of Navy Accounts " means the Officer appointed to be Director of Navy Accounts in the Office of the Naval Adminis-tration, or such person as may be appointed by the Naval Board to perform the duties of the position during -his absence.

Accountant Officer " means the Officer in charge under the Com-manding Officer of cash, victualling, and clothing duties.

" Certifying Officer " means the Officer appointed by the Naval Board to certify accounts and approve the payment thereof.

" Accounts Officer " means the Officer responsible for the _receipt and payment of Public Moneys in Naval Establishment or Office.

" Executive Officer means an Officer of the Executive Branch of the Forces.

PART II.

GENERAL.

Advances.

5. Officers-in-Charge and Commanding Officers shall be responsible for enforcing due economy •on all Officers and others charged with any expendi-ture of public money, or with the care, use, or expenditure of stores.

6. It is the duty of every member of the Naval Forces to assist in carrying out these Regulations.

7. (1) The King's Regulations and Admiralty Instructions shall constitute no authority for expenditure in the Royal Australian Navy.

(2) References in these Regulations to the King's Regulations and Admiralty Instructions refer to the 1913 edition.

8. Commanding Officers and Officers-in-Charge shall not vary any payments provided for under Regulations.

9. The Director of navy Accounts or the Accountant Officer of one of H.M.A. Ships or the Certifying Officer at an Establishment or Office on whose books a member is borne for pay, may authorize ,any other Certifying -Officer to make an advance to such member on;account of pay or travelling expenses, provided that the amount advanced does not exceed the total amount due to the member at date of the advance.

10. An Accountant Officer or Certifying Officer shall be liable for the amount of disallowances arising from errors or over-issues made by him in disregard of regulations or in the absence of proper authority.

Cprgestforuse 11. (1) Residential furniture and mess traps may be supplied to Official Residences and Government quarters, and Billiard Tables may be supplied lidfes's irt(r'ars. to Officers' and Men's Messes at Naval Establishments, subject to such conditions as are approved_ by the Naval Board.,

(2) Except as approved by the Minister, who may waive or vary the charges in special cases, the following charges shall be made :—

Furniture— Consumable articles .. 15 per cent. per annum. Permanent articles .. 4 per cent per annum.

Mess Traps . . 8 per cent. per annum.

Billiard Tables and Accessories— Officers' Messes .. 72 per cent. per annum. Men's Messes .. Nil.

(3) Furniture shall be classified as consumable or permanent in accordance with Admiralty " Regulations for the supply of Residential Furniture and. Cabin Furniture in Shore Establishments, and of Billiard Tables,"

(4) The percentage charges on furniture and mess traps shall be made on the official valuation. On Billiard Tables and accessories supplied to Officers' Messes, the charge shall be made on the original• cost. Repairs and replacements in respect of Billiard Tables and accessories shall be paid for by the Messes using the Tables, but for Officers' Messes, cost of repairs and replacements, up to one-half of the percentage charges paid, may be refunded.

(5) After the close of each tenancy or after five years' occupation, should the tenancy be beyond that period, Residential Furniture shall be surveyed and re-valued.

12. (1) When any person in receipt of consolidated rates of pay occupies lela tgeable for for purpose of residence, the whole or part of a building belonging to or occupied quarters. by the Commonwealth, a deduction of 10 per centum from such person's salary or wages shall be made as rent therefor, except as provided in sub-regulation (2) of this regulation.

(2) The Minister may fix the rent to be charged, to any person on a basis other than the foregoing, or may waive altogether the charge for rent.

(3) In calculating for any purpose the rate of salary or wages of such person, the amount so deducted for rent shall be deemed and taken to be part of his salary.

(4) An officer or a man on sea-going rates of pay, in occupation of official married quarters, shall pay such rent for the premises as is approved by the Minister.

(5) The Officer-in-Charge shall be responsible, in all cases, for the abatement from salary or wages of the necessary charges for rent of quarters.

13. A person_ in receipt of consolidated rates of pay, who is in occupation Fuel and of official quarters, shall not be provided with, fuel or light at Government light,

expense, unless the Order in Council appointing such person expressly provides that one or more of such services exe to be allowed, or unless the Minister approves of one or more of such services. being supplied.

PART III.

Rates of Pay—Officers (sea-going).

PAY AND ALLOWANCES. 14. (1) The daily rates of active pay prescribed in regulations 15 to 22

inclusive, the rates of allowances prescribed in regulations 30 to 50, and the rates of deferred pay as prescribed in regulation 52 shall apply, where nab otherwise stated, to Officers serving in the Permanent Naval Forces (Sea-going)

(2) Rank or relative rank specified shall be as defined in the King's Regu-lations and Admiralty Instructions.

(2) A Probationary Engineer Sub-Lieutenant shall receive pay and allowances as laid down for Engineer Sub-Lieutenants on promotion.

(3) An allowance for Engineer duties is included in the scale of pay for officers of the Engineering Branch up to Commander's rank inclusive. The rates prescribed in sub-regulation (1) of this regulation for the Engineering

Branch will he paid continuously while an officer is employed on Engineering duties. A Lieutenant (E) or Lieut.-Commander (E) who reverts to Deck duties shall, whilst employed on such duties, receive pay on the scale of the Executive Branch.

(4) The conditions regarding the commencement of (E) pay for Sub-Lieu-tenants (E) and Lieutenants (E) shall be as approved by the Naval Board.

16. The following shall be the daily rates of Active Pay for Officers of the Accountant -Branch.

(2) The following daily rates of Active Pay shall apply to officers promoted to Mate from Warrant Rank, and to such officers promoted to Lieutenant and Lieutenant-Commander from Mate :—

(3) A Warrant Officer whose total emoluments as a rating on the date immediately preceding his promotion to Warrant Rank, exceeded the amount to which he would be entitled as a Warrant Officer may, on the approval of the Naval Board, be paid a special rate of pay. Such a case shall be dealt with in accordance with the conditions governing similar cases in the Royal Navy.

(4) The Mechanical Branch (column " A ") shall include the ranks of Warrant Engineer, Commissioned Engineer, Engineer-Lieutenant, Engineer-Lieutenant-Commander, Warrant Mechanician, Commissioned Mechanician, Warrant Shipwright, Commissioned Shipwright, and Ship-wright-Lieutenant, Warrant Electrician, Commissioned Electrician, Warrant Ordnance Officer, Commissioned Ordnance Officer, and Officers promoted to the ranks of Lieutenant and Lieutenant-Commander in their respective branches from the foregoing ranks.

Definition of Service.

Increments.

24. (1) Service in rank on the Active List, for the purpose of increments in pay, shall include all time actually served on full pay in that rank by an Officer on the Active List of the Royal Navy, Royal Australian Navy, or Navy of any of His Majesty's Dominions.

(2) All previous service in the Royal Navy, Royal Marines, or in the Navy of any of His Majesty's Dominions shall be allowed to count as if served by a rating in the Royal Australian Navy towards " Service " for seniority, pay, good conduct badges, and allowances. Ratings re-entering the service shall not count their former service towards progressive pay when the period of absence has exceeded five years, except in such special cases as may be approved by the Naval Board.

25. (1) Increments of pay shall be subject to such conditions as may be approved by the Naval Board.

(2) In the case of an officer " Provisional " time shall count for incre-ments of pay, but " Acting " time shall not so count. Temporary Acting Warrant Officers will, however, be allowed the same increments of full pay as authorized for confirmed Warrant Officers, R.A.N., of similar rank.

(3) Time prior to and in desertion shall, under no circumstances, count as service for purposes of increment, but time served prior to dis rating may count towards progressive pay on restoration to rating.

26. Officers or ratings in excess of the authorized number of any rank or rating may be carried on the strength, provided there are vacancies in the higher rank or rating and that the total establishment is not exceeded.

27. Officers placed on the half-pay list shall receive pay at the daily rate of one-half of the active pay prescribed for their rank, but shall not be entitled to deferred pay or allowances of any nature whatever.

Officers on 28. (1) An Officer on the Retired or Emergency List called up for duty

the Retired and in time of war or emergency shall receive pay and allowances at the rates Emergency Lists. prescribed for an Officer of corresponding rank in the Permanent Naval

Forces (Sea-going), including Deferred Pay, provided that—

(a) an Officer who has, been promoted after being placed on the Emergency List shall receive the full pay and allowances pre-scribed for the higher rank ; and

(b) unemployed time on the Retired or Emergency List shall not count towards increments in full pay governed by seniority.

(2) An Officer on the Emergency List voluntarily employed in time of peace in the Permanent Naval Forces (Sea-going) shall receive pay and allow-ances at the rates prescribed for an Officer of corresponding rank in the Sea-going Forces, provided that—

(a) unemployed time on the Emergency List shall not count towards increments in pay ; and

(b) deferred pay shall not be credited.

(3) An Officer on the Emergency List called upon to undergo a course of instruction shall be paid at the rates prescribed for such Officers voluntarily employed in peace time.

29. (1) Pay shall not be made from Naval Funds to Surgeon Lieutenants Medical

who at the time of entry into the Medical Branch, are permitted to serve =LI in

Equipment Allowance to Officers on the Emergency List.

(2) Officers transferred from another branch of the Royal Australian Navy, or from the Royal Navy direct or appointed within twelve months of the date of their retirement from the Royal Navy shall receive no gratuity on transfer or appointment.

(3) An Officer to whom an Outfit Gratuity has been paid and who fails to serve for two years from the date of becoming eligible for such Gratuity shall be required to refund one-fourth of the allowance in respect of each period of six months (or part of such period) by which his service falls short cf two years ; the refund may, however, be waived in whole or in part, at the discretion of the Naval Board, if the failure to complete two years' service is due to death, invaliding through causes beyond. the Officer's own control, or other special circumstances.

(4) Midshipmen specializing in Engineering may, on appointment to the Royal Naval Engineering College, Keyham, be granted an equipment allow-ance of £10 for the purchase of technical books and instruments

32, When called up for service in time of war or national emergency, an Officer on the Emergency List shall receive the Outfit Gratuity of £30 under the conditions prescribed in regulation 30 for Officers appointed for temporary service in the Permanent Naval Forces (Sea-going).

33, (1) Every rating engaging for more than three years' service shall on first entry, be supplied at Government expense with a full uniform kit applicable to his rating.

(2) A rating whose engagement in the Royal Navy expires whilst on loan to the Royal Australian Navy, and who engages for a period in the Royal Australian Navy, service being continuous, shall not receive any free issue of kit on effecting such engagement.

(3) A former rating of the Royal Navy, Royal Australian Navy, or Royal Fleet Reserve, who engages in the Royal Australian Navy within six months of discharge, shall not receive any free issue of kit on engagement except in special circumstances, with the approval of the Naval Board.

(4) A former rating of the Royal Navy, Royal Australian Navy, a Royal Fleet Reserve, who engages in the Royal Australian Navy, after an interval of not less than six months, for a period of more than three yeaincluding be supplied, on engagement, with the full free kit as approved by the Naval Board.

(5) A person entered :Lem shore for three years or leri , Eraluding a former rating of the Royal Navy, Royal Australian Navy, or Royal Fleet Reserve, discharged more than six months prior to re-entry, shall receive a gratuity or a free issue of articles of Et not exceeding half the value of a full kit, as may be approved by the Naval Board.

34. (1) Kit Upkeep Allowance shall be granted to ratings commencing Kit Upkeep

from date of entry as follows :— Allowance.

Class I. .. 100. per diem. Class IL 81c1. per diem. Class III. 10-d. per diem. All Band Ratings 1032-d_ per diem.

(2) Kit Upkeep Allowance shall continue to be credited during periods of detention. In all other cases where deferred pay is not credited, ride sub-regulation (7) of regulation 51, Kit Upkeep Allowance shall also be stopped for the same period.

(3) Kit Upkeep Allowance, at the rates prescribed in sub-regulation (1) Ratings Oa

of this regulation, shall be credited to ratings lent from the Royal Navy, commencing from the date of entry for service in the Royal Australian ro7tuf=ry Navy.

(4) In addition to the allowance provided for in sub-regulation (1) of this regulation, Submarine Kit Allowance shall be payable under con-ditions approved by the Naval Board at the following rates :-

Compensation for loss of uniform, etc

36. The Naval Board may approve of compensation in the case of an officer or man who sustains, as a result of a casualty of the Service, loss of or damage to, necessary articles of uniform clothing and equipment, or books, instruments, or tools required for the proper performance of his duties.

Deserters' 37. Recovered deserters are not to be treated as new entries.dischargef a uniforms. deserter if not sold before his recovery may be restored to him. If his kit

has been sold, he should be supplied with a reduced kit (as laid down in the Uniform Regulations), to be charged against his pay and allowances.

Retention of 38. (1) Except as hereunder provided, a rating may, on his discharge kit on disc'narge. from

the Sea-going Forces, be permitted to retain his kit.

(2) In the case of a rating who, in accordance with the provisions of regulation 33 was supplied gratuitously on entry or re-entry with uniform kit, or was granted a gratuity in lieu and who is discharged within two years of date of such entry or re-entry, a charge in respect of clothing shall, subject to sub-regulation (7) of this regulation, be made against the rating's Deferred Pay Account at date of discharge in respect of each full month of the unexpired portion of the two year's service.

