locker. In fact, Windows Server 2003 made a huge leap this year as theprimary server OS (63% vs. 39% in 2005), while Netware continued itsslide down in market share among law firms with only 13% indicating it’stheir primary server operating system. Microsoft’s other “bread andbutter” product, Office 2003, also made a big climb to first place as thepreferred word processor and spreadsheet program, with 44% ofrespondents citing usage versus the next most popular choice of OfficeXP (2002) at 39%. Wondering about WordPerfect? A few loyalistsremain, with 5% still using it as their primary keyboard tickling letterwriter. And perhaps Steve Ballmer’s tirades against Linux are paying off?For the first time since we began tracking Linux usage among law firmsin 2000, usage of Linux has dropped 4%, but it still remains significantat 21%. And would you believe it? UNIX, the OS that most figured wouldsurely be dead by now, still hangs on with 9% who haven’t flipped itspower switch off yet. Maybe they forgot it was still back there in theserver room, running without a blue screen of death?
The Devil Wears Prada . . .My Dell Wears Gucci. And VMWare.Dell is still going strong! They command the majority share of desktopPCs (61%) and laptops (55%), and the use of Dell servers continues torise with 38% indicating that they buy Dell for the back room. However,HP/Compaq remains dominant in the server realm with 55%. Relatedto servers, we enhanced our question this year for a very hot technologycalled virtual server software, for which VMWare is king (28% vs. 8%for MS Virtual Server), but don’t count Microsoft out. Both vendorsrecently began making some of their offerings available for free butsupport will cost you. Currently, usage of virtual server technologyamong firms is at 35%, and we suspect this very interesting tool togrow in adoption. Storage area networks (SANs) are another serverroom technology that continues to soar. SANs are now in use by amajority of firms (51%) in order to keep up with their growing storageneeds and uptime requirements.

We are truly appreciative of the great response by ILTA member firmsto this year’s survey. We received a record number of respondents(491), representing firms with attorney counts ranging from 4 to 4,800.Over 98,000 attorneys and 230,000 total end users are represented bythis data. The majority of responses were received from the UnitedStates (90%), with submissions also coming from firms in Canada(8%), Australia and the United Kingdom. Our respondents representprivate law firms, with a statistically average firm having about 90attorneys and 205 total users, spread among 3 offices. This publicationincludes a section which reports data based on the following sizecategories and percentage of respondents in each:
In this year’s survey, we added more than 15 new questions on topicssuch as PDAs, cost recovery, WAN architecture, online backup software,firewalls and Web filtering. Several questions from prior surveys werealso revised and/or improved. As a result, a few graphs won’t includetrend data because the rephrasing of the question rendered past datairrelevant. Without further ado, and with a nod toward movie titles fromthe past year, let’s look at some highlights and trends.
Fun with Dick and Jane . . .Hilarity Ensues with Microsoft UpgradesIs there ever a year during which firms aren’t working on a major upgradeinvolving Microsoft products? Of course not! For 2006, many firms wereburying their older versions of Windows and Office into Davy Jones’s

