    If the debtor is unable to dictate because ofsickness or some other reason, then the one

    who should dictate on his behalf is hisguardian.

    The loan should be witnessed, and the

    witnesses should be two men, or one man andtwo women.

    The lender has the right to ask the borrower toguarantee the loan with a pledge which thelender will keep.

    Means : O Allah, I seek refuge with thee fromsin and debt and he asked, why areyou often seek refuge from debt, O Messenger

    of Allah? He said, if someone involved ina debt, when he speaks he lies, when hepromises he disobeys, narrated by al-Bukhari.

    Means : The prophet said, whoever takes themoney of the people with the intention ofrepaying it, Allah will repay it on his behalf,

    and whoever takes it in order to spoil it, thenAllah will him, narrated by Abu Huraira.

    Means : Forgiven all the sins of thedead who died martyred unless it had a

    debt (to the people), narrated by Muslim.

    To record financial transactions and other mattersrelated to the business or muamalat;

    Financial records must be made in a fair, accurate andtrustworthy. In order to make the transaction fair, itrequires the writer who is obey to Allah.

    Writer must have the skills and know the law ofjurisprudence. However, depending only on

    knowledge is not enough because a lot of harm hasbeen caused by those who are knowledgeable but donot have a fair and honest nature.

    The transaction should be recorded

    accurately, systematically and withoutreducing the rights of anyone, not even alittle.

    Provide witnesses and evidence thatexplains the transaction.

    Note must be made regardless of small or

    large transaction.
