FURNITURE STANDARDS 74/01/2015[Introduction]

INTRODUCTIONFURNITURE STANDARDS

The Furniture Standards are one volume of the Real Estate and Facilit ies Design and Construction Standards. The other components include the Technical Design Guidelines (TDGs) and the Educational Specifications. The Furniture Standards are supplemental and complementary to the other components of the Real Estate and Facilit ies Design and Construction Standards. Any content within the Furniture Standards in conflict with other portions of the Real Estate and Facilit ies Guidelines and Construction Standards shall be called to the attention of TCCD.

This specification will serve as a tool for the design team in facilitating the development of spaces that are consistent from project to project. The standards shall also be beneficial for project submittals to the Innovation Forum by establishing standardized evaluation criteria for assessing project feasibility.

OVERVIEWFURNITURE STANDARDS

This edition of the ‘Furniture Standards’ supersedes the ‘Tarrant County College District - District Wide Furniture Standards’, published May 8, 2008.

The document has been prepared to support and administrate TCCD’s mission to provide affordable and open access to quality teaching and learning. The standards developed throughout this document incorporate the guidelines established by the Texas Higher Education Coordinating Board (THECB) and the ongoing goal for TCCD to establish a pathway to student success, now and in the future.

In an effort to achieve these goals, this standard establishes specifications and a level of quality for products, rather than dictating specific manufacturers and product numbers. As the educational teaching and learning environment evolves, so must the flexibility of the products and specifications. To provide the functionality of today, but allow for growth in the future, the furniture specifications are performance based. By focusing on maximum performance specifications, not specific products, the variety of product types can be reduced. Fewer, more flexible components can be used to serve multiple functions.

Establishing Furniture Standards reduces TCCD’s current for planning, providing, and managing furniture assets. The range of improved services include:

1. Furniture Standards Enable Re-util ization of Existing Assets: Campus wide furniture assets are more easily identified, inventoried, and valued, resulting in opportunities to reutil ize assets campus-wide. By maximizing existing inventory, new furniture purchases can be minimized.

2. Acquisition Costs Reduced: Standardizing with 1-3 furniture dealers will result in better contract pricing, terms and delivery.

3. Real Estate Costs Reduced: New or renovated space can be designed around defined modules promoting better building util ization. TCCD planners are able to identify amount of gross space needed in relocation situations, department shifts, etc. and are able to help plan and evaluate user requests more effectively.

4. Planning Costs Reduced: Lower external and internal planning and design costs typically result from standardization. Repetitive evaluation of multiple plans is eliminated. Lower space planning and design costs typically result from establishing furniture standards since responses to certain job functions are already generally in place. Less employee time is spent coordinating and managing furniture.

5. Improve Service Delivery: Allows for a stocking program and potential to inventory service parts to improve response to end user. Standards designed around express delivery programs for quick turn around when needed.

SCOPEProducts and specifications listed are typical furniture items used throughout all campuses. Specialized furnishings are outside of the scope of this publication.

MINIMUM STANDARDSAll products shall comply with ANSI/BIFMA (Business & Institutional Furniture Manufacturers Association) product safety and performance standards and guidelines.

LEED PROJECTSFurniture acquisition can aid in seeking LEED (Leadership in Energy and Environmental Design) certif ication by identifying products and programs that can contribute to LEED criteria in the categories of Materials and Resources, Indoor Environmental Quality and Innovation (Ergonomics Training, Sustainability Training, Product Innovation).Specify products that are low-emitting and carry third party certif ications like Cradle-to-Cradle and SCS Indoor Advantage. Also, use products containing a percentage of post-consumer and pre-consumer content.

SUSTAINABILITYStrive to work with full-service furniture dealerships. Most local dealers are committed to promoting a sustainable work environment and business practice, by protecting our environment, reducing consumption and by being culturally and politically sensitive. Implementation should include:• Protect the environment and health of employees, neighbors and customers.• Establish measurable goals toward sustainability, and regularly assess progress.• Prevent pollution.• Promote sustainability awareness with employees, customers, manufacturers and suppliers.

When possible, all products should carry a GREENGUARD, BIFMA (Business and Institutional Furniture Manufacturers Association) Level 1, SCS Indoor Advantage and/or a MBDC (McDonough Braungart Design Chemistry) Cradle-toCradle certif ication.

