Kay McKeen/SCARCE informed the Committee that the cooking oil into bio-fuel recycling program is expanding into additional municipalities and will continue to be encouraged.

3. Chairman’s Report 3a. Presentation of Anniversary Awards
Chairman Zay presented Dave Winklebleck/Sr. Project Engineer with a certificate of appreciation for his 10 years of service with the County. Chairman Zay presented Kathy Huth-Nichol/Division Assistant II with a certification of appreciation for her 10 years of service with the County.
4. Minutes – December 3, 2013 A motion was made by Member DiCianni, seconded by Member Krause to approve the December 3, 2013 minutes as presented and to receive and place on file any and all handouts received during the Public Comment portion of the Agenda. On voice vote. Motion carried.

National Flood Insurance Program Community Rating System, Potential CRS Credit in DuPage County, A Guide For Local Officials
Stormwater Permitting Manager Heffter presented to Committee an overview of changes made to the National Flood Insurance Program’s Community Rating System. With the changes, premiums for flood insurance could increase considerably. Stormwater Management prepared a Guide for Local Officials of potential CRS credit offered under the NFIP’s CRS to identify DuPage County programs and activities that individual communities can claim in order to maximize their residents’ discounts. This Guide can also be found of the County’s website. 10. SM-0001-14 – RESOLUTION – Agreement Between the County of DuPage
Illinois and West Chicago Environmental Response Trust for Work Tasks Associated with the McDowell Grove West Branch Restoration Project
A motion was made by Member DiCianni, seconded by Member Krause approve the above agreement with West Chicago Environmental Response Trust as presented. On voice vote. Motion carried. 11. SM-0002-14 – RESOLUTION – Direction to Apply for Modification of the Gate
Operation Plan at the Fawell Dam Flood Control Facility A motion was made by Member Brummel, seconded by Member Krause to approve the above direction as requested. On voice vote. Motion carried. 12. DRAFT SM-0003-14 – RESOLUTION – Acceptance of Land Donation, for the
parcel currently identified by permanent parcel number 01-26-402-001 (final will be distributed in meeting)

13. SMp-001-14 – RESOLUTION – Requisition #19399, issued to Koso America,
Inc. to replace three (3) self-contained, linear hydraulic actuators at Fawell Dam, for Stormwater Management, for a contract amount of $282,846.00, per low Bid #13-284
A motion was made by Member Fichtner, seconded by Member Krause to approve the above contract with Koso American, Inc. as presented. On voice vote. Motion carried. 14. SMp-024A-12 – RESOLUTION – AMENDMENT to Resolution SMp-024-12,
issued to Martam Construction, Inc. for Brewster Creek Flood Mitigation Project, for Stormwater Management, to increase the encumbrance $218,000.00, resulting in a new contract total of $4,639,679.52 (4.93% increase)(A18401)
A motion was made by Member DiCianni, seconded by Member Krause to approve the above contract increase with Martam Construction, Inc. as presented. On voice vote. Motion carried. 15. INFORMATIONAL ONLY
Requisition #19402, issued to Water Well Solutions, for the dewatering wells at the Wood Dale/Itasca Reservoir, for Stormwater Management, for a contract amount of $21,895.00, per low quote #Q14-029
A motion was made by Member DiCianni, seconded by Member Krause to place on file the Water Well Solution low quote as presented for information purposes only. On voice vote. Motion carried. 16. Old Business:
16a. Update on Flood Plain/floodway Violation, 27W253 Liberty Street, Incorporated Winfield.
Stormwater Permitting Manager Heffter updated the Committee regarding the above violation. Although the violation is not resolved the County held a meeting with the Village, and the engineers and attorney’s involved in this violation to discussion possible remediation methods. At that time, it was decided to call another meeting, this time with the inclusion of the Illinois Department of Natural Resources, Office of Water Resources to continue discussion. Staff will continue to update Committee.