(3) Where the clothing so issued was a full kit, the charge shall be at the rate of £1 10s. per month in the case of Class I. and Class III. ratings and VI. 5s. per month in the case of Class II. ratings. Where, however the rating concerned has received a reduced kit or gratuity in lieu under sub-regulation (5) of regulation 33, the charge shall be at the rate of 15s. per month in the case of Class I. and Class III. ratings, and 12s. 6d. per month in the case of Class II. ratings.

(4) For the purposes of the charges mentioned in sub-regulations (2) and (3) of this regulation, full months shall be calculated from the date of discharge, odd days at the end of the two-year period being disregarded.

(5) Where the Deferred Pay credit is insufficient to meet the charge, or where the terms of the rating's discharge involve forfeiture of Deferred Pay, all articles of his compulsory kit and other articles of kit issued gratuitously to him, except such articles as are necessary to meet his immediate require-ments, shall be recovered and sold, and the proceeds applied towards liquidation of the debt.

(6) Should the total of any Deferred Pay and the sum realized from sale of kit exceed the Clothing Charge, the balance shall, except as provided in sub-regulation (7) of this regulation, be credited to the rating. In the event, however, of the total referred to being insufficient to meet the Clothing Charge, no deduction shall be made from Active Pay on that account.

(7) The case of a rating discharged for any of the following reasons shall be dealt with in the manner prescribed hereunder : —

(a) " Discharged Dead."

No Clothing Charge shall be made, but in the case of a rating who, in accordance with the provisions of regulation 33, was supplied gratuitously on entry or re-entry with uniform kit, or was granted a gratuity in lieu, and who is discharged within six months of date of such entry or re-entry, all articles of his compulsory kit and other articles of kit issued gratuitously to him, shall be sold and the proceeds credited to " Revenue ";

(b) " Invalided " as a result of disability not due to his own misconduct, carelessness or neglect,

Charge, the balance (if any) referred to in sub-regulation (6) of this regulation shall be credited. to " Revenue " ;

(ii) Where the amount of deferred Pay is sufficient to meet the Clothing Charge or where no Clothing Charge arises, all such articles of his kit as are specified. in the Uniform Regulations as " strictly uniform " shall be sold. and the proceeds credited to " Revenue " ;

(d) " Services no longer required. ", " Dismissed. ", " Dismissed. with disgrace ".

(i) Where the kit is required. to be sold to meet the Clothing Charge, the balance (if any) referred. to in sub-regulation (6) of this regulation shall be credited to " Revenue " ;

(ii) Where no Clothing Charge arises, all such articles of kit as are specified in the Uniform Regulations as " strictly uniform " shall be sold and the proceeds credited to " Revenue ".

(8) A rating about to be discharged. " Unsuitable," " Services no longer required. ", " Dismissed " or " Dismissed with disgrace " shall not be per-mitted. to retain any such articles of kit as are specified. in the Uniform Regulations as " strictly uniform ".

(9) In the event of a rating being discharged. for any of the reasons mentoned in sub-regulation (8) of this regulation and not being in possession of civilian clothing, he shall be provided at Government expense with such civilian clothing as may be decided by the Naval Board.

39. (1) A member of the Permanent Naval Forces (Sea-going), when not Lodging

Lodging Allowance—Annual Rate.

(3) Lodging Allowance shall not be credited when a member is on leave for periods exceeding four days.

40. (1) Officers (Sea-going) of the Royal Australian Navy, who are appointed to positions on shore, and are not provided with accommodation, shall be paid Lodging Allowance at the following rates provided that, where the period of service ashore does not exceed one month, Officers shall be paid the difference between the daily and annual rates of Lodging Allowance prescribed in this sub-regulation :--

(2) Payment of Lodging Allowance at the annual rate shall continue to be made when an Officer proceeds on recreation leave, or on sick leave, provided the Officer is not accommodated in hospital.

(3) Payment of Lodging Allowance at the annual rate shall also continue to be made—

(a) for the first seven days whilst an Officer is accommodated in hospital ; and

(b) for the first seven days only when temporarily absent from Head-Quarters and travelling allowance is drawn under the conditions prescribed in sub-regulation (7) of regulation 92.

Provided, always, that the lodgings are retained and paid for during the period.

(4) In calculating Lodging Allowance at the annual rate, the amount payable shall be ascertained by multiplying the annual rate by the number of days in the period of calculation and dividing the result by 365.

(5) Marriage Allowance shall not be payable concurrently with the annual rate of Lodging Allowance to an officer who resides, or is able to reside, at his own home.

41. (1) On production to the Commanding Officer of satisfactory evidence of marriage, an allowance may be paid in accordance with the scale set out hereunder :—

(2) Warrant Officers over six years' seniority shall receive the allowance prescribed for Warrant Officers under six years' seniority up to a maximum of 3s. per diem

(3) Commissioned Officers from Warrant rank in receipt of " on promotion" rates of pay shall receive 2s. per diem Marriage Allowance. Commissioned Officers from Warrant rank in receipt of rates of pay prescribed for Com-missioned Officers from Warrant rank " after three years' seniority " and " after six years' seniority " shall receive ls, per diem Marriage Allowance. Commissioned Officers from Warrant rank in receipt of pay as Commissioned Officer from Warrant rank " after nine years' seniority " shall not be entitled to Marriage Allowance.

(5) The conditions as set forth in the following paragraphs shall Marriage Allowance— govern payment of Marriage Allowance. Conditions of

(a) In the case of an Officer, an allotment must be declared in favour Payment,

of his wife of not less than one-third of his active pay (excluding allowances) plus full amount of Marriage Allowance payable.

(b) In the case of a Chief Petty Officer, Petty Officer, or man an allot-ment must be declared in favour of his wife of not less than one-half of his active pay (excluding allowances) plus full amount of Marriage Allowance payable.

(c) For the purposes of determining the amount of monthly allotment to be declared in each case in respect of Marriage Allowance, a month shall be reckoned as 30 days.

The necessary allotment should commence from the first day of the month following credit of Marriage Allowance.

(d) Marriage Allowance may be to widowers with children subject to an allotment in favour of a guardian of not less than one-quarter active pay (excluding allowances) plus full amount of Marriage Allowance payable. If the children are in the care of more than one guardian, a separate allotment in favour of each guardian shall be made, and the total amount of such allotments shall equal or exceed one quarter of active pay (excluding allowances) plus the full amount of Marriage Allowance.

(e) Marriage Allowance will be payable irrespective of place of residence of wife, or of guardian in the case of a widower, provided the necessary allotment is made.

(f) Marriage Allowance may be paid in regard to step-children and adopted children under sixteen years of age, provided that the member claiming the allowance maintains such children and that they are not in receipt of endowment from any other source.

Dependant Allowance.

(g) During periods of detention or imprisonment not exceeding 90 days, the allotment should be continued at a rate not less than the amount of Marriage Allowance which would have been payable to the rating. The debt accumulated by such allotment may be recovered in easy instalments, or in the event of discharge communicated to Navy Office for recovery from deferred pay.

(h) The payment of Marriage Allowance shall be entirely subject to the pleasure of the Naval Board, who may withhold the whole or part of the allowance as may be considered desirable.

42. (1) When Marriage Allowance is not drawn, Dependant Allowance at a rate not exceeding 2s. per day may be paid to—

(a) Commissioned Officers from Warrant rank in receipt of " on pro.. motion " rates of pay.

(b) Warrant Officers irrespective of the rate of pay received. (c) Ratings.

in respect of a dependant residing in Australia requiring support, subject to an allotment of one-half of the active pay (excluding allowances) of the Officer or man, plus the amount of Dependant Allowance credited.

(2) Commissioned Officers from Warrant rank in receipt of pay as

Commissioned Officer from Warrant rank " after three years' seniority " or Commissioned Officer from Warrant rank " after six years' seniority" may be paid Dependant Allowance under similar conditions at the rate of I s. per diem only.

(3) Commissioned Officers from Warrant rank in receipt of pay as Com-missioned Officer " after nine years' seniority," shall not be entitled to this allowance.

(4) Dependant Allowance shall not be credited without the prior approval of the Naval Board and shall, generally, be limited to cases of mothers being widows or of the father being permanently incapacitated by age or infirmity from earning wages exceeding £2 per week. Such Allowance shall not be payable where there are unmarried sons not serving in the Naval or Military Forces, or daughters in receipt of wages exceeding £2 per week, or where the allottee possesses income of like amount. An Allowance not exceeding 2s. per day may also be approved by the Naval Board in any other special case where Marriage Allowance is not already paid and dependence upon the member of the Permanent Naval Forces (Sea-going) is clearly established, subject to residence in Australia and to the above limitation as to private income.

(5) A War Pension may be disregarded as income for the purpose of the foregoing, and Dependant Allowance may be paid to a widow or other female relative provided she does not possess other income exceeding £2 per week- .

(6) Payment of Dependant Allowance shall he entirely subject to the pleasure of the Naval Board, who may withhold the whole or part of the Allowance as may be considered desirable.

(7) Dependant Allowance shall not be included in the daily rate of pay for the purposes of mulcts, being regarded for that purpose similarly to Lodging, Ration, and Marriage Allowances. Payment of Dependant Allowance shall not, however, be made when a rating is in cells, civil prison, or undergoing detention.

(8) During periods of detention or imprisonment not exceeding 90 days, the allotment shall be continued at a rate not less than the rate of Dependant Allowance. As allotment will be continued in such circumstances at the

rate of, at least, £3 per month, when the ordinary allotment is stopped on discharge of a man to cells, civil prison, or detention quarters, a charge shall be made against his pay in respect of an allotment at the reduced rate.

(9) The debt accumulated by payment of the allotment as prescribed in sub-regulation (8) may be recovered by easy instalments from the pay of the rating. In the event of discharge, the debt incurred shall be communicated to the Director of Navy Accounts for recovery from deferred pay.

43. All allowances shall be subject to such conditions as may be approved General by the Naval Board.

Condition.

ALLOWANCES TO OFFICERS.

44. (1) The Officer appointed to command H.M.A. Squadron shall be entitled Table Money.

to Table Allowance at such rate as may be approved by the Minister, on the recommendation of the Naval Board, not exceeding El 10s. per diem.

(2) Payment of Table Allowance to this Officer shall be subject to the conditions, where such can be applied, prescribed in the King's Regulations and Admiralty Instructions for payment of such allowance in the Royal Navy.

45. (1) The rates of Allowances to Officers shall be as prescribed in the following sub-regulations, but these Allowances shall be paid only during the actual employment specified, or under the special circumstances set forth, and no increase shall be made in deferred pay on account of same. The conditions governing payment of the undermentioned Allowances contained in King's Regulations and Admiralty Instructions or in Admiralty Fleet Orders shall apply in the Royal Australian Navy unless otherwise specified:—

47. When the Accountant Officer (the rank allowed by complement being not below Paymaster Lieutenant-Commander) is absent from the ship continuously for upwards of three months otherwise than on leave, the Paymaster Lieutenant, Paymaster Sub-Lieutenant, or Paymaster Mid-shipman performing his duty, although not holding an acting order as Pay-master Lieutenant-Commander, may, on the approval of the Naval Board, be granted additional pay ; but the special remuneration thus granted shall not exceed the difference between the Officer's own rate of active pay and the lowest rate of active pay for a Paymaster Lieutenant-Commander. A full report of the circumstances shall be made to the Naval Board in order that the rate payable may be decided.

The amount of such extra pay shall be made up of the total difference between the rate of Active Pay received in the lower rating and the minimum rate of Active Pay of the higher rating.

ALLOWANCES NOT CHARGEABLE TO PAY VOTE. Pilotage. 50, (1) Payment for pilotage may be allowed to Navigating Officers

at such rates as may be approved by the Naval Board, subject to the general conditions laid down in the King's Regulations and Admiralty Instructions, and to such other conditions as the Naval Board may direct.

(7) A sum based on a capitation allowance of 3s. per annum per rating of the authorized complement of Communications Branch ratings (excluding boys) shall be allowed to provide prizes for proficiency in the Communications Branch.

Payment of deferred pay.

(12) Ratings acting as Interpreter, whilst actually performing the duties, shall receive an allowance of ls. per hour, with a maximum payment of 5s. for any one day.

(13) Boys serving, in Sea-going Training Ships and offenders undergoing detention at Detention Quarters may have their hair cut at Government expense. The following allowances shall be payable to the barber selected from the Ship's Company to carry out the duty in his spare time— s. d.

DEFERRED PAY OF PERMANENT NAVAL FORCES (SEA-GOING).

51. (1) Deferred Pay in accordance with the scale prescribed in regulation 52 shall be allowed to accumulate to the credit of every officer and man entered for service in the Permanent Naval Forces (Sea-going); provided that deferred pay shall not be credited to any officer on the Active List of the Royal Navy serving in the Permanent Naval Forces (Sea-going), and any Royal Navy rating engaged or re-engaged from or after 1st July, 1924, for loan service in the Royal Australian Navy.

(2) Interest at the rate of 31 per cent. shall be credited annually on the 30th June in each year on the amount of accumulated Deferred Pay standing at credit of each member on 30th June of the previous year, pro-vided that a full year's interest shall be allowed only on amounts which have stood to the credit of the member for a full year. Interest added to Deferred Pay Account shall be considered as part of accumulated Deferred Pay and shall bear interest accordingly.