FINISHES & PRODUCT SELECTIONFURNITURE STANDARDS

As a standard, fabric grades and finishes shall be selected from mid-priced options, typically identified as ‘Grade 2 or B’. In specialty areas, higher priced selections will be considered, with approval. When choosing wood tones, choices should be based on creating a coordinated appearance throughout the facility.

The finishes for standard furniture pieces, such as student chairs and office task chairs, are standardized, in order to maximize flexibility throughout the campus. Like manufactures should be maintained in similar or adjacent areas. Furniture manufactures shall be consistent within administrative area levels. For example, administrative furniture shall match executive personnel furniture.

PROCUREMENT METHODSFURNITURE STANDARDS

Furniture procurement packages shall be in the format of a competitive sealed proposal process, unless otherwise dictated by TCCD. Furniture product acquired for TCCD will be purchased from an Interlocal Government Procurement Agency listed in the Appendix. Contract forms shall be the standard Interlocal Government Procurement Agency agreement. Interlocal Government Procurement Agencies are master agreements that provide state agencies and authorized local public entities an efficient and effective means of procuring furniture and equipment items. Some Interlocal Government Procurement Agencies allow state and local authorized entities to take advantage of federally negotiated pricing agreements.

Different manufacturers have different Interlocal Government Procurement Agency contracts, discounts, and methods of applying discounts. These arrangements are revised regularly. Therefore, the current details should be reviewed and updated periodically.

TCCD has also developed relationships with local dealerships. Independent contracts have been established with these dealers, with a limited lifespan. These arrangements are also revised regularly, and are provided in the Appendix. This appendix should be regularly revised as contracts are extended, expired or established.

DEALER SERVICESFURNITURE STANDARDS

In addition to ordering, delivering and installing furniture, contracted dealers shall also provide the following services.

• Review of the proposal before ordering for possible errors in quantities or omissions in finishes or descriptions or manufacturer’s numbers that might delay the order

• Provide receiving facilit ies that can unload from all different size trucks and safely store the product until an entire project is ready to be installed

• Check for freight damages and facilitate manufacturer’s procedure for responding to freight damage

• Check for accuracy of order acknowledgements and monitor progress of order. Minimize restocking fees or purchase of unwanted product.

• Provide protection of building during installation

• Provide single point of contact to address any questions related to the ordering, manufacturing and shipping of product

• Provide a single point of contact for financial concerns related to the order; i.e. deposits and payments.

• Installers shall be trained and have prior experience installing each of the products included on the order.

• Provide an on-site supervisor for each furniture installation.

• Provide a final inspection walk-through with a TCCD representative for each project installation.

• Provide servies for qualified craftsmen to complete professional repair of finishes, including wood finishes, and damages to product.

Allsteel Inc. warrants its products to be free from defects in material and workmanship for as long as the original purchaser owns them, except as set forth below.

Allsteel shall repair or replace with comparable product (at Allsteel’s discretion), free of charge, any Allsteel product or component manufactured after August 6, 2012, that fails under normal commercial office use.

This warranty is subject to the following provisions:

Some natural variations occurring in wood, leather, or other natural materials are inherent to their character and not considered defects. Allsteel does not warrant the colorfastness or matching of colors, grains, or textures of these materials. Additionally, a Customer’s Own Material (COM) selected by, and used at the request of, a user is not warranted.

The materials and components listedbelow are covered according to the following schedule from the date of sale:

• Wood products and electrical components (lamps and ballasts are not covered), seating controls, pneumatic cylinders, glides, casters and polymer-based components, and foam – 12 years

COALESSE® WARRANTY

This warranty applies to Coalesse products delivered in the United States, Canada, Mexico, Latin America, and the Caribbean.

Coalesse, a division of Steelcase Inc. (“Coalesse”), warrants that Coalesse, Brayton, Metro and Vectabrand commercial products are free from defects in materials or workmanship, for a period of (10) years, subject to the exceptions listed below. Coalesse will repair or replace with comparable product, at its option and free of charge, any product, part or component manufactured after November 16, 2009 that fails under normal use as a result of such defect. This warranty applies from the date of manufacture, regardless of shift usage and is valid only for the original purchaser.

First Office casegoods, tables, and seating products are guaranteed to be free from defects in design, material and workmanship,

given normal use and proper care, for 12 years of single-shift service with the exceptions noted below. First Office will repair or

replace, at our discretion without charge to the original purchaser, any product or part thereof which fails as the result of such a

defect during the warranty period. First Office assumes no responsibility for repairs to products that result from user

modifications, attachments to a product, misuse, abuse, alteration, or negligent use. Except as stated above, First Office makes no

expressed or implied warranties as to any product, and, in particular, makes no warranty of merchantability or fitness for any

particular purpose. First Office shall not be liable for consequential or incidental damages arising from any product defect.