16b.Compliants:
Bloomingdale Glen Ellyn Lisle Heffter addressed the Committee regarding the formal complaints filed against the above municipalities. Committee was provided staff reports documenting the communities handling of their respective complaints and agreed to continue to have staff monitor the complaint resolutions and report back as needed. A motion was made by Member DiCianni, seconded by Member Krause to combine and approve the above complaints as presented. On voice vote. Motion carried. 17. New Business: Member DiCianni addressed the Committee regarding Coal Tar Sealant Ban Legislation. The legislation being developed would ban the use and sale of Coal Tar Sealant in the State of Illinois. Ultimately, it will be the decision of the State of Illinois. The Environmental Committee voted in support of the proposed legislation. It has been determined; although with some dispute from the Coal Tar Industry, that the coal tar sealant contains carcinogens, enough to be harmful to humans. Use of the Coal Tar sealant causes enhanced environmental concerns. Member Michelassi arrived at 8:00 am Member Yusuf arrived at 8:00 am 18. Executive Session – Section 102 ILCS 120/2 (c)(5) – Land Acquisition A motion was made by Member DiCianni, seconded by Member Michelassi to go into Executive Session pursuant to the Open Meetings act for the above Section. Roll call: DiCianni-aye, Fichtner-aye, Grant-aye, Krause-aye, Michelassi-aye, Yusuf-aye, Zay-aye, Brummel-aye, Curran-aye. Motion carried unanimously. A motion was made by Member DiCianni, seconded by Member Krause to go out of Executive Session. Roll call: DiCianni-aye, Fichtner-aye, Grant-aye, Krause-aye, Michelassi-aye, Yusuf-aye, Zay-aye, Brummel-aye, Curran-aye. Motion carried unanimously.

FEBRUARY 2014 Stormwater Management Hosting Green Infrastructure Symposium
Stormwater Management and The Conservation Foundation will be hosting a free Green Infrastructure
Symposium at North Central College (Naperville) on February 27. This half-day symposium is the first of its
kind for DuPage County. It will provide local contractors with information necessary to make business decisions
regarding green infrastructure. With guest speakers and vendors, it is a starting point for contractors interested
in pursuing green construction. Immediately following the symposium, participants may participate in an
optional walking tour along North Central College's Sesquicentennial Walkway featuring permeable pavement
and rain gardens immediately following the symposium. Stormwater Management partially funded this green
infrastructure project through the County’s Water Quality Improvement Program grant.

Stormwater Management commends the Graue Mill
development in Hinsdale for securing $2.57 million
in Hazard Mitigation Grant Program (HMGP) funds
from FEMA, which will be used for flood control
improvements pending a local agency match. This
funding is expected to alleviate the hardships the area
experienced from storms in 2010 and 2013, including
evacuations and prolonged power outages.

SWM to be Featured at IAFSM
Stormwater Management is hosting several breakout
sessions at the Illinois Association of Floodplain and
Stormwater Managers (IAFSM) annual conference on
March 12 and 13. The presentations include the
County's wetland mapping initiatives, agricultural
wetlands and the West Branch DuPage River flood
control and restoration project in Warrenville and
Naperville. In addition, SWM will host an exhibit.

Last month, several DuPage County agencies - including Stormwater
Management - launched a new consultant selection process for professional
services. This is intended to align with the Qualification Based Selection
(QBS) process already in place for engineering, architectural and surveying
services. The process involves a prequalification measure to assure firms are
qualified for County projects, which will be posted on a quarterly basis.

Klepp, P.E., Sr. Project Engineer SUBJECT: Floodplain Mapping Update An invitation to discuss the status of the County’s proposed floodplain maps was sent to all of the communities affected by the County’s re-mapping work funded by FEMA. Over the next two weeks staff will be meeting with representatives from nineteen different communities to discuss the County’s proposed floodplain maps. Those communities are as follows: Bloomingdale, Roselle, Willlowbrook, Oak Brook Terrace, Darien, Glen Ellyn, Lisle, Itasca, Addison, Woodridge, Wheaton, Villa Park, Lombard, Westmont, Wood Dale, Naperville, Elmhurst, Downers Grove and Hinsdale. These meetings will provide an opportunity for each community to see all of the changes that have been made to the floodplain maps, especially in those watersheds that have had the models re-run.

