THE CONSTITUTION

EXPIRY OF THE TERM OF THE ELEVENTH PARLIAMENT

WHEREAS, Article 101 (1) of the Constitution provides that a general election of Members of Parliament shall be held on the second Tuesday in August in every fifth year;

WHEREAS, vide Gazette Notice No. 2693 of 17th March, 2017, the Chairperson of the Independent Electoral and Boundaries Commission gave a notification that the general election of Members of Parliament shall be held on 8th August, 2017;

AND WHEREAS, Article 102(1) of the Constitution provides that the term of each House of Parliament expires on the date of the next general election;

NOW THEREFORE, it is notified for general information that the term of the National Assembly shall expire on the 8th of August, 2017, being the date of the 2017 general elections.

APPOINTMENT

IT IS NOTIFIED for the general information of the public that the Cabinet Secretary for Energy and Petroleum, in exercise of the powers conferred by sections 5 (1), 5 (3) (b), 5 (3) (c) and 5 (3) (d) of the Petroleum (Exploration and Production) Act, and for the purposes of realizing the objective of Kenya Vision 2030 to fast track the commercial development of oil discoveries in Block 10BB and Block 13T to achieve Full Field Development and the development of a crude oil export pipeline, appoints a committee to be known as the First Oil Technical and Commercial Working Committee consisting of the following—

1. The mandate of the Committee shall be to—

(a) negotiate the First Oil Technical and Commercial agreements between the Government and the contractors in order to secure the Government‘s interest by obtaining the most favourable conditions for the Government;

(b) undertake such research and consultations, including consultations with Government-appointed advisors, as the Committee considers necessary before finalising the First Oil Technical and Commercial agreements;

(c) advise the Government on, and draft any, enabling policy, or statutory, regulatory or institutional framework, in relation to oil and gas exploration, development and production, and approve a roadmap for the First Oil Development phases;

(d) review, negotiate and oversee the implementation of the First Oil Technical and Commercial agreements between the Government and the contactors;

(e) advise, in consultation with relevant Government agencies, on a land access framework that provides secure long term access to land for the First Oil Development;

(f) review and submit, once in every three months, reports on the progress and work done in respect of First Oil Development to the Cabinet Secretary and Principal Secretary; and

(g) perform any other function related to the Full Field Development and First Oil Development as may be directed by the Cabinet Secretary.

2. In undertaking its mandate, the Committee may—

(a) hold such meetings as may be required in relation to the development of the First Oil Project;

(b) negotiate on behalf of the Cabinet Secretary and the Principal Secretary in relation to the development of the First Oil Project;

(c) review and draft documents, and advise the Cabinet Secretary and Principal Secretary in relation to the development of the First Oil Project;

(d) prepare and submit quarterly and annual reports in such form as the Cabinet Secretary may direct;

(e) invite appointed external experts to review and advise on any commercial or technical issues related to the development of the First Oil Project;

(f) make recommendations that are relevant in advancing the commercial and technical activities leading to the development of the First Oil Project; and

(g) require, through the Principal Secretary, the production by any relevant person of any information or document in relation to the development of the First Oil Project.

3. The Committee shall establish a secretariat which shall comprise of the members of the Committee and shall be responsible for preparing the reports of the Committee and for documenting the proceedings of the Committee.

4. The Committee shall carry out its mandate in consultation with the Principal Secretary and shall be answerable to the Cabinet Secretary.

THE WATER ACT

COAST WATER SERVICES BOARD

APPROVED TARIFF STRUCTURE FOR THE PERIOD 2017/18 TO 2019/20

The Coast Water Services Board applied to the Water Services Regulatory Board (WASREB) for a review of tariffs for the Coast Water Bulk Supply, for the period 2017/18 to 2019/20 as per section 72 (1) b of the Water Act 2016.

A public consultation meeting on the application was held on 12th May, 2017 at the Kenya School of Government, and a report submitted to WASREB in accordance to the requirements of section 139 of the Water Act, 2016. In response to a call for comments published on 26th May, 2017 by WASREB, and with a closing date of 28th June, 2017, no submissions were received on the application.

After considering the application, the written and oral submissions by all stakeholders during the consultation period, and based on latest available data, WASREB has determined a downward tariff review for the Coast water Bulk Supply is justified in order to improve service delivery at both the Bulk supply and the utilities in the coast region, operate sustainably and protect consumer interests by meeting the tariff conditions outlined below.

