The Fertiliser Association of India Western and Southern Region Training Programme (Virtual) on Fertiliser (Control) Order ProvisionsDate : 23 rd August 2021 (Monday) Time : 9.00 AM to 5.00 PM. BRIEF BACKGROUND To ensure adequate availability of right quality of fertilizers at right place, right time and at right price to farmers, the Fertiliser was declared as an Essential Commodity and Fertiliser Control Order (FCO) was promulgated in 1957 under Section 3 of Essential Commodities Act,1955. FCO regulate manufacturing and import of fertilisers (Inorganic, organic and Bio Fertilisers etc.) their distribution, trading, price, quality in the country. The FCO provides for compulsory registration of fertiliser manufacturers, importers and traders, Notifies the specification of all fertilizers manufactured/imported and sold in the country, regulate the manufacture of fertilizer mixtures, packing and marking on the fertilizer bags, appointment of enforcement agencies, setting up of quality control laboratories and prohibition on manufacture/import and sale of non-standard/spurious/adulterated fertilizers etc. Fertilizer Quality Control Laboratories have been established in the Country both under Central and State government jurisdiction. Under Central Government Central Fertiliser Quality Control &Training Institute (CFQC&TI), Faridabad and its three Regional Fertiliser Control Laboratories (RFCL) at Chennai, Mumbai and Kalyani (Near Kolkata) were established. Training programmes were regularly organised by these central government training institutes for updating the knowledge of the enforcement officials of the state agriculture department. Any violation/misappropriation of the rules specified under FCO will be viewed very seriously and the enforcing authorities are empowered to cancel the manufacturing licenses/authorization letter/registration certificates issued to manufacturer/importers/dealers and mixture manufacturers. In addition imprisonment orders can be issued ranging for the period from 3 months to 7 years along with fine for the offenders under ECA. The FCO offence has also been declared as cognizable. The enforcement of this Order has primarily been entrusted to State Governments. The Central Government provides training facilities and technical guidance to States and supplements their efforts through random inspection of manufacturing units and their distribution network through the Inspectors. From 1957 to 1985, nearly seventy amendments were made in the order. This led to the overall review of the various provisions of the order and in supersession of 1957 order a comprehensive revised order was issued with effect from September 25, 1985 known as The Fertiliser (Control) Order 1985. NEED FOR TRAINING

Managers and officers working in the fertiliser manufacturing units, Legal department, Marketing and

Quality Control Divisions, Importers must know and understand the basic aspects of FCO to avoid legal

complications arising out of non compliance of the provisions in the order. Ignorance of any law cannot

constitute an excuse. We are not permitted to plead ignorance as a defense to escape the rigors of law.