M E M O R A N D U M To: Stormwater Management Planning Committee From: Robert Swanson, Water Quality Supervisor Date: February 24, 2014 Re: Budget Transfer Summary – IEPA Grant On August 14, 2012, DuPage County entered into a Financial Assistance Agreement with the Illinois Environmental Protection Agency (IEPA) for the West Branch DuPage River Corridor Restoration Project. The project involves riparian restoration improvements and stream bank stabilization along a 3.3 mile segment of the West Branch DuPage River located in Warrenville and unincorporated DuPage County. These improvements were designed to reduce nonpoint source pollution and runoff volume/velocity, which providing beneficial hydrologic functions and enhancing aquatic habitat. Design and construction costs for the West Branch Corridor Restoration Project were estimated at $2,284,489. The IEPA, through the grant agreement, will provide 60% of the actual project costs, with that amount estimated at $1,370,693. Specific improvements, including approximately 8,000 linear feet of stream bank stabilization, installation of pool/riffles sequences for stream channel stabilization, and energy dissipation practices at stormwater outfalls were paid for at a rate of 100% of the invoices from bond fund 408-221. As the grant reimburses at a rate of 60% expended costs, only 40% of the invoices should have been taken out of the bond fund account (408-221) with the remaining 60% being paid from 131-135. The requested budget transfer totaling $226,497.27 is equal to 60% of the total of invoices paid for those specific improvements, noted above and billed in fiscal year 2013, which will be reimbursed by IEPA. A budget transfer in the amount of $226,497.27 from 131-135-4180 to 131-135-3750 needs to occur because only the latter of these accounts can be used to obligate appropriations from a previous fiscal year. Once reimbursed by IEPA, those funds will be deposited into the bond fund (408-221) and appropriated for fiscal year 2015.

The permit to discharge stormwater runoff into Waters of the State, held by DuPage County and all municipalities, requires consideration by permittees of incorporation of green infrastructure concepts into their stormwater programs. Green infrastructure approaches essentially infiltrate, evapotranspirate, or reuse stormwater, with significant utilization of soils and vegetation rather than traditional hardscape collection, conveyance, and storage structures. Common green infrastructure approaches include green roofs, trees and tree boxes, rain gardens, vegetated swales, infiltration planters, vegetated median strips, permeable pavement, and protection and enhancement of riparian buffers and floodplains. The Village of Villa Park has expressed interest in partnering with Stormwater Management to identify opportunities that incorporate green infrastructure within their community, particularly in the areas serviced by a combined sewer system. Combined sewer systems are sewers that are designed to collect rainwater runoff, domestic sewage, and industrial wastewater in the same pipe. Most of the time, combined sewer systems transport all of their wastewater to a sewage treatment plant, where it is treated and then discharged to a water body. During periods of heavy rainfall or snowmelt, however, the wastewater volume in a combined sewer system can exceed the capacity of the sewer system or treatment plant. For this reason, combined sewer systems are designed to overflow occasionally and discharge excess wastewater directly to nearby streams, rivers, or other water bodies. These overflows, called combined sewer overflows (CSOs), contain not only stormwater but also untreated human and industrial waste, toxic materials, and debris. Through the use of green infrastructure, the volume of the stormwater runoff can be minimized, thus, the frequency of CSOs can also be reduced. The consolidated efforts of Stormwater Management and Villa Park to implement green infrastructure within the Village will be formally outlined through a Memorandum of Understanding (MOU). The MOU will detail the role that each party will fill with regards to planning, conceptually designing, and identifying potential funding for green infrastructure opportunities.

