Road Bengaluru- 560009 Dear Sir/Madam TENDER FOR RENOVATION OF EXECUTIVE VOF Flat No. B-104, AT NABARD QUARTERS, RAHEJA PARK APARTMENT, Magadi Road, BENGALURU 1. I / We have examined the Scope of Works, Specifications and Schedule of Quantities and Terms and Conditions relating to the tender for the said works after having obtained the Tender document invited by you. 2. I / We have visited the site, examined the site of works specified in the Tender Document and acquired the requisite information relating thereto as affecting the Tender. 3. I / We hereby offer to execute and complete the works in strict accordance with the Tender Document at the item rates quoted by me / us in the attached Schedule of Quantities in all respects as per the specifications and Scope of Works described in the Tender Document and the Annexure containing Terms and Conditions. 4. I / We enclose herewith interest-free Earnest Money Deposit (EMD) for Rs.26, 000/- (Rupees Twenty Six Thousand Only) by Demand Draft payable at Bengaluru in favour of 'National Bank for Agriculture and Rural Development' (NABARD) and the sum shall be forfeited in the event of our withdrawal of Tender before expiry of the validity period of offer and / or in the event of our failure to execute the Contract when called upon to do so by accepting our Quotation. 5. In the event of this tender being accepted, I/We agree to enter into and execute the prescribed Agreement with NABARD as per the format given in the Annexure. 6. I/ We agree to pay all Government (Central and State) Taxes such as State GST, Central GST, IGST, ,Works Contract Tax, Excise Duty, etc. or any other taxes prevailing from time to time and the rates quoted by me/us are inclusive of the same. 7. INSTRUCTIONS TO THE APPLICANTS/ CONTRACTORS

2) Applications containing false and/or incomplete information are liable for rejection.

3) In deciding the selection of a Contractor, great emphasis will be given on the ability and competence of applicants to render required services within the specified time frame.

4) The applicant must have qualified and experienced professionals in the respective discipline. 5) All PQ bid papers annexed along with the “Technical Bid‟ document should be serially

numbered on the top right hand corner of every page. 6) All pages of the Technical bid document should be duly signed and stamped by the authorised

signatory of the applicant. The applicant should submit all requisite documents in support of information furnished in the Technical Bid document and should be attested by an authority competent to attest the documents. Failure to attach attested copies may lead to disqualification of the bidder.

7) Tenders should be on the specified form (Non-transferable) which may be either downloaded

from our website www.nabard.org or collected from under-mentioned address and submit the completed document along with necessary papers in prescribed proforma on or before 06 September 2017 by 15.00 hrs. to, Chief General Manager, NABARD, No. 46, NABARD Towers, K G Road, Bangalore 560 009. Tenders should be submitted super-scribed with the name of the work, date, details/ address of the applicant and time of opening on the envelope. They will be received up to 1500 hrs on 06 Sept. 2017 and will be opened on the same day at 15.30 hrs in the presence of bidders who choose to be present.

8) The employer (NABARD) does not bind itself to accept the lowest or any TENDER, and NABARD

reserves its right of accepting the whole or any part of the TENDER and the Bidder shall be bound to perform the same at the rate quoted. While deciding upon the selection of contractors for participating in the Price bid, emphasis will be given on the ability and competence of applicants to do good quality works within the specified time schedule and in close co-ordination with other agencies, besides the rate structure of the items. Also, emphasis will be given to the applicants who have executed majority of the similar works (Structural Rehabilitation & Renovation works (Civil, Electrical and Interiors).

9) NABARD also reserves the right to split the order and Place the Order/s on ‘one or more’

number of parties at its discretion, if required.

10) For the project, the contractor should have a separate in-house team of professionals consists of experienced/qualified junior engineers/ site supervisors, to execute the projects independently and smoothly within the time schedule.

11) The rates/ fees/charges for rendering the services as per item of works shall be quoted by the

applicant in the format provided in the Price Bid. Further, the contractor must acquaint himself with the site condition before quoting his rates and carrying out the work.

12) Tender submitted shall remain valid for 90 days from the date of opening for the purpose of

acceptance and award of work, validity beyond 90 days from the date of opening shall be by mutual consent.

13) The information pertaining to experience and related information of the Contractor may be

provided as per the formats enclosed in Annexure. Further, the information so furnished may be supported by certificates, wherever applicable.

14) The Price bid should contain only the rates quoted by the Contractor. The Bidder shall quote

rates both in figures and words. On check if there are differences between the rates quoted by the Bidder in words and in figures, the rates in words will be considered as final.

15) The Bidder will not be permitted to quote for works in NABARD where a relative is posted. In

this context, relative shall be defined as a person connected by blood or marriage to the bidder.

16) Before quoting, the Bidder shall inspect the site, to fully acquaint himself about the condition in regard to accessibility of the site, working condition of site and locality including installations of tools and plants (T&P) etc., conditions affecting accommodations and movement of personnel etc. required for the satisfactory execution of the work contract. No claim whatsoever on such account shall be entertained by the Employer in any circumstances.

17) Except writing rates and amounts, the Bidder should not write any conditions or make any

changes, additions, alterations and modifications in the printed form of Tenders. No conditional rebate will be accepted.

18) Bidder should attach required proofs (Self Attested Photocopies) for the eligibility in support of

works of similar nature, as indicated in Technical Bid. 19) All tender paper annexed along with the ‘Bid’ should be serially numbered on the top right hand

corner of every page. All pages of the tender document should be duly signed and stamped by the authorized signatory of the applicant. The tender document should be submitted in original. Tender document not submitted in original will be treated as invalid and rejected. The applicant should submit complete set of documents in support of information furnished in the Bid document.

20) “JVs/ Consortiums/ MOUs shall not be considered.” 21) Canvassing in connection with the Tenders is prohibited and the Tenders submitted by the

contractors who resort to canvassing are liable for rejection. 22) Decision of the Bank in regard to determining the selection of the applicant/ Contractors shall be

final. The Bank is not bound to assign any reasons there for and reserve the right to reject any or all offers.

23) The Contractor or his authorized representative should visit the site frequently as required by Consultant/PMC/NABARD and meet them with prior appointment for any clarifications and to receive instructions, take measurements, etc. at the site.

Should this quotation be accepted, I hereby agree to execute the said work at the respective rates mentioned in the schedule of quantities and abide by instructions contained in the above paragraphs. Date: Place:

PRE-QUALIFICATION CRITERIA Contractor who fulfills the following pre-qualification criteria only need to apply. Joint ventures are not accepted. 1. The bidder should have minimum average annual financial turnover of Rs. 4.00 lakhs in the last 3

financial years ending on 31.03.2017.