In the event of any member or his estate becoming entitled to receive Deferred Pay on account of discharge, expiration of engagement, resignation, death, or for any other reason as provided in these Regulations, interest on the amount of accumulated Deferred Pay standing at credit on 30th June prior to the date on which he or his estate became entitled to payment of Deferred Pay in the circumstances aforementioned shall be allowed from 1st July to the end of the month in which payment of Deferred Pay becomes due.

The Deferred Pay Account of an Officer or man shall be closed when payment is made in full of the amount accumulated, or when payment is made on expiration of an engagement. In tacoumulated,an officer or man re-entering the Service or continuing in the Service after drawing Deferred Pay, no interest shall be allowed in respect of any amount at credit prior to the closing of the account.

(3) Payment of Deferred Pay and accumulated interest will become payable in the following circumstances :-

(a) Officers- (i) Upon final discharge from the Active List of the Sea-going

Forces, except as provided in sub-regulation (4), provided that officers placed on half-pay prior to termination of their services may be paid accumulated Deferred Pay at any time after the date of their ceasing to draw full pay, provided further that an officer transferred to the Auxiliary Services shall not be paid Deferred Pay until final discharge from the Auxiliary Services.

(ii) Upon being invalided from the service for causes beyond the officer's control.

(iii) Upon the death of the officer whilst serving.

Petty Officers and Men- (i) Upon completion of the engagement into which entered. (ii) Upon completion of each re-engagement. (iii) Upon discharge to Shore, excepting as provided in sub-

regulation (4) of this regulation. (iv) Upon being invalided from the Service for causes beyond

the rating's control. (v) Upon the death of the rating whilst serving.

Provided that where the engagement or re-engage-ment referred to in (i) and (ii) is not completed before a further re-engagement is entered into, Deferred Pay will not be payable until the date the former engage-ment or re-engagement would have expired and further provided that a rating transferred to the Auxiliary Services from the Sea-going Forces shall not receive accrued Deferred Pay until final discharge from the Auxiliary Services, notwithstanding that his engage-ment in the Sea-going Forces may expire immediately prior to commencement of Service in the Auxiliary Services.

(4) No person who is— (a) discharged " Run " ; (b) dismissed from His Majesty's Service with disgrace ; (c) dismissed from His Majesty's Service ; (d) discharged from the Service as " Services no longer required "

or whose services are dispensed with on account of mis-conduct ; or

(e) discharged at own request whether by voluntary retirement or resignation,

shall be entitled to any payment under this regulation.

(5) No payments in respect of accumulated Deferred Pay shall be made other than in the circumstances prescribed in paragraphs (a) and (b) of sub-regulation (3) of this regulation, but the Naval Board may, in special circum-stances, restore the whole or any portion of the Deferred Pay which, but for the reasons set out in sub-regulation (4) of this regulation, would have been pay-able. Such cases shall generally be limited to cases where " Run " has been removed.

(6) Contributions by the Commonwealth towards pension rights of men lent from the Royal Navy shall be deducted from amounts credited to those men on account of Deferred Pay.

(7) Deferred Pay shall not be credited in any of the following circum-stances :-

(a) During imprisonment or detention (either summarily or by Court Martial) ;

(b) during imprisonment following conviction by a Civil Court ; (c) during confinement in cells ; or

53, The allowances provided in regulations 30 to 50 inclusive shall not be applicable to Officers, Petty Officers and men of the Permanent Naval Forces in receipt of consolidated rates of pay.

54. Where Medical Officers of the Permanent Naval Forces (Sea-going) Hospital

are required to undergo a six months' course of study at an approved Courses.

Medical School prior to presenting themselves for examination for the rank of Surgeon Lieutenant-Commander, or where Senior Medical Officers of over fourteen years' seniority are permitted to undergo a special three months' course in approved subjects, the Naval Board may approve of payment, from Commonwealth Funds, of the whole or a portion only of the fees for such courses.

(3) Royal Navy ratings serving in the Royal Australian Navy who become eligible for the Royal Navy Medal and Gratuity shall not be entitled to the Royal Australian Navy Gratuity and Allowance in addition to the award provided in King's Regulations and Admiralty Instructions, nor shall any rating be eligible for the gratuity and allowance who would have become entitled to the Long Service and Good Conduct Medal prior to 1st January, 1920, but for the fact that his character had not been continuously assessed as " Very Good."

(2) A fixed fee of 10s. 6d. per capita shall be paid to Military Area Medical Officers for the examination of Naval Recruits at places where there is no Naval Medical Officer available.

Deserters—Forfeiture of Pay, &c.

59. (1) A person who deserts from the Royal Australian Navy shall forfeit all active pay, allowances, and deferred pay due to him to the date of his desertion, and shall forfeit all past service far the purposes of furlough, of Good Conduct Badges, and Long Service and Good Conduct Medal.

(2) The Naval Board may, in the case of recovered deserters in special circumstances, approve of the restoration of any portion of the pay, allow-ances, deferred pay, or service forfeited by the act of desertion.

60. (1) The Captain shall cause the clothes and effects of a deserter to be delivered into the charge of the Accountant Officer, together with an inventory signed by two or more persons.

(2) After the expiration of three months from the date of desertion the Captain shall authorize the clothes and effects of a deserter who has not been recovered, to be sold on board by auction.

(3) The proceeds of such sale shall be credited by the Accountant Officer to "Revenue."

61. (1) Rewards for arrest of absentees and deserters may be paid as follow :-

Up to a limit of El for a straggler. Up to a limit of £3 for a deserter or presumed deserter.

(2) The amount of the reward, within above limits, shall be at the dis-cretion of the officer issuing the warrant, and shall, together with cost of his own passage to his Ship or Depot be charged against the pay of the deserter or straggler earned subsequent to arrest.

62. (1) Petty Officers and other ratings may, in peace time, be permitted, subject to the approval of the Naval Board, to purchase their discharge on the following terms :-

(a) Up to but not exceeding three months from date of first entry E20 ;

(b) After three months from date of first entry- (i) Boys and Ordinary Seaman IL or Ordinary Seaman under

18 years of age, £40. (ii) Men—

63. Ratings, except boys, discharged by purchase from the Royal Aus- Re-entry after

tralian Navy, and subsequently allowed to re-engage in the service within puriscohaarge. by

a period of two years from date of their discharge, may, on the approval of the Naval Board, be refunded one-half of the amount paid for discharge in each case, or the full amount paid when deferred pay has been forfeited, provided an engagement to serve for five years is executed on re-entry of the rating concerned.

(b) A person engaged as Constable in the Naval Dockyard Police without, previous service in the Permanent Naval Forces (Sea-going) shall receive, on first appointment, the minimum rate of pay for Constable.

Child 6 5 . (1) In addition to the rates of salary there shall be payable to members.

Endowment. of the Auxiliary Services allowances at the following rates :-

To each member who is married or a widower, and who is the father or step-father of dependent children under the age of fourteen years, and who is in receipt of salary at a rate less than £500 per annum the sum of £13 per annum in respect of each such child so dependent. A similar allowance may, on the approval of the Naval Board, be granted to any member in respect of orphan or adopted children under the age of fourteen years who are dependent upon and maintained by that member.

Provided that the total sum per annum paid to any member under this paragraph shall not exceed the amount by which the salary per annum of the member falls short of £500.

(2) Payment shall be subject to the following conditions :-

(a) The total salary inclusive of the allowance shall not exceed £500 per annum. Where the annual salary, plus the allowance, would exceed £500 per annum, the allowance is to be reduced so that the total will not exceed £500 per annum.

(b) For each child (including step-children) provided that the child is not contributing to its own support and is wholly and solely dependent upon the member.

(c) For each dependent child under fourteen years of age, provided that the Deed of Adoption or other satisfactory evidence of adoption is produced when required by superior authority, and that the child is not contributing to its own support and is wholly and solely dependent upon the member. In such cases, the member must not have received or be in receipt of any payment in respect of such adoption.

entitles them to the award of the Royal Australian Navy Long Service and Good Conduct Medal may be paid the gratuity of £20 and the allowance of S1 per annum, subject to compliance with the conditions prescribed in regulation 57 of these Regulations for ratings in the Permanent Naval Forces (Sea-going).

68. Officers on the Sea-going List of the Permanent Naval Forces lent to the Auxiliary Services shall receive the rates of pay and allowances prescribed -for their corresponding ranks in the Permanent Naval Forces (Sea-going).

69. An officer or man transferred from the Permanent Naval Forces Leave due on

(Sea-going) to the Auxiliary Services, who is permitted to carry forward transfer.

recreation leave due may, with the approval of the Naval Board, and subject to the existence of vacancies on the appropriation, continue to be borne on the books of one of H.M.A. Ships or Establishments on Sea-going rates of pay and allowances from the date of his transfer for a period equal to the amount of recreation leave due, and the leave shall subsequently be taken at consolidated rates of pay only.

70, Chief Petty Officers and Petty Officers of the Permanent Naval Men lent

Forbes (Sea-going) lent for service on the Royal Australian Naval Reserve IZIgtoigg Staff of the Auxiliary Services shall continue to receive the rates of pay and

allowances prescribed for their corresponding ratings in the Permanent Naval Forces (Sea-going).

71. District Allowances on the same scale as paid to members of the District

Commonwealth Public Service may be paid to all members of the Permanent Allowances.

Naval Forces in receipt of consolidated rates of pay while residing in any district or locality for which a District Allowance has been approved under Public Service Regulations.

72, (1) On first appointment to the Auxiliary Services, direct from the uniform vfasttuities on shore, after the expiration of six calendar months from discharge or

resignation from the Permanent Naval Forces (Sea-going) or other Naval Appointment.

Uniform Gratuities on Promotion or Change of Class of Uniform subsequent to entry.

(3) Persons permanently transferred to the Auxiliary Services direct from the Permanent Naval Forces (Sea-going) will not normally be eligible for uniform gratuities set forth herein ; but when such transfer involves a change in class of uniform, the District Naval Officer or Commanding Officer may approve of the payment,of uniform gratuities not exceeding the maximum rates prescribed in sub-regulation (1) of this regulation.

(4) Uniform gratuities prescribed in sub-regulation (1) of this regulation shall not be payable again on re-engagement in the Auxiliary Services.

(5) On first appointment to the Naval Dockyard Police, uniform as approved by the Naval Board shall be provided at Government expense, or a uniform gratuity in lieu may be paid at the following rates :—

(2) No gratuity shall be paid on change of uniform from Class IL to Class III. or from Class III. to Class IL where such change is in consequence of the transfer of a member at his own request or owing to misconduct.

(3) A member of the Permanent Naval Forces (Sea-going) in receipt of sea-going rates of pay who is lent to the Auxiliary Services shall be entitled to Uniform Gratuity and Kit Upkeep Allowance at the rates prescribed in these Regulations for members of the Sea-going Forces.

74. (1) Deferred Pay in accordance with the scale prescribed in sub-regulation (9) of this regulation shall be allowed to accumulate to the credit of every officer and man serving in the Permanent Naval Forces (Auxiliary Services) provided that Deferred Pay shall not be credited to an officer who prior to 19th October, 1925, elected to contribute for superannuation benefits under the terms of the Superannuation Act 1922-24 in lieu of Deferred Pay

(2) Interest at the rate of 32 per cent. shall be credited annually on the 30th June in each year on the amount of accumulated Deferred Pay (excluding shillings e,nd pence) standing at credit of each member on 30th

June of the previous year. Interest added to Deferred Pay Account shall be considered as part of accumulated Deferred Pay and shall bear interest accordingly.

(3) In the event of a member becoming entitled to receive Deferred Pay as prescribed in these Regulations and the amount of accumulated Deferred Pay standing at credit on 30th June prior to the date on which he became entitled to such payment being in respect of not less than twelve months' service, interest shall be allowed on such amount (excluding shillings and pence) from 1st July to the end of the month in which payment of Deferred Pay becomes due.

(4) Deferred Pay and accumulated interest will become payable upon final discharge from the Active List of the Auxiliary Services except as provided in sub-regulation (5) of this regulation.

(5) No person who is—

(a) discharged " Run " ; (b) dismissed from His Majesty's Service with disgrace ; (c) dismissed from His Majesty's Service ; (d) discharged from the Service as " Services no longer required "

or whose services are dispensed with on account of mis-conduct ;

(e) discharged at own request whether by voluntary retirement or resignation ; or

(f ) invalided from the Service for causes due to misconduct or within his own control,

shall be entitled to any payment under this regulation.

(6) No payment in respect of accumulated Deferred Pay shall be made other than as prescribed in sub-regulation (4) of this regulation, but the Naval Board may, in special circumstances, restore the whole or any portion of the Deferred Pay which, but for the reasons set out in sub-regulation (5) of this regulation, would have been payable.

(7) Deferred Pay shall not be credited in any of the following circum-stances :-

(a) during imprisonment or detention (either summarily or by Court Martial) ;

(b) during imprisonment following conviction by a Civil Court ; (c) during confinement in cells ; or (d) during sick leave granted without pay.

(8) In every case where Active Pay is drawn, Deferred Pay allowed shall be credited. Mulcts for leave breaking or deductions on account of being in 2nd class for conduct, and sick leave on reduced pay shall not affect Deferred Pay.