M E M O R A N D U M To: Stormwater Management Planning Committee From: Robert Swanson, Water Quality Supervisor Date: February 26, 2014 Re: Water Quality Improvement Program Grant Update As was noted last month, interest in this year’s Water Quality Improvement Program grant funding was extremely solid, due to a combination of substantial outreach, strong need for redevelopment throughout DuPage County, and desire to incorporate green infrastructure into projects. Stormwater Management received nine applications from a variety of public and private entities, with a total funding request of over $1,712,000. Staff is working to assess the projects based on an evaluation of overall water quality benefit, wetland and riparian area enhancement, educational aspects, regional benefits, dedicated funding, readiness to proceed, and long-term management plan for the project. However, the review process has not been finalized at this time and recommendations will be presented at April’s meeting. Stormwater Management, through the Water Quality Improvement Program, has continued to award water quality grants to projects that offer a regional benefit by reducing volume and pollutant transport to DuPage County streams. Eligible projects include those that incorporate streambank stabilization through bioengineering practices, in-stream habitat improvements, pond restoration, channel and riparian buffer rehabilitation, wetland creation and/or restoration, and green infrastructure technologies that reduce or filter stormwater runoff.

COMMITTEE ACTION REQUESTED: A motion by Committee to not object to a variance
request for the remediation construction activities on the above referenced property without
providing all of the on-site detention required by the DuPage County Countywide Stormwater
and Flood Plain Ordinance in favor of payment into Bensenville’s fee-in-lieu of detention fund.
Staff received a Petition for Variance for remediation construction activities on the Victory Auto
Wreckers property at 710 E. Green Street, in incorporated Bensenville. The petition requests relief
from the Section 15-72 of the DuPage County Countywide Stormwater and Flood Plain Ordinance
(Stormwater Ordinance) to waive the requirement for 0.65 acre-feet of on-site detention in favor of
payment into Bensenville’s fee-in-lieu of detention fund
The petitioner notes that the following items are relevant to the request:
1. Victory Auto Wreckers, Inc. is an auto salvage and wrecking business within the Village of
Bensenville, Illinois, a Partial Waiver community. The business is a high volume auto
recycling facility providing single parts for retail purchase or scrap metal by the container.
They receive vehicles and drain their fluids (gas, radiator, oil, etc.) before storing the vehicles
onsite for customers to remove desired parts. They also store non-titled vehicles for the
duration required to obtain the title and then they sell parts from the vehicles as well.
2. Victory Auto Wreckers, Inc. would like to expand their asphalt paving to include the entire
site apart from the existing pond and adjacent areas which will be modified for
detention/volume control, forming an engineered barrier / cap of the site subsurface, as part of
the requirements of a Remedial Action Plan (RAP). Although the site is already highly
impervious, the impervious area of the site will increase further under the proposed
redevelopment.
3. The proposed project consists of remediation construction activities to comply with
requirements from the Illinois Environmental Protection Agency (IEPA), with requirements to
cap and make impervious areas of contaminated soil. An attempt was made to limit the new
impervious area to less than 25,000 square feet to exempt the area from site runoff storage
requirements; however, discovery of contaminated soil within a drainage ditch previously
anticipated to remain pervious no longer makes this viable.
4. There is an existing pond that stores stormwater from non-contaminated areas of the
development. This pond will be maintained and reshaped to address storage requirements for
runoff from other non-contaminated site areas; however, the lack of available pervious land
prevents the further expansion of this pond.
5. The areas to be made impervious per requirements from the IEPA currently provide surface
drainage within the property of Victory Auto Wreckers. Following the project, drainage will
be provided through underground storm piping.
6. Several options to address the newly discovered soil contamination within the eastern site
drainage ditch have been evaluated. The principal conclusion of the IEPA is that the
recommended resolution will be to make the area impervious and provide an engineered
barrier atop the in-situ contaminated soils and eliminate the human contact contamination
vector. This will increase the new impervious area above the limit to which detention is
required.
7. Additional pervious land for expansion of the existing detention pond or a new detention pond
is not available. Excavation to provide underground detention would disturb the existing
contaminated soil thus exposing the construction workers involved to contamination and
creating special waste that would have to be removed and landfilled off-site at great and
unnecessary expense.
8. The variance is requested for areas made impervious in accordance with the agreed upon
remediation action plan. There have been no reasonable means identified to avoid or remedy
the hardship as the nature of the remedial action plan requires that surfaces be made
impervious.
9. The unique circumstances of the applicant relate to requirements of the remedial action plan,
the nature of the soil contamination present, and the requirement to construct an engineered
barrier.
10. The exceptional nature of the development relates, as previously mentioned, to the
requirements of the remedial action plan agreed upon by the IEPA and the availability of
pervious land for expansion of detention facilities.
11. Detention and volume control for newly impervious areas will not be provided as it is
impractical to size the existing pond to accommodate the flow and cost prohibitive to provide
an engineered detention vault.