2. The contractor should have experience in similar works (Civil contractors in Rehabilitation and

Renovation works including plumbing, electrical and interior works) during the last 7 years. The details to be provided in format given in annexure.

3. The bidder should have experience of having successfully completed similar projects of value of total building work with super structured civil, plumbing, water supplying, electrical and interior decoration work during the last 7 years ending 31.3.2017 as under:

a) Three similar completed works each costing not less than _Rs. 6.00__ lakhs (OR) b) Two similar completed works each costing not less than _Rs. 8.00__ lakhs (OR) c) One similar completed work costing not less than _Rs. 11.00___ lakhs.

4. Similar work means construction/ external and internal renovation of commercial/residential buildings with RCC columns, beams, preferably for central/state govt. or other public sector units.

5. The contractor/firms who has executed works for Govt/Public Sector undertaking is required to submit job completion certificate from Govt/Public Sector undertakings. Those who have executed works in private sector, they should submit certificate of their employer having executed similar work and preferably with TDS Certificate. The copy of relevant income tax return shall be enclosed to establish that the work has been completed by the contractor.

6. Should submit audited balance sheets / P&L account and Income Tax Clearance Certificates for

the last 03 financial years

7. The value of executed works shall be brought to the current level by enhancing the actual value of work done at a simple rate of 5% per annum, calculated from the date of completion to previous day of last day of submission of tenders.

8. The contractor/firm should have valid registration for GST etc. The contractor shall submit the

copies of registration certificates for verification.

Definitions a) “The Contract” The term Contract Document means the Notice Inviting Tender, Tender form,

Instructions to Tenders, Safety Code, Conditions of Contract, Specifications, Priced Schedules and Drawings, Articles of Appendices. Notwithstanding the sub-division of the documents into separate volumes and sections, every part of each shall be deemed to be supplementary to and complementary of every other part and shall be read with and into the contract so far as it may be practicable to do so. In the contract the following expressions shall, unless the context otherwise requires, have the meaning hereby respectively assigned to them.

b) Techno-Commercial Bid/ Technical bid: Contract document containing all technical and commercial conditions required for effective and efficient execution of the work.

c) “NABARD / Employer” means NABARD having its Registered & Corporate Office at C-24, G

Block, BKC, Bandra East, Mumbai 400 051 and includes its representatives, successors and assigns.

d) “Sanctioning Authority” means authority nominated to exercise power of approval, sanction and acceptance concerning administrative, financial and technical aspects of transactions done on behalf of NABARD.

e) “Architect/ Consultant/ PMC” means representative appointed by the Employer to give technical advice, supervise the work and provide consultancy services in regard with the project.

f) “The Contractor or Contractors” means the firm or agency or individual engaged by the Employer to execute the work. It shall also include their legal representative(s), successors or assigns.

g) “Contract value” means the value of the entire work as stipulated in the work order conveying acceptance of the tender subject to such additions thereto or deductions there from as may be made under the provision herein after contained.

h) “Tendered value” means the value of the entire work as stipulated in the work order.

i) The term “Work” means the work, which is undertaken by the Contractor pursuant to the Contract. Work includes, unless specifically excluded, the supply and provision of materials, labour, equipment, supplies, plant, tools scaffoldings, transportation, superintendence, temporary construction of every nature, taxes, work contract tax, excise, Octroi, insurance, and all other services and facilities necessary for the full performance and completion of the requirements of the Contract.

j) “The Site” means the premises, into or through which work is to be executed under the contract or any adjacent premises, which may be allotted or used for the purpose of carrying out the contract.

k) “Market Rate” means the rate as decided by the Employer on the recommendations of Bank’s Representative based on the cost of materials and labour at the site where the work is to be executed plus 15% towards all overheads and profits.

TERMS AND CONDITIONS 1. Quantities indicated in the BOQ are only tentative and shall be executed only at the sole

discretion of NABARD and PMC. The quantities indicated are based on estimation, which may vary upward or downward during execution. The bills shall be settled on the basis of actual quantity of items executed by the contractor at the site. Some of the items of work may not be executed at all and some may be partially executed at the sole discretion of NABARD. The contractor shall not have any claim on account of variation.

2. This is an Item Rate Contract. Quoted rates should be workable and reasonable and should include incidental and all overheads and profits. The contractor should furnish Rate Analysis for scrutiny of the rates by NABARD, if required.

3. Rates should include all Taxes- CGST, SGST, IGST, Levies, Wages as per Act, etc. as applicable and should be firm for the entire Contract period. No escalation of rates will be allowed for the entire contract period on any account.

4. Materials used should conform to relevant BIS Codes. BIS and CPWD Specifications and Method of Measurements shall be followed as applicable. However, in the absence of the same and / or in case of any discrepancy, the decision of NABARD shall be final.

5. Income Tax (TDS) and other applicable taxes as per statutory provisions will be deducted from total payment due to the Contractors.

6. ESTIMATED QUANTITY: Quantities as per SOR/Price bid are indicative only (subject to variance of +/-10% of each Item as per BOQ/as applicable.) However, it is distinctly understood that NABARD shall not guarantee any minimum quantity / value during the duration of the contract and the bidder will not be entitled to demand any charges whatsoever or any other loss or damage of whatsoever nature from NABARD for non-utilization of the said Plant / facilities/work called for wholly or in part.

7. The rate of additional items / non-tendered items (if considered necessary during the execution of work will also have to be undertaken) will be worked out on the basis of rates quoted for similar items in the contract wherever existing. If similar items are not available, the rates for such items will be derived as per standard method of rate analysis based on prevalent fair price of labour, material and other components as required with 15% towards contractor’s profit and overheads plus applicable work contract (VAT) & service tax or GST. In such cases, contractor shall submit the documents supporting the price his rate analysis along with all relevant supporting market rates list / vouchers for consideration of the Bank.

8. In case the contractor is constrained to substitute/ variate in the material specifications on account of non-availability of the same in the market or long delivery time, he/they must obtain the approval for any such substitution/variation from Bank. For variate/substitute item, Bank will make the suitable deduction/additional payment on the basis of difference in the cost of item specified in tender and substituted item or proportionate cost in case of variation in size plus 15 % towards contractor’s profit and overheads from the quoted rate. In such cases, contractor shall submit the documents supporting the cost of the material purchased and quotation of the material specified in the tender for consideration of the Bank.

9. The Contractor shall comply with the provisions of Contract, Labour (Regulation & Abolition) Act, 1970, Minimum Wages Act, EPF & NP ACT – 1952 and all other Labour Laws and other Statutory Regulations (both Central and State) that may be enforced from time to time by the appropriate authorities. NABARD shall not be held responsible for any penalty or failure of any Labour Regulations. NABARD shall have the power to inspect the Wage Register, PF Register and for physical verification of salary paid to and PF deduction of the staff with reference to any records of the Contractor and to insist the Contractor to comply with Laws.

