The Agency •  The Danish Agency for Labour Market and Recruitment – a new

agency from 1st January 2014

•  Two divisions handling applications for residence permit –  Labour Immigration Service –  Student Immigration Service

Biometric residence cards •  You must appear in person to have your biometric features (a facial

photo, fingerprints and electronic signature) recorded every time you submit an application

•  Where? - your local police station or at our Citizen Centre in Njalsgade 72 C, 2300 Copenhagen

•  Biometrics must be recorded by the latest 14 days after applying for a permit

The Greencard Scheme

•  GR1 form – current fee is DKK 6.485 •  The applicant must obtain at least 100 points •  Points are given for: educational level, language skills, work

experience, adaptability and age •  Most points are awarded for educational level: for a PhD you get 80

points and for a master degree you get 60 points

The residence permit is issued for 3 years for the purpose of seeking work, and subsequently working, in Denmark

Based on an individual assessment using a grading system

designed to assess the likelihood that the applicant will be able to find qualified work in Denmark

Greencard Conditions: Self support •  You must be able to support yourself during your first year in

Denmark •  Documentation can be a bank statement showing your name,

recent date, currency and the required amount •  The amounts can be found at www.newtodenmark.dk •  If you apply for an accompanying family member you must also

show that you can support this person

Greencard Educational Documents •  A basic requirement is that you as a minimum have the equivalent of

a Danish bachelor’s degree or a corresponding medium length degree

•  We ask The Danish Agency for Higher Education for an assessment of your educational level if you have a foreign degree. This is done as academic degrees vary from country to country, even if they are called the same

•  If you have obtained your degree in Denmark your educational documents will not be assessed by The Danish Agency for Higher Education. This shortens the processing time considerably (30 days)

Greencard Extension of your residence permit •  If you have worked for 12 consecutive months for a minimum of ten

hours per week at the time the decision to extend is reached or •  If you become involuntarily unemployed no more than 3 months

before applying for an extension and prior to this have worked for 12 consecutive months for a minimum of ten hours per week

The Pay Limit Scheme Conditions •  A gross annual pay of no less than DKK 375.000

•  This amount is an absolute minimum which must be met even if you take unpaid holiday during your employment

Duration •  Corresponds to the employment period + six months job seekers permit •  A maximum duration, however, of 4 years the first time you apply •  During the job seekers period, you are not allowed to work. If you

however find a new job, you can begin your new job as soon as you have applied for a new residence and work permit

If you change job •  New permit or extension? •  When are you allowed to start working before you have been

granted the residence permit?

Wait to defend •  If you are an employed PhD, you can apply for a residence permit

covering the time period from handing in your dissertation until defending it (max. 4 months). Use application form XG1

•  Not entitled to work à documentation of self support

•  Documentation of when you are defending your dissertation •  Accompanying family members must apply for a new residence

permit

Accompanying family member •  A residence permit as an accompanying family member:

–  Gives you the right to work and study in Denmark –  You must live at a joint address with the main applicant (i.e. your

spouse or parent)

Family member •  When holding a residence permit as an accompanying family

member: –  You are not allowed to receive public assistance under the terms

of the Active Social Policy Act (fx “kontanthjælp”) –  If your sponsor is here as a research trainee or on a “wait to

defend”-permit he or she must document that they can support you (DKK 2.100 per month per person)

Family member •  Children born in Denmark or outside Denmark

Ø An application (FA8) must be submitted regardless of where the child is born

Ø A copy of the child’s passport and birth certificate must be enclosed

Ø A fee of DKK 2.095 (2014 level) must be paid and the receipt of the paid fee must be enclosed the application

Family member Biometric features –  As the child is living with his or her parents, the child is

exempted for carrying proof of the residence permit. –  Should the child need proof of his or her right to reside in

Denmark in connection with travel, biometric features must be obtained in order to issue a residence card for the child.

Family member •  For children born in Denmark of parents holding permanent

residence permits:

–  You can chose to apply for a permit as an accompanying family member through our Agency

•  You must pay a fee

–  Or you can chose to apply for family reunification through the Danish Immigration Service. The application form FA7 must be used.

•  You do not have to pay a fee

Lapse of residence permit

•  Your permit lapses automatically if you give up your residence in Denmark:

- sell your house,

- deregister your address with the CPR-registry.

•  Your permit lapses automatically if you stay outside of Denmark for more than 6/12 months

If  you  leave  Denmark  for  an  extended  period  of  Fme,  or  if  you  no  longer  maintain  a  residence  in  Denmark,  your  residence  permit  

can  lapse

Lapse of residence permit You can apply for dispensation to prevent your permit from lapsing, if your stay outside Denmark is with a specific purpose:

- work - education - maternity/paternity leave - taking care of ill family

•  Duration: maximum 3 years •  Family members can also apply •  Use application form BF1

Extension of residence permit •  An application for extension of your residence permit must always

be submitted before your current residence permit expires and earliest two months before

•  Right to continue to work og study while we process the application

(service goal of three months) •  If you have to travel, you can apply for a re-entry permit at the police

station