• The substitution of any unauthorized non-Coalesse components for use in the place of Coalesse components in an integrated product solution; such substitute components include but are not limited to worksurfaces, leg supports, panels, brackets, shelves, overhead bins, and other integral components.The following products and materials are not covered by this warranty:

• Products considered consumables (e.g. lamps),• Customer’s Own Material (COM) or non-standard textiles and materials• Variations occurring in surface materials (e.g. color fastness or matching grains, textures, and colors

Global warrants that all commercial products are free from defects in material and workmanship, for the life of the product, to the original purchaser.

Global will repair or replace, at Global’s option, as the sole remedy for any defect covered by the warranty. The warranty applies to products purchased after July 1, 2013.

General Commercial Seating:Global’s warranty for general commercial seating covers all chair components including bases, casters, glides, frames, arms, plastic seats, backs and otherstructural components.

The exceptions to the warranty for general commercial seating are:• Foam, Fabric (As sampled on Global and Branded Cards), Mesh Material and Electrical Devices, which are warranted for five (5) years.• Control mechanisms are warranted for 12 years.

The warranty applies only to single shift, standard commercial usage, defined as a standard eight (8) hour work day, five (5) days a week (40 hours), for usersweighing up to 300 pounds.

Heavy Duty Seating:Global offers products designed for multiple shift applications (24 hours a day / 7 days a week) and larger individuals weighing up to 350 and/or 500 pounds(depending on series and/or model), Global warrants these products for 10 years to the original purchaser. All components (including control mechanisms,pneumatic cylinder, base, casters, glides, frames, arms, plastic seats/backs, etc.) are covered for 24/7 under the warranty. The exceptions are foam and fabric,which is covered for five (5) years. Fabric or upholstery material on these products must exceed 100,000 double rubs for the fabric portion of the warranty toapply. Heavy Duty product series that apply under this warranty currently include: Admiral TS, Concord Executive 24 hour, Dexter/Dexter+, Granada TS, Malaga TS, Mallorca TS, Maxima II, Obusforme Comfort TS, Robust, Salute, Saxon, Stamina+, Truform TS, Tritek Ergo-Select, and Yorkdale TS.

Light Use Seating:Global offers light use seating that is warranted for 10 years for the original purchaser. The warranty covers all components (frame, glides, and arms). Thefoam/fabric is warranted for five (5) years. The warranty on these light use series is for an eight (8) hour day, 40 hour week and for users up to 200 pounds.Light use product series that apply under this warranty currently consists of Galaxy, Key and Kats.

Fabrics:Global warrants fabrics, vinyls and leather products marketed on Global and Global Branded cards. Global Carded Branded textile alliance programs arecurrently with Arc-Com, Designtex, Knoll, Momentum, Maharam, Ultrafabrics, Dani and Spinneybeck, are warranted for five (5) years. Global does not warrantCOM (Customer Own Materials) or GPM (Global Purchased Materials) that are customers own specified material, or graded-in and purchased by Global for aconsumer. For GPM or COM products, please contact the textile supplier for performance information and warranty details.

Seating Warranty Summary:

Files, Desks, Modular Furniture, Tables, Panels & Accessories:Global warrants all components of metal storage and filing, laminate and wood veneer desks, laminate and wood veneer tables, metal leg components and basicpanels for the lifetime of the product to the original purchaser.

Herman Miller, Inc. (“Herman Miller”), 855 East Main Avenue, PO Box 302, Zeeland, Michigan 49464-0302, USA, warrants the products sold by it and its subsidiaries to be free from defects in material and workmanship, regardless of the number of shifts during which the products are used, for the warranty periods specified.

This warranty covers the sale of Herman Miller product in all countries. Not all of the product lines appearing on this list are marketed by Herman Miller in all countries, and appearance on this list does not imply an offer for sale of a product line in a particular place. Product line availability is defined in current price lists applicable to different regions.

During the applicable warranty period, Herman Miller, as its sole obligation, will repair or replace (at its option) any product, part, or component covered by this warranty and sold after the effective date of this warranty which fails under normal use as a result of a defect in material or workmanship; Herman Miller will repair or replace the aforementioned product, part, or component with a comparable product, part, or component.

