    Steps to Form a Maori Incorporation under Tikanga Maori

    1. Decide what block of land or lands you wish to use to base the

    Incorporation on. Prepare land descriptions, title, Memorial schedule and

    valuations.

    2. Fill in a Land Transfer Application Form and Annexure form (from

    Whitcouls or Bennetts Govt bookstore) and annex all whanau names to be

    incorporated, (the more the better) and send to Land Information New

    Zealand LINZ.

    Refer to TTMLA 1993 Part IX, Sec 169 and 170, which reads:

    Sec 169(1) - This part of this Act applies with respect to Maori Freehold

    Land, and to General land Owned by Maori.

    Sec 170. Owners and Assembled Owners defined (1) In this Part of

    this Act, the term Owners, in relation to any area of land, means thepersons beneficially entitled to that land in fee simple as tenants in

    common, whether legal or equitable (2) In this part of this Act,

    the term assembled Owners, in relation to any land, means the Owners

    of the land assembled together in a meeting called and held in accordance

    with this Part.

    Sec 172. Matters may be dealt with by assembled owners The assembled

    owners of any land may consider, and, where appropriate, pass resolutions

    concerning, any one or more of the following matters:

    (a) A proposal that the owners of the land or of any part of it shall, either

    by themselves or together with the owners of any other land, become

    incorporated under part XIII of this Act:

    (b) A proposal that any defined land of the owners be included in an

    existing order of incorporation pursuant to section 251 of this Act:

    3. Panui in the paper with intentions to form Inc. and giving 21 days notice.

    4. At the meeting:

    (a) Elect an interim chairman and secretary to run the meeting.(b) Move resolution to hold the land under Tikanga Maori.

    (c) If the land is held under a Trust then the Chairman and Secretary need

    to move a resolution to terminate the Trust that is registered under the

    Maori Land Court.

    (d) Re-affirm the Declaration of Independence and Te Tiriti O Waitangi.

    (e) Move resolution to form Maori Incorporation in accordance with Part

    XIII of Te Ture Whenua.

    (f) Move resolution to form Management

    (g) Elect people to sit on Management Committee may be 7 people.

    (h) Appoint an Auditor and a Share Valuer.