(9) The daily rates of Deferred Pay shall be as follows :-

(10) The amount of Deferred Pay which may be paid to an officer of the Auxiliary Services who is transferred thereto from the Permanent Naval Forces (Sea-going) shall not exceed the amount which would have accumulated to his credit had he remained in the Sea-Going Force and attained in such force a rank equivalent to the rank held by him in the Auxiliary Services. The Naval Board shall determine the maximum amount of Deferred Pay payable under this provision.

(11) In any case where the accumulated Deferred Pay, with interest, for which a member may become eligible under the foregoing sub-regulations on discharge on account of having attained the prescribed age for retirement or on account of invalidity or retrenchment is not equivalent to one year's Active and Deferred Pay at the rate received by the member immediately prior to termination of his service, the Deferred Pay of the member shall be increased by the addition of such sum as will equal the difference between the amount of accumulated Deferred Pay and one year's Active and Deferred Pay.

(12) For the purposes of this regulation, retrenchment shall be deemed to mean the compulsory termination of the services of a member for the reason that his service or position is not necessary, or for the reason that the work for which he was appointed or engaged is finished, or for the reason that a reduction in numbers borne has been decided upon, provided always that the member has been in the service of the Commonwealth for not less than ten years continuously, immediately prior to termination of his service.

(13) Where an officer or rating had served previously in the Permanent Naval Forces (Sea-Going or Auxiliary Services), the additional Deferred Pay which would otherwise be credited under the `provisions of sub-regulation (11) of this regulation, shall be reduced by the amount of Deferred Pay paid

respect of such previous service, and by the amount of any payment made

-to the Admiralty in respect of the member on account of pension liability, and also by the amount of any payment made to the member or his depen-dants as an Act of Grace.

(14) In the event of the death of a member while serving, the amount of any payment under this regulation shall be paid to the widow and dependent children in such proportions and under such conditions as the Naval Board may determine. The amount payable in respect of an infant dependent child may be paid on behalf of such child to the widow or such other person as the Naval Board may direct. The receipt of the person to whom payment is made on behalf of an infant dependent child shall constitute an absolute discharge to the Commonwealth in respect of the payment of the amount determined as the proportion payable to such child.

(15) An officer or a rating in receipt of Royal Navy Retired Pay or Long Service Pension appointed to or engaging in the Auxiliary Services shall not be eligible to receive an additional amount of Deferred Pay under the pro-visions of sub-regulation (11) of this regulation unless he has completed five years' service in the Permanent Naval Forces (Sea-going or Auxiliary Services) subsequent to completion of time for R.N. pension.

(16) A member who retired under the Defence Retirement Act 1922, or a -person who has been granted any pension or superannuation allowance -under the laws of a State or under the terms of the Superannuation Act 1922-24 shall not be eligible to receive an additional amount of Deferred Pay under the provisions of sub-regulation (11) of this regulation.

PART IV.

VICTUALLING

75. Rations shall be supplied to officers and men of Permanent Naval Rations.

Forces (Sea-going), subject to such conditions as may be determined by the Naval Board.

76. (1) Except in such cases as may be approved by the Naval Board, victualling Ships and Establishments shall be victualled under the General Messing Allowance. System at a rate of ls. 9d. per head per diem. This Victualling Allowance may also be paid in lieu of the Standard Ration and Messing Allowance, subject to such conditions as may be determined by the Naval Board.

(2) Officers shall, subject to such conditions as may be prescribed, draw the Victualling allowance in cash.

(3) The rates to be charged for provisions issued on repayment to the General Mess and to a Repayment Mess shall be as set forth in the Fixed Issuing Price List approved by the Naval Board.

(4) Articles, the price of which is not otherwise provided for by the Naval Board, shall be issued at cost price.

77. (1) The daily standard ration for ships not victualled on the General standard

Messing 78. In addition to the daily standard ration prescribed in regulation 77, Allowance. a Messing Allowance of 9d. per diem shall be payable in cash to the

Messes of Officers and Men who are victualled in kind on the standard ration.

Leave 79. When rations in kind are not supplied during periods on leave Allowance. exceeding 48 hours, a Leave Allowance at the rate of ls. 9d. per diem shall be

paid in lieu of rations. This allowance shall not be paid on account of week-end leave.

Provision 80, When rations in kind are not supplied during periods of duty, and Allowance. members are required to victual themselves from other than Service sources,

a Provision Allowance at the rate of 3s. per diem shall be paid.

81. The Naval Board may in exceptional circumstances, and on pro-duction of satisfactory evidence, release an Accountant Officer of a portion or the whole of the liability resulting through a debit balance in the General Mess Account.

82. Mess savings shall be paid to the Mess Caterer,

83. Extra issues other than for ordinary meals shall not be charged against the Messing Allowance, but shall be included in the Provision Account, and credit taken for same at the end of each quarter or period of account.

84. Excess breakages of mess utensils, due to stress of weather or circum-stances other than neglect, may, at the Captain's discretion, be replaced free of charge to the messes.

85, An Accountant Officer shall be liable to the Crown for any losses resulting from the condemnation of provisions obtained in excess of require-ments.

86. Expenses incurred by Officers' Messes in entertaining official visitors shall not be allowed as a charge against Government funds, except in exceptional circumstances approved by the Naval Board,

Auxiliary 87. (1) A member of the Auxiliary Services shall not be eligible for any services. issue of rations in kind or to payment in lieu thereof except as provided in

sub-regulation (2) of this regulation and in regulations 99 and 100.

(2) Except as provided in regulations 99 and 100, and subject to such other conditions as may be determined by the Nava] Board, a member of the Auxiliary Services employed in camps of training or on other duty which necessitates his absence over night from usual place of residence, shall be entitled to rations in kind or allowance in lieu in accordance with the rate and scale approved for a member of the Permanent Naval Forces (Sea-going).

PART V.

COMPENSATION FOR INJURIES.

88. (1) The Naval Board may authorize payment of compensation to a Assessment. nember of the Permanent Naval Forces who is retired or discharged on account of—

(a) wounds received or disease contracted on active service ; (b) injuries received on duty or disease contracted on and attributable

to service, provided the injury or disease was not due to the member's default.

(2) The compensation payable under this regulation, which the Naval Board may authorize, shall be according to the following scale :-

(a) The maximum amount. (b) Three-quarters of the maximum amount. (c) One-half of the maximum amount. (d) One-quarter of the maximum amount. (e) One-eighth of the maximum amount. (f) One-sixteenth of the maximum amount.

(3) The maximum amount of compensation payable under this regula-tion shall be a sum equivalent to three years' pay of the member at the date of his retirement or discharge, and shall be awarded only in case of total disability to earn a livelihood,

(4) In case of partial disability, the compensation payable under this regulation shall be less than the maximum amount, and shall be fixed in accordance with the scale, so that the amount awarded shall be pro-portionate to the degree of disability of the member as may be determined by the Naval Board.

(5) For the purpose of assessing compensation in the case of persons on sea-going rates of pay, the following payments and allowances only shall be considered as pay

(a) Active Pay. (b) Deferred Pay. (c) Good Conduct Badge Pay. (d) Allowances for special qualifications. (e) Victualling Allowance. (f) Kit Upkeep Allowance. (g) Marriage Allowance. (h) Dependant Allowance.

The allowances under paragraph (d) shall be included only for members actually entitled under Regulations to receive such allowances by reason of qualifications held. Victualling Allowance under paragraph (e) shall represent the daily allowance for rations, fixed from time to time, to be allowed under the general messing system.

(6) In the case of members of the Auxiliary Services, Deferred Pay shall not be included as pay for purpose of compensation.

Widows and 89. (1) The Naval Board may authorize payment of compensation to families. the widow and children of a member of the Permanent Naval Forces who

is— (a) killed on Active Service or dies from wounds received or disease

contracted on Active Service ; (b) killed on duty or dies from injuries received on duty or disease

contracted on and attributable to Service, if the death or disease was not due to the member's default.

(2) The amount of compensation authorized shall be three years' pay as defined in regulation 88, sub-regulation (5), at the rate received by the member immediately prior to his death. No claim for compensation shall be considered unless it is made within twelve months of the death of the member.

(3) The amount of compensation payable under sub-regulation (2) of this regulation shall be distributed in such proportions and in such manner as the Naval Board determines, having regard to the circumstances of the widow and children. The compensation apportioned in respect of an infant child may be paid on behalf of the child to the widow or such other person as the Naval Board directs.

(4) The receipt of the person to whom payment is made on behalf of an infant child shall constitute an absolute discharge to the Commonwealth in respect of any compensation payable to the child under this regulation.

Minor injuries. 90. (1) The Naval Board may authorize payment of a gratuity not exceeding a maximum of £8 in each case, to Chief Petty Officers, Petty Officers, and men invalided or discharged who, at date of discharge are suffering from any disabilities resulting from minor injuries sustained on duty for which a Hurt Certificate (Form A.M. 183) has been granted in accordance with Regulations. Such gratuity shall be payable at the expiration of the rating's engagement only, and shall be in addition to any compensation awarded under the provisions of regulation 88 in respect of any other disability.

(2) The following condition shall apply generally to payment of the gratuity :—

(a) The injury must be one for which a Hurt Certificate has been granted, but possession of a Hurt Certificate shall not entitle any rating to the gratuity where no disability exists.

(b) The amount of gratuity shall be assessed by a Board of Survey consisting of, at least, two Medical Officers, due regard being given to the rating's future occupation.

(c) The Board of Survey shall assess, separately, the gratuity for any disability arising from any previous minor injury for which a Hurt Certificate is held in any case where the rating is being invalided in consequence of a hurt or sickness attributable to the Service.

(d) The Naval Board shall determine the amount of gratuity, if any payable, each case being dealt with on its merits.

91. An Officer on the Retired or Emergency List, who may receive Officers on Emergency

hurts or wounds as the result of active service in the Royal Australian Navy, List. or his wife and children in the event of his being killed or dying of injury whilst so serving, shall be eligible for the award of compensation as if the Officer had been on the Active List of the Permanent Naval Forces (Sea-going).

PART VI.

TRAVELLING AND TRAVELLING ALLOWANCES.

I.—PERMANENT NAVAL FORCES (SEA-GoiNG).

92. (1) The following shall be the rates of travelling allowances which scale of travelling

(2) The minimum period of absence for which payment may be made is conditions for

six hours, and the maximum period fourteen days except in such special payment.

(3) Members of the Sea-going Forces detained at a port waiting to join ship or on appointment to a ship or depot, or otherwise on duty away from ship or depot, where service accommodation is not available, shall enter lodgings as soon as possible. Travelling allowance under sub-regulation (1) of this regulation may be paid when travelling.to the port or place of duty ; the allowance may also be paid for three days, or four, if including a Sunday, while seeking lodgings, and then lodging and provision allowances shall be paid. In cases, however, where it is known definitely that the total period of detention waiting to join a sea-going ship will not exceed seven days, or that service accommodation will be available within seven days, travelling allowance at the full rate shall be payable throughout the period. A certificate shall be given in the body of the voucher on which travelling allowance is paid to the effect that quarters are not available.

(4) Officers and men when absent over 48 hours and entitled to Travelling Allowance, shall have deducted therefrom the amount of Victualling Allow-ance, if any, credited to them on the Ship's ledger in respect of such absence.

(5) Travelling Allowance shall not be payable concurrently with Lodging Victualling, Leave, Messing or Provision Allowances, or when quarters are provided at place of duty, except that Officers in receipt of the annual rate of Lodging Allowance may, when absent from head-quarters on duty, draw such allowance concurrently with Travelling Allowance for a period not exceeding seven days provided lodgings are retained and paid for during the period.

(6) Travelling Allowance shall not be payable when travelling by steamer or other vessel, or by railway, in which quarters and rations are provided.

(7) Boys and ratings under 18 years of age who are proceeding to their homes on Christmas leave may be paid Travelling Allowance in advance at the rate of 4s per diem (for a portion of a day, ls. for the first six hours and 6d. for every subsequent three hours) while actually travelling from ship to home and from home to ship, but no Travelling Allowance is payable when the boys or other ratings are accommodated on trains or ships where meals are provided at the expense of the Department.

(8) Ratings dismissed or finally discharged from the Service for any cause other than by purchase or at their own request may be paid Travelling Allowance for the journey to the actual place from which they were originally recruited within the Commonwealth or to their Port Division, but the amount advanced for Travelling Allowance is to be charged against any sums due to the rating.

93. (1) When detached for duty on shore or in other ships for periods of less than six hours, members of the Permanent Naval Forces (Sea-going) may be paid Meal Allowance at the following rates :—

(2) The amount payable in respect of meals shall be additional to Victualling Allowance, if any, credited.

94, (1) All Officers temporarily loaned to other ships for periods exceeding six, but under 48 hours, who are required to continue their mess subscription in their own ship during the period of loan, may be paid an allowance of :—

5s. for Commissioned Officers (including Commissioned Officers from Warrant Rank),

4s. for Warrant and Subordinate Officers,

for a whole day's absence, and Meal Allowance for broken periods, but not to exceed two meals in any one day. Payment shall be made in such cases in the ship from which the officer is loaned.

(2) Ratings belonging to the Permanent Naval Forces lent to vessels or services in which they have to contribute to a higher official rate of messing shall be allowed the difference, subject to the approval of the Naval Board in each case.

