This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner, Commissioner, the Commission voted unanimously to approve the Reappointment of Gregory Wimmer to serve as a Board Member for the Green Valley-Glenwood Public Service District. His term will expire on October 31, 2022.

RE:OATH – BRAMWELL PUBLIC SERVICE DISTRICT

This day on motion of Gene Buckner, Commissioner, seconded by Greg Puckett, Commissioner, the Commission voted unanimously to approve the Appointment and Oath of Office for Harold Brown to fill the unexpired term of William Allemeier on the Bramwell Public Service District Board of Directors. His term will expire on June 13, 2017.

RE:DRAWDOWN – MERCER/SUMMERS IV-B ELGOOD WATER PROJECT

This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner, Commissioner, the Commission voted unanimously to approve Drawdown #16 in the amount of $14,681.85 for the Mercer/Summers IV-B Elgood Water Line Extension Project.

RE:APPROVAL – HATFIELD MCCOY TRAILS

This day on motion of Gene Buckner, Commissioner, seconded by Greg Puckett, Commissioner, the Commission voted unanimously to approve .7 miles of county route 15/1 in Mercer County for limited All-Terrain Vehicle (ATV) traffic. This request is for the specific purpose of traveling to and from the Hatfield McCoy Trails to access lodging facilities, food and fuel located near the Pocahontas Trail System in Mercer County.

Meadows be appointed as Administrator of the estate of Marshall Allison, deceased, and personal representative be removed.

The Commission further ORDERS bond in the amount of $1,000.00 remain on said estate.

RE:FUNDING REQUEST – GREEN VALLEY-GLENWOOD PSD

This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner, Commissioner, the Commission voted unanimously to approve a funding request in the amount of $9,874.10 to Green Valley-Glenwood PSD for the Ceres Hollow Water Extension project. Funding will be taken from the Coal Reallocation Severance Tax fund.

RE:FUNDING REQUEST – CITY OF BLUEFIELD

This day on motion of Gene Buckner, Commissioner, seconded by Greg Puckett, Commissioner, the Commission voted unanimously to approve a funding request in the amount of $1,000 to the City of Bluefield for the Veterans Community Luncheon Event. Funding will be taken from the Hotel Motel fund.

RE:FUNDING REQUEST – CHILDREN’S HOME SOCIETY

This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner, Commissioner, the Commission voted unanimously to approve a funding request in the amount of $500 to the Children’s Home Society for the 9th Annual Ghost Walk. Funding will be taken from the Hotel Motel fund.

RE:FUNDING REQUEST – SONS AND DAUGHTERS OF ITALY

This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner, Commissioner, the Commission voted unanimously to approve a funding request in the amount of $1,000 to the Sons and Daughters of Italy for the Southern WV Italian Festival. Funding will be taken from the Hotel Motel fund.

RE:FUNDING REQUEST – MERCER COUNTY COMMISSION

This day on motion of Gene Buckner, Commissioner, seconded by Greg Puckett, Commissioner, the Commission voted unanimously to approve the purchase and installation of new blinds for Judge Sadler’s courtroom as quoted by Rayblockers Custom Blinds. Funding in the amount of $8,600 will be taken from the Video Lottery fund.

RE:FUNDING REQUEST- MERCER COUNTY LITTER CONTROL

This day on motion of Gene Buckner, Commissioner, seconded by Greg Puckett, Commissioner, the Commission voted unanimously to approve the purchase and installation of a new winch and spray in bed liner for the Mercer County Litter Control Ford F-150 as quoted by D&M Truck Bedliners. Funding in the amount of $1,030 will be taken from the Hotel Motel fund.

RE:ANNOUNCEMENT – HALLOWEEN TRICK-OR-TREAT TIME

This day on motion of Gene Buckner, Commissioner, seconded by Greg Puckett, Commissioner, the Commission voted unanimously to approve the designated Trick-or-Treat time in Mercer County for Monday, October 31, 2016 from 6:00 to 8:00p.m.

RE:ANNOUNCEMENT – MERCER COUNTY COMMISSION AGENDA MEETINGS

This day the Commission made the announcement that agenda meetings are held at 10:00 a.m. the Tuesday before the Regular County Commission meeting every month. The public is welcome to attend.

RE:DEPOSIT AT INTEREST – SINKING BOND FUND

As provided by section five, article six, chapter seven of the West Virginia State Code, One thousand nine hundred thirty-one, the county treasurer is authorized to establish with county depositories two accounts, one to be designated “demand deposit account” and the other to be designated “time deposit account”.

THEREFORE, it appears that the SINKING BOND deposit in the demand deposit account exceed the current requirements or demands, the treasurer of Mercer County is directed to transfer the sum of TEN THOUSAND DOLLARS & no/100 ($10,000.00) Dollars to said TIME DEPOSIT account, which will earn interest thereon, for a period of thirty (30) days.

This to be effective June 18, 2017.

This day came Frye Roofing Inc., by representative, and moved the Commission to correct the Land Books for 2016, touching the assessment thereon against the said Frye Roofing Inc. on Lot 4-5-6 Sec 155 Blfd (Comm), Bluefield District, County of Mercer, State of West Virginia. Prosecuting Attorney waiving notice thereto.

After hearing all the evidence in the case and it appearing to the Commission that there was an error in assessment, property assessed for $82,020 class 4 – should be assessed for $75,360 class 4. It is therefore ordered that Frye Roofing Inc. be exonerated from the payment of taxes, or if the taxes have been paid, shall be refunded by the Sheriff of Mercer County on such erroneous assessment.

Amount of Exoneration $184.88.

This day came Dennis F. Elswick, by representative, and moved the Commission to correct the Land Books for 2016, touching the assessment thereon against the said Dennis F. Elswick on 1 Ac Bluestone, Beaver Pond District, County of Mercer, State of West Virginia. Prosecuting Attorney waiving notice thereto.

After hearing all the evidence in the case and it appearing to the Commission that there was an error in assessment, property assessed for $57,780 class 2 – should be assessed for $29,580 class 2. It is therefore ordered that Dennis F. Elswick be exonerated from the payment of taxes, or if the taxes have been paid, shall be refunded by the Sheriff of Mercer County on such erroneous assessment.

Amount of Exoneration $320.92.

This day came Anthony Scyphers, by representative, and moved the Commission to correct the Land Books for 2016, touching the assessment thereon against the said Anthony Scyphers on 122 ¾ Ac Laurel Cr, Plymouth District, County of Mercer, State of West Virginia. Prosecuting Attorney waiving notice thereto.

After hearing all the evidence in the case and it appearing to the Commission that there was an error in assessment, property assessed for $203,390 – should be assessed for $140,031. It is therefore ordered that Anthony Scyphers be exonerated from the payment of taxes, or if the taxes have been paid, shall be refunded by the Sheriff of Mercer County on such erroneous assessment.