WASREB gives a one (1) month‘s notice to all existing and potential customers of Coast water Bulk Supply that the approved tariffs for the three financial years, 2017/18, 2018/19 and 2019/20 shall be as follows:

3.0 Conditions attached to the tariff approval.

The conditions attached to this approval which shall form part of the license conditions of the Coast Water Services Board are:

(i) Strengthen the bulk water unit to operate as an autonomous cost centre with the following competencies.

(a) Organization structure with job description and job specification. The top level offices to comprise the Managing Director Office, Technical Department, Planning, Finance and Commercial Department and Human Resources and Administration. The holder of the offices will be recruited competitively and meet the criteria for relevant university degree and membership of a professional body. (a) Separation and ring-fencing of the bulk water sales in order to safeguard the bulk water supply system. Thus all billing, revenue collection activities and expenditure will be undertaken at the unit.

(b) Branding of the unit complete with own logo reflecting its central role in bulk water supply within the coast region.

(c) Bulk meters shall be placed at all off take points to all the WSPs/ licensed community water projects and the readings shall be shared with the Regulator and the WSPs on a quarterly basis.

(d) All other off takes on the bulk lines shall be documented and shared with the regulator. Meters hall be installed at all these off takes these shall be billed to CWSB and deemed to be part of the Corporate Social responsibility of the CWSB and reported as such to give an accurate picture of the current bulk operations. The report of these off takes shall be shared with the regulator on quarterly basis.

(e) Water quality of the water supplied shall be as per the acceptable standards in the Coast Water Services Board licence conditions and the report of water quality from the bulk supply shall be submitted to the Regulator as per the Water Quality and Effluent Monitoring Guideline.

(f) Total breakdowns and blowouts in the bulk system shall be reported to regulator on a quarterly basis _taking into account that the occurrences of this problem leads to the non compliance by the WSPs with the acceptable benchmarks in schedule D1 of the SPA in interruption of water supply and acceptable service hours.

(g) The Incomes and Expenditures of the bulk cost centre shall be administered in such a manner by the Manager-in-Charge that it will expedite the smooth running of operations without undue interference from the other operations of the licensee.

(i) The bulk water operations meet the abstraction fees to WARMA.

(ii) The balance as at 31st March, 2017 was KSh. 151,354,836.73 .This should not be passed on to the agents (WSPs).

TAVEVO WATER AND SEWERAGE COMPANY LIMITED


TAVEVO Water and Sewerage Company Limited (TAVEVO) applied to the Water Services Regulatory Board (WASREB) for a review of tariffs for water services, for the period 2017/18 to 2019/20 as per section 72 (1) (b) of the Water Act, 2016.

A public consultation meeting on the TAVEVO application was held on 22nd May, 2017 at the Mwatate CDF hall, and a report submitted to WASREB in accordance to the requirements of section 139 of the Water Act, 2016. In response to a call for comments published on 26th May, 2017 by WASREB, and with a closing date of 28th June, 2017, no submissions were received on the application.

After considering the application, the written and oral submissions by all stakeholders during the consultation period, and based on latest available data, WASREB has determined an upward tariff review for TAVEVO is justified in order to improve service delivery, operate sustainably and protect consumer interests by meeting the tariff conditions outlined below.

WASREB gives a one (1) month‘s notice to all existing and potential customers of TAVEVO that the approved tariffs for the three financial years, 2017/18, 2018/19 and 2019/20 shall be as follows:

4. Conditions attached to the Approved Tariff

The proponent, Aquila Properties Limited, is proposing to develop a block of apartments on plot L.R. No. 209/18650 Chiromo Road, Nairobi City County. The project constitutes of one block apartments having 18 No. floors each having 10 No. residential units. Additionally, there is the ground floor, 4 level parking decks, and 4 level basement floors. The ground floor will be connected to Arboretum Road by a proposed bridge across Mathare River. The roof plan will consist of six water tanks and two stores. The development will comprise a total of 180 units.

The proponent, Sunraj Tech (K) Limited, is proposing to install a pyrolysis plant on a vacant plot located in an industrial zoned area. The proposed site is secured within a perimeter wall and has access to other bulk infrastructure including water and electricity supply. The project main components include a shed to house the tyre pyrolysis machine, waste tyre storage shed, parking area, an office block of ground floor level, soak pit and septic for disposal of sewage. The site neighbors have undeveloped parcels of lands and a few establishments involving themselves in storage and transportation of cargos such as coal and clinker

Specify locations for trailers and equipment, and areas of the site which should be kept free or traffic equipment, and storage.

Ensure that damaged or wasted construction materials including cabinets, doors, plumbing and lighting

fixtures, marbles and glass will be recovered for refurbishing and use in other projects.

Use of durable, long-lasting materials that will not need to be replaced as often, thereby reducing the amount of construction waste generated over time.