10. The Contractor should be responsible to fulfil all the obligations in connection with the workers employed by the Contractor for the purpose of the Contract and all the Statutory and other liabilities, if any, including minimum wages, leave salary, uniform, ex-gratia, gratuity, ESI, Provident Fund, Workmen Compensation, if any, etc. in connection therewith shall be on the Contractor's account and payable by the Contractor.

11. The Contractor should arrange to obtain necessary insurance cover (Workmen compensation policy) for his employees at his cost and should be responsible for the safety of persons, employed by him.

12. All work shall be carried out as per latest CPWD specifications or procedure for electrical work

and materials conform to relevant BIS codes where mentioned. The co-eff. for painting works will be taken as stated in tender or as per CPWD specifications. Samples of materials or brand wherever required shall have to be got approved by Bank’s Engineer before actual use in the work.

13. The contractor will make temporary arrangements at the site at his cost for storage space. All material required for proper completion of work including cement and steel, labour, scaffolding, safety equipment, tools and plants etc. shall be arranged by the contractors. The contractor will take all the steps to ensure the safety of labour, persons and Nabard property. The contractor will maintain a First Aid Box at site.

14. The work involved calls for a high standard of workmanship combined with speed and use of quality materials as specified and approved. Any workmanship or materials not complying with the specific requirements of approved samples or which have been damaged, contaminated or deteriorated must be removed immediately from the site and replaced at the risk and cost of contractor.

15. QUALITY CONTROL: i. Quality Consciousness: The contractor should make himself aware of the quality standards

set by the Architect/The NABARD, Bangalore and employ staff who have sufficient experience in handling high quality construction and who can team up with the Architect and The NABARD, Bangalore to bring out excellent results.

ii. Quality tests and expenses: The contractor should ensure quality of materials and

workmanship by producing test reports by approved agencies as and when asked by the Architect/The NABARD, Bangalore for any part of the work. The cost of such tests shall be borne by the contractor.

iii. Quality Assurance: Any part of the work found defective with respect to the drawings or

specifications in the opinion of the Architect/The NABARD, Bangalore shall be demolished/removed by the contractor at his cost and risk.

iv. Quality acceptance: The NABARD, Bangalore reserves the right to hold the payments of bills of any stage in part or full if the quality of work done at that stage is not acceptable by the Architect/The NABARD, Bangalore.

v. The contractor shall arrange for testing of major constructions materials such as cement,

steel, pipes to be used in the project from a Govt. Engineering College if required at their cost and submit such test reports/results to the Bank/Architects.

16. The work should be carried out with least inconvenience to the occupants and the car parking.

The workmen employed by the Contractor should abide by the Rules and Regulations maintained by PMC & NABARD in the premises, especially in respect of working hours, entry of the workers to the premises, interpersonal relation with the occupants etc.

17. EXECUTION OF WORK i) The specifications/ list of approved makes shall be strictly adhered to. If any item is not available

as per the list of makes specified, approval has to be obtained for equivalent make, after having produced proof of non-availability of the item in the market. The work done should conform to the standards as per BIS/ IS codes and CPWD specifications.

ii) Instructions of the NABARD, regarding the project work shall be forwarded to the contractor through the Consultant/ Architect.

iii) The Architect will determine on behalf of The NABARD, if the work is being performed in accordance with the Contract documents. NABARD/ Consultant will have the authority to reject the Contractor's work which does not conform to the contract documents and the authority to reject the Contractor's work which does not conform to the. Contract documents and to request necessary inspection and testing. The Contractor shall be required to remove the defects and materials and nothing extra shall be payable to the Contractor on this account.

iv) A Site Order Book shall be maintained by the Contractor on Site wherein all instructions from the Architect or Site in Charge shall be recorded.

v) The Contractor shall give every facility to the Architect and/or their representatives/ concerned NABARD officials necessary for inspection, examination and test of the materials and workmanship. If the work is to be done at a place other than the site of the work, the Contractor shall obtain the written permission of the Architect for doing so.

vi) Except the representative of the Public authorities, any person not connected with the Project and any other/unauthorized person, shall not be allowed on the site at any time without the written permission from NABARD/ Consultant.

vii) NABARD and his consultants, if any, will visit the site at intervals appropriate to the stage of construction and warranted by the Construction schedule to familiarize themselves with the quality of the work and to determine in general if the work is proceeding in accordance with the drawings and specifications.

viii) The Architect will check and monitor the schedule prepared by the Contractor and co-ordinate the work of all the Contractors on the Project including their use of the site. The Architect will keep the Contractor informed of the overall Project Management Schedule to enable the Contractor to plan and perform the work properly.

ix) A proposed CPM/ Bar chart for the work schedule considering the date of starting and date of completion as required by The NABARD , Bangalore should be submitted along with the tender and detailed chart shall be submitted within 7 days of communication of acceptance of tender in the MS PROJECT/ PRIMAVERA / MS Excel software’s with detailed descriptions.

x) Architect in co-ordination with NABARD, Bangalore shall be the interpreter of the requirements

of the Contract Documents and he will judge the performance there under of the Contractor.

xi) The Contractor shall prepare and submit to the Consultant comprehensive lists of the manufacturer's products proposed for the Project. Such lists shall include all information on materials, equipment and fixture as may be required for the preliminary approval of the Architect/Project Engineer.

xii) Materials to be incorporated in the work shall conform to latest relevant BIS marked goods where manufactured. No materials shall be brought by the Contractor to site unless samples are approved by the Consultant/ NABARD.

xiii) The Contractor's representative on site will record the measurement of works carried out by the Contractor in proper measurement books, preferably jointly with the Site in charge, whenever possible. The Architect shall keep the Measurement Books and Contractor may request for the same only for purpose of recording measurement.

xiv) Debris shall be periodically removed from the site. Debris/ waste materials shall be removed from the flats/Premises periodically during the progress of the work. The scrap/ waste shall not be accumulated/ dumped in the flats/ premises.

18. The Contractor should obtain approvals, if any, necessary for the work from the statutory bodies on behalf of NABARD. The Contractor shall assist PMC fully in respect of any liaison with TNEB / Municipal or any other authority for necessary approval/permission with regard to the construction / maintenance works. The fees and other statutory charges, if any, will be reimbursed to the Contractor based on the original receipts produced to NABARD.

19. The Contractor shall not directly or indirectly transfer, assign or sublet the Contract or any part of it, without written permission of NABARD.