This warranty extends only to the original purchasers who acquire new product from Herman Miller, its subsidiaries, or its authorized resellers. Any product, part, or component must have been used according to Herman Miller’s published instructions and installed and maintained by a Herman Miller factory-trained technician or an authorized Herman Miller dealer installer. If these requirements are met, warranty coverage will be extended. Any misuse, abuse, or modification to the original product voids the warranty. Herman Miller does not warrant the performance of the product when used in combination with other than original Herman Miller product.

The warranty period starts from the date of purchase.

This document inclusively describes all of the warranties given and remedies available with respect to the company’s products and services. Herman Miller and its subsidiaries disclaim any other warranty whether express or implied, statutory or otherwise, in relation to the products.

Herman Miller does not warrant: • natural variations in wood grain or figure or the presence of

character marks

• changes in surface finishes, including colorfastness, due to aging or exposure to light

• marks, scars, or wrinkles occurring naturally in leather

• veins, marks, voids, fissures, or cracks found naturally in stone

In addition, Herman Miller does not warrant: • failure resulting from normal wear and tear

• pilling of textiles

• the matching of colors, grains, or textures of natural materials

• the colorfastness or the matching of colors of textiles, including an exact match to cuttings, samples, or to swatch cards

• damage, marking, or staining of veneer surfaces due to contact with rubber or similar compounds; damage from sharp objects or imprinting from writing instruments, or prolonged exposure to direct sunlight

• discoloration of Lyris™, Lyris 2, and any light-colored textiles due to soiling, stains, or dye transfer from clothing including denim

• foreign objects abrading fabric over time

Herman Miller tests Customer’s Own Material (COM) and other customer-supplied items for manufacturing quality only and does not provide any warranty with regard to these materials.

Herman Miller does not warrant products that are exposed to extreme environmental conditions or that have been subject to improper storage.

Herman Miller’s products meet the requirements of national and specific local codes as stated in the price books and other written publications.

TO THE EXTENT ALLOWED BY LAW, ANY IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED AND TO THE EXTENT THEY ARE LEGALLY REQUIRED, ARE LIMITED IN DURATION TO THE DURATION OF THIS WRITTEN WARRANTY.

Terms and ConditionsSeating WarrantyJSI warrants to the original purchaser that each piece of furniture will be free from defects in workmanship given normal usefor a period of 12 years of single shift service. Pneumatic lifts and casters are warranted to be free from defects in materialsand workmanship for a period of 5 years and textiles for 2 years. Electrical items not manufactured by JSI are covered for aperiod of one (1) year. JSI will, at its option, repair or replace any defective merchandise within the terms of the warranty.

JSI makes no expressed or implied warranties as to any product, and, in particular, makes no warranty of merchantability orof fitness for any particular purpose.

This warranty does not cover:• Natural variations in color, grain, or texture of wood and covering materials over which JSI has no control.• Damage caused by an installation or transportation company.• Accident, user modifications, misuse or product neglect.

Natural Variations in WoodEvery tree has unique and defining characteristics, likefingerprints. These characteristics include differences in color,grain configurations and texture. When specifying natural orlight finishes, these natural markings are not masked and areeasily detected. Maple and cherry species have a high degreeor uneven distribution of grain. With this in mind, we hope youenjoy and appreciate the beauty of each tree’s fingerprints. Inaddition, lighter finishes may discolor and darken when exposedto ultraviolet rays. Products cannot be replaced due to thesenatural variations.

Matching FinishesDue to the natural characteristics of wood, environmentaleffects, and material upgrades, we cannot guarantee exactfinish matches on existing furniture previously ordered from JSI.

If an exact match to existing furniture is required, it must bespecified so that the proper procedures can be followed toensure an acceptable finish. We will accept no liability for thefinish if this procedure is not followed. We reserve the right tomake changes in a finish formula if we believe the change willimprove the quality or appearance of our furniture. Productscannot be replaced due to these natural variations.

Lifetime Warranty

Effective July 1, 2008, Sitmatic warrants that the products it sells, and all components

thereof, shall be free from defects in workmanship or materials. Except for components

specifically excluded, for the life of the product, Sitmatic shall, at its option, repair or

replace any chair, or component thereof, that proves defective.

In the unlikely event you should require remedy under this warranty, simply locate the six

digit control number on the chair mechanism and contact Sitmatic at 1(800) 288.1492.

Sitmatic will, at your option, either send the necessary replacement to you at no cost, or

arrange a service call by a factory authorized service technician. You may contact your au-

thorized Sitmatic servicing dealer directly to effect the same remedy under this warranty.

