ESTABLISHMENT OF GOVERNANCE STRUCTURE FOR HUDUMA KENYA SERVICE DELIVERY PROGRAMME

IT IS NOTIFIED for the general information of the public that the President and Commander-in-Chief of the Kenya Defence Forces, has established the following governance structure for the implementation of the Huduma Kenya Service Delivery Programme in Government—

1. The Service Delivery Summit:

The Service Delivery Summit shall consist of—

H.E. the President of the Republic of Kenya - (Chairperson)

Members:

Cabinet Secretary, Ministry of Interior and Co-ordination of National Government

Cabinet Secretary, Ministry of Information, Communication and Technology;

Cabinet Secretary, the National Treasury;

Cabinet Secretary, Ministry of Land, Housing and Urban Development;

Cabinet Secretary, Ministry of Industrialization and Enterprise Development;

Cabinet Secretary, Ministry of Education;

Cabinet Secretary, Ministry of Labour, Social Security and Services;

Cabinet Secretary, Ministry of Health; and

The Attorney-General.

Cabinet Secretary, Ministry of Devolution and Planning

2. Functions of the Service Delivery Summit:

(1) The Service Delivery Summit shall be responsible for developing the vision and overall policy for the transformation of the public service delivery.

(2) In the performance of its functions, the Summit shall–

(a) provide the vision and overall policy direction and priorities for the Huduma Kenya Service Delivery Programme;

(b) ensure commitment at the highest level of Government to the Huduma Kenya Service Delivery Programme;

(c) review the progress and address high level challenges of the Huduma Kenya Service Delivery Programme; and

(d) approve the necessary policy, legislation, regulatory and institutional frameworks for successful implementation of the Huduma Kenya Service Delivery Programme.

3. The Service Delivery Summit shall meet at least twice in each year at such a place as it shall consider appropriate.

4. The Service Delivery Summit may co-opt such persons from such institutions as it considers necessary for the performance of its functions.

5. The Technical Committee

The Technical Committee shall consist of the –

Cabinet Secretary, Ministry of Devolution and Planning (Chairperson);

Cabinet Secretary, Ministry of Interior and Co-ordination of National Government (Alternate Chairperson);

Principal Secretary, Department of Interior;

Principal Secretary, Ministry of Information, Communication and Technology;

Principal Secretary, the National Treasury;

Principal Secretary, Ministry of Land, Housing and Urban Development;

Principal Secretary, Ministry of Industrialization and Enterprise Development;

Principal Secretary, Department of Education;

Principal Secretary, Ministry of Health;

Principal Secretary, Ministry of Labour, Social Security and Services;

Solicitor-General, Office of the Attorney-General; and

Principal Administrative Secretary, Directorate of Public Service Management.

6. Functions of the Technical Committee:

(1) The Technical Committee shall be responsible for the co-ordination and implementation of the Huduma Kenya Service Delivery Programme including the sourcing and development of relevant management information systems and information communication and technology infrastructure.

(2) In the performance of its functions, the Techinical Committee shall—

(a) develop policy, legislative and any other recommendations on the implementation of the Huduma Kenya Service Delivery Programme for the approval of the Summit;

(b) approve the establishment of all Huduma Kenya service delivery channels including online and mobile portals, management information systems, information, communication and technology infrastructure, equipment and the physical Huduma centres;

(c) review enabling policy, legal and institutional framework to support the implementation of the Huduma Kenya service delivery initiatives in the Government;

(d) develop service delivery standards and regulations for the Huduma Kenya Service Delivery Programme;

(e) implement the business process re-engineering and automation of processes for service delivery within their Ministries or agencies;

(f) implement the decisions of the Service Delivery Summit;

(g) provide content and data within the respective MDA custody for Huduma Kenya platforms;

(h) develop, codify, market and export intellectual property created or acquired in public service delivery innovation;

(i) promote private sector participation, especially youth enterprises in provision of public services through digital villages, call centres and biashara agencies;