20. Article of Agreement The Consultant has to sign the agreement as per attached “Article of Agreement” in annexure. This agreement shall be executed in duplicate and the Employer shall retain the original and the Contractor shall retain the duplicate. The Contractor shall bear the Stamp Duty on the original as well as the duplicate of this Agreement.

21. CONTRACTOR'S LIABILITY AND INSURANCE: i. Throughout the construction period, the Contractor shall take full responsibility for the care of

the work and for taking precautions to prevent loss or damage and to minimize the same to the greatest extent possible. He shall be liable for any damage or loss that may happen to the work or any part, thereof and to NABARD, Bangalore equipment and plant from any cause whatsoever and shall at his own cost repair and make good the same so that at completions of the work.

ii. The Contractor shall be responsible for all injury to the works or workmen, persons, animals

and things for all damages to the structure and that may arise from carelessness, accident or

any other cause whatsoever in any-way connected with the carrying out of the Contract, or any sub-contractor, or any of these, or sub-contractors, employees, whether such injury or damage arise from carelessness, accident or any other cause whatsoever in any way connected with the carrying out of this contract. The contractor also will be responsible for any damage to the buildings whether immediately adjacent or otherwise, and any damage to the roads, streets, foot paths or ways as well as damages caused to the buildings and works forming the subject of these contract by rain, wind or other inclemency of weather. The contractor shall indemnify the Bank and hold harmless in respect of all and any expenses arising from any such injury or damages to persons or property as aforesaid and also in respect of any claim made in respect of injury or damage under any act of compensation or damage consequent upon such claim.

iii. The contractor shall obtain an all risk insurance policy for the workmen employed by him or by his sub-contractor, from any Nationalised Insurance Company in the joint name of employer and contractor. The original policy shall be deposited with the Bank and renewed from time to time during the currency of the contract at the cost and expenses of contractor.

iv. The Contractor shall fully indemnify The NABARD, Bangalore and hold him harmless in respect

of all losses, claims and any expense arising from such injuries or damage to any person any property whatsoever which may arise out of or in consequence of carrying out the Contract and against all claims, demands, proceedings, damages, costs, charges and expenses whatsoever in respect of or in relation thereto.

v. In the event of any fire and /or earthquake the Contractor shall as soon as the claim under the

policy is settled or the work is reinstalled by the Insurance Office should they elect to do so, proceed with all due diligence with the completion of the work in the same manner as though the fire and or earthquake had not occurred and on all respects under the same conditions of the Contract. However, in case of rebuilding or reinstatement after fire and/or earthquake, the Contractor shall be entitled to such extension of time for completion as the Architect/ The NABARD, Bangalore may deem fit.

vi. The Contractor shall-ensure that similar insurance policies are taken out by his Sub-

Contractors, if any, and shall be responsible for any claims or losses to The NABARD, Bangalore resulting from their failure to obtain adequate insurance protection in connection thereof. The Contractor shall produce or cause to produce by his Sub-Contractor, if any, the relevant policies and premium receipt as and when required by the Architect/ The NABARD, Bangalore.

22. Foreclosure of contract due to abandonment or reduction in scope of work: If at any time after acceptance of the tender, the Employer decides to abandon or reduce the scope of the work for any reason whatsoever and does not require the whole or any part of the works to be carried out, the Employer shall give notice in writing to that effect to the consultant/ Contractor(s) and the consultant/ contractor(s) shall act accordingly in the matter. The consultant/ contractor shall have no claim to any payment of compensation or otherwise whatsoever, on account of any profit or advantage which he might have derived from the execution of the works in full but which he did not derive in consequence of the foreclosure of the whole or part of the works.

23. TERMINATION OF CONTRACT BY OWNER: NABARD shall without prejudice to their right to proceed against the contractor in respect of any delay or inferior workmanship or otherwise or to any claims or damage in respect of any breach of the contract and without prejudice to any rights or remedies under any of the provisions of

this contract or otherwise and whether the date for completion has or has not elapsed by giving 15days’ notice in writing absolutely terminate the contract in any of the following cases:

I. If the Contractor having been given by the Architect a notice in writing to rectify, reconstruct or replace any defective work or that the work is being performed in any inefficient or otherwise improper manpower shall omit to comply with the requirements of such notice for a period of seven days thereafter or if the contractor shall delay or suspend the execution of the work such that either in the judgment of the Architect or Bank(which shall be final and binding) he will be unable to secure completion of the work by the date of completion or he has already failed to complete the work by the date.

II. If the contractor being a company shall pass resolution or the court shall make an order that the company shall be wound up or if a receiver or a manager on behalf of a creditor shall be appointed or if circumstances shall arise which entitle the court of creditor to appoint a receiver or a manager or which entitle the court to make a winding up order.

III. If the contractor commits gross misconduct, or engages in dishonest and/or professional misbehavior.

IV. If the contractor commits breach of any of the terms and conditions of this contract.

V. Or if the contractor (whether an individual, firm or incorporated Company) shall suffer execution to be issued.

VI. Or shall suffer any payment under this contract to be attached by or on behalf of any of the creditors of the contractor.

VII. Or shall charge or encumber this contract or any payments due or which may become due to the contractor there under.

VIII. Or if the Architect shall certify in writing to The NABARD, Bangalore that the contractor has abandoned the contract or has failed to commence the works, or has without any lawful excuse under these conditions suspended the progress of the works for 14 days after receiving from the Architect written notice to proceed or has failed to proceed with the works with such due diligence and failed to make such due progress as would enable the work to be complete within the time agreed upon or has failed to remove materials from site or pull down and replace work within seven days after receiving from the Architect written notice that the said materials or work were condemned and rejected by the Architect/ The NABARD, Bangalore under these conditions or has neglected or failed persistently to observe and perform all or any of the acts, matters or things by this contract to be observed and performed by the contractor for seven days after written notice shall have given to the contractor requiring the contractor to observe or perform the same or has to the detriment of good workmanship or in defiance of the Architect’s instructions to the contrary sub-let any part of the contract.

24. EARNEST MONEY DEPOSIT (EMD): The bidder shall enclose a Demand Draft (from a scheduled commercial bank) for Rs. 26000/- (Rupees Twenty six Thousand only) drawn in favour of National Bank for Agriculture and Rural Development payable at Bengaluru towards Earnest Money Deposit (EMD). In case of successful bidder, the EMD will be retained with NABARD, the same will be refunded in three months after completion of the entire work. In case of unsuccessful bidders, the EMD will be refunded only on award of contract to the successful bidder. The EMD / SD will not bear any interest. If the bidder withdraws his tender before expiry of the validity period of the tender or if the Contractor fails to execute / complete the works satisfactorily, NABARD reserves the right to forfeit the EMD / SD. Any tender not accompanied by the EMD will be rejected.