95. Officers and men lent to the Auxiliary Services from the Permanent Naval Forces (Sea-going) who are in receipt of sea-going rates of pay shall not, in any circumstances, be eligible for transfer, removal, or travelling expenses other than as prescribed for the Permanent Naval Forces (Sea-going) in these Regulations.

96. (1) Recruits may receive Travelling Allowance and be provided Recruits.

with accommodation by rail or steamer as per scale prescribed for Seamen and other ratings in sub-regulations (1) of regulations 92 and 103, for the journey from the place where they are recruited to the ship or depot of final entry.

(2) If rejected at the final examination, Travelling Allowance and accom-modation may also be granted for the return journey.

IL—ROYAL AUSTRALIAN NAVAL AUXILIARY SERVICES, ETC.

97. (1) When travelling on duty and

(2) When members travel by steamer or other vessel, or by railway, and the fare paid includes subsistence one-quarter of the ordinary rates shall be allowed.

(3) Where a member is provided with subsistence and lodging, the Naval Board shall determine what allowance, if any, shall be granted, but any allowance granted shall not exceed one-quarter of the amount specified in the scale of travelling allowances, according to the period of residence in the same place.

(4) Where an officer is provided with subsistence without lodging, or is provided with lodging without subsistence, the Naval Board may reduce the prescribed travelling allowances, but the allowance shall not be reduced by more than one-third in any case where lodging only is provided, or by more than two-thirds where subsistence only is provided.

Scale of meal 98. Members of the Royal Australian Naval Auxiliary Services, Officers allowance when travelling. and other persons in receipt of consolidated rates of pay detached for

temporary duty and required to travel for periods which do not necessitate absence over night from their head-quarters or temporary head-quarters, may be paid Meal Allowance at the rates and under the conditions prescribed in the following paragraphs :-

(a) Members absent from their head-quarters or temporary head-quarters during at least two meal periods shall, subject to the provisions of paragraph (c), be paid for meals as under :—

(i) Where a member is absent far at least twelve hours, and such absence covers three meal periods, actual ex-penses incurred for three meals may be paid.

(ii) Where a member is absent during two meal periods payment of expenses necessarily incurred for one meal only may be paid.

Where a member is absent during one meal period only, no payment will be made.

The amount payable in respect of meals shall be the actual amount necessarily expended, but in no case shall the amount allowable exceed the following rate :—

99. A member of the Royal Australian Naval Reserve Staff detailed to attend a military course of training away from his head-quarters in a city or suburban area and required to obtain his mid-day meal away from his usual place of residence, may be paid a luncheon allowance not exceeding ls. 6d. per diem for each whole day attendance.

In exceptional cases, when a member of the Auxiliary Services in receipt of consolidated rates of pay is required for duty, beyond the ordinary hours of duty, and such duty necessitates his obtaining a meal or meals away from his usual place of residence, he may be granted the actual amount expended on such meal or meals, provided that :--

(a) The maximum sum allowable in such instance shall not exceed the rates prescribed in regulation 98.

(b) The member concerned is unable to reach his usual place of residence within the normal meal time allowed.

(c) The officer responsible certifies to having issued the order directing the member to such duties.

101. Meal Allowance shall not be payable concurrently with Travelling Allowance or when rations in kind are issued.

III.-TRAVELLING ALLOWANCE-GENERAL.

102. (1) Claims for travelling Allowance (including any expenses incurred Time limit

for conveyance of baggage) and for Travelling Expenses shall be submitted for for payment not later than one month after the completion of the journey.

(2) Claims for increased rate of travelling or other allowances consequent Rate on

on promotion to higher rank shall not be admitted for any period prior to promotion, &c_

date of gazettal or notification of the promotion. (3) Officers and others holding temporary or acting rank shall draw the

allowances of such rank. (4) No Officer shall travel on duty without first obtaining the written Authority for

instructions of his Commanding Officer, and such Commanding Officer, travelling.

before issuing such instructions, shall satisfy himself that the travelling is necessary, and shall state the nature of the duty on the written authority.

(5) Except as otherwise prescribed in this regulation no travelling or other allowance shall be payable towards the cost of first taking np appointment.

(6) Persons appointed to the Permanent Naval Forces (Sea-going) may receive Travelling Allowance at the scale provided in regulation 92 sub-regula-tion (1), and be provided with accommodation by rail or steamer as per scale in regulations 103 and 104 for the journey to Ship or Establishment to which appointed.

(7) In the case of persons appointed to the Auxiliary Services, where the cost of railway or other fares for conveyance of the member, his wife and family, to the locality of appointment, exceeds the member may be allowed the amount in excess. The Naval Board may increase the allow-ance where, in its opinion, the circumstances warrant it.

(8) On first taking up appointment in the Auxiliary Services within six months after termination of long service in the Sea-going Forces, transfer and removal expenses as prescribed in regulation 115 may be paid to persons who are required to transfer their residence to an outport within a State or to another State.

(9) Gratuities to railway porters, stewards, &c., are inadmissible, but Gratuities.

porterage outside the railway station will be allowed for journeys with baggage of a bulky nature, or over 28 lb. in weight, when cab hire is not charged.

(10) The rates of Travelling Allowances are exclusive of any cost of Times for

conveyance by rail, coach, or steamer, and, in computing the period, the calculation

time shall be counted from the time of departure by train, coach, or steamer, to the time of return by the same.

(11) Where it is proved to the satisfaction of the Naval Board that the variation of

Travelling Allowance payable to a member under these Regulations is, as a ra te' rule, either insufficient to cover, or in excess of expenses reasonably incurred, the Naval Board may vary the allowance.

(12) All advance up to 75 per cent, of the maximum Travelling Allowance Advances.

to which it is anticipated a member may be entitled may be made where extended absence is probable and cash payments exceeding a total sum of £5 require to be made.

IV. TRAVELLING AT GOVERNMENT EXPENSE.

(4) Chief Petty Officers will not be granted. sleeping berth accommodation when travelling by rail except for the journey between Perth and Port Augusta.

(5) Where a warrant is issued. chargeable to the Department, the cost of booking a seat, if necessary, shall be included in the warrant.

(6) When drafts are sent by train, seats shall be reserved., whenever possible, in proximity, in one or more compartments for the Petty Officers in charge or sub-charge and men.

(7) The means of conveyance shall be by railway if the cost be not greater than by other mode of conveyance.

(8) The Naval Board. may, in special circumstances, allow a superior class of accommodation to any rating who would. otherwise be required. by this regulation to travel second class.

104. (1) The following shall be the classes of accommodation by sea, except where otherwise stated. in this regulation, when travelling at Government expense in mercantile vessels :-

(3) When travelling in company with members of the Royal Navy, Petty Officers shall conform to the arrangements adopted. for their corresponding Royal Navy ratings.

(4) Commanding Officers may assign a superior class of accommodation to invalids upon medical recommendation.

(5) A rating whose steamer passage has been booked for draft overseas who, consequent upon a medical examination, is found to be medically unfit for draft owing to his own default may, at the discretion of the Naval Board, be debited with any charges made by the shipping company arising out of the cancellation of his passage.

(6) In special circumstances the Naval Board may assign a superior class of accommodation.

105. In such special cases as may be approved by the Naval Board, officers travelling overseas on duty may receive the passage money for the class and route to which they are normally entitled, and be allowed to make their own arrangements for passage. Where, in special circumstances, approval to travel by a route other than that normally allowed is given at an officer's own request, any additional expense thus incurred must be borne by such officer. In every case shipping company or railway vouchers must be produced for the full sum advanced.

106. Passage at Government expense of the wife and family of an officer Passage of

107. (1) In those cases where Officers and men are entitled to passages by Families.

sea or rail, at Commonwealth expense, for their wives and families, the term " children " is to be understood to include only such sons as are not over 16 years of age at the date of commencement of the journey, and unmarried daughters dependent on and residing with their fathers. An exception to this rule may be permitted in the case of sons over 16 years who by reason of physical or mental infirmity are necessarily dependent on their parents.

(2) Steamer, rail, or other fares of adopted children are not allowable except in special circumstances with the approval of the Naval Board.

108. Officers and men proceeding to complete unexpired leave after recall shall be entitled to railway warrants at Government expense for both the forward and return journeys, but shall not be entitled to such railway warrants or any expenses in the following cases :-

(a) Where the unexpired portion of the leave subsequent to recall will not admit of at least 24 hours being spent at their destination ;

(b) Where the additional leave is granted in excess of four days over the unexpired period of leave originally granted ; and

(c) Where they are aware, before proceeding on leave, that it is probable they will be recalled.

109. Warrants chargeable to the Department may be issued in the following cases :-

(a) Officers and men of the Sea-going Forces given Christmas or Foreign Service Leave at Sydney or Melbourne, in respect of the journey beyond Adelaide or Brisbane to home, such ranks and ratings themselves bearing the cost of the journey as far as Adelaide or Brisbane, provided that, in the case of Foreign Service Leave, if such leave commences later than 30th April, no further warrant will be granted for the ensuing Christmas Leave.

(b) Boys and ratings under 18 years of age who are proceeding to their homes within the Commonwealth on Christmas Leave.

110. (2) Flag Officers, Commodores, and Officers in Command, appointed in the United Kingdom to the Royal Australian Navy, who join their ships at ports in Australia, may be allowed free conveyance to Australia of combined baggage and mess stores in accordance with the scale prescribed in King's Regulations and Admiralty Instructions.

(3) Chaplains will be allowed 2 cwt, for Books, Medical Officers 2 cwt. for professional books and instruments, and Officers in charge of Paymasters' Accounts 1 cwt, for books and accounts in addition to their allowance of Baggage according to their seniority, as prescribed in sub-regulation (1) of this regulation.

112. (1) Except as provided in sub-regulation (8) of this regulation, cab Cab hire

hire shall be allowed to Officers only when travelling with baggage. (including taxi cabs).

(2) Except as provided in sub-regulation (8) of this regulation, cab hire will not be allowed when railway or other ordinary public conveyance is available. Claims for cab hire must be supported by a statement showing the necessity for using carriages or cabs, also the places from and to, and distance travelled.

(3) Except as provided in sub-regulation (8) of this regulation, cab hire will not be admissible for distances of less than 2 miles, unless baggage of a bulky nature or of over 28 lb. weight is necessarily taken, or unless such conveyance is required for necessary saving of time apart from all cir-cumstances under the Officers' own control.

(4) Cab hire shall be allowed to Petty Officers when travelling with baggage if no cheaper mode of conveyance is available.

(5) When cab hire is claimed for more than 5s., receipt for such payment must accompany claim. Claims for cab hire at rates in excess of the legal fares are not admissible. Claims for hire of taxi-cabs shall not be admitted where the rates for hire of such cabs exceed the rates for hire of ordinary cabs.

(6) When an Officer or Petty Officer proceeds on duty by rail or steamer, the amount which may be approved for cab or taxi hire between ship, depot or home and railway station or steamer shall be limited to 5s. except in special cases when the Officer, in Command may approve of a larger amount being paid on production of supporting receipt. When such special approval is given the reason shall be stated on the voucher.

(7) When two or more Officers or two or more Petty Officers proceed from one quarter on the same duty, a separate cab will not be allowed for each, unless it be shown that it was impracticable for the Officers or Petty Officers to perform the journey together.

(8) Notwithstanding that ordinary public conveyance may be available, Cab hire for

motor cars may be utilized in the case of Officers required to travel on duty official ealls,

through the public streets in No. 3 or No. 4 dress with swords, in connexion with the paying of official calls, attendance at funerals, special church parades, and police courts, or in the case of Aides-de-camp on duty when required to wear the dress aforementioned.

(9) In the case of Officers not in command, the Commanding Officer shall certify on the voucher that the Officers for whom the cars were hired under the provisions of sub-regulation (8) of this regulation were officially detailed for the duty.

113. In cases other than those referred to in sub-regulation (8) of regu- Motor cart

Lion 112, motor cars shall be engaged only for such official duties as cannot efficiently be performed by the medium of normally available means of transport ; and wherever practicable the approval of the Naval Board shall be obtained before the expenditure is incurred or payment made therefor.

114. (1) Officers who use their own motor cars when travelling on Allowance for

public business, or any member whose motor car is used for such purpose, musgtoof, pora7,3ate

may be allowed in respect thereof payment at the rate of 8d. per mile.

(2) The prior approval of the Naval Board or the Secretary must be obtained to use a private car, and proof must be produced that the use of a motor car results in greater efficiency and saving than would be the case if any other conveyance were employed.

V.-TRANSFERS AND REMOVALS.—AUXILIARY SERVICES.

115. (1) When a member of the Royal Australian Naval Auxiliary Services or other person on consolidated rates of pay is transferred from a District, Sub-District, or station to another District, Sub-District, or station, the actual cost of rail, steamer, coach, or ether fares, at Government rates, of such member, his wife, and children (as defined in regulation 107) shall be paid by the Department, in addition to Travelling 7Allowance for such a member, provided such transfer is not made by way of punishment, or at the member or person's own request.

(2) Reimbursement of cost of removing necessary household furniture-shall be made subject to the following limitations :—

(3) In very exceptional circumstances where it can be satisfactorily proved that the amount as set out in sub-regulation (2) of this regulation is not sufficient to cover the actual cost of removal of necessary household furniture and effects, the Naval Board may approve the payment of an additional amount towards such actual cost.

(4) Persons shall not be entitled to any compensation for losses or damages arising from removal.