(j) submit quarterly progress reports to the Service Delivery Summit on the development and implementation of the Huduma Kenya Service Delivery Programme;

(k) source, commit and deploy financial, human and other resources necessary for the implementation of the Huduma Kenya Service Delivery Programme;

(l) commission research and development and liaise with entities within and outside Kenya for the improvement of integrated service delivery in Government;

(m) ensure commitment at the highest levels of Government to the Huduma Kenya integrated service delivery programme;

(n) make recommendations for policy decisions on the implementation of the Huduma Kenya integrated service delivery programme to the Service Delivery Summit; and

(o) perform such other duties as may be conferred on the Committee from time to time.

7. The Technical Committee shall hold such number of meetings at such a place as it shall consider appropriate.

8. The Technical committee may co-opt such persons from designated institutions as it considers necessary for the performance of its functions.

9. Huduma Kenya Secretariat:

The Huduma Kenya Secretariat shall consist of—

(a) a secretary; and

(b) such other persons as may be necessary for the performance of the functions of the Secretariat.

The members of the Secretariat shall be appointed by the Cabinet Secretary, Ministry of Devolution and Planning from the public and private sector.

10. Functions of the Huduma Kenya Secretariat

The Secretariat shall be responsible for –

(a) the day to day implementation of the Huduma Kenya Service Delivery programme;

(b) the implementation of the decisions of the Technical Committee;

(c) the management and co-ordination of the operations, staff, finances and physical facilities to support the Huduma Kenya Service Delivery Programme including the Huduma Centres;

(d) the preparation of implementation plans and quarterly reports ;

(e) monitoring and evaluating the performance of the Huduma Centres and other Huduma Kenya channels;

(f) the general administration of the Secretariat; and

(g) undertaking any other functions as may be directed by the technical Committee.

The Water Services Regulatory Board has pursuant to Section 73 (5) of the Water Act, 2002 approved a Regular Tariff increase for water and sewerage tariffs for Kericho Water and Sanitation Company (KEWASCO).

Since the WSP has attained the monthly turnover threshold of Kshs. 10 million, LVSWSB shall ensure that a tariff study is conducted during the tariff period and submit a new a RTA application, at least six months before the expiry of the new tariff structure, based on the findings of the study and the information from their billing system.

KENYA NATIONAL ASSURANCE COMPANY (2001) LIMITED

NOTICE TO LIFE ASSURANCE POLICYHOLDERS OF KENYA NATIONAL

ASSURANCE COMPANY LIMITED (IN LIQUIDATION)

1. In 2002, the High Court authorized the Official Receiver and Liquidator of Kenya National Assurance Company Limited (in liquidation) to transfer all the Assets and Actuarial Liabilities of the Life Fund of Kenya National Assurance Company Limited (in liquidation) to Kenya National Assurance Company (2001) Limited for the purpose of payment of all unpaid Life Assurance Claims of the policyholders. Up to date, the new company has settled 90% of the value of all the claims transferred by the Liquidator.

2. Pursuant to the enactment of the Unclaimed Financial Assets Act

of 2011 on the 16th December, 2011, Kenya National Assurance Company (2001) Limited is required by Section 7 of the Act to deliver to the Unclaimed Financial Assets Authority any funds held under Life or Endowment Insurance Policy or Annuity Contract that has matured and remained unclaimed/unpaid for more than two years after the benefits became due and payable.

We would like to inform all the Life Assurance Policyholders of the former Kenya National Assurance Company Limited (in liquidation) that unclaimed policy benefits which have been outstanding for a period of more than 2 years will be transferred to the Unclaimed Financial Assets Authority who will continue with payment of the benefits to the claimants.