25. RETENTION MONEY DEPOSIT (RMD)/ SECURITY DEPOSIT (SD): Five percent (5%) of the gross value of the work done and claimed in the RA Bills shall be deducted towards Retention Money

Deposit. This amount shall not bear any interest. The Security Deposit/RMD & EMD will not bear any interest and will be refunded after Defects Liability Period of 12 months from the date of Virtual Completion of works, provided the Contractor has satisfactorily carried out all the rectification works and attended to all defects to the satisfaction of NABARD.

26. All work must be completed within 45 DAYS which shall be reckoned from the 10th day of the date of issue of work order. Delay in the completion of work will attract LIQUIDATED DAMAGE @ 0.25 % of contract value per week, which may be to the maximum of 5% of the value of contract. For delay beyond control of contractor, no liquidated damage will be imposed. Contractor will submit the main reasons for the delay for consideration of Bank, in case of delay in completion of work. Extension of time will be considered on the written request by the contractor.

27. DEFECTS LIABILITY PERIOD: Twelve (12) months from the date of Virtual Completion (VCC) and actual possession of works, certified by NABARD. Warrantee for toilet cum bathroom Water proofing work shall be for 10 years from the date of Virtual Completion of work.

Warranty Period (period shall start from the day of completion of the project) Contractor shall have to provide warranty a) Against water proofing work for 10 years. b) Against any kind of defect in wooden carpentry work for a period 10 years. c) Against internal painting works for 5 years. d) Against other civil works for 12 months.

28. CERTIFICATE OF VIRTUAL COMPLETION OF WORKS: The Contractor shall report in writing to the

Employer in the form of a Certificate as per the format given at Annexure, as and when the works are completed in all respects. The Employer shall, after due verification of the works, issue to the Contractor a certificate to be called "Virtual Completion Certificate"(VCC). The defects liability period shall commence only from the date of actual possession.

29. PAYMENT OF CONTRACTOR’S BILL i. The contract is strictly on item-rate basis. The quantities as executed, measured and

accepted for payment shall be settled as per rates quoted. Rates should include all Taxes- GST, Levies, Wages as per Act, etc. as applicable and should be firm for the entire Contract period. No escalation of rates will be allowed for the entire contract period on any account.

ii. Before ordering any materials or doing any work, nevertheless the drawings provided, the Contractor shall verify the pertinent field dimensions for the project and shall be responsible for the correctness of the same.

iii. The Contractor shall be entitled under the Interim Certificates, payment against the checked R. A/ final bills for the work done not prior to 30 days from the date of issue of the work order subject to the actual work being executed in accordance with the contract, and reasonable scrutiny by Architect/ NABARD. The Contractor shall submit R.A bills only after working out the appropriate measurements jointly recorded with PMC/NABARD at site in the measurement book (MB). This is not only to regulate the correctness of the quantity but also to facilitate expeditious clearing of the bills.

iv. Bills submitted by the Contractor will be paid by NABARD after all the statutory deductions viz. RMD @ 5%, TDS and other statutory deductions etc., as applicable.

v. Retention Money Deposit at the rate of 5% (Five percent) of the value of the work executed shall be deducted from running interim bills shall constitute the Security Deposit. The Security Deposit shall be released at the end of defects liability period of 12 months from the date of Virtual Completion, provided the defects are made good according to the true intent and meaning thereof after due completion of work.

vi. Any discrepancy in settlement of RA or Final bills may be brought to Bank’s notice within seven (7) working days of date of crediting of the settled amount by NEFT to the contractor’s a/c being maintained with NABARD.

30. No advance shall be paid towards Mobilization and cost of materials.

31. The old materials viz. any steel bars if demolition of RCC works uncounted, valves, pipes and other accessories shall be carefully dismantled and removed/ disposed away before installing the new system by the contractor.

32. The agreement will be made on a non-judicial stamp paper of Rs.200/- as per the given format at

the contractors cost.

33. PROJECT COMPLETION: The work should be completed within 45 days from the 10th day of issue of work order. On successful completion of entire works covered by the contract to the full satisfaction of the Employer, the consultant shall ensure that the following works are also completed to the satisfaction of the Employer. a) Clearing the site of all scaffolding, wiring, pipes, and surplus materials by the contractor. b) Remove all rubbish, debris etc. from the site by the contractor as required by the Employer. c) All defects/imperfections have been attended and rectified as pointed out by the Employer / Bank’s Representative to the full satisfaction of Employer.

34. The contractor will clear the site by removing the debris, scaffolding and balance materials from

the site. The certification in this regard shall be taken from the ACT and shall be attached with the Final Bill.

Should this quotation be accepted, I hereby agree to execute the said work at the respective rates mentioned in the schedule of quantities and abide by terms and conditions contained in the above paras. SCOPE OF WORKS

The scope of work to be executed under the contract covers the repair, restoration and renovation works of NABARD owned Executive VOF flat No.B-104 at Raheja park Apartment, Magadi Road, Bangalore with all services, approved drawings.

1) Rehabilitation of Structural members beam and column Internal and external as directed by

PMC / NABARD / Structural Consultant. 2) Remodelling of the flat by dismantling existing infill partition walls (non- load bearing) and

construction of new infill partition walls with hollow light-weight blocks and providing for lintel as per plan and requirement.

3) Repair of existing sanitary lines and rerouting the lines by construction of new drainage chambers directly connecting to the main drainage.

4) Complete renovation of the Bathrooms including waterproofing of sunken slab, lintel beam repair, Tiling, dadoing, replacing sanitary fittings, Plumbing.

5) Repair in the Balcony and replacement of hand rails. 6) Removing the existing mosaic flooring and relaying the floor with high quality Vitrified tile

flooring. 7) Two level false ceiling. 8) Replacing the existing sheeted electrical points with new trendy modular switches. 9) Electrical wiring of the flats. 10) Dismantling the existing RCC kitchen platform and providing for pantry space as per the plan. 11) Scrapping the existing paint layer to expose the plaster surface, provide and apply putty and

apply two coats of acrylic emulsion paint of approved brand, colour and texture. 12) Replacing the existing light fixture with new trendy LED light fittings. 13) Replacing the existing ceiling fan with new trendy brand beat quality ceiling fan. 14) Replacing the existing windows, doors, Ventilator & MS grill with new aluminium framed

windows. 15) Providing and installing Plumbing and sanitary fittings 16) Diluting and injecting chemical emulsion for POST-CONSTRUCTIONAL anti-termite treatment

throughout the flat. 17) Interior decoration works including carpentry work for wardrobes, cabinets, etc. 18) Interior painting with approved acrylic emulsion for walls, veneer finish for wooden doors,

cabinets, enamel painting for grills, etc. 19) Other such renovation works as per site requirement and as given in Schedule of Quantities.