Over the Hedge . . .Where I Want to Send My Old PC!A definite trend has emerged on the replacement of desktop PCs, withfirms squeezing more life out of them. Perhaps this is due to theswiftness of hardware advancements that have outpaced software, orperhaps it’s due to pure economics. In any case there are an increasingnumber of firms that have moved from a three- to four-year replacementcycle or are replacing PCs as needed. Microsoft also seems to recognizethat companies want to prolong life for older computers. In July, theyannounced Windows Fundamentals, which is touted to bring a mixture ofthin client technology with limited local application processing for olderPCs. When it comes to extending the life of laptops, things haven’tchanged much. Those portable work centers tend to get a lot of abuse,and most firms continue to replace them on a three-year cycle. Andeven though portables have gotten more affordable, it’s also interestingto note that the percentage of attorneys who use a laptop computer inplace of a desktop computer hasn’t really changed over the last fewyears. Perhaps this is due in part to the increasing use of PDAs byattorneys who would rather tote a small, light-weight BlackBerry insteadof a leather bag that feels like it carries a brick.
Snakes on a Plane . . .PDAs on the TrainSpeaking of PDAs, more firms than not have decided to limit the extentof their technical support to one PDA platform, thus simplifying PDAsupport and maintenance, which was one of the top five mostfrequently cited annoyances in last year’s survey. And the PDA ofchoice? A BlackBerry, of course, powered by a BlackBerry Enterpriseserver (BES, or BEZ as everyone likes to call them). Just over threequarters of all firms (77%) indicate that they use BlackBerry PDAs andmost of them have a BES.
An Inconvenient Truth . . .Global Budgets Are Getting Warmer!When firms were asked how their capital budgets compared to last year,a majority (53%) indicated that their capital budget increased versusstaying the same (31%) or decreasing (15%). Similarly, IT operatingexpense budgets just tend to grow each year for most firms. There is atrend toward purchasing rather than leasing major expenditures, with60% of firms indicating they buy instead of lease.
My Super-Ex Girlfriend . . .Super Vendors and Annoying VillainsWhen firms were asked to name any vendors that had done anoutstanding job in terms of product quality, support and pricing, severalhave made it a repeat year. At the top of the list: Dell, CDW, HP,Microsoft and Interwoven garnered the most votes. On the villain sideof things, when firms were asked to name their biggest annoyances, thetop two vote getters were related: users’ acceptance of change andmeeting needs for and/or getting participation in training. Last year,spyware and spam were the biggest pests. What a difference a year
can make! Perhaps related to the resistance to change by users, amajority (53%) of firms indicated that they either have implemented orare working on a matter-centric interface to their major informationsystems. A big change!
King Kong vs. Little Man . . .The Impact of Firm SizeWhile ILTA member firms have a significant number of things incommon, there are different challenges posed by firm size. The detailedtables included in this survey provide a rich source of information onhow firms of different sizes are using technology. Here are a few of theways that firms are different, based on size:
Compared to larger firms, smaller firms are:
More likely to have fewer staff per attorney
More likely to not standardize on a replacement cycle for PCs orlaptops
More likely to handle records management in a manual fashion
More likely to buy instead of lease new technology
Less likely to bill clients for copies printed by laser printers
More likely to have users using two different word processingprograms
Compared to smaller firms, larger firms are:
Much more likely to use virtual server software
Much more likely to have attorneys using laptops full-time
More likely to provide financial support of PDAs and have a higheradoption of PDA usage
More likely to have metadata removal software to clean documents,and more likely to have document assembly software to automatedocument creation
More likely to have or be working on a matter-centric interface oftheir systems
Much more likely to have automated IT support, that is, to usespecific tools for software distribution, inventory, remote control ofthe desktop and helpdesk call tracking
Much more likely to use VPN technology or Citrix for remote access
Much more likely to have video conferencing equipment
More likely to have a Nortel or Cisco phone system, and more likelyto have an IP telephony system (VoIP)
Much more likely to have an extranet and a Web-based portal forusers
More likely to offer wireless network connectivity, and more likely tohave a redundant or backup Internet connection
More likely to use a Web filtering technology to block or limitInternet access to harmful content
Much more likely to have a completed business continuity plan
More likely to have increased the capital budget and operatingbudget since last year

On Average . . .Every few years, it has been interesting to describe the “average” U.S.law firm in terms of their technology from the survey results. And whilethere’s truly no such thing as an average law firm, for yourentertainment, here’s what it might look like:
It has 90 attorneys and a total of 205 users, spread across threeoffices. Their Microsoft network is running the most current versions ofWindows on their HP servers and their Dell desktops and Dell laptops.They are making use of an HP or EMC SAN, and they are eitherexperimenting with or have started to use the virtual server technology(e.g., VMWare). BlackBerry PDAs are very prevalent, and the firm isfinancially supporting their usage, for which half of the attorneys haveadopted them.
Microsoft Outlook and Word 2003 are two of the firm’s most usedapplications, with Interwoven there to help manage their growingdocument and file collection. They have an interest in working on a newmatter-centric interface to their systems and might have alreadyimplemented one. Elite is used to handle their billing and conflictsearch needs, and Equitrac helps them manage cost recovery, but theyare not billing for pages printed on their laser printers. Their favoritelitigation support tools are Summation, CaseMap and TimeMap.
Remote access to the firm’s systems is important, and the firm employsmore than one solution which includes Citrix, Outlook Web and VPNencryption. Untethered access inside the firm is also important, sowireless networking is available in the office space which includeswireless Internet access to visitors. The Internet is mission-critical forthe firm, and, as a result, they have a backup connection along with aCisco (PIX) firewall to protect the network and a Web filtering system tohelp block other harmful or objectionable content. Speaking of avoidingpotential disasters, the firm is still working on their business continuityplan.
Of course, all of this technology costs money, and the firm finds thattheir expenses keep rising. But keeping current is important, and, as aresult, the firm saw their capital budget grow compared to last year’sbudget. They have also come to favor buying their major purchasesrather than leasing them.