3. In compliance with Section 19(3) of the Unclaimed Financial Assets Act, 2011. All policyholders with ordinary life, Group Life, Retirement Benefits Schemes and Annuities are requested to lodge their claims with the company for payment if they have not done so already. Claimants are required to provide the following documents to facilitate payment:-

(i) Proof of ownership in the form of original policy documents

(ii) Copy of national identity card/passport

(iii) Last pay slips showing last date of premium payment

(iv) Any other form of evidence of last premium payment

(v) Affidavit for change of name and loss of original policy document

(vi) Death certificate if the policyholder is dead

(vii) Grant of letters of administration where no nominee is specified

4. If we do not hear from you within 60 days from the date of this notice, we shall, incompliance with the aforementioned Act, remit the unpaid amount to the Unclaimed Financial Assets Authority by 30th June, 2014. Any claim for the unpaid benefits after 30th June, 2014 should be lodged with the unclaimed Financial Assets Authority.

POWERLINE PROJECT

INVITATION OF PUBLIC COMMENTS

PURSUANT to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.

The Proponent (Kwale International Sugar Company Ltd) in collaboration with KPLC is proposing to construct a 19km 132kV electricity transmission line from Base Titanium Ltd to Ramisi in

Kwale County.

The project activities shall include the valuation and compensation of property falling within the Right of Way (ROW), land acquisition where applicable, clearing of trees and vegetation above 7m in the ROW, creation of temporary access roads, construction of tower pads, erection of pylons and stringing of conductors from the source to the terminal point.

Construction of power line will comprise of electrical conductors supported on 24-27 metre high pylons constructed of stainless steel metal; steel towers (pylons) comprising both angle towers and line towers for purposes of mounting the conductors on which the 132kV power supply will be transmitted.

The following are the anticipated impacts and proposed mitigation measures:

To prevent erosion by constructing adequate drainage works.

The towers will be placed so as to leave a buffer zone of 15m where they might be crossing rivers and stream, and span 5 m when crossing any drainage channels.

Natural vegetation

Clearing the vegetation manually is recommended to minimize environmental impact with no burning of the cleared vegetation.

Land excavation and access roads

Use of heavy machinery and vehicles will be restricted to the designated work areas.

Areas sensitive to erosion will be installed with soil protection works.

Rehabilitation of temporary access roads and using existing roads/tracks will be used for access to minimize the number of new roads required.

People falling into dug holes

The tower holes, and dug holes will be covered immediately after digging to avoid people falling in to them (especially at night).

The site should be secured with safety tapes to prevent people from falling into dug holes.

Noise and vibration

Noise generating activities will be restricted to day time hours.

The constructor shall comply with provisions of the Noise and excessive vibration regulations, 2009.

Residents along the way leave shall be notified of about the construction schedules through village liaison committees.

Fire Hazards The contractor shall prohibit burning of vegetation as a means of way leave clearance.

The contractor shall provide adequate fire fighting equipment on site.

The contractor shall provide a fire prevention and fire emergency plan to KPLC.

Solid waste management Solid wastes like metallic pieces, wooden planks and stone debris will be

disposed off as per the legislation guiding the same i.e. Waste Management Regulations.

Ambient air Restrict speed on earth roads particularly during the dry season.

Contractor to ensure friable material is covered during transportation.

All vehicles shall be maintained in good working condition.

Burning of vegetation and wood material will be prohibited.

Occupational Health and Safety

Work areas shall be restricted to authorized personnel only.

Anti-climbing barbed wire and danger signs on towers and steel towers will be installed in areas with a likelihood of scaling.

Construction crew to be supervised by a safety officer in charge of safe work procedures.

Contractor shall apply KPLC guidelines on safety and conform to provisions of the OSHA, 2007.

Community policing shall apply through local administration to prevent causes of vandalism.

Regular testing of equipment for safety.

Use of signs and barriers to keep off unauthorised persons from work sites.

Excavated areas shall be covered to prevent accidental falls.

The Proponent (Maiyan Holdings Limited) proposes to put up a

holiday home on Land Parcel No. Nanyuki/Naibor Block 1/13 (Kariunga) Situated In Nanyuki District, Laikipia County.