TECHNICAL SPECIFICATIONS

All Technical specifications and procedures required during execution of the work has been mentioned in the Schedule of Quantities in Price bid and as per Standards followed by CPWD confirming to IS codes and BIS. The contractor should strictly abide by these standards and maintain high standards of workmanship along with quality. ANTI-TERMITE TREATMENT GENERAL All materials supplied by the contractor shall conform to their respective Indian Standard Codes and shall be from reputed manufacturers. The contractor shall furnish test certificates for materials and obtain the approval of the Engineer in charge/Architect prior to the use of such materials in the works. The specification establishes the materials and method of accomplishing anti-termite treatment of soil or an directed by engineer in charge/Architect for protection of buildings against attack by subterranean termites with the usage of chemical emulsions in accordance with the usage of chemical emulsions in accordance with the procedure laid down. MATERIALS Emulsifiable concentrates of Aldrin (0.5%)/ Heptchlor (0.5%)/Chlordane (1%), Conforming to IS 1307/6439/2682 respectively in water emulsions shall be used for treatment of soil. TREATMENT PROCEDURE The treatment shall be carried out by an approved agency specialised in the field. Apart from this specification, the wok shall be carried out in compliance with IS: 6313. Prior to start chemical treatment, area(s) shall be made free from, stumps, timber off cuts, levelling pegs, roots of plants/trees etc. Before commencement of anti-termite treatment 12mm dia holes shall be drilled outside the external wall, between junction of wall and plinth protection at minimum 300mm internal and with chemical concentrate and filled by hand operated pressure pump until refused. Payment for anti-termite treatment shall be made on square meter basis only. The rates shall include supplying all materials, spray pumps, tools and tackles, other accessories, labour, site preparation, rodding, tamping, mixing, and spraying the specified. The Anti-termite treatment shall carry 10 years guaranteed period and the contractor shall use adequate amount of chemicals as required to sustain the 10 years guarantee. PLASTERING AND POINTING CEMENT PLASTERING Materials Cement shall be fresh and sand shall be medium quality, cleaned, free from organic matter or salts. All the materials including water shall be of standard specification. Preparation of Mortar. Materials shall be at first mixed dry thoroughly till uniform in colour in the required proportion and then shall be mixed wet adding water slowly and gradually for at least four times to give a uniform paste. So much material shall be prepared at a time as can be used within the initial setting time. Further approved water proofing compound such as FOSROC make or equivalent make etc as per manufacturer’s instruction and as directed by the Architect at correct proportions shall be used.

Preparation of Surface The surface of the wall shall be brushed, cleaned, washed, watered and wetted with water before plastering. In case of lime plaster on cement concrete the face shall be lightly roughened, cleaned, washed and wetted. To ensure uniform thickness of plaster as specified, narrow strips of about 10cm wide plaster shall be applied at a distance of 1m centres and the gaps between such strips shall immediately be filled up with mortar. Laying Plastering shall be started from the top and worked towards the ground. The whole surface shall be made flush with wooden straight edges and rubbed thoroughly with wooden floats to ensure an even surface. Rounding of corners if desired by the engineer in charge shall be carried out in one operation. Curing Plastered surface shall be kept wet by sprinkling water after 12 hrs. for at least 7 days and shall be protected from rain or storm. WATER PROOF CEMENT PAINT Rate The rate shall include all labour, materials, equipment and tools, for carrying out the working including cost of scaffolding. Preparation of Paint Water proof cement paint of “super snowcem” or approved equivalent make shall be mixed with water and stirred to obtain a thick paste, which shall then be diluted to brushable consistency. Application of Paint The surfaces treated with minimum two coats of waterproof cement paint. Not less than 24 hours shall be allowed between two coats and the subsequent coats shall be applied only after the preceding coat has become hard. Curing Curing shall be started after the paint has hardened by sprinkling with water two or three times a day. SPECIFICATION FOR WATER PROOFING WORKS 1. All WATER PROOFING work shall be got executed from specified agency or as approved by Architect as per specifications under the overall supervision of the main contractor. Rates quoted by the main contractor shall include for the water proofing treatment by approved water proofing agency with all over heads and profits. 3. Water proofing shall be required to be done at Terrace or as instructed by Architect: MODE OF MEASUREMENT: Flat area covered between inside of the parapet wall shall be measured. To this the area of the vertical surface treatment calculated by taking the inside per meter of the parapet and the height of treatment over parapet wall measured from finished horizontal treatment shall be added. In case the treatment is continued over the horizontal potion of the parapet on top, the same shall also be added to the areas calculated as above. 4, Main Building contractor shall obtain a guarantee for a period of 10 years for all the water proofing treatments from approved waterproofing contractor and shall be jointly responsible for any defects noticed in the work during the above period. Rate quoted shall include for the same.

5. All waterproofing work shall be guaranteed for Ten years in approved proforma provided elsewhere in the Tender document, acceptable to the Employer, on a stamp paper of required denomination. This guarantee will be given by approved waterproofing contractor directly to NABARD and counter singed by the main contractor and furnished to NABARD as soon as the work is virtually completed and before the final bill is settled. 6. Although the waterproofing work is guaranteed by the approved waterproofing contractor for ten years, the main building contractor shall be responsible if at any time during the defects liability period, the surfaces treated for waterproofing show leaks, wet patches, dampness or the waterproofing given way to the influence either due to the inadequacy of the work carried out or used or for any other reason whatsoever relating to materials, workmanship etc., and shall be liable, without any extra cost and inconvenience to the Employer or the occupants, to carry out the necessary remedial measured as and when required during defects liability period. 7. The contractor should include the cost of erecting scaffoldings, ladder, jhulla etc. required for painting the staircase / building both from inside and outside.

8. Care should be taken to paint switch boards, electric wiring on batten with paint similar to wall or ceiling as the case may be for which no extra payment will be made.

9. MEASUREMENTS FOR PAINTING: All measurements shall be in metric units. Length and breadth to be measured correct to a centimeter. Deductions in measurements to be regulated as follows: For Acrylic emulsion paint interior/exterior, spirit polish, synthetic enamel paint.

a. No deduction shall be made for opening less than 0.5 sqm and no addition made for jambs, sills reveals therein etc.

b. Openings exceeding 0.5 sqm. shall be deducted and jambs, soffits, sills etc. measured.