Excluded items are operating mechanisms, pneumatic cylinders, casters, plastics, foam,

fabric, finishes, labor costs, wood and urethane components which are warranted for

ten (10) years. Damage, which in Sitmatic’s sole judgement, is the result of contact with

adjacent furniture or normal wear is expressly excluded from this warranty. On site service

is available to customers within a 50 mile radius of their authorized Sitmatic dealer. War-

ranty remedy for non-standard Sitmatic fabrics must be sought from the mills providing

those fabrics. Except as herein stated, Sitmatic shall not be liable for any damages or for

the breach of any warranty, expressed or implied, or for any other obligation or liability

on the account of the products covered by this warranty. Sitmatic makes no warranty of

merchantability or fitness for a specific purpose.

The basic structures of the chair are covered for the chair’s life: mechanism housing, cylinder housing, seat and backrest structures. All other parts of the chair are warranted for 10 years.

There is no exclusion for “normal” or 8-hour usage. If the facility operates 24 hour-a-day, 7 days-a-week, the warranty is still the same. •There is no “weight limit” on the warranty. If an employee can fit in the chair, the chair is warranted.•Labor is specifically covered in the warranty. Most warranties are conspicuously silent on this issue, and as we all know, labor costs •more than the parts.

In years gone by, we had a very simple warranty that provided full coverage on all parts and labor for the same period of time. Unfortunately for the consumer, many of our competitors started issuing outrageously long warranties. What the consumer didn’t see was the fine print. Many components, like foam and fabric, were not covered. Usage was restricted to 8 hours per day. Any employee over 250 lbs. negated the warranty.

Labor was not mentioned, or in some cases the consumer was required to disassembled the chair, crate it and return it to the factory. Inferior quality chairs started to show up everywhere, because the purchasing decision was based solely on perceived warranty length. Every sales situation began with a long winded explanation of warranties, instead of the true merits of the seating. Finally we gave up, and like every major furniture manufacturer, we created a longer warranty; a lifetime structural warranty, but the lifetime portion is clearly identified as a structural warranty.

Sitmatic’s on-going business is repeat corporate and government clients, not retail sales or one-time “mega-orders”. Obviously, our clients are pleased with the quality of our product and our after-sales service. As of yet, you do not have the benefit of this experience, so we offer you the following: we will match any of our competitor’s warranty, as long as we are allowed to do so word for word. We caution you, how-ever, that this may actually decrease the warranty for many of the components of the chair, add weight limits, and restrict the hours that a chair can be used.

Many manufacturers preach quality, but at Sitmatic we truly live it. From initial design through final inspection, our overriding concern is that your chairs do their job for a very long time. • An “ordinary use” means use of the product (i) in conformance with all applicable local, state or federal laws, codes and regulations (including without limitation building and/or electrical codes) and (ii) in accordance with manufacturer recommendations and/or instructions in the materials and documentation accompanying the product.

DOCUMENT CONTAINS 1 PAGE All table and seating products manufactured by Versteel, are guaranteed by a Lifetime Warranty against defects in materials and workmanship from the date of purchase.

Electrical items manufactured by Versteel are guaranteed against defect for a period of five (5) years from date of purchase.

Electrical items not manufactured by Versteel are covered by the manufacturers under their specified warranty.

Consumables such as gas cylinders, casters and glides are covered fora period of one (1) year. Versteel will not cover labor costs associatedwith replacing the casters or glides.

Wood veneer is warranted for a period of ten (10) years. Natural variations in grain, color or texture of wood should not be construed as defects under this warranty.

Versteel will replace or repair (at our discretion) without cost to our customers any item manufactured by Versteel found to be defective as a result of defective material or workmanship. We will not, however, repair any item which is not properly installed, abused or subject to any use other than that which was originally intended. The warranty does not cover normal wear and tear of the product, which is expected over the course of ownership. Any repairs by the customer must receive specific written authorization from Versteel before being executed on location to receive proper reimbursement for associated costs. In no event shall liability under this warranty exceed the original purchase price.

Warranty on plastic laminates and upholstery is not covered by Versteel but is covered by laminate and textile manufacturers under their specified warranty only. All foams, fabrics and vinyls are prone to stretch and loosen over time through normal use. This natural effect, called puddling is covered for a period of one (1) year from the date of purchase.