The holiday home will comprise: 12 Residential clusters of

averagely 6 units. The access to the cluster homes will be for residents

only, the clusters will be set on 3 acre plots with the choice of two

housing typologies of a 4-bedroomed villa of 240 M2 which can be

sold as a lower unit or upper unit of 2 bedrooms of 120 M2 each and a

complete 3bedroom unit of 185 M2.

The following are the anticipated impacts and proposed mitigation

measures:

The process will facilitate change of approximately 3096 acres from KFS (Kenya Forest Service) ownership to a public land that will be used as a settlement scheme for the current landless inhabitants.

INVITATION OF PUBLIC COMMENTS

PURSUANT to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.

The Proponent (Kenya Airports Authority) is proposing to construct a Greenfield Passenger Terminal with associated taxiways and remote parking at the Jomo Kenyatta International Airport (JKIA). Details of the project are contained in chapter 2 of the EIA Study report.

Below is a summary of the anticipated impacts and the proposed mitigation measures:

Habitat, Flora and Fauna All vegetation clearance will be undertaken with due care and attention to minimize impact on the adjacent habitat;

Destroy removed vegetation in accordance with NEMA regulations and requirements.

Resource Consumption Minimize water consumption (e.g., use ditch and groundwater to compact soils and cure concrete);

Reuse materials (e.g., stockpile structural for reuse, use nonstructural fill for landscaping, recycle asphalt);

Construction waste A minimization / collection / storage / treatment / re-use / disposal strategy for each waste stream in accordance with local requirements;

Develop, under the guidance of a qualified professional, a soil management and disposal program;

Develop safe on site storage facility that is locked, contained, away from site drainage;

Liaise with the local authorities on suitable dumping site for generated waste.

Contractors to empty holding tanks on a regular basis and dispose of in local treatment facilities.

Re-use some of the excavated soil wastes for backfilling while the rest to be disposed-off at designated areas.

Dispose of waste in accordance with the NEMA guidelines.

Noise Hydraulic construction to be used in preference to percussive techniques where practical;

All plant and equipment will be properly maintained and silenced where appropriate and switched off when not in use;

Noisy works to be done during the day.

Local Traffic Obtain agreement with City Engineer for transport routes to and from construction sites;

Ensure traffic control measures are deployed at locations that require the added safety;

Collaboration with the existing NGOs in the area with the local community to alleviate the problem.

The plant has been designed to handle at least 1000 tons of hazardous waste per month. The incineration plant will have also have a waste handling and sorting yard and waste holding point.

IMPORTANT NOTICE TO SUBSCRIBERS TO THE KENYA GAZETTE

THE following notes are for the guidance of persons submitting “copy” for

inclusion in the Kenya Gazette, Supplement, etc.:

(1) The Kenya Gazette contains Notices of a general nature which do not

affect legislation. They are, therefore, submitted to the Government

Printer directly.

(2) Legislative Supplement contains Rules and Regulations which are

issued by the Central Government. Because of this, they must be

submitted to the Government Printer through the office of the

Attorney-General.

(3) Bill Supplement contains Bills which are for introduction in the

National Assembly.

(4) Act Supplement contains Acts passed by the National Assembly.

All “copy” submitted for publication should be prepared on one side of an

A4 sheet no matter how small the Notice is, each page being numbered and

should be typewritten with double spacing. Copy should be clear, legible and

contain no alterations.

Particular attention should be paid to the following points:

(i) Signature must be supported by rubber-stamping or typing the name

of the signatory in capital letters.

(iiust be correct and filled in where necessary.

(iii) Care should be taken to ensure that all headings to Notices and

references to legislation are up to date and conform with the Revised

Edition of the Laws of Kenya.

EXTRACT FROM THE CODE OF REGULATIONS, SECTION D—

Kenya Gazette

“D 34. (1) Communications for the Kenya Gazette should reach the

Government Printer not later than 9 a.m. on Friday of the week before

publication is desired. The Government Printer will not publish communications

received after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the

cost of advertising in it.

It is emphasized that these notes are for guidance only, but it is requested

that persons submitting copy for publication first satisfy themselves that such

copy is complete in every respect.