Patch Repairing: -The Patch repairs shall generally be carried out as under: a. Patches should be marked properly on the surface and all loose plaster of the cracked portion

shall be removed as directed by the Engineer. b. The surface to be patch plastered, shall be wetted thoroughly and if plain, shall be roughened up

by hacking. c. The plastering shall be done as directed. The finishing coat shall match with the adjoining

surface. The rate quoted shall include all types of finishing and no extra payment shall be admissible.

d. The cement mortar used shall be 1:6 (one part cement to six parts of sand by volume) and the work shall be done as directed by the Engineer.

e. The patches thus repaired shall be cured adequately and shall be got approved from the Engineer before proceeding further.

f. Wide cracks in plaster, if any shall be grooved as directed and should be filled by polymer modified cementitious repair mortar such as Roff Plaster coat R 03 & 05 or equivalent make, as per manufacturer specifications. No payment will be made for this operation.

g. Minor cracks in plaster due to separation of brick work from the concrete or wood work or between two masonry panels or diagonal cracks shall be grooved as directed, filled and finished with "SNOW FILLA" or mentioned in schedule of quantities specifications. The rates quoted for respective items shall be inclusive of this operation.

h. Measurement: The measurements of the patchesexceeding 0.1 sq.m. in area shall only be recorded. The patching work having 0.1 sq.m. or less in area shall not be measured and paid for.

Application of Wall Care Putty. i) The plastered surface after scrapping and patch plastering has to be brought to level by applying one coat of Birla putty MF to required thickness (not more than 3mm thickness). If more thickness is required to make the surface level in any areas, then the same has to be done in more than one coat of Birla Putty MF as per manufacturer specifications.

Then make the surface even & smooth with one or two coats of Birla Putty SF to required thickness (not more than 1.5mm thick). The unevenness on the surface maybe removed by gently levelling the surface with very fine water proof emery paper, not less than 500 number, to get a glossy white surface. The surface should be brought to proper line and level to such an extent that no undulations could be visible and all the edges and corners should be finished very sharp to look like a narrow hair line. Dining Platform:

1. The locally available best quality mirror polished granite slabs (maximum 3 pieces) of approved shade will be provided and fixed by pasting the same to the top surface of the counter(top surface of the RCC slab) using approved quality and make synthetic resin adhesive

2. Openings /holes of appropriate dimensions shall be provided on the slab to insert SS sink

and for hose pipe from LPG cylinder.

3. All exposed surfaces shall be shaped to the approved profile and polished to get the same finish of the top surface. The edge of the platform is to be moulded to full round with smooth finish. The granite skirting an the top boarder should be of locally available best quality granite of approved shade to match with the granite counter top

Fixing of Granites and vitrified tiles on floors: The old marble mosaic tiles from the floor and dado area, the cuddapah stone slab from the staircase tread & landing area should be removed completely without damaging the base concrete. If any damage occurs to the concrete, it has to be made good with fresh cement concrete and the surface had to be brought to level. After cleaning the surface, a semi-viscous cement slurry layer has to be spread over the base concrete, which will act as a bond coat for the new tile / granite base course. The rich cement mortar of 1:4 of workable mix shall be spread over the cement slurry applied floor to receive the vitrified tiles / granite slabs. The same shall be fixed properly to line, level and slope with tapping with light weight hammer on all over the body of the granite slab / vitrified tiles. There should not be any entrapped air below the tiles / slab. After fixing of the slab / tile, there should not be any hollow sound after tapping with coin. The tile / slab joint are to be sealed with matching shade cemented pigment and cleaned properly. The staircase tread / landing granite slab should be moulded at the edges to the desired shape to mirror finished polish before fixing. The moulded edge of granite slab should be kept projected by about 5 to 10 mm from the face of the riser. Fixing of Vitrified/ Ceramic tiles on wall / dado / skirting / staircase riser/hand rails: All the old tiles from the wall / dado / skirting / staircase riser / liftdoor jamb / staircase window jamb & sill / reveal area should be removed completely without damaging the base concrete / masonry. If any damage occurs to the concrete, it has to be made good with fresh cement concrete and the surface had to be brought to level. The staircase balustrade area (staircase wooden hand rail should be removed completely and taken away without any extra cost), entrance lobby wall dado, lift lobby wall dado, head room wall dado etc. are to be scrapped completely to remove the paint / neeru up to the cement plastered surface and subsequently the plastered surface is to be chipped with hammer & chisel thoroughly to make it sufficiently rough to receive the wall tiles. After cleaning the surface, a semi-viscous cement slurry layer has to be spread over the base concrete, which will act as a bond coat for the new tile / granite base course. The rich cement mortar of 1:4 of workable mix shall be applied over the cement slurried surface to receive the vitrified tiles / granite slabs in vertical position. The same shall be fixed properly to line and level with tapping with light weight hammer on all over the body of the granite slab / vitrified tiles. There should not be any entrapped air below the tiles / slab. After fixing of the slab / tile, there should not be any hollow sound after tapping with coin. The tile / slab joint are to be sealed with matching shade cemented

pigment and cleaned properly. The lift collapsible gate side granite slab and any such other place, where semi-circular shape moulding is advised, should be done before fixing to them in position. The moulded edge of granite slab should be kept projected by about 15 to 20 mm from the plane face. The edge of the vitrified tile / granite slab should be properly filled up with cementitious material with matching pigment or with white cement and evenly finished from top. While fixing granite in the handrail portions, baby metal chips fixed to the granite using chemicals such as Aerolite has to be provided for more bonding, as directed by the Engineer. The work of scaffolding shall be deemed to be the part of the work of respective items under schedule and no extra payment in this regard under any circumstance shall be admissible. The scaffolding thus erected shall have to be got approved from the Engineer or his representative before commencing the work or actual painting. However, it should be noted that approval from the Engineer shall not relieve the Contractor of his responsibility and any damage to the property or any loss of life due to the negligence on this regard shall be at the Contractor's account. Polymer Modified Cement Mortar and Anti corrosive coating. i) Break open the loose and damaged concrete. Remove loose rust from reinforcement by light tapping or hammering. Apply rust removing chemical such as Rusticide of M/s Sunanda / Dr. Fixit or other equivalent make on exposed surfaces of reinforcement. After 24 hours, wipe the reinforcement with cotton cloth and apply passivator coating using PolyalkFixoprime of Sunanda make (or equivalent material from Dr. Fixit or any other approved brand) and cement slurry in the weight ratio 1:1.25 on the exposed surfaces of reinforcement. ii) After 24 hours, apply first coat of bonding layer with Sunanda make Polyalk EP / other equivalent product as approved, Cement slurry in the proportion 1 : 0.5 by weight to concrete area. iii) Before drying the bonding coat, place polymer modified cement mortar with Polyalk EP of Sunanda or other equivalent approved make in the ratio 1 Kg (Polyalk EP) : 5kg(Cement) : 15 kg(Quartz Sand) with controlled water @ 1 litre. Level the surface with trowel and finish the surface. SAMPLES FOR APPROVAL Contractor, before supply of material should show the samples of all the materials to the bank and get it approved.