(5) Furniture, where practicable, shall be removed by railway if the cost be not greater than by other means of conveyance.

(6) The Naval Board may, in lieu of cost of removal, authorize payment ,

of an amount not exceeding the maximum prescribed for removal expenses to compensate for loss in any case where an officer elects to dispose of his furniture and effects instead of removing them to his new station.

116, (1) On discharge on account of having been found medically unfit for further service, or on completion of the term of service for which he was engaged or appointed, free rail, steamer, or coach transport may be pro-vided for the member, his wife and children, to home port, or in lieu thereof transport to any other place in the Commonwealth, provided that the cost of such transport does not exceed the cost of transport to the member's home port.

(2) The cost of conveyance of the furniture and effects in the possession of married members who are transported under sub-regulation (1) of this regulation may be borne by the Department.

(3) Except in special circumstances where the approval of the Naval Board has been obtained, the transfer at departmental expense must be carried out within three months of the member's retirement or discharge.

117. Where a married member, upon transfer, cannot enter into occupancy of quarters or private residence through unavoidable delay in transmission of furniture and household effects, or for any other reason approved by the Naval Board, and the member is therefore obliged to reside for the time being

with his family at an hotel or other house of accommodation, the Naval Board may approve of payment to such member of an allowance equal to the difference between ordinary household expenditure and cost of board and lodging, but not exceeding half the cost of board and lodging of himself and family, provided that such allowance shall not be paid for more than one month except upon the approval of the Naval Board.

PART VII.

MEDICAL ATTENDANCE, MEDICINES, AND DENTAL TREATMENT.

I.-PERMANENT NAVAL FORCES (SEA-GOING).

118. (1) Members of the Permanent Naval Forces (Sea-going) shall be Medical granted free medical attendance subject to the following sub-regulations. attendance.

(2) Arrangements may be made for admission and treatment of officers Hospital and men in a hospital with approved accommodation, and the expense so accommoda-

incurred shall be defrayed by the Department. ton.

(3) The term " hospital " referred to in these Regulations shall include any hospital-Naval, Military, civil (general or private), receiving home or ward, but shall not include Naval Sick Quarters.

In cases of venereal disease, however, the Sick Quarters at Garden Island and Venereal Ward at Flinders Naval Depot shall be regarded as a hospital, and all medical cases under " bed " treatment at Flinders Naval Depot and Royal Australian Naval College shall be regarded as receiving treatment in a hospital with approved accommodation.

(4) In cases where an officer or man elects to be treated in a private Private hospital, or by a private practitioner, a Naval hospital, or hospital with hospitals. approved accommodation being available, or where a patient, being an invalid or otherwise, is discharged, at his own request, from such hospital or from the care of a medical officer against the advice of such medical officer, such member shall assume all financial responsibility consequent upon his action, and, before his request is approved, shall sign a written undertaking to that effect, which shall be transmitted to the Naval Board.

(5) When, in an emergency, operations are performed by civil surgeons surgical upon officers and men at hospitals with which the Department has no operations '

arrangements as to fees, and when patients cannot travel to a recognized hospital, the sum allowed in payment of such operations shall be determined by the Naval Board, but shall not, unless in special circum-stances, exceed £30.

119. (1) Orthopedic or other surgical appliances shall be supplied only spectacles, &c. when recommended by the Board of Medical Survey and approved by the Naval Board in those cases where disability is directly attributable to service in the Permanent Naval Forces (Sea-going).

(2) Spectacles may be supplied to any rating in the classes permitted to wear them whose sight becomes defective after enetring the service, provided he is not considered a fit subject for invaliding.

120. (1) Full dental treatment, at the expense of the Department, Dental

shall be allowed to officers and men. Such treatment shall include extractions, treatment.

scaling of teeth, fillings (amalgam or cement), treatment of pyorrhoea and supply of dentures.

(2) The supply of dentures shall be limited to one upper and one lower set, except in those cases, where a new denture is considered necessary by the Medical Officer and the Surgeon Dentist owing to subsequent extractions. Ordinary repairs may be undertaken.

IL—PERMANENT NAVAL FORCES (AUXILIARY SERVICES' ) .

Medical 121. Members of the Auxiliary Services shall be entitled to medical attendance. attendance and treatment, including drugs, dressing and hospital treatment,

to the same extent as members of the Sea-going Forces, subject to such arrangements as may be made by the Naval Board from time to time, provided that they shall not be entitled to the sick allowance whilst on leave prescribed in regulation 125, nor to be refunded the cost of medical attendance whilst on recreation leave.

Dental 122. On the recommendation. of the Medical Officer dental treatment at treatment. the expense of the Department shall be allowed to members of the Auxiliary

Services. This treatment shall include extractions, scaling of teeth, fillings (amalgam or cement), also supply of porcelain. crowns, and dentures and treatment for pyorrhea under such conditions as may be approved by the Naval Board.

PART VIII.

LEAVE OF ABSENCE ON GROUND OF ILLNESS.

I.—PERMANENT NAVAL FORCES (SEA-GOING).

Sick leave. 123. (1) In peace time, members checked sick on account of disabilities for which they are not themselves responsible may, if not previously invalided from the service, be borne on full pay for a period not exceeding six months. During war time, the period of full pay under this regulation may, with Naval Board approval, be extended to eighteen months. Such periods shall include any sick leave granted under regulation 124.

(2) In special cases (such as serious bodily injury received whilst serving, insanity resulting from an accident on duty, or sickness due to extraordinary exposure or exertion on service), or in cases of sickness abroad, the Naval Board may determine the period in addition to that prescribed in sub-regula-tion (1), during which the member shall receive the full rate of pay.

(3) For the purposes of this regulation the term " sickness abroad " shall include sickness in Australia of a member of the Royal Navy serving in the Royal Australian Navy on loan.

(4) Except as prescribed in sub-regulation (2) of regulation 126, all members again checked sick with the same complaint within seven days shall be considered as under continuous treatment for the purposes of this regulation.

Sick leave— 124. (1) Sick leave may be granted to— conditions of.

(a) Members requiring convalescence after a severe illness, operation, illness due to service in the tropics or in an unhealthy climate, on the recommendation of a Naval Medical Officer.

(b) Members who elect to be treated privately under conditions pre-scribed by regulation 118 (4).

(c) Members sick on shore in consequence of being unfit to travel.

(2) Sick leave may be approved for a period not exceeding 30 days by the Commanding Officer, but the Naval Board may, at its discretion, extend this period.

(3) The Department will not be responsible for the payment of expenses incurred for medical and surgical treatment whilst on sick leave, unless in such exceptional circumstances as may be specially approved by the Naval Board.

125. When leave is granted under paragraph (c) of snb-re ation (I) of Sick

regulation 124, and the person is under treatment of a private practitioner, allowance.

a sick allowance of 6s. per diem may be granted up to a limit of ninety-one days from date checked sick. In exceptional cases this period may be extended by the Naval Board.

1260 (1) Members sick on shore or sent to hospital suffering -from disabilities Pay while on other than venereal disease, which are the result of the member's own sick list ,

misconduct, carelessness or neglect, shall be placed on half pay at the expiration of thirty days and cease pay at the expiration of ninety-one days.

(2) All such members again checked sick on shore or in hospital, within fourteen days from expiration of their previous period of sickness on shore or in hospital, shall be considered as being under continuous treatment, but only those days actually so checked shall be counted for the purposes of 'educed pay in accordance with the terms specified in sub-regulation (1).

127. (1) A member whilst uncle' treatment for venereal disease shall— Pay while under treatment

disease, ntfor

(a) on the first occasion, be placed on half-pay after fourteen days v

and cease pay after ninety-one days from the date of being placed under treatment

(b) on the second or any subsequent occasion, be placed on half-pay from the date of being placed under treatment, and cease pay after ninety-one days therefrom.

(2) In the case of a member who after 1st January, 1927, has been under treatment for venereal disease and is again placed under treatment for venereal disease, the Medical Officer shall certify whether the subsequent treatment is on account of a relapse or a new infection, and the case shall be dealt with under paragraph (a) or (b) of sub-regulation (1) of this regulation in accordance with the Medical Officer's Certificate.

(3) In any such instance where the Medical Officer certifies that the case is a relapse, the member shall be considered as being under continuous treat-ment, but only the days the member is actually under treatment shall be counted for the purposes of reduced pay or cessation of pay in accordance with the provisions of sub-regulation (1) of this regulation.

(4) In this regulation the meaning of the words " under treatment for venereal disease " shall include all cases of persons suffering from venereal disease, whether sick on shore or on the sick list or attending list, other than-

(a) those to whom a Hurt Certificate has been granted ; and (b) those syphilitic cases considered by the Naval Genito Urinary

Specialist as not being in an active condition and as fit for draft to any ship, although such cases may require further periodical treatment.

128. Members who are invalided shall not be granted any period of Home Leave and pay or Foreign Service leave, but shall be entitled to pay and allowances for when invalided.

Allowances. 129, (1) Marriage and Dependant Allowances shall be paid continuously

during sickness, from whatever cause arising, when full or half pay is paid ; but when a member is placed on half pay the provisions of regulations 41 sub-regulation (5) paragraph (g) and 42 sub-regulation (8) in regard to allotment of proportion of pay shall apply to the reduced pay.

(2) Whilst undergoing hospital treatment at Government expense, allow-ance in lieu of rations, or of quarters, shall not be payable.

Reduced pay. 130. Half pay during illness shall consist of half the substantive and

non-substantive rates of pay received by or credited to the member at the date of being placed on reduced pay. Marriage or Dependant allowance, if previously paid, shall, however, continue to be credited in full, subject to the provisions of regulation 129.

Deferred pay. 131, No reduction shall be made in deferred pay in respect of any period

during illness when reduced pay is drawn or of sick leave granted on reduced pay.

IL-PERMANENT NAVAL FORCE (AUXILIARY SERVICES),

Applications for 132. Applications for leave of absence on the ground of illness shall be sick leave. supported by the certificate of a duly qualified medical practitioner, except

in the case of single-day absences, not exceeding three in any twelve months, when, unless otherwise directed by the District Naval Officer, the production of a medical certificate shall not be necessary.

133. District Naval Officers or Commanding Officers, H.M.A. Naval Establishments, may, on production of satisfactory medical evidence, grant leave of absence on the ground of illness upon the following conditions :—

(a) The basis for determining the terms on which leave of absence may be granted on account of illness shall be ascertained by multiplying one week on full pay, two weeks on half pay, and four weeks on third pay, by the number of completed years of the member's service. For the purposes of this regulation

service " shall mean continuous service in a position of a permanent nature under the State or Commonwealth.

(b) To determine the leave, if any, for which a member is eligible under this regulation, the leave which has been granted during his service at rates of full pay, half pay, and third pay respec-tively shall be deducted from the periods ascertained under the provisions of paragraph (a) of this sub-regulation. Pro vided that, in the case of a member who was appointed to the Auxiliary Services before the commencement of this regulation, the leave of absence to be deducted shall be the leave of absence granted within seven years preceding the date of commencement of this regulation, together with any leave granted since such date.

Provided further that no deduction shall be made in respect of leave granted prior to 30th June, 1922, in the case of a member who served abroad during the Great War 1914-1918 as a member of any Naval or Military Force raised in Australia or in any other part of the British Empire, or as a member of the Naval or Military Forces of any ally of Great Britain.

(c) After deduction has been made as provided in paragraph (b) of this sub-regulation, the periods remaining at each rate of pay shall be the periods of leave for which the member is eligible at the date of application.

Provided that the maximum period allowable with pay in respect of any continuous absence through illness shall be fifty-two weeks.

(d) Where a member has exhausted all leave allowable with pay, he may be granted leave without pay.

Provided that in respect of any continuous period of absence, leave with pay and without pay shall not exceed seventy-eight weeks.

(e) In any case where a member has not completed twelve months' service, he may be granted such proportion of one week on full pay, two weeks on half pay, and four weeks on third pay as his service in completed months bears to twelve months.

(2) Upon the commencement of this regulation, a record shall be made as soon as practicable calculated as provided in this regulation, of the leave for which the member is eligible, and such record shall be amended from time to time as becomes necessary by recording any further leave granted the member, and the leave for which he is still eligible in accordance with his length of service.

(3) Notwithstanding anything contained in this regulation, where the illness of the member is due to injury sustained in the performance of his duty, the Naval Board may determine from time to time the period of leave of absence on account of illness which may be granted to that member and the conditions under which the leave may be granted.

134. (1) Where a member has been absent through illness for thirteen Extcnsion of . weeks continuously, and application for further leave is made, the District sick lcavc. Naval Officer, or Commanding Officer, may, subject to these Regulations, provisionally grant further leave, but all such applications with supporting evidence of illness shall be forwarded to the Naval Board.

(2) The granting of such further leave shall be subject to the member being examined and the leave being recommended by a District or Sub-District Naval Medical Officer.

135. If any member is absent from duty on account of illness and such Rcturn to absence has extended beyond thirteen weeks continuously, he shall not be d"ty° permitted to return to duty unless and until the District or Sub-District Naval Medical Officer has certified that he is fit to resume work.

Provided that where a member resumes duty after a lesser period than thirteen weeks' continuous absence due to illness, the District Naval Officer or Commanding Officer may, if he is of opinion that the member is not fit to resume duty, direct him to submit himself for examination by the District or Sub-District Naval Medical Officer, and if the examination discloses that the member is unfit to resume duty, the District Naval Officer or Commanding Officer shall grant such further leave of absence on account of illness as the medical report indicates as necessary.