14. Water quality will be improved over existing conditions through the installation of a new
oil/water separator to treat the proposed basin discharge prior to release to the Creek, and the
repurposing of an existing building as a fluid removal area to protect the environment.
15. The petitioner agrees to pay a Detention Variance Fee (a.k.a. fee-in-lieu of) to Bensenville for
the 0.65 acre-feet of detention required but not provided on site.
Staff notes that the variance is similar to past variances with extensive subsurface soil contamination not
objected to by Committee and recommends not objecting to the variance.

FIRST AMENDMENT INTERGOVERNMENTAL AGREEMENT BETWEEN THE COUNTY OF DUPAGE AND THE VILLAGE OF ELK GROVE VILLAGE, REGARDING
THE BUSSE WOODS DAM AND SALT CREEK WATERSHED FLOOD CONTROL PROJECT
WHEREAS, the County of DuPage (“COUNTY”), pursuant to statutory authority to
control flooding and manage stormwater run-off has adopted the “Salt Creek Watershed Flood Control Plan,” (“Plan”); and
WHEREAS, the Plan recommends the construction and installation of various
improvements to control flooding and improve stormwater management within the Salt Creek Watershed, including modifications to the Busse Woods Dam; and
WHEREAS, the Village of Elk Grove Village (“VILLAGE”) and COUNTY desire to have a study performed regarding the optimization of the Plan components prior to undertaking any work to modify the Busse Woods Dam; and
WHEREAS, the COUNTY and VILLAGE have agreed to share the costs of undertaking such a study and for the design of the Busse Woods Dam modifications; and
WHEREAS, the study regarding the optimization of the Plan components and the design
of the Busse Woods Dam modifications shall be the PROJECT; and WHEREAS, the COUNTY and the VILLAGE entered into an Intergovernmental
Agreement (“AGREEMENT”) to set forth their respective funding obligations to cost share PROJECT expenses; and
WHEREAS, communities located within the Salt Creek Watershed would benefit from
data sharing and involvement with the PROJECT; and WHEREAS, the CITY OF WOOD DALE, VILLAGE OF ADDISON, CITY OF
ELMHURST, VILLAGE OF OAK BROOK, VILLAGE OF HINSDALE AND VILLAGE OF VILLA PARK, (“PARTICIPATING COMMUNITIES”) each desire to participate in the PROJECT and are willing to cost share in its expenses as set forth in this First Amendment; and
WHEREAS, the COUNTY, the VILLAGE and the PARTICIPATING COMMUNITIES
have determined that it is in the best interest of the parties and their residents to modify said AGREEMENT to allow for PROJECT cost sharing by the PARTICIPATING COMMUNITIES; and NOW, THEREFORE, in consideration of the premises and mutual covenants contained herein, and in the spirit of intergovernmental cooperation, the COUNTY, the VILLAGE and the PARTICIPATING COMMUNITIES agree as follows:
1.0 RECITALS INCORPORATED.
1.1 The foregoing recitals are incorporated herein by reference as though fully set
forth herein.
2.0 AGREEMENT REMAIN IN EFFECT
2.1 This AGREEMENT remains in full force and effect except to the extent that the provisions of this FIRST AMENDMENT conflict with the terms of the AGREEMENT, in which case the provisions of this FIRST AMENDMENT shall control.
3.0 AMENDMENTS TO THE AGREEMENT 3.1 Section 3.0 shall be amended to provide that wherever the COUNTY has a right or obligation under this AGREEMENT each PARTICIPATING COMMUNITY shall enjoy the same rights and be bound by the same obligations to the same extent as the COUNTY.
3.2 Section 4.0 shall be amended to read as follows:
4.0 COST-SHARING 4.1 Following the VILLAGE’S tender of the last deliverable item identified
in Paragraph 3.4, and completion of all tasks identified in Paragraph 2.2, including each of the sub-paragraphs, and upon receipt of the VILLAGE’S invoice or payment request, the COUNTY and PARTICIPATING COMMUNITIES shall each reimburse the VILLAGE, in the following stated amounts: 4.1.1 The COUNTY shall pay ninety-eight thousand dollars and no
cents ($98,000.00). 4.1.2 The Village of Addison shall pay twelve thousand five hundred
dollars and no cents ($12,500.00). 4.1.3 The City of Wood Dale shall pay twelve thousand five hundred
dollars and no cents ($12,500.00). 4.1.4 The City of Elmhurst shall pay five thousand dollars and no
cents ($5,000.00). 4.1.5 The Village of Oak Brook shall pay three thousand dollars and
no cents ($3,000.00). 4.1.6 The Village of Hinsdale shall pay two thousand five hundred
dollars and no cents ($2,500.00). 4.1.7 The Village of Villa Park shall pay twelve thousand five hundred
dollars and no cents ($12,500.00).
4.2 Within five (5) business days of this Agreement’s full execution, the COUNTY and each PARTICIPATING COMMUNITY shall inform the
VILLAGE, by e-mail or facsimile transmittal, of the identity of one or more employees, or retained consultants, who will act as that party’s representative.
4.3 Payment by the COUNTY and each PARTICIPATING COMMUNITY
of its stated amount shall constitute a full and complete discharge of its reimbursement obligation to the VILLAGE, and neither the COUNTY nor any PARTICIPATING COMMUNITY shall be obligated for any payment of any portion of any such amount that is not its own.
3.3 Paragraphs 5.1 and 5.2 are amended so that the phrase “other party” shall hereafter be read to state “other parties.” This AGREEMENT is also amended so that any reference to “party” may be construed to mean “parties.”
3.4 Paragraph 6.1 shall be amended to require any notice given under the terms of this AGREEMENT shall be issued to the PARTICIPATING COMMUNITIES in the same manner notice is given to the VILLAGE or COUNTY and, further, that notices be served on the respective PARTICIPATING COMMUNITIES as follows:

Re: Stormwater Ordinance Complaint Update
Village of Lisle
At the November 2013 Stormwater Committee meeting, Committee directed staff to investigate
complaints alleging the Village of Lisle’s failure under the DuPage County Countywide Stormwater
And Flood Plain Ordinance (Stormwater Ordinance). The complaints alleged that unpermitted
development activity on Riedy’s Tee Time property in incorporated Lisle had occurred, and that Lisle
had not initiated proceedings, as necessary, to enforce the Stormwater Ordinance, or taken actions to
abate and redress the unpermitted activity, as required in Section 15-103 of the Stormwater
Ordinance. The complainants alleged that activity on the subject property had diverted a creek or
regraded an area to cause stormwater from their property to flow onto adjacent park district property
and possibly an adjacent residential neighborhood.
Stormwater Management staff reported to Committee in February on the Village’s progress to
investigate and resolve the alleged complaint. Concerned with the amount of time being taken to
address the violation, Stormwater Management staff requested that the Village pursue a commitment
from the property owner to come into compliance with the Stormwater Ordinance along with an
anticipate schedule.
Information documenting the Village’s actions was sent to staff in mid-February. The information
shows that a Village consultant completed a drainage investigation in November 2013 and concluded
that field conditions at that time did not match a Village approved 1995 final grading plan, which
constitutes a violation of Village code. The Village met with one of the owners of the subject
property on January 24, 2014 to discuss the requirements for resolution of the violation, and sent a
formal Notice of Violation letter to the owners on January 29. Due to weather conditions and the
complexity of the problem the Village has set a deadline of April 10, 2014 for the owners to submit a
permit application outlining plans to resolve the violation.
Staff recommends that Committee take no action at this time as the Village has demonstrated they are
actively pursuing the violation. Staff will continue to track the progress and provide Committee with
updates as necessary.