Quality Control: a. Quality Consciousness: The contractor should make himself aware of the quality standards set

by the Architect/The NABARD, Bangalore and employ staff who have sufficient experience in handling high quality construction and who can team up with the Architect and The NABARD, Bangalore to bring out excellent results.

b. Quality tests and expenses: The contractor should ensure quality of materials and workmanship

by producing test reports by approved agencies as and when asked by the Architect/The NABARD, Bangalore for any part of the work. The cost of such tests shall be borne by the contractor.

c. Quality Assurance: Any part of the work found defective with respect to the drawings or

specifications in the opinion of the Architect/The NABARD, Bangalore shall be demolished/removed by the contractor at his cost and risk.

d. Quality acceptance: The NABARD, Bangalore reserves the right to hold the payments of bills of

any stage in part or full if the quality of work done at that stage is not acceptable by the Architect/The NABARD , Bangalore.

e. The contractor shall arrange for testing of major constructions materials such as cement, steel,

pipes to be used in the project from a Govt. Engineering College if required at their cost and submit such test reports/results to the Bank/Architects.

SAFETY CODE The Contractor shall maintain in a readily accessible place first aid appliances including adequate

supply of sterilized dressings and cotton wool. An injured person shall be taken to a public hospital without loss of time, in cases where the

injury necessitates hospitalization. No portable single ladder shall be over 8 metres in length. The width between the side rails shall

not be less than 30 cm. Clear and the distance between two adjacent rungs shall not be more than 30 cm. When a ladder is used an extra mazdoor shall be engaged for holding the ladder.

Every opening in the floor of a building or in a working platform be provided with suitable means

to prevent the fall of persons or materials by providing suitable fencing or railing or safety net whose minimum height shall be one metre.

Workers employed on mixing and handling material such as asphalt, cement, mortar, welding works shall be provided with protective footwear rubber hand gloves and protective goggles.

Hoisting machine and tackle used in the works, including their attachments, anchorage and supports shall be in perfect condition. The Employer reserves the right to instruct the Contractors to take additional safety precautions if found necessary.

All workers shall be provided with helmet, Safety Shoes and Safety belts. I/We accept to abide by the above Safety code to be enforced at site during work.

ARTICLES OF AGREEMENT

ARTICLES OF AGREEMENT made this _____________ day of __________ between the National Bank for Agriculture and Rural Development (NABARD), Karnataka Regional Office, Bangalore (hereinafter called “the Employer”) and having its Head Office at C-24, G-Block, Bandra Kurla Complex, Bandra (E), Mumbai – 400051 of the one part and M/s -------------------------------------------------------- (herein after called "the Contractor") having its office at ----------------------------------------------------------------------------------- of the other part.

WHEREAS the Employer is desirous of getting executed the work of “Renovation of Executive VOF flat No. B-104 at NABARD Officers Quarters, Raheja Park Apartment, Magadi Road, Bengaluru” and has caused the technical and price bids showing and describing the work to be done under the direction of the Employer.

AND WHEREAS the said terms and conditions have been signed by or on behalf of the parties hereto.

AND WHEREAS the Tenderer has agreed to execute upon and subject to the conditions set forth in the technical &Price Bids and Terms & Conditions of Contract (all of which are collectively hereinafter referred to as “the said Conditions”) the work shown upon the said technical specifications, and included in the Price Bid at the respective rates therein set forth amounting the sum as therein arrived or such other sum as shall become payable there under (hereinafter referred to as “the said contract amount”).

NOW IT IS HEREBY AGREED AS FOLLOWS:-

1. In consideration hereinafter mentioned, the Contractor will upon and subject to the conditions annexed, carry out and complete the works shown in the contract, described by or referred to in the Schedule of Quantities, Scope of Works and in the said terms and conditions.

2. The Employer shall pay the Contractor the said fee / amount or such sum as shall become payable at the times and in the manner specified in the said conditions.

3. The said Conditions and Appendix thereto and the documents attached hereto shall be read and construed as forming part of this Agreement and the parties hereto shall be respectively abide by, submit themselves to the said Conditions and the correspondence and perform the agreements on their part respectively in the said conditions and the documents contained herein.

4. This Agreement and documents mentioned herein shall form the basis of this contract.

5. The Contractor shall afford every reasonable facility for execution of the said work.

6. This contract is an item rate contract for carrying out the work of “Internal and External renovation of VOF flat No. B-104 in NABARD officer quarters at Raheja Park Apartment, Magadi Road, Bengaluru” and to be paid for according to actual measured quantities at the rates contained in the Schedule of Rates and probable quantities or as provided in the said conditions.

7. Time shall be considered as the essence of this contract, and the Tenderer hereby agrees to complete the entire work 3 months from the 10th day of the date of issue of work order, subject nevertheless to the provision for extension of time as permissible by the Employer.

8. All payments by the Employer under this contract will be made only at Bangalore.

9. All disputes arising out of or in any way connected with this agreement shall be deemed to have arisen at Bangalore and only Courts in Bangalore shall have the jurisdiction to determine the same to the exclusion of all other courts.

The contractor shall not have any right to claim loss of profit / loss of opportunity to work from the Employer.

WHEREAS THIS AGREEMENT is supplementary to a contract (hereinafter called the contractor dated ______and made between the Employer of the one part and the Guarantor of the other part) whereby the Firm/Contractor inter alia undertook to render the waterproofing work of toilet sunken slab of VOF B-104. And whereas the Guarantors agreed to give guarantee to the effect that the said building/Terrace shall remain free from Leakage/Seepage of water for a period of Ten years (10 YEARS) from the date of completion of waterproofing works carried out as per the relevant I. S. Code. Now the Guarantor hereby agrees to make good all defects observed if any in the waterproofing work, during this period of guarantee and to the satisfaction of the Employer. The Guarantor also agrees to take up such rectification work at his own cost, and within one week from the date of issue of notice from the Employer, calling upon him to rectify the defects. The decision of the employer as to the cost payable by the Guarantor will be final and binding, in case the Guarantor fails to commence the work as per above notice and the work is got done through some other contractor. That if the Guarantor fails to execute the waterproofing work or commits breach there under then the Guarantor will indemnify the principal and his successor against all loss, damage caused, expense or otherwise which may be incurred by him by any reason of any default on the part of the Guarantor in performance and observance of this agreement. As to the amount of loss and/or damage and/or cost incurred by the Employer the decision of the Employer will be final and binding.