136. (1) If the District Naval Officer or Commanding Officer has reason contagious to believe that a member is in such a state of health as to render him a danger t=a1Z to other members or the public, he may require the member to be examined illness. by the District or Sub-District Naval Medical Officer.

(2) Upon receipt of the medical report, the District Naval Officer or Commanding Officer may direct the member to absent himself from his duties for a specified period or if already on leave of absence, direct him to continue on leave for a specified period, and the member's absence shall be regarded as absence on leave owing to illness.

137. The rate paid far Sundays and public holidays occurring during absence on leave shall be the same as that -allowed for the period of leave in which the Sunday or holiday occurs.

138. (1) No leave shall be granted with pay on account of illness caused by misconduct of the 'a , ,, ea her or in any .case of absence from duty without sufficient cause

(2) When the District Naval Officer, - or Commanding Officer, or any officer approved by the District Naval Officer or Commanding (Officer, has occasion for doubt as to the cause of illness or the reason for the absence, he may require a medical practitioner to visit and examine the member, or may direct such member to attend on 'a medical practitioner for ,examination..

(3) If the report •of the medical _practitioner is not favorable to the member concerned, or if the member is not available for examination at the time of-:the medical practitioner's visit without, in the (opinion of the DiStrict Naval Officer or Commanding Officer, reasonable cause therefor, the cost to the Department of such examination or visit shall be charged against the member and be deducted from his pay.

(I) A member shall submit himself to medical examination when required to do so, by the medical practitioner selected by the District Naval Officer or

'Commanding Officer, or any officer approVed by the District Naval Officer or 'Commanding Officer.

PART IX.

FURLOUGH AND EXTENDED LEAVE.

Furlough. 139, (1) When a person has continued in -the service of the Commonwealth under the provisions of the Defence or Naval Defence Acts for at least twenty years, the Naval Board may grant him leave of absence for a period not exceeding one month and a half on full pay, or three months on half pay, in respect of each completed five years of continuous service.

Provided_ that such person shall not be granted leave of absence to exceed a continuous period of twelve months at any one time, and that service in the Permanent Naval Forces on loan from the Royal Navy shall not be counted as service qualifying for such leave of absence.

Provided further that in the case of any person being appointed to or enlisting in the Naval Forces after 30th November, 19I9, the service which -shall be taken into account for the purposes of this regulation shall not include any service in a temporary capacity.

Previous service, (2) Where a person has become transferred or appointed from any in State or Commonwealth. position of a permanent nature under the State or Commonwealth to a

permanent position in the service of the Commonwealth under the provisions of the Defence Act or Naval Defence Act, all continuous service of such person under the State or Commonwealth shall, for the purpose of furlough, be reckoned as service in:the service of the Commonwealth under the provisions of the Defence Act or Naval Derci-,ce Act.

(3) Members of the Permanent Naval Forces who served under the'terms of the Naval Agreement Act 1903, may, for the pranose of furlough, be allowed to count service under the terms of the Navel, Agreenz ,,nt Act 1903 as service in the service of the under the provisions of the Defence Act or Naval Defence Act, provided that service under the Defence Act or Naval Defence Act is continuous with service under the Naval Agrecnz-ent Act 1903.

(4) When a person who has continued in the service of the Commonwealth Furlough du

fur at least twenty years is retiring, the Naval Board may authorize payment on retirement.

to him upon retirement of a sum equivalent to the amount of pay that would have been received by him during such leave of absence as would immediately prior to retirement have been granted to him under sub-regulation (1) of this regulation.

(5) Upon the death of a person who, at the date of his death, was eligible Furlough due under this regulation for grant of leave of absence, the Naval Board may at death.

authorize payment to the dependants of the member of a sum equivalent to the amount of pay which would, under this regulation, have been granted to the person had he retired immediately prior to the date of his death.

(6) Notwithstanding anything contained in this regulation—

(a) There shall not be granted under this regulation, in respect of the service of any person, leave of absence or pay on retirement or death exceeding in the whole twelve months on full pay or its equivalent ;

(b) Except upon the retirement of a person who had attained the prescribed age of retirement, leave of absence for recreation shall not be granted under the Naval Forces Regula-tions in respect of the year in which leave of absence granted under this regulation commences, and, if leave of absence for recreation has been granted in the year in which leave of absence granted under this regulation commences, it shall be regarded as part of the period of leave of absence granted under this regulation : provided that the total period of leave of absence for recreation, which may under this paragraph be withheld or regarded as portion of the period of leave of absence granted under this regulation during any person's period of service, shall not exceed the period of absence for recreation which may be granted in respect of one year of service ; and

(c) The official conduct record of a person shall be taken into con-sideration in determining whether the whole or any portion of the leave of absence or pay provided in this regulation may be granted.

140. (1) The Naval Board may grant to any person whose period of service is less than twenty years who is ineligible for furlough under the last preceding regulation immediately prior to his retirement from the service on or subsequent to his attaining the prescribed age for retirement, leave of absence on full pay for a period not exceeding that appropriate to his service, as specified in the following scale :-

Service of sixteen years and less than twenty years—five months. Service of twelve years and less than sixteen years—four months. Service of eight years and less than twelve years three months. Service of four years and less than eight years—two months.

(2) Except as provided in sub-regulations (4) and (5) of this regulation, a person shall not be eligible for the grant of extended leave under this regulation unless he has completed twelve years' service.

(3) In lieu of leave in accordance with sub-regulation (1) of this regulation, the Naval Board may authorize payment to a person eligible for leave in pursuance of this regulation upon his retirement from the service of a sum equivalent to the pay for a period cf leave not exceeding that which the person could have been granted under this regulation.

Definition of pay.

(4) When a person who has not attained the prescribed age for retirement is invalided from the service after less than twenty years' service, and the cause of such invaliding is permanent and is not due to misconduct or to causes within his own control, the Naval Board may authorize payment to the person of a sum equivalent to the pay for a period of leave not exceeding that for which, had he attained the prescribed age for retirement, he would have been eligible under sub-regulation (1) of this regulation.

(5) In the event of the death of a person before he has completed twenty years' service and either before or after he has attained the prescribed age for retirement, the Naval Board may authorize payment to the dependants of the person of a sum equivalent to the pay for the period of leave which the member would have received had he been eligible for, and granted leave of absence under sub-regulation (1) of this regulation.

(6) The official conduct record of a person shall be taken into consideration in determining whether the whole or portion of his leave of absence or pay provided in this regulation may be granted.

(7) A member of the Auxiliary Services of the Permanent Naval Forces who is retired voluntarily or compulsorily in pursuance of the decision of the Government to re-organize and retrench the Department of Defence, may, notwithstanding that he has not reached the age for retirement, be paid, subject to the approval of the Governor-General, the sum equivalent to the pay for the period of leave for which he would be eligible under sub-regula-tion (1) of this regulation had he reached the age for retirement at the date of the termination of his appointment or of his discharge.

141. (1) For the purposes of extended leave or furlough as regards person on Sea-going rates of pay the following payments and allowances only shall be considered as pay :-

(a) Active Pay. (b) Deferred Pay. (c) Good Conduct Badge Pay. (d) Allowances for special qualifications. (e) Victualling Allowance. (f) Kit Upkeep Allowance. (g) Married Allowance. (h) Dependant Allowance.

The allowances under paragraph (d) shall be included only for members actually entitled under Regulations to receive such allowances by reasons of qualifications held. Victualling allowance under paragraph (e) represents the daily allowance for rations fixed from time to time, to be allowed under the general messing system.

(2) When payment of a lump sum is granted in lieu of extended leave or furlough the payments and allowances referred to in sub-regulation (1) of this regulation shall be included in the payment in respect of the whole period at the rate which the member was entitled to receive at the date of termination of his appointment.

(3) In the case of the Auxiliary Services, Deferred Pay shall not be included as pay for purposes of payment in lieu of extended leave or furlough.

PART X. MISCELLANEOUS.

Sale of stamps. 142. Accountant Officers are authorized to purchase a supply of ordinary postage stamps from the public money in their charge for sale to the Ship's company.

approval. (2) Stores lost from theft, robbery or misappropriation on the part of an

employee of the Department shall not be written off without the approval of the Treasurer.

(3) Obsolete or unserviceable stores, arms and equipment may be lent with the approval of the Naval Board.

(4) Stores which form part of the equipment of the Naval Forces for war shall not be issued on loan for use for other than naval purposes except for charitable purposes and then only by special consent of the Minister.

(5) The Naval Board may approve of the sale or the writing oft of condemned, unfit, damaged or deficient stores, the value of which does not exceed £100.

(6) The Director of Naval Stores and Victualling, and the Director of Ordnance, Torpedoes and Mines, may approve of the sale or writing off of condemned, unfit, damaged or deficient stores, the value of which does not exceed £5.

(7) The Naval Board may, subject to naval requirements approve of the issue of stores on repayment of not less than cost, to other Common-wealth Departments, to the Imperial Government and to other Govern-ments.

(8) This aegulation shall not apply to the sale of articles of kit and other articles, the issues of which are governed by regulation.

144, (1) An expenditure not exceeding Ten pounds may be authorized Funerals—

by District Naval Officers on funerals of members of the Permanent Naval sAeu rvxlcheT,L, Forces and members of the Royal Australian Naval Reserve who die whilst reserves.

on duty, or as the result of illness or injury contracted on duty. (2) Where it is proved to the satisfaction of the Naval Board that the

actual necessary expenses incurred were in excess of £10, the Naval Board may approve payment of such further sum as may be considered reasonable.

145, (1) An expenditure not exceeding Ten pounds (£10) may be Funerals—

authorized by Commanding Officers for funerals of members of the psl.a,1112 Permanent Naval Forces (Sea-going) who are buried on siere.

(2) Where it is proved to the satisfaction of the Naval Board that the actual necessary expenses incurred on the burial were in excess of £10, the Naval Board may approve payment of such further sum as may be considered reasonable.

(3) Where the burial is undertaken by relatives, the Naval Board may approve of re-imbursement of funeral expenses incurred. The sum approved however, shall not exceed the cost which would have been incurred had the funeral been carried out by the Department, and shall be subject to deduction of cost of the coffin and other expenses which may have been incurred by the Department prior to the removal of the body.

(4) The relatives may have the body conveyed, at their own expense, from the place of death to the deceased's home for burial, or may be issued with two second-class railway warrants, at Government expense, to enable the nearest relative and one other to proceed to and return home from the Naval Funeral.

143. (1) Government stores, except as hereinafter provided, shall not Loan and sale

(5) The procedure to be adopted by Commanding Officers of Ships in which a member of the Permanent Naval Forces (Sea-going) dies whilst the vessel is in a port of the Commonwealth or outside the Commonwealth, in regard to obtaining quotations from local undertakers for the funeral and payment of the undertaker's account shall be such as the Naval Board may approve from time to time.

146. (1) The Naval Board may approve of a charge being made for entrance to sports grounds enclosed in Naval property, subject to snob conditions ao may be approved.

(2) Amounts collected as a result of such charge shall be paid to the credit of a General Fund or Sports Fund, but shall not be used for the advantage of individual members.

147. Chaplains having no relative rank, Lodging and Travelling Allowances rates shall be—

Chaplains under four years' seniority, the rate as prescribed for a Lieutenant.

Chaplains of eight years' seniority, the rate as prescribed for a Com-mander, and

Chaplains of fifteen years' seniority, the rate as prescribed for a Captain.

148. (1) Any amount received from Canteen tenants as rent shall be paid to the General Ship's Fund, or, in the absence of such Fund, disposed of as the Naval Board may approve.

(2) The Ship's Fund shall consist of moneys received in the nature of rent from the Canteen tenant.

(3) The Fund is primarily intended to meet the cost of recreation for the Ship's Company and for benevolent purposes connected with the Ship, The Commanding Officer shall satisfy himself that sufficient allowance is made for these objects, due regard being had to the proportion of the Ship's Company who are able to participate in any form of recreation.

(4) The administration of this Fund, shall, subject to the provisions of sub-regulation (3) of this regulation be Winder the control of the Canteen Committee

(5) The accumulation of a large surplus in the Ship's Fund shall not be permitted, and any balance remaining after making allowance for probable current expenses is to be returned to the messes periodically in proportion to the amount of their Canteen bills.

(6) All accounts in connexion with the Ship's Fund, including all subsidiary funds, e.g.. cricket club and rifle club, shall be audited quarterly by officers nominated by the Commanding Officer, who are to be independent of those serving on the Canteen Committee. After each audit, a statement of accounts shall be prepared, submitted for approval by the Commanding Officer, and publicly exhibited.

149.-(I) Witnesses who are summoned or ordered to attend at a court martial or a court of inquiry at the request of the Department or by order may receive remuneration for such attendance as follows :—

(a) For Obvilians..—In accordance with the rates payable (in the State in which the court martial or court of inquiry is held) to witnesses attending the Supreme Court of that State in its criminal jurisdiction.

(b) For Members of Forces not permanently employed.—At the rate of travelling allowance prescribed for the Permanent Force (Sea-going),

(c) For Members of Forces Permanently Employed.-At the usual rate of Travelling Allowance if so entitled.