10-Year Limited Warranty Subject to the limitations set forth below, NWN, Inc./Westin-Nielsen warrants all furniture it manufactures to be free from defects in material orworkmanship for a period of 10 years from date of invoice, given normal use (eight-hour shifts, five days per week) for the original purchaser.NWN, Inc./Westin-Nielsen will, at its sole option, repair or replace an item free of charge, or provide an allowance for repair of any defective part.This warranty does not apply to damage resulting from other equipment, table bases, storage, accident, misuse, abuse, negligence or instanceswhen original construction has been altered by someone other than NWN, Inc./Westin-Nielsen. No part shall be construed as defective unless a factory inspection has been made. All expenses for packaging and shipment of returnedmerchandise are the customer’s sole responsibility and shall be paid by them. Written information containing the name of the original customer,the original invoice number, copy of the original purchase order and the exact location and use of the product must be provided. Because of natural variations on materials over which NWN, Inc./Westin-Nielsen has no control, this warranty does not extend to color, grain ortexture of wood, leather or upholstery cover. No upholstery materials are warranted against fading, wearing or for being cut by the customer orothers. For purchased component parts, we will applyexactly the same warranty that is extended to us by our supplier. All other warranties, expressed or implied, are excluded and NWN, Inc./Westin-Nielsen makes no warranty of merchantability or fitness for anyparticular purpose. NWN, Inc./Westin-Nielsen shall not be liable for incidental or consequential damages arising from any product defect. PDQ ProgramMany models are available for shipment in 10 working days after we receive fabric for up to 24 seats. Orders desiring “PDQ-Quick Ship” mustclearly request “PDQ-Quick-Ship” on the purchase order at the time it is placed with us. There is no additional charge for PDQ-Quick Ship orders,but we do require that they be 100% prepaid. Credit Policy/TermsFor established accounts, credit terms are NET 30 days from invoice date. A 1 ½% per month or 18% annual finance charge will be assessed onall past due balances. When exceeding the agreed to credit limit, a 50% deposit may be required with the purchase order. Established accountsthat do not maintain a prompt pay status will be assigned a Cash Before Shipment requirement. New and non-accredited accounts must enclose a 50% deposit with the purchase order and the balance must be paid prior to shipment and uponnotification that the order is ready to ship. All custom orders require a 50% deposit due with order and the balance paid prior to shipment upon notification that the order is ready to ship. Application for credit must be made on the NWN, Inc./Westin-Nielsen credit application form and include four current trade references, plus onebank reference. Please include addresses and fax numbers for all references. Allow a minimum of 30 days for reference checking by mail. Opencredit is subject to our credit policies. California Technical Bulletin 133All Westin-Nielsen chairs can be constructed to be CAL TB 133 compliant. When our chairs are manufactured with a fire barrier layer CAL TB 133,compliance can be achieved with a wide range of commercial fabrics. The additional charge for CAL TB 133 compliant construction is:- +15% List extra for all single chair models- +20% List extra for all multiple seating, sofa or settee models By using a proper fire barrier, most fabrics will comply with CAL TB 133. Fabric content information for CAL TB 133 orders must be provided attime of order to determine if the proposed upholstery fabric is an exception. If project specific test results are required, the customer will be required to pay any test charges and attendant freight costs. Please contactWestin-Nielsen Customer Service for details. Storage/Cancellation/ReturnsStorageIf the customer will not accept delivery of merchandise when NWN, Inc./Westin-Nielsen is ready to make shipment, we will transfer themerchandise to storage. NWN, Inc./Westin-Nielsen considers such a transfer to be the same as delivery, and will issue an invoice and expect payment at that time. The customer bears therisk of loss or damage during storage. Cancellation and ReturnsNWN, Inc./Westin-Nielsen’s acceptance of an order is final. Orders may not be cancelled nor furniture returned without NWN, Inc./Westin-Nielsen’swritten approval. NWN, Inc./Westin-Nielsen reserves to its sole judgment when and under what circumstances it will approve a cancellation or areturn. Custom orders cannot be cancelled or changed once production has begun. Requests for cancellations or furniture returns should be made in writing to NWN, Inc./Westin-Nielsen. We only approve a request for cancellationor return in writing to the customer, not by phone or email. If an order specifying Customer’s Own Material (COM) is cancelled after the COM hasbeen cut, credit for the COM will not be issued. In the event of any and all cancellations, NWN, Inc./Westin-Nielsen will charge the customer forany portion of the order that has been completed, plus an amount of profit that has been lost on the remaining portion of the order.