150. The allowances prescribed in King's Regulations and Admiralty Court martial

Instructions shall be paid to the Officiating Deputy Judge Advocate or Clerk cztasiscipimary of Court and to the Provost-Marshal at courts martial.

PART XI.

AUTHORITIES FOR EXPENDITURE.

151. (1) The Minister may approve of any expenditure not covered by Ministerial

these Regulations provided that the necessary funds have been made available 2cgorol by parliamentary appropriation or by the Treasury in anticipation of Powers.

parliamentary appropriation. (2) The Minister may, by writing under his hand, delegate any of the

powers, functions, and authorities conferred upon or vested in him by these Regulations.

(3) Every delegation under this regulation shall be revocable at will, and no delegation shall prevent the exercise of any power, function, or authority by the Minister.

152. (1) In addition to the authorities specifically vested throughout Authority of

these Regulations, the Naval Board is authorized- Naval Board.

(a) To approve of increments to members of the Permanent Naval Forces where such increments are prescribed by these Regula-tions and require Naval Board approval, subject to provision being made therefor in the Appropriation Act

(b) To approve up to the value of E10,000 in each case of all requisitions for supplies within the Votes on the Estimates ;

(c) To approve up to the value of E10,000 in each case of expenditure under the Division or Subdivisions of any Votes for Contin-gencies, General Services, and for Maintenance of Ships and Vessels and existing Establishments ;

(d) To approve of requisitions on Works and Railways Department for repairs and maintenance, sanitation and water supply, and fittings and furniture, within the Votes on the Estimates.

(2) All authorities vested in Directors and Officers-in-Charge by these Regulations may also be exercised, where necessary, by the Naval Board.

(3) The Naval Board may approve of the taking on charge of excess Stores.

(4) In all cases where expenditure is approved by a majority of the Board, such cases shall, unless the majority includes the Finance Member, be referred to the Minister for decision before any liability is incurred.

153, (1) Directors are authorized to incur expenditure as set forth in - Authorities off the following sub-regulations. directors.

(2) The Director of Naval Stores is authorized to approve .of expenditure not exceeding MOO in any one case on the following items :-

(a) Naval Sea Stores for equipment and maintenance of H.M.A. Squadron not in excess of stocks authorized to be maintained

(b) Coal and Oil Fuel for H.M.A. Squadron;

(c) Naval Stores for-

(i) Construction and repair of H.M.A. Ships, and Maintenance of Dockyards and Naval Yards ;

(ii) Fleet Auxiliaries ; (iii) Naval Establishments, Naval Barracks, Official Residences,

Naval Colleges, Naval Detention Quarters ; (iv) Naval Reserves ;

(d) Stores for Central Administration ; (e) Office requisites and stationery subject to the approval of superior

authority, where necessary ; (f) Stores in excess of those authorized to be maintained not exceeding

£2 in any one case.

(3) The Director of Victualling is authorized to approve of expenditure on victualling stores not exceeding £300 in any one case.

(4) The Director of Engineering (Naval) is authorized to approve of expenditure not exceeding £300 in any one case on docking, refitting and repairing of H.M.A. Ships, Fleet Auxiliaries, and other vessels in the Naval Service.

(5) The Director of Naval Medical Services is authorized to approve of expenditure not exceeding £100 in any one case on medicines and medical stores required for the Naval Medical Service.

(6) The Director or Ordnance, Torpedoes and Mines is authorized to approve of expenditure not exceeding £100 in any one case on Naval Armament Stores.

Authorities of 154. (1) Officers-in-Charge are authorized to incur expenditure as set officers-in- forth in the following sub-regulations. charge. Captain-Super- (2) Captain-Superintendent, Sydney, New South Wales, is authorized— intendent, Syddey. (a) To engage skilled or unskilled labour at ruling rates of wages

provided such are not less than Award rates, and provided that the work on which such labour is employed has been duly authorized. No person is to be employed at any wage in excess of 15s. per diem, unless the rate is that prescribed by an Award, or has been approved by the Naval Board.

(b) To engage temporary draughtsmen for such limited periods as may be necessary, and to renew such appointments from time to time as requisite, provided that total period shall not exceed twelve months without Naval Board approval, at the rates prescribed in Arbitration Court Awards. The approval of the Naval Board is to be obtained for all increases beyond the rates prescribed in the Awards. The employment of all temporary draughtsmen is to be reported to the Naval Board for confirmation.

(c) To approve of payment of claims for Overtime and Sunday Pay. (d) To approve of Yard demands on the Naval Store Officer for

materials for Yard Services and upkeep of Yard Plant and Floating Craft, which the Captain-Superintendent is authorized to put in hand, or for which Naval Board approval has been received.

(e) To approve of special demands from H.M.A. Ships on the Naval Store Officer for stores in excess of quantities allowed by Establishment provided the excess quantities are essential for ordinary services.

(f) To approve of repairs to Yard Plant Moorings and Floating Craft being carried out, provided the cost of same, including labour and material, does not exceed £100 in any one case. This includes cost of replacements to make good defects, e.g., tools to maintain stocks, but does not include new work.

(g) To approve of expenditure for Contingencies, e.g., towage, not exceeding £100 in any one case and for all recurring services such as electric supply and telephones.

(h) To approve of purchases under established procedure of authorized fresh provisions required for victualling sea-going personnel of H.M.A.S. Penguin, and Depot Ship for Ships in Reserve.

(i) To approve, in emergent cases, of expenditure in anticipation of superior authority.

j) To requisition on the Works and Railways Department for repair and maintenance in connexion with H.M.A. Naval Establish-ments, Sydney, not exceeding £300 in any one case.

(3) The Naval Store Officer, Sydney, is authorized-

(a) To approve of contract demands on the Contract Board or the District Contract Board or requisitions for the local purchase of-

(i) Naval Stores which are authorized for local purchase and which are required to replenish authorized stock, which will not be exceeded on receipt of Stores purchased ;

(ii) Naval Stores which are required for repair and refit of H.M.A. Ships approved by the Naval Board ;

(iii) Naval Stores for supply to H.M.A. Ships or Shore Establishments in accordance with a demand specially approved by superior authority.

(b) To approve of requisitions for minor items of Naval Stores not ordinarily kept in stock, not exceeding £5 in value in each case, required for specific Yard Services.

(c) To approve of requisitions for all services in connexion with Naval stores not exceeding £20 for any particular service in respect of any one shipment.

(4) The Victualling Store Officer, Sydney, is authorized- victualling

(a) To approve contract demands on the Contract Board or District eOfficery.

Contract Board as necessary or requisitions as applicable for local purchase of-

(i) Victualling Stores which are authorized for local purchase and which are required to replenish authorized Yard Stocks which will not be exceeded on receipt of stores purchased.

(ii) Authorized Victualling Stores for supply to H.M.A. Ships or Shore Establishments not ordinarily kept in stock.

(b) To approve of requisitions for minor items of stores not ordinarily kept in stock, and not exceeding £5 in value in each case, required for specific Yard Services.

(c) To approve of requisitions for all services in connexion with Victualling Stores not exceeding £20 for any particular service in respect of any one shipment.

(5) The . Deputy Armament Supply Officer, Sydney, is authorized— To approve of contract demands on the Contract Board or the

District Contract Board, or requisitions for the local purchase of stores up to £10 in any one order and not exceeding £50 in any one month.

(6) Captain-Superintendent of Training, Flinders Naval Depot, is authorized—

(a) To approve of demands upon Naval Store Depots for Stores allowed by Establishment.

(5) To approve of contract demands or requisitions as applicable for the local purchase of stores (other than Victualling Stores) authorized for local purchase and in accordance with Establish ment.

(c) To approve of expenditure, other than for Stores, not exceeding £25 in any one case under Contingencies.

(d) To approve of the employment of casual labour (non-clerical), but no person is to be employed under this authority for any longer time than an aggregate period of six". (6) weeks in any financial year without the approval of the Naval Board.

(e) To approve of purchase under established procedure of authorized fresh provisions required for victualling sea-going personnel of II.M.A.S. Cerberus and Tenders.

(f) To requisition on the Works and Railways Department for repair and maintenance in connexion with Flinders Naval Depot, not exceeding £300 in any one case.

(7) Commanding Officer, Royal Australian Naval College, is authorized— (a) To approve of demands upon Naval Store DepOts for Stores allowed

by Establishment. (b) To approve of requisitions as applicable for the local purchase of

Stores (other than. Victualling Stores) authorized for local purchase and in accordance with Establishment.

(c) To approve of expenditure, other than for Stores, not exceeding £25 in any one case, under Contingencies.

;c1) To approve of the employment of casual labour (non-clerical), but no person is to be employed under this authority for any longer time than an aggregate period of six (6) weeks in any financial year without the approval of the Naval Board.

(e) To approve of purchase under established procedure of authorized fresh provisions required for victualling sea-going personnel of II.M.A.S. Franklin and Tenders.

(f) To requisition on the Works and Railways Department for repair and maintenance in connexion with R.A.N. College, not exceeding £300 in any one case.

(g) To approve of requisitions on the Commonwealth Clothing Factory Melbourne, for diagonal serge suits required for issue on repayment to Cadet Midshipmen.

(8) Commanding Officer, 11.M.A.S. Tingira, is authorized- (i) To approve of demands upon Naval Store Depots for Stores allowed

by Establishment. (ii) To approve of expenditure, other than for Stores, not exceeding

£25 in any one case, under Contingencies. (iii) To approve of purchase under established procedure of authorized

fresh provisions required for victualling sea-going personnel of Tingira.

(9) District Naval Officers are authorized— District Naval

°them' (a) To approve of demands upon Naval Store Depots'for Stores allowed by Establishment.

(b) To approve of contract demands or requisitions as applicable for local purchases of other stores and for such stores allowed by Establishment, the local purchase of which may be authorized by the Naval Board.

(c) To approve of expenditure, other than for Stores, not exceeding £25 in any one case, under Contingencies, in connexion with the B.A.N. Reserve, expenditure incurred by District Naval Officer acting as Local Representative of the Naval Board or Naval Intelligence Officer, care and maintenance of ships and craft under his orders, recruiting for the R.A.N.

(d) To approve, in emergent cases, of expenditure in anticipation of superior authority.

(e) To requisition on the Works and Railways Department for repairs and maintenance in connexion with buildings under their, control not exceeding E25 in any one case.

(10) Naval Representative, London, is authorized— Naval Representative,

(a) To engage, at ruling rates of pay, temporary clerks, draughtsmen London.

or typists, for such limited periods as may be necessary, and to renew such appointments from time to time as requisite, provided that total period shall not exceed six (6) months without special Naval Board approval. The approval of the Naval Board is to be obtained for all increases beyond ruling rates of pay. Report of the engagement of any temporary clerk, draughtsman, or typist under this authority shall be made forthwith to the Naval Board.

(b) To approve of demands on the High Commissioner for stationery and incidentals not exceeding £5 in anyone demand, or E25 in any one month. This limit may be exceeded in emergent cases, but covering approval of the Naval Board shall be sought at the earliest possible moment.

(c) To approve of expenditure under Contingencies (e.g., Rail Fares ; Postages, Cablegrams, &c.), not exceeding E10 in any one case.

This limit may be exceeded in emergent cases and in regard to travelling expenses and rail fares and freights, but the covering approval of the Naval Board shall be sought at the earliest possible moment.

(d) To approve of payments under Regulations to sea-going personnel borne on books of London Naval Depot for pay.

(11) The expenditure to be authorized by District Naval Officers under Limits for District paragraphs (b) and (c) of sub-regulation (9) must not exceed in the offi„, Naval

aggregate the following amounts per month in the respective States without the approval of the Naval Board :--

155. The authorities delegated in regulations 153 and 154 are subject to compliance with the following provisions, except where otherwise specifically stated :-

(a) That provision made on Estimates will not be exceeded, and the requirements for the remaining period of the financial year will not involve the necessity for applying for additional provision on any Vote concerned.

(b) That, except in regard to the Naval Representative in London, certificate has been inserted by the local certifying officer that funds are available under his control, or by the Director of Navy Accounts that funds can be made available.

(c) That the expenditure does not involve any alteration in existing rules or practice.

(d) That there is nothing irregular in the character of the expenditure. (e) That the expenditure is not an allowance or payment to any

member of the Department except such as is governed by regulations and does not require superior approval.

Naval Works— 156. (1) Each Officer-in-Charge is authorized to carry out the following Pcrformance by naval ratings. Naval Works by Naval ratings and employees under Naval supervision :-

(a) Jobbing and urgent minor repairs estimated to cost £5 or less. (b) Urgent repairs prescribed in Public Works Regulation 53. (c) Maintenance of stations, switchboard and wiring, and other plant

in generating stations installed by the Naval Authorities. (d) Such works of repairs and maintenance estimated to cost more

than £5 as may be delegated specifically by the Minister for Works and Railways :

Provided that works set forth in paragraphs (a), (b), and (c) only shall be carried out at Naval Staff Offices under the supervision of District Naval Officers and Sub-District Naval Officers.

(2) The cost of the works shall be recoverable from the Departm- na_ f Works and Railways, except that works executed by the Naval Authorit.. as at paragraph (c) of sub-regulation (1) shall be maintained from Naval Votes.

(3) The above authorities shall be subject to such conditions as may be approved by the Naval Board.
